The historic trial for Donald Trump's 2016 election interference indictment continues, but was on a break today in New York. That gives us an opportunity to get caught up with all the action since our previous mid-week "ketchup" episode in the first-ever criminal trial of a former U.S. President. We have much to discuss to that end on today's BradCast, but we first kick it off with some election and voting rights news. [Audio link to full show follows this summary.]

  • Democrats "massively outperformed" pre-election polling yet again on Tuesday, in a Special Election for the U.S. House in New York's 26th Congressional District. Timothy Kennedy was predicted to win the seat by 9 points. He won by 36!!!
  • The Trump-appointee heavy 3rd Circuit Court of Appeals voted to uphold a three-judge panel finding that mail-in ballots with missing or incorrect dates on their outer envelope in Pennsylvania must be tossed out, even though, as both sides agree, that date is used for exactly nothing. If a voter, for example, writes 2023 instead of 2024 on the ballot's outer sleeve this November, it cannot be counted, according to the Court. Democrats disproportionately vote by mail, as compared to Republicans, in the Keystone State. Voting Rights advocates are now deciding whether to take the matter to SCOTUS (good luck with that) or rehear the matter on a different basis at the trial court. Both options offer a perilous path before this year's election in the critical battleground state.
  • In an absolutely twisted ruling, a three-judge federal panel ruled on Tuesday struck down Louisiana's newly-drawn second majority-Black U.S. House district, declaring it to be "an impermissible racial gerrymander". The new House map was approved by the state's GOP-controlled legislature earlier this year after they'd lost their long fight in federal court against adding a second Black voting district in a state which has long had just one (out of six), despite Black voters comprising one-third of the state. The new map with the newly redrawn district was already used to select candidates in the state's primaries last month. As explained today, this is likely to become a real test of the corrupted U.S. Supreme Court's often opportunistically used, so-called "Purcell Principle".

At a moment when, as President Joe Biden has aptly warned, both "democracy" and "freedom" will be on the ballot in November, third-party myopia poses a clear and present danger to survival of constitutional democracy in these United States.

Metaphorically, the word "myopia" refers to "cognitive thinking and decision making that is narrow in scope or lacking in foresight or in concern for wider interests or for longer-term consequences." It is a metaphor that, in this current cycle, can be applied to the Presidential campaigns of Green Party candidate Jill Stein, People's Party candidate Cornell West, and the independent candidacy of Robert F. Kennedy, Jr.

Third-party myopia lies in the near mathematical certainty that none of these three candidates can secure a single electoral vote, let alone the 270 needed to become the next POTUS. It also lies in the failure of progressive third-party candidates to recognize the potential for "blowback" --- for example, the creation of a supermajority of corrupt, democracy-subverting rightwing SCOTUS ideologues as an unintended consequence of past third-party Presidential campaigns. Myopia can also be found in the polemic canard that there's no ideological difference between the two major parties. That thinking is false on countless levels, but especially when it comes to the very core of our democracy: voting rights. On that score alone, the two major parties are polar opposites.

By their very nature, third-party campaigns are divisive --- a truly unfortunate circumstance at this pivotal moment in our nation's history. But if ever there was a time for We the People to unite in our resolve that, in the immortal words of Abraham Lincoln, "government of the people, by the people, for the people, shall not perish from the Earth", it would be on Nov. 5, 2024. Only "transformative solidarity" can save our precious constitutional democracy.

Among our stories today...

  • Just to help kick things off...American University distinguished professor Allan Licthman has a "13 keys to the White House" method for predicting who will win any Presidential election. His method has accurately called the winners in 9 of the past 10 elections. (In fact, he was arguably right in 10 out of 10!) We discuss his method and, though he's not yet made his "official" prediction this year, who he believes currently has the upper hand in 2024.
  • Donald Trump was found in criminal contempt of court in his New York trial related to his 2016 election interference via hush-money felony charges. Justice Juan Merchan found [PDF] Trump violated his gag order barring attacks on jurors and witnesses via social media and elsewhere in nine different instances. The judge made clear that incarceration is pretty much the only option left by state law if Trump commits new violations. Veteran federal prosecutor Glenn Kirschner suggests today's ruling may make things "significantly worse" for the disgraced former President, as the bail conditions in all four of his criminal indictments in four different jurisdictions bar him from committing new crimes. We also get you quickly up to speed on some of the Prosecution's new witnesses on the stand in the actual trial on Tuesday.
  • United Auto Workers' chief Shawn Fain is on a roll. Just over a week ago workers at the Volkswagen plant in Chattanooga voted by a 3 to 1 margin to unionize on the heels of the UAW's huge victories last year in their strike against Detroit's Big Three automakers. The victory by workers at the Tennessee plant was the first of its kind in the South. And then, late last week, the union struck a last minute deal for a new contract with Daimler Truck in North Carolina, bringing big pay raises and major benefit increases to workers at four of the company's plants in the state.
  • As we reported previously, 18 Trump allies in Arizona last week were criminally indicted on nine charges each of conspiracy, fraud and forgery related to their failed attempt to steal the 2020 election for Trump in the state via a Fake Electors plot. Over the weekend, state Sen. Jake Hoffman, one of two sitting state Senators indicted as a Fake Elector, was chosen, just days later, by the Republican National Committee to be an official National Committeeman in the 2024 election. Apparently criminal indictments for election fraud are now being rewarded by today's GOP.
  • The full 4th U.S. Court of Appeals on Monday ruled that West Virginia and North Carolina's decision to refuse health care for transgender people under government-sponsored insurance is discriminatory and a violation of federal law. NC blocked gender-affirming care for state employees and WV Medicaid blocked coverage for gender-affirming surgery. The plaintiffs won in an 8 to 6 ruling at the appeals court, though the thoroughly corrupted and illegitimate U.S. Supreme Court Republican majority will almost certainly have the final say in the matter.
  • The U.S. Drug Enforcement Administration will finally remove marijuana as a Schedule III narcotic, according to a report by AP today. It will no longer be treated similar to heroin and cocaine, as the Biden Administration plans to finally reclassify the popular plant as Schedule I after 50 years, now that some 38 states have already legalized cannabis for medicinal and/or recreational use. President Biden previously pardoned thousands of Americans charged with simple possession under federal law and urged states to do the same. Democrats in Congress, in the meantime, are pushing the DEA and Attorney General to drop it from the list of controlled-substances entirely to treat it more like alcohol.
  • The news above is one of a spate of newly or soon-to-be finalized regulations from a bunch of Biden Administration Executive Agencies. You may (or may not) have heard news of late about a cascade of new rules issued by the Administration on everything from Student Loan forgiveness to dozens of new environmental and climate-related regulations. There is a reason they are all happening right about now, and it has to do with the Congressional Review Act, which we explain in detail on today's program.
  • Finally, Desi Doyen joins us for our 1,400th Green News Report! And yes, along with troubling news for Africa and the U.S. Gulf Coast, she's got some historic news of landmark new regulations from the EPA to curb pollution from U.S. power plants. And, yes, that too should be in time to beat GOP abuse of the Congressional Review Act as cited above...

The court takes Wednesdays off in Donald Trump's New York criminal trial on 34 felony counts related to his use of hush-money paid to a porn star to help him cheat his way to winning the 2016 Presidential election. So, today is a good opportunity for us here on The BradCast to get caught up on our trial story so far with two guests who are following it closely. [Audio link to full show follows this summary.]

But, FIRST UP, it was Primary day in Pennsylvania on Tuesday, and though the nominations for both major party's Presidential candidates are long ago all but official, the turnout and results from the Keystone State's closed primaries on both sides are somewhat revealing. Tune in for details, but suffice to say, Joe Biden appears to have outperformed Trump in the narrowly divided battleground state yesterday, where Dem turnout outpaced Republicans and Nikki Haley, who quit the race weeks ago, racked up nearly 17% of the GOP Presidential vote. There were several U.S. House races of note and uncontested primaries for this year's critical U.S. Senate race in PA, where incumbent Democrat Bob Casey is taking on billionaire hedge-fund manager Dave McCormick (who has been less than forthright about his upbringing.)

President Biden signed a long-overdue $61 billion aid package for our democratic allies in Ukraine after overwhelming Senate passage on Tuesday night. That followed on the heels of Saturday's passage in the House by Democrats following an about-face by GOP House Speaker Mike Johnson. The package adopted by Congress and signed by the President today is for $95 billion in all, including funding to replenish Israel's missile defense systems following Iran's attack last week, billions of dollars in humanitarian aid in Gaza, and military aid to Taiwan. The bill also includes a ridiculous measure that may result in the popular social media app TikTok being banned in the U.S.

In reproductive rights (or lack thereof) news, the corrupted far-right majority on the U.S. Supreme Court appeared skeptical during heated Oral Argument on Wednesday over a Biden Administration mandate under the Emergency Medical Treatment and Labor Act (EMTALA). The 1986 statute requires hospitals that accept federal medicare funding to offer emergency, life-stabilizing care to all patients who arrive in the emergency room. After SCOTUS overturned Roe v. Wade, the Administration reminded facilities that such care includes abortions when a patient is "in serious jeopardy" or any condition that might impair bodily functions or organs, no matter the state's own restrictions on reproductive care. Idaho disagreed and sued. The packed rightwing supermajority on the High Court was working hard today to side with Idaho.

There was somewhat brighter related news in Arizona on Wednesday when, after three weeks of trying, Democrats in the state's House were finally able to vote to repeal the state's 1864 territorial ban on nearly all abortions. Three Republicans joined all 29 Democrats to repeal the law. The measure still needs passage in the GOP-controlled state Senate, after which AZ's 15-week abortion ban would take the place of the 160-year old near-total ban.

And THEN, we're joined again today our friends award-winning columnist and blogger HEATHER DIGBY PARTON of Salon and Hullaballoo and former attorney (and former Republican) KEITH BARBER of Daily Kos to get up to speed on this week's fits and starts in Donald J. Trump's New York criminal trial.

After last week's faster-than-expected jury selection, the trial began with Opening Statements on Monday in which prosecutors described Trump's criminal scheme to hide several sexual affairs just before the 2016 election as "election fraud, pure and simple". On Tuesday morning, during a contempt hearing on at least 10 instances in which Defendant Trump violated the court's gag order against attacking jurors and witness, the judge instructed Trump's attorney Todd Blanche that he was "losing all credibility with the court." Says Barber today: "In a list of phrases that could be the worst to come out of a judge's mouth in the first two days of a trial, that would be right at the top of the list."

On both days, shortened for the Passover holidays, David Pecker, former National Enquirer publisher and longtime friend of Trump, took the stand on behalf of the prosecution to discuss hush-money payoffs he'd arranged as part of an alleged conspiracy with Trump and his attorney Michael Cohen to publish damaging stories about Trump's political opponents and quash stories that might be damaging to him. As Pecker detailed, that included paying off a Trump Tower doorman to shut up about his claim that Trump fathered an out-of-wedlock child with a maid who also worked there, and to "catch and kill" the story of Playboy model Karen McDougal who says she carried on a nearly year-long affair with Trump while his wife Melania was pregnant.

Parton describes the first witness in this case as offering several ironies since Pecker "said that their little scheme back in 2015 and 2016 was all fake news. Literally fake news. They made up stories. They killed negative stories about Trump and pushed negative stories that were literally fake news about his rivals. It's like gaslighting to the thousandth power."

Pecker's is expected to continue his testimony on Thursday regarding the $130,000 hush-money payment made to adult film star Stormy Daniels, which was repaid to Cohen by Trump via monthly installments during his first year in the White House. Those payments became the falsified business records at the center of this trial, as the Trump Organization logged them as legal retainer fees, rather than unreported reimbursements that ran afoul of campaign finance laws, according to prosecutors.

Both Parton and Barber find it curious that, while Trump has been relentless in his attacks on witnesses like his longtime attorney and fixer Cohen, he has not said a negative word about his friend Pecker since the former Enquirer chief signed a cooperation agreement with prosecutors in 2018. She believes there is much more that Pecker knows about Trump above and beyond the scandals he's already detailed in this case. Barber concurs: "There's reason to believe that David Pecker has more of Trump's bodies buried in various places."

During opening statements in the disgraced former President's ongoing criminal trial, prosecutors argued the scheme surrounding his hush-money payments to a porn star just before the 2016 election amounted to "election fraud, pure and simple." Similar fraud since then, by Trump and now much of his Republican party, pervades many of our stories on today's BradCast. [Audio link to full show follows below this summary.]

Among our stories today...

  • It's Primary Day in Pennsylvania. We'll have noteworthy results and/or problem reports on tomorrow's program. (Recent elections in PA have revealed serious problems with the touchscreen voting systems still shamefully used in a number of jurisdictions.) But the election in the Keystone State today --- as some voters are reportedly struggling with newly implemented Photo ID requirements --- also provides a reminder as to why it's a good idea to vote in primaries, even when races at the top of the ticket may already be foregone conclusions.
  • Donald Trump's election-fraud-via-hush-money criminal trial in New York continued on Tuesday. We offer a a few quick updates. One point we missed Monday's opening statements, included the fact that prosecutors say they have hand-written documentation from longtime Trump Organization CFO Allen Weisselberg as to why Michael Cohen was paid $420k as reimbursement for his $130k payment to porn star Stormy Daniels. Today, the day began with a contempt hearing over at least ten instances in which prosecutors allege that Trump has violated the court's gag order on attacking jurors and witnesses. The judge has yet to issue his ruling, but the hearing culminated with Trump's attorney Todd Blanche being upbraided by a frustrated Justice Juan Merchan, who told him, "You are losing all credibility with the court." For that, it appears, Trump's campaign and associated groups have been paying about $145,000 in donor money for legal fees each day since early 2023, according to newly released numbers. After the jury arrived, the trial's first witness continued his testimony. That would be former National Enquirer publisher, longtime Trump pal, and alleged "catch and kill"/hush-money co-conspirator David Pecker.
  • Arizona's 2022 Republican election losers, Kari Lake and Mark Finchem, both falsely claim their elections, for Governor and Sec. of State respectively, were stolen from them somehow, by the Republican officials who run elections in the state's largest County. They sued in 2022 and have lost in court after court ever since. On Monday, the corrupted rightwing U.S. Supreme Court also rejected their case. They are both running again in 2024, for U.S. Senate and state Senate respectively. What could possibly go wrong?
  • Speaking of 2024 Republican U.S. Senate candidates in battleground states, Wisconsin's Eric Hovde really, really wants you to know that he totally thinks "elderly should absolutely vote". Even after his previous comments about elderly voters in nursing homes that really kinda makes it seem otherwise.
  • The Trump Campaign and the RNC (now effectively one and the same) have announced their plans for an "Historic, 100,000 person strong Election Integrity operation"! We've got a few thoughts about what that really means. Though it probably doesn't help that a statement from Trump himself included in the announcement echoes almost precisely a statement long attributed to Josef Stalin that "it's not who votes that matters, but who counts the votes".
  • As to actual election fraud, as usual, the call is coming from inside the Republican house. This time, it's a guy named Austin Smith, an Arizona's Republican state Rep. and top leader of Turning Point Action --- a group which has long echoed Trump's false 2020 election fraud claims. Smith has apparently been caught submitting dozens of signatures, in his own hand-writing, for his own reelection campaign. While denying the charges, now being investigated by the AZ Attorney General, Rep. Smith has since resigned from Turning Point and called off his reelection campaign. But really, he insists, he didn't do it!

Nothing but huge news --- all of several different sorts --- on today's BradCast. [Audio link to full show follows below this summary.]

FIRST UP: After months of stalling to the benefit of Russian dictator Vladimir Putin and our wannabe dictator former President, Republican House Speaker Mike Johnson, to his credit, bucked the majority of his own caucus and reversed course last week on Ukraine. The full reason for his sudden about-face remains unclear --- and a majority of his own party still voted against aid to our besieged democratic allies in Europe --- but whatever the reason, it is very good news for both Ukraine and global democracy. The full Democratic caucus in the House backed Johnson's plan to adopt some $95 billion in military, humanitarian and economy aid to Ukraine, Israel (including more than $9 billion in assistance to residents of Gaza), Taiwan and other Indo-Pacific allies. Far-right House Republicans derided the legislation as "America Last" aid to foreign wars and have been threatening to invoke another motion to vacate the Speaker's chair. So far, however, they've failed to pull the trigger.

NEXT UP: The first criminal trial of a former (and perhaps future) U.S. President got underway for reals on Monday in New York, with opening statements presented by both sides in what Prosecutors are characterizing as a 2016 "election fraud" via hush-money case against Donald J. Trump. We step through the opening presentations of each side's case today. NY prosecutors detailed how they intend to demonstrate that Trump, in a panic following the release of the infamous Access Hollywood tape, where he boasted about assaulting women, took measures just before the 2016 election to pay off women he was alleged to have had affairs with, including Playboy Model Karen McDougal and adult film star Stormy Daniels.

The schemes to silence the women, according to state prosecutor Matthew Colangelo, were carried out via an elaborate conspiracy between Trump, his then attorney and fixer Michael Cohen, and then publisher of the National Enquirer, David Pecker. The plot involved 34 allegedly falsified business transactions --- including checks signed by Trump while serving in the White House --- disguised as legal retainers to Cohen, rather than reimbursement money for hush-money payments. The Trump Organization couldn’t cut a check to Cohen with the memo "reimbursement for porn star payoff," so "they agreed to cook the books," said Colangelo, to make the payments appear to be for legal services.

The Enquirer produced what prosecutors described as "checkbook journalism" on Trump's behalf to "catch and kill" McDougal's story of a nearly year-long affair with Trump while his wife Melania was pregnant in 2006. And Cohen paid Daniels directly in exchange for signing a $130,000 non-disclosure agreement that prevented her from revealing her 2006 tryst with Trump while Melania was nursing their infant son. "He covered up that criminal conspiracy by lying in his New York business records over and over and over again," Colangelo told the jury, detailing what he characterized as "election fraud, pure and simple."

In Trump's defense, his attorney Todd Blanche made the case that none of the actions described by prosecutors are crimes. "I have a spoiler alert," he told the jury, "there’s nothing wrong with trying to influence an election. It’s called democracy."

Prosecutors called Pecker as their first witness on Monday, but the court session was cut short on due to a dental emergency for one of the jurors and a planned early finish to the day due to the Jewish Passover holiday. Pecker is set to return to the stand for the prosecution on Tuesday.

FINALLY: The story that (understandably, given the above) is not getting nearly the attention it deserves today. On Friday, by an overwhelming 3 to 1 margin, workers at a Volkswagen plant in Chattanooga, Tennessee voted to unionize by joining the United Auto Workers. The landmark vote came after a full-court press against it the day before the unionization election was to begin last Wednesday, via an unprecedented joint statement by six Republican southern state Governors. TN's Gov. Bill Lee and the Governors of Alabama, Georgia, Mississippi, South Carolina and Texas warned in the statement against workers voting to join the union, charging that it would result in jobs leaving the state.

Nonetheless, VW's workers overwhelmingly approved the historic resolution, in what UAW leader Shawn Fain described on Sunday to our guest today, veteran labor journalist and author STEVEN GREENHOUSE of The Guardian, as "the first domino to fall" in what Greenhouse describes as the UAW's "ambitious $40m campaign targeting 13 automakers, including VW, Mercedes, Tesla, BMW, Toyota, Nissan and Hyundai, with a total of 35 non-union plants across the US."

"It's a very big deal," Greenhouse tells me today. "It's a big deal because unions have had a very hard time organizing the South. Indeed, unions and union leaders are often told 'it's impossible to win the South, don't even bother.' Factory-workers are so worried that if they vote to unionize, the plant will close and move overseas. So this victory really bursts the citadel, breaks down the tradition of all these losses in the South. This finally shows you can win."

In fact, two previous efforts to unionize the same VW plant failed some 10 and 15 years ago. But now, post-pandemic and, most notably, with the rise and inspiration of the UAW's new, charismatic leader Fain, there is renewed action and optimism. "This gives a lot of momentum, a lot of energy and inspiration to autoworkers, and I think to the larger labor movement," says Greenhouse, the author of several books on the subject including his latest, Beaten Down, Worked Up: The Past, Present and Future of American Labor.

We discuss, among other things today: why this effort at VW succeeded where previous votes failed; how unprecedented the statement was from those six southern Governors (In Greenhouse's interview with Fain on Sunday, the labor leader called them "liars" and "puppets for corporate America" that "don't give a damn about working-class people...even though workers are the ones who elect them."); how the unionization in the auto industry may inspire similar efforts by workers in other industries for the first time in man years; whether the UAW will actually be able to unionize Tesla, as led by the very anti-union Elon Musk, as well as the other non-union plants being targeted by the UAW around the country, following their wildly successful strike against Detroit's Big Three automakers last year.

One of those targeted non-union plants belongs to Mercedes-Benz in Vance, Alabama where workers are scheduled to hold a unionization vote next month. If both VW and Mercedes are unionized, as Greenhouse reported a Georgetown labor historian observing last week, it would "be nothing less than an earthquake [and] the biggest breakthrough in private-sector organizing in decades."

You may be happy to know we don't begin today's BradCast with news about the disgraced former President. But you may be less happy about what we do lead with, especially if you own a home or a car or live on Planet Earth. [Audio link to full show follows this summary.]

Among our many stories today...

  • Recently, Federal Reserve Chair Jerome Powell confirmed that, thanks in no small part to our quickly worsening climate, insurance rates for cars and homes continue to skyrocket. Yes, manmade climate change is a key factor in slowing the decrease of inflation (which, of course, is just one reason Republicans would rather do nothing about it). As the frequency and intensity of weather-related disasters quickens (just ask the folks in New Orleans who were swamped with some 8 inches of rain in a matter of hours last week), the cost of insurance is spiking, becoming unaffordable for many and even unattainable in a number of coastal states. You may soon discover that your home is worth a lot less than you think, thanks to the climate crisis. We step through some of those grim details today, the trillions of dollars it is ALREADY costing Americans, and the even grimmer news about what is still to come unless and until we can end the burning of fossil fuels that is only beginning to wreak so much havoc across the entire globe.
  • We started reporting on this story last week, when it didn't seem like it could really be a story. Well, it's beginning, at least, to look more like it really could be a real story. Ohio's Republican Attorney General has now joined the state's Republican Sec. of State to say they will not allow Joe Biden on the state's ballot this November unless the Democratic Party certifies his candidacy before the state's statutory deadline of August 7. The Democratic National Convention, which is set to officially nominate the President, doesn't happen until August 19. When a similar situation occurred in 2020 --- which might have kept Donald Trump off the ballot --- the GOP state legislature simply changed the statutory deadline for that year. But now, because it's only Democrats whose convention isn't scheduled to take place until after OH's 90-day deadline before the November 5th election, Buckeye State Republicans seem to be suggesting they may actually not put Biden on the ballot...as impossible as that seems to believe. Let the lawsuits begin...
  • The Nevada Supreme Court on Thursday overturned a lower court ruling that had blocked a broad, Constitutional "Reproductive Freedom" measure to protect prenatal care, abortion, vasectomies and infertility care from appearing on this November's ballot in the critical battle ground state. Supporters of the measure are celebrating today, but are also said to be gathering signatures for a second measure that will focus only on abortion rights for this year's ballot.
  • After two of seven previously-seated jurors were dismissed on Thursday morning in Donald Trump's criminal trial in New York, seven more were seated before the day was done. Barring any other dismissals, that fills out the 12 jurors that will be needed to begin the case proper, once six alternate jurors are chosen. The judge admonished the press for reporting enough details about jurors that one who asked to be removed this morning said that friends had been able to identify her from media reports. Also, after prosecutors earlier this week sought sanctions against Trump for three violations of his gag order, they cited another seven incidents since then. That issue will be heard next week. Opening Statements in the trial could begin as early as Monday if the case continues to move briskly forward.
  • Very exciting news is underway in the South this week, specifically in Tennessee, where workers at a Volkswagen plant in Chattanooga are now voting to unionize and join the United Auto Workers. Workers at the plant seem confident that the election will be successful. But that's just the first of 13 non-union automakers who are being targeted for unionization by the UAW since labor unions huge victories last year in strikes against GM, Ford and Stellantis (which now owns Jeep and Chrysler). Another election is likely to happen soon at a Mercedes-Benz plant in Alabama, with 36 non-union plants targeted in all. If workers are successful in unionizing at both VW and Mercedes in the two southern states, according to one labor historian, it "would be nothing less than an earthquake" for the labor movement and its "biggest breakthrough in private-sector organizing in decades." It apparently has anti-labor Republicans worried. In a joint statement described by one expert as "unprecedented and shocking", six southern state governors, all Republican --- from Tennessee, Alabama, Georgia, Mississippi, South Carolina and Texas --- issued a joint statement on the day before voting began at VW, charging that "unionization would put our states' jobs in jeopardy." Kentucky's Democratic Governor, Andy Beshear, by contrast, announced last week that he was "proud to stand shoulder-to-shoulder" with the UAW.
  • Finally, in case we didn't frighten you enough with our opening coverage of the catastrophic, climate change-fueled weather driving insurance rates through the roof, Desi Doyen joins us for our latest Green News Report with much more to frighten you about. But she also has good news for workers as well, and bad news for the fossil fuel industry tools at Fox "News"...

Even Joe Biden is now making jokes about the plummeting value of the former President's latest scam, his attempt to turn his failing social media site into a Wall Street meme stock. As discussed on today's BradCast, it ain't working. At least for now. [Audio link to full show follows this summary.]

The value of Trump Media & Technology Group, trading under Donald Trump's initials as DJT, has lost about two-thirds of its value since it debuted as a publicly traded stock at the beginning of the month. If it "drops any lower," Biden quipped at a rally in Pennsylvania today, Donald Trump "might do better under my tax plan than his."

When it first went public, DJT quickly shot up to nearly $80 per share. It has been nose-diving by double-digit percentages pretty much every day since. The stock closed on Tuesday at less than $23 a share. On Monday night, the Washington Post's Drew Harwell posted a piece that is nearly equal parts hilarious, for those who enjoy the schadenfreude of Trump losing billions of theoretical dollars in just a few weeks time, and heart-breaking, for those who feel for the hundreds of thousands of Trump fans who have lost, in some cases, their "whole nest egg" because they were brain-poisoned enough to buy into Trump's latest fraudulent scheme.

Harwell's report of the reaction to the plummeting value of the stock by Trump supporters themselves on Truth Social, the money-losing venture that is currently DJT's only actual business, is harrowing and amazing. (But just more evidence of the "deep state", if you believe some of the denialists who are still buying more shares every day now!) But it serves as yet another reminder that, as sick as Trump is, it is our nation itself, and its people, whose illness we must eventually figure out how to attend to.

Anyway, tune in to today's show for many more thoughts on the above, and a whole bunch of other news of the day, including...

  • Trump's recent Truth Social video rant on how Presidents simply can't do the job of Presidenting without absolute criminal immunity, the way the Founders wanted it. Then again, there is no evidence that the Founders wanting anything of the sort (quite the opposite, in fact); every President of the United States before (and since) Trump has been able to function just fine without it; and --- oh, yeah --- as Trump said in a separate rant just one day earlier, apparently "Crooked Joe Biden...can't put two-sentences together" but has been clever enough to mastermind all four of Trump's current criminal indictments in two different states and two separate federal jurisdictions, all without leaving a trace of evidence. "At what point are the actions of a sitting President...against his opponent for election interference considered illegal?," Trump asked. But, according to Trump just one day earlier, even if the President had anything to do with Trump's criminal indictments (he doesn't) it would still never be illegal!
  • The disgraced former President's criminal trial in New York, on 34 federal counts related to hush-money payments to a porn star to help him win the 2016 election, seems to be moving faster than expected. On Tuesday, seven jurors were selected on the second day of the trial. Just five more jurors and six alternates are needed before opening statements can begin, perhaps as early as the beginning of next week.
  • On Tuesday, House GOP lawmakers finally delivered their two articles of impeachment against Dept. of Homeland Security Secretary Alejandro Mayorkas to the U.S. Senate, where the high-crime-and misdemeanor-free charges are expected to die either very quickly or somewhat less quickly, in an impeachment trial that, according to the rules, must begin immediately and continue until complete. Good thing there is nothing else Congress needs to be doing right now.
  • The far-right conspiracy outlet known as One American News (OAN) has reportedly struck a confidential settlement with voting system vendor Smartmatic, in the defamation lawsuit brought against the Trump-supporting TV channel for lies told about the company's voting systems following the 2020 election. Despite repeated false claims by OAN anchors and guests that Smartmatic software was used "in 30 states" to steal the election for Biden --- with zero evidence in support of those claims --- the company's voting systems are only used in one U.S. jurisdiction: here in Los Angeles County, where even brain-poisoned MAGA dupes aren't dumb enough to claim the election was stolen from Trump.

    For the role that we personally played in confusing Sidney Powell, Rudy Giuliani, and the OAN clowns regarding Smartmatic's role in U.S. elections, I can only say: "You're welcome!"

    The terms of the settlement are undisclosed, but it follows on last year's $787 million settlement between Fox "News" and Dominion Voting Systems over similarly false claims, as well as a settlement between OAN and a former Dominion executive. There are many other similar defamation suits still pending, however, by both Smartmatic and Dominion over lies told about them following 2020 by other well-known Trump conspiracists.

Special coverage of an historic day with Heather Digby Parton of Salon, attorney Keith Barber of Daily Kos...

After a number of quick news headline since our previous BradCast last week, it's on to the biggest story of the day: the first day of the first criminal trial of a former U.S. President. [Audio link to full show follows this summary.]

Of course, the nation has never seen anything like it. I might suggest we'd otherwise be unlikely to see anything like it again in our lifetimes, but for the fact that the trial on 34 felony counts against Donald J. Trump that began in New York on Monday is just the first of four criminal trials awaiting the disgraced former President and presumptive Republican Party nominee for the 2024 Presidential election.

Jury selection finally got underway late on Monday after a series of pretrial arguments in the indictment brought by Manhattan District Attorney Alvin Bragg. It alleges that that Trump created a series of fraudulent business records with the intent to hide a $130,000 hush-money payment to porn star Stormy Daniels just weeks prior to the 2016 Presidential election. The payment was made amid Trump's panic in the wake of the release of the Access Hollywood videotape in the closing days of the 2016 race, during which Trump is heard bragging about sexually assaulting women.

Then, while serving as President of the United States, Trump signed and sent monthly payments to his then personal attorney/fixer Michael Cohen to reimburse him for the payment to Daniels on Trump's behalf, as well as for several hundred thousand additional dollars for Cohen's efforts.

The payments were meant to prevent Daniels from discussing a sexual affair she says she had with Trump ten years earlier, while Trump's wife Melania was nursing their newborn son.

The payments, according to Federal Elections Commission (FEC) findings, violated federal campaign finance laws which, Bragg alleges, changes the charges for Trump's falsified business records from misdemeanors to felonies. Thirty-four of them, in fact, all in service of cheating to win the 2016 election. Bragg describes the scheme --- just as Trump would, had a Democratic candidate done anything even close to it --- as "election interference".

We're joined today for special coverage of the legal, political and cultural significance of this historic day by two longtime friends of the program: Award-winning columnist HEATHER DIGBY PARTON of Salon and her Hullaballoo blog, and former attorney and former lifelong Republican KEITH BARBER, who now covers legal and constitutional issues as "KeithDB" for the progressive Daily Kos website.

Both offer explanations of the alleged crimes themselves and their insights on the Prosecution's witness list, which includes, among many others, Cohen and Daniels as well as Playboy model Karen McDougal --- who is said to have carried out a year-long sexual dalliance with Trump during Melania's pregnancy --- and David Pecker, the head of the company which owned the National Enquirer in 2016. Pecker has since admitted to buying McDougal's story to make it go away --- a so-called "Catch and Kill" scheme --- on behalf of Trump, his longtime friend.

Barber details some of the complexities of the NY criminal case and how unusual it is for prosecutors to call some 6,000 potential jurors. Parton discusses the historic, political and cultural ramifications of this trial. Both offer thoughts on the likelihood that Trump ends up spending time in jail, either for the crimes themselves, which could result in a sentence of up to four years, or for violating the gag order placed on Trump by the trial judge, Justice Juan Merchan, after Trump has spent weeks attacking potential witnesses and the judge's family. Prosecutors charged today that Trump violated the gag order three times over this past weekend alone. A hearing on that matter will be held next Wednesday, April 24 Tuesday, April 23.

"It is a shocking, unprecedented moment to see an ex-President --- and current nominee for one of the major parties for President --- whining like a 5-year-old every five minutes about being politically persecuted because he committed the crime of paying hush money to an adult film actress, and in the process of doing that, violated New York state law," Parton argues. "And motivated at the time in order to win an election. What he keeps calling 'election interference' is actually true."

Barber notes that what Trump continues to complain about "a two-tiered system of justice", which somehow disadvantages HIM. That might be true, Barber suggests, "if Trump did not face the same justice that Michael Cohen did for being his co-conspirator in all of this, and really doing the same thing." Cohen served a year in federal prison after pleading guilty to participating in the criminal conspiracy "directed" by Trump the then-President. "This is an equalization of justice. Bringing this case to trial is saying, 'Look, the guy who Cohen helped is also going to be held accountable.' And I think it's a triumph for justice that that is going to be happening."

As you might guess, there is a lot to cover on this historic first day of Trump's first criminal trial. And, as shameful as it all is, we also find the time for more than a few laughs along the way during today's Special Coverage...

Keep hope alive. We've got a bunch of mostly good news stories for you on today's BradCast! [Audio link to full program is posted at the end of this summary.]

Among those stories today...

  • EVERY VOTE MATTERS: The great state of California has finally wrapped up its month-long tabulation and canvassing following its March 5th Super Tuesday primaries. And, in one race, there's a bit of a first-of-its kind surprise. Ever since 2012, the state has run a top-two primary system, where candidates from all parties run in the same primary race and the top two vote-getters, regardless of party, go on to compete in the general election. This year, however, in a U.S. House race for an open seat in the state's 16th Congressional District, there was an exact tie among the 2nd and 3rd place candidates, who each received exactly 30,249 votes. So, three candidates --- in this case, all Democrats --- will go on to the November general election and its anybody's guess who may win.
  • BIDEN RISING: After months of polls showing Joe Biden trailing Donald Trump in national polling, now that the general election is in sight with Americans finally beginning to understand that --- like it or not --- it will almost certainly be a Biden v. Trump match-up, the polls are finally turning in favor of the President. It's a fairly small shift, but a meaningful one, with a bevy of high quality polls almost all finding Biden either ahead of or tied with Trump. There are lots of caveats for these numbers, as discussed today (for example, it's only April and these numbers could change, and they don't include third-party candidates, etc.), but the general news should come as an encouraging turn of events for those who have been freaked out for months about Biden's performance against Trump in early polling.
  • RIGHTWING DIRTY TRICKSTERS PAY THE PRICE: Bufoonish rightwing clowns Jacob Wohl and Jack Burkman, who sent misleading robocalls to thousands of Black voters, lying to them about being arrested and more if they voted in the 2020 election, continue to pay a price for their dumb, offensive, dirty tricks. The pair will now have to pay as much as $1.2 million for their violations of civil rights laws in New York, according to a consent decree struck with the state's Attorney General Letitia James. That follows previous penalties for the pair of a more than $5 million fine by the Federal Communications Commission last year, and two years of probation plus 500 hours of voter registration to which they were sentenced in Ohio, another of several states where their scam played out.
  • MORE RIGHTWING DIRTY TRICKSTERS PAYING A PRICE: A woman named Aimee Harris who pleaded guilty to stealing a diary belonging to President Biden's daughter Ashley Biden before the 2020 election, when she sold it for $40,000 to rightwing dirty trickster James O'Keefe and his nearly-defunct fake "news" outfit called Project Veritas, was sentenced to a month in prison, three in home confinement, two years of probation and to return the money she raised from her crimes. Her partner in the scam, who was smart enough to cooperate with federal authorities, will be sentenced later this year, suggesting that criminal charges may still be in the offing for the disgraced Republican operative O'Keefe. His home was searched by the FBI after the crime initially came to light. Keep hope alive.
  • NOPE: Yet another New York appeals court judge has rejected yet another last-ditch legal attempt by Donald Trump to delay his trial on 34 felony fraud counts related to his hush-money payments to porn star Stormy Daniels to help him cheat to win the 2016 election. That criminal trial is now still set to begin with jury selection this coming Monday. In this latest court denial, the NY appellate judge dismissed Trump's motion regarding the partial gag-order against him --- expanded after he identified and attacked the daughter of trial Judge Juan Merchan on social media --- charging the order was somehow "unconstitutional". The bad news for the disgraced former President comes just one day after his bid for a change of venue for the trial was similarly denied by a different appellate judge.
  • YOUR MONEY IS NO GOOD HERE: Last week it appeared that Trump successfully avoided, for now, the seizure of his property as he appeals his liability in New York's $454 million civil fraud judgment against him. He was allowed to file a reduced bond for just $175 million with the state. As it turns out, however, there are a lot of problems with that bond, as secured from a sleazy California outfit known as Knight Specialty Insurance Company. A LOT of problems. More and more of which have been coming to light ever since NY A.G. Tish James, last week, informed the judge in the case that Trump's bond appears to be deficient. Among those problems: the surety company is not licensed to issue bonds in New York; the company does not have enough "capital and surplus" to meet state standards (or even cover the amount of the bond!); and the bond itself appears to suggest Trump is responsible for the $175 million dollars, rather than Knight, which is not an actual bond at all. A hearing on the matter is scheduled in NY civil court for April 22.
  • HAPPY ENDING: Finally, Desi Doyen joins us for our latest Green News Report, with news on what scientists suggest could be a terrifying hurricane season; good news for California's mountain snowpack; disturbing news about the Colorado River water supply; and some long-overdue good news from the Happiest Place on Earth...

Trump staring down barrel of both civil and criminal accountability in Empire State; Also: Biden forgives another $6B in student loans; U.S. calls for 'immediate, sustained ceasefire' in Gaza; Scientists baffled by spike in record year of global heating...

On today's BradCast: It's crunch time for our disgraced former President in his old home state. Sad! But they ain't playin' in New York. So, get your popcorn ready. [Audio link to full show follows this summary.]

But first, a few other news items of note...

  • The past year has been the warmest on record globally --- on both land and sea --- for likely the last 100,000 years. Some of that warming has long been predicted by scientists, thanks to the continuing release of emissions from burning fossil fuels that are the main cause of global warming. But the sudden spike over the past 12 months has been far worse than predicted based on years of data and computer modeling. Top climate scientists are now baffled about the cause and wondering if, perhaps, they've been low-balling the climate change crisis in their modelling.
  • More good news for student loan borrowers today. The Biden Administration is forgiving another $6 billion in loans to some 78,000 public-service workers who were promised over a decade ago that their service would eventually help forgive their debt, only to be lied to and misled by schools and private companies administering their federal loans. President Biden is correcting that today, and will also be informing an additional 380,000 borrowers that they will also see their debt wiped out over the next two years if they keep their payments up to date. As of now, the Administration has forgiven nearly $144 billion in debt, even after the corrupted U.S. Supreme Court corruptly blocked his original plan for $430 billion in debt relief.
  • Secretary of State Antony Blinken in Cairo on Thursday called for an "immediate, sustained ceasefire" and the release of all hostages in Gaza. He said the Administration is supporting U.N. Security Council resolutions calling for same, and reiterated U.S. opposition to Israel Prime Minister Benjamin Netanyahu's promised offensive in Rafah unless accommodations are in place to prevent still more harm, death and starvation of the civilian population sheltering in southern Gaza. At the same time, the far-right Prime Minister --- facing felony charges whenever he finally leaves office --- is taking aim at high-ranking Jewish leaders in the U.S. like longtime Israel supporter and Democratic Senate Majority Leader Chuck Schumer, for having dared to call for new elections in Israel.
  • New campaign fundraising numbers are out this week via the Federal Election Commission and reveal that the Biden Campaign and his affiliated fundraising groups are far outpacing the Trump Campaign and its affiliated groups. The Biden Campaign now has more than double the amount of cash on hand as Trump does, even as most of the funds raised by the former President has gone to cover his legal bills over the past year.
  • But the jig may finally be up for Donald Trump in New York, where he must come up with some $464 million dollars in cash or bonds by this Monday to avoid the start of seizure of his assets by the state following his loss in the state's civil trial against him, his company and his two eldest sons for massive bank, tax and insurance fraud. Reportedly, the office of state Attorney General Letitia James has already filed judgements in both New York City (home of Trump Tower, 40 Wall Street and other major property assets) and Westchester County (the location of one of his golf courses and an estate he owns called Seven Springs). The filing of judgements is the first step toward the state's seizure of Trump properties as well as bank and brokerage accounts. That process could begin as early as Monday if Trump is unable to come up with a half-billion dollar bond or get some other form of emergency relief from the NY state appeals court between now and then. Moreover, today the trial judge in the case expanded strict oversight by a court-appointed monitor of just about every financial event or attempted event at the Trump Organization to help ensure the longtime con-man is unable to move funds around or pull off any other chicanery to avoid accountability. As noted, they ain't playin' in NY!
  • But it's not only civil accountability barreling toward Trump in New York. The judge overseeing his upcoming criminal trial, likely to begin next month, related to hush-money payments made before and after the 2016 election, issued a ruling this week on what evidence may and may not be presented at trial by each side. As WaPo's Jennifer Rubin detailed today, it "couldn't have gone worse for Trump". Judge Juan Merchan, she reports, "ruled against [Trump] in virtually all of his motions to exclude evidence. By contrast, the judge largely granted Manhattan District Attorney Alvin Bragg’s motions to exclude evidence for trial that Trump believed might be exculpatory." The ruling, Rubin suggests, indicates Merchan "will not indulge Trump’s antics nor allow the trial to devolve into a spectacle." We'll see about that. But, she adds: "Based on these rulings, Trump should be quaking in his boots."

Lots (and lots) of news on today's BradCast, from Israel to TikTok foolishness to lots (and lots) of Trump accountability news. [Audio link to full show follows below this summary.]

Among our lead stories today...

  • Senate Majority Leader Chuck Schumer, an ardent, longtime supporter of Israel, called on Israel's Prime Minister Benjamin Netanyahu to hold new elections. New York's Schumer, a Jew who happens to come from NYC, which has the world's largest Jewish population, cited the far-right Prime Minister as an obstacle to peace who is turning Israel into the world's "pariah". In a 40-minute floor speech, the Senate's top Democrat charged that the unpopular Netanyahu, who is avoiding facing felony charges while remaining in office and avoiding a new election until his war against Hamas in Gaza is over (which it will never be, as long as these are the stakes), "has lost his way by allowing his political survival to take precedence over the best interests of Israel." This is a very big deal in a whole bunch of ways. We discuss some of them today.
  • There has been a bipartisan push this week to adopt a bill that would result in the banning of the TikTok app in the U.S. if the company which owns it does not divest from China. Donald Trump, who, as President, issued a failed Executive Order to ban the popular social media video app (it was blocked by the Courts for violating First Amendment free speech rights) has recently flip-flopped to support the app, after meeting with a billionaire hedge fund manager heavily invested in the company. But, despite the popularity of the bill which has now passed in the House, we discuss why it is a terrible idea. Social media regulations are long overdue. But the menace of China's (theoretical) ownership of TikTok is no worse than Elon Musk's actual ownership of Twitter/X. And, in case Democrats failed to notice today, Trump's former Treasury Secretary, Steven Mnuchin, announced that he is trying to bring together an investor group to purchase the company. Still think this is a good idea, Dems?
  • The UK's Guardian, in an excellent piece today, details the Trump business associates who prosecutors say paid Alexander Smirnov $600,000 in 2020, the year that Smirnov, now charged with lying to the FBI, fed them false claims that Joe Biden accepted bribes from the Ukrainian energy company named Burisma. Prosecutors have also charged that Smirnov met with Russian Intelligence officials before passing on the lie to the FBI, which House Republicans cited at the center of their doomed impeachment probe of the President. So, Smirnov passed on disinformation from Russian intelligence to the FBI and was paid by longtime business associates in the U.S., UK and Dubai of the then-President who was running for re-election that year. And, after losing the election, those lies were used to try and impeach the guy who defeated him. This movie keeps getting worse and worse.

In Trump accountability news today (there is lots of that as well)...

  • U.S. District Court Judge Aileen Cannon, appointed by Trump after he lost the election, but before he left the White House, rejected a Team Trump motion, for a happy change, in the case of the highly classified documents he stole when leaving the White House, and then hid from prosecutors seeking to get them back. Cannon turned down his attempt to dismiss the felony charges based on his claim that the Espionage Act he is charged under is too vague.
  • Meanwhile, the one criminal case that Trump is facing which had not yet been derailed by Trump's various delay tactics --- his New York state hush-money case --- may now be delayed following a tranche of thousands of documents from a previous federal investigation recently turned over to Manhattan prosecutors. We explain what happened here and why the NY D.A.'s office cites the defendants actions for this surprise revelation. Prosecutors have agreed to a 30-day delay before the start of the trial, which was previously scheduled to begin on March 25. The judge overseeing the case, however, Judge Juan Merchan, has yet to decide how much, if any, delay he will allow.
  • Trump's former White House trade advisor, and one of his top 2020 "voter fraud" fraudsters, Peter Navarro must report to federal prison in Miami next Tuesday, according to a federal appeals court panel today. Navarro was charged with criminal contempt of Congress for refusing to answer subpoenas from the House January 6 Committee. Like former Trump advisor Steve Bannon, who has managed to remain free pending appeal, Navarro was sentenced to four months for his crimes.
  • And, in a bit of Trump accountability news that appears to have slipped through the cracks, last week, a judge in the UK ordered Trump to pay some $382,000 in attorneys fees to the lawyers of former British spy Christopher Steele and his private intelligence company. Trump had filed sued in the UK, charging that the "shocking and scandalous" allegations in the so-called Steele Dossier had harmed his reputation. (Please hold your laughter.) The British judge determined the claims were "bound to fail" and ordered Trump to cough up legal fees to cover the frivolous suit. In 2022, Trump lost a similar case he filed in Florida against Steele, Hillary Clinton and a number of top former FBI officials. That case was also tossed and he was ordered to pay nearly a million dollars for that fiasco. I guess he's still not tired of winning.
  • Finally, Desi Doyen joins us for our latest Green News Report with cruel news out of Ron DeSantis' Florida; disturbing news about the fossil fuel industry's continuing methane leaks; terrifying news about GOP plans if Trump retakes the White House; and sad news for California salmon...

I should be in bed nursing my illness (whatever it is), rather than doing today's BradCast. But given the firehose of news, some of it huge, that broke after yesterday's guest-hosted show with Nicole and Desi (thank you, guys!) and today, I felt I had to come in for this one. Nasal congestion be damned. [Audio link to full show follows this summary.]

Back in 2018, as Trump-nominated Supreme Court Justice Brett Kavanaugh was lying his way through his Senate Confirmation hearings, he made what sure sounded like a threat at the time. "This confirmation process has become a national disgrace," he whined through angry tears. "And as we all know, in the United States political system of the early 2000s, what goes around comes around."

There has been a boatload of important news over the past 24 hours. But what may have been Kavanaugh's long-promised "comes around" moment may have finally occurred last night. The U.S. Supreme Court came up with at least 4 votes to hear Oral Argument of Donald Trump's ridiculous claim that Presidents enjoy "absolutely immunity" for any and all crimes they may commit while in office --- including ordering Seal Team Six to murder domestic political opponents, as Trump's lawyer's argued in this case at the lower D.C. Court of Appeals.

The federal appellate court, as well as the trial court below it, unanimously rejected the argument. But, rather than taking up the case three months ago, when Special Counsel Jack Smith asked them to, the corrupt SCOTUS waited more than two months before deciding, in a terse, one-page order [PDF], to "expedite" the matter by hearing it...seven weeks from now. The question will be: "Whether and if so to what extent does a former President enjoy presidential immunity from criminal prosecution for conduct alleged to involve official acts during his tenure in office." --- Which "official acts" they may be referring to are uncited.

In the bargain, Trump's previously scheduled May 4th federal trial date for attempting to steal the 2020 election remains on on pause and may not now even begin before the 2024 election.

At the same time, in New York state court on Wednesday, an appellate judge, within hours after Trump's filing, rejected his attempt to offer a $100 million bond to prevent Attorney General Letitia James from beginning seizure of his assets in about 30 days for failure to post cash or a bond for the full $454 million penalty he faces for a decade of massive fraud via his corrupt real estate company. And Trump's criminal trial in the state, on 34 charges related to cheating to win the 2016 election with hush-money payments to a porn star, is set to begin at the end of next month.

Given my physical condition of late, we called in our good friends and very wise longtime fellow bloggers HEATHER DIGBY PARTON of Salon and Hullabaloo, and 'DRIFTGLASS' of The Professional Left Podcast, to help make sense of these key, historic events. They each offer context and analysis of what appears --- to them at least --- to be one of the most corrupt actions ever taken by our corrupted, far-right, Trump-appointed supermajority on the High Court.

Driftglass argues the news from the Court on Wednesday is that "It's a corrupt court. And that corrupt court has rendered a corrupt decision," underscores his belief that Trump will never see a day in prison. Digby reminds us that true accountability was always going to come from only one place: the voters at the ballot box this November. "I'm sorry to have to tell you," she tells me, "but it's going to have to be a grinding out of a Presidential campaign and people are going to have to vote this guy out."

We've got a lot of ground to cover on today's program, with smart insights from both of them as usual, even if I don't have the energy to document much of it here for you today. So, please tune in.

There's one point, however, that I didn't get to on the show --- blame the cold medicine --- in response to the somewhat grim and arguably cynical (if accurate) assessments from Digby and Driftglass. That is, that even if Trump's federal trial for attempting to steal the 2020 election had moved forward, as scheduled, well before this November's election, I think the magic bullet moment that had been applied to that trial --- as if a guilty conviction would be an elixir that finally woke up the nation to how corrupt he truly was, leading supporters to abandon him --- was always, in my estimation, somewhat overblown.

When (not if) Trump is found guilty on any of the 91 criminal counts he is currently facing at both the state and federal level, his supporters will find a way to justify it and continue their support nonetheless. It'll be a evidence of a "corrupt system" or "Joe Biden's witch hunt" against Trump, etc.

I have never quite bought into the prodigious polling which suggests his 2024 support would crater once he was finally found guilty of a crime. His supporters know what he did. We all do. It's obvious. A criminal conviction is unlikely to change many opinions of him either way. This was and still will be --- as both Digby and Drifty point out --- about the VOTERS showing up and VOTING to save our democracy from the clutches of a fascistic, sociopathic, narcissist hell-bent on destroying it for revenge. Whatever happens between now and November 5, nobody else was ever gonna do it for us.

Finally today, Desi Doyen joins us for our latest Green News Report, as winter heat in the center of this nation blew away records for February, topping out in the 80s and 90s in huge swaths of the region over the past week. That helped touch off what is now the largest wildfire in Texas history. In February! That, and much more on today's GNR.

From the Hillary emails in 2016 to the Hunter Biden laptop in 2020 to the Biden Burisma "bribery" allegations that fell apart so spectacularly this week with the arrest of the man who House GOPers cited as the lynch-pin for their entire Revenge Impeachment case against President Biden, it turns out it was all part of a wildly successful foreign campaign to divide and threaten American political system.

Turns out Alexander Smirnov, that guy with the false Burisma claims about the Bidens, apparently got it all from Russian intel operatives who have, for the past ten years, been pushing all of these phony narratives straight out from the Kremlin through various useful idiots, onto the set of Fox "News" and the rest of the rightwing media, into the mouth of the disgraced former President, and straight through to the hearing rooms of the U.S. Congress where it was shared --- either knowing or unknowingly (it doesn't really matter) --- by GOP dupes.

It's quite an extraordinary success story, in truth. For Vladimir Putin. And a shameful failure of our corporate mainstream media to even notice much of it happening in real time. They also played the role of useful idiots when it counted the most over much of the past decade and right on up until today.

Josh Marshall described it as "A Bigger Story Than You Can Possibly Imagine" this week, and I believe he is correct. Much more on all of that --- and Putin's deadly rise --- on today's program.

  • MyPillow CEO Mike Lindell is not only an election denier and grifter. He also won't pay off a bet. In 2021, Lindell claimed to have obtained "irrefutable" evidence that the 2020 election was stolen from Donald Trump by China over the Internet. His evidence was Internet data packets that he claims to have obtained from a "whistleblower". He offered $5 million to anyone who could prove the data wasn't from the election. A two-time Trump voter did so in 2022. The data, he proved, was nothing but junk. But Mike wouldn't pay up the $5 million he offered via his "Prove Mike Wrong" challenge. A private arbitration panel agreed the man was owed the money. Cheap chiseler Mike still wouldn't pay. This week, a federal judge ordered him to do so.
  • Corporate media spend a lot of time focusing on Joe Biden's bad polling numbers against Donald Trump. This week, a new survey by Quinnipiac University, a major pollster, found Biden beating Trump among registered voters nationally by 4 points. So Politico covered the new survey with this headline: "Poll: Nearly 70 percent of voters say Biden is too old to serve again".
  • Is it any wonder so many on the left are still under the misguided impression that someone, anyone, who knows who?, but certainly someone, should replace Joe Biden on the 2024 ballot! Because that unidentified someone would certainly have a better chance of defeating Donald Trump this year! Well, even if there was evidence of Biden not running this year (there isn't), recent polling doesn't even back up the assertion that other Dems would do better against Trump than Biden would. But, hey, if you've got a realistic scenario to replace Joe Biden that won't result in a second Trump Presidency, please feel free to email me! We covered so much territory on today's BradCast that I'm having trouble writing about all of the seemingly disparate pieces in a cogent narrative here. So I won't try. I'll give you the pieces, and hopefully you will listen to the show to see how it all ties together (or doesn't). [Audio link to full show follows below this summary.]

Among the many stories covered on today's program...

  • Wednesday's mass shooting at the Kansas City Chief's Super Bowl victory rally; Wednesday's mass shooting at an Atlanta high school; President Biden's official response.
  • Special Counsel Jack Smith's speedy filing [PDF] at SCOTUS in response to Donald Trump's continuing attempt to further delay his federal trial related to his attempts to steal the 2020 election with his absurd claim that Presidents enjoy "absolute immunity" for any and all crimes committed while serving in office.
  • New York State Judge Juan Merchan on Thursday confirmed Trump's trial will begin on March 25 on 34 criminal felony charges related to hush-money payments made to a porn star to help him win the 2016 election. The judge rejected Team Trump's argument that sitting for a trial related to cheating to win the 2016 election will hamper his efforts to win the 2024 election. The trial is expected to last for six weeks.
  • A salacious sidebar to the 13 criminal felony counts Trump is facing in Georgia for his failed conspiracy to steal the state's 2020 election played out in a Fulton County courtroom on Thursday. A defiant District Attorney Fani Willis responded on the witness stand to charges from one of Trump's 18 alleged co-conspirators that the D.A.'s romantic relationship with one of the prosecutors on the case was either inappropriate or somehow a conflict of interest effecting the charges brought against Trump and his co-defendants. Willis was defiant in her response to questions and her testimony will continue on Friday.
  • BREAKING DURING SHOW!: A former FBI informant named Alexander Smirnov was arrested and charged with lying to government officials in the summer of 2020 about Joe Biden and his son Hunter receiving millions of dollars in bribes from Burisma, a Ukrainian energy company. Those lies have been a central part of Trump and Rudy Giuliani and House Republicans' phony, years-long attempts to smear the Biden family and impeach President Biden. Today's felony charges were filed by Trump-appointed Special Counsel David Weiss, who was tapped by Trump A.G. Bill Barr five years ago to try and find dirt on the Bidens. He found it instead on those spreading the dirt.
  • A few thoughts on how corporate mainstream media headlines, social media posts and mobile phone alerts can dangerously distort news.
  • A few thoughts on how Phoenix, Arizona media outlets 3TV and CBS 5 are seemingly doing the bidding of the fossil fuel industry while pretending to be consumer advocates.
