On this week's KPFK/Pacifica Radio BradCast, it was great to be joined again by former FBI Special Agent, 9/11 whistleblower, TIME's 2002 Person of the Year (and even BRAD BLOG guest blogger) Coleen Rowley.

Rowley filed an op-ed in the New York Times this week with 15 questions for U.S. Senators to ask FBI Director nominee James Comey before deciding to confirm him. Naturally, they asked almost none of them during his oversight hearing on Tuesday, choosing to laud him, for the most part, for his willingness to stand up to Bush and Cheney, one very famous night in 2004, while ignoring the fact that, as the ACLU's Laura Murphy describes it: "Comey...also approved or defended some of the worst abuses of the Bush administration during his time as deputy attorney general. Those included torture, warrantless wiretapping, and indefinite detention."

As a 24-year FBI veteran, suffice to say, Rowley did not seem impressed with Comey's often contradictory answers --- particularly on mass surveillance and torture --- in the few instances that he was asked tough questions by the Committee. Her insight here is important and very helpful, particularly as the hearing was, incredibly, almost completely ignored by the corporate media entirely.

We also discussed Edward Snowden and the award that her group, Sam Adams Associates for Integrity in Intelligence, an organization of former national security officials, honored the NSA whistleblower with this week, "praising his decision to reveal the extent of U.S. government electronic surveillance of people in the United States and around the world."

After Rowley, we covered the still non-existent "Zombie Voters" in South Carolina; the woman hauled away by cops during her testimony for offering her opinions on the radical anti-abortion bill in the Texas legislature; the student journalists who held NSA recruiters feet to the fire at the University of Wisconsin; and, of course, Desi Doyen joined us for the latest Green News Report. Along the lines of citizens speaking up for themselves, as we heard in the audio posted earlier today of University of Wisconsin students peppering NSA recruiters on campus with some very tough questions...Here's a woman who was offering her thoughts to a Texas state legislative committee yesterday about their radical new anti-abortion bill they are trying to slam down Democrats' and citizens' throats.

The woman's comments, apparently, became no longer to the liking of the committee chair at some point, and so she was ordered hauled away by the cops.

If they had to take such extreme measures to avoid hearing this woman offer her opinion for a couple of minutes, after she waited her turn in line to do so, as per the rules, I guess she must be worth listening to. So, here ya go...

Good thing she wasn't a "Tea Partier". We'd be at war by now.

[H]ave you seen this Guardian article yet that provides a recording of University of Wisconsin students taking their campus NSA recruiters to school?

I couldn't be more proud of how calmly and logically they destroyed every argument the recruiters put forth.

No, we hadn't! But we have now. And it's great listening. Always enjoy citizens smartly challenging authority, even if we actually do feel a bit sorry for the NSA recruiters here. The lousy government policies aren't their fault. Still, it's as close as most Americans are likely to get to trying to see some accountability from "the NSA", and it's great to hear folks standing up, asking tough questions and trying to demand accountability in any way they can.

The Guardian's headline for their coverage is "NSA recruitment drive goes horribly wrong". We'd say it went great!

Surprise! Despite Republican and Fox 'News' claims of 900+ 'zombie voters', there were actually zero...

At the beginning of 2012, the Executive Director of the South Carolina State Election Commission demolished the claim, put forward by the state's Republican Attorney General, that some 953 votes in the state had been cast in recent elections by "dead people".

They hadn't, of course, and the claim was little more than a transparent ruse to try and "stuff the ballot boxes" in support of polling place Photo ID restrictions meant to disenfranchise largely minority, poor, elderly and student (read: Democratic-leaning) voters.

Unsatisfied with actual facts and stuff at the time, state Republicans tasked the State's Law Enforcement Division (SLED) with investigating the matter and, what do you know --- despite claims happily aired by Fox "News" from every Republican in the state, from the Governor to the AG to the party apparatchik last year --- it turns out zombie voters are still not voting in SC, no matter how many times the pretend claims are investigated.

After an 18-month probe, just before last week's holiday, when few suckers, chumps, pawns, stooges, Republican Fox "News" viewers might notice, SLED quietly issued a report recommending no further action, and closed its investigation into the completely bogus claims after concluding none of the accusations were true --- as MSNBC's Al Sharpton was kind enough to highlight...


There once was a day when the Republican Party actually fought for legislation concerning actual, real things, right? I seem to recall such a day, though it seems so long ago now...

"Pentagon Papers" whistleblower Daniel Ellsberg wrote an op-ed in Sunday's Washington Post explaining why he believes that NSA whistleblower Edward Snowden made the right decision in fleeing the country, rather than staying here and facing charges for leaking classified NSA documents about massive government surveillance programs that he believes to be illegal and/or unconstitutional.

"The country I stayed in was a different America, a long time ago," writes Ellsberg, alluding to his own decision to stay in the country to face charges of espionage (which were eventually tossed out) in 1971 after he leaked thousands of pages of classified Defense Department documents to the New York Times and other media outlets about the purposely deceptive origins of the Vietnam War and lies told by American Presidents to support those deceptions.

"When I surrendered to arrest in Boston," he writes, "having given out my last copies of the papers the night before, I was released on personal recognizance bond the same day."

"For the whole two years I was under indictment, I was free to speak to the media and at rallies and public lectures. I was, after all, part of a movement against an ongoing war. Helping to end that war was my preeminent concern. I couldn't have done that abroad, and leaving the country never entered my mind," he explains.

In the op-ed, the iconic 70's whistleblower goes on to echo several of the points he had previously made during my interview with him in mid-June, just days after Snowden outed himself as the leaker from an undisclosed location in Hong Kong: "There is no chance that experience could be reproduced today, let alone that a trial could be terminated by the revelation of White House actions against a defendant that were clearly criminal in Richard Nixon's era --- and figured in his resignation in the face of impeachment --- but are today all regarded as legal (including an attempt to 'incapacitate me totally')."

"I hope Snowden's revelations will spark a movement to rescue our democracy, but he could not be part of that movement had he stayed here," write Ellsberg, adding that there is "close to no chance that, had he not left the country, he would have been granted bail. Instead, he would be in a prison cell like Bradley Manning, incommunicado."

After Snowden outed himself, Josh Marshall of Talking Points Memo had expressed a thoughtful skepticism of Snowden and his motivations in this affair, though Ellsberg dismissed Marshall's musings as "stupid and mistaken" when I asked him about the comments directly during my interview.

Today, Marshall says, he's "kinda curious" about what Ellsberg meant in his op-ed remark that "The country I stayed in was a different America, a long time ago"...

I was honored recently to sit down with my friend, the great Rick Overton, for one of his soon-to-be-infamous Overview with Rick Overton podcasts. (Two, actually, as we went on and on long enough that he decided to break it into two parts.)

Most of you probably know the Emmy-award winning Rick, whether you know it or not. Stephanie Miller Show listeners/viewers will know him from his regular appearances there. Everybody else has probably seen him as an actor or, as I like to call him, the "comedians' comedian", in something or other, whether you realize it or not.

Rick describes his podcasts as "conversations with brilliantly creative people" which "delve into the mechanics of their craft in a fun and engaging hour."

Desperately short of a "brilliantly creative" person for his latest outing, he tracked me down at my Hollywood home recently for what was an informal, often casual, and even sometimes rambling conversation. It was, at times, maddening, challenging, hilarious, insightful and "inciteful". We discussed everything from NSA spying and Obama apologism (in Part I) to great comedians whose influence actually changed our culture, from Lenny Bruce to Andy Kaufman (whom Overton worked with...covertly) to George Carlin to Jon Stewart and beyond.

"In my opinion, you don't need to hedge," Mark Rumold, attorney at the Electronic Frontier Foundation told me.

"There's no question in my mind", he said, that the surveillance programs revealed by former NSA contractor Edward Snowden include both illegalities and unconstitutionalities. They "violate the First and Fourth Amendment of the Constitution" and even "the plain terms of FISA [the Foreign Intelligence Surveillance Act], the law on which the authority is purportedly based, and...other federal statutes."

Rumold was my guest this week on the KPFK/Pacifica Radio BradCast where my hope was to strip away all of the nonsense "controversy" about Snowden and Guardian journalist Glenn Greenwald in order to focus on the actual disclosures, what we know about them, what we don't, and what we know about the lies told by the Administration about them (especially those by Director of National Intelligence James Clapper.)

Also, Rumold discussed the status of his EFF lawsuit attempting to force the secret Foreign Intelligence Surveillance Court (FISC) to release their 2011 finding on the illegalities/unconstitutionalities of one of the very few programs that they actually rejected.

If you are confused about any or all of that, today's show is a great primer on those key points and several more. The BRAD BLOG's legal analyst Ernie Canning described today's BradCast as "fascinating stuff." And though he may be somewhat biased, I --- who am completely objective on these things --- would tend to agree with him.

We also covered the breaking news out of Egypt, as President Mohammed Morsi was forced out of office in a military coup and Al Jazeera English was pulled off the air...live. Seriously, what the hell is wrong with these people?! Via TPM...

SAN FRANCISCO (AP) — Lawyers for the sponsors of California’s same-sex marriage ban have filed an emergency motion asking the U.S. Supreme Court to overrule the federal appeals court that on Friday freed the state to issue marriage licenses to gay couples.

Attorneys with the Arizona-based Alliance Defending Freedom said they submitted the petition on Saturday to Justice Anthony Kennedy, who handles motions dealing with the 9th Circuit Court of Appeals.

Senior Counsel Austin Nimocks says a three-judge 9th Circuit panel acted prematurely and unfairly when it lifted the hold on same-sex marriages it had put in place while a challenge to the ban made its way through the courts.

Nimocks says the Supreme Court’s consideration of the case is not done yet because his clients still have 22 days to ask the justices to reconsider their decision holding that Proposition 8’s backers did not have legal authority to defend the ban.

Once again, in case this is still not clear to opponents of marriage equality: Just because same-sex marriage is now allowed in CA, it is not now, nor will it ever be mandatory here, or anywhere else. So you're cool.

Two additional things strike me in regard to the above, at the moment. 1) The group trying to block gay couples who love each other from marrying each other in California is from Arizona?! 2) Their organization is called "Alliance Defending Freedom"?! Really? Proving once again that irony is not just merely dead, it's really most sincerely dead.

UPDATE: Justice Kennedy, who sided with the Supreme Court majority decision that allowed marriage equality to return to CA this week, rejects the Alliance Hating Freedom's request "with no additional comment", according to AP. But the Prop 8 supporters say they plan to "continue their efforts to halt gay marriage by filing their request with another Supreme Court justice."

On MSNBC's All In Thursday night, Chris Hayes flagged Barbara Starr's Tuesday report at CNN on how, according to unnamed U.S. government intelligence officials who offer some very specific details, terrorists are now, allegedly, changing their habits in the wake of the recent surveillance disclosures by former NSA contractor Edward Snowden.

Hayes cites Starr's reporting in order to point out the hypocrisy in how some leaks, those seemingly meant to make the Pentagon look good, are, apparently, perfectly fine in the eyes of many of the very same people who have otherwise criticized --- and even called for the arrest of --- both Snowden and Guardian journalist Glenn Greenwald, who had the temerity to report on Snowden's leaks.

The point Hayes makes here --- the last one, in particular, about the "vast and growing web of secret government" and our responsibility for "what our government does in our name," as quoted below (along with his full video commentary), is right on the money...

It was another news week from hell on today's KFPK/Pacifica Radio BradCast.

We covered today's Supreme Court rulings on Prop 8 and DOMA with Evan Wolfson, one of the architects of the national marriage equality strategy, from FreedomtoMarry.org.

I had a word or three to say about the Court gutting the Voting Rights Act this week.

I also offered a thought or two on NBC's David Gregory suggesting that journalist Glenn Greenwald "aided and abetted" NSA whistleblower Edward Snowden, and on the jackassery of national embarrassment Rep. Darrell Issa (R-CA) and the collapse of his pretend IRS "scandal". Desi Doyen joined me for the latest Green News Report update on President Obama's landmark climate speech this week.

And somehow we managed to fit in a few phone calls and a thought or two on Wendy Davis' stand in TX late last night and the state Republicans attempt to fraudulently pass a radical anti-abortion bill anyway. As we told you, the IRS 'scandal' was phony from the jump...

If you had read The BRAD BLOG when the Treasury Department's Inspector General's report on the pretend IRS "scandal" came out, you'd already know just about all of this. We tried to tell ya way back then. You see, unlike the rest of the media, it seems, we bothered to actually read that report before reporting on it. For anybody who did the same, the scam should have been pretty clear.

Now we learn that IRS flagged progressive groups for additional targeted scrutiny when applying for tax-exempt status --- just as they did for "Tea Party" groups. But, in the case of progressives, they continued doing so until this month, even after they had stopped flagging "Tea Party"-related groups, according to documents[PDF] released by Democrats on the U.S. House Ways and Means committee on Monday.

That, of course, is why we also described the pretend "scandal", in a subsequent report, as "nearly as phony as the Shirley Sherrod, Van Jones and ACORN 'scandals'".

Not first time there's been blatant fraud in the TX legislature...

Extraordinary. Texas Republican legislators are now, officially, the champions of vote fraud.

After Democratic state Senator Wendy Davis' nearly 13 hour standing filibuster of SB5, a draconian abortion restriction bill supported by the state's Republican Gov. Rick Perry, Republicans decided to throw the rule of law out the window, and hold a roll call vote on the bill after midnight, when the special session was officially over, according to state law.

Nonetheless, Lt. Gov. David Dewhurst fraudulently announced that the bill, which had supposedly passed at 12:01am, had actually passed at 11:59pm the night before, when the state Senate would still have been legally in session. Making matters even worse, the Republicans then went back and changed the official TX Senate web page to reflect their blatant fraud.

According to some quick research by James Carter IV, however, it looks as though TX legislators may be playing with a felony according to the state penal code in their apparent attempt to "knowingly make a false entry in, or false alteration of, a governmental record".

It's hardly the first time there's been massive vote fraud inside the Texas Statehouse, even as the Republicans there have been attempting, for years, to enact draconian polling place Photo ID restrictions for everyone else, under the fraudulent guise of combating "voter fraud".
