On today's BradCast: Donald Trump's U.S. Supreme Court nominee faced questions all day in the U.S. Senate Judiciary Committee. But what the hell is Judge Neil Gorsuch even doing there at all? And doesn't normal coverage of the hearings do little more than normalize a decidedly abnormal situation? [Audio link to show follows below.]

Donald Trump's selection to fill the seat left vacant by the death of Justice Antonin Scalia more than a year ago, represents nothing less than a stolen seat on a stolen U.S. Supreme Court. If he is confirmed, Republicans are likely to be rewarded for their theft with a majority on the high court for another generation, following their unprecedented refusal to even hold hearings for Barack Obama's nominee for the seat, Judge Merrick Garland.

I've been wrestling with how to cover this week's hearings, which I consider to be illegitimate (and that is true even setting aside the disturbing matter of Trump as President!) Professor Peter M. Shane of Ohio State University's Moritz College of Law joins me to try and help make sense of the situation. His recent piece at the American Constitutional Society, cited by the New York Times today, details how neither Democrats nor corporate media, to date, seem to have figured out how to issue any kind of institutional penalty for the GOP's blatant, brazen and unheard of theft.

Shane explains that, historically, despite Republican assertions to the contrary, "there is no close precedent" in history for what the GOP has done here. "The reason that they didn't want Judge Garland to become Justice Garland was, of course, the fear that they would be losing what had been a secure 5-4 conservative majority on the court. But they also didn't want to give him a hearing because they knew, if they gave him a hearing, that Judge Garland would appear to be so thoughtful, so reasonable, so accomplished and balanced a person, that it would be politically much more difficult to vote 'no'. Nobody in the Senate is constitutionally obligated to vote in favor of Judge Garland, it would just be hard to explain why [they didn't.]"

So they stole the seat instead, by refusing to even hold a hearing, much less a vote. As to the Democrats' lack of an organized response, such as a promise to filibuster Judge Gorsuch (or any other Trump nominee other than Garland), despite the threat of the GOP doing away with the filibuster for SCOTUS nominees, Shane observes: "It seems to me that the Democrats very frequently anticipate the political defeat that lies ahead, and just keep their powder dry for a fight that never happens." He argues Dems are likely "worried about political blowback for being a fierce party of resistance," adding: "That's what the Republicans have been, increasingly, since 1980. If they've paid a penalty for it, I haven't noticed."

Also on today's program: While Congressional hearings have taken over the beginning of the week, House Republicans are making last minute changes to their scheme to replace the Affordable Care Act, by making it still crueler for millions of Americans (but with even more kickbacks for wealthy ones!) in hopes of wheeling and dealing for enough votes to squeek by with passage in the U.S. House, where they plan to ram the bill through for a full floor vote this week before tossing it to the Senate.

Finally: A majority of Americans are unable to name even a single SCOTUS Justice, and the tax-payer cost for Trump's constant weekend vacations could cover four federal programs for the arts, the elderly, the jobless and the homeless that his budget proposal hopes to slash entirely...

On today's BradCast, it was another bad day in court for Donald Trump, a disturbing day in the nation (and around the world) for those who care about science, the arts, the war ravaged and the poor, and a pretty encouraging week for those voters who actually give a damn about racial discrimination at the polling place. Donald Trump's second attempt at a travel ban is, so far, not faring much better than his first one. Two federal courts have now blocked his newer Executive Order attempting to block Muslims and refugees from entering the country.

In the meantime, Trump finally released his alarming budget proposal, detailing draconian cuts to science, the arts, and policies that assist and aid the poor, in order to pay for a massive $54 billion increase in military spending and the border wall between the U.S. and Mexico. The cuts, if they were to be enacted, are far worse than you might have imagined, and even more drastic than many Congressional Republicans --- and even some in Trump's own Administration --- had been calling for. We detail the cruel mess and some of the responses, including one from the Corporation for Public Broadcast (for which each American pays just $1.35 per year), and who, along with the National Endowment for the Arts and organizations which help the poor and hungry across the globe, would be wiped out by Trump's "American First: Budget Blueprint to Make American Great Again".

Then, on the 52nd anniversary of President Lyndon B. Johnson's historic 1965 introduction of the Voting Rights Act in Congress following the Bloody Sunday march in Selma, Alabama --- and four years since the U.S. Supreme Court gutted that landmark voting law in 2013 --- several court cases over the past week have, once again, found racial discrimination at the polling place by elected officials. We cover two such cases today, one that unlawfully purged African-American voters in a rural Georgia county before a white man unseated a black incumbent mayor in 2015, and the other, with far-reaching implications, in Texas, where a 2 to 1 appellate court ruling finds the state intentionally discriminated against Hispanic voters when drawing up its 2011 Congressional redistricting maps. That ruling (with a remarkable dissent) could result in the state being required to once again obtain federal pre-clearance under the VRA before enacting any new voting laws in the future.

Finally, we close with an amusing --- and telling --- look at what Fox "News" considers to be "anti-Trump media bias"...

Today on The BradCast, the record-breaking March Blizzard of 2017 (sorry, Weather Channel, we won't call it "Stella"!), may be mostly gone from the Northeast, but a blizzard of disinformation remains in its wake. We do our best to shovel out a bit today with our favorite Republican meteorologist. [Audio link to show is posted below.]

I'm happy to be joined today by Paul Douglas, longtime Minnesota broadcast meteorologist, StarTribune columnist and co-author of Caring for Creation: The Evangelicals Guide to Climate Change and a Healthy Environment to respond to, among many other things, those on the right (led by Matt Drudge), charging that the blockbuster late-season winter storm that swept through the Midwest and Northeast, leaving record snowfall in its wake, was actually evidence that Donald Trump should "clear out [the] climate hysterics" from the National Weather Service.

While he's here, Douglas also explains the dangers of Donald Trump's proposed massive cuts to the Environmental Protection Agency (EPA) and the National Oceanic and Atmospheric Administration (NOAA) and other science, weather and climate-related federal agencies. NOAA, he says, whose satellites are relied upon as the "eyes" of the National Weather Service, is also "essential for the private sector, and for the military". Without those eyes, many of which are already beyond their expected lifespan, Douglas argues that the nation will be "more vulnerable" to all matter of threats.

Douglas also offers his thoughts on last week's comments by Trump's EPA Chief Scott Pruitt, claiming, in contradiction of well-established science, that the scientific evidence is lacking to prove that CO2 is the primary driver of man-made climate change. Douglas gives us a non-denier Republican perspective on the entire matter, noting that we "can't pollute our way to prosperity" and argues that "the final chapter is not written yet" when it comes to the GOP response to climate change. Somehow or another he remains "optimistic" that his party will come around to reality on that score...eventually. (I remain dubious.)

On today's BradCast: It's no longer about facts. For Republicans and Team Trump, it's now about undermining virtually every authority on which American democracy has, for so long, relied. [Audio link to show is posted below.]

As an unusual late season blizzard slams the Northeast, the White House continues to deploy a blizzard of disinformation in hopes of disparaging the Congressional Budget Office (CBO) in the wake of its estimate [PDF] released yesterday, finding that some 24 million Americans will go without health care coverage by 2026 under the Republican's proposed bill to replace the Affordable Care Act ("ObamaCare"). That, even as the White House had reportedly made similarly dire estimates on their own concerning the disastrous affect of the imperiled GOP legislation.

The attack against the non-partisan CBO is just one example of many key, American institutions now under fire by Republicans. David Roberts, climate and politics journalist from Vox.com, joins us to today to discuss the recent comments made with CNBC's Joe Kernan by Donald Trump's EPA Administrator Scott Pruitt, pretending that he doesn't know that scientists determined long ago that carbon dioxide is the primary driver for man-made climate change.

But outrage over those falacious remarks and Pruitt's dismissal of basic scientific facts misses the bigger point, Roberts explains. "If the science was going to settle anything, it would have settled it by now," he says. The issue is not about facts or science, but about the Republican Party itself and their on-going assaults on our nation's institutions --- from science to government to academia to journalism to, yes, the CBO.

"If it wasn't Scott Pruitt, it would be someone else who denies climate change," as head of Trump's EPA, Roberts argues. "That's what the party is. It's one major party, in the U.S. --- alone among major parties in the developed democratic world, alone, completely idiosyncratic and unique in this --- den[ying] that climate change is happening and that humans are causing it. So if Pruitt outrages you, the proper target of your outrage is the party. He's just a party functionary. If it wasn't him, it'd be someone else."

Roberts discusses why that denial is so important to the party, and whether or not even they believe their own nonsense anymore.

Finally today, speaking of climate change denial: Some very encouraging news when it comes to renewable energy in the U.S. (don't tell Donald Trump or the Republicans) and some bad news in court for Sec. of State and former ExxonMobil CEO Rex Tillerson...

The never before utilized Section 4 of the 25th Amendment to the U.S. Constitution (full text posted below) may provide the most efficient lawful means to facilitate a swift end to the madness brought on by the Presidency of Donald J. Trump.

The real issue is not whether Donald Trump --- an utterly dishonest raging authoritarian narcissist and "pathological liar" --- should be removed from office. Instead, the focus should be on which of two alternative constitutional means for removing this miscreant from office has the best chance of ultimately succeeding.

Impeachment is a cumbersome process that, assuming the GOP-controlled Congress would permit it, entails lengthy investigative hearings, and the introduction of Articles of Impeachment alleging High Crimes and Misdemeanors --- Articles that must be approved by a majority of the House. This would be followed by a trial in the Senate. Trump would then be removed from office only if two-thirds of the Senate votes to convict. Tall orders for both Republican-majority chambers, to say the least.

Throughout the length of those protracted proceedings, Trump would remain in office with access to the nuclear codes.

In his recent New York Times op-ed, Nicholas Kristof, quoting Harvard's renowned Constitutional Law Professor Laurence Tribe, opined that the 25th Amendment offered a viable means for removing Trump from office. Per the language of Section 4 of the 25th Amendment, if Vice President Mike Pence and a majority of Trump's own cabinet transmitted to the leaders of the House and Senate "their written declaration that [Trump] is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President." The burden would then shift to Trump to submit "his written declaration that no inability exists." If he submits a declaration contending that he is able to carry out the duties of his office, Trump would not be permanently removed unless two-thirds of both Houses of Congress upheld the Vice President's declaration.

Irrespective of the legal bases for impeachment --- such as Trump's corrupt and remarkably overt violations of the Constitution's Emoluments Clauses --- it is unlikely that a GOP-controlled Congress would be willing to entertain, let alone vote to impeach a Republican President. This would especially be true if, as is likely, the Articles of Impeachment were introduced by Democratic members of the House.

By contrast, as observed by Lawrence O'Donnell during a Feb. 20 airing of The Last Word (see video below) --- if successfully invoked, the 25th Amendment would pit Republicans against Republicans: to wit, Vice President Mike Pence and a majority of the cabinet against Trump and a minority of the cabinet. If the chaos that is the Trump administration continues and potentially threatens GOP majority rule in either or both houses of Congress in 2018, there's a distinct possibility that, as predicted by Sen. Charles Schumer (D-NY), the dynamics within the GOP could undergo a significant change. If he could overcome loyalty to the man who named him as his running mate, Pence and a majority of the cabinet could legally initiate a swift end to the Trump presidency.

That's a lot of "ifs"...and even if they all came to pass, there is more to think about regarding this path...

While the corporate media have been somewhat beside themselves with effusive praise of Donald Trump's success at reading a speech from a teleprompter at his address to a joint session of Congress on Tuesday night, our guests on today's BradCast see it somewhat differently.

Suffice to say journalists Jacki Schechner and Gaius Publius were far less impressed. They both join us today to un-spin Trump's speech and some of the alternative facts he presented --- on healthcare, energy, the hate-crime epidemic, his exploitation of the widow of a Navy SEAL killed recently in Yemen and more --- as well as both the media's and Democrats', at times, beguiling response to it all.

Both also offer thoughts on the very happy "merger" of the Trump and Republican Party brands, as well as the DNC's election of a new party chair over the weekend --- and what all of it means going forward.

On today's BradCast, resignation and evidence of corruption continue to dog the wildly unpopular incoming Trump Administration just days before his Inauguration; And is Comcast/NBCUniversal doing the bidding of the Mormon Church in Utah? [Audio link to show follows below.]

As we barrel towards what is certain to be an incredibly bizarre (to say the least) Inauguration Day for the historically unpopular Donald Trump, the Obama Administration has reportedly transferred out another 10 Gitmo detainees to Oman. In the meantime, a senior Trump White House appointee (and former Fox "News" contributor) has already resigned after revelations of massive plagiarism, as new questions about financial improprieties continue to mount for a number of Trump cabinet nominees and for the Trump Campaign itself.

Then, we are joined by former GOP Presidential candidate and gay rights activist Fred Karger, to discuss his latest campaign against the Mormon Church, which he believes should lose their tax exempt status revoked by the IRS due to participation in a number of anti-gay political campaigns and other corruption. Karger is charging that Comcast/NBCUniversal has blocked the airing of his new TV ad for MormonTips.com, after the media behemoth had previously agreed to run the 30 second spots in the state of Utah.

"I know how the Mormon Church operates," Karger explains, describing his claim that the Church is behind Comcast nixing the spots. "They are all powerful, particularly in the state of Utah. It's a virtual theocracy. They exercise a tremendous amount of power."

"They don't like me," he notes. "I'm the guy that discovered their vast involvement in California's Prop 8 in 2008 to take away gay marriage. I got them investigated and prosecuted by [California's] ethics office because they only admitted to spending $2,078 on the campaign. Turns out it was hundreds of thousands of dollars they ended up reporting. Much more likely millions. So I've learned they are very dishonest, and they've have done things very secretively." He argues that they've used their muscle to convince Comcast (which, he says, "controls something like 90% of the [cable television] market in Utah") to kill the ads. "So they're using censorship to quash our free speech and I'm going to be fighting back against them."

Finally today: Is the Trump Administration planning to shut down the White House Press Room after taking office? Esquire reported over the weekend that the matter is under serious consideration and, in response, Trump's top officials are not denying it...though they do appear to be lying about their reasons for it...

On today's BradCast, U.S. media failed to report on the rise and dangers of Mussolini and Hitler with the gravity that was warranted in the 20s and 30s. Are they making similar mistakes today with the rise and elevation of Donald Trump to President of the United States? [Audio link to show is posted below.]

Media Matters' Matt Gertz joins me to today to argue Trump's bizarre press conference on Wednesday, his first since the November election (first since last July, actually), revealed more than a dozen "signs of how bad press treatment will be under Trump". At the presser, the day after the release of an unsubstantiated dossier charging personal and financial compromise with Russia, Trump refused questions from either CNN or BuzzFeed News, declaring them both to be "fake news" for breaking various elements of the story. Gertz suggests the way it played out illustrates that the media are both failing to push back against Trump, and are likely underestimating how bad things are likely to get for them (and all of us) once he becomes President.

"This was not something that came out of nowhere," Gertz tells me. "This was clearly the strategy going into the press conference: to attack Buzzfeed, to attack CNN, to tie the two of them together, and to suggest that all of their reporting was illegitimate."

"They're going to go on trying to de-legitimize the media, one by one, piece by piece, to make it impossible for anyone to try to get out critical news analysis about what his administration is doing. This was the first step, and it's going to keep getting worse," he warns. "Trump bragged on the campaign trail that he could stand in the middle of 5th Avenue and could shoot somebody and he wouldn't lose voters. Rhetorically speaking, that's what he basically did to [CNN's] Jim Acosta. He basically took him out in front of the entire press corps, humiliated him, pretty brutality, and other reporters just sort of moved along. They went on and they asked their questions, and they just kept going."

But were CNN and BuzzFeed wrong to report as they did in the first place? And do the media, in general, have only themselves to blame for the spot they're in at this point? Have they learned anything from last Wednesday, much last the past year? And is that Breitbart clown "reporter" Matt Boyle the new "Jeff Gannon"? We discuss all of that and much more during today's conversation.

First today, the DoJ Inspector General announces he will investigate the FBI and its Director James Comey concerning their controversial actions regarding Hillary Clinton's private email server in the run-up to last year's election and whether they ran afoul of long-established Justice Department guidelines.

Then, the head of the Office of Government Ethics blasts Donald Trump for failing to divest his business holdings. And, in the U.S. Senate, Trump's unprecedented conflicts of interest came into play during Sen. Elizabeth Warren (D-MA)'s questioning of super-genius Dr. Ben Carson, Trump's nominee (for some reason) to be Secretary of Housing and Urban Development.

Meanwhile, Trump's Secretary of Defense nominee, Gen. James Mattis, began his confirmation hearings today in the Senate, where he said he intends to honor the anti-nuclear agreement with Iran that the GOP pretends to hate. At the same time, Republicans in both the House and Senate are finally beginning to face reality on that and on the fact that their years of pretending the Affordable Care Act ("ObamaCare") was a disaster may now be a huge problem for them, as they have no actual plan to "repeal and replace" the program.

Finally, we're joined by Larry Flynt, longtime First Amendment champion and publisher of Hustler Magazine, to discuss his recent ad [PDF] in Variety which slammed the U.S. media, blamed them for the rise and Presidency of Trump, and called on them to "wake up!"

He tells me that while he's seen a lot during his decades of battles with Republicans like Ronald Reagan and George W. Bush, but "it's never been as bad as with Trump. Every time this guy opens his mouth, he tells a lie. I mean, that should not be tolerated by any member of the press."

Flynt also discusses what his $1 million bounty for incriminating video tape on Trump has uncovered so far, and why it's so difficult to actually damage him at this point. We also discuss, among other things, Hustler's consistent years of covering news in the magazine, in addition to porn, even when other media outlets have pulled their punches at various times when Republicans were in power. I've seen a lot in my life, but today may be the most insane news day I've ever seen, or certainly attempted to cover in a single episode of The BradCast. Among the stories we cover today, all from with the past 18 hours or so [audio link to show follows below.]...

On today's BradCast, Donald Trump's nominee for Secretary of State, ExxonMobil CEO Rex Tillerson, has filed papers to "divest" from the oil giant. But a closer look at his filings suggests he may not actually have cut all ties and interests in the profits of the only company he has ever worked for until now. [Audio link to show is posted below.]

First today, apparently it's still not "terrorism" when a non-ISIS American carries out a mass shooting, as was the case last Friday at the Fort Lauderdale International Airport. The alleged shooter, a veteran of the Iraq War and former National Guardsman, killed five and wounded six others, even as Republican Florida lawmakers press for more guns in airports and elsewhere.

Then, as many as eight of Trump nominee's are all set to come before U.S. Senate committees this week for confirmation hearings, pretty much all at the same time, and even before the U.S. Office of Government Ethics has even completed the background checks for many of them for the first time since the OGE was created. That, despite unprecedented corporate conflicts of interests for virtually all of the cabinet-level and top advisory positions being filled --- not to mention the first press conference in six months scheduled by Trump at the same time, along with the Majority Leader Mitch McConnell's plan plan to hold a budget "vote-a-rama" concurrently with all of the above.

One of the nominees set for truncated confirmation hearings this week is Exxon's Tillerson, who last week filed papers with the U.S. Security and Exchange Commission (SEC) explaining how he plans to divest from some $180 million in Exxon stock. While Tillerson's attorneys describe the scheme as a way to sever ties with the oil giant, Public Citizen's David Arkush finds a discrepancy in the legal filings that suggest Tillerson may still have reason for allegiance to Exxon, rather than the well-being of U.S foreign policy.

"In the agreement between Exxon and the trustee [set to keep Tillerson's holdings while he serves as Sec. of State]," Arkush finds wording "that would leave him with a clear incentive to still favor Exxon as Secretary of State."

"He has viewed the entire world through the lens of what's good for Exxon," Arkush explains after detailing the concerns with the SEC declarations. "A lot of people look at that record and are critical of the fact that he has no government experience and, technically, I guess, in a certain sense, no foreign policy experience. I don't think that's the issue. I think the issue is he does have experience...He has spent 41 years working at a single company that has a single motive, which is to make money by finding oil around the world, digging it up, and burning it." He goes on to optimistically warn: "We are headed toward utter disaster."

On today's BradCast, it's another busy day of warmongering on Capitol Hill, attempts to gut American's health care systems, and one last-ditch effort to keep Trump from becoming the President-Elect. [Audio link to the show follows below.]

The cyberwar-mongering against Russia continued today in both the U.S. media and U.S. Congress, despite wildly erroneous reporting by mainstream media outlets and the disturbing lack of public evidence to support both the claims and calls from Democrats and some Republicans alike, to go on the offensive against the former Soviet nation. Those calls increased today during a U.S. Senate hearing with outgoing Dir. of National Intelligence James Clapper (who previously lied to Congress about the NSA's bulk collection on American email and phone call information), and despite new revelations that the FBI never examined the computer servers of the DNC, which they allege to have been hacked by Russia in hopes of supporting Donald Trump over Hillary Clinton.

Then, a new report documents an attempt from a bi-partisan legal team hoping to block the ratification of Trump's Electoral College victory in Congress on Friday. The effort is based on the group's 1,000-page documented legal finding that more than 50 of Trump's electors were unlawfully and/or unconstitutionally seated.

Alternet journalist Steve Rosenfeld, who broke the story late last night, joins us to explain the basis for the last-ditch effort to stop Trump, its chances for success, and some Congressional Democrats' surprising response to it.

"Everywhere you look under the rug, there's something else that is either broken or not followed when it comes to the partisan tinkering of elections," Rosenfeld tells me, arguing that Dems should use the information from the legal experts to both challenge Trump's (lack of) mandate and, at the very least, "as a moment to lecture the Republicans on voter suppression." He adds that despite the seeming Hail Mary nature of the effort, "today people are frantically searching for a Senator" to support a challenge to the Electoral College results during the Joint Session of Congress scheduled for Friday. Good luck with that.

Also today: U.S. House Speaker Paul Ryan announces that the GOP plans to end federal funding for Planned Parenthood, despite the organization's popularity and Desi Doyen joins us for the first Green News Report of the new year, with a whole bunch of environmental-related news that you may have missed over our holiday break, including the blatantly false story late last week by the Washington Post charging that "Russian hackers penetrated [the] U.S. electricity grid"...

The U.S. House watchdog office was formed by Democrats in 2008 after the massive Jack Abramoff influence-peddling and bribery scandals of the George W. Bush era. After voting last night --- with no advance notice or public debate --- to hobble the OCE, Republicans were forced to reverse their plans thanks to public outrage expressed through phone calls to Congress. Nonetheless, Donald Trump is being inappropriately credited by the corporate media for the reversal, despite the lack of evidence that he actually opposed the move or that his tweets were responsible for the GOP changing course.

The episode suggests that public opinion, outrage and shaming may still matter in these United States, even in the Age of Trump, and even if the corporate media fail to notice. But we'll see.

At the same time, as NBC News guts their own news reporting outlets, they've announced today they are hiring Fox "News" star Megyn Kelly for untold millions. And, in Wisconsin, the agency responsible for environmental protection has solved Climate Change...by simply changing their website to pretend it no longer exists.
