Voting is now officially under way in the 2018 midterm general elections, as Early Voting finally began on Friday in Minnesota and South Dakota and, very shortly, in at least half a dozen other states around the country in advance of Election Day on November 6th. Voting, however, will not be nearly as simple and verifiable for voters in Georgia, as we discuss in some detail on today's BradCast. [Audio link to complete show is posted below.]

Meanwhile, as media continue to focus on the extraordinary allegation of sexual assault against U.S. Supreme Court nominee Brett Kavanaugh (and Trump's new response to them), as made by Palo Alto University psychology professor Christine Blasey Ford, and whether or not she will appear to give testimony about it to the U.S. Senate Judiciary Committee next week, the continuing danger and toxic fallout from Hurricane Florence continues in both North and South Carolina a full week after the storm first made landfall. An urgent warning Thursday from Duke Energy about the imminent rupture of a giant holding pond reservoir where toxic coal ash waste is stored became a reality on Friday. At the same time, the human death toll from the storm rose to at least 42, with new evacuations called for in South Carolina on Friday due to still-rising rivers as thousands remained dislocated or without power in North Carolina.

Next, we move to the shameful situation in Georgia, just weeks out from the crucial midterm elections, where Sec. of State Brian Kemp --- the Trump-endorsed Republican who is running for Governor this year against Democratic nominee Stacey Abrams --- is allowing inaccurate voter registration forms, falsely instructing first-time voters that they must mail in proof of residence when registering, to be used across the state.

Even more disturbing is the fact that Peach State voters will be forced, once again, to vote on 100% unverifiable touchscreen voting systems on Election Day, despite a U.S. District Court Judge finding them this week to be "unverifiable" and featuring "serious vulnerabilities" which are "not just a theoretical, paranoid notion at this point," as defendants in the case, including Kemp, had argued in court. Nonetheless, in response to a motion filed by plaintiffs seeking to force the state to allow Election Day voters to use the same hand-marked paper ballots used for absentee voting for years across the state, Judge Amy Totenberg is allowing GA's unsecurable and unverifiable 16-year old Diebold touchscreen voting machines to be used yet again this November. In her ruling [PDF], she cites defendants' claims of "chaos" and forced poll closures they threatened would ensue if hand-marked paper ballots were ordered for use at polling places this year.

We're joined today by longtime Election Integrity advocate and one of the plaintiffs in the GA case, MARILYN MARKS of the Coalition for Good Governance, to discuss this week's ruling and Kemp's disingenuous defense of his indefensible voting systems.

"The defendants put the judge in a very difficult place because they essentially threatened that they would sabotage the election. They didn't really use those words, but they said, 'We're going to shut down early voting locations in Fulton County'. Fulton County [Atlanta] has 21 early voting locations. They said 'We'll go down to three'. In their briefing, they said they'd go down to one. They also said they may close Election Day polling places if she were to require them to go to a paper ballot," Marks tells me. "And so the vast majority of Georgia's voters are going to vote on what the judge has basically said is going to be an unconstitutional system."

"The court was already very well aware of the science, and she was quite aware of the lack of any effort, and lack of any science, and lack of any expert testimony put on by the defendants. So I think that her decision didn't rest on the science. It was this whole threat of chaos."

Moreover, she says, the state has also falsely claimed that counties were required to use the unverifiable touchscreen systems. "The state not only had been saying it was required by state law, but they had threatened the counties who began to recognize it wasn't required by state law, and that the counties, local authorities, have the ability, on their own, to go to paper ballots. The Secretary of State has been threatening them, telling them 'No, you do not have that authority.' They even told the press that they would punish counties that went to paper ballots."

While Marks, who is a Republican herself, reports the multi-partisan plaintiffs are justifiably disappointed in the court's ruling for the short term, she also details several key findings from the ruling which will be important to the continuing efforts both in this case and other federal challenges like it around the country. Among the favorable finding are that plaintiffs do, in fact, have Constitutional standing to challenge such voting systems in federal court, and that "further delay", according to Judge Totenberg, in moving the state to a verifiable voting system after this year's elections, is "not tolerable".

"The important thing here," Marks explains, is that the judge "said that we were likely to prevail on the merits as we move forward in this case, and our claims are related to constitutional claims. And that is what the scholars, the lawyers, the election advocates across the country are recognizing as such a very important finding in the ruling she has made here. That we are likely to prevail in our argument that this is an unconstitutional system, when the voters cannot rely on an auditable, verifiable system."

Marks also explains one moment from the hearing where she said she thought later: "Man, I'm glad Brad isn't here to hear this, or his head would have exploded." My head subsequently explodes when she relays the story and for much of the rest of my interview today.

While Abrams, Kemp's African-American opponent in the Gubernatorial election, is calling for voters to cast hand-marked paper absentee ballots this year to increase the likelihood of them being accurately tallied, Marks explains why she is not certain that is actually a better option for voters in the state. She details the Catch-22 that GA voters are once again facing, not unlike the Catch-22 Judge Totenberg said she found herself in while deciding how to rule on plaintiffs' motion this week.

On today's BradCast, as my producer Desi Doyen likes to say, we once again attempt "to squeeze a 10 pound show into a 1 pound bag." [Audio link to show follows below.]

First up, the latest on Hurricane Florence, now downgraded to a tropical storm but wreaking extraordinary havoc, storm surge, flooding, hundreds of rescues and now at least five deaths. The monster storm has largely stalled over the Carolinas to dump, according to one meteorologist, 10 trillion gallons of rainfall, or enough to fill more than 15 million Olympic-size swimming pools.

Also today, Donald Trump's former campaign chair Paul Manafort finally pleaded guilty in a deal to cooperate with Special Counsel Robert Mueller that requires him to cooperate on the Trump/Russia investigation and, as Marcy Wheeler describes, is "pardon proof".

Next, an update on the still-unexplained natural gas explosions that set dozens of homes ablaze north of Boston, a story which broke at the very end of yesterday's BradCast.

Then, a brief followup on the reported widespread problems with voter registrations in New York during their state and local primaries on Thursday, the final primaries of the season before the crucial 2018 midterm elections in November. Those reported failures for some voters at polling places helped underscored at least one of the important outcomes from Thursday's contests.

We're joined by The Intercept and New Republic contributor DAVID DAYEN to discuss reported results out of New York, where progressive actress and activist Cynthia Nixon challenged two-term Democratic Gov. Andrew Cuomo and progressive Fordham University law professor Zephyr Teachout vied for the Democratic nod to become the state's next Attorney General. Alas, those underdog progressive upstarts on the statewide ballot were unsuccessful, though, as Dayen reports, Teachout was undermined by a rightwing Democratic Congressman who, he tells me was likely "placed in there to depress Teachout's upstate numbers on behalf of Wall Street special interests."

Still, he says, both challenges managed to force Cuomo and his party to the left on a number of important matters already. That move to the left was more of a lurch, however, at the state Senate level, where 6 of 8 members of the so-called Independent Democratic Conference (or IDC, a group of corporate Democrats who had caucused with Republicans in the Senate, giving the GOP control of the otherwise Democratic-majority body) were turfed out by progressive challengers. That, Dayen argues, is likely to result in a huge difference in the legislation enacted by a state legislative body that has been blocked for years, with Cuomo's help, from adopting a number of long-overdue progressive reforms on everything from healthcare to fiscal matters to New York's antiquated election laws.

"There was this host of progressive legislation that was clogged in the state of New York because of Republican control of the state senate, which was facilitated by Democrats. It's confounding that this went on for so long!," he observes."Andrew Cuomo is a throwback to the New Democrats, the Clinton era. And he believes that if he was forced to sign progressive legislation, it would hurt his ultimate ambition, which is the presidency. He's still stuck in a 1990s mindset that you can't go any further left than, I guess, 'midnight basketball' laws in order to win the Presidency."

And, as primary season voting is finally now wrapped up, we discuss the various ways in which voters and broadly diverse candidacies have helped to redefine the Democratic Party over the past year. "The Democratic Party is one of the more diverse parties at this point in history that we've seen, certainly ever in America, maybe elsewhere. Representation absolutely matters. The people who are the workhorses of the Democratic Party --- women, people of color --- want to see themselves represented in the leadership that is going to carry the party forward."

Also, on this week's 10th anniversary of the 2008 global financial meltdown, Dayen, author of the widely acclaimed Chain of Title: How Three Ordinary Americans Uncovered Wall Street's Great Foreclosure Fraud, explains how even a decade later no real accountability has ever been brought to the elite who caused the crisis and how even Barack Obama's own Treasury Secretary was allowed to undermine him in a way that is not dissimilar to the actions discussed in the recent anonymous New York Times op-ed regarding a "resistance" inside the Trump Administration.

Dayen also discusses several other way in which the ramifications of the Wall Street bank bailouts still reverberate throughout the American body politic, by "set[ting] the table for demagogues. And that's what happened in 2016."

Finally today, some details from concerned scientists on the nuclear plants currently threatened by the massive flooding of Florence, specifically, the Duke Energy-owned Brunswick plant in North Carolina which houses two reactors almost identical to the GE-designed reactors which melted down after power-outages following the 2011 tsunami-caused flooding in Japan...

Perhaps our title for today's BradCast, which is a quote from North Carolina Governor Roy Cooper in advance of Hurricane Florence, should have its apostrophe removed. "Disasters at the Doorstep" may better describe the multiple disasters, breaking and otherwise, covered on today's show. [Audio link to full show follows below.]

It was the final primary election day of the year today, before the crucial November midterms, and we've got coverage of results out of Rhode Island, which voted on Wednesday, and problem reports out of New York, which voted on Thursday. But first, the latest on Hurricane Florence as she begins to make landfall on the U.S. southeastern seaboard and, while downgraded to a Category 2 as of air time, still poses an extraordinary and potentially catastrophic threat to millions of Americans from not just winds, but massive storm surge and rainfall (and a host of toxic threats to go with it.) That's the first, but hardly the only disaster covered on today's program.

Then, reported primary results from the final federal primary election of the year in Rhode Island on Wednesday, where a "computer glitch" via a third-party vendor who runs the state's DVM website imperiled thousands of voter registrations this week. Thankfully, in what may be one of the only disasters averted, as covered today, the problem was discovered in time for those voters to be properly added to the rolls before polls opened for Wednesday's elections. The largely "blue" state saw victories for both centrist and progressive Democrats alike. We report on a number of the noteworthy results.

The news may be less good for voters in New York, which is holding the final primary contests of the year for state and local offices --- their federal primaries were held in June. Problems are being reported today by voters in New York City who said they did not appear on the rolls at precincts today as expected or whose party registrations were inaccurate. Several closely watched contests by progressives are on the ballot, including actress Cynthia Nixon's Democratic primary challenge to Gov. Andrew Cuomo and progressive activist Zephyr Teachout attempt to win the Dem nod for state Attorney General.

We discuss what we know (and don't yet) about those widespread voter registration problems being reported today, which echo massive disenfranchisement problems during the 2016 Presidential primary between Hillary Clinton and Bernie Sanders in the Big Apple. That 2016 disaster was due to an unlawful purge of more than 100,000 voters by the NYC Board of Elections. However, despite persistent claims by many Sanders supporters to this day, no evidence exists to tie the illegal purge to either Clinton or the Democratic Party itself. The cause for what may --- or may not --- have happened today, remained even murkier as of airtime.

Next --- after disturbing breaking news out of Massachusetts where fires have exploded in at least 60 homes in three communities north of Boston, for still-unknown reasons, and out of Hawaii, where Tropical Storm Olivia has nearly topped an earthen reservoir, threatening thousands who live below its dam --- a brief, if angry rebuttal to Donald Trump's twisted and wholly fabricated claim today that some 3,000 Puerto Ricans did not die due to last year's Hurricane Maria in Puerto Rico.

Yes, the President of the United States is now a Maria Denier, claiming that Democrats are somehow behind the officially confirmed numbers --- which are higher than 2005's Hurricane Katrina or the 9/11 attacks --- and simply made them up to "make [him] look as bad as possible". We share the actual facts behind the (conservatively low!) numbers and some of the broad condemnation in response to his false claim from both Democrats and Republicans alike today.

Finally, Desi Doyen joins us for the latest Green News Report with more on the many threats posed by Florence, Trump's latest undermining of action meant to curb global warming, and a new dire warning from the U.N. Secretary General regarding the quickly growing threat of climate change...

On today's BradCast: Some encouraging election news. More disturbing news about the Republican's "sham" rush rob to ram through another GOP activist onto the U.S. Supreme Court before they could lose their slim majority in the U.S. Senate. And the re-emergence of Barack Obama before the November midterms. [Audio link to show follows below.]

First up today, noteworthy reported results from Thursday's midterm primary elections in Delaware and some largely good election news elsewhere.

In Florida on Friday, a federal judge ordered 32 counties sued by a number of voting rights and Latino advocacy groups to immediately publish election materials in Spanish, in addition to English, in compliance with the Voting Rights Act. As we discussed with Demos' Senior Counsel Stuart Naifeh on a program last week, the groups had sued after the counties failed to comply with the VRA, despite some 50,000 U.S. citizens who were dislocated from Puerto Rico after Hurricane Maria having trouble re-registering and voting in the Sunshine State's "English only" counties. The judge's ruling, suffice to say, suggests he was VERY unhappy with the defendants in the case.

In Kansas, a Republican candidate for the state's House of Representatives has been arrested on election fraud charges. Notably, the Sec. of State Kris Kobach, a longtime GOP "voter fraud" fraudster and now the state's Republican nominee for Governor, had no comment on the arrest after having failed to bring the charges himself, despite convincing the state legislature to give him prosecutorial powers (the only SoS in the nation with such powers) and despite having made claims of a massive "voter fraud" epidemic central to his role as the state's chief election official.

Then, the week-long circus at the U.S. Senate Judiciary Committee's confirmation hearings for Donald Trump's U.S. Supreme Court nominee, former Republican activist turned D.C. Court of Appeals Judge Brett Kavanaugh, wrapped up on Friday, with still more late disclosure's about Kavanaugh's record while serving as an operative in the George W. Bush Whitehouse. The disclosures come from documents from during that period which Republicans had attempted to keep "confidential" from the American public.

Salon's political reporter AMANDA MARCOTTE, who's been reporting on the proceedings, joins us to discuss what we've learned --- and haven't --- about Kavanaugh and the Democrats' surprisingly united and aggressive attempt to block his confirmation. "The Senate Democrats came at this in a way that I don't think I've ever seen them do anything of this sort before. They had an organized strategy, and they executed it pretty well," she explains.

We focus specifically today on Kavanaugh's "threat to women's health and safety" with his disingenuous and misleading statements to the Committee (and to potential swing voting Republican Sens. Susan Collins and Lisa Murkowski) about Roe v. Wade's Constitutional right to an abortion as "settled law". Several lines of questioning from Sen. Kamala Harris (D-CA) this week, as well as so-called "committee confidential" documents released by Sen. Cory Booker (D-NJ) --- at threat of Senate expulsion --- underscore the con that both Republicans and the activist Judge Kavanaugh are attempting to pull off on the American public.

"If you were a space alien and you just dropped in to watch these hearings, you would get the impression that the Republicans think of Brett Kavanaugh as a liberal lion. All they do is talk about how anti-racist he is, how pro-equality. The cases that he's ruled on that they've highlighted were the three or four extremely rare ones where he sided with working people or oppressed people or people trying to get healthcare. The tiny minority of his cases. They barely go a minute without talking about how much he loves women, and he's practically a feminist," Marcotte says. "It's been kind of surreal, because obviously they don't believe a word of it, because if they actually thought he was any of the things they were presenting him as, they wouldn't have nominated him."

She charges Kavanaugh has been trying to "imply that he's going to uphold Roe", though "he clearly has no intention of doing it. That's why the leaked emails were such a big deal...These hearings should be understood as an elaborate theater to give Susan Collins and Lisa Murkowski cover while they vote, to claim that they're pro-choice while voting to overturn to Roe v. Wade."

We also take a few minutes to discuss Marcotte's recently published book, Troll Nation: How the Right Became Trump-Worshiping Monsters Set on Rat-F*cking Liberals, America, and Truth Itself --- not that she has particularly strong opinions on such things.

Finally, after another tough week --- almost a year and a half of them, in fact --- former President Barack Obama reemerged on Friday with a speech at the University of Illinois that unloaded on Trump as, among other things, "a symptom, not the cause" of our current woes. More importantly, he offered some advice and inspiration regarding the necessity of voting in this November's midterms and elections beyond them. We close out the week with some excerpts from his address...

Lots of news (for a change?) on today's BradCast after a tremendously busy news weekend (for a change?) [Audio link to today's show is posted below.]

Among the stories covered on today's program: In a fairly transparent attempt to distract from all of his Administration's --- and his own personal --- scandals, Donald Trump announed today that he plans to pull the U.S. out of the North American Free Trade Agreement (NAFTA) between the U.S., Canada and Mexico, and is striking a new trade agreement with Mexico only. We caution to be very aware of that claim.

Then, we're joined by STUART NAIFEH, Senior Counsel at Demos to discuss the lawsuit recently filed by his group and a number of Hispanic-American organizations against 32 counties in the state of Florida. Following last year's catastrophic Hurricane Maria in Puerto Rico, more than 133,000 U.S. citizens living on the island relocated to the Continental U.S., according to the Center for Puerto Rican Studies, which estimates [PDF] more than 54,000 of them now live in Florida. These U.S. Citizens, many of whom speak Spanish only, can now re-register and vote in the state, but the counties named in the lawsuit make election materials available in English only, in violation, the groups argue, of Section4(e) of the 1965 Voting Rights Act. The groups are suing to force those counties to produce election materials in Spanish before the November 2018 midterms and argue that the English-only procedures have led to lower than expected registration by these potential voters in the Sunshine State. Naifeh says this has been a longstanding issue in Florida, but even more of an issue since Maria, since there are suddenly "a lot of people coming all at once with limited English," he says.

Naifeh also explains another lawsuit just filed by the group against the state of Arizona, where the Secretary of State is not properly re-registering voters who have changed their addresses on their drivers licenses through the DMV. That, he argues, means that some 500,000 registered voters, whose registrations should be automatically moved, may find themselves unable to vote or will have their provisional ballots tossed out this November, because "Arizona has been systematically failing to update voting addresses," as required by 1993's National Voter Registration Act. Voters in both states --- Florida and Arizona --- are heading to the polls on Tuesday for their state's midterm primary elections.

Then, some breaking news out of North Carolina, where a federal court panel has found the state's U.S. House Districts to be an unconstitutional partisan gerrymander. That, after the federal courts found the previous maps were unconstitutional racial gerrymanders. The court may order new maps to be redrawn in advance of the November election! If they do, and if the U.S. Supreme Court is deadlocked 4 to 4 on an emergency appeal by the state before a new Justice is seated, then the lower court's order to use new maps for the November 6th election would stand!

Next, over the weekend, the DNC voted to change their bylaws to restrict the role of so-called SuperDelegates (party insiders, activists and elected officials) in the nominating process for Presidential candidates. Under the new scheme, adopted by an overwhelming voice vote at the weekend's annual Summer meeting in Chicago, SuperDelegates would have no vote for the party's Presidential nominee on the first ballot at the Democratic National Convention, leaving the selection of the nominee (if he or she can get a majority on the first ballot) up to state primary and caucus voters, rather than party insiders, before the Convention.

Also today, the Government's student loan ombudsman at the Consumer Financial Protection Bureau (CFPB) has resigned, charging in a scathing resignation letter that the Trump Administration is using the Bureau "to serve the wishes of the most powerful financial companies in America" by allowing private for-profit colleges, universities and student loan companies to run roughshod over American families, despite mandates from Congress to end the decades-long ripoffs by such companies.

After a quick report on Saturday's primary elections in Hawaii (moderate Democrats did well, more progressive candidates less so), we head straight out to Las Vegas for today's BradCast, where the 26th annual hackers convention, DEF CON, held its 2nd annual Vote Hacking Village. [Audio link to show follows below.]

After every voting system on display at last year's event was hacked within minutes by conference attendees, organizers tried to make it a bit more difficult this year. They made unverifiable electronic voting systems, optical-scan paper ballot tabulators and electronic pollbooks from a number of companies --- almost all of which will be in wide use across the country once again for this November's crucial midterms --- available for investigation and penetration. Once again, the hackers in attendance made short order of pretty much all of them.

Stunning vulnerabilities [PDF] were discovered, including some that officials have known about (and ignored or tried to keep secret for years) while others were revealed for the first time. Things like Chinese pop song files were found on one system used in actual elections recently, along with a host of other disturbing findings, which we summarize today.

Other disturbing findings regard the ES&S m650, an optical scanner used to tabulate paper absentee ballots in more than half of the country. Hackers discovered several severe vulnerabilities (some of which have been known for more than a decade, and others which election officials hoped to withhold from the public), including the ease with which the machine's entire operating system can be overwritten by inserting a zipdrive with a file named "update" before powering it on. Also, electronic pollbooks were found to be corruptible in seconds and found to store unencrypted administrative passwords --- in plain text format! --- on their removable memory cards (one of which was simply "password".)

There was also a mock election run on the systems still used in states like Georgia. In that election, a candidate not even on the ballot ending up winning. In another case which officials should take note of, a ballot cast via email was intercepted and changed. "The selection of the candidate was changed so that when it was received it was different from what was sent," the organizers note. "This is a big deal for the real world because we already allow for email balloting, in special cases for Americans living overseas [such as active military]. This is allowed in 30 states plus DC."

Moreover, the Voting Village organizers also offered replicas of swing-state Sec. of State website available to some 50 children from ages 6 to 17. You'll be shocked to learn that most were able to hack the mock SoS websites in some fashion, including changing candidates names and parties, and tampering with reported elections results to show, for example, 12 billion votes cast. The fastest exploit of a Sec. of State replica site (Florida's) was by an 11-year old who did it in 10 minutes!

We're joined today to discuss all of this by Emmy-award winning journalist and documentarian LULU FRIESDAT whose video from last year's DEF CON Voting Village went viral (several times) since then, and who was on hand to document this past weekend's conference once again. She details the extraordinary "sea change" since last year's event, as many elections officials and U.S. Intelligence Community representatives were on hand for this year's festivities.

"What's really great about this year's Def Con is that we are starting to see a collaboration and communication between three groups that really have been working more as silos previously, and that is election officials, security experts, and hackers," Friesdat reports. "It was very deliberate on the part of the organizers, Jake Braun, Harri Hursti and Matt Blaze, to really try to bring those three groups together... Because we're not going to make progress on this issue unless these three groups start communicating with each other."

"We don't have a one-size-fits-all solution for this. Every county is going to have to have some different solutions. What we have are principles. And I think the principles remain the same. The principles are yes, every voter who can mark a ballot by hand, needs to mark a ballot by hand. And security experts across the board are really starting to say that, openly publicly."

"There is a sea change happening. You really could feel it. This year, there was an entire panel of election officials, whereas last year almost none of them actually came," Friesdat tells me, adding cautiously: "There are thousands of election officials all over the country who are still dragging their feet. You look at states like Georgia, and they are doing everything they can to stay in basically an unauthenticated election protocol. So it is a wide spectrum."

Among the noteworthy accounts from Friesdat, we discuss California Sec. of State Alex Padilla's call for more federal funding for election systems (meaning, more money for more computers) and Colorado Elections Manager Dwight Shellman who, though a fan of electronic tabulation, calls for routine post-election audits everywhere (which almost no states do at all.)

We also discuss the remarks at the conference by DHS Asst. Secretary for Cybersecurity and Communications Jeanette Manfra, who admitted last summer during U.S. Senate Hearings that the agency never found evidence that votes were changed in the 2016 Presidential election, in no small part, because nobody ever bothered to look! DHS never carried out any forensic investigations of voting systems, nor even bothered to count ballots to make sure they were accurately tabulated by counting computers in the election, despite the ongoing warnings by the Intelligence Community of Russian cyberattacks and interference. "Could it be done?," Friesdat asks rhetorically, "The answer, over and over and over again, is yes, it could be done. Election results could be manipulated. And is it difficult? No. It is a piece of cake."

While this year's DEF CON Voting Village was another huge leap forward in bringing concerns about all of these systems to the public, it appears we have a long way to go until American figures out the solution. I'd suggest that solution is public oversight of tabulation of hand-marked paper ballots (Not computers, but people! I call it "Democracy's Gold Standard".) But, hey, computers --- all of which are obviously wildly hackable --- could work too, right?

It's yet another wild ride on today's BradCast! Climb aboard and buckle up! [Audio link to show is posted below.]

First up, the saga of Kansas' wildly close primary election for the GOP gubernatorial nomination between current Gov. Jeff Colyer and the oft-disgraced Sec. of State Kris Kobach grows more acrimonious by the hour. The fight over Kobach's refusal then agreement to recuse himself from the counting and canvassing process now includes Colyer charging Kobach is giving counties advice on counting provisional and mail-in ballots that is "inconsistent with Kansas law" and that Colyer's new "voter integrity" hotline has received hundreds of calls, including claims that voters were "turned away" from the polls on Tuesday and had trouble finding Colyer's name on the ballot. (The latter complaint, as I explain, could be a result of new ES&S ExpressVote touchscreen voting machines now used in several KS counties. Those machines, in crowded races, fail to show all candidates on a single screen, requiring the voter to hit a "More" button.) A recount and/or litigation between the two Republicans may lie ahead, in what couldn't be a better result for Democrats if they'd designed it themselves.

Then, a followup on the Trump EPA's recent announcement that they intend to bring asbestos back and about the Russian company which mines and sells most of the world's supply of the deadly mineral. The firm, according to their own Facebook page recently, is now actually stamping Donald Trump's face on their packaging!

Next, we're joined by the L.A. Times' Pulitzer Prize-winning journalist MICHAEL HILTZIK to discuss the real story behind Trump's recent tweets on California's ongoing record wildfires and the President's bizarre suggestion that the out-of-control blazes are due to "bad environmental laws" and mismanagement of the state's water system. He claims the firses are happening because California allows water to be "foolishly diverted into the Pacific Ocean". While none of those things are actually anywhere close to the truth or the reason for the global warming-fueled fires, Hiltzik explains how Trump's misinformed claims actually appear part of an effort by the Interior and Commerce Departments to exploit the ongoing catastrophes as a way to strip away the state's control of its own water system and, believe it or not, as a pretext for Interior Secretary Ryan Zinke's hopes of hollowing out the Endangered Species Act.

Hiltzik describes Trump as the "Drought Denier in Chief" while explaining that the state of California has said they have plenty of water to fight the fires. "The diversion of water" in the state is not to the ocean, as Trump charges, but "for growers in the Central Valley of California who live in one of the very few Republican zones in the state and are basically supported by the very few Republican office-holders we have in Congress."

"Under federal law," he explains, "water has to be kept flowing through a lot of our rivers so that fish, and fishermen, and fisheries are supported, and we don't let those species go extinct. And when I say 'going extinct', it's not only fish at risk of going extinct but, as I've reported, there are salmon fishermen on the coast whose livelihoods are at risk of going extinct because the salmon are being stressed by federal policies that don't allow enough water to flow down the rivers they use."

"So growers have been on the warpath, saying 'Oh, we're not getting water, we're drying up because of these biological opinions that say the fish need the water'. These are biological opinions that were issued in accordance with the federal Endangered Species Act. So, Trump has been out for the ESA since the get-go."

But why do Trump and the Republicans favor the farming industry over the state's billion dollar fishing industry? Hiltzik explains that and much more, as the Administration ups their efforts to avoid letting a good catastrophe go to waste.

Finally, some good news for voters in North Carolina, where a federal court has blocked the state from purging voters without notice or in the 90 days before an election; A jury verdict out of San Francisco awards $290 million to a school groundskeeper after finding Monsanto liable for his terminal cancer tied to the use of their toxic weed killer RoundUp; And we close out with Jimmy Kimmel's clever idea for trying to convince Trump to give a damn about our ever-worsening climate crisis...

On today's BradCast: While voters head to the polls today in Ohio, Missouri, Michigan, Kansas and Washington state (results and problem reports from those states on tomorrow's show), we look at some of the problems still emerging from primary races earlier this year, and new documentation on Donald Trump's now-disbanded hoax "voter fraud" commission, headed up by Kansas' con-man Secretary of State Kris Kobach (who is on the KS ballot seeking the GOP nomination for Governor today). We also look at some of the Trump voters who say they've had enough, and the "idiots" still with him, even as he continues to undermine them, the economy and small business across the country. Among the stories covered on today's program...

• Maine's Democratic Sec. of State Matt Dunlap who, as a Commissioner on Trump's so-called "Presidential Advisory Commission on Election Integrity" was forced to sue the Commission to get documentation on what they were actually doing, calls his time on the panel "the most bizarre thing I've ever been a part of". After finally receiving some 8,000 documents by court order, Dunlap concedes the Commission was little more than a scam to try and prove Trump's evidence-free theory that anywhere from 3 to 5 million illegal votes were cast in the 2016 election (in which some 3 million more votes were cast for Hillary Clinton than Trump.) Long-time GOP "voter fraud" fraudster Kris Kobach responds to Dunlap today, by citing two easily-debunked "reports" on "voter fraud" created by rightwing outlets to hoax the nation into instituting disenfranchising Photo ID voting restrictions at the polls.

• New evidence and testimony submitted with a new court filing in a lawsuit against Georgia and its Sec. of State (and, now, GOP gubernatorial nominee) Brian Kemp, reveal massive problems during the state's May primaries and July primary runoffs, including voters given the wrong ballots, the wrong precincts at which to vote, and, in at least once precinct, 670 ballots cast despite only 276 registered voters in the precinct. (The lawsuit challenges GA's use of 100% unverifiable voting systems and seeks to force the state to move to hand-marked paper ballots before November. My most recent interview with plaintiff Marilyn Marks, the Exec. Dir. of the non-partisan Coalition for Good Governance, is here.)

• Los Angeles County finally has an explanation for why more than 118,000 names were left off the printed polling place voter rosters during California's June 5th statewide primary. The County's official explanation is posted here, along with a link to the Executive Summary [PDF] of the report by IBM Security Services, the group commissioned to carry out an independent probe of what happened. The County has chosen to not share the full investigative report with the public.

• Trump's trade war is continuing to take its toll. Toyota recently announced that as much as $3,000 could be added to the sticker price of some of its most popular models, and thousands of U.S. jobs may be imperiled in the bargain. And, as NBC News finds Trump's anti-immigration policies are costing small businesses dearly --- particularly in "Trump Country" from the Midwest to Texas to Maryland --- CNN finds that some, but not all, Trump voters are regretting their 2016 votes and deeply embarrassed by this President.

• Finally, Desi Doyen joins us for our latest Green News Report, as record heat takes its toll across the globe, thousands of fire fighters in California are battling some 16 wildfires, including the largest in state history, toxic algae is stinking up the state of Florida, and something really stinks in North Carolina.

On today's BradCast, our week of exploding ridiculous GOP myths continues. On Tuesday, we debunked the absurd notion that they oppose "big government" in favor of state and local control. Yesterday, the decades-long scam that they oppose debt and deficit spending. Today, their opposition to "socialism" is exposed for the lie that it remains. [Audio link to show follows below.]

But, first up today, Tuesday's primary runoff in Georgia offered yet another stark reminder of what could go terribly wrong in the Peach State --- and all of the others --- this November, as voters were, again, prevented from casting ballots due to a failure in the state's voter registration database and its computerized electronic pollbook system. That, of course, is on top of the 100% unverifiable touch-screen voting systems that voters are still forced to use in Georgia on Election Day --- at least when they are allowed to vote.

But, don't worry. Brian Kemp, the Republican Sec. of State who "oversees" both systems --- including during the several years when the entire registration database and administrative passwords for the tabulation systems were left unprotected online for downloading --- is now the GOP's nominee for Governor in the state. He'll make certain the public has confidence in the results of his race this November between him and Stacey Abrams, who could become the nation's first African-American female Governor.

Then, it's onto Donald Trump's socialist --- yes, socialist --- scheme to bailout farmers in the Midwest who are being devastated by Trump's trade war with China. But, again, don't worry. He's found an old FDR-era New Deal program that the White House plans to use to give farmers $12 billion in tax-payer money to make some of the losses he has caused them a bit less stinging. In response, Republicans in Congress this week pretended to be outraged about the bailout, while taking no actual action to reverse either it or Trump's trade wars with the world.

Of course, the GOP only pretends to oppose socialist programs, which are otherwise wildly popular with the American public. When needed, they are more than happy to privatize profits and socialize losses when they control the reins of government. By way of yet another example today, we share a remarkable story along those lines, about a very powerful Republican family from Indiana who has been enjoying local, state and federal government bailouts for years --- to the tune of some $20 million --- following the failure of their once-formidable gas station empire and the toxic trail it has left behind.

Finally today, Desi Doyen joins us for the latest Green News Report, as heat records continue to be shattered this month, global warming-fueled fires and flooding wreak deadly havoc across the globe and in the U.S., and as Trump and the Republicans expand their ongoing war on the environment, public lands and endangered species...

It's remarkable that Democrats --- and the mainstream corporate media --- have allowed Republicans to get away with claiming to be "conservatives" who support states rights, small government and local control for so many years. As it turns out, the exact opposite is usually true. That becomes abundantly clear whenever and wherever the GOP takes the reins of government power. We've got several examples of that, once again, on today's BradCast. [Audio link to show is posted below.]

As global climate change continues to shatter heat records across the country and planet, the death toll continues to rise along with temperatures and more intense, unexpected (if long-predicted) extreme weather. On Tuesday, at least 74 were killed in sudden wildfires in Greece. That toll, which is expected to rise, comes on the heels of hundreds killed by recent record rain, flooding and accompanying landslides in Japan, and at least 77 dead amid all-time record heat there over the past week alone.

Heat records are being shattered every day of late here in the U.S. as well, including in Phoenix where it topped out at a record 115 degrees on Monday, and where airplanes were grounded for several days last summer thanks to record warmth. This year, however, with the help of Trump's FAA, American Airlines has come up with a way to avoid being grounded despite new record temps. They've just raised the maximum temps under which their planes are allowed to take off! What could go wrong?

At the same time, the Trump Administration is now challenging the state of California's right to set their own fuel efficiency standards for cars, despite an agreement with the Obama Administration that had, with the approval of automakers, established a uniform nationwide standard. The state's right to set its own environmental standards at all --- as established over nearly 50 years under the federal Clean Air Act --- will now, reportedly, be revoked by Trump's EPA who, apparently, have no use for states rights (at least when that's inconvenient to GOP corporate funders.) Let the law suits begin continue.

Similarly, so-called "conservatives" in Texas are attempting to use Big Government state law to preempt efforts by local governments and voters in Austin, San Antonio and Dallas, who hope to establish their own rules for paid sick-leave. Some 40% of Texas workers, according to a recent study, are currently prevented from taking a paid day off when either they or their children get sick. The state's Big Government-loving Governor Greg Abbott and Attorney General Ken Paxton (facing his own securities fraud indictments) oppose the city measures, just as they have in the past when voters in local jurisdictions have attempted to ban fracking, raise minimum wage requirements or even ban plastic bags.

There is, however, a solution. We can all try --- try, at least --- to vote the liars and hypocrites out of office this November. In Nevada, for example, voters are now said to be on the verge of potentially electing the first female majority state legislature in our nation's history. To pull it off, however, and to flip local, state and Congressional seats from "red" to "blue" this year, voters will have to turn out and actually be allowed to cast a vote.

A new study from the Brennan Center for Justice suggests that may be more difficult than many currently appreciate. Their analysis finds that voters are being purged from the rolls at a record pace, particularly in jurisdictions with a history of racial discrimination, where such procedures previously required federal preclearance under the Voting Rights Act (until the GOP majority on the U.S. Supreme Court gutted the landmark 1965 law in 2013.)

So, with just over 100 days remaining until this year's crucial midterm elections, please CHECK YOUR VOTER REGISTRATION to make sure you are still properly registered! Don't wait until its too late!

But, we close today with at least a bit of encouraging news. Despite the stolen GOP majority on the U.S. Supreme Court recently blocking lower federal court rulings finding U.S. House and state legislative seats had been unlawfully gerrymandered by partisans in several states, a number of statewide measures to end partisan gerrymandering will most likely be on the ballot this November. Unless, that is, so-called "conservative" Republicans block the so-far wildly successful, bi-partisan grassroots initiatives in states like Michigan, Missouri, Colorado and Utah...

A whole lotta stuff happened over the long holiday weekend, much of which the Trump Administration hopes you don't notice at all. We try help you notice them on today's BradCast. [Audio link to full show is posted below.]

But we start with some of the very few bits of good news we could find, as November's elections --- and our only hope --- loom large. First up: A petition drive in Michigan to place a host of election reforms on the ballot appears to have been successful. With 430,000 signatures submitted (far more than the 316,000 required), it looks like Michiganders will be able to vote for automatic voter registration, same-day registration, no-fault absentee voting and much more this Fall.

In Kansas, following a trial and federal court order, Kris Kobach, the state's embarrassing Sec. of State, has finally added some 25,000 voters to the rolls who had been denied access for lack of "Proof of Citizenship" documents. The court struck down the state law requiring the documentation as unconstitutional after Kobach monumentally failed in his defense of the law during the recent trial on behalf of voters who had challenged it. That hasn't stopped the GOP's top "voter fraud" fraudster, however, from claiming --- you guessed it --- fraud during a recent GOP straw poll in advance of the August primary in the state, where Kobach hopes to win the Republican nomination for Governor. (He lost the straw poll to Republican Gov. Jeff Colyer...by a lot.)

In other (largely) good news, Starbucks says they plan to do away with plastic straws to help save the planet (and comply with local governments who are banning them.)

Then, to the much less good news, as all-time heat records were shattered, by double-digits, here in Southern California over the holiday. Though the wildly corrupt fossil-fueled tool Scott Pruitt was finally forced to resign over the holiday weekend as chief of the Environmental Protection Agency (his resignation letter is amazingly creepy!), his second-in-command, Andrew Wheeler, an actual coal industry lobbyist, will now take over the EPA.

Also in recent days, two issues that Trump claims to have fixed (which he broke in the first place), have proven not to have been fixed at all. Despite Sec. of State Mike Pompeo describing recent "denuclearization" talks with North Korea as "productive", the North's Foreign Ministry characterized the U.S. attitude at negotiations as "gangster-like" and "cancerous" just after he left. That, after Donald Trump recently declared: "There is no longer a Nuclear Threat from North Korea".

And, the chaos continues as the Administration is reportedly nowhere near being able to reunite some 3,000 children with their parents, as required by a federal court order and deadlines, after they were separated at the southern border by Trump's immigration goons. That, after identification documents for many of the children were reportedly lost or destroyed, and despite Trump signing an Executive Order two weeks ago which he said would solve the tragic separations that he caused in the first place.

Finally today --- along with a ton of phone calls from listeners on all of the above and much more throughout today's show --- a few words, and some personal remembrances, on the sad passing last week of progressive radio and television broadcaster, and workers' champion, Ed Schultz...

Desi and I are ducking out for a short breather over the Independence Day holiday. But, before we go, I appeared recently on Free Forum, hosted by longtime broadcaster and great interviewer TERRENCE MCNALLY.

So, with McNally's kind permission on today's BradCast, we bring you that recent interview, originally recorded in studio on June 24, 2018 at KPFK, our flagship Pacifica Radio Network station in Los Angeles, in which the tables are turned a bit on me.

I respond to his questions about my background, the bizarre circumstances --- and, yes, election chicanery --- which helped lead me deep into the world of investigative blogging, broadcasting and muckraking some 15 years ago.

We also discuss detailed concerns about the reported (and still unverified) results of the earth-shaking 2016 Presidential election, how jurisdictions around the country are now moving to new computerized voting and tabulation systems in its wake (even as those systems, with computer-marked, barcoded ballots will only sever to make public oversight of results worse, not better) and what Americans can do right now to fight like hell to assure they are able to vote and have their votes counted as per intent in the crucial 2018 midterms.

On today's BradCast: The U.S. Supreme Court seat stolen by Senate Majority Leader Mitch McConnell and his Senate Republicans --- who carried out the unprecedented blockade of President Obama's SCOTUS nominee Merrick Garland for almost a year following the death of Antonin Scalia --- paid off in spades today in two separate 5 to 4 decisions which should forever have an asterisk next to them in the history books. [Audio link to today's show is posted below.]

First up today, however, primary elections are being held in seven states on Tuesday in New York, Maryland, Utah, Colorado and Oklahoma, with primary runoffs in Mississippi and South Carolina. We'll have noteworthy results and problem reports on tomorrow's BradCast, though we already know of one huge problem in Baltimore. (No, it's not a mere "glitch" or "snafu", Baltimore Sun. It is a failure...at the very least!) On Monday night, it was revealed that Maryland failed to include updated voter registration information for some 80,0000 voters who made changes to their party affiliation or residential addresses since April of 2017. The announcement was made by the state late on the evening before Tuesday's elections, in which those voters were forced to vote on provisional ballots at the polls. Those ballots will be included in the results, but won't be tallied until next week.

Then, we're joined again today by Slate's great legal reporter MARK JOSEPH STERN to discuss both of the U.S. Supreme Court's grim rulings today on Trump's Muslim travel ban and on so-called "crisis pregnancy centers", as well as several decisions from Monday --- all of which, Stern correctly points out, would almost certainly have seen the opposite outcome under Garland instead of Justice Neil Gorsuch who has been the "decisive 5th vote" in each of the cases. "Every single one of the decision that we're talking about right now would have come out differently if Justice Merrick Garland were sitting on the Supreme Court right now instead of Justice Neil Gorsuch. We would have an end to partisan gerrymandering, an end to racial gerrymandering, an end to voter suppression, an end to crisis pregnancy centers' efforts to be lawless and not have to comply with basic medical licensing. The travel ban would be struck down. It's almost brutal to think about how all of these cases would turn out if the man who should be on the Court were on the Court."

Stern details Chief Justice John Roberts' 5 to 4 majority opinion in the travel ban case, in which the Court overturned multiple lower courts to uphold Trump's third attempt at banning immigrants and travelers from several majority Muslim countries. As dissenter Justice Sonia Sotomayor also does, Stern compares the ruling to the notoriously shameful 1944 Supreme Court decision in Korematsu v. U.S., which allowed Japanese-Americans to be forced into internment camps during WWII. Today's ruling is being described as "shameful", “hateful" and "racist" by immigration advocates and religious groups alike. Stern calls the decision --- in which Roberts largely dismisses Trump's oft-repeated statements revealing his personal animus towards Muslims --- as "Korematsu 2.0"

"This Court is not as disturbed and disgusted by Trump's approach to immigration as I think a majority of Americans are," he tells me. "This is a Court that's eager to bless the President's moves in the realm of national security, and to basically believe his pretext, even when it's flagrantly B.S"

Sotomayor argues in her dissent: "By blindly accepting the Government's misguided invitation to sanction a discriminatory policy motivated by animosity toward a disfavored group, all in the name of a superficial claim of national security, the Court redeploys the same dangerous logic underlying Korematsu and merely replaces one gravely wrong decision with another."

Stern also details Justice Clarence Thomas' 5 to 4 majority opinion which, under a pretext of First Amendment free speech rights, strikes down California's restrictions on anti-abortionist scam artists posing as phony medical clinics to hoax pregnant women into not receiving abortions. Thomas, charges Stern, "wrote an astonishingly broad decision that effectively says the government has no power to regulate professional speech, no power to regulate medical speech, or doctors' speech, except when they are telling abortion patients not to get abortions." In all, he says, describing how the Court is also targeting voting rights by reversing multiple lower courts in recent rulings, they are "on a kind of tear right now, overturning court after court" and/or using any "flimsy reason to send a case back down" for rehearing.

Yes, elections matter, if you haven't noticed. In the case of the 2016 election, the result will now haunt the U.S. for generations.

Finally today, we're joined by Desi Doyen with the latest Green News Report on the climate changed-fueled flooding in Iowa that resulted in an oil train derailment and hundreds of thousands of gallons of dirty tar sands crude spilled into the drinking water supplies, and other such cheerful news to close out today's program...

On today's BradCast, we have not one, but two important and separate warnings for Donald Trump and the Republican Party, as pulled from the deep audio archives of 1988. Both of which --- on two separate topics from two separate people --- they seem to be completely ignoring, even as one of those warnings comes from their supposed idol Ronald Reagan. [Audio link to show posted below.]

First up today, the Trump-caused child immigration crisis continues to unfold with several disturbing new reports of unspeakable abuse at two separate federally-contracted facilities, based on filings in new federal court cases. One from Associated Press on beatings and more at a youth facility in Virginia and the other from the Center for Investigative Reporting on the forced injection of psychotropic drugs at a facility near Houston. That, as an Executive Order signed by the President on Wednesday, reversing part of his Administration's policy, fails to speak to family reunification for more than 2,300 children separated from their parents in recent weeks under Trump's "zero tolerance" border policy, and an Administration request to the Pentagon for space to house some 20,000 migrant children.

While all of those American nightmares have been unfolding over the past week, the effects of Trump's growing trade war have been quietly playing out in the background, as the Dow has dropped some 600 points over the past four days, with China and friendly allies like Canada, Mexico and the EU vowing massive and swift retaliation for ill-considered tariff's on foreign imports instituted by Trump. Among the hardest-hit victims of his new trade wars: farmers who were among some of biggest supporters of Trump's candidacy in 2016.

Perhaps that explains why, as share in an audio clip from 1988 today, Ronald Reagan warned: "We should beware of the demagogues who are ready to declare a trade war...all while cynically waving the American flag."

Next, we're joined by MARK JOSEPH STERN, legal reporter at Slate, and our "Supreme Correspondent" this month, as the U.S. Supreme Court slowly releases a bevy of decisions in advance of their planned Summer recess, on a number of major cases heard at the high court over the past term. Among the cases we discuss today:

• On Thursday, SCOTUS released a 5 to 4 decision allowing states to impose sales taxes on all online purchases. The ruling found some very strange bedfellows in both its majority and minority opinions, but both Stern and I agree, the decision makes sense, and will be good for local retailers, jobs, the economy and state budgets where, particularly in "red" states, tax cuts in recent years have lead to the gutting of education, infrastructure and other important social services. The 1967 SCOTUS ruling struck down today, was "a totally capricious standard that the Court created itself," Stern argues. "This was the Court fixing a problem that it made."

• Stern also details an exceedingly troubling --- if little reported --- case out of South Dakota, where a man was found guilty of murder and sentenced to death, according to jury members themselves, they feared, as a gay man, he might enjoy life in prison too much. Seriously. Perhaps the most disturbing part of this matter: the Court declined to hear the case at all. Even the liberal Justices failed to offer a written dissent to the Court's decision.

• We also discuss the SCOTUS' regrettable punts this week on two partisan gerrymandering cases in Wisconsin and Maryland. (More on those cases earlier this week, with author David Daley on Monday's BradCast.)

• And the seemingly unprecedented federal court smack down of Kris Kobach, notorious GOP "voter fraud" fraudster and Kansas Secretary of State. His "Proof of Citizenship" voter registration law was struck down by a George W. Bush-appointed federal judge, and he was slapped for his contemptible performance in the courtroom --- where he represented both himself and the state of KS --- with more humiliating sanctions that include an order to attend six hours of legal classes. Moreover, as Stern reports, Kobach appears to be in still more violation of court orders, as he has yet to remove the requirement for citizenship documentation for voter registration from the KS Sec. of State website, as the judge ordered him to do "immediately" in her ruling on Monday.

  "I think that there is a decent chance that we could see even more sanctions for Kobach after this," Stern tells me. "Kobach is such a clown that this judge is going to finally have to bring down the hammer and I think it's going to be a glorious sight." (More on that case, with Sophia Lakin, one of the ACLU trial attorneys on the case, from Tuesday's BradCast.)

• Previewing the cases still to come before the end of the month, Sterns warns: "I think the Supreme Court is going to hobble public sector unions by preventing them from collecting dues from no-union members. I worry the Supreme Court is going to uphold the [Muslim] travel ban. I do think the Court may put real limits on the government's ability to collect information about where your cell phone has been from your provider. That's going to be a bright spot, I hope. But I also think the court's going to end up striking down California's disclosure requirements for crisis pregnancy centers. So, this is s not going to be a good term for progressives. I think everyone needs to just buckle in and focus on November."

Finally, Desi Doyen joins us for the latest Green News Report on a number of important issues that the Trump Administration did quietly this week as the rest of the nation and media were consumed with the child immigration story, and the 30th anniversary of Dr. James Hansen's first dire warning to Congress --- also in 1988 --- about the then-looming menace of global warming due to the unprecedented release of greenhouse gasses, such as carbon dioxide from the manmade burning of fossil fuels, into the atmosphere...

On today's BradCast: GOPers in D.C. try to overcome Trump's wildly unpopular new border policy and Kansas' Secretary of State loses again in court and faces what may be his most humiliating moment to date. But that's very good news for voters! [Audio link to program is posted below.]

First up, the panic for Republicans on Capitol Hill continued to mount on Tuesday as GOP lawmakers scrambled to find a legislative way out of the family separation crisis created by Donald Trump at the southern border, where more than 2,300 children have now been separated from their parents since his "zero tolerance" policy was first implemented just two months ago. Also today, the Administration announced their intention to pull the U.S. out of the U.N. Human Rights Council the day after its outgoing head blasted the United State's new border policy as "unconscionable" for "inflicting such abuse on children". We discuss the latest on all of the above.

Then, after a quick recap of the 8-year ignominious history of Kansas Sec. of State Kris Kobach's inglorious tenure as the nation's top elected GOP "voter fraud" fraudster, we're joined by attorney SOPHIA LIN LAKIN of the ACLU's Voting Rights Project, to discuss Kobach's latest brutal humiliation. In a victory for the state's voters on Monday, U.S. District Judge Julie Robinson (a George W. Bush appointee), struck down Kobach's extreme "Proof of Citizenship" voter registration law, finding it in violation of the National Voter Registration Act and the Constitution.

The KS Sec. of State has repeatedly defended the law in court, and has been defeated in virtually every battle over it for years, since persuading the state legislature to adopt the measure. But Robinson's ruling on Monday permanently enjoins the law, which had kept tens of thousands of legitimate state registrants in various forms of electoral limbo as Kobach continued to insist their was a massive (if, apparently invisible) epidemic of non-citizen voters jeopardizing the integrity of KS elections.

Kobach, who originally ran for office in 2010 almost solely on the false and misleading promise to "STOP VOTER FRAUD" in Kansas, has failed to find virtually any such fraud during his eight years in office. As Lakin, a member of the ACLU's trial team explains today, during the trial earlier this year, wherein Kobach chose to represented himself and his state, he was unable to show evidence of almost any non-citizen registrations or votes cast in Kansas, despite millions of legal ballots cast during the same period.

"From 1999 to 2013," she tells me, "Kobach was able to present just 39 confirmed non-citizens who were able to successfully get on the rolls, and of those 39, only 11 voted." Most of the registrations, she explains --- as did the judge in her 118-page ruling [PDF] --- were due to administrative errors.

"The judge pretty much agreed that Kris Kobach has been peddling a xenophobic lie that non-citizens are engaging in rampant election fraud. And this was his chance. This court battle that we just had was his chance to put on the record his evidence that this is what was happening. The judge saw that evidence, and she agreed that there was very little evidence of non-citizen voting in Kansas --- certainly not enough to justify the tens of thousands of individuals that have been disenfranchised by that requirement."

"The judge very much wanted Kris Kobach to have his day in court, to put his evidence of non-citizen voting to the test, to see what he was able to actually muster," Lakin tells me. "We even re-opened discovery for the very purpose of him doing that. So, the proof is in the pudding here. He utterly failed."

Of course, Kobach has vowed to appeal the ruling, as he does. But, aside from the verdict's very good news for voters, there was another extraordinary aspect to Robinson's ruling on Monday. In what amounted to a third set of judicial sanctions against him during the long course of the 2016 case and this year's full bench trial, Judge Robinson admonished Kobach in a newly humiliating way. After previously sanctioning him to pay some $50,000 in ACLU legal bills, due to his contempt in having misled the court, Robinson ordered Kobach to attend 6 hours of law school to study up on federal and state courtroom procedures!

Lakin details how, during the trial, the judge repeatedly --- and embarrassingly --- was forced to explain basic rules of evidence and other standard courtroom procedures to Kobach.

"Judge Robinson essentially ordered Kobach to go back to school" in her ruling, she says, explaining that Kobach's performance in the courtroom and repeated reprimands from the judge were likely even worse than the clownshow that the media reported them as, at the time. When I asked how unusual these type of sanctions are against a trial lawyer, she says: "To be honest, I don't think I've ever seen so many sanction rulings against an attorney at all," much less one where they were ordered to attend legal classes.

And, as if that wasn't enough, the ACLU launched yet another lawsuit today against Kris Kobach, this time over his so-called "Crosscheck" system to help (inaccurately) purge voting rolls in some 26 states.
