On today's BradCast: Our long 'Digby' drought is finally over! [Audio link to show follows below.]

But, first up today, an update on the ongoing counting from (and fights over) last week's incredibly close GOP gubernatorial primary in Kansas between Sec. of State Kris Kobach and Gov. Jeff Colyer, who is accusing Kobach's deputy of giving incorrect instructions to counties regarding the counting of provisional ballots. Some 9,000 provisionals are now being processed as Kobach leads the current unofficial count by just over 100 votes out of some 311,000 cast last week. The latest battle is over whether provisional ballots cast by unaffiliated voters who did not officially declare a party affiliation at the polls (because poll workers failed to instruct them to do so) should be included in the tallies. Colyer's office argues yes. Kobach's deputy --- who is overseeing the post-election canvas following Kobach's recusal --- says no. We explain both positions.

Meanwhile, in neighboring Missouri last week, Republican voters in Clay County appear to have elected a huge Hitler fan, by a very large margin, as their nominee for the state House of Representatives. Earlier this year a former member of the American Nazi party won the GOP nomination for the U.S. House of Representatives in a Congressional district outside of Chicago.

Then, as the defense rested Tuesday without bringing forward any evidence or witnesses in the first of two federal indictments against former Trump Campaign chairman Paul Manafort, we're joined by HEATHER DIGBY PARTON of both Salon and Hullabaloo, to catch up on a number of stories boiling over from within the Trump Scandal Swamp.

Most notably, she explains her recent spot-on observation that the Whitewater scandals during the Clinton Presidency, rather than Nixon's Watergate scandal, may offer "a better window into the current behavior of the Republican Party" when it comes to their denial of and outrageously partisan attacks on Special Counsel Robert Mueller's investigation into alleged Team Trump/Russia coordination in the 2016 Presidential election.

After drawing apt comparisons to Watergate (and there are plenty), Parton moves to Ken Starr's Whitewater investigation. "What the Republicans did in that era --- it was kind of the beginning of this 'scorched earth' partisanship that we see today. They brought all hands on deck to go after Bill Clinton, starting in 1992," she says. After which, "they started to use this scandal-mongering as a political weapon. This became their weapon of choice."

Thus, she concludes, "that's how they're viewing the Russia scandal. They are portraying it to their people as a partisan weapon, that 'They're using all of this to damage Trump, there's no substance to it!' In their view, they can convince their people that this is how scandals work because that's what they do" in their own so-called investigations, which really are, more often than not, the "witch hunts" that Trump and Congressional Republicans characterize the probe by Mueller (a lifelong Republican) to be.

While we're in the swamp, we also discuss the Manafort case, Trump's Dept. of Justice firing of senior FBI counter-intelligence official Peter Strzok (who oversaw the beginning of the Trump/Russia investigation in 2016) on Monday, and the importance (or lack thereof) regarding sensational new allegations being made by fired White House staffer and former TV reality star Omarosa Manigault Newman this week, in conjunction with the release of her new tell-all book.

Finally, we're joined by Desi Doyen for our latest Green News Report in which, among other things, we discuss more record heat and fires threatening national parks and forests, the Trump Administration's efforts to use those disasters to cripple the Endangered Species Act and help out the logging and farming industries, and Interior Secretary Ryan Zinke's on-tape charge that "environmental terrorist groups" are to blame for massive record wildfires currently engulfing large areas of the West...

It's yet another wild ride on today's BradCast! Climb aboard and buckle up! [Audio link to show is posted below.]

First up, the saga of Kansas' wildly close primary election for the GOP gubernatorial nomination between current Gov. Jeff Colyer and the oft-disgraced Sec. of State Kris Kobach grows more acrimonious by the hour. The fight over Kobach's refusal then agreement to recuse himself from the counting and canvassing process now includes Colyer charging Kobach is giving counties advice on counting provisional and mail-in ballots that is "inconsistent with Kansas law" and that Colyer's new "voter integrity" hotline has received hundreds of calls, including claims that voters were "turned away" from the polls on Tuesday and had trouble finding Colyer's name on the ballot. (The latter complaint, as I explain, could be a result of new ES&S ExpressVote touchscreen voting machines now used in several KS counties. Those machines, in crowded races, fail to show all candidates on a single screen, requiring the voter to hit a "More" button.) A recount and/or litigation between the two Republicans may lie ahead, in what couldn't be a better result for Democrats if they'd designed it themselves.

Then, a followup on the Trump EPA's recent announcement that they intend to bring asbestos back and about the Russian company which mines and sells most of the world's supply of the deadly mineral. The firm, according to their own Facebook page recently, is now actually stamping Donald Trump's face on their packaging!

Next, we're joined by the L.A. Times' Pulitzer Prize-winning journalist MICHAEL HILTZIK to discuss the real story behind Trump's recent tweets on California's ongoing record wildfires and the President's bizarre suggestion that the out-of-control blazes are due to "bad environmental laws" and mismanagement of the state's water system. He claims the firses are happening because California allows water to be "foolishly diverted into the Pacific Ocean". While none of those things are actually anywhere close to the truth or the reason for the global warming-fueled fires, Hiltzik explains how Trump's misinformed claims actually appear part of an effort by the Interior and Commerce Departments to exploit the ongoing catastrophes as a way to strip away the state's control of its own water system and, believe it or not, as a pretext for Interior Secretary Ryan Zinke's hopes of hollowing out the Endangered Species Act.

Hiltzik describes Trump as the "Drought Denier in Chief" while explaining that the state of California has said they have plenty of water to fight the fires. "The diversion of water" in the state is not to the ocean, as Trump charges, but "for growers in the Central Valley of California who live in one of the very few Republican zones in the state and are basically supported by the very few Republican office-holders we have in Congress."

"Under federal law," he explains, "water has to be kept flowing through a lot of our rivers so that fish, and fishermen, and fisheries are supported, and we don't let those species go extinct. And when I say 'going extinct', it's not only fish at risk of going extinct but, as I've reported, there are salmon fishermen on the coast whose livelihoods are at risk of going extinct because the salmon are being stressed by federal policies that don't allow enough water to flow down the rivers they use."

"So growers have been on the warpath, saying 'Oh, we're not getting water, we're drying up because of these biological opinions that say the fish need the water'. These are biological opinions that were issued in accordance with the federal Endangered Species Act. So, Trump has been out for the ESA since the get-go."

But why do Trump and the Republicans favor the farming industry over the state's billion dollar fishing industry? Hiltzik explains that and much more, as the Administration ups their efforts to avoid letting a good catastrophe go to waste.

Finally, some good news for voters in North Carolina, where a federal court has blocked the state from purging voters without notice or in the 90 days before an election; A jury verdict out of San Francisco awards $290 million to a school groundskeeper after finding Monsanto liable for his terminal cancer tied to the use of their toxic weed killer RoundUp; And we close out with Jimmy Kimmel's clever idea for trying to convince Trump to give a damn about our ever-worsening climate crisis...

On today's BradCast: It's kind of amazing that Trump's wildly corrupt Interior Dept. Secretary Ryan Zinke is still in office. Now that the EPA's Scott Pruitt is gone, and Interior just accidentally released a whole bunch of revealing information, maybe Zinke is a bit closer to the exit door. [Audio link to show follows below.]

But first up today, results from Tennessee's primary elections on Thursday, and the outlook for November in the key U.S. Senate race to replace the state's outgoing Republican Sen. Bob Corker. Popular former Democratic Governor Phil Bredesen is now set to face off against the very Trumpy GOP nominee Rep. Marsha Blackburn in a race is central to Democrats' chances of winning back a majority in the upper chamber of Congress in this year's midterms.

Following up our preview yesterday of next week's important U.S. House Special Election in Ohio's 12th Congressional District --- where Democratic candidate Danny O'Connor could very well flip that seat from "red" to "blue" on Tuesday --- our stable genius President tweeted out an endorsement yesterday for a Republican who is not even running in the race.

Also today, some encouraging news out of Texas, where the corporate owners and manager of the Arkema Chemical plant near Houston were indicted on Friday, following the "reckless" release of toxins into the air during an explosion at the plant amid Hurricane Harvey flooding last year.

Then, we're joined by AARON WEISS, Media Director of the Center for Western Priorities (and host of its Go West, Young Podcast), to explain the "monumental" screw-up last month when the U.S. Department of Interior accidentally released unredacted documents regarding the agency's deliberations over the unprecedented lifting of federal protections for a huge portion of the Grand Staircase-Escalante monument in Utah.

"We'd always suspected that the outcome was preordained. But this really makes it crystal clear that the fix was in from the beginning," Weiss tells me, detailing the Department's subsequent redactions in the documents, revealing what Zinke's agency hoped the public wouldn't find out. Namely, that priceless archaeological treasures, native American relics, and a huge tourist and recreational industry benefiting the local economies, are now endangered by the unprecedented closure of nearly half of the Grand Staircase and some 85% of Bears Ears monument (also in Utah). The two monuments are the first to be scaled back in response to Donald Trump's executive order calling for the review of some 27 national monuments established by previous Presidents.

Weiss explains the how the screw-up came about in response to Freedom of Information Act (FOIA) requests: "Under the Freedom of Information Act, you're allowed to redact certain things. But then you also have this very broad exception, it's called the 'B-5 deliberative process exemption.' And it's supposed to be so that officials can discuss policy options candidly. But oftentimes we see that B5 redaction being used as what's called the 'because I want to' redaction. And that's exactly what happened here, because they wanted to redact stuff that didn't look good for them, they called that stuff 'deliberative'. even though many of these sections were not discussing policy options, they were just basic facts."

"If you look at what got mistakenly unredacted in just this one document, and think about the tens of thousands of other pages already released and yet to be released, it does raise huge questions about the way they're abusing that B5 deliberative exemption."

He goes on to offer an update on the several legal challenges facing the unprecedented closures by the Trump Administration, and how the unredacted revelations underscore Team Trump's pretty clear aim of aiding their friends in the fossil fuel extraction industry at the expense of all others. Weiss also highlights a newly emerging scandal regarding what appears to be a wildly corrupt development deal in Zinke's hometown of Whitefish, Montana, involving the Secretary, his wife, and the CEO of oil services giant Halliburton.

Finally today, we share a portion of a short video rant unleashed yesterday by Ring of Fire co-host Farron Cousins, regarding concerns about election system security and hacking in the upcoming election. In the clip, he argues that these worries might have been avoided entirely had both Democrats and Republicans listened "to people like Brad Friedman at The BRAD BLOG" who have been warning about these concerns "for more than 14 years". "If we would have listened to them years ago," Cousins argues, "we wouldn't even be having this conversation today." [Fact-check: Mostly true!]

On today's BradCast: Trump's unending White House chaos appears to have morphed into Trump's White House purge of not-insane top officials, beginning with his Tuesday firing of Secretary of State Rex Tillerson, via Tweet. [Audio link follow below.]

At the same time, Trump named rightwing former Congressman and Fox "News" Tea Party flunky turned CIA Director Mike Pompeo as his nominee to take over the role of the nation's top diplomat and Deputy CIA Director Gina Haspel, who oversaw torture at so-called "black site" prisons during the George W. Bush presidency, to take over Pompeo's role as CIA chief.

We're joined today by national security and civil rights journalist MARCY WHEELER of emptywheel.net to discuss all of today's alarming developments. At the center of our conversation, after discussion of why Trump off-loaded Tillerson, is whether Pompeo and Haspel will even be able to make it through the confirmation process in the U.S. Senate at all at this point, and how the entire mess, once again, highlights the shameful failure by Congressional Democrats and former President Barack Obama to demand real accountability for the war criminals at the center of Bush's torture regime.

"When people talk about how we ended up with Donald Trump, this is the problem," Wheeler argues. "We have excused things like torture for so long that it's just created the opportunity for Donald Trump. Yes, those precedents really created the way for him."

Remarkably, as discussed today, even Democratic Sen. Diane Feinstein --- who spent years heroically fighting the U.S. Intelligence agencies to expose their horrific torture practices --- seems prepared to approve Haspel, for some reason, as do the former heads of those agencies --- the very same folks who claim to oppose Trump and object to his response to allegations of Russian meddling in the 2016 election.

On Haspel, Wheeler warns: "She's terrible for two reasons. One is that she's a torturer, and not just a torturer but a particularly sadistic one. But the second one is that she orchestrated both a personal and agency cover-up. And so we should expect, with her as CIA Director, to have the CIA even less in control than it is now." Yes, Haspel also oversaw the CIA's destruction of their videotapes of torture sessions.

Hard to figure out who's more furious about it all, me or Wheeler, after years of warning about precisely this day.

On Pompeo, Wheeler says: "He is much closer to Trump's views on [Russia, North Korea and Iran]. Very importantly, especially on Iran. So I think if Pompeo is confirmed, I think the chances of us going to war with Iran are significantly higher."

And, just to make my day, she warns that, should National Security Advisor H.R. McMaster be replaced, as rumored, his replacement won't even have to struggle with Senate confirmation (a road, which she predicts, may be difficult for both Haspel and Pompeo, though more so for the latter.) If McMaster is replaced by John Bolton, as some have suggested, "he gets appointed, because it's not Senate confirmed. So If Trump wants him, he's in charge of nuking North Korea."

Finally, Desi Doyen joins us for some more thoughts on the removal of Tillerson (ironically enough, even though he previously served as CEO of ExxonMobil, he was decidedly not a climate change denier and actually supported the U.S. staying in the Paris Agreement) and for the latest Green News Report, in which the nation and planet continue to suffer from the perfidy of dishonest Republican climate change denialism...

On today's BradCast: Donald Trump and his Great American Shitshow continues today, though he has now received a very helpful hand from Congressional Democrats, for reasons that may beggar the imagination. [Audio link to show is posted below.]

First up today, a quick word on the allegations regarding $130k in hush money said, by the Wall Street Journal, to have been paid by Donald Trump to a porn star just before the 2016 election, reportedly to hide a sexual liaison during his marriage with the now-First Lady, and on the sordid sex and blackmail scandal now roiling Missouri's new "family values" Republican governor, Eric Greitens. In normal times, of course, both stories would be huge news everywhere and we'd be discussing impeachment and/or resignation of both men. These days, however, each scandal is barely breaking the national news radar.

Then, more encouraging election news for Democrats this week in Tuesday's special elections around the country, with Dems flipping another long-held Republican seat in a deeply "red' area, this time in the Wisconsin State Senate. The results seem to be freaking out the state's controversial GOP Governor Scott Walker in advance of his own re-election contest later this year and signals a possible Dem takeover of the state Senate in advance of 2020 redistricting!

Next, Congress is on the verge of reauthorizing a warrantless mass surveillance program that civil libertarians on the right and left have long opposed and characterize as a blatant violation of the U.S. Constitution's 4th Amendment privacy protections against unwarranted search and seizure. Last week, after Trump made it clear he had no idea what Section 702 of the FISA Amendments Act actually was --- despite his administrations' long time lobbying of Congress to reauthorize and, indeed, expand it, it for another 6 years --- Republicans in the U.S. House passed it with the help of several Democrats (including House Minority Leader Nancy Pelosi).

This week in the U.S. Senate, a bi-partisan group lead by Senators Rand Paul (R-KY) and Ron Wyden (D-OR) fell one vote shy of blocking the measure through a filibuster. So it now appears the legislation will clear both houses and sent to Trump for his signature.

We're joined today by ELIZABETH GOITEIN, former Dept. of Justice attorney, now co-director of the Liberty and National Security Program at NYU's Brennan Center for Justice, to explain Section 702, the efforts to lobby against its reauthorization, and why it is that many Congressional Democrats are willing to join Republicans in granting the Trump Administration's NSA, DHS, FBI, DOJ, CIA, etc., extraordinary new powers to secretly spy on every American citizen's phone calls and emails without warrant, due diligence or even probable cause.

While the legislation was "driven primarily by Republican leadership," she says, there were "enough Tea Party style Republicans who have really rallied in support of greater privacy protections" that some marginal reforms were added. Though, she explains, they aren't really reforms at all, and the entire dangerous package could not have moved forward had Dems stuck together in opposition.

"It's a failure of Democratic leadership," Goitein tells me. "At the last minute, [Senate Minority Leader] Chuck Schumer said he would vote no on cloture [to end the filibuster] --- but he hedged that and said, 'Amendments should be in order and we should have the chance to look at amendments, but the bill itself is not that bad, it makes improvements to the law'. Which is not true. It actually takes the law backwards. Minority Leader Pelosi in the House did even more damage...coming out in support of the bill and opposing the amendment that would have made these improvement. And then a whole bunch of Democrats went along with her."

Goitein argues "there was a full court press by intelligence officials" to pass this measure. So, even Trump's cluelessness about it was unable to prevent it from moving forward, even as it allows for the emails of two American citizens speaking to each other --- with no foreign target in the mix --- to be indexed, searched and read by the FBI without an order from any court. She explains the horrible details in depth on today's show, and why it has been so difficult to challenge this provision in a court of law.

Finally, nearly every member of the bipartisan National Park Service Advisory Board has resigned en masse this week, citing the Interior Department and its Secretary Ryan Zinke's failure to hold any meetings with the board, as required by law, during the entire first year of Trump's Presidency. The Administration's response to the mass resignation today is almost as disturbing, if not more so, than the resignation itself.

Among the stories covered on today's extremely busy program...

  • Late updates on the devastating mud-flows that have, so far, resulted in the deaths of 17 in Southern California's Santa Barbara County, just north of Los Angeles, following a massive rainfall this week in the area just burned by the largest fire in state history;
  • A federal judge has temporarily blocked Donald Trump's attempt to lift the DACA program, which has protected some 800,000 children of immigrants who came here with their parents through no fault of their own;
  • Just days after announcing their intention to open 90% of U.S. coastline to off-shore drilling, Trump's Dept. of Interior chief Ryan Zinke reverses course, but only for the state of Florida, in what appears to be a political (and unlawful) favor to Florida's Governor Rick Scott, who Trump is supporting in a run for the U.S. Senate;

In election and voting news today...

  • Just minutes before Virginia's House of Delegates convened its new legislative session today, Democrat Shelly Simonds conceded her 94th District race against Republican David Yancey without seeking the second "recount" she is entitled to by state law. The first "recount" resulted in a declared "tie" vote and a random drawing, following a very questionable ballot [JPG] counted for the Republican after the initial "recount" had handed the victory to Simonds by a single vote. (She could still ask for a recount as late as the 17th, if she and the Democratic Party wise up and changes their minds. Republicans absolutely would have demanded such a count had the random drawing gone the other way. They would also have prevented her from being seated until that count was completed. Moreover, I share some disturbing comments from a conversation about all of this with the Voter Registrar who oversaw the election in Newport News, VA.)
  • In the 28th District race for Virginia's House, an appeals court denied the Democrats emergency motion for a new election today, after the Republican was declared the winner by 73 votes even though 147 voters were given the wrong ballot on Election Day last November. (With both of those Dems out, the GOP majority in the VA House has shrunk from 66-34 last session, to just 51-49 as of today, despite Democrats winning 55% of the vote statewide in the Republican gerrymandered state);
  • In North Carolina, a federal court panel issued a landmark and blistering ruling on Tuesday night, finding state Republicans had blatantly gerrymandered the swing-state's U.S. House Districts on a partisan bases to ensure a 10 to 3 majority for themselves, in what the panel found to be a violation of the Constitution's Equal Protection Clause. The court ordered new Congressional maps to be drawn up immediately, in the next two weeks, in time for the 2018 primaries. But Republicans vow to appeal the ruling to the U.S. Supreme Court, which is currently deciding a separate but very similar case on partisan gerrymandering of state legislative districts by Wisconsin Republicans.
  • And today, a divided (and stolen by the GOP) U.S. Supreme Court heard oral argument in a case challenging Ohio Secretary of State John Husted's scheme to purge voter rolls after voters have gone just two years without voting in a federal election, in what Democrats and voting rights advocates argue is a violation of the National Voter Registration Act (NVRA).

Finally today...

  • Trump's Energy Secretary and former Texas Governor Rick Perry sees his scheme to extend the life of coal and nuclear plants under the false guise of "grid resiliency" go up in smoke after all of the appointees on the Federal Energy Regulatory Commission (FERC), most of whom were appointed by Trump, unanimously reject the plan, which was seen as a payoff to a coal baron benefactor of both Perry and Trump. A former Trump Campaign official, however, sees a far more insidious (and laughable) conspiracy.

On today's BradCast: A last minute ruling by the Alabama Supreme Court, without plaintiffs even present, will allow the state to destroy electronic "ballot images" created by the state's digital computer ballot scanners in Tuesday's special election. Also, was it the fake news or the real news that tipped last year's Presidential election? [Audio link to show follows below.]

In Alabama, computer tabulators determine the intent of voters (either correctly or incorrectly), as cast on hand-marked paper ballots from Tuesday's highly contentious U.S. Senate Special Election between Republican Roy Moore and Democrat Doug Jones. The state Supreme Court, in a late ruling on Monday, issued a stay [PDF] that effectively reversed a lower court order [PDF] on Monday. That order had required all digital scanners in the state to be set to retain all such images created by the system as ballots are scanned through it. The stay now means that only in the exceedingly rare event of a hand "recount" of paper ballots will the public be able to oversee elections results to determine if the computers got it right on Tuesday.

We've been covering this issue for some time. (My original interview last week with election integrity and transparency advocate John Brakey, who helped organize the AL lawsuit is here.) Yesterday, it looked like a win for Brakey and the multi-partisan plaintiffs who filed in court to demand the state's retention of all digital images for inspection by the public, as per federal law requiring all election materials be retained for 22 months. But late on Monday, Secretary of State John Merrill and Alabama's state Election Administrator Ed Packard argued their case [PDF] ex parte (in otherwords, alone, without the plaintiffs there or allowed to respond) and received a favorable ruling from Roy Moore's old colleagues on the court. (Moore was formerly a State Supreme Court Justice, until twice being removed for failing to follow federal court orders.)

I spoke with Brakey and attorney working on the case, Chris Sautter, earlier today, as well as other experts. I've got details on their comments, and from the court documents, on today's show. Essentially, the state argued that state election officials didn't have jurisdiction to order county election officials to turn on the software switch on the scanners to retain all ballot images, and that doing so at the last minute, as the Circuit Court ordered on Monday, would "cause confusion among elections officials and be disruptive to" the election on Tuesday. That, even though the Circuit Court judge found it wouldn't cost the state anything to do so and that failing to turn on the setting that retains the images would lead to irreparable harm to the plaintiffs. Sautter tells me the state did not make the case for last minute confusion during the lower court arguments.

I suspect we'll have much more on that and on other problems reported at the polls today, on tomorrow's BradCast, along with whatever results --- accurate or inaccurate (who knows?) --- that the computers may report by then.

Then, after a flurry of fake news over the weekend during the final run-up to Tuesday's U.S. Senate election in Alabama, we discuss an alarming new study analyzing the effect of both real and fake news during the run-up to last year's Presidential election. Was it so-called fake news and Russian Facebook ads that gave Donald Trump the edge to defeat Hillary Clinton last year? Or, was it a failure by the mainstream corporate media --- the "real news" --- to responsibly cover important issues that the electorate needed before casting their vote? DAVID M. ROTHSCHILD, co-author of the new study published by Columbia Journalism Review, joins us today to discuss their --- at times, remarkable --- findings.

I'd strongly urge you to read their full damning report --- particularly if you are of the mind that fake news and ads said to have come from Russia, turned this election --- because there are too many detailed and troubling findings in it for me to adequately summarize either here or during today's program.

But, to cite just one aspect of my conversation with Rothschild about the report's analysis of 150 front-page articles in the New York Times over the 69 days prior to last year's November election, he tells me: "150 stories. And of that, there were just 10 stories where they actually really touched on a specific policy initiative of either of the candidates, the ideal thing that you would want the 'paper of record' to be supplying to people. The vast majority of stories were miscellaneous campaign stories. Over 50% of them talked about the horse race. Very small percentages, 15% or less, actually talked anything about policy, with even smaller percentages actually talking about the policies themselves. It was all about the horse race, all about the scandals, not about the impact of the election itself on policy, which is ultimately why we have elections and ultimately defines the impact of these elections."

His study notes that in just six days right before the election, "The New York Times ran as many cover stories about Hillary Clinton’s emails as they did about all policy issues combined in the 69 days leading up to the election." That said, ironically enough, as Rothschild notes, even the MSM coverage of the purported scandals was terrible, misleading and inaccurate as well! They, and we, never seem to learn.

After a few news headlines today --- Australia's parliament finally adopts marriage equality; the white Charleston, SC cop who killed unarmed black man Walter Scott receives a 20 year sentence; another school shooting, this time in NM --- we move on to Sen. Al Franken (D-MN)'s announcement today on the floor of the U.S. Senate that he plans to resign "in the coming weeks".

The stunning announcement by the popular and dogged comedian-turned-Senator comes after fellow Democrats this week called for him to step down in the wake of several allegations of sexual misconduct said to have occurred before he became a U.S. Senator. Franken, who has been a champion for women's rights during his time in the Senate, maintains he either doesn't recall the incidents at all or remembers them quite differently than reported. He has described the most recent charge leveled against him this week by an unnamed victim, said to have been a Congressional staffer in 2006, as "preposterous". Nonetheless, while expressing confidence he would have been cleared by the Senate Ethics Committee of any wrongdoing, he says he will now step aside before that probe was even able to begin in earnest.

We share excerpts of Franken's remarks on the floor today, which include, as he notes, "some irony in the fact that I am leaving while a man who has bragged on tape about his history of sexual assault sits in the Oval Office and a man who has repeatedly preyed on young girls campaigns for the Senate [in Alabama] with the full support of his [Republican] party."

So, did Democrats fall for another right-wing trap in pushing Franken out? It wouldn't be the first time. We discuss several such traps --- including one that MSNBC seems to have fallen for this week regarding progressive radio host Sam Seder, before wisely changing course two days later --- with longtime progressive writer and blogger GAIUS PUBLIUS, who wrote earlier this week about Democrats falling, yet again, into the Republicans' "deficit trap" regarding federal spending on military and social programs. We debate why and whether Democrats fall into these rightwing traps or if they willingly choose to walk into them, for some reason.

"Why is it that Democrats seem to be one foot in the Republican camp and afraid to be too much in opposition, and one foot in the Democratic camp and not so fully pro-democratic values as we'd like them to be?," Publius observes as we discuss Franken, the 'deficit trap' and more. "I would argue that it's not fear. We're not dealing with cowards here. We're dealing with people who are, in some sense, compromised by their own values. Their own values are putting them in this position where they can't please anybody."
