On today's BradCast, oil prices crash, Sanders surges in both Iowa and New Hampshire, the GOP tries to find an alternative to Trump, we're joined by the mathematician who says that the George W. Bush "Presidency" was his fault...sort of --- and we discuss why it all still matters today.

First up, Desi Doyen joins us to discuss the importance of and reasons for the plunging price of oil, which fell below $30/barrel today for the first time since 2003.

Next, new polling out of both Iowa and New Hampshire suggest the potential for very closes races, on both the D and R side of the aisle, this year. Bernie Sanders, who had been trailing Hillary Clinton in IA for months, has now overtaken her there, according to new numbers, and has increased his lead in NH over the woman still described by corporate media as "the Democratic front-runner". On the GOP side of the aisle, Trump retains his lead in NH, while IA tightens and the search for an "establishment" alternative takes a few surprising turns.

Then, speaking of close elections, we're joined by Dr. John Allen Paulos, professor of mathematics at Temple University to discuss the mother of all close elections, and why he believes his November 22, 2000 NYTimes op-ed helped lead directly to the U.S. Supreme Court stopping the ballot count in the Sunshine State, resulting in their (s)election of George W. Bush.

After I recount (pardon the pun), just some of the chicanery and still-unexplained anomalies that resulted in the exceedingly close tallies reported by Florida in 2000, Paulos, author of the New York Times best-seller, Innumeracy: Mathematical Illiteracy and Its Consequences and, his latest, A Numerate Life: A Mathematician Explores the Vagaries of Life, His Own and Probably Yours, explains how he still "regrets" his mathematical analysis of the race at the time, which ended up being cited by the courts during the legal battle that eventually stopped the tally of paper ballots in Florida.

(For the record, yes, had Florida counted all of the ballots in the state at the time, as the Times reported on November 12, 2001 --- so you are forgiven, if you didn't notice --- Gore would likely have won the state, "no matter what standard was chosen to judge voter intent.")

"People talk about the 'Butterfly Effect' in dynamical systems [ed note: as opposed to the Butterflly Ballots in Palm Beach County, FL!], where tiny little initial differences lead to huge disparities down the road. This was, in a sense, a case where I was the little butterfly flapping its wings in South America leading, after many intermediate events, to a hurricane in New Orleans."

"In retrospect, obviously, I wish I hadn't done that," Paulos tells me about his op-ed, published 15 years ago last month, adding: "As a moral tiebreaker, Gore won almost half a million more votes nationwide. At the very least, they should have flipped a coin" and "Oh, yeah, they should have counted the ballots. That's what should have happened."

Finally, speaking of the consequences of elections and actually counting votes to determine the intent of voters, we conclude today's show by discussing how the George W. Bush administration allowed North Korea to obtain the atomic bombs that the rogue nation is once again using to threaten the world. Yes, more fallout from the disastrous Bush Administration, still affecting us today because we failed to count the voters' ballots.

Last year ended with a number of voter database breaches --- from the Sanders/Clinton/DNC database kerfuffle to the discovery of the still-mysterious posting of some 191 million voter records online shortly thereafter.

But those concerns may pale in comparison to the fact that the nation is about to begin voting in Presidential primaries and caucuses using electronic voting systems and tabulators that have failed time and again, that remain vulnerable to both malfunction and malfeasance, and that are often impossible for the public to oversee in any meaningful way.

On today's BradCast: Welcome to Presidential Election 2016! Good luck! (We're gonna need it.)

Joining us to discuss the voter database breaches as well as concerns about election integrity and oversight in early caucus and primary states such as Iowa, New Hampshire, South Carolina, Nevada and beyond is Bev Harris of BlackBoxVoting.org.

Harris, the election integrity watchdog featured in HBO's Emmy-nominated 2006 documentary Hacking Democracy, has been investigating and writing about those voter database breaches lately, including a new one that has just been discovered concerning tens of millions of additional voter records.

While voter registration databases actually contain public information, she explains, there are restrictions on their use, and they are not supposed to simply be posted publicly for download. "This stuff is not secure. It'll probably never be secure," she warns. "One of the things I did was really research how many of the breaches have occurred over time, and it's a shocking number. You can't secure this stuff." As we discuss on today's program, that point is something to keep in mind when you hear advocates of Internet Voting systems (the next nightmare that some hope to force upon American democracy) claim otherwise.

We then step through the differing voting processes used in each of the early voting states, with Harris explaining that completely unverified and/or unverifiable e-voting and tabulation systems --- most of them hacked many times in the past --- will once again be in use in every state in the union. Yes, even where hand-marked paper ballots are used, almost all of those ballots are tabulated by unverified computer systems.

"I'm not at war with a machine," she explains. "I'm at war with no transparency. We have to be able to have some way to see and authenticate that count, before the ballots travel anywhere."

Harris tells me: "The key here is not that there will never be a mistake, or never be fraud. The key is that the public has a right to accountability. If you can catch it, and do something about it --- if you're vigilant enough and doing a patriotic duty of vigilance --- then that's the whole point. When you start saying, 'No, you can never see, you can never account for it,' then you have a problem."

We discuss how it was, in fact, public oversight of hand-counted paper ballots at GOP caucus sites in Iowa in 2012 which resulted in the correct results actually becoming known weeks later, long after the Republican Party misreported them on the night of the caucuses.

Transparency, however, is not quite as easy in other early voting states like New Hampshire (remember the unbelievably unverified mess there in 2008, when Hillary Clinton's victory defied even Exit Polls taken on the day of the Primary?) and, especially, South Carolina (remember the unknown Alvin Greene's 100% unverifiable and inexplicable victory in their 2010 Democratic U.S. Senate primary?)

"There's not just one magic wand you can wave, but there are things to at least force some accountability into it," Harris tells me, describing some of the ways election integrity advocates can try to force the issue a bit. Among her suggestions: "You can go [to the polling place at closing time] and snap a picture of what those [computer tabulated] results are with your cell phone and compare it with, at least, what they report" later on.

We cover a lot of ground in the conversation and I suspect we'll be discussing this issue with her, and others, a lot more as the election year moves forward. But today's show is a good place to begin.

Once again, it's the smartest post-debate analysis you'll find anywhere on today's BradCast, following last night's fear- and war-mongering "national security" GOP debate in Las Vegas (in which neither climate change, nor guns, two of the actual greatest threats to national security, were even discussed.)

Yes, it's now Trump and Cruz' GOP world. All of the other candidates --- and the entire Republican Party (and maybe even you and me) --- just live in it.

I'm joined for today's coverage by our returning champion, the great Heather Digby Parton of Salon and Digby's Hullabaloo blog. And, for the first time, I'm also joined by actor, comedian and radio broadcaster Hal Sparks, formerly of E's Talk Soup, Showtime's Queer as Folk and currently of Disney XD's Lab Rats and the Hal Sparks Radio Program Mega-Worldwide on WCPT in Chicago!

As our theme song says, we're "tryin' to make some sense of it all," once again on today's program. No easy feat. But we go well beyond the "horse race" in our analysis, as usual, and as the 2016 Republican Presidential candidates (that's the year they're hoping to win the nomination, not the number running...it just seems that way) worked hard on the stage last night at Sheldon Adelson's Venetian Hotel and Casino to be the manliest-man and bombiest-bomber of them all!

Parton and Sparks offer incisive and lively commentary and fact-checking on what has seemingly now become a two-man race for the nomination. And I try to explain why Democrats ought to be very very careful what they wish for. Enjoy!

And how Dems should have been careful what they wished for...

Today on The BradCast we catch up with a lot of incoming from over the past week (or two) as Republicans officially begin to freak out about the likelihood of Donald Trump becoming their nominee and the possibility (perhaps, their hope) for a contested nominating convention, and as the U.N. climate conference heads into its final hours towards an agreement that might save the planet.

We cover quite a bit of ground on today's show, as you'll hear, so I'll just let you listen and make of it what you will, rather than go into great detail here.

Suffice to say, we call out not just Republicans for the mess we're all now in --- from the rise of money in politics to to the rise of Trump to the rise of fear and fascism to the rise of global temperatures --- but also the mainstream corporate media. Had they not consistently failed to do their job over the past decade (or two), they might have kept this entire fine mess from happening in the first place.

But why would want to? They are now the biggest winners of all. And the Democrats don't seem to be laughing about it any of it anymore. Enjoy the show.

GUEST: Author and Constitutional law expert Ian Millhiser...

What a week. On today's BradCast (audio link below), Republican legislators and Presidential candidates continue their demonization of Muslims and refugees from war-torn Syria and we pause from their madness to shed some light on a disturbing new scheme to block Democratic policymaking altogether.

First, with an unabashed rejection of facts (and reality and history), Republicans from the state level to the Presidential candidate level put forward stunning new rejections of the nation's values. From the high-ranking GOP lawmaker in Tennessee who wants to use the National Guard to round-up and deport Syrian refugees in his state, to Donald Trump's disturbingly Nazi-like call to force all Muslims to register as such with the federal government, we reach new, shameful lows following the Paris attacks one week ago today.

Also of note: CNN's remarkable double standard in suspending a reporter for expressing sympathy for refugees. (Here's that Don Lemon/CC item I mentioned from The BRAD BLOG in 2010.); And a precious few rays of light from one GOP Congressman (at least for one courageous moment) and then from Stephen Colbert.

Finally, even as that shameful "debate" bottoms out, rightwing schemes to further cripple the ability for Democrats to govern at all on the federal level continue. Ian Millhiser, journalist, Constitutional law expert and author of the new book, Injustices: The Supreme Court's History of Comforting the Comfortable and Afflicting the Afflicted, joins us to discuss his disturbing observations from this year's annual gathering of the Federalist Society.

As reported in his recent article, "The Little-Noticed Conservative Plan To Permanently Lock Democrats Out Of Policymaking", Millhiser explains the rightwing group's broad new efforts to attack rule-making by federal agencies. He tells me how the group is now trying to "permanently hobble not just the federal rule-making process but the federal law-making process" itself.

"What groups like the Federalist Society are pushing," he charges, "is ways to change the fact that elections matter. To make it so that they can permanently put into place structures --- whether it's declaring something unconstitutional, whether it's changing the balance of power between the various branches of government --- they're looking to permanently put in place structures to make sure that only conservative policies can go into effect."

"The basic idea is to shut down the agency's power to regulate," Millhiser tells me. "Between gerrymandering and so many other factors, it's so difficult for Democrats to take the House [even when they win a majority of votes]. If they [the Federalist Society] can prevent [federal] agencies from regulating, then that means that, well, Democrats might be able to take the Presidency but they won't be able to do anything with it when they have it. It effectively shuts the Democrats out of the policy-making process even when they win the Presidential election."

That idea, he explains, absolutely dominated the group's recent gathering and it's one they hope to implement "by any means necessary", whether in Congress or, more disturbingly, through judicial activism on the federal bench.

While four Supreme Court Justices (Scalia, Roberts, Thomas and Alito) are already dedicated Federalist Society members, "the big scary," he reminds us, "is that there are four Supreme Court justices who are likely to retire in the next 5 or 6 years. So if the next President gets to replace four Justices, there's going to be a massive shift in the law. If that next President appoints four very conservative Justices in the vein of Justice Samuel Alito, then whatever agenda the Federalist Society wants to be able to enact in this phase, they're just going to enact it in the Court."

Following last week's horrific terror attacks in Paris, Republican Governors and Presidential candidates have turned against those fleeing terror in Syria by calling for states to keep out the huddled Syrian masses of men, women and children yearning to be free.

Despite the existing, incredibly onerous, nearly two-year process of vetting such refugees before they are allowed to come here --- and despite state Governors having no direct control over immigration/refugee policies at the federal level, more than 30 of them have now declared they will not allow refugees from the war torn nation to be relocated within their state borders.

Presidential candidates like Donald Trump, Ted Cruz and even the supposedly "reasonable" and "moderate" Jeb Bush have declared we need to consider shutting down mosques and/or institute a Christians-only policy for refugees coming to the U.S. from countries under siege by terrorists.

These GOP cowards and liars have little more evidence to back up their assertions about dangerous refugees "pouring into our country from Syria" than they did when they warned President Obama was allowing an Ebola epidemic to land on our shores and kill us all just a few short months ago.

Nonetheless, some gullible and frightened American citizens have responded to the offensive, anti-American rhetoric of GOP leaders by turning against their fellow citizens, sometimes violently, for the "crime" of being Muslim or even just appearing to be of Middle-Eastern origin.

All of the above, of course, is precisely what Osama bin Laden --- and now ISIS --- long ago announced to be exactly what they were hoping for.

PLUS: Big victory for courageous student protesters in Missouri...

On today's BradCast, the power of protest and organization.

We start at the University of Missouri after African-American players on the football team there used their power over the weekend to collectively and courageously support a student hunger strike in a protest to force university system President Tim Wolfe to resign amidst a series of racially charged incidents on the Columbia, MO campus. The leverage used by the players is another great reminder of how smart and courageous protest can succeed in making substantive change --- even against some of the world's most powerful entities. Go Tigers!

Speaking of which, my guest today is, once again, Douglas Hughes. You may recall him as the 61-year old Florida postal worker who landed his homemade gyrocopter on the West Lawn of the U.S. Capitol in a dramatic protest last spring. He was our guest back in April, just days after the incident where he had hoped to bring attention to the desperate need for campaign finance reform.

He was, at the time, arrested and charged with six felonies that might have netted him more than 9 years in jail for his attempt to deliver an important letter to all 535 members of Congress. Now, he has struck a plea deal with federal prosecutors and joins us to discuss the deal, why he took it, the latest developments in his case, and whether he feels his protest was ultimately worth the extraordinarily high cost.

Hughes tells us today that he has "no regrets" for having "stomped on the dragon's tail", despite losing his job at the Post Office, facing enormous fines, jail time, and even the loss of his ability to vote as a "felon".

"I stomped on the dragon's tail and I knew it was going to turn around and come after me," Hughes tells me. "And it has, and I have no regrets."

He credits the flight with helping to broaden the discussion about the need for reform, and says, despite the extraordinary cost, he'd do it again "in a heartbeat" as he continues his call for a "voters rebellion" to help "get the money out of politics so everybody that's in Congress knows they've got to answer to us."

Though Hughes was reluctant to mention it, he has a GoFundMe page where folks can donate to his legal defense fund and other needs as he is now struggling to survive day-to-date until his Social Security finally kicks in. Please consider helping him out if you can!

This week's CNBC GOP debate opened up a great opportunity for new attacks on a favorite old enemy: the so-called "liberal media"! (Yes, they are actually considering Wall Street's favorite wingnut cable channel for the investment class to be part of the "liberal media" now, rather than blaming themselves for the failures of their own Presidential candidates!) But they also find new enemies amongst fellow Republicans like RNC Chair Reince Preibus, who may quickly become the Rightwing's new "John Boehner".

Plus: The White House announces U.S. boots will now be on the ground in Syria --- but does Congress even care?; Is Jeb's campaign really dead? Or should the voters decide that rather than the media?; Hillary joins the growing calls for investigation of ExxonMobil; And, climate change actually finds its way into a Republican Presidential debate!...

It was a 'Rocky Mountain Mess' to many, but we try to make sense of CNBC's GOP Presidential Debate in Boulder, CO last night on today's BradCast anyway!

My guests today are Heather Digby Parton --- Salon contributor, Hillman Foundation opinion journalism award winner, and proprietor of Digby's Hullabaloo blog and the Colorado Statesman's John Tomasic.

"Digby" has joined us for all of our post-debate coverage so far this year and offers smart insight yet again today. Tomasic shares his on-the-ground perspective after covering the goings on inside and outside of the Coors Event Center before, during and after yesterday's debate(s).

Was anything learned from either the 'Kiddie Table' or 'Main' debates? Is Jeb finally done for? Did Kasich's gambit work? Did Trump accidentally make sense again? Does Jindal have a magic wand he doesn't know about? Is Social Security really a scam?

Were the CNBC moderators as awful as the GOP would like us all to believe? Why was a Republican debate held in the liberal "Mecca" of Boulder in the first place? And why were the students at CU-Boulder kept from attending it?

On today's BradCast...the Republican Party may appear to be falling apart on one level --- because it is (and we cover quite a bit of their various disasters in advance of tonight's Republican Presidential debate in Boulder, CO today) --- but on another level, the GOP still controls not just both chambers of the U.S. Congress, but also the vast majority of statehouses and Governor's mansions across the country.

So, while the Democrats' Presidential prospects may be encouraging for them, are they actually in denial about their real problems? And/or is there another way out of their current morass?

Ian Millhiser, journalist, Constitutional law expert and author of the new book, Injustices: The Supreme Court's History of Comforting the Comfortable and Afflicting the Afflicted, joins us to discuss what may be the Democrats' best way out of the mess: The U.S. Supreme Court and as many as four vacancies that may occur on the bench during the next Presidency. "The Future Of The Democratic Party," he wrote recently, "Will Be Decided By The Supreme Court."

"A big reason why Democrats are so far underwater when it comes to state legislative races, when it comes to House races, is because of the Supreme Court," Millhiser tells me on today's show. "The Supreme Court has ordered the lower federal courts not to even look at partisan gerrymandering cases. They're not allowed to even consider them under existing Supreme Court doctrine."

Millhiser goes on to explain how the Court's recent rulings on voting rights have also made things far more difficult for Democrats. SCOTUS, he argues, "isn't enforcing the Constitution and at other times its mangling the Constitution."

"The situation Democrats find themselves in is due to a number of problems layered on top of each other, many of which are at the fault of the Supreme Court. Many of these problems could be solved if we had a Supreme Court that was prepared to give us fairer elections," he notes. With as many as four --- four --- seats potentially becoming vacant on the Court during the next Presidency, the party that controls the White House as of 2017 will have an enormous opportunity to affect what happens in this country for generations.

While both major parties often use the potential for Supreme Court vacancies to underscore the importance of controlling the White House, Millhiser explains the reasons --- and there are many --- why the 2016 election really is different from recent elections where that argument has been offered. "If the Supreme Court gets even more conservative," he warns, "then you're looking at an apocalypse for the Democratic Party."

Biden out, Ryan in...Maybe...As original 'funding father' of the modern conservative movement argues 'we are heading towards a cliff'...

Joe Biden is out (of the race for the 2016 Democratic Presidential nomination) and Paul Ryan is in (sort of...for the contest to replace John Boehner as Speaker of the House).

We cover both breaking stories today on The BradCast before settling in for a related, and at times, very lively, conversation with conservative icon Richard Viguerie about what the hell Republicans and 'conservatives' in the so-called Freedom Caucus are thinking at this point, as the GOP Civil War rages over control of the U.S. House and much more.

"I consider myself a conservative, not a Republican," Viguerie clarifies right off the bat. "I do operate in the Republican Party, but do consider myself a conservative, which is the case with many of my national conservative friends. They think of themselves as conservatives, not Republicans."

The 82-year old Viguerie is a legend amongst conservatives. He is regarded by many as the 'funding father' of the movement, thanks to his roll in the creation of direct mail political fund raising. He continues to play a very influential role among Republicans via his books --- such as Takeover: The 100-Year War for the Soul of the GOP and How Conservatives Can Finally Win It and Conservatives Betrayed: How George W. Bush and Other Big Government Republicans Hijacked the Conservative Cause --- and the ConservativeHQ.com website, self-described as "the online news source for conservatives and Tea Partiers committed to bringing limited-government constitutional conservatives to power."

Right now, it seems, neither he nor the others at his Conservative HQ site are willing to agree to Ryan's newly issued demands to become the next Speaker. So, what are they and fellow Republicans thinking at this point?

Viguerie says he and those in the so-called Freedom Caucus are "looking for a fighter. The grassroots is white hot with anger at the silence and the ineptness of our supposed leaders out there. And that's what driving this problem with the House Speaker selection right now."

I did my best to press Viguerie on all matter of related issues, including whether he and his conservative compatriots support the U.S. Government defaulting on our loan payments for the first time in history, as may well be the case in the next several weeks if the "debt ceiling" is not raised and a budget is not passed to keep the government open and operating --- which, I tell him, seems very un-conservative to me!

His responses make clear that he is more than willing to take such gambles and has no intention of rolling over for those "Big Government Republicans" that he considers to have sold out the movement. He believes "we are heading towards a cliff," thanks to overspending and tells me that he is is willing to force spending cuts as "part of a deal" to raise the debt limit, even if that results in default or shutdown. "We need to have a conversation with the American people about our priorities."

On the hunt for a Presidential candidate, Viguerie insists: "Voters do not like establishment Republicans. They really do reject them across the board. When I talk to Republicans and they say 'we've got to beat Hillary', I say that's fine, I understand that, but if you nominate an establishment Republican --- a Chris Christie, a Jeb Bush type, a John Kasich --- you're going to lose. The people don't want an establishment Republican."
