Among the stories covered on today's program...

• Huge news today from the CDC! "This is a great day for America," President Joe Biden proclaimed in the Rose Garden, after his mask free meeting with vaccinated Republicans in the Oval. The fully vaccinated may now take off their masks in most places both indoors and out, and end social distancing protocols, according to the CDC's surprise announcement. There are a few caveats, as we discuss, and, of course, even though this weekend marks two weeks since the second COVID shot for Desi and me (and the "fully vaccinated" status that comes with it), we've still got a few reservations.

• Even the friends on Fox and Friends admit they are all vaxxed up now! But even that hasn't kept them from continuing to pump disinformation about vaccines into the veins and brains of their horrifically misinformed viewers.

• The quest continues to get shots into arms of the hesitant --- many of whom not-coincidentally-at-all happen to be Republican male and Fox "News" viewers. Some GOP state Governors are now coming up with clever incentives. West Virginia's Jim Justice is offering $100 savings bonds to residents age 16 to 35 who get their shots. Ohio's Mike DeWine announced on Wednesday that vaxxed up Buckeye Staters will be eligible to win 1 million dollars in a lottery, five weeks in a row! (But why not 10 winners each week of $100,000? We discuss.) In both cases, the payoffs are coming courtesy of the federal government, via Joe Biden and the Democrats' American Rescue Plan, which no Republicans voted for. But it's nice to see Republican Governors enticing their residents with "socialist" cash prizes!

• And then there's Georgia's embarrassing Republican Rep. Marjorie Taylor Greene who "aggressively confronted" New York's Democratic Rep. Alexandria Ocasio-Cortez on Wednesday night in the halls of Congress. She followed her, stalked her, and called her a "terrorist" and a "chicken" for refusing, apparently, to debate her about...whatever. It was some top-notch 5th grade level bullying, but nothing new for the loathsome Greene. Her caucus, apparently, has no problem with her behavior, even as they voted this week to remove Rep. Liz Cheney from her leadership position because she refuses to participate in the Big Lie about a stolen election and believes Donald Trump should be held accountable for inciting an insurrection on the U.S. Capitol.

• And, yes, it was an insurrection, despite the attempts by House GOPers in recent days to pretend that it was not. (Here's some fresh video evidence if you need it.)

• Speaking of accountability (or lack thereof), Politico offers a fascinating scoop today --- for some reason --- regarding extradition statutes in two different states in the event that, for example, someone who is staying at a resort in Palm Beach, Florida or Bedminster, New Jersey finds themselves criminally indicted by a District Attorney from Manhattan within the next few months. Hmmm....

• And, speaking of a bit more accountability --- let's say, at the federal level --- on Wednesday night, the U.S. House Judiciary Committee struck a court-approved deal with the U.S. Dept. of Justice for Donald Trump's White House Counsel Don McGahn to finally answer his 2019 subpoena to testify about his starring role in the 448-page report [PDF] issued by Special Counsel Robert Mueller concerning at least 10 documented instances of apparent criminal obstruction by the disgraced former President. No extradition charges are needed for federal indictments...unless the perp flees the country.

• Finally, Desi Doyen joins us for our latest Green News Report as the Colonial Pipeline restarts after a ransomware attack shut down the nation's largest pipeline network (and, yes, as I asserted in the GNR, we learned later today the company did pay a ransom to the hackers!); as gas hording Americans on the Eastern Seaboard have been panic-buying; as the Biden Administration greenlights the first major offshore wind farm in the U.S.; and as Tesla dumps Bitcoin due to its massive carbon footprint...

On today's BradCast, our lonely fight to save what is left of our public airwaves continues, as mainstream media outlets continue to benefit from --- and therefore do not bother to report on --- the march toward full corporate ownership of what were once our prized and protected airwaves. But first up today, the breaking news on that nation's latest school shooting. Today it was in Knoxville, Tennessee.

Next, the vaccination of the nation continues apace, with about 36% of adult Americans now having received at least one shot. This week, many more states will open eligibility to all adults 16 years of age and older in advance of Joe Biden's national date for doing so in all 50 states next Monday (April 19). Here in Los Angeles, all adult residents will be eligible as of Tuesday. We offer a few tips for how to get an appointment quickly. (Specifically, Kaiser-Permanente appears to have tons of available appointments, for members and non-members alike, via their website at KP.org.)

While vaccinations are proceeding at an impressive pace, hitting another 24-hour record of 4.6 million shots on Saturday, the race to outpace the spread of variants continues. While much of the nation is plateauing in case numbers at high levels or even surging slightly upward, a number of states, particularly in the Northeast and upper Midwest are surging quite steeply. The most disturbing case at the moment, by far, is in Michigan, where its Democratic Governor Gretchen Whitmer has been begging the Biden Administration for a vaccine surge in response to a spike that is as bad there as it was last Fall. For reasons that aren't entirely clear, the Administration has offered additional vaccinators and test kits, but not additional vaccine as of now. The CDC Director said on Monday that what is needed in MI's case is not more vaccine, but lockdowns. However, one of the reasons the state is in such bad shape now is because Trump-incited rightwingers last year not only rebelled against Whitmer's mandatory lockdowns, but even hatched a plot to kidnap her after Trump tweeted to "Liberate Michigan!"

What happens in Michigan, unfortunately, won't stay in Michigan. Their surge will spread elsewhere unless someone figures out how to get it under control. Similarly, what happens in Georgia will absolutely not stay in Georgia, as Republican lawmakers across the country are continuing to push voter suppression measures akin to the suppressive law adopted by Republicans in the Peach State last month.

The corporate pushback against Georgia's anti-voting law and those in other states continues to grow. Over the weekend, 100 corporate executives held a Zoom meeting to discuss how they planned to respond. On Monday, the first major Hollywood production --- Will Smith's "Emancipation" film --- previously set to film in Georgia, announced they were pulling production from the state due to the new law. Other productions could follow suit, given that Georgia has become a bit of a filmmakers Mecca by offering generous tax breaks to Hollywood production teams.

In addition to the group of corporate execs planning their own actions against anti-democracy laws, a group of some 60 law firms is reportedly teaming up to take action as well. That said, it's pathetic that the citizenry has to rely on corporations to become angry enough that Republicans might pay attention to their concerns --- the same concerns that the GOP ignored when they came from the citizenry itself before Georgia adopted its new law. In today's America, the citizenry don't seem to matter. It's corporate dollars to (or withheld from) Republicans that appears to be our only chance of convincing desperate Republicans to block or rollback these onerous restrictions on access to the ballot box. We're happy to see companies jumping in, but its absurd that we need to rely on them to somehow save "democracy".

Speaking of the need to save democracy, we're then joined by media reform activist SUE WILSON of the Media Action Center. Late last year, she and former Republican FCC official Art Belendiuk joined us on the program to discuss actions they were taking to expose the fact that rightwing media behemoth Sinclair Broadcasting appeared to be blatantly violating FCC ownership rules by taking secret ownership of more than one television station in a number of major markets, using sham front companies to skirt federal scrutiny.

At the same time, as Wilson reports today at BradBlog.com, the FCC has been attempting to change its own media ownership rules to allow for more corporate consolidation by granting major broadcasters the right to own more than one TV station in any given market. The FCC's initial attempt to change the rule preventing companies from controlling all of the public airwaves in major markets was blocked by the 3rd Circuit U.S. Court of Appeals, which found that the FCC violated the Administrative Procedures Act in not carrying out proper studies to determine the effects of the rule change on broadcast outlets owned by women and minorities. SCOTUS heard the FCC's appeal in the case on January 19th (Trump's last full day in office). The Court handed down its decision in FCC v. Prometheus Radio Project on April 1, overturning the lower court to allow the FCC's new, relaxed ownership rule, even as Justice Kavanaugh, in his opinion for the unanimous Court, conceded that the record evidence relied on by the FCC was "sparse". But, he held on behalf of the Court, the rules in question, now changed by the FCC, "were no longer necessary to serve the agency's public interest goals."

As Wilson found, however, the reason the record was so sparse was because the FCC had carried out no studies of its own to determine the adverse effect of consolidation on minority owned business before formalizing their new rules. They relied instead on private organizations to present evidence as to why the consolidation would harm minority broadcasters. But private organizations did not have access to much of the FCC's public information, because the federal agency hasn't collected the information from stations around the country.

It all amounts to what Wilson describes as a Catch-22 that ill-serves the public, and further undermines our public airwaves, handing off even more control to corporate interests, rather than we, the people. "This is the worst decision that nobody knows about," Wilson tells me. And, of course, they don't know about it, because mainstream corporate broadcasters benefits from the rule change, so they haven't bothered to mention much about it to any of their listeners or viewers.

Wilson argues that Congress needs to take action, and asks listeners to contact their members of Congress. "We're finding that Republicans and Democrats are very interested in this [because] this is bad for our whole country."

Both Desi and I, as seen in the photo, got our first COVID vaccine shots over the weekend! It was on the same day that a record 4 million Americans also received shots. And it was, in various ways, both revelatory and relieving as discussed on today's BradCast. [Audio link to full show follows summary below.]

There are additional signs today that there is, indeed, light at the end of the COVID tunnel (and that the light is not an oncoming train, as Desiree often warns!), but there are also serious concerns as confirmed infection rates are back on the rise in more than 30 states, including some where it's absolutely spiking in recent weeks.

Overall, cases rose more than 5% in the past week in the U.S., even as testing declined by 13%. We have significantly better news in that the new daily death rate has fallen by some 20% over the past week, but COVID-related hospitalizations are once again on the rise. That's usually followed by an increase in deaths.

Moreover, there have been some very disturbing spikes in cases of younger people becoming hospitalized in recent weeks in several states, as we are now in a race to distribute vaccine quickly enough to avoid allowing for deadlier and more transmissible variants to develop.

As it has been a while, and as I'm in a reasonable good mood after Moderna #1 over the weekend, today seemed a good day to open up the phones to listeners to hear about how their own experiences getting vaccinated --- or trying to --- has been going and how it has gone for them. (I experienced mild fatigue for a day or so. Desi felt pretty much nothing.) And, for those listeners who do not plan to get a vaccine for some reason, we're open to hearing why would be.

On today's BradCast: Even though creepy liars like Donald Trump and Ted Cruz "guaranteed" we'd no longer be talking about "COVID! COVID! COVID!" after Election Day, it turns out they were wrong. Who could have predicted it? And what else are we still talking about after the election? The election! Because Trump is continuing his desperate efforts to try and steal it from the voters and Joe Biden, the candidate they elected. But it would be a mistake to ignore what Trump is trying to do. We think. [Audio link to show is posted below summary.]

Among the many stories covered on today's show, we begin with the pandemic...

• U.S. hits a grim official milestone, with quarter of a million now dead from COVID-19, most of them unnecessarily so, thanks to our deranged President, experts now predict we may see 400,000 fatalities by February. The President of the United States remains in his bunker and has offered no comment;

• The CDC implores Americans to limit travel and gatherings over next week's Thanksgiving holiday;

• As the pandemic surges out of control in all 50 states, those with denialist leaders who failed to implement serious restrictions are now the ones with the highest per-capita infection, hospitalization and death rates. So, yeah, the highest rates are, by far, in "red" states by and large, while "blue" states, like California and New York have among the lowest rates. (Note to Republicans: Election Day is over. You don't have to lie about COVID anymore to try and help Trump get re-elected. You can now start protecting the lives of your fucking constituents like you should have done months ago.)

Then it's on to the, yes, still-uncertified election...

• While the bulk of the GOP remains in as much denial about the Presidential election as they are about the coronavirus, and the pathetic Trump Administration continues to delay important transition work to a Biden Administration, a few cracks in the wall are beginning to form, even visible from the wingnut couch on Fox & Friends crew and even by Mitch McConnell;

• But the two Wayne County, Michigan wingnuts --- who held out for three hours with phony claims about "voter fraud" in Detroit before agreeing to certify the County's results --- are also having trouble letting go. They want yet another do-over vote to rescind the certification following a call from Trump. The state says that won't happen. But state certification is still to come next Monday and the state Board of Canvassers is constructed the same way the Wayne County Board is: a four-person Board with two Ds and two Rs. So anything could happen by the time they are set to vote to certify results in the state next week, where, by all available evidence, Biden trounced Trump by nearly 160,000 votes;

• Michigan is not the only state where some GOP dead-enders are hoping to somehow block certification of the November 3rd election. Similar (if likely similarly futile) efforts are afoot in Arizona, Pennsylvania and Nevada;

• Failure, however is not a roadblock for Trump, a man for whom the idea of simply doing the right thing has never occurred. On Thursday, he invited the Republican legislative leaders of the gerrymandered Michigan state House and Senate to the White House for a meeting on Friday, where it's expected he will try to convince them to convene a vote of the state legislature to override the popular democratic will of the voters and award the state's elector to The Loser instead;

• And for those who say The Loser's scheme could never EVER actually happen, I tend to agree with you (Desi may not). But I would also urge you, by all means, to NOT read this article today by Democratic strategist Chris Marshall headlined: "Are you sure Trump's plan to steal the election has failed? You shouldn't be".

Finally, for some less terrifying news, ironically enough...

On today's BradCast: This is not a drill. In my nearly-two decades of covering elections, I've never been as concerned about attempts to undermine an election than I now am regarding this year's Presidential election on November 3rd. [Audio link to full show is posted below summary.]

Last Friday's BradCast interview with American Postal Worker Union President Mark Dimondstein, regarding the mandates by Louis DeJoy, Trump's newly-appointed Postmaster General, to slow down the mail "everywhere" --- and DeJoy's Friday Night Massacre that took place moments after we got off air --- are just some of the huge reasons for my concern. Please make sure that you are prepared, well in advance, for this year's election, and that you know how to not only receive a Vote-by-Mail ballot, as necessary for many due to the pandemic, but that you know what the deadlines are for registering to vote, requesting a VBM ballot, and where and how to drop it off IN PERSON, so your ballot doesn't get lost in Trump's USPS slowdown. Once you've learned all of that, please make sure everyone you know does the same. Ernie Canning has written a helpful article at Bradblog.com with some important related tips, and 2020VotersCalendar.org is a very helpful new website resource with specific information along these lines for voters in each of the 50 states.

Over the weekend, Puerto Rico's primary was a disaster, as ballots did not arrive at all --- or far too late for many to vote --- in 50 out of 110 voting centers across the island. A second make-up election is now being planned, hopefully, for next Sunday. If something like that happens on November 3rd, of course, all may be lost.

In the meantime, just days after Donald Trump falsely claimed that children were "almost immune" to the coronavirus, a new report finds that nearly 100,000 children in the US tested positive for it in just the last two weeks of July alone. That's a 40% increase in child coronavirus cases during those two weeks in the U.s. jurisdictions researchers examined. At least 86 children have died from COVID-19 since May, the report from the American Academy of Pediatrics and the Children's Hospital Association also finds, including a 7-year old with no pre-existing conditions in Georgia last week.

This coincides with the mind-boggling push by Trump to reopen schools for in-person classes immediately, as a number of states run by Trumpy Governors press forward with plans to do so. One such state is Georgia, where some schools opened for the new term already last week and saw photos of crowded hallways and maskless children go viral on social media almost immediately (before suspending the student who posted them). Now that same school is returning to distance learning this week after six students and three staff members at the school tested positive. Other school districts in the state reported even worse numbers.

In Florida, where two teenagers have died so far this month, at least 12 counties are reopening schools this week, more than 17% of tests are now coming back positive. The CDC recommends schools only reopen where the positive test rate is lower than 5%, yet at least 9 of the 12 school districts planning to open in the Sunshine State are currently seeing rates much higher than that. That, as nearly 165,000 are confirmed to have died from COVID in the U.S. and new data from the CDC finds 200,000 more deaths since mid-March than would normally be expected at this time of year, based on recent trends before the pandemic.

As bad as its all getting, the White House appears unwilling to compromise with Democrats on a new COVID emergency relief bill, despite tens of millions of Americans who saw their expanded federal unemployment benefits from an earlier relief bill expire at the end of July. In response, rather than negotiate or demonstrate the art of his pretend deal-making prowess, Trump spent the weekend playing golf and signed one Executive Order and three Executive Memos that pretend to do a whole bunch of stuff that they actually don't and are most likely unconstitutional to boot. One of his executive actions, to temporarily defer payroll taxes for those who are working (the taxes will have to paid at the end of the year instead), would actually cut funding to Social Security and Medicare. Another would take money from FEMA to restore some of the expanded unemployment benefits, but slash them by a third, prevent them from being paid to the lowest-income earners, and require cash-strapped states pay 25% percent of the expanded payments.

Yet, there is no effort in his executive actions to bailout states and cities who are now completely out of money due to their COVID-related crash in revenues. Many couldn't help fund the expanded unemployment even if they wanted to. Similarly, there is no effort to fund the Post Office with the $25 billion that its GOP-dominated Board of Governors has requested to keep the USPS running. And no effort to give $4 billion to election officials around the country to help upgrade their systems to help manage the huge influx of absentee voting due to COVID or even to help make in-person voting safer, as election officials across the country have long sought.

In short, the weekend's news was terrible and the news ahead is likely to get nothing but worse for a while. But we thought you should know it, since the President of the United States --- who said his executive actions this weekend "will take care of pretty much this entire situation, as we know it" --- continues lying to the nation in hopes that it will somehow help him get reelected. It won't. But stealing the election remains completely on the table and actively under way.

Finally, we open up the phones to callers on all of the above. And, though I specifically asked several times, I couldn't seem to find one listener willing to call in and explain why they would be happy to send their kids back to in-person classes right now. Go figure.

On today's BradCast: They were the last major decisions of the term for the Republicans' stolen U.S. Supreme Court. And at least all of the Justices seemed to mostly agree that Presidents are not above the law, even if this one was allowed to buy some time before facing accountability. [Audio link to show is posted below.]

Lucky for Donald J. Trump, that extra time granted by two remands to lower courts by SCOTUS today will almost certainly prevent the public from seeing his tax returns and other likely fraudulent financial documents from the years before his Presidency, before he must stand for re-election on November 3rd. Despite those considerable gifts from SCOTUS today, Donald Trump went off on an incomprehensible Twitter tantrum in response. For some, I guess, too much is never enough.

"Not even the President, is categorically above the common duty to produce evidence when called upon in a criminal proceeding," Chief Justice John Roberts wrote for the majority in one of Thursday's long-awaited 7 to 2 opinions [PDF]. Citing 200-year old remarks by Chief Justice John Marshall, Roberts observed: "We reaffirm that principle and hold that the President is neither absolutely immune from state criminal subpoenas seeking his private papers nor entitled to a heightened standard of need." Even accused sexual assaulter Justice Brett Kavanaugh agreed in a concurring opinion that "no one is above the law."

While no one may be above the law, Trump received two extraordinary gifts from the court today. One opinion, Trump v. Vance [PDF] effectively postpones the disclosure of his dubious financial documents to the Manhattan District Attorney for a criminal grand jury investigation until, mostly likely, after the November election. The other, Trump v. Mazars [PDF] prevents several Congressional Committees from seeing similar documents that they subpoenaed from Trump's accounting firm, also until after the election --- and maybe never if the clock runs out on the end of the Congressional session in December. It will likely take at least that long to work through the courts with SCOTUS' newly-raised bar for such subpoenas of the Executive Branch by Congress.

We're joined once again today, at the last minute, by Slate's great court reporter MARK JOSEPH STERN to offer his ever-helpful clarity and context to today's complicated opinions, which one attorney today described thusly: "The ruling is 'No president is above the law', but they post-dated it to the Biden administration".

"I think he just doesn't really understand how the Court gave him a gift," Stern explains, in response to my questions about Trump's whining, incoherent Twitter response to today's ruling. "These decisions are wrapped up in a lot of language that pointedly reduces the President's immunity and executive privilege from oversight and investigations. And announces or reaffirms some crucial principles, like, of course a state can subpoena a President's records for a grand jury proceeding and, yes, Congress can also subpoena the President and his confederates and businesses if it seeks to get that information to pass legislation."

"But the Court said 'We are going to draw a line because we're not so sure that here, either the New York grand jury or the House of Representatives checked all the boxes that we think they needed to in order to get this information.' So, there's going to be a run-down-the-clock thing now, where Trump tries to keep fighting this in the lower courts --- at least through the November election --- and that means we may never actually get to see these records that the Supreme Court said, theoretically, we could have a right to see."

Stern observes: "It was almost like it was a carefully brokered compromise to reach this exact result and then work backwards for the reasoning." Nonetheless, Stern notes, even if his financial firms are allowed to escape subpoenas by Congress, "the writing is on the wall" for the subpoenas filed by Manhattan District Attorney Cyrus Vance. "I think the lower court is going to very quickly say, 'Yep, these records can go to the grand jury.' And that's going to be that. It could happen in a matter of weeks."

We will see. Or not.

Next, a few more accountability odds and ends today. Trump received another gift this week in the form of a second --- and still-unexplained --- extension of the deadline for the release of his annual financial disclosure statement. Speaking of, the New York Times' Thomas Friedman thinks that Joe Biden should refuse to debate Trump (who now needs the debates more than Biden does) unless Trump releases his tax returns from his years as President, since he promised to do so in 2016, and Biden has already done so. Friedman has one other condition as well that he suggest Biden place on the debates before agreeing to participate this year.

On the COVID-19 front today, the CDC is now claiming they are not planning to rewrite guidance for the reopening of schools after Vice President Mike Pence indicated yesterday they would be doing so following Trump's complaint that their original recommendation for opening schools safely was "very tough and expensive". And, whaddaya know? There's a surge of COVID cases in Tulsa following Trump's unmasked super-spreader campaign rally there in late June, according to the city's top health official.

On today's BradCast: Things are going to get far worse before they finally get better. In this case, "worse" means far more deadly and "better" means an election this fall that somewhat accurately reflects the intent of the electorate. Donald Trump has now get the killing Americans part down, but he and his fixer/Attorney General are still feeling their way around how best to undermine the election. [Audio link to show follows below.]

Just weeks ago, in late May, the Trump Death Cultists on Fox "News" and those entrusted to govern states like Florida, were railing against media, demanding apologies by those who warned that opening up for business prematurely amid a deadly viral pandemic was a terrible idea. Republican Governors like Florida's Ron DeSantis and hackish clowns like Sean Hannity of Fox "News" aren't asking for apologies anymore, it seems, as at least 56 Florida hospital ICUs across the state have now hit capacity, with dozens more nearly full as well. Florida is just one such GOP-led state whose political decisions in advance of the November election have had deadly consequences as 31 states are now seeing infections and hospitalizations rise.

The conservative projected death estimates put out by the infectious disease modelers at University of Washington's Institute for Health Metrics and Evaluation (IHME) have once again been revised in the bargain. IHME now forecasts more than 208,000 deaths in the U.S. from COVID-19 by November 1, while noting that some 45,000 lives could be saved over that same period if we all simply wore masks in public. Other experts believe the mortality number could be as high as 500,000 by the end of this year.

So, again, we ask: At what point does it become a CRIMINAL act when DeSantis and Donald Trump and Vice President Pence command schoolchildren, amid this out-of-control surging pandemic, back to in-person classes next month, under thread of financial penalty, and in defiance of CDC guidelines? At least the CDC guidelines based on science and health data, versus Pence's newly promised revised CDC guidelines that the Administration ordered to be cooked up after Trump found the real ones to be too "tough" and "expensive". When do these people become liable for criminal deadly negligence or even mass murder?

This scheming is nothing short of sick and twisted. We will soon look back on these days with ghastly horror at what they have done in short-sighted and ill-considered hopes of winning re-election this November.

Speaking of which, while Trump and his corrupt A.G. Bill Barr have been out lying about absentee voting amid the pandemic, it seems Republican strategists and candidates are becoming quite concerned that their voters may be actually be listening to them. Many GOP voters new believe that vote-by-mail ballots are all fraudulent, which could end up costing the GOP dearly this year.

At the same time, folks like EDDIE PEREZ, Global Director of Technology and Standards at the OSET (Open Source Election Technology) Institute, has been doing his level best to debunk many of the lies about mail-in voting being infectiously spread by Trump and his Attorney General who, for example, recently declared that "a foreign country could print up tens of thousands of counterfeit ballots" and use them to undermine our elections somehow. Perez explains (and here's a shorter Twitter version of his explanation) why such claims are largely nonsense, even if there are, in fact, some concerns about fraud in absentee voting --- just not the ones that Trump and Barr are mostly trumpeting.

As no fan of absentee voting myself --- other than in cases where voters literally cannot vote at the polls on Election Day, or are forced to use 100% unverifiable electronic voting systems at the polling place, or when we find ourselves in the middle of an out-of-control deadly global pandemic --- I've got a few pointed questions for Perez on the reality of absentee ballot fraud.

Among the issues he speaks to: Whether ballots can really be counterfeited (by foreign or domestic actors alike); What security measures are in place to prevent someone from casting a ballot in someone else's name?; Should voters have confidence in signature matching by election officials who are not hand-writing experts? And more. "If nothing else," Perez tells me, "the country needs to realize --- and particularly election officials and Get Out The Vote organizations --- there are really, really good reasons to protect public health to make by-mail voting available to people, as one of several options. That's really critical. For November, you've got to have a balance. We need to pay attention to educating voters about what it's going to take to ensure that their ballot is accepted and counted."

Also, as Perez, before joining the non-profit OSET Institute, was a 15 year veteran of Hart-Intercivic, one of the nation's three major private voting system vendors (about whom we've reported a great deal of less than flattering things over the years), we take a few minutes today to discuss why private, for-profit vendors are ill-equipped to meet the critical needs of transparent, overseeable elections in support of American democracy. "I'll say that the one thing we can agree on," Perez notes, "is transparency in the voting process is what helps to build trust with the public. Transparency is what is going to produce confidence. And that's what we need in our democracy."

I didn't have the heart or time to respond that "trust" has nothing to do with Americans elections. But, other than that, on the need for transparent oversight to build confidence among the electorate, he is spot on.

Finally, two objectionable SCOTUS opinions were handed down today, allowing religious organizations to, among other things, ignore any and all state or federal anti-discrimination laws, because "freedom of religion", apparently, also now includes the freedom to take actual freedoms away from everyone else...

Seriously, at some point American officials will need to be prosecuted for mass murder for their criminal delinquency and deceit in dealing with the coronavirus pandemic, which has, so far, in just four months, cost the lives of more than 122,000 Americans. Those prosecutions should begin (if not end) with the man currently serving as President of the United States. That is particularly true in the wake of his criminal admission at his Death Rally in Tulsa last week, when he admitted that he told his "people...slow the testing down, please!" The White House later said Donald Trump was just joking, but when asked if he was kidding, he publicly admitted otherwise. "I don't kid," he said, "let me just tell you, let me make it clear." And we now have hard evidence on today's BradCast to prove that, perhaps for the first time, he was finally telling the truth. [Audio link to full show is posted below.]

On Wednesday, confirmed new coronavirus cases in the U.S. set a single day record of more than 38,000. At the same time, hospitalizations are rapidly increasing in a number of states around the country, including states such as Florida, Texas, Arizona and Oklahoma, where denialist Republican Governors reopened for business far too quickly, in direct contradiction to almost all health experts.

As states like New York, New Jersey and Connecticut --- hit hardest and earliest at the beginning of the pandemic --- have seen case numbers and hospitalizations plummet, they've instituted quarantine restrictions on travelers from some of the currently hardest hit states. As of Wednesday, the list included Alabama, Arkansas, Arizona, Florida, North Carolina, South Carolina, Utah and Texas.

When asked what he would say to the leaders of some of those states, including Florida, whose Republican Gov. Ron DeSantis had issued a quarantine on travelers from the NY metro area early in the pandemic (while failing to mandate appropriate restrictions in his own state), New York's Democratic Governor Andrew Cuomo said today: "You played politics with this virus and you lost. You told the people of your state and you told the people of this country, White House, don't worry about it. Just open up, go about your business, this is all Democratic hyperbole. Oh, really? Now you see 27 states with the numbers going up. You see the death projections going up. You see the economy going down. It was never politics, it was always science. And they were in denial."

Well, many of them are still in denial. And not just denial, but taking purposeful, affirmative efforts to lie to their people about COVID-19 numbers in their own states. The expert who ran Florida's once-lauded COVID-19 tracking website, but was fired because, she says, she refused to manipulate the data, sent out a warning this week. She charges that officials have been "instructed this week to change the numbers and begin slowly deleting deaths and cases so it looks like Florida is improving next week in the leadup to July 4."

In West Virginia, the state's Republican Gov. Jim Justice, a billionaire coal baron, has forced out the commissioner of the state's public health bureau because he didn't like the numbers she was reporting, as cases rise in at least 11 counties. He had previously lauded her at regular COVID-19 press briefings where she spoke. She was not at his latest briefing on Wednesday and released a statement upon her forced resignation that night, urging state officials "to stay true to the science".

Meanwhile, as the head of the U.S. Centers for Disease Control and Prevention (CDC), conceded that the infection rate in the U.S. is likely 10 times higher than the number of cases currently reported (that's 23 million probably infections, instead of the official 2.3 million reported as of today), states like Texas are seeing not just increased cases, but spiking hospitalizations, which have doubled over the past week. In Houston, ICU beds were 97 percent full by Wednesday. (In Florida, Gov. Ron DeSantis has barred hospitals from reporting those numbers anymore.) Even Republican Gov. Greg Abbott is now warning of the state's "massive outbreak", while still failing to mandate masking or even allowing local officials in Houston or anywhere else to do so on their own.

And yet, with all of that, Donald Trump really has told his "people" to "slow the testing down." Talking Points Memo's Josh Kovensky has been documenting the refusal by the Dept. of Health and Human Services (HHS) and the Federal Emergency Management Agency (FEMA) to approve extensions for federally funded testing at 13 sites across five states, including Texas. Where more than 40 such sites were once funded by the federal government across the country, only 13 sites remain, and they have been told by the Trump Administration that those resources will end on June 30th, despite desperate requests from officials in Texas, Illinois and Pennsylvania for the much-needed aid to continue.

That's just a taste of today's program, which raises the very serious question: Should these people be held accountable for the thousands --- perhaps tens of thousands --- of American citizens who are likely to die, thanks to their purposeful efforts to ignore science and health officials for purely brazen political purposes?

The deadly denial about the coronavirus is a fast-motion mirror of the Republican denial, for brazen political purposes, regarding climate change. Today we close with some accountability and/or attempts at accountability on that front in our latest Green News Report, in which Minnesota's Attorney General has now filed a consumer fraud lawsuit against Exxon, Koch, and the American Petroleum Institute, citing, by way of just one example, a "proprietary" document from Exxon warning about the dangers of "CO2 concentrations in the atmosphere...due to fossil fuel combustion" that "will cause a warming of the earth's surface" and "dramatic environmental effects before the year 2050." That prescient, on-the-money document is dated October 16, 1979, before Exxon went on to spend millions of dollars over decades to misinform the public that climate change due to the burning of fossil fuels was little more than a hoax. Desi Doyen joins us for that attempted accountability and a bit more that has actually succeeded in a refreshingly encouraging GNR today. And it comes not a moment too soon...

On today's BradCast: As the U.S. crossed the 100,000 coronavirus death Rubicon over Memorial Day weekend, the President of the United States played golf. Twice. And called a potential Democratic Vice Presidential nominee fat. And a former Secretary of State and Democratic Presidential nominee a "skank". He also suggested a popular TV host murdered someone. And he lied again (and again) about absentee voting fraud (even though he committed it himself.) The Presidential election is 161 days away. [Audio link to full show is posted below.]

Before we get there, however, former CDC Director Tom Frieden said this weekend, "It's 100,000, but it looks like we're still at the beginning of this pandemic." He is not alone. According to the Imperial College London, the U.S. could see another 200,000 dead on top of those who have died already from COVID-19, thanks to the President's desperately premature push to reopen the nation's economy. That, while Trump is ignoring the first 100,000 dead, even though, as the New York Times observes:

At the same time, despite the Republicans' attempt to pretend the viral pandemic away, without very quick action by the Republicans who control the U.S. Senate to prevent massive layoffs at the state and local level, we could be looking squarely at a second Great Depression before year's end, The American Prospect's David Dayen reports today with very good evidence in support.

Speaking of that Presidential election (did we mention it's just 161 days away? --- but who's counting?), we have some very good news from Florida today to counter the grim news with which we felt it necessary to open today's program. A federal judge has nixed the voter suppression law enacted by Republican Gov. Ron DeSantis and the state's GOP-controlled legislature. The law was adopted to gut the state Constitutional Amendment passed by 65% of FL voters in 2018 to allow most former felons to register to vote after having completed "all terms of their sentence including probation and parole."

Amendment 4 ended the state's shameful lifetime ban on voting rights for former felons. U.S. District Judge Robert Hinkle, following an eight-day trial earlier in Spring, declared the GOP's new Jim Crow law --- enacted to upend Amendment 4 --- to be an unconstitutional poll tax, as the law mandated the payment of all fines and fees before former felons would be allowed to register to vote, whether they could afford the payments or not. Moreover, the state keeps no database of such fines and fees, so many former felons had no idea if they owed money or not. Because of that, many declined to register to vote for fear of being charged with perjury when attesting that they had they had "completed all terms" of their sentence on the voter registration application.

Despite that very good news, we suspect the roller coaster battle by the Florida GOP to prevent as many as 1.5 million new voters in the crucial battleground state --- including about a quarter of the its African-American male voting age population --- from getting their voting rights back will continue.

Of course, the GOP War on Democracy is happening all over the country right now. We close today's show with a new front opened in that war over the weekend by the Republican National Committee and former GOP Congressman-turned-candidate-again Darrell Issa. They filed a federal lawsuit alleging that California Gov. Gavin Newsom's May 8 order to send absentee ballots to all registered voters in the state for the November election is in violation of the U.S. Constitution.

Yes, it even sounds absurd on its face, but longtime BRAD BLOG legal analyst ERNEST A. CANNING joins us today to explain exactly why the complaint is even more ridiculous than it sounds and the two big reasons why he believes it is likely to be "dismissed at the district court level". Whether that dismissal will be upheld by the GOP's stolen majority on the U.S. Supreme Court, should Republicans push it that far (and why wouldn't they?), is a separate question. It was another impossible news day to cover on today's BradCast, but we did our best with two historic hearings happening in D.C. at the very same time and a few special elections around the country just to keep us on busy. [Audio link to show is posted below summary.]

One hearing was on Capitol Hill and the other was at the U.S. Supreme Court --- or, at least, on the live-streamed telephone conference call that has now replaced traditional in-person oral argument at the actual Court, thanks to the still worsening coronavirus pandemic.

We begin today with the SCOTUS hearing. Two of them, in fact. Both on the attempts by federal and state officials to obtain Donald Trump's financial records stretching back 10 years from before he became President. One case concerns subpoenas from three different U.S. House Committees to Mazars USA, the President's longtime accounting firm, as well as to Deutsche Bank and Capitol One, with whom Trump has done business. The other case is over a subpoena by by the Manhattan District Attorney for many of the same documents and tax records from the same financial institutions. That document demand is part of a state grand jury investigation related to unlawful hush money payoffs Trump gave to two women in advance of the 2016 election, and his convicted lawyer Michael Cohen's allegation that Trump and his companies fraudulently inflated and deflated his net worth when applying for loans or filing taxes.

Trump is not actually a party to the subpoenas, but is suing the financial institutions to prevent them from responding to the lawful subpoenas. To date, he has lost every hearing in the cases in lower Courts, where his lawyers actually argued that a sitting U.S. President could shoot people on 5th Avenue and could not be stopped, arrested or investigated for doing so. While the Justices didn't seem to entertain that argument, several of them, particular the Republican-appointees, seemed to be trying to find a way to help Trump out of this jam. We discuss what seems likely to result in either a split on the two different cases --- with the Court blocking the Congressional subpoenas while allowing the ones in the state criminal investigation in NY --- and/or one or both cases being remanded back to lower courts for a more narrow reconsideration that would likely prevent Trump's tax returns and other financial records from being released in advance of the 2020 election.

As those arguments were playing out today, the heads of Trump's CDC, FDA and Dr. Anthony Fauci, Director of the National Institute of Allergy and Infectious Diseases, testified before the U.S. Senate's Health, Education, Labor and Pensions (HELP) Committee. They did so remotely from their homes, where they are each self-quarantining after recently coming into contact with infected individuals at the White House. One of those individuals was Vice President Mike Pence's Press Secretary who tested positive on Friday, just before Pence appeared at a meeting with food producers in Iowa. As the company CEOs waited for the round-table discussion with Pence to begin, they were asked by an aide to the Vice President to remove their masks! That, despite advice from health officials (including the White House's own), and even though two of the executives run meatpacking plants where thousands of workers have contracted COVID-19. One represents Tyson Foods where more than 1,000 workers --- a third of its workforce --- at a meatpacking plant in Waterloo, Iowa have now tested positive. At least three workers at the plant have died.

Rural counties, especially in the heartland --- many with meatpacking plants and prisons --- are seeing a spike in cases of late, along with metropolitan areas where mostly Republican Governors have begun to prematurely lift stay-at-home orders to try and help the economy recover. An unreleased White House document prepared by the CDC and Department of Homeland Security, obtained by NBC News on Sunday, details hotspots all over the country, with many "red" states and counties seeing huge increases in cases over the past week. For example, last Friday, Arizona saw its largest single-day increase in cases, just about a week after Republican Gov. Doug Ducey began reopening the state.

A separate analysis of infections by the Associated Press today finds increasing cases in many of the same hotspots cited by the unreleased White House document, while noting that thousands of people are now getting sick from COVID-19 at their workplaces, including in recently reopened sectors such as construction workers in Austin, TX. At the same time, health workers continue to be hit especially hard, with more than 28,000 now having tested positive with more than 230 deaths in the industry. That, as well over 81,000 Americans have now been killed by the virus over the past two months.

No doubt, all of this is why Fauci warned Senators today of "really serious" consequences, including "suffering and death that could be avoided", if businesses reopen too soon. "There is a real risk that you will trigger an outbreak that you may not be able to control," he cautioned. "Which, in fact, paradoxically would set you back. Not only leading to some suffering and death that could be avoided, but could even set you back on the road to trying to get economic recovery because it would almost turn the clock back, rather than going forward."

But Donald Trump has an election to win this November, and it appears no number of dead Americans will get in his way of winning a second term. On that note, it's Election Day in several states today. And Trump was offering a preview of this November by lying over the weekend about today's Special Election for the U.S. House in California's 25th Congressional District. On Saturday, Rep. Tom Emmer (R-MN), who heads the National Republican Congressional Committee (NRCC) issued a memo to House Republicans with an "urgent call to arms", telling them to "raise hell" because Democrats in California were "doing all they can do to steal the election". Naturally, Trump took the lie and ran with it, tweeting about the addition of an extra in-person polling place for early voting over the weekend in a diverse part of the District, opened at the request of the city's REPUBLICAN Mayor!

Trump falsely claimed the polling place was added by the state's Republican Governor Gavin Newsom. (It wasn't, it was added by L.A. County --- at the request OF THE REPUBLICAN MAYOR who, while supporting the Republican in the race, was furious there was no polling place within his city's boundaries.) Trump falsely declared a "Rigged Election!" and lied to his Twitter followers that the election "was supposed to be mail in ballots only". That is also untrue. For the record, last Friday, Newsom did announce that every registered voter in the state would be sent a postage-paid absentee ballot for the November Presidential election. The move is said to be for safety reasons due to the pandemic --- the pandemic which Trump originally ignored, made much worse, and is now pretending to be over.

Finally today, Desi Doyen brings us the latest Green News Report, as the Administration reopens national parks despite the growing risks of coronavirus; as tax-payers are forced to pay for cleaning up old wells of bankrupted oil companies; and as France offers an airline bailout in exchange for cuts in greenhouse gas emissions. Donald Trump is putting George Orwell to shame. A Republican U.S. Congressman is caught on tape committing election fraud. And our Green News Report may have finally jumped the shark --- or at least the news we report in it today has. All on today's BradCast. [Audio link to show is posted below.]

I've said many times on the show that Donald Trump and the Republicans can't simply lie this one away. Or vote it away. Or simply ignore it. The hard numbers of Americans dying --- at least 75,000 already --- can't merely be wished away, as Trump has successfully been able to do with so many of his crimes, misdemeanors, appalling failures as President and other scandals. But maybe I was wrong. Maybe they can actually pretend it all away. In fact, that is now what they are trying to do.

In Arizona, some two dozen experts at two top universities who had been compiling the state's most robust public modeling for COVID-19 were told by the head of the state's Department of Health Services to stop their work immediately, according to an email obtained by Phoenix' ABC affiliates and reported by the Arizona Republic on Wednesday. They will also no longer have access to special data sets the team had employed in their work. The order came as AZ's Republican Governor Doug Ducey was lifting coronavirus restrictions across the state, and after the experts from Arizona State University and the University of Arizona produced five different potential models for reopening the state, with only one scenario that did not show a dramatic increase in cases. That one allowed for businesses to reopen at the end of May. But Ducey wants them open now, so his Health Department has shut down the state's best information in favor of models they claim are coming from FEMA and the CDC --- moels that have no been released publicly.

Back in D.C., the President of the United States is now reportedly questioning the coronavirus death toll numbers, believing them to be lower than reported, according to AXIOS, when, in fact, it is almost universally agreed among experts that the most widely reported numbers from Johns Hopkins University are likely vastly lower than the actual death toll, since most states have only reported those who have died after testing positive for COVID. Tens of thousands of more Americans have died over the past several months almost certainly from the virus, but they are not currently included in those figures. Nonetheless, Trump and other senior aides are now planning to publicly question the death toll as being falsely inflated, while the tragic numbers continue to blow away Trump's repeated lies since January about expected U.S. deaths from the pandemic. Yes, he's preparing to simply pretend it all away, as he did with the death toll for Hurricane Maria in Puerto Rico and as Republicans have done for years regarding the science of climate change.

At the same time, as AP revealed today, the Administration is also preventing the release of a 17-page CDC guidance report meant to help local churches, restaurants, schools, summer camps, transit systems and other business reopen safely, with one CDC source telling AP they were told the guidance "would never see the light of day." After the publication of the report by the AP documenting the Administration's attempt to bury it, the New York Times reports the White House "rejected the recommendations over concerns that they were overly prescriptive, infringed on religious rights and risked further damaging an economy that Mr. Trump was banking on to recover quickly." In other words, Trump believes he can revive the economy quickly to improve his re-election chances, no matter how many Americans are unnecessarily killed in service to that cause.

And, speaking of elections, the Denver Post published a remarkable story on Wednesday night, along with an audio recording revealing Colorado U.S. Congressman and state Republican Party Chair Ken Buck ordering another GOP party official to falsify election results on an affidavit in order to place a Republican candidate for state Senate on Colorado's upcoming primary ballot.

The Republican official, Eli Bremer, GOP chair of state Senate District 10, is heard on the call refusing to do so without consulting with an attorney first. He asserts that he was being asked by Buck to commit a crime in signing a false affidavit to certify that at a local candidate received the 30% support necessary to be placed on the ballot when, in fact, he received only 24% in a recent vote.

A state District Court judge ruled on Monday that Bremer would have, in fact, been in violation of state law had he signed the affidavit as ordered by Buck. The state Republican Party appealed the ruling to the Colorado Supreme Court which declined to hear the case, leaving the lower court's ruling in place. Buck, a Tea Party right-winger and former District Attorney, claims the initial vote was flawed. He has yet to resign his post as Colorado GOP Chair or U.S. Congressman. He should step down from both. Had any Democrat been caught on tape doing anything even close to what Buck is heard doing in the recording, they would already be gone. We'll hope the Colorado state Bar Association, at the very least, sees fit to take away Buck's license to practice law after being caught on tape repeatedly ordering someone else to violate it.

Finally, even with what may be our most ridiculously apocalyptic Green News Report ever today, we have to tack on one more sign of the end of the world, as a potentially historic snowstorm is now forecast to dump as much as one foot this weekend in parts of the Northeast and New England --- in MAY! On today's BradCast: Make no mistake. Donald Trump's Executive Order earlier in the week pretending to force meatpacking plants to stay open did no such thing, despite how it was misreported by the corporate media. But for those really interested in protecting the nation's food supply, there is an answer. [Audio link to the full show is posted below.]

Trump's order was issued as meatpackers working on lines across the country, now at least 7,000 of them, have been infected with coronavirus, with at least 25 of them now killed by it. Workers are being sacrificed as Just four Big Ag monopolies now control 85% of the nation's beef supply with just 50 plants producing 98% of it for the nation.That is down from thousands that did so all across the country until recent decades when those four mostly foreign-owned companies were allowed to buy up and dangerously consolidate the nation's food supply.

It is now costing us in a number of ways. Many of the worst COVID-19 hot spots across the country are in meatpacking plants with hundreds of infections in each and many of those are concentrated in South Dakota, Nebraska and Iowa. While the CDC and Occupational Safety and Health Administration (OSHA) have issued guidance recommendations for how the crowded plants may be run more safely, OSHA has made those recommendations voluntary, not mandatory. Thus, the Big Ag companies are largely ignoring the CDC safety guidelines in order to keep cranking out the meat, no matter the deadly cost to the workers and their families and communities where the disease continues to spread.

In Republican-run states like SD, NE and IA, the Governors have refused to issue stay-at-home orders, despite pleas from local Mayors and health officials to do so. Worse, Iowa Gov. Kim Reynolds has told the companies that they may regard any workers too afraid to risk their lives by showing up to work in unsafe conditions as having voluntary quit. Therefore, says Reynolds, those workers will not qualify for state unemployment benefits when the companies fire them. As all of this has played out, and plants have been forced to shut down with workers literally collapsing on the lines, the nation has begun to see shortages of beef, pork and chicken in grocery stores, leading the CEO of Tyson Foods to recently declare that the "the food supply chain is breaking." No kidding. But that is thanks, in no small part, to the consoladition of companies by Tyson and the few others!

Fifth generation Iowan J.D. SCHOLTEN, who joins us on today's show, says that it doesn't have to be this way. The Democratic candidate for the U.S. House in Iowa's 4th Congressional District blames the consolidation of the nation's food supply by a handful of companies for multiple disasters the industry is now facing. "One of the reasons we're a secure nation is because we are a food secure nation," Scholten tells me. "And we're getting dangerously close to being so concentrated that we're very vulnerable. This pandemic has put a spotlight on that. If one plant goes down for any reason, that really hurts the entire system."

Scholten is running for Congress this year again after nearly unseating 9-term Republican white nationalist Rep. Steve King in 2018, when the Democratic nominee was just over 3 points shy of winning in the deep-red district that Donald Trump won by 27 points in 2016. He argues today that the threats to our broken food supply chain --- with few farm-to-table restaurants in the entire state, despite being the very heart of Farm County --- can easily be fixed if the nation enforces long-ignored trust busting laws already on the federal books.

"We had this battle 100 years ago," he says, "and, as a result, we had the Packers and Stockers Act. That was in 1921. Next year, which I hope to be my first year in Congress, will be the 100th anniversary" of the Act which he wants to see invoked again. "I think it's a real opportunity coming out of this that farmers and workers come together. If we enforce our anti-trust laws, we can balance the playing field, allow farmers to stay on their land and make a dime, and allow workers to make an honest wage and be respected."

He also believes that the crisis has turned many of Iowa's previously-solid Republicans away from their Party. "It's really in the last couple of weeks where we've really gotten the attention of farmers who, I would say, traditionally don't give a crap about the Democratic candidate in this race. I've had a number of Republicans, whether they're farm managers or actual farmers, reach out to me and say, 'You're dead on, on this issue! Thank you for saying something, because we all know [Steve] King won't.'"

Scholten wants to restore regional systems of food production and delivery that he says "will benefit Iowa. Not only will it help our farmers, it will help our rural communities. If we create this alternative local and regional food system, for pennies on the dollar, it would create so many decent jobs in rural Iowa that have really gone to the wayside."

We discuss all of that and much more today, including why he thinks that this year he may finally be able to remove the execrable racist Steve King from office once and for all and how the Hawkeye State now plans to mail absentee ballot request forms to every registered voter for their upcoming June 2nd primary. Scholten is running unopposed in the primary, but King --- who has been removed by House Republican leadership from all of his committee assignments after racist statements that even they couldn't ignore --- is facing a challenge from four other Republicans. Scholten believes King will win the GOP nod anyway, but will be cash-starved after doing so.

Next, the continuing state-by-state and county-by-county slog to reform election procedures to ensure voters can safely vote in upcoming primaries and this November's critical general election amid a global pandemic. On that score, bad news for voters out of the GOP-controlled state legislature in Louisiana, where in-person voters across the entire state are forced to vote at the polls on unverifiable touchscreen voting systems which are now also deadly disease vectors for the coronavirus. While the state's Republican Secretary of State and Democratic Governor had struck a deal for a scheme that would allow most voters in the state to vote by absentee ballot, Republicans in the state legislature gutted most of that proposal to make voting by mail much more restrictive. How did both state chambers hold full votes on the measure? They voted by mail of course!

Much better news for voters this week in two counties in Pennsylvania where primaries will be held on June 2nd as well. Election officials in Crawford and Luzerne Counties --- which previously forced all voters to use 100% unverifiable touchscreen voting systems at the polls --- have now decided to allow in-person voters to vote on hand-marked paper ballots instead. Happily, few will even need to do so. Late last year the state, for the first time in its history, adopted a measure that allows for no-excuse absentee voting for all. Many voters will be sent an absentee ballot application for the primary in the mail, but all registered voters may request a mail ballot online at VotesPA.com by May 26. The deadline to register to vote in the Keystone State's primary is May 18.

Finally, we close today with a song and a laugh to shuffle off into the weekend. Among the stories covered on today's program...

• Backlash is growing against COVID-19 financial relief measures adopted by Congress, signed by the President, and failing to help the Americans that they were supposedly designed to be help;

• But, in what appeared (at least as of early this morning) to be much better news, Donald Trump had been planning to stop endangering public health with his appearances at White House coronavirus task force briefings. He did not appear at any briefings over the weekend and, as of Monday morning, on the heels of continuing blowback in response to his musings at last Thursday's briefing in which he discussed injecting people with disinfectant to "cure" coronavirus, his Press Secretary confirmed he would be reducing his role in those nightly briefings which, long ago, turned into Trump Campaign TV shows. A few hours later, however, the White House backtracked. Sure enough, by Monday evening, Trump was back at the podium. But we're still ignoring him. You're welcome.;

• We can't, however, ignore everything he says, particularly when he continues to put out dangerous misinformation from that podium. Thankfully, we have more trustworthy news sources like....Saturday Night Live to correct him! Brad Pitt played Dr. Anthony Fauci on the show over the weekend, and we share it today because a) it was very funny and b) it helps correct a whole bunch of deadly BS that Trump has been misinforming the American public with. (So much so that even Republicans have been forced to come out and correct the President's dangerous misinformation on poisoning people to try and kill the coronavirus, after calls to emergency poison control hotlines spiked around the country following Trump's remarks.);

• Shifting to elections news --- the only way we'll ultimately be able to turn the page from many of our ongoing nightmares --- some very good news out of North Dakota today. A settlement has been reached, according to the Campaign Legal Center, with two Native American tribes who sued the state over the GOP effort to prevent them from voting with a law that mandates a Photo ID voting restriction requiring IDs with residential street addresses. That, even though thousands of tribal members living on reservations in the state do not have residential addresses. The settlement, agreed to by the state in hopes of avoiding a trial, will (theoretically) ensure that all Native Americans voters will be able to do so without a problem in ND's upcoming June 9th primary and beyond. That good news also allowed us to report another related good news story from the 2018 election that we've being trying to cover for the past year and a half! It has to do with the three Republican members of the ND state legislature, incuding the House Majority Leader, whose seats were flipped from "red" to "blue" in the 2018 mid-terms in response to the GOP-majority's purposely-disenfranchising Photo ID measure. The best part: The guy who sponsored the 2013 law which took effect in 2018 for the first time, was ousted in the same election by Democrat Ruth Buffalo --- a Native American!;

• With that good election news out of the way, we move on to New York for some much-less-than-good election news. On Monday, the Democrats on the State Board of Elections voted to cancel the June 23 Democratic Presidential Primary, even though Bernie Sanders, who has suspended his campaign and endorsed Joe Biden, has said he wishes to remain on the ballots for the 20 or so remaining primaries. Over the weekend, his campaign asked the NY Dems to NOT cancel the primary. While most NY voters, due to the coronavirus, will be allowed to vote via absentee ballot in the June 23 election (where there will still be other primaries and issues on the ballot), Democratic state officials said that removing the Presidential race from the ballot would lower turnout in hopes of making in-person voting safer.

  The Sanders Campaign is furious and calls the move a "blow to American democracy". Democratic NY Rep. Alexandria Ocasio-Cortez is also angry and called for the DNC --- which claims they did not call for the cancellation --- to override or reverse the decision, in some fashion. She notes that "Sen. Sanders explicitly stated that he intended on continuing to collect delegates in order to advance wage, healthcare, climate & other priorities into the platform at the convention," adding "unity isn't a feeling, it's a process. Undemocratic, unilateral decisions that disenfranchise millions of progressive voters & volunteers is extremely destructive to the process of unifying the party for Nov."

  The Sanders Campaign has now petitioned the NY State Board of Elections to keep his name on the ballot, with his attorney noting that the Vermont Senator "is concerned that his removal from the ballot would undermine efforts to unify the Democratic Party in advance of the general election." The vote today --- which neither Biden, nor the state Party, nor Gov. Andrew Cuomo asked for --- comes despite the reasonable argument detailed last week at The BRAD BLOG by Ernie Canning, who explained why he believes the more votes Sanders receives in the remaining primaries, the more likely that presumptive nominee Biden will actually win this November!;

• Also, speaking of elections, voting in Ohio's postponed-at-the-last-minute March 17th election will finally end as of tomorrow (April 28). Absentee ballots postmarked by Monday night will be counted if they arrive at County headquarters by May 8 or if voters deliver them to County Boards of Election by Tuesday night at 7:30pm. In-person voting will be available on Tuesday for disabled or homeless voters, though the state's Secretary of State has said that any voter who claims disability or that they are unable to receive mail will not be challenged and will be allowed to vote in person at County Boards of Elections on April 28;

To quote Donald Trump when he thought the cameras had stopped rolling after his disastrous Oval Office address last week: "Oooookaaay...." So, we are now living in a new world. For the time being. Millions are being instructed to stay home from work. Markets are tanking. Major states and cities are shutting down schools, restaurants, bars, clubs, theaters and casinos. Some are instituting full "stay at home" lock-down orders. And Congress is scrambling to pass emergency legislation to try and help displaced workers and families as the coronavirus crisis threatens to shut down the nation entirely for weeks, months or longer. All of this amidst a Presidential election under the most dangerously inept and dishonest Administration in the history of the nation.

On today's BradCast, we try to get you caught up with the unfolding, bizarre and disorienting mess that we are all going through together in hopes of "flattening the curve" of the rate of infections to try and ensure that the U.S. hospital system doesn't become overwhelmed with patients. Like you, we have no idea how this is supposed to work, but we're all working through it together, even as Trump literally told the nation's Governors today they are on their own in coming up with enough respirators and other medical equipment to keep their residents alive, and as he continues to lie to the country about the availability of testing and eventual arrival date of a vaccine (which is most likely more than a year from now, even as a single live test began today).

And, speaking of that Presidential election, states --- particularly those which are touchscreen-voting heavy, like Louisiana, Georgia and Ohio --- are beginning to announce postponements of their primary elections. Ohio's Governor has attempted to do so before tomorrow's planned election that was to be held along with Florida, Illinois and Arizona. But a state judge, late today (minutes ago, justt after we got off air) has now blocked the Republican Ohio Governor's attempt to postpone. So, full-on chaos for a change in the Buckeye State tonight. The other three big states (at least at this hour) are planning to go through with their own elections tomorrow, even as polling sites at senior citizen centers are requiring last-minute relocation and frequently-elderly poll workers are (justifiably) calling in to cancel.

Other states, such as New York are considering postponement, while Maryland considers moving to all-Vote-by-Mail primaries. More than a dozen states, such as Texas, do not even currently offer no-excuse absentee voting. That needs to change. [CORRECTION: I had initially cited Pennsylvania as one of those states that do not allow no-excuse absentee voting. In fact, no-excuse absentee voting was instituted late last year as part of a package of election reforms in the Keystone State. My apologies for the error!]

We cover all of that AND wave very briefly at Sunday's Presidential Debate (which we hope to revisit in a bit more detail soon - but we'll see) before opening the phones to check in with callers today, including one from Minneapolis who describes the situation there as dire, others from Southern California who wonder where the head of the CDC has disappeared to, and another who questions both the threat and infection numbers currently being reported. On today's BradCast: If you think the coronavirus is worrisome now, just wait until voters in jurisdictions where they are forced to vote on unverifiable --- and germy --- TOUCHSCREEN computers start putting two and two together before Election Day. Not that the election officials who insisted on such an idiotic idea ever gave much of a damn about their voters, as our guest today makes abundantly clear. [Audio link to show is posted below.]

First today, however, another sign that Republicans should almost certainly be in very big trouble this November. But, of course, that requires voters be able to vote in a way that the public can know their votes were tabulated as per voter intent (not possible on a touchscreen voting system of ANY type.) The trouble for the GOP could get even worse, however, depending on the Administration's handling of the expanding coronavirus crisis. That response does not seem to be going well, so far. The Dow plummeted another 1,200 points on Thursday, due to investor fears of a global pandemic, resulting in the sixth straight day of losses and the worst week for the markets since October, 2008 --- the height of that year's global financial crisis.

But Donald Trump is finally on the job! He surprised the man who had been in charge of the government's response to the epidemic, Health and Human Services Secretary Alex Azar, by announcing that Vice President Mike Pence would now be the Administration's point man on the matter. Azar was informed at the same time as the rest of us, when Trump announced the news at a press conference on Wednesday evening as Azar was standing next to him.

As to Pence having "a certain talent for this", as Trump announced at the presser, Pence's record as Indiana Governor in 2015, when he presided over the worst HIV outbreak in state history, strongly suggests otherwise. Still, as Desi Doyen joins us to point out today, none of this is reason to panic. It is reason, however, to take a few simple measures to keep you and your family safe, and Desi offers some helpful tips toward that goal.

All of this is also just one more reminder as to why this dangerous menace of an Administration must be replaced as soon as legally possible. To that end, there are reasons to be concerned about the integrity of several upcoming primary elections, not to mention this November's critical general election. Saturday's crucial South Carolina primary will require all state voters to use brand-new, 100% unverifiable touchscreens made by a company with a long history of election failures. The March 3rd Super Tuesday primary, just three days later, will see voters in California, Texas, and North Carolina, among other states, forced to use new, similarly unverifiable touchscreen voting systems for the first time.

Meanwhile, in the battleground state of Georgia, where a federal judge last year ordered the state's nearly twenty-year old, failed, unsecure Diebold touchscreen systems to be scrapped and replaced, the Republican Sec. of State has now mandated that every county use all-new, unverifiable touchscreens made by the Canadian firm, Dominion Voting, for the upcoming March 24 primaries in the Peach State. That, instead of a simpler, safer, cheaper, verifiable hand-marked paper ballot systems.

We're joined today for a long-overdue visit from MARILYN MARKS, Executive Director of the invaluable Coalition for Good Governance, the lead plaintiff in the federal case that resulted in the decertification of GA's old touchscreen systems. And we've got a LOT of NEWS to catch up on with her today! Her group is also suing in federal court to block the new systems as well and filed this week, in state court, to block their use in a runoff election on March 3rd, given that the huge, brightly-lit touchscreens, as Marks explains, violate voter privacy by allowing others, from all the way across the precinct, to see the "secret ballot" of every voter!

She says "the outrageous way people are being required to vote in Georgia" is "disgusting" and "insidious". The new lawsuit [PDF] notes the new touchscreens (pictured above) are 22 inches high and 14 inches across. "It's very, very brightly lit with incredibly huge fonts. You can see across the room --- from thirty feet away --- you can see what candidate someone is voting for. So there is absolutely no ballot secrecy at all. Anybody in the room, you can see their ballot choices. The press can see it, the public can see it, the pollworkers can see it, their neighbors can see it, their minister, their doctor, their landlord, their boss. Everybody is voting essentially in public!," Marks says.

Marks watched "hundreds of people vote on this" while poll watching at last November's trial first run of the systems during a small municipal election and says, "we just turned our eyes when they get to the place that they're pressing the choice for their candidate, because we can see it from thirty, forty feet away. Everybody talks about it!" The mind-boggling design flaw, she explains, violates state law, and she details what the state court is expected to do about it.

But that's not all we catch up on today regarding the fight to vote verifiably (and secretly) in the state. Marks reports on the current state investigation underway by the GA Sec. of State into both her and Georgia Tech computer professor and voting systems expert Rich DeMillo (also a recurring BradCast guest) for, essentially, having the temerity to investigate concerns about the voting systems in Georgia. Marks explains the ongoing probe and what Sec. of State Brad Raffensperger's office is accusing her and DeMillo of doing. She calls it "completely absurd", adding "of course it is all retaliation. ... It is nothing but an attempt to try to marginalize the efforts of experts and successful activists. And to discourage others."

But, while all of that may be mind-blowing, it may be nothing compared to the new revelations recently uncovered by the expert hired by the Coalition to carry out a forensic investigation of GA's central computer server for its old system. As listeners may recall, data researcher Logan Lamb discovered before the 2016 Presidential election that GA's main election server for the entire state --- including the state's voter registration database, programming for all ballots statewide, and administrative passwords to its voting system --- were discovered to have been sitting on a web server for download by anyone, no password necessary, for at least six months (and probably much longer) before the 2016 Presidential election in which it was thought possible that Georgia might finally flip to "blue".

That researcher, Logan Lamb, alerted authorities about the data's vulnerability. As thanks, he was reported to the FBI by then Republican Sec. of State, now Governor Brian Kemp, as a potential hacker. He wasn't. But he has now been hired by the Coalition as an expert to examine the now-retired server in question. And, last month, according to AP, he made a startling discovery while examining a mirror image of the 2016 server, which was finally turned over by the state in December of 2019. Lamb found evidence that the server may have been hacked by someone who took advantage of a bug that provided full control of the server. Moreover, he found that all of the system's log files --- which would detail all actions taken on the server --- had been wiped out up until November 10, 2016, two days after that year's Presidential election...for some reason. Now why would that be?

We discuss all of that and MUCH more in another jaw-dropping, must-listen segment today with Marks, including our shared embarrassment that in both of our own home counties (she's in Mecklenburg County, NC, the state's most populous and diverse, and I'm in L.A. County, the largest in CA and even the country) elections officials have instituted new, unverifiable touchscreens for the 2020 elections, set for first time use in both counties next week on Super Tuesday!
