'Democracy came out victorious' in Lula's defeat of Bolsonaro; U.S. democracy at stake in next week's midterms; New Senate polling; Pelosi's would-be assassin was a follower of Trump's election lies; Callers ring in...

We're just over one week from the most critical midterm elections in these United States since the Civil War. So, we've got a lot to discuss on today's BradCast. And the phones are finally fixed at KPFK, so we were actually able to hear from callers today as well! [Audio link to full show is posted below this summary.]

Among the stories covered on today's program before listeners ring...

  • Why it really matters: A few thoughts on why, exactly, these elections are so critical, in all 50 states, for the future of American democracy itself; why you need to vote in whatever state you live in by Tuesday; and why, depending on how it all goes, this could be the last democratic election in this country. An overstatement? I don't think so in the least. But tune in for much more on all of that and for listner calls from folks who may or may not agree with me.
  • If they can do it in Brazil: Great news! The far-right, Donald Trump-supported autocrat Jair Bolsonaro was deposed in a runoff election on Sunday to Brazil's former leftist President, Luiz Inácio Lula da Silva, popularly known as "Lula". The race was closer than polls had predicted, but it was the first time since the nation became democratized in the 1980s that an incumbent President went down to defeat. That is good for workers, that is good for the planet (given Bolsonaro's destruction of the Amazon rainforest), and, as Lula said up winning, good for democracy itself. "This isn’t a victory of mine or the Workers’ Party, nor the parties that supported me in the campaign," said the once and future President. "It's the victory of a democratic movement that formed above political parties, personal interests and ideologies so that democracy came out victorious."
  • After all that: New polling out today from New York Times and Siena College finds four key U.S. Senate races are still polling pretty much where they were several weeks ago, despite recent breathless corporate media reports that Dem support was tanking and a "red" wave was forming. Perhaps it is, but that's not what today's new polling suggests. The Democratic Senate candidates in Arizona, Pennsylvania and Georgia all still lead their Republican opponents, if by slim margins, and the race in Nevada is said to be a dead heat. At least, if you believe pre-election polling. (And I wouldn't, if I were you.) It's all likely to be very close. All of it. Everywhere. Please get out and vote, as they did in Brazil...for democracy.
  • Another assassination attempt on the Speaker of the House: We were off on Friday, so didn't get to ring in on it, but we've learned more over the weekend about the attacker who, echoing January 6, 2021 insurrectionists, was hunting for Nancy Pelosi as he hoped to use zip ties to restrain her 82-year old husband Paul last Friday morning at their house in San Francisco. The attacker ended up cracking Paul Pelosi's skull with a hammer before he was tackled by police. By way of contrast with the "outrage" expressed for weeks by Republicans at peaceful protests outside the homes of corrupt Supreme Court Justices several months ago, many of those same GOPers made jokes over the weekend about the attack on the Pelosis by a man who appears to have been a supporter of QAnon conspiracies and far-right commentators and who believed Trump's lie that the 2020 Presidential election was stolen from him. The 42-year old assailant has now been charged with both state and federal felonies, including attempted murder; assault with a deadly weapon; assault on the immediate family member of a federal official; and attempted kidnapping of a federal official. Paul Pelosi is said to be recovering after emergency surgery for a fractured skull.
  • Calls forward: Finally, we open up the phone lines --- for the first time in a month, now that they're fixed here at the station! --- on all of the above and more with some very lively callers (several of whom, as usual, don't agree with me on every li'l thang...)

Today on The BradCast: Elections are not only about the future, they're also about accountability for failed leadership. There is a lot of that in Florida today, even if it's difficult to notice above the death, destruction and devastation following Hurricane Ian. [Audio link to full show follows this summary.]

Current estimates for the cost of damage in Florida following Hurricane Ian range anywhere from $40 to $60 billion. And, yet, the state's two Republican U.S. Senators both voted against a bipartisan infrastructure bill last year which included some $50 billion to help states harden and upgrade infrastructure to better withstand events exactly like Ian.

Marco Rubio called the measure "wasteful". Rick Scott described it as "reckless spending". Each has received nearly a quarter of a million dollars from the oil and gas industry since 2017. Moreover, both Rubio and then Representative, now Governor, Ron DeSantis voted against disaster funding in 2013 following Hurricane Sandy, even though both are now seeking similar federal funding for Florida.

Hurricane Ian was made far worse than it otherwise might have been thanks to climate change caused by the burning of oil and gas that the state's GOP leaders have long promoted despite decades of warnings from scientists. Just weeks ago, DeSantis issued an order blocking his state's pension fund --- which invests billions held on behalf of teachers, firefighters and other state workers --- from even considering the climate risks posed to companies when investing in them. He described such considerations as "political".

Of course, the state's U.S. House contingent is also filled with GOP climate deniers who have long lied to their constituents about the dangers of our worsening climate crisis in of the state's most affected by it. Every single Florida Republican in both the House and Senate voted against the Democrats' recently adopted bill that invests $369 billion over the next ten years to wean the nation off fossil fuels and the greenhouse gas emissions that made the state's recent disaster so much worse --- and makes high-tide flooding in South Florida now a regular occurrence, even on sunny days.

Will any of Florida's corrupt GOP leaders ever be held accountable by voters for their deadly, failed leadership on these issues? That is, if voters are even able to vote this year amid the rubble left behind by Ian?

Rubio is facing a reelection challenge in November by Democratic Rep. Val Demings. The state's former Governor, Charlie Crist (then a Republican, now a Democrat) is challenging DeSantis. While the Dems trail in both contests according to pre-election polling, both are within reach --- at least if voters are informed enough to know who is on their side, and who has been playing them as suckers for years, as we discuss in detail today.

Also today...

  • The bipartisan U.S. House Select Committee investigating Donald Trump's January 6 insurrection at the U.S. Capitol and his multiple failed attempts to steal the 2020 Presidential election has now rescheduled their next (maybe last?) public hearing for Thursday, October 13, following a previous cancellation two weeks ago due to Hurricane Ian.
  • More evidence of why you should ignore the polls and predictions in these UNconventional times before this year's critical midterm elections: voter registration for women --- especially younger Democratic women --- has spiked even in the ruby "red" state of Idaho following the U.S. Supreme Court's overturning of 'Roe v. Wade', according to new data.
  • President Biden announced, on Thursday, the pardons for thousands of Americans convicted for "simple possession" of marijuana under federal law over the years. He called on Governors to do the same for those charged under state laws and has asked both his Health and Human Services Secretary and the U.S. Attorney General to finally consider rescheduling cannabis from its current Schedule I status, which classifies pot --- which is now sold legally in dozens of states --- on the same level as LSD and heroin, and even more dangerous than fentanyl and methamphetamine.
  • Finally, Desi Doyen joins us for our latest Green News Report with news on Biden's visit to Florida after Ian; Saudi Arabia and Russia's plan to raise oil prices; the climate stakes of Brazil's upcoming Presidential runoff election; and great news from the great state of New York regarding electric vehicles...

With unspeakable devastation from Florida to Ukraine, the stakes couldn't be higher for our upcoming midterm elections. We cover all of that on today's BradCast, even while tending to some long overdue accountability and grotesque conflicts of interest in Congress. [Audio link to full show is posted below this summary.]

The horrifying death toll from last week's climate change-fueled Hurricane Ian continues to rise. More than 100 were confirmed dead in Florida alone as of airtime. That number is likely to keep growing, along with the growing questions about why state officials did not call for evacuations before they finally did. Put those questions into the same file that may explain the state's years of climate crisis denial and its now collapsing insurance industry.

At the same time, corrupt authoritarian regimes elsewhere are similarly ill-serving their citizens. We get caught up a bit today on Russia's sham referendums and unlawful annexation of four regions in eastern Ukraine last week. That, as Russia's military offensive continues to collapse and lose ground to Ukrainians defending their sovereign homeland; as Vladimir Putin faces growing unrest after announcing the forced draft of hundreds of thousands of Russians; and as he continues to threaten the use of nuclear weapons as his political and military fortunes devolve.

Then, we move to Brazil, where far-right President Jair Bolsonaro lost in the first round of voting on Sunday to the nation's former leftist President known to the people simply as "Lula". While Lula defeated Bolsonaro over the weekend, neither candidate received the votes necessary to avoid a run-off later this month. Lula's victory was much narrower than expected based on pre-election polling showing that he was likely to defeat Bolsonaro by about 14 points. He won by just less than 6 points in what should serve as another object lesson for U.S. voters before our own critical midterm elections in just 35 days.

Next, we're joined by longtime government affairs and ethics lobbyist CRAIG HOLMAN of Public Citizen to discuss the Combatting Financial Conflicts of Interest Act that he had hoped to see passed in the House before next month's midterms. Holman helped shepherd passage of 2012's STOCK Act. It was hoped that the decade old measure --- requiring immediate disclosure of stock trades by members of Congress and ending their exemption from insider trading laws --- would shame members into avoid conflicts of interest when trading stocks in companies which they also oversaw in Congressional committees.

As Holman details today, the STOCK Act failed in that regard for several reasons. As a New York Times analysis found last month, at least 97 members of the House and Senate, of both parties, continue to hold stocks in companies that they oversee on Congressional committees. But it is hoped that the new measure will end that as well. It would bar members and their direct family (spouses and children) from buying and selling stocks at all, and require them to divest their portfolio entirely or place such assets into blind trusts.

"Prior to the STOCK Act in 2012," Holman explains, "insider trading was illegal for you and I and Martha Stewart, but it was perfectly legal for members of Congress. And they were making use of it. There was one economist who came out with a study that showed members of Congress enjoy a 12% higher rate of return than the rest of us on the stock market. Which means either they're geniuses at trading in the stock market, or they know something that we don't know. Quite obviously, it's the latter."

While the STOCK Act did reduce members' trading in stocks by about two-thirds, he says, the other third "are still out there trading. They are sitting on the same committees and in their same official capacities overlooking the same businesses that they're buying and selling stocks in."

The new bill, however, would finally end those bipartisan conflicts of interest, and/or the appearance of same, once and for all. But, Holman also explains how the bill he had hoped to see passed by both chambers before this year's midterms was derailed last week He tells us whodunnit and how he hopes to see the measure adopted nonetheless in the lame duck session after the elections. Here's hoping!

Does Holman have any concerns that this new law would prevent qualified folks from running for Congress in the first place? "Not on my end," he responds. "That is one argument that you always run into. But, quite frankly, if you've got a huge financial conflict of interest with your official duties of serving in Congress, I don't want you here. If you're not going to get rid of that conflict of interest, you pose more of a threat to the integrity of our legislative process, no matter how competent you are."

Finally, President Biden visited Puerto Rico on Monday in the wake of the devastation of Hurricane Fiona (the storm that took out power across the island, yet again, just two weeks before Ian's devastation in Florida). He didn't throw paper towels at residents, as the former guy did following Hurricane Maria, though he did vow to help get their infrastructure back up and hardened to withstand many more of these storms that will be coming their way as the climate crisis worsens. It was another lively call-in show today on The BradCast, even with one caller accusing me of "professional, managerial class gate-keeping for the Democrats." (Okay. But, if so, where do I pick up my managerial class paycheck?!) [Audio link to full show follows this summary.]

Before we get to the listener calls, however, some important news items today...

  • Good news: Italy has just elected its first female Prime Minister! Bad news: She represents a far-right authoritarian party with its roots in Italian World War II neo-fascism.
  • Last week began with three enormous climate change-fueled storms simultaneously slamming Puerto Rico (which is still largely without power or clean water), Alaska and Japan. This week begins similarly, with three huge storms. One (the same one that hit Puerto Rico) slamming eastern Canada and another super-typhoon that spun up from tropical storm to Cat 5 in 24 hours before ravaging The Philippines. The third storm, Hurricane Ian, is now building strength as it edges Cuba as a Cat 2. It's expected to make potentially catastrophic landfall somewhere in Florida in the next day or two, potentially as a Cat 4. Exact landfall location is still unknown, but Desi Doyen joins us to explain how insanely dangerous Ian could turn out to be, particularly for the city of Tampa Bay.
  • Then, new polling from the Marquette University Law School, considered the "gold standard" for polling on the U.S. Supreme Court, finds, for the first time, that a majority of Americans are either "strongly" or "somewhat" in favor of expanding the the number of Justices on the Court. As you'll recall, the Republican majority Senate during the Trump Administration, packed and stole the Court majority, first by holding a vacant seat open for a full year (effectively, changing the number of seats from 9 to 8 in 2016); then by a blowing up the Senate filibuster rule requiring 60 votes to seat Justices for lifetime positions on the bench. They did that for three controversial far-right Justices who have since helped the corrupted Republican majority on the Court turn the Constitution and nation upside down by ignoring precedent, making up new "doctrines" from thin air, and overturning critical Constitutional rights established by half-century old SCOTUS opinions like Roe v. Wade.

    For many of the reasons discussed on today's show, expansion of the Court is --- at least in my opinion --- the number one reason for voting for Democrats in this November's critical midterm elections. Everything else --- codifying Roe's protection of reproductive rights into federal law, protecting democracy and the planet itself --- are all ultimately subordinate to the High Court. As corrupted as it currently is, expanding the Court to rebalance it is a must...even if many Democrats in Congress and the White House don't yet seem to understand that. Happily, a majority of Americans, across virtually every demographic sector, now agree.

  • Then, we open up the phones to callers on all of the above and more. With, as usual, a bunch of folks calling in to disagree with me, and at least one who correctly identifies the "Big Lie of the Left," that "both parties" are equally bad. They aren't. Not by a demonstrable long shot, as we discuss. Which, apparently, is proof enough that I'm a "professional, managerial class gate-keep[er] for the Democrats!" Who knew? But check please!)

GOP election denier wins MD Guv primary; Bipartisan Senators unveil electoral reform bills; Bolsonaro plays Trump card; GA D.A. cracks down on Giuliani, Graham, fake electors; House Dems play hardball; Biden unveils actions for climate crisis...

There were almost too many clear and present dangers to fit into today's BradCast. But we did our best. Buckle up. [Audio link to full show follows below this summary.]

Among them...

  • Trump-endorsed 2020 election denier, Dan Cox, named as winner of Maryland's GOP gubernatorial primary. Democrats rejoice...but should they?
  • A bipartisan team of U.S. Senators, lead by Maine Republican Susan Collins and West Virginia Democrat Joe Manchin, strike a deal to reform the Electoral Count Act of 1887 to clarify, in theory, that Vice Presidents may not steal elections during joint sessions of Congress to confirm Electoral College votes. We are, let's say, skeptically optimistic.
  • Brazil's far-right autocratic President Jair Bolsonaro --- loved by Trump and Tucker Carlson of Fox 'News' alike --- goes full Trump in declaring that his re-election contest in about 75 days, in which he is predicted to lose by a landslide, will be marred by massive fraud requiring military intervention to sort out.
  • It's not looking good for Steve Bannon in his Contempt of Congress trial. It is looking much better, however, for those who believe in accountability and the rule of law.
  • It's also not looking good for a whole passel of conspirators who attempted to help Trump steal the 2020 Presidential election in Georgia, including Rudy Giuliani, Sen. Lindsey Graham, whose attempts to quash their subpoenas have failed so far, and 16 GOP fake electors now designated by Fulton County District Attorney Fani Willis as "targets" in the special grand jury probe.
  • GOPers in the House and Senate are squirming today, as House Democrats play some excellent hard ball (for a change) by calling votes on the Respect for Marriage Act, to give federal statutory protection to both same-sex and interracial marriage, and the Right to Contraception Act. Republicans are outraged --- OUTRAGED! --- that they're being forced to take a public stance on these issues during an election year, after SCOTUS recently made clear those previously Constitutionally-established rights may now be on their chopping block as well, following their corrupt overturning of Roe v. Wade.
  • Following the corrupt SCOTUS majority gutting the ability of the EPA to regulate carbon, and the corrupt Joe Manchin gutting Joe Biden and the Democrats' critical climate change agenda, the President announced plans for Executive Actions to take on the crisis which he describes (correctly) as a "clear and present danger"...

Corrupt WV Dem still undermining Dems, nation, planet; Secret Service deleted Jan. 6 texts; Arrest warrant issued for indicted CO GOP election official; NY's GOP Guv nom submitted 13,000 fraudulent signatures...

I don't relish saying "I told ya so" on The BradCast. But, in today's lead story, unfortunately, I have to yet again. [Audio link to full show follows this summary.]

Among the news stories covered on today's program...

  • We've been telling you for months that West Virginia's corrupt Democratic U.S. Senator Joe Manchin --- whose family makes millions from the coal industry and campaign rakes in millions from the fossil fuel industry --- never had any intention of allowing any environmental measures to pass that might actually help reduce the deadly emissions that are causing our climate crisis. Nonetheless, his fellow Democrats and corporate media, like Charlie Brown, seem to keep buying his BS claims that he really really wants to adopt environmental provisions and raise taxes on the wealthy to help pay for them. After months of more pretend negotiations, Lucy pulled the football away from Charlie Brown yet again on Thursday night.
  • Gas prices are finally falling. Will Joe Biden get credit for that, since he was inappropriately blamed for Big Oil's record profits from war profiteering and price gouging? (Which all Republicans in Congress refused to outlaw recently?)
  • Texas' privatized, unregulated electric grid is on the brink of collapse yet again, thanks to record heat (which is thanks to a fossil fuel industry-sponsored climate crisis that all Republicans and Democrat Joe Manchin refuse to do anything about.) Will Lone Star State voters this November finally figure out who is to blame for the outages --- and hundreds of deaths that continue to come with them --- during both extreme heat and cold in the state?
  • Oh, look! The Secret Service seem to have accidentally erased all of their text messages from January 5 and 6, 2021, even after the Dept. of Homeland Security's Office of Inspector General asked to see them. Luckily, not much happened over those days that the American people would very much like to know about.
  • Oh, look! A D.C. Metropolitan Police Officer has reportedly testified to the bipartisan U.S. House Select Committee investigating the January 6, 2021 insurrection and Donald Trump's other attempts to steal the election that there was a physical altercation with Secret Service officials inside Trump's limo when he wanted to go to the Capitol instead of back to the White House that day. The alleged under-oath corroboration has so far received much less corporate media notice than the anonymous, still-unnamed person at the Service who claimed that Cassidy Hutchinson was lying during her explosive public testimony late last month about what she'd been told about the incident just after it happened. And the Secret Service officials who were supposed to come forward to dispute her story to the Committee have still failed to do so. (Sure would have been helpful if the Service hadn't erased their text messages from that day.)
  • Mesa County, Colorado's disgraced County Clerk (and recently failed GOP candidate for Secretary of State), Tina Peters, is in yet more legal trouble. The easily-duped MAGA election fraud conspiracy theorist --- now charged with 7 felonies and 3 misdemeanors related to her orchestrating an illicit scheme to unlawfully copy and publicly distribute very sensitive voting system software last year --- had a warrant issued for her arrest by a Judge on Thursday after she left the state without court permission to speak at another evidence-free MAGA election fraud conspiracy conference in Vegas.
  • But the actual election fraud perpetrated by GOP officials running for office continues. Just a few short weeks after 5 of the 10 Republicans running for the Gubernatorial nomination in Michigan were struck from the ballot for turning in tens of thousands of fraudulent petition signatures, it's happened again. This time in New York. The GOP nominee for Governor, U.S. Rep. Lee Zeldin --- who voted against confirming Joe Biden's 2020 Electoral College victory and whose website features a "Team Zeldin Election Integrity Task Force" page, vowing to work "around the clock now and into November to ensure we have fair elections" --- apparently turned in nearly 13,000 fraudulent petition signatures, including 900 pages of photocopies of signatures, in hopes of appearing on the Independent Party ballot line this fall. The Libertarian Party challenged the fraudulent signatures and the state Board of Elections confirmed the fraud, denying Zeldin a third line on the November ballot.
  • Finally, Desi Doyen has our latest Green News Report, with a passel of climate related stories that are so grim, we can't even bring ourselves to tease them here. On the other hand, she does have one pretty good piece of news out of California...so there's that!

"If you're innocent, why are you taking the Fifth Amendment?," Donald Trump used to repeatedly bellow at his campaign rallies. "It's disgraceful," he would tell his MAGA Mob over and over again in 2016. "Only the mob takes the Fifth!" All words that, we just have a feeling on today's BradCast, may soon come back to haunt the disgraced, twice-impeached former President. [Audio link to full show is posted at end of this summary.]

Trump, and his family, and his family business, are now just losing motion after motion, case after case in courts across the country. And the more the losers lose, the more they have to lose.

Among the stories covered on today's program...

  • The BRAD BLOG web server was offline for much of the past 24 hours. We explain what happened and why we're likely gonna need to some shows off in the days ahead in hopes of finally fixing it. (And, yes, we could really use your help!)
  • Of course, if we had an obscene $200 million contract from Spotify (not just $100 million as previously reported), it might be much easier to fix it. But nobody is worth $200 million just to talk on air or on a webstream, no matter how important what they may have to say. But that's especially true for folks like Joe Rogan, who just fills the time with words --- entertaining or otherwise --- that may also have the affect of killing people. Moral of the pathetic Spotify/Rogan story: the company doesn't pay its musical artists nearly enough and, if they have that much extra money lying around to blow on one guy to help spread deadly misinformation, they are also definitely not paying enough in taxes.
  • As to our loser former President and his loser family, Donald Trump and his daughter Ivanka and son Don Jr. lost bigly in New York court on Thursday, where a judge ordered them to answer questions under oath within the next 21 days from state Attorney General Letitia James. She is investigating the family and their business for very clear evidence of years of bank, tax and insurance fraud. Their gambit to sue to the AG to avoid sitting for a deposition has failed and each of them may well consider pleading the Fifth very soon. Ya know, like the mob does.
  • The news was no better for Trump in his hopes of avoiding accountability regarding the insurrection he incited last year on January 6th, in his last desperate bid to steal the 2020 election. On Wednesday, President Biden and the White House counsel rejected Trump's attempt to invoke Executive Privilege to block White House visitor logs from January 6th, 2021.
  • And, also in D.C. this week, the Attorney General there had another victory in court over the Mob Family Trump, when a federal judge allowed him to restore the Trump Organization back into his lawsuit regarding millions of dollars that Trump and his family and his Trump Organization appear to have unlawfully stolen from the non-profit Presidential Inauguration Committee back in 2017. In a stunning ruling by a different judge last year, the company had been released from the lawsuit. But D.C. Attorney General Karl Racine brought evidence to the Court revealing that the unspeakably cheap and greedy Trump Organization inappropriately billed the Committee for about $50,000 in Inaugural weekend hotel rooms that they never ended up using. We explain the sleazy backstory.
  • In somewhat similarly amusing news, out in Colorado, the very Trumpy disgraced and recently arrested Mesa County Clerk, Tina Peters has now declared her intention to run for Secretary of State! Her backstory of recent disgraces --- apparently helping to steal and distribute proprietary voting system software after sneaking into a secure warehouse and turning off security cameras in the middle of the night; being relieved of her duties and barred from overseeing her county's election by a state judge; being investigated for election-related crimes by local, state and federal prosecutors; and being hilariously arrested last week for refusing to turn over evidence that she violated a judge's order by video-taping a court proceeding (among other stuff) --- should make her a top-notch candidate to win the GOP primary for the state's top election official this year! That, even as state Republicans are pretending as if they'd really rather she didn't run at all.
  • Finally, Desi Doyen joins us for our 13th Anniversary Green News Report! Despite almost certainly being the nation's longest-running bi-weekly national broadcast devoted to coverage of our climate crisis, the news on that front continues get largely worse, not better, as revealed again in today's episode. Though, as usual, there is also a bit of very good news on that front to help the medicine go down a bit easier...

Guest: Former Asst. U.S. Attorney Randall D. Eliason; Also: Climate disaster in Rio; Retail sales boom under Biden; I.G. finds Trump Interior Sec. 'misused public office for private gain'...

The clean up on aisle 45 seems to never end on The BradCast. But a whole bunch of experts (including our guest today) suggests our disgraced former President is inching ever closer to some very bad news --- at least in New York. [Audio link to full show is posted at end of this summary.]

First up, some other news not getting enough coverage today...

  • Our climate emergency continues to worsen, as 10 inches of rain fell in three hours in a mountainous tourist area near Rio in Brazil on Tuesday. As of airtime at least 58 were confirmed killed by the downpour and the deadly mudslides it triggered. That comes on the heels of at least 40 killed in similar storms in Brazil last month, as the nation's President, Jair Bolsonaro, has allowed for the acceleration of deforestation in the Amazon rainforest, contributing to our worsening climate crisis and resulting in these deadly, extreme weather disasters.
  • The Biden economic boom continues, despite corporate media's continuing obsession with inflation. On Wednesday, the Commerce Department reported consumer spending surged in January, and at much higher numbers than can be attributed to inflation. Retail sales nearly doubled what Dow Jones had previously estimated would be seen in January. A separate report today also found that industrial production spiked three times higher than estimates for last month.
  • Donald Trump's disgraced Interior Secretary, Ryan Zinke, "misused his public office for private gain" and lied about it to government ethics officials, according to a report [PDF] released Wednesday by the Department's Inspector General. Despite vowing, upon his confirmation as Trump's Interior chief in 2017, to disassociate with a foundation he worked with and a related commercial venture while serving as Secretary, Zinke was found to have communicated with the group dozens of times via email and text; had private meetings with them in D.C.; and played an "extensive, direct, and substantive role" in a commercial development project that would also benefit a private commercial project of his own in Montana. The I.G. reportedly referred the matter to Biden's Dept. of Justice, which --- for reasons unknown --- declined to bring criminal charges against Trump's disgraced former Interior chief. And, because no accountability was ever brought over this matter --- or a host of other personal Zinke scandals revealed while he served under Trump --- the wildly corrupt Zinke is now running again for high office in Montana, hoping to win back his old U.S. House seat this year.

Then, it's on to our guest today, for insight on a number of related matters.

Earlier this week, it was revealed that Trump's longtime accounting firm, Mazars USA, informed him and his family business last week that they would no longer be doing business with them. Moreover, they informed Trump that nearly 10 years of annual financial statements they'd prepared for him and the Trump Organization should no longer be relied upon to be accurate in any way, as it was based on faulty information supplied by Trump.

The company informed Trump that Statements of Financial Condition created from 2011 to 2020 were being retracted and that, due to a "conflict of interest", they would no longer be working for his company. The news came via a court filing on Monday by New York state Attorney General Letitia James in response to the attempt by Trump and his children to avoid depositions in James' civil investigation into alleged bank, tax and insurance fraud by all of them. The Manhattan D.A. is also running a concurrent criminal probe into many of the same matters.

Since that news became public this week, a number of legal experts have explained that Mazars' "conflict of interest" almost certainly means the firm is now cooperating with New York prosecutors against Trump and his businesses. Longtime Trump investigative reporter David Cay Johnston told CNN on Tuesday that he believes Trump and his company and maybe even his kids, will, in fact, be indicted on racketeering charges in the state.

We're joined today by former Asst. U.S. Attorney RANDALL D. ELIASON, who spent years as Chief of the DoJ's Public Corruption/Government Fraud section in D.C. He's now a law professor at George Washington University Law School where he is an expert in white collar criminal law. Eliason offers helpful insight into Trump's increasingly serious New York troubles and discusses his recent opinion piece at Washington Post calling on Attorney General Merrick Garland to explain himself in regard to the DoJ's probe (or lack thereof) into the 10 or more obstruction of justice allegations detailed by Robert Mueller in the report on his Special Counsel investigation.

On the New York matter(s), Eliason cites a recent comment he'd heard that Mazars' dumping of Trump suggests "the ship is leaving the rats." He charges that the financial firm is clearly "trying to distance themselves, and that suggests they see something bad coming down the road for their client." He concurs that "the most likely explanation for what's going on is that Mazars is now cooperating, either in the criminal case or the civil case, or both, and potentially testifying against Trump and the Trump Organization. That definitely creates a conflict of interest, to where they'd say, 'Well, I can't be your accountant anymore because now I'm actually a witness against you.'"

Eliason also offers a very helpful explanation of what racketeering charges actually are, and how, if Johnston is right, that might play into the New York state prosecutions and even the investigation by Fulton County, Georgia District Attorney Fani Willis into Trump's conspiracy to steal the 2020 election in the Peach State. Eliason further helps us understand how both the NY state Attorney General and Manhattan D.A. could both ultimately bring charges for the same set of fraud crimes, but as a civil matter (resulting in fines and other such penalties) by the A.G. and as a criminal indictment (potentially resulting in prison time) by the D.A.

As to the curious case of Merrick Garland, as Eliason highlighted in his recent Post op-ed, he does not count himself among those who think that Biden's Attorney General is necessarily dropping the ball. But he does believe an explanation is warranted to the American people regarding any potential investigations of Trump on the many cases of obstruction painstakingly spelled out in Mueller's Special Counsel report on Russian interference in 2016 and Trump's related firing of FBI Director James Comey.

On Monday, the statute of limitations into the oldest such obstruction allegation cited by Mueller has now run out. (That, as Eliason detailed at the Post, was "Trump’s alleged request to then-FBI Director James B. Comey to drop the criminal investigation of disgraced former national security adviser Michael Flynn. Other acts of possible obstruction soon will be similarly time-barred.")

"This clock is ticking away," Eliason tells me today. "Given the size of the investigation, the seriousness of the investigation, the detail in that report, even though DoJ doesn't normally comment on cases that it's not going to bring, or that it's not prosecuting, in this case they should. They should tell us something about what's happened with that Mueller Report now that we have an administration in office that is not filled with Trump appointees."

Eliason spells out why he believes that, while the DoJ doesn't usually comment on such cases, "this is a unique case" where "a lot of people are really convinced that the evidence of obstruction was pretty overwhelming" and that "it's bad for the Department and bad for the country if that just is allowed to fade into the distance and nobody ever says, 'Hey, we did take a look at this, and here's what we decided.'"

In fact, Eliason believes there is evidence to suggest that Garland is carefully looking at Trump's potential criminal exposure in regard to the January 6 insurrection at the U.S. Capitol, but is less certain about his handling of the Mueller allegations and thinks "there should be some closure on that.".

All of this, of course, as the clock may also be ticking toward an announcement by Trump that he plans to run for President again in 2024. How would that affect any potential federal indictments against the twice-impeached former President? We discuss that matter --- "practically speaking, that gets really hairy --- as well.

Our guest on yesterday's BradCast nailed it. The stolen and packed U.S. Supreme Court did, in fact, strike down one of the Biden Administration's vaccine mandates today (the one that allows employees to not get vaccinated if they choose), while narrowly approving the vaccine mandate for all health care workers at facilities that receive federal funding. [Audio link to full show follows this summary.]

The Omicron surge continues to rack up both record infections and hospitalizations. Death counts are now on the rise as well. Though there are hopeful signs that some parts of the U.S. may be peaking or plateauing, and that, in a few weeks, the surge may plunge as quickly as it initially spiked over the past few weeks. The advice this week from the Los Angeles County Health Director to hang on for just a few more weeks and avoid any non-essential public gatherings, particularly indoors with the unvaccinated or those at high risk of severe illness during that period, is likely good advice for everyone in the nation at this time.

That is especially true now that the non-medical experts at the U.S. Supreme Court seem dead set on preventing actual experts charged with protecting workers from helping to protect millions of them.

As Slate's ace legal journalist Mark Joseph Stern predicted on yesterday's BradCast, the packed Republican Supreme Court did, in fact, put a stay on President Biden's Occupational Safety and Health Administration (OSHA) mandate for workers at large companies with more than 100 employees to either get vaccinated or get tested weekly. The other case heard during emergency oral arguments last week, the Administration's Health and Human Services mandate for vaccination of all workers at health care facilities that accept Medicare or Medicaid funding, was narrowly allowed to remain. Chief Justice John Roberts and Brett Kavanaugh joined the Court's three liberals in a 5 to 4 opinion [PDF] on that one.

Today, we step through the absurdities of the Majority opinion from the Court's rightwingers on the stayed employer mandate [PDF], as well as the even more absurd --- but dangerously so --- Concurring opinion authored by Justice Gorsuch with Thomas and Alito, as well as the furious Dissent, jointly penned by Justices Breyer, Sotomayor and Kagan.

"Underlying everything else in this dispute is a single, simple question," the Dissenters wrote, 'Who decides how much protection, and of what kind, American workers need from COVID–19? An agency with expertise in workplace health and safety, acting as Congress and the President authorized? Or a court, lacking any knowledge of how to safeguard workplaces, and insulated from responsibility for any damage it causes?"

The stinging Minority dissent derides the non-expert Court Majority for being the ones to decide that the non-experts in Congress, as opposed to the experts at the Executive Branch agency charged by Congress via specific statue to protect workers, must make specific medical decisions through legislation for those workers. It is, of course, madness. Especially, as the Dissenters note, the Court's "Members are elected by, and accountable to, no one," whereas those at OSHA are not only experts, but "responsible to the President, and the President is responsible to—and can be held to account by—the American public."

Tune in for all the details. But the good-ish news for the moment is that only three of the Court's rightwingers were willing to sign on to the idea that statutes granting Executive Agencies the power to regulate things should be ignored when there is a "major question" at stake, as we discussed in some detail with Stern on Wednesday. But that good-ish news may not stand for long, as the Court will hear a case next month with even broader implications, as to whether the EPA, despite its statutory charge by Congress, is allowed to regulate pollution that is causing our climate emergency and much more. As we detailed yesterday, we are, in fact, watching the far-right "deconstruction of the Administrative state" before our very eyes.

Then, in what would, during normal times, be our lead story today, we quickly cover the arrest of Stewart Rhodes, the founder and leader of the far-right Oath Keepers militia outfit, who, along with ten others in his group, were charged today "seditious conspiracy" for their part in the Trump-incited attack on the U.S. Capitol on January 6, 2021, as part of Donald Trump's plot to steal the 2020 election.

The federal charges are the most serious to date in relation to the January 6 attack and are precisely what our guest from several weeks ago, Marcy Wheeler of Emptywheel, told guest host Nicole Sandler was likely to soon happen, as the Dept. of Justice and Attorney General Merrick Garland continued a painstaking bottom-up probe. And yes, we did interview the Oath Keepers' Rhodes on this program back in 2016. Here is a link to that lively, if occasionally testy, interview.

And, in one more related matter on an absurdly busy show (restructured about five times before air today as news kept breaking!), GOP House Leader Kevin McCarthy, who recently told a reporter he "wouldn't hide from anything" when he asked if he was willing to speak to the bipartisan House Select Committee investigating January 6th, refused to cooperate with a voluntary invitation on Wednesday to speak with the Committee. In response to the news, Carl Bernstein (of Watergate's Woodward and Bernstein) told CNN on Wednesday night that the Committee already "has the goods" on McCarthy and what he said to Trump on Jan. 6 "and McCarthy has lied about it since."

"So, we have a real conspiracy, a real cover-up, real stonewalling in excess of anything we saw in Watergate," said Bernstein...who should know.
