On today's BradCast: Despite the New England Patriots' amazing, come-from-behind overtime victory at the Superbowl, it was yet another very rough weekend for Donald Trump. [Audio link to show follows below.]

More startling insider reports continued to pour out from the leakiest White House ever over the weekend, as a federal judge appointed by George W. Bush temporarily blocked Trump's entire Muslim immigration and refugee ban on Friday, and then refused to reinstate it late on Saturday, despite an emergency motion by the Administration.

Moreover, more than 100 major corporations told the court they opposed the ban on Sunday, and a bunch of very senior former security and intelligence officials and cabinet secretaries (mostly Dems, but also a number of Republicans) filed a brief with the court on Monday explaining why Trump's order makes the U.S. less, not more, safe.

All of that took place before John Yoo, the GOP lawyer who penned the infamous "torture memos", arguing in favor of brutal and sweeping executive powers on behalf of the Bush Administration, announced in an op-ed today that even he thinks Trump has gone too far. As if all of that wasn't bad enough for Trump, even conservative members of parliament from one of our oldest and best allies are now announcing they want nothing to do with him, following what they describe as his racism and disrespect for the judiciary after his weekend Tweets blasting the federal judge who stayed his travel ban.

But one thing didn't suck for Trump this weekend, the "gobsmacking" victory by his friend Tom Brady and the Patriots over the Atlanta Falcons, who managed to lose despite a 25-point margin. The Falcons' stunning loss --- grasped from the jaws of what seemed like certain victory --- had a disturbingly familiar ring for many Democrats watching the game. But Lindsay Gibbs, sports writer at Think Progress, joins us for some much-needed perspective for progressives on the politics surrounding and, at times, overtaking Sunday's big game.

"With Trump, everything is political these days. There's no escaping our reality right now," argues Gibbs. "These days, even saying stuff like 'America is Beautiful' is seen as a politically charged statement." But, she notes, citing many of the surprisingly progressive and not-sexist-as-usual ads aired during the game (including the stunning spot from 84 Lumber, which Fox would not allow to run in full), "the fact that all these ads were touting these progressive values, or were openly mocking Trump, does say that right now companies think inclusiveness sells."

In 2016, Senate Republicans stole the U.S. Supreme Court by refusing to hold a hearing, much less a vote, on Barack Obama's centrist (arguably, too centrist) nominee Judge Merrick Garland following the death of Justice Antonin Scalia. Now that Donald Trump has announced his own nomination for the stolen seat, Judge Neil Gorsuch, history --- and democracy --- demands that Democrats filibuster any nominee other than Garland, even if it leads (as it will) to the "nuclear option" in which Senate Republicans do away the filibuster rule, as Trump has now called for.

We explain why all of this matters on today's show, detailing the GOP's extraordinarily dishonest and hypocritical action and rhetoric on this point from Republican Majority Leader Sen. Mitch McConnell, Sen. Orrin Hatch, Sen. John McCain and others.

On today's BradCast, a few of Donald Trump's nominees for top cabinet slots may be facing trouble, as Senate hearings continue this week in the U.S. Senate, preparations are finalized (and changed) for the Inauguration, and President Obama issues last minute pardons and commutations. First today, as we go to air, breaking news on Obama's merciful commutation of the unprecedented 35-year prison sentence for U.S. Army whistleblower Chelsea Manning and a number of additional last-minute pardons and commutations.

Then, as Senate confirmation hearings resume today for Donald Trump's nominees, including for Education Secretary nominee Betsy DeVos and Interior Dept. Secretary nominee Rep. Ryan Zinke (R-MT), we look at concerns about both of them. Billionaire DeVos, for example, has given, quite literally, millions of dollars in donations to Republicans and GOP causes over the years, including tens of thousands to the GOP Senators set to vote on her nomination in the Health, Education, Labor and Pensions Committee today. And, in the Energy and Natural Resources Committee, Sen. Bernie Sanders pressed Zinke on whether or not he believes, like Trump, that climate change is "a hoax".

Then, we're joined by financial journalist and award-winning author David Dayen, to discuss several Trump nominees whose confirmations could now be in jeopardy, including the President-elect's picks to head up Health and Human Services (Rep. Tom Price), Labor (billionaire Andrew Puzder), Treasury (billionaire Steve Mnuchin) and Commerce (billionaire Wilbur Ross). We also discuss Dayen's recent big scoop at The Intercept on a memo detailing "widespread misconduct" (including fraud) at Mnuchin's mortgage bank OneWest and CA's then Democratic Attorney General, now U.S. Senator Kamala Harris' failure to further investigate or prosecute, despite recommendations from her own staff to do so.

Whether or not some of those nominations fall apart, Dayen notes a "supreme irony" in the both the election of Trump and the nominations of guys like Mnuchin and Ross, both profiteers of the "Great Foreclosure Machine".

"There was never any accountability for that. The Obama Administration famously kind of walked off the field in terms of prosecuting bankers and financial institution executives who instigated [the 2007 financial crisis]," argues Dayen. "And then who gets placed into power in the aftermath is the same people whose reputations have been rehabilitated effectively, who weren't given any sanctions for the actions that they took. And, in addition, the fact that there was no accountability created this sort of broken social fabric that helped lead to the rise of populist figures like Donald Trump in the first place."

"There are a lot of ways you can look at this," he tells me. "But there's no question that that failure to get the accountability that the American people wanted in the wake of the financial crisis played a role in the actions that occurred on Election Day 2016, and now those same people who profited off that neglect will be in charge."

Finally, as public pressure builds against some of those nominations, pressure has also led to a number of changes in plans for this week's Inauguration...

On today's BradCast, resignation and evidence of corruption continue to dog the wildly unpopular incoming Trump Administration just days before his Inauguration; And is Comcast/NBCUniversal doing the bidding of the Mormon Church in Utah? [Audio link to show follows below.]

As we barrel towards what is certain to be an incredibly bizarre (to say the least) Inauguration Day for the historically unpopular Donald Trump, the Obama Administration has reportedly transferred out another 10 Gitmo detainees to Oman. In the meantime, a senior Trump White House appointee (and former Fox "News" contributor) has already resigned after revelations of massive plagiarism, as new questions about financial improprieties continue to mount for a number of Trump cabinet nominees and for the Trump Campaign itself.

Then, we are joined by former GOP Presidential candidate and gay rights activist Fred Karger, to discuss his latest campaign against the Mormon Church, which he believes should lose their tax exempt status revoked by the IRS due to participation in a number of anti-gay political campaigns and other corruption. Karger is charging that Comcast/NBCUniversal has blocked the airing of his new TV ad for MormonTips.com, after the media behemoth had previously agreed to run the 30 second spots in the state of Utah.

"I know how the Mormon Church operates," Karger explains, describing his claim that the Church is behind Comcast nixing the spots. "They are all powerful, particularly in the state of Utah. It's a virtual theocracy. They exercise a tremendous amount of power."

"They don't like me," he notes. "I'm the guy that discovered their vast involvement in California's Prop 8 in 2008 to take away gay marriage. I got them investigated and prosecuted by [California's] ethics office because they only admitted to spending $2,078 on the campaign. Turns out it was hundreds of thousands of dollars they ended up reporting. Much more likely millions. So I've learned they are very dishonest, and they've have done things very secretively." He argues that they've used their muscle to convince Comcast (which, he says, "controls something like 90% of the [cable television] market in Utah") to kill the ads. "So they're using censorship to quash our free speech and I'm going to be fighting back against them."

Finally today: Is the Trump Administration planning to shut down the White House Press Room after taking office? Esquire reported over the weekend that the matter is under serious consideration and, in response, Trump's top officials are not denying it...though they do appear to be lying about their reasons for it...

On today's BradCast, U.S. Senate confirmation hearings for Donald Trump's top Administration nominees are officially underway. They began today with Day 1 of hearings for controversial U.S. Attorney General nominee Sen. Jefferson Beauregard Sessions of Alabama. [Audio link to show posted below.]

In the days leading up to today's Sessions session, Democrats have blasted Senate Republican Majority Leader Mitch McConnell for reversing course on demands he had made for Obama nominees back in 2009, requiring that all background checks and vetting by the Office of Government Ethics be completed before hearings begin. Also, before today's hearing commenced, members of the Congressional Black Caucus requested time to give testimony on Sessions' extremely controversial civil rights record. Senate Judiciary Committee Chair Chuck Grassley (R-IA), however, while agreeing to allow the member testimony, broke with Senate tradition by only allowing it only after all of the other witness testimony has completed.

On today's BradCast, Donald Trump's nominee for Secretary of State, ExxonMobil CEO Rex Tillerson, has filed papers to "divest" from the oil giant. But a closer look at his filings suggests he may not actually have cut all ties and interests in the profits of the only company he has ever worked for until now. [Audio link to show is posted below.]

First today, apparently it's still not "terrorism" when a non-ISIS American carries out a mass shooting, as was the case last Friday at the Fort Lauderdale International Airport. The alleged shooter, a veteran of the Iraq War and former National Guardsman, killed five and wounded six others, even as Republican Florida lawmakers press for more guns in airports and elsewhere.

Then, as many as eight of Trump nominee's are all set to come before U.S. Senate committees this week for confirmation hearings, pretty much all at the same time, and even before the U.S. Office of Government Ethics has even completed the background checks for many of them for the first time since the OGE was created. That, despite unprecedented corporate conflicts of interests for virtually all of the cabinet-level and top advisory positions being filled --- not to mention the first press conference in six months scheduled by Trump at the same time, along with the Majority Leader Mitch McConnell's plan plan to hold a budget "vote-a-rama" concurrently with all of the above.

One of the nominees set for truncated confirmation hearings this week is Exxon's Tillerson, who last week filed papers with the U.S. Security and Exchange Commission (SEC) explaining how he plans to divest from some $180 million in Exxon stock. While Tillerson's attorneys describe the scheme as a way to sever ties with the oil giant, Public Citizen's David Arkush finds a discrepancy in the legal filings that suggest Tillerson may still have reason for allegiance to Exxon, rather than the well-being of U.S foreign policy.

"In the agreement between Exxon and the trustee [set to keep Tillerson's holdings while he serves as Sec. of State]," Arkush finds wording "that would leave him with a clear incentive to still favor Exxon as Secretary of State."

"He has viewed the entire world through the lens of what's good for Exxon," Arkush explains after detailing the concerns with the SEC declarations. "A lot of people look at that record and are critical of the fact that he has no government experience and, technically, I guess, in a certain sense, no foreign policy experience. I don't think that's the issue. I think the issue is he does have experience...He has spent 41 years working at a single company that has a single motive, which is to make money by finding oil around the world, digging it up, and burning it." He goes on to optimistically warn: "We are headed toward utter disaster."

On today's BradCast, Donald Trump officially becomes President-Elect, House Republicans adopt a radical restructuring of the U.S. Government at the long-sought behest of the Koch Brothers, and Trump's nominee for Attorney General is exposed as a liar. [Audio link to show posted below.]

While corporate media were covering another mass shooting, this one allegedly by an Army veteran in Florida, the U.S. Congress met in a Joint Session today to certify the final Electoral College vote count. Despite multiple challenges to the results in 10 different states by House Democrats from the Progressive and Black Caucuses, not one U.S. Senator (Democratic, Republican or, yes, Independent) stepped up to join them, as required by the Constitution, for an official challenge to the results. We have full coverage of that, along with the citizen protests inside the Senate chamber as Vice President Joe Biden officially certified the results.

In another reminder that Democrats may not yet full appreciate what we are all now up against, Republicans in the U.S. House passed the radical REINS Act ("Regulations from the Executive in Need of Scrutiny" Act) on the second day of the Congressional session. The bill, which the Koch Brothers and their many political organizations have been pushing for years, will upend more than a century of governmental functioning by requiring that every major regulation adopted by a federal agency be approved by both houses of Congress within 70 days. Under the Act, if either the House or Senate fail to ratify new regulations --- created by experts, sometimes over many years, to enforce laws passed by Congress --- it cannot be enforced, and no other similar regulation can be considered until the next session of Congress, a year or two later.

Investigative journalist Steve Horn, who covered the bill's passage in the House at DeSmogBlog yesterday, joins us to discuss the disturbing and far-reaching ramifications if this bill passes in the Senate and is signed by the President, and why it is that it's seemingly receiving little or no attention or concern from Democrats or corporate media.

"The Koch Brothers and the entities they fund...see this as a potential landmark thing. It's huge," Horn tells me. "If it gets through the courts, it could be something akin to a Citizens United, where it sets a whole new precedent. I think the Koch Brothers see this as a potential sea change in government. They want to change the landscape altogether." Well, this'll do it.

Then, as the GOP is drastically limiting the number of days and witnesses for upcoming confirmation hearings of Trump's top appointments, more than 1,000 attorneys are opposing the controversial appointment of Alabama Sen. Jeff Sessions as the next U.S. Attorney General. And a number of longtime DoJ Civil Rights Unit attorneys are calling him out for lying about his litigation record on civil rights when he served as US Attorney in the 80s.

And, finally, Michelle Obama, in her final remarks as First Lady at the White House, called for hope, not fear, as we all move forward together...

On today's BradCast, it's another busy day of warmongering on Capitol Hill, attempts to gut American's health care systems, and one last-ditch effort to keep Trump from becoming the President-Elect. [Audio link to the show follows below.]

The cyberwar-mongering against Russia continued today in both the U.S. media and U.S. Congress, despite wildly erroneous reporting by mainstream media outlets and the disturbing lack of public evidence to support both the claims and calls from Democrats and some Republicans alike, to go on the offensive against the former Soviet nation. Those calls increased today during a U.S. Senate hearing with outgoing Dir. of National Intelligence James Clapper (who previously lied to Congress about the NSA's bulk collection on American email and phone call information), and despite new revelations that the FBI never examined the computer servers of the DNC, which they allege to have been hacked by Russia in hopes of supporting Donald Trump over Hillary Clinton.

Then, a new report documents an attempt from a bi-partisan legal team hoping to block the ratification of Trump's Electoral College victory in Congress on Friday. The effort is based on the group's 1,000-page documented legal finding that more than 50 of Trump's electors were unlawfully and/or unconstitutionally seated.

Alternet journalist Steve Rosenfeld, who broke the story late last night, joins us to explain the basis for the last-ditch effort to stop Trump, its chances for success, and some Congressional Democrats' surprising response to it.

"Everywhere you look under the rug, there's something else that is either broken or not followed when it comes to the partisan tinkering of elections," Rosenfeld tells me, arguing that Dems should use the information from the legal experts to both challenge Trump's (lack of) mandate and, at the very least, "as a moment to lecture the Republicans on voter suppression." He adds that despite the seeming Hail Mary nature of the effort, "today people are frantically searching for a Senator" to support a challenge to the Electoral College results during the Joint Session of Congress scheduled for Friday. Today on The BradCast: The U.S. electoral disasters continue, GOP takeover and theft, and what non-Rightwingers can do about it all. [Audio link to show posted below.]

House Republicans snuck in something else in their new U.S. House rules yesterday, beyond their aborted attempt to gut the independent Office of Congressional Ethics: a provision to make it easier to give away federal lands. Desi Doyen fills us in on the scheme.

Then, a few updates --- troubling ones --- on the attempted Wisconsin Presidential 'Recount', where at least 11,000 votes were revealed to have been mistallied (in a state that Donald Trump reportedly won by just 22,000 votes), only half the ballots were allowed to be counted by hand, the cost was about half of what Green Party nominee Jill Stein had been forced to pay, and the final turnout and voter registration numbers in the state are still unknown (ensuring the results still cannot be verified as accurate, even as Congress will accept the Electoral College results on Friday.)

Those are just a few of the reasons why WI is found near the bottom of the list of states in the Electoral Integrity Project's newest report. Most of the lowest-ranked states (14 of the bottom 15) are in the South and/or have both legislatures and governorships controlled by Republicans. The survey, a project of Harvard University and the University of Sydney, also determined the U.S., once again, to be near the bottom of the list of established democracies when it comes to how world political scientists and election experts rate our elections.

Finally, we open the phone lines today to ask listeners: What now? What can progressives, Democrats, the left, the center-left, the center --- basically, the non-Right --- do as Republicans take control of Congress, the White House and a stolen U.S. Supreme Court? On today's BradCast: Enough playing defense. It's time for Democrats to go on the offense, in states all across the country, to expand the franchise, in numerous ways, rather than simply defending against increasing Republican efforts to restrict voting rights. And where they won't, it's time for progressives to hold them accountable for it. [Audio link to show follows below.]

Today I'm joined by Daniel Nichanian, election expert and post-doctoral fellow in political science at the University of Chicago to discuss his "Voting Rights Manifesto: A State-by-State Plan to Defend Democracy", as recently published in Vox.com's "Big Ideas" series.

Nichanian explains where and how Democrats can and must take action, right now, even during the Trump years, to expand voting rights and access to the polls. Yes, it can (and must) be done in states across the country where Democrats still have control of legislatures and governorships. In many cases, as he describes, Dems don't even need to control both.

No need to wait for and hope that Congressional Republicans to restore the Voting Rights Act, which they probably will never actually do. There are many ways for Democrats to expand voter registration (such as automatic universal registration and other reforms), expand the pool of those eligible to vote (restoring millions of felons' voting rights, for example), ways to make it easier to vote (early voting and easier access to absentee voting), and many other tools to take a proactive stand in the new year.

"The Democratic Party has not been at the forefront of the voting rights issue in the past two years," Nichanian observes. "The issue has really come to a head since the wave of Republican takeovers of state houses in 2010 and 2014, when the Republican Party really prioritized, in state after state, putting in place a very ambitious and consistent agenda of its own to curtail voting rights. The extent to which the Republican Party has prioritized this issue, it keeps taking Democrats by surprise." But, he explains, "when the Democratic Party has power, in many places, they really don't get their act together to think about what has to be done on this issue, and actually get it done."

We discuss how Democrats can do so. We also try and hold them accountable for not having done so to date in so many places where they should have by now --- even in places like New York and California. I'm hoping the conversation, and Nichanian's piece at Vox, might give us all something positive to work for in the new year, even at the same time as progressives build the resistance against the destructive, anti-democratic agenda of Donald Trump and the GOP.

The Arctic has turned freakishly warm over the past two months of what is likely to be the warmest year ever recorded on the planet (for the third year in a row). She also has some good news as the year wraps up, however: A new poll finds that Trump's voters actually support regulations on the burning of carbon that causes global warming and, something that even Trump can't change, solar power is now the world's cheapest form of energy. Take that, Big Oil, Big Coal and 2016!...
