On today's BradCast: Our last show before a long holiday weekend packs a wallop and finds not just the President of the United States in violation of the Constitution, but also Alabama's Secretary of State. Also: zombies! [Audio link to show follows below.]

First up, President Trump found an excuse today to bail out of the planned June 12th nuclear summit with North Korean leader Kim Jong-Un, stunning allies in South Korea with a letter to Kim that sounded not unlike a bad breakup letter from a "needy" boyfriend, meant to keep his girlfriend from breaking up with him first --- while begging her to come back. We share the bizarre letter in full, along with both reactions to it and reasons behind it.

Then, it's been an interesting week for the First Amendment and those who claim to be "Constitutional conservatives", as Scott Pruitt's EPA locked out mainstream media outlets, such as AP and CNN, from a major water contamination forum, and as a federal judge in New York ruled that Trump was personally violating the Constitutional First Amendment free speech rights of seven plaintiffs who sued after he blocked them on Twitter. (My interview with one of the plaintiffs earlier this year, legal journalist Rebecca Showalter-Poza, is here.) The Dept. of Justice is said to be reviewing the court's ruling and may appeal.

While those plaintiffs were purportedly blocked from seeing or responding to Trump's Twitter feed, because he disagreed with their political points of view, the case echoes a similar matter that we discussed some months ago, after I was blocked on Twitter by Alabama Sec. of State John Merrill (R) in the midst of a bizarre conversation [PDF] in which I politely corrected the Secretary for erroneous public statements made about his state's computerized vote tabulation systems.

We're joined today to discuss both of those free speech matters and more by University of Kentucky College of Law professor JOSHUA A. DOUGLAS, who was also blocked by Merrill on Twitter last year after mentioning to him that "blocking people on Twitter, blocking his own constituents on Twitter, could violate the First Amendment".

Douglas, whose assertion was bared out by the federal judge in New York this week, explains the ruling and what may happen next in the case (will Trump end up pushing the case and violating a federal court order and then attempt to pardon himself as a test run for the future?), and I share an emailed response to my query from Merrill this morning in full, as the blocks continue on Twitter in apparent violation of the Constitution.

The central part of Merrill's response to me today [emphasis added]:

I will continue to use my social media forums the way that I have in the past. They will not be utilized by other users to express their political views or promote their agendas.

While I don't think Merrill actually owns Twitter quite as much as he seems to think he does, there was actually no political view or agenda expressed in my conversation with him that resulted in the block. More importantly, as Douglas notes in response to Merrill's remarks today: "Once someone like Donald Trump or John Merrill begins to use his Twitter account in a governmental capacity, then he can't pick and choose and block someone because he thinks, in his own view, that that person is promoting some sort of political agenda. That's really what the core of the First Amendment is all about, and that's what this court said."

Douglas, a Constitutional law and elections expert in Kentucky, also offers his thoughts on this week's upset victory by political newcomer Amy McGrath over DCCC-recruited Lexington Mayor Jim Gray in the primary contest for the Democratic nomination to challenge Rep. Andy Barr (R) this November in Douglas' own district. His take, particularly on the "conservative" bent of the two Democratic candidates, is somewhat different than the one offered by BlueAmericaPAC's Howie Klein on yesterday's program.

Then, we're joined by Desi Doyen for an incredibly news-chocked and, at times, quite troubling Green News Report. And, finally, to lighten things up just a bit before a long holiday weekend, an actual story about a "ZOMBIE ALERT!" issued in south Florida this past week. No, really!...

On today's BradCast, Trita Parsi helps us make sense of the Israel/Syria attacks. I'm Angie Coiro of In Deep sitting in the host chair today.

Trita Parsi from the National Iranian American Council helps us get through the "they started it" claims around yesterday's attacks. We spend some time deconstructing media reports and voices on the issue. He talks, too, about the Americans still held hostage in Iran, and potential long-term consequences of Trump pulling out of the nuclear agreement.

Then Brad Adams of Human Rights Watch talks about the release of American hostages from North Korea. I ask him about Israel kicking a Human Rights Watch employee out, based on his support of the Palestinian-led Boycott, Divestment, Sanctions (BDS) movement.

Then it's back to Gina Haspel, as more news came out today about inaccuracies in her Senate testimony. Daphne Eviatar of Amnesty International details Amnesty's call for Haspel's CIA bid to be rejected.

Finally, we dig to the source of all those troublesome Scott Pruitt emails with Elena Saxonhouse, senior attorney with the Sierra Club. It was the Sierra Club's dogged insistence on getting 24,000 pages of emails that opened up all those tales.

Yes, my guest argues on today's BradCast, West Virginia Republicans may very well nominate a man just out of jail on charges related to the deaths of 29 coal miners to be their nominee for the U.S. Senate this year. [Audio link to show is posted below below.]

But, before we head down to Coal County for that conversation today, a few news headlines...Republican Senate Majority Leader Mitch McConnell is vowing to prevent a bi-partisan proposal for protecting Special Counsel Robert Mueller from being fired by Donald Trump, from coming to the Senate floor for a full vote, even if, as now appears likely, the bill is approved by the GOP-lead Senate Judiciary Committee.

The notoriously obstructionist McConnell also appears ready to block any new Congressional military Authorization for the Use of Force --- as currently being considered in the Senate Foreign Relations Committee --- citing, along with GOP House Speaker Paul Ryan, the AUMFs from 2001 and 2002, for authorization of war against al-Qaeda, the Taliban and Iraq after 9/11, as valid enough approval for Trump to bomb Syria, however he sees fit. Speaking of which, the NYTimes is reporting that Defense Secretary James Mattis had tried to insist that Trump obtain Congressional authorization before attacking Syria last week, but was overruled by the President.

Meanwhile, in Kansas today, a federal judge found GOP Sec. of State Kris Kobach in contempt of court, amidst the long-watched ACLU cases challenging a state law he'd championed, which has kept thousands of otherwise valid voters off the rolls for failing to provide proof of citizenship documents to the state. Kobach, one of the nation's leading Republican "voter fraud" fraudsters, was slapped by the George W. Bush-appointed federal judge in her ruling [PDF] and ordered to pay the ACLU's legal fees for the contempt hearing. This is the second time that Kobach, now a candidate for the 2018 Republican nomination for Governor in Kansas, has been found in contempt.

Also today, in more good news for voters, New York's Democratic Governor Andrew Cuomo, facing a primary challenge from progressive actress and activist Cynthia Nixon, announced a plan to immediately restore voting rights to some 35,000 parolees by executive order.

Then, we're joined by West Virginia's own BOB KINCAID, the always-colorful, long-time radio host and President of West Virginia's Coal River Mountain Watch, to discuss the remarkable re-emergence of disgraced coal baron Don Blankenship, the former Massey Energy CEO who was released from prison last year following a one-year sentence for his involvement in safety violations at the company's Upper Big Branch Mine, where an explosion killed 29 workers in 2010.

Blankenship, to the supposed horror of establishment GOPers, is running for the party's nomination for the U.S. Senate in the state's May 8th primary, in hopes of taking on incumbent Democratic Sen. Joe Manchin. Remarkably, Blankenship's fortunes appear to be rising, just three weeks out from a contest against a number of very Trumpy primary opponents. That has now forced the national GOPers to form a "local" PAC to purchase ads that take on Blankenship by pretending to be against Massey's coal-related pollution of drinking water in the state. In return, Blankenship is now firing back at his former ally Mitch McConnell.

"It's all swamp," Kincaid says. "Don Blankenship is the ultimate swamp. If McConnell is a swamp Captain, then Don Blankenship is a swamp Field Marshal. Remember, [McConnell] got behind a Supreme Court candidate in this state some years back solely so that he could protect Massey Energy from a jury verdict that they deserved --- trying to make sure that verdict would be overturned once it got to the [state] Supreme Court. That's swampy behavior if anything is."

Kincaid details the once-wildly powerful Blankenship's deadly background and the contours of the now-bizarre race --- which is beginning to echo Roy Moore's disastrous GOP run for the U.S. Senate in Alabama last December --- in a state where Trump won by some 40 points in 2016 and the conservative Manchin is considered to be amongst the most vulnerable Democratic Senators up for re-election this year.

"They really don't know quite what to do with him because, frankly, Don Blankenship doesn't give a damn. He has that in common with Geezer Disgustus over in the White House. It seems like everything just bounces of off him. Mainly because he can just push it off to one side, he can run his own ads, he can finance his own campaign. There's a certain element of people in this state who would vote for the Devil himself --- and Blankenship is pretty close --- if he said 'I hate that Obama'," argues Kincaid, adding, "There's a whole lot of white-lash still left in West Virginia."

We also discuss what progressives --- whose own Democratic primary candidate, Paula Jean Swearengin, does not appear to be gaining traction in the state --- ought to do this November, if faced with a choice between a vote for the coal-loving corporatist Manchin and whoever becomes the GOP nominee amid our ever-deepening, Trump-induced national emergency.

"The fact of the matter is, we've been in a Constitutional crisis ever since the Electoral College failed to do that which the Framers said the Electoral College was designed to do. And if you let this Congress continue, there is no hope whatsoever of saving the Republic," he warns...

Guest: Political scientist and author David Faris of Roosevelt University on radically reforming 'long-term structural barriers to progressive power'...

On one of the ugliest political days in recent memory (and they are likely to get still uglier --- and deadlier, as Trump launches a military attack against Syria moments ago), we fight our way on today's BradCast, out of the slime to look beyond the near horizon for how progressives can change structural impediments in our political system, just as soon as Democrats are able to regain majorities in both Congress and the White House. [Audio link to full show is posted below.]

But first, we wade into the swamp long enough to cover Donald Trump's stunning pardon on Friday of former Vice President Dick Cheney's Chief of Staff Scooter Libby, a felon who was found guilty of having lied to federal investigators and obstructing justice after purposely leaking the highly classified identify of covert CIA agent Valerie Plame to the media during the run up to the Iraq War. That, as an enraged Trump took to Twitter on Friday to tar former Republican FBI Director James Comey as a "LEAKER & LIAR" and "slime ball" following the release of his new book.

But, as we strive today to look towards a brighter future somehow, we are joined by DAVID FARIS, political science professor at Roosevelt University and author of the new book out this week, It's Time to Fight Dirty: How Democrats Can Build a Lasting Majority in American Politics. Faris' book outlines a number of radical ideas for a progressive institutional restructuring of our democracy which, he argues, can and should all be carried out just as soon as Democrats regain control of the House, Senate and White House.

The "procedural proposals", as he describes them, include, among other things: statehood ("on Day 1") for Washington D.C. and Puerto Rico (and breaking California into several smaller states); transformation of our federal judiciary (by, among other things, doing away with lifetime tenures on the federal bench and a forced restoration of a Democratic majority on the Republican's stolen Supreme Court); and restructuring the U.S. House for proportional representation to help overcome the scourge of extreme partisan gerrymandering. All of which, Faris takes pains to note, can be done without the daunting task of amending the U.S. Constitution, and, as he argues, would be no more radical than ideas that Republicans have both been instituting for decades and plan to implement in the near future, unless they are prevented from doing so.

"Most of the ideas in this book I consider a process of rectifying existing injustices in our electoral system and our political processes, and then responding in kind to some of these Republicans escalations --- partly to convince the Republican Party that some of the things they are doing are deeply destructive, and that they will lead to retaliation," Faris tells me. "I think they are assuming things like holding a Supreme Court seat open for Neil Gorsuch will not get a reply from the opposition."

"Part of the purpose of the book," he continues, "is to outline a series of ideas that are actually the right thing to do. I don't consider them to be 'fighting dirty'. I think it will be perceived as fighting dirty, but I actually really believe in all these ideas as improving the long-term performance of our democracy overall."

Faris argues that "Democrats have to take some of these procedural issues and these electoral issues much more seriously. I think they need to take them as seriously as they take their policy proposals, and their intra-party battles over what the party's stance should be on certain issues. Because the reality is in national politics, in every election for the last twenty years, the Democrats have been fighting at a really significant disadvantage, due to things like felon disenfranchisement laws, like gerrymandering, like voter ID laws. And if they don't seriously rethink some of these things, they may come back to power in 2020, but they're going to kick it right back in 2022, or 2024, or 2026. Because these long-term structural barriers to progressive power are very poorly understood by the broader public. And, in all cases, they are an affront to the spirit of small-d 'democracy' as it should be practiced, and as it is practiced in most of the rest of the world."

I hope you'll tune in for the detailed discussion (and debate) on a number of Faris' fascinating proposals for reform on today's program --- and why it is that Democrats have shied away from them for too long --- before we then head back into Trump's swamp for a few more minutes at show's end.

Among those slimy stories to close out the week: The U.S. Senate confirms Andrew Wheeler as second in command to embattled EPA Administrator Scott Pruitt. Wheeler was, until his nomination late last year, a very powerful coal industry lobbyist and will now take charge of the EPA if Pruitt is pushed out.

And, finally today, wealthy Trump and George W. Bush donor Elliot Broidy steps down as the RNC's deputy finance chair after revelations that he paid a Playboy playmate $1.6 million to keep quiet about an affair in which she was reportedly impregnated and had an abortion. The man who set up the hush money payoff for Broidy? Donald Trump's personal attorney and "fixer" Michael Cohen, whose office and residences were raided at the beginning of the week in relation to, among other things, virtually identical schemes to prevent adult film actress Stormy Daniels and Playboy model Karen McDougal from revealing their own affairs with Trump in the days just before the 2016 Presidential election...

  • A record-breaking number of women are now running for Congress, and the filing deadlines haven't even passed in half of the states;
  • Sinclair Broadcasting Group's insidious misuse of our public airwaves for rightwing pro-Trump propaganda purposes finally begins to catch the attention of Democrats in Congress, as company executives mouth off with pathetic excuses, former employees speak out, some staffers resign in protest, and others, while embarrassed by being forced to read on-air nonsense from their owners, find reasonable excuses for not quitting (such as outrageously onerous contract terms) at once-respected TV news outlets now controlled by the nation's largest owner of television stations;

On today's BradCast: Why in the world did 16 U.S. Senate Democrats vote in favor of gutting central provisions of the Dodd-Frank banking reform bill, as originally put in place by Congress after the 2008 global financial meltdown to avoid another such catastrophe? That and many other disasters covered on today's show. [Audio link is posted at end of article.]

Ironically enough, the new bank deregulation bill was passed on Wednesday with the votes of those Democrats and all of the Senate Republicans on the tenth anniversary of the 2008 collapse. We're joined today by the U.S. Senate Banking Committee's former chief investigator, BARTLETT NAYLOR, who is now Financial Policy Advocate for Public Citizen's Congress Watch division. He explains what this bill will do and how it allows for the same type of dangerous speculation by big Wall Street banks that led to the Great Recession ten years ago.

Naylor says the bill is "going to take the guardrails down" for banks that have less than $250 billion in assets. "This is a class of banks that collectively took some $50 billion of bailout money. A dozen of them have engaged in misconduct and have been sanctioned by regulators int he last three or four years. This class would have included Countrywide, [which] made so many bad loans that it toxified the entire industry. By taking their eyes off this class, it invites another financial calamity."

He also offers his thoughts as to why it is that those 16 Democrats appear so willing to do the bidding of the Big Bank lobby, even as many other Democrats, led by Senators Elizabeth Warren of MA and Sherrod Brown of OH, strongly opposed the measure. "I suspect it's about campaign contributions, but I don't know why any Senator who is up for re-election wants to tell his or her constituents that they're trying to help the banks," Naylor tells me. "They're not trying to help consumers, they're trying to help the banks."

"Labor unions, faith groups, civil rights groups, consumer advocacy groups such as ours," all oppose the bill. "The only people that are supporting this bill are bankers," he argues. Naylor says it could still be stopped before final passage while it is being reconciled with an even more draconian U.S. House version. Donald Trump campaigned on gutting the protections of the Dodd-Frank law, whose provisions remain very popular among voters, adding still more questions as to why those Dems are going along with it, even in an election year.

All of that comes as Trump confirms his appointment of rightwing TV economist Larry Kudlow as his new top economic adviser, despite the fact that Kudlow had insisted the economy was booming under George W. Bush --- ("There's no recession coming," Kudlow wrote at the time. "It's not going to happen.") --- during the very same month in which economists have since concluded the Great Recession actually began.

But, all of those stories, sadly, are not the only disasters to report on today's show. We also cover the horrific pedestrian bridge collapse in Miami and a deadly explosion at yet another chemical plant in Texas today.

And all of that came after the White House announced new sanctions today against Russia, related to allegations of interference in the 2016 election and also for what the Administration describes as a concerted hacking operation targeting critical U.S. infrastructure like the energy grid, water and aviation systems and other key elements of the U.S. economy.

The Kremlin quickly vowed retaliation today in response to the new sanctions. And, while the move suggests somewhat of an about-face for this Administration, there still remains no explanation for why the Dept. of Homeland Security --- as concerned about hacks to our infrastructure as they claim to --- have yet to forensically examine any of the nation's extremely vulnerable computerized voting and tabulation systems (or even count any of the ballots!) for evidence of manipulation during the 2016 Presidential election.

Finally today, after late breaking news that Donald Trump, Jr.'s wife Vanessa is reportedly filing for divorce, Desi Doyen joins us for our latest Green News Report on, among other things, the nomination of Trump's CIA Director Mike Pompeo to become the nation's first climate science denying Secretary of State. Because everything is awesome!...

On today's BradCast, so many great cons to debunk, so little time. But we've actually got some good news for voters today as well. [Audio link to full show is posted below.]

First up today, Trump unleashes his massive and wildly unpopular --- and, yes, job-killing --- new taxes on imported steel and aluminum.

Then, some voting news, most of it good. The state of Washington is the ninth state in the union to adopt automatic voter registration, and a federal court has ruled that California must inform Vote-by-Mail voters before their ballots are tossed out when election officials decide that the signature on the ballot doesn't match the one on the voter's registration form. According to the ACLU's lawsuit, as many as 45,000 voters in the state were disenfranchised, without their knowledge, thanks to California's horrible practice, carried out by the whim of officials who are anything but handwriting experts.

Meanwhile, two Democratic U.S. senators have sent a letter to the nation's top three election vendors, ES&S, Dominion, and Hart Intercivic, asking if they have shared the source code from their computerized voting and tabulation systems with Russia. We discuss what this actually means and doesn't. (For example: No, it's not necessary for Russia or anybody else, including elections officials, to have access or familiarity with proprietary source code from voting and tabulating systems in order to manipulate computer-tallied elections!) We also call out Reuters for continuing to spread the evidence-free claim in their report on this that "voting machines were not directly affected" by meddling during the 2016 election.

Next, we're joined by Vox.com's environment and politics writer DAVID ROBERTS to discuss a new report [PDF] released by the Trump Administration's own Office of Management and Budget(!) which, as he writes, "demolishes the GOP’s deregulatory claims." In short, it finds that benefits to the public of federal regulations far outstrip their costs in pretty much every imaginable way.

The aggregate costs of major federal regulations (those with an impact of $100 million or more) between 2006 and 2016, according to the annually mandated report released late on a Friday night for some reason, "were somewhere between $59 and $88 billion. And the aggregate benefits were somewhere between $219 and $695 billion," says Roberts. "So, even if you take the highest possible estimate of costs, and the lowest possible estimate of benefits, the benefits are still well over double what the costs were, in the most conservative analysis."

While Donald Trump has attempted to cut hundreds of rules and regulations across federal agencies --- repeatedly boasting about doing away with a record number of "job-killing regulations" and bureaucratic red-tape --- the fact is, as his own OMB (headed up by the far-right, Tea Party, regulation-hating Mick Mulvaney!) detailed in their report, those regulations do not "kill jobs" or cost the government money. In fact, killing those rules costs the government far more, particularly the environmental rules being radically gutted by this Administration.

But, as Roberts argues, the "job-killing" mantra has been so often repeated by Republicans since the days of Ronald Reagan --- and gone largely unchallenged by corporate media --- much of the public now simply accepts those false assertions as reality.

"Just to be clear, we've known this about federal regulations for a long time," Roberts notes. "These things have been subjected to cost-benefit analysis out the wazoo for years and years. Not only by the federal government, but by outside analysts. They all more or less converge on this same answer, which is that the public health and social and employment benefits of these things wildly outweigh the costs, and have for years."

"The reason Republicans hate this is because, when you see it in aggregate like this, it's almost enough to convince you that government can be an agent of good, that it can improve public health and welfare while still maintaining economic growth."

"It's revealing, I think, that this is treated as a revelation," he tells me. "It ought to be commonplace by now. It's the consensus of the experts. We just don't accept it, because Republicans, just through the sheer weight of repetition, have been saying 'job-killing regulations', 'burdensome regulations', etc., etc., for so long, that that's just sort of baked into the cake as one side of the debate, even though there's no support for it. There's no analysis that supports that."

We discuss why that is and who actually benefits from the GOP's great con. (Hint: It isn't the bulk of the folks who voted for Donald Trump!) Robert's also goes on to argue why he believes that Democrats are at least partly to blame for this con having taken such a death grip on the American conscience as self-defeating "conventional wisdom" over the past several decades.

Finally, Desi Doyen joins us for the latest Green News Report for yet another demonstration of how the decades-long scam to gut regulations continues to threaten the nation and the world...

On today's BradCast: As the White House implosion continues at the end of one of its most chaotic weeks to date, Trump declares a trade war! [Audio link to show is posted below.]

Well, huge tariffs on imported steel and aluminum, anyway, (those are taxes on the American people, Mr. President), which will almost certainly lead to international trade wars with friend and foes alike, raise the cost of many consumer goods and, yes, kill American jobs.

The proposed tariff scheme has already led to an internal White House war with Trump's lead economic advisor threatening to resign if they are implemented, Congressional Republicans furious about the plan, close allies such as Canada and the EU threatening to retaliate against the U.S., the entirety of the fossil fuel industry (from oil to natural gas to coal) declaring that jobs will be lost and prices will rise, and even Trump's own Defense Secretary advising that the measure, which President Chaos is hoping to pull off on "national security" grounds, will have a "negative impact on our key allies". Other than that, the idea is going over very well.

At the same time, there was another school shooting by a 19-year old on Friday, this time at Central Michigan University; Texas sees huge early voting turnout in advance of Tuesday's 2018 mid-term primary elections (even beating turnout for the 2016 Presidential primaries!); New polling finds the Affordable Care Act (Obamacare) and Medicaid with record high approval ratings; and the state of Georgia is finally moving away from their 14-year old 100% unverifiable Diebold touch-screen voting systems...to new, similarly unverifiable computer-printed "paper ballot" systems.

(The GA legislature is moving a measure forward to fund new "Ballot Marking Devices" or "BMDs", which are, essentially, very expensive computerized "electronic pencils" that allow voters to use a touch-screen to print out a non-human readable barcode on a piece of paper, which is then tallied by a computer scanner. Or, the computer may print human-readable vote selections on paper which may or may not actually be verified by the voter to reflect their intent before being tallied by a computer. After an election, it'll be impossible to know if any of those so-called ballot cards actually reflect voter intent. That's why election integrity advocates oppose the new "bad to worse" scheme quickly moving forward in GA!)

Then, Desi Doyen joins us for the latest Green News Report as Trump's EPA chief Scott Pruitt cites the bible as his excuse for polluting the planet and killing children with fossil fuel exploitation and dangerous chemicals. (Hope Pope Francis doesn't find out!)

(Hope the supposedly anti-tobacco Democrats who are helping to kill people by making it more difficult to vape don't find out!)
