Sen. Lindsey Graham (R-SC): "My hope is that our Democratic colleagues - if you start listening to the bloggers - if we're going to let the bloggers run the country, then the country's best days are behind us."

Out of touch much, Senator? We suspect if the bloggers actually did run the country, we'd be much better off (if only because you'd be out of office.)

But perhaps Graham is confusing responsible, educated "bloggers" with the right-wingnut "bloggers" he's likely more familiar with. For example, here's the very popular (on the Right) Dijon deranged wingnut "Gateway Pundit," Jim Hoft, with his insightful perspective on the important news of the day yesterday:

They're just two ordinary metrosexual guys going out for a burger ... Obama and Biden, two ordinary guys, go out for a sandwich and Obama asks for Dijon mustard at Joe's Hell Burger. ...I hear it's delish with arugula lettuce. Yum-Yum.

If that's who you meant by "bloggers," Senator --- and we're ashamed that Hoft represents our former hometown of St. Louis, MO --- we might agree with you.

Governor: 'Civil union is not equal to civil marriage'...
By Brad Friedman on 5/6/2009 11:09am PT

Yet another state backs the conservative, Constitutional principle of equal protection under the law for all, as Maine's Gov. John Baldacci signs the legislature's newly approved bill, allowing for marriage equality in the state.

Said Baldacci upon signing:

In the past, I opposed gay marriage while supporting the idea of civil unions. I have come to believe that this is a question of fairness and of equal protection under the law, and that a civil union is not equal to civil marriage.

Maine's recognition of equal justice for all, follows Vermont whose legislature last month over-rode a gubernatorial veto to pass a marriage equality law. Prior to that, same sex marriages were recognized as Constitutionally protected by Supreme Courts in Iowa, Massachusetts, Connecticut and California. In all of the state Supreme Court decisions, it was a Republican-appointee who wrote the majority opinion.

California's court finding has since been overturned by Prop 8, the constitutionality of which is currently being challenged. For the moment then, five states in the union now protect the right of same sex couples to enjoy the same rights that couples of opposite sexes enjoy.

'It's hard not to believe there was something deliberate about it'...
By Brad Friedman on 5/2/2009 12:04pm PT

A few developments this week in the case of Mike Connell, the GOP IT guru who died in a single-engine plane craft last December, just after being forced to testify in a long-standing OH 2004 voting rights case, but before the case could come to trial. As The BRAD BLOG has long covered both the lawsuit, and Connell's central role, I wanted to make sure the new developments were noted here. Forgive my quick copy and paste, necessarily, given the circumstances of the week which still have me otherwise distracted in many ways. Background links on the entire Connell story are included at the end of this item...

First via RAW:

The sisters of Michael Connell, a GOP IT consultant and former associate of Karl Rove who died in a plane crash last December, are now questioning the circumstances surrounding his death.

"Shannon Connell of Madison says her brother Michael rarely talked about work," a local Wisconsin paper reported Thursday. "She knew he ran an Ohio company called New Media Communications that set up websites for Republicans including former President George H.W. Bush and Florida Gov. Jeb Bush. But it wasn't until after he died last December, when the small plane he was piloting crashed, that she learned via the Internet of his tie to a voter fraud case and to allegations that presidential adviser Karl Rove had made threats against him.

"'At first, it was really hard for me to believe Mike was dead because somebody wanted him dead," the paper quoted Shannon as saying. "But as time goes on, it's hard for me not to believe there was something deliberate about it."

"A native of Illinois, Shannon moved to Madison in 2002," the paper adds, "the same year as her sister, Mary Jo Walker. Walker, a former Dane County Humane Society employee, has similar concerns about their brother's death: 'It doesn't seem right to me at all.'"

There were a few other notable tidbits from Bill Lueders' original report in Wisconsin's The Daily Page...

From Project Vote:

On the eve of the Presidential election, facing an historic defeat, the Republican National Committee quietly filed a motion to dissolve an existing consent decree in which they'd agreed not to engage in voter caging or other types of voter intimidation. Since 1982, the RNC has been restricted from conducting so-called "ballot-security" measures that have historically been used to deter thousands of Americans"”largely low-income and minority citizens"”from voting. Now, the RNC wants to be free of these restrictions. A hearing on the RNC motion is scheduled for next Tuesday in the U.S. District Court for New Jersey.

The case began in the early 1980s when the Democratic National Committee sued the RNC for voter suppression tactics that targeted about 45,000 people in low-income and minority areas. The RNC subjected minority voters in New Jersey to misleading election notices, the intimidating placement of off-duty police around polling places, and the unlawful practice of "voter caging" whereby unfounded voter challenge lists are compiled from returned mass direct mailings.

The case, DNC v. RNC, resulted in a 1982 decree in which the RNC agreed not to engage in voter caging and intimidation activities or to target minority voters.

Despite the consent decree, the RNC began using similar tricks in Louisiana in 1986. Under the guise of fraud prevention, the RNC facilitated voter caging programs and other tactics. Commenting on the program, Kris Wolfe, the Midwest RNC political director, sent a memo to Lanny Griffith, the Southern RNC political director, saying "I would guess this program will eliminate at least 60,000 to 80,000 folks from the rolls"¦If it's a close race"¦this could keep the black vote down considerably." The DNC filed a contempt motion to reopen the case and enjoin the RNC from conducting the Louisiana programs. Once again, the RNC voluntarily agreed to a consent decree rather than fight the claims in court. The result was a 1986 decree [PDF] in which the RNC agreed not to do any ballot security programs anywhere in the country without prior court approval.

More than 20 years later, on November 3, 2008, the RNC moved to terminate the 1982 and 1986 consent decrees. The RNC claims the consent decrees hamstring their efforts to combat voter fraud, despite the fact that voter fraud is less common than death by lightning.

Well, they got the Supreme Court. Now's as good a time as any to get "official" permission to suppress the vote again. Beats winning by actually getting more votes than the other guys, I guess.

Update: Pulitzer Prize Winner: Bush must have been 'Just kidding'...
By Brad Friedman on 4/28/2009 3:05pm PT

George W. Bush just before the invastion of Iraq:

War crimes will be prosecuted, war criminals will be punished and it will be no defense to say, "I was just following orders."

And let's also not forget what Saint Ronnie similarly said on these matters. Seems to me the Republicans themselves have made a very compelling case for prosecuting war criminals, such as George W. Bush.

Father, grandfather, husband, veteran, patriot, co-director of VotersUnite.org, democracy advocate, blogger, friend...
By Brad Friedman on 4/27/2009 12:29pm PT

Update 4/27, 11:54pm PT...

"I will choose to celebrate his life."
- Ellen Theisen, John Gideon's co-director at VotersUnite.org on his passing.

It was a very lonely time for advocates of democracy in the U.S. when John Gideon posted his first guest blog here in the dark days of October 2005, and when we began to carry his vital "Daily Voting News" on Election Day, one month later, in November of that same year.

While the fight for democracy in this country has become somewhat less lonely as the Election Integrity movement has grown since then, thanks in no small part to the tireless, daily contributions of John, it feels very lonely again today. My good friend passed away this evening in a Seattle hospital, having succumbed to a surprise and sudden bout with bacterial meningitis.

John held on as long as he could, but tonight he'll rest with his beloved wife who passed some years ago.

He was 62, and a Vietnam veteran who never stopped fighting for his fellow veterans and in service of our country. He is survived by his son Rick and grandson, and a life-long legacy of fighting in defense of his nation, and for all that it stands for. He has left that legacy behind as a gift --- and challenge --- for us all.

John's always-understated "Daily Voting News" --- which he filed, often seven days a week, for well over five years --- provided simple links to news of election reform, failure and success from around the nation, as culled from papers, blogs, press releases and official and academic reports around the country, and even the world. In so doing, he connected the seemingly disparate dots of local stories, and apparently anecdotal woes, into a cohesive tale of a nation struggling to regain footing on the pedestal on which it had once, and still hoped to stand.

The compelling narrative the DVN slyly wove together daily --- almost, as if in slow-motion, with each passing day --- was clear: We were, and are, a country whose promise of public, transparent democracy threatens to slip away forever beneath a cynical and foolish crush of ill-considered corporatism and greed, self-imposed expediency and often well-meaning, yet destructive naivete. In short: Unless we take care --- every single day --- what's left of our democracy will further wither to the whims of cold, disinterested privatization no longer resembling the self-governance our founders envisioned, and that we have convinced ourselves still remains.

If there is anything we can give back to the man, in thanks for his selfless service, over so many decades, on so many fronts, it is to continue to carry the torch of the man who fought for democracy until he had nothing more he could give...

There has to be a morning-after pill...
By Brad Friedman on 4/26/2009 10:46pm PT

I was scheduled to be on CNN's new online "Live" format last Thursday, before they knew what the "topic of the day would be". Turned out to be the FDA's approval to allow Plan B, a.k.a "the morning-after pill", to be sold to 17 year-olds after they were ordered by a U.S. District Court to do so. The judge also ordered the FDA to re-evaluate whether all age restrictions should be removed, following a determination that the Bush Administration's FDA had used politics, for years, instead of science, in determining whether Plan B was safe and effective enough to be sold over the counter.

Here's the video from my appearance along with a coupla other bloggers, Rachel Campos Duffy of AOL's parentdish and Gina Cooper from GinaCooper.com (she blogged about her appearance here). No comment on the use of the cutesy "Blogger Bunch" name for the segment, or for the allegation that Brad "leans to the Left" during the intro, even though Rachel, who doesn't "lean", but rather seems to live "on the Right" isn't described as such. But, as I say, no comment on any of that. I look forward to being invited back again soon...

Reagan on torture prosecution, via Andrew Sullivan, from the days before George W. Bush decided how to use signing statements for evil, rather than good...

From his signing statement ratifying the UN Convention on Torture from 1984:

"The United States participated actively and effectively in the negotiation of the Convention . It marks a significant step in the development during this century of international measures against torture and other inhuman treatment or punishment. Ratification of the Convention by the United States will clearly express United States opposition to torture, an abhorrent practice unfortunately still prevalent in the world today.

The core provisions of the Convention establish a regime for international cooperation in the criminal prosecution of torturers relying on so-called 'universal jurisdiction.' Each State Party is required either to prosecute torturers who are found in its territory or to extradite them to other countries for prosecution."

My italics. Reagan was admant [sic] about prosecuting torture, but also prosecuting inhuman treatment that some might claim was not full-on torture. Now go read National Review or The Weekly Standard. And look what has happened to conservatism in America.

Reagan was, of course, part of the Blame-America-First crowd. Soft on terror. Friend of the evil-doers. Why did Ronald Reagan hate America?

By Brad Friedman on 4/24/2009 1:16pm PT

Hope? David Swanson reported last night that the AG "made [him] a promise":

As Attorney General Eric Holder left an appropriations subcommittee hearing on Thursday I spoke loudly from the third row as he prepared to leave the room:

"We need a special prosecutor for torture, Mr. Attorney General. Americans like the rule of law. The rule of law for everybody."

He replied as he approached and walked by, surrounded by bodyguards:

"And you will be proud of your country."

I was joined by others in replying simultaneously:

"Yes, we want to be proud of our country. We're ready. No need to wait."

Holder knew exactly what it would take for me to be proud of my country, and he told me directly that I would be.

Will I? Time will tell.

UPDATE 7/11/09: NEWSWEEK reports that Holder "may be on the verge of" and "leaning toward appointing" a prosecutor to investigate Bush/Cheney-era torture. Their story notes that his initial deliberations on this matter seem to have coincided with his comments as noted above. Details on all now here...

Fox 'News' host goes ballistic. Thank you...
By Brad Friedman on 4/23/2009 2:38pm PT

Shepard Smith's days at Fox "News" may have to be numbered at this point. Even the filthy Judith Miller, for Chrissakes, is joining him in being appalled by the torture memos.

"If there was torture, there was a crime. If there was a crime, there were criminals who ordered the torture," he says to the reprehensible apologist Clifford May before he and Miller both concur that these "horrendous techniques are illegal"...

But later, Smith completely blows his stack on Fox's online-only show The Strategy Room, pounding on the table and SHOUTING: "We are America! I don't give a rat's ass if it helps! We are America! We do not fucking torture!!!":
