The most cogent broadcast media discussion about Same Sex Marriage issues that we recall seeing. As usual, it comes from The Daily Show. Also, as usual, the opponent here --- in this case Mike Huckabee --- ultimately can come up with absolutely no legitimate reason to oppose full rights for all Americans, other than concerns about having to rewrite a few editions of Merriam-Webster's. Bravo, Jon...


Even if he's out of his mind in regard to things like evolution and equal rights for Americans, Huckabee's a decent fellow who, we suspect, will some day have a "revelation" and reverse his opinion on both of those things once he no longer perceives he needs them to win public office (for example, after he no longer plans to run for anything). That cynicism, of course, runs contrary to my belief that he's "a decent fellow". But hey, nobody's perfect, right?

Admittedly, events of the last decade or two have greatly lowered our bar for "decent fellows" when it comes to Republicans, unfortunately.

The 2008 election introduced "low information voters" --- people who don't educate themselves about political issues until the waning days of a campaign. Now it appears that it was less educated people --- not blacks and Latinos, as was originally suggested in early post-election analysis --- that put Proposition 8, the anti-gay marriage amendment, over the top last month in California.

A survey released last week by Public Policy Institute of California (PPI) of voters found that the true determining factor in who voted for Prop 8 was not ethnicity. It was education level:

In their outreach to blacks, Latino, Asians and other minority voters, the conservative operatives behind Proposition 8 neglected to mention a key aspect of the initiative that could contribute to rolling back minority rights for years to come.

Prop 8 not only rendered quaint the California Constitution's equal protection clause --- a foundational precept that instructs the state to protect the rights of all citizens equally --- it also rescinded the right to marry for California gays. This sets it apart from other states' anti-gay marriage amendments because it establishes a precedent for conservative efforts to curb minority rights using ballot initiatives and by other means:

RELATED...Princeton University moves to ban freshmen from the sidewalks: "The Princeton Proposition 8 campaign aims to secure the definition of Princeton University sidewalks as a means of pedestrian transit for sophomores, juniors, seniors, graduate students, faculty, staff, and other members of the university community, but supports the elimination of the right of freshmen to walk on sidewalks."

The majority supporters of the measure note that "they are not 'froshophobic' and that some of their best friends are freshmen, but they maintain that freshmen on the sidewalk degrade the sacred institution of sidewalks."

We concur with both of the above efforts. Details and video on the latter here. Minorities have gotten away with too much for too long in this country, under the guise of "rights"! We say that all must change now!

As I haven't had much (if any) time to focus on it since last Tuesday's election, I just wanted to toss in for now, here on Veterans Day, that I find it hard to believe that many of those vets, to whom we ought a great debt, would have risked their lives to fight to remove individual freedom, personal liberties, and hard fought rights for any American.

Thus, what may have happened in this state last Tuesday, when voters apparently voted in favor of Prop 8 to remove the right to marriage equality for same-sex couples, is an embarrassment and a reminder of why rights should never be put up for popular vote. The U.S. Constitution --- and presumably the CA Constitution, which will be amended by this proposition, if it's allowed to stand --- is meant to protect and guarantee the rights of the minority from the tyranny of the majority.

Had it been placed on the ballot for a popular vote in the 1800's, slavery would likely have been approved by the electorate as well. That wouldn't have made the right to live free of enslavement in these United States any more correct than removing the right for same-sex couples to share all of the benefits (whatever they may be) of marriage that every other couple in America has the right to enjoy.

What a shameful disgrace. It will not stand. But it remains an extraordinary embarrassment that so many still have to go to such lengths in order to guarantee their individual rights and freedoms in 2008...particularly after all that we've been through in this nation.

Happy Veterans Day to all. And thank you to all of those who have served. Your sacrifice will not have been in vain.

California's Proposition 8 --- a Constitutional amendment to ban the right to same-sex marriage in the state --- currently has more "yes" (in favor of discrimination) votes than "no" votes tallied, 52.2% to 47.8%, according to the CA Sec. of State's website. This represents a difference of 434,830 votes. But according to the No on 8 campaign, three to four million provisional and vote-by-mail ballots remain uncounted...

Since we could use some good news around here for a change, we're happy to highlight yet another conservative decision to honor both the Constitution and the rights of all Americans to enjoy equal protection under the law...

The Connecticut Supreme Court has ruled 4-3 in favor of eight gay couples who sued on the grounds that the state's 2005 civil unions law did not provide equal protection under its constitution.
...
The court's decision in Kerrigan & Mock v. Dept. of Public Health reads, in part:

We conclude that, in light of the history of pernicious discrimination faced by gay men and lesbians, and because the institution of marriage carries with it a status and significance that the newly created classification of civil unions does not embody, the segregation of heterosexual and homosexual couples into separate institutions constitutes a cognizable harm.

Congratulations to the free peoples of Connecticut, and thank you to their Supreme Court for pushing back against those --- Democratic, Republican, or any other --- who would attempt to re-interpret the Constitution and/or liberally create new laws in order to try and discriminate against any American.

51% Oppose; 42% in Favor - Only 7% Are Undecided

A new Field Poll shows that 42 percent of California voters say they will vote for Proposition 8, the ballot initiative sponsored by the national anti-gay lobby that would amend the California Constitution to revoke the right of gay people to marry, while 51 percent say they plan to vote against it, according to a report in the Mercury News:

The poll showed a California sharply divided over a constitutional ban --- along the lines of geography, gender, race, age, religious belief and political affiliation. But it's also a California where Proposition 8 supporters may have a hard time winning in November. Just 7 percent of voters were undecided, a strikingly small amount so long before Election Day, leaving relatively few voters to sway.

"Very few initiatives in the history of the Field Poll have started out behind and come from behind to be approved," said Mark DiCamillo, director of the Field Poll. "The fact that (the initiative) is behind does not bode well for its chances."

Mercury News also reports that "[women], older baby boomers and residents of coastal California --- particularly the Bay Area --- were among those most hostile to the proposed ban. Protestants, Latinos, residents of inland counties and people in their 40s and over age 65 were the most likely to favor it."

At least one professional advocate of bigotry toward gays was quick to downplay the poll results. "Historically, the Field Poll has understated the support for upholding the definition of marriage," Jennifer Kerns, a spokeswoman for ProtectMarriage.com, told the Mecurty News. "The reality is that the vast majority of Californians support the definition of marriage as between a man and woman."

6 Helicopters, Mr. Sulu, 3 Protesters But No Wrath of God

I live about 100 yards from West Hollywood City Hall so when the first marriage licenses were issued to gay people there on Tuesday, it was a big day for news helicopters overhead. I, of course, watched the festivities as reported by CNN's Thelma Gutierrez, via satellite feed to Atlanta, routed back to me 3,000 miles across the country by cable. What a whacky world.

Thelma was not alone. According to WeHo News, our local online-only newspaper, media outlets on the scene also included Tokyo Broadcasting Corporation, the British Broadcasting Corporation, Wall Street Journal, NY Times, and the Washington Post.

Del Martin, 87, and Phyllis Lyon, 83, got to tie the knot today, after 56 years together. That's what liberty and freedom look like. Congratulations to the lovely couple.

Also, this. Fiscal conservatives here in California, and elsewhere, may wish to re-think their stance on marriage equality and say "Thanks, gay people!"

Analysts say same-sex marriages will generate several hundred million dollars and create thousands of jobs for California's economy.
...
"Spending by resident same-sex couples on their weddings and by out-of-state couples ... will boost California's economy by over 683.6 million dollars in direct spending over the next three years," the UCLA study reported.

Of course, some folks are hoping to turn back the clock by trying to change the Constitution next November out here. Here's my interview, from last week, with Richard Prenctice, CEO of the so-called California Family Council, a member of the "Protect Marriage Coalition." Why he's against liberty and freedom (and apparently sound fiscal policies) remains a mystery to me. Though I did my best to try and find out.

Another reminder may be needed: Just because California now allows same-sex marriage, it does not mean you must marry someone of the same sex. Also, if you are currently in a heterosexual marriage, you are more than welcome to stay married. I'm no lawyer, but I'm pretty certain about both of those points.

We've long argued that same-sex marriage was, for all intents and purposes, a done deal. Marriage equality, under virtually any legitimate conservative reading of the U.S. and most state Constitutions, cannot be denied.

If the segment, at right, from tonight's O'Reilly Factor is any indication, it looks like even Bill O'Reilly is finally coming to grips with that fact, in light of the new poll showing for the first time that a majority of Californians are finally in favor.

Neither O'Reilly, nor his guest, "family law attorney" and "gay marriage opponent" Don Schweitzer, seem to be able to come up with a single legitimate reason to oppose it. The uncomfortable silences while they reach for something...anything...is really something to see. And if they've lost O'Reilly, well, the dead-enders may take a while longer to get the message, but it's over. The good guys will win this one...

Conservative Decision Respects Constitutional Right of 'Equal Protection', Allows Heterosexuals to Remain Married to Opposite-Sex Partners...

California's Republican-dominated Supreme Court --- in a conservative finding --- has just found the state's ban on same-sex marriage to be in violation of the state Constitution.

And yes, that's a conservative finding, in that it respects both the state and U.S. Constitution and keeps Government out of our bedrooms and private lives.

For those phony "conservatives" who don't understand the difference, a special note: The ruling does not require you to go out and marry someone of the same sex. So you don't need to worry your little selves about it one bit. You get to stay married to your current partner as usual. If you wish.

This time, there is no explicit text messaging to a Congressional page from a member of Congress, then co-chair of the House Caucus on Missing and Exploited Children, while a bill is being debated on the floor of the Capitol.

This time, the stage is a booth in back of an X-rated video store, and then a room in the nicest hotel in Spokane, Washington.
