Broward County, FL, has dropped all charges against a local Election Integrity advocate whose arrest, described by an election official and other colleagues at the time as "outrageous," was captured on video tape late last year.

Ellen Brodsky, who had been a non-partisan candidate for Supervisor of Elections in last November's election, was arrested at the apparent behest of the office of the county's current Supervisor of Elections --- Brodsky's Democratic opponent in the race --- Dr. Brenda C. Snipes, while trying to view public, post-election counting and canvassing of ballots.

She was charged, at the time, with "disorderly conduct" and "trespassing," forced to spend the night in jail, and not released until nearly 6:00am the next morning, even though her son had posted the required $25 (twenty-five dollar) bail for her by 8:30pm on the evening of her arrest.

The "disorderly conduct" charges were dropped some time later, following the release of a video tape of the incident as posted by The BRAD BLOG in the days following the arrest. The tape, reposted again at the bottom of this article, revealed that Brodsky's conduct had been anything but disorderly when the county police were summoned by Fred Bellis, a deputy election official from Snipes' office, and Brodsky was thrown into handcuffs and hauled away.

While Brodsky's trial on a "trespassing" charge had been set to start today, a last-minute offer to drop all charges, in exchange for admissions by Brodsky that she would not be disruptive in the future, was sent to her last night from Snipes' attorney.

"There was no way I was gonna agree to such demands," Brodsky told The BRAD BLOG today, following the county's dismissal of the court case. "We offered our own compromise," she said. "We will accept a withdraw of all charges, and will, as I've always done, agree to follow Florida law regarding public meetings." It was an oral agreement.

Her attorney, Tanner Andrews, echoed her sentiment. "We agreed to do what we're already doing. We'll obey the law," he explained during a phone call this afternoon. "I could agree not to rob the bank next Sunday and it'd have the same legal effect," he added...

A draft summary of what I see as the most important, most doable, federal election reform priorities for 2009...

Okay, so I've been asked on several occasions, since the election last year, what I regard as the top priorities for election reform in the U.S. of A. In hopes of keeping it simple, stupid, at least until I hear opinions on these back from you folks, here is a summary list of the most important, and most eminently-doable-at-the-federal-level reforms as I see it.

I welcome your thoughts, recommended changes, additions, etc. For the moment, this is not meant as a comprehensive list of all needed reforms, particularly at the various local levels. But it's meant as a list of the big ones, as I seem them, and the ones for which I believe we could actually find a consensus in this Congress sooner rather than later. Nor is this meant as whitepaper with arguments and details for each item. But hopefully most regular readers of The BRAD BLOG will understand what these reforms entail and why they are necessary, as written in this summarized, simple list.

After hearing from you all, I may post an updated version later and/or set these up on their own page, in order track legislation for each of them as they roll (or don't) through Congress. Here's the list...

According to Media Matters, 'liberal', 'Obama-loving' MSNBC has now shown the following misleading graphic at least twice to support stories suggesting that Barack Obama is somehow responsible for the alarming drop in the Dow-Jones industrial average...

And here is the graphic they are not showing, making it quite clear that the plummet has little to do with Obama's Presidency...

The "Liberal Media" strikes again!

(For the record, Media Matters also notes that it's not just "liberal" MSNBC, of course. The wingnut propagandists at Bloomberg and WSJ, along with Fox "News'" Chris Wallace, are also banging the same misinformative drum. So, naturally, MSNBC finds it necessary to not miss a beat.)

In the Minnesota Independent's coverage of former Sen. Norm Coleman's latest push for a "do-over" election, they also point to our recent coverage of GOP chair Michael Steele's obnoxious and absurd fund raising email to GOP members:

Actually it’s surprising Republicans would even consider letting Franken off with a simple do-over when they’ve got the goods on him. According to a Monday fund-raising letter from RNC Chair Steele, Franken is “stealing Norm Coleman’s U.S. Senate seat in Minnesota.”

Well, that's a good point, isn't it? With Steele, the Republican Senatorial Campaign Committee, the Republican National Lawyer's Association, and all of their affiliated wingnuts claiming over and over that Franken is "stealing" the election (as we detailed and linked in our report), why aren't the Republicanists calling for criminal charges to be brought against him?

It does seem rather gracious of them to allow Franken to compete in a "do-over" for a U.S. Senate seat which they claim to have evidence of him trying to "steal" in the first place, no?

Are the wingnuts just nice that way? Or are they just full of shit? Hmmm, tough call.

(BTW, with all of those charges by the Republicanists, before the election, of ACORN committing massive "voter fraud," shouldn't Coleman and the Republicanists have brought forward their evidence for that during this important election contest trial, since they seem to have lost by only about 250 votes? Especially in MN, where ACORN helped to register more than 42,000 new voters prior to last year's election? With all of those fraudulent ACORN voters, and with Coleman's team having gone over every single vote cast with a fine-tooth comb, you'd think the GOP could have offered evidence of at least one case of "voter fraud" committed by ACORN in MN, no? Apparently not.)

'It's a non-issue', source tells The BRAD BLOG, federal law already 'makes it a crime to lie to Congress, regardless of oath'

Given the questions concerning whether or not Karl Rove and Harriet Miers will be required to testify under oath as part of their agreement to give "transcribed depositions under penalty of perjury" concerning the U.S. Attorney purge scandal, as announced yesterday by House Judiciary chairman John Conyers, we thought we'd seek some clarification.

We asked a senior source on the U.S. House Judiciary team whether or not taking an oath before testifying would be required, or whether the agreement requires Rove and Miers not be placed under oath. Writes our source in reply:

NO oath is required for congressional testimony. 18 USC 1001 (copied below) make it a crime to lie to congress, regardless of whether there is an oath. Penalties are the same as traditional perjury, where an oath is given (as in a court of law). There is no difference. When oaths are given in congress, it is generally for the cameras or to remind the witness of his obligations. On the latter point, the same can be accomplished by reminding about a witness's obligations under 18 usc 1001. This is a non issue.

House Judiciary Committee Secures Rove and Miers Testimony in U.S. Attorney Firings

In an agreement reached today between the former Bush Administration and Congressman John Conyers, Jr. (D-Mich.), Chairman of the House Judiciary Committee, Karl Rove and former White House Counsel Harriet Miers will testify before the House Judiciary Committee in transcribed depositions under penalty of perjury. The Committee has also reserved the right to have public testimony from Rove and Miers. It was agreed that invocations of official privileges would be significantly limited.

In addition, if the Committee uncovers information necessitating his testimony, the Committee will also have the right to depose William Kelley, a former White House lawyer who played a role in the U.S. Attorney firings.

The Committee will also receive Bush White House documents relevant to this inquiry. Under the agreement, the landmark ruling by Judge John Bates rejecting key Bush White House claims of executive immunity and privilege will be preserved. If the agreement is breached, the Committee can resume the litigation.

Chairman Conyers issued the following statement:

"I have long said that I would see this matter through to the end and am encouraged that we have finally broken through the Bush Administration's claims of absolute immunity. This is a victory for the separation of powers and congressional oversight. It is also a vindication of the search for truth. I am determined to have it known whether U.S. Attorneys in the Department of Justice were fired for political reasons, and if so, by whom."

A finding by the "highest court" in Germany has found electronic voting to be unconstitutional...

Germany's highest court has ruled that the use of electronic voting in the last general election was unconstitutional.

September's upcoming elections looks set to see a return to the more traditional pencil and paper countrywide.

Constitutional judge Andreas Vosskuhle said that the judgment did not rule out digital voting for once and for all, but added that the equipment used four years ago did have shortcomings.

The use of electronic voting was challenged by a father-and-son team. Political scientist Joachim Wiesner and son, physicist Ulrich Wiesner complained that push button voting was not transparent because the voter could not see what actually happened to his vote inside the computer and was required to place "blind faith" in the technology.

In addition, the two plaintiffs argued that the results were open to manipulation.

It took only four years, since e-voting was first deployed widely in Germany, for the country, and its highest court, to find that secret vote counting was unacceptable in a democracy, while the political-structure, media-structure and judicial-structure in the U.S. still remain largely clueless, or otherwise uninterested in either transparency or democracy.

Congratulations are due to our German EI advocacy brethren (as well as those in Holland who figured it out long before Americans did, as well):

German hacker-cum-data-protection group Chaos Computer Club has been spearheading a campaign with the Dutch foundation Wij vertrouwen stemcomputers niet (We don't trust voting computers) to stop the further spread of electronic voting because of fears about the risk of electronic errors and the potential for abuse.

In 2008, the Dutch government decertified the use of existing paperless systems and rejected a proposal to develop a new generation of voting computers.

Hysterical fund raising letter from Michael Steele charges MN's 'Democrat' Senator-elect's apparent victory a 'tragic injustice,' 'outrageous power grab'...

The "one and only true party of the people" hoping to "rebuild...from the grassroots up," according to an email from its new chairman Michael Steele, seems to be having trouble doing anything differently from the old GOP party. At least if the latest fund raising letter from Steele, charging "liberal Democrat comedian Al Franken" as "stealing Norm Coleman's U.S. Senate seat in Minnesota," is any indication.

On the same day that former Senator Coleman rested his so-far failed case in his election contest in St. Paul against apparent Senator-elect Al Franken, the new GOP chair sent a missive to supporters, begging for money, using the same old failed tactics of the RNC of old; namely, lying to supporters about facts, offering specious, unsupported allegations of Democrats "stealing" elections (despite all evidence to the contrary), making liberal use of the word "liberal," and referring to Democratic party members as "Democrat" party members.

Steele's shameless email (posted in full at the end of this article) echoes the RNC's so-far failed conspiracy-theory strategy to "win" the Senate seat, as previously used by the Coleman camp, the Republican Senatorial Campaign Committee (RSCC), the Republican National Lawyer's Association (RNLA), and GOP propagandists from Hannity to Rush to the wingnut blogosphere which dutifully repeat all of their tin-foil hattery, and/or supply it to them in the first place...

Franken team moves to strike Norm's claim of 100 'double-counted ballots' following revelation
UPDATE: Coleman fined by judges...

On Day 1 of the Coleman/Franken U.S. Senate election contest in Minnesota, the Coleman team was busted doctoring evidence.

Earlier this week, the Coleman camp was busted having withheld notes from Franken's team, and today, the end of Week 5, "all hell just broke loose in the Minnesota courtroom," according to TPM's Eric Kleefeld, when it was revealed that Coleman's team has also been hiding a witness, as revealed by secret email!

"Al Franken's lawyers [caught] Team Coleman in the act of yet more concealing of evidence --- and they've now made a motion to totally strike the Coleman camp's claims about double-counting of ballots, which the Coleman camp has hoped to use to subtract over 100 votes from Franken's lead."

Add to that what attorney Ernest Canning guest blogged here last week, explaining how Coleman's attorneys need to be sanctioned for having moved to un-count 933 ballots they'd previously signed a stipulation for, agreeing they were legitimately added to the total.

Just imagine what this case would look like by now, had Franken --- or any Democrat, anywhere, anytime --- been busted doing any of those things in regard to an election or an election contest.

UPDATE 3/3/09: Coleman fined for the incident. Slap on wrist includes stern warning that case could be dismissed if it happens again, according to the Star-Tribune:

One of the more contentious episodes in the trial so far ended Monday when the judges slapped Coleman with a $7,500 fine for failing to disclose a document from a Republican election judge who claimed votes were double-counted in Minneapolis. But they allowed her testimony to become evidence.

"In the event this sanction fails to deter future conduct on the part of [Coleman's] counsel, the court will not hesitate to impose harsher sanctions, up to and including dismissal [of the case]," the judges wrote.

From BlackBoxVoting.org's Bev Harris, on the section of the new Election Reform bill being proposed in the U.S. House by Rep. Rush Holt (D-NJ), which would federally institutionalize secret software for vote counting, and the requirement of non-disclosure agreements for those who are lucky enough to be allowed permission to examine it...

I've been engaged in debate in private listservs on the so-called "new" Holt Bill, which is basically exactly the same as the old Holt Bill, and every bit as much a danger to our liberty as the other Holt Bill.

In fact, clause for clause, it's pretty much the same. Now, one wonders, in a new administration and with new political realities, why would one put forth a bill that supports secret vote counting?

The Holt Bill, like the persistent reappearance of Internet Voting proposals, reminds me very much of the process corporations followed in the late 1800s while grabbing "corporate personhood." They kept coming back to the well, year after year, defeat after defeat, until one year, someone fell asleep at the wheel and corporations grabbed the "right" to personhood.

What we are seeing in elections today is the surreptitious dismantling of self-government. Heck, if corporations can be persons, why not just choose our decisionmakers and in fact, just vote for us?

Well, we wouldn't allow that, because we'd know that is actually just slavery, giving up our inalienable right to self-government. So it must be done surreptitiously.

Last week, we analyzed the latest draft version [PDF] of Holt's soon-to-be-introduced "Voter Confidence and Increased Accessibility Act" bill in depth. We detailed the dangers of its provisions allowing for secret software --- which even he and his office admit have been included in the bill because Capitol Hill lobbyists from "the proprietary software industry...won" the battle over full software and hardware disclosure --- along with Holt's continued insistence on allowing for the use of unreliable, unverifiable touch-screen voting devices.
