Before things turn too ugly this week, let's take a moment to flag four great progressive things --- arguably, four great conservative progressive things --- which all happened on Friday.

The first two items got a fair amount of notice, the second two, not so much. But since they all happened on the same day, and that day was Friday, when such stories tend to disappear all together, they are all worth briefly flagging here to make sure you're aware of them...

  • Sen. Rob Portman (R-OH), a co-sponsor of the unconstitutional "Defense of Marriage Act" (DOMA) in 1996, became the first sitting Republican Senator to come out in favor of marriage equality for all. It took him learning that he had a gay son two years ago before he was finally able to do the right thing, but we'll take what we can get. It's another in a string of victories and very encouraging signs for conservative progressivism, specifically the right of equal protection under the law for all.
  • The Maryland legislature voted to ban the inhumane, abhorrent, expensive, ineffective and unequally applied Death Penalty. They become the 6th state in as many years to do so, and the 18th state overall. As Governor Martin O'Malley (D) notes in an op-ed today: "Across our ever-more-closely connected world, the majority of public executions now take place in just seven countries: Iran. Iraq. The People’s Republic of China. North Korea. Saudi Arabia. Yemen. And the United States of America." This is another clear victory for those who believe in the Constitutional value of equal justice for all under the law and who hate Big Government --- the biggest --- allowing itself to kill its own citizens.
  • A federal court ruled that the use of so-called "National Security Letters" --- essentially, a warrantless statement from the FBI handed over to banks, libraries, phone companies, etc., demanding unlimited private information about a specific person for supposed "national security purposes" --- is unconstitutional. Specifically, the gag order on those banks, libraries, phone companies, etc., disallowing them from notifying the target about the intrusion on their privacy, is what the judge found in violation of the First Amendment. The case brought by the Electronic Frontier Foundation(EFF). The use of these letters have been one of the most insidious and abused elements of the PATRIOT Act for a very long time, ever since its passage following 9/11. The court ruling is likely to be appealed by the DoJ, but the finding is, for now, a positive step in the right direction --- at least for those of us conservative progressives who give a damn about unwarranted search and seizure, freedom of speech, etc. AP notes that "the FBI made 16,511 national-security-letter requests for information regarding 7,201 people in 2011" alone.
  • A federal appeals court has re-instated a case filed by the ACLU arguing that the CIA must, at the very least, respond to Freedom of Information Act (FOIA) requests concerning the use of the drone strikes. The FOIA requests in question had sought information on "the legal basis for carrying out targeted drone killings; any restrictions on those who may be targeted; any civilian casualties; any geographic limits on the program; the number of targeted killings that the agency has carried out; and the training, supervision, oversight, or discipline of drone operators." Even if the ACLU is ultimately victorious in this case, the CIA would not necessarily have to provide the information sought in those requests, but they would at least have to respond to them and state which responsive documents they may have and why they are not responding. The ACLU notes that the drone program "has already been responsible for the deaths of more than 4,000 people in an unknown number of countries."

After the two court rulings above on Friday, former Constitutional attorney and civil liberties champion Glenn Greenwald tweeted wryly: "Wow ... it's like we have a 3rd branch or something."

Much of this nation's government, all three branches, are largely stuck and broken in the muck and mire of partisan, corporate-sponsored quagmire or worse. So the fact that we had four important, not-horrible, arguably excellent things happen within that quagmire all on the same day on Friday are worth, at least, noting here for the record.

In the wake of the Jan. 1, 2013 decision by House Speaker John Boehner (R-OH) to postpone a vote on Hurricane Sandy relief until after the 113th Congress was sworn in, NY Rep. Peter King's sense of betrayal, which he described as "a knife in the back" in a remarkable floor speech, is understandable, but his proposed remedy is woefully deficient.

The only way that Republicans in an entire region of the country --- the Northeast --- can achieve meaningful representation in the 113th Congress may be by way of a massive party switch. The increasingly rare breed of "moderate House Republicans" may soon only be left with the choice of emulating the late Sen. Arlen Specter's 2009 party switch, by either becoming Democrats or by becoming independents who will caucus with the Democrats.

Of course, that didn't work out terribly well for Specter either...

With just 5 days to go until the nation holds its next Presidential Election, power remains out in large swaths of the Eastern Seaboard, according to Google Maps' special Hurricane Sandy power outage map.

The outages persist in a number of states which force the majority of their voters to use 100% unverifiable electronic voting machines to cast their votes at the polls on Election Day. If power is out at the polling place on Election Day in those states, voters may not be able to cast their vote at all.

As we warned before Sandy barreled ashore earlier this week, the ability of voters to vote at all --- presuming polling places are not flooded and voters are able to get to them --- is imperiled by states such as Virginia, Pennsylvania, West Virginia, Maryland, New Jersey, North Carolina and even Ohio, all of which force all, or some of their voters to vote on systems which simply do not work if they do not have power.

While most of those states require a small percentage of emergency paper ballots be made available at the precincts, that number is unlikely to be enough in the event that voting machines are unavailable all day at the polls on November 6th. Moreover, battery backups on the electronic touch-screen systems are unreliable at best and, even when working, can only be counted on for a small number of hours.

In Pennsylvania, for example, as noted yesterday by the Pittsburgh Post-Gazette, "In case of power loss, local election officials are encouraged to keep enough paper ballots on hand for 20 and 25 percent of their registered voters."

While the PA Dept. of State claimed in the same report that voting machines can run on backup batteries "about six hours," a Lehigh County, PA election official offers a more realistic assessment, noting their touch-screen system backup batteries last just 2 and a half hours at best.

The BRAD BLOG has long warned that power loss on Election Day is just another, among a myriad of reasons why forcing voters to use such systems is insane and extraordinarily disrespectful to the electorate in such jurisdictions. Other reasons why these type of voting systems should never be used: They are 100% unverifiable in every case (whether they include a so-called "Voter Verifiable Paper Audit Trail" or not, as some do) and computer scientists and security experts have long warned, in virtually every instance where these type of systems have been examined over the past decade, that they are both prone to failure and easily manipulated, by both election insiders and hackers alike, in ways that are unlikely to ever be detected.

At The Nation today, Ari Berman notes that "Thanks to a wave of new voting restrictions passed by Republicans, the 2012 election was already shaping up to be pretty chaotic before the arrival of Hurricane Sandy, which left 8.2 million households without power in 15 states and the District of Columbia."

He then goes on to detail some of the worst hotspots for concern...

"History is being written as an extreme weather event continues to unfold, one which will occupy a place in the annals of weather history as one of the most extraordinary to have affected the United States," the Weather Channel's Senior Meteorologist Stu Ostro is warning. "This is an extraordinary situation, and I am not prone to hyperbole."

The National Weather Service has been telling us over the past several days that the serious impact of the super storm which is Hurricane Sandy is not to be underestimated. But there is another concern that has been keeping me awake over the past week or so.

NBC's Al Roker spelled out that concern briefly on Sunday's Meet the Press, explaining what I've been worrying about since it became clear that the storm could have serious ramifications on Election Day.

I'm not talking about the political ramifications about its effect on planned campaign events between now and Election Day, on Early Voting turnout, or even how it's handled by President Obama and FEMA, etc. I'm talking about the serious question of whether voters will be able to vote on Election Day at all, particularly in states which force voters to use electronic voting systems at the precincts.

"We expect massive power outages throughout the area," Roker told NBC's David Gregory (before Gregory hurried to ignore the comment entirely.) "As the system moves on shore it's going to be a long term effect. It's going to last for about 72 hours. And so we're talking about people who could be without power for at least 10 days. That, as you know, will take it right into Election Day. So what will people do if they can't get to the voting booth, or the voting booths don't have power?"

Good question, Al. And one we've warned about here for a number of years.

There are about a half a dozen states (listed below) directly in harm's way where voters are forced to use 100% unverifiable electronic voting systems on Election Day. In those locations, unless they have enough emergency paper ballots printed up to accommodate the entire electorate at precincts where power remains disrupted on Election Day, there could be very serious and unprecedented problems...

That'll teach 'em to mess with the Military-Industrial Complex.

As the Washington Post reported earlier this month, Maryland's "Montgomery County Council resolution asking Congress to spend less on wars and redirect the funds to social programs has drawn the scrutiny of one of the county’s largest employers and other lawmakers."

Despite the non-binding resolution's [PDF] 5 to 4 majority support on the Council, it was withdrawn from consideration after "Bethesda-based Lockheed Martin," a giant manufacturer of sophisticated military weapons, "which employs more than 5,000 workers in Montgomery, urged county officials against the resolution."

The Lockheed lobbyists were joined in their efforts to derail the County Council's resolution --- supported by Democratic members of the council --- by Democratic state and county officials concerned about implications of insulting the weapons contractor giant, while officials in neighboring Virginia "gleefully watch[ed] from afar" as the two states are in frequent competition for billions of Pentagon dollars and the jobs that portend to go with them.

But Pentagon dollars are among the least efficient ways to increase jobs and wealth in any given community, as explained by John Feffer, a co-director of Foreign Policy In Focus at the Institute for Policy Studies and Jean Athey, a coordinator of Montgomery County Peace Action, a supporter of the now-withdrawn Montgomery resolution:

Spend a billion dollars on the military, economists Robert Pollin and Hedi Garrett-Peltier estimate, and you get about 11,000 jobs (just a little more than what Lockheed Martin employs in all of Maryland). Spend that same billion dollars on clean energy projects and you generate about 17,000 jobs. The same money invested in education produces nearly 30,000 jobs.

Nonetheless, Lockheed and other longtime members of the Military-Industrial Complex continue to work with public officials in exploiting the "jobs scam" in order to pit state against state, county against county and town against town to bilk tax-payers out of billions under the cynical rubrik of "job creation."

And when that doesn't work, there are other, darker methods that can be used to send the "right" message to those members of the public who might have the temerity to oppose their corporate interests...

A senior aide and a consultant hired by former Maryland governor Robert L. Ehrlich Jr. (R) were indicted Thursday in a case stemming from thousands of anonymous robocalls placed on election night last year that suggested voters could stay home even though the polls were still open.

Paul Schurick, 54, Ehrlich’s de facto campaign manager, and Julius Henson, 62, a consultant paid by the campaign, were both charged with three counts of conspiracy to violate election laws, one count of influencing votes through fraud and one count of failing to identify the sponsor of the calls. In addition, Schurick was charged on one count of obstruction of justice.

In a statement, the Office of the Maryland State Prosecutor, which obtained the indictments from a Baltimore grand jury, said its investigation is continuing. All but one of the charges handed down Thursday carry maximum prison sentences of five years.

Of course, while the Maryland scheme appears to have been criminal, this year, the more pressing problem is the fact that GOP state lawmakers aren’t resorting to robocall schemes; they’re just rigging the game before Election Day even comes.

As we talked about last week, there is a concerted national effort on the part of many Republican policymakers to make it harder for traditional Democratic voters to participate in the 2012 elections. Under the auspices of rooting out “voter fraud” — a problem that appears to exist largely in the over-active imaginations of GOP activists — Republicans are passing voter-ID measures, approving new laws restricting voter-registration drives, and closing early-voting windows.

If all goes according to plan, going forward, they won’t even need ridiculous schemes like the one in Maryland.

Of course, the new indictments handed down against Ehrlich's aides in MD (Ehrlich ended up losing the election anyway) are hardly the only examples of GOP election fraud going on out there, even as there are rarely indictments for any of it.

We recently detailed the story of the high-ranking Clay County, KY, election officials (including the County Clerk, a circuit court judge, and the school superintendent --- and other members of the County Election Commission) who were sentenced to a combined total of some 150 years in the federal penitentiary jail, for gaming elections for years in the county via buying and selling votes as well as, in 2006, actually changing the votes of voters on electronic touch-screen voting machines.

That's election fraud. As to actual voter fraud --- the thing that Republicans pretend exists in epidemic form, but doesn't, so they can use the propaganda to bolster implementation of their disenfranchising polling place Photo ID voter suppression schemes --- early this week we reported on the new complaint filed against former GOP Governor and current Republican Presidential front-runner Mitt Romney for having committed voter fraud in the state of MA. It appears that Romney voted in MA last year, even though he no longer actually lived there.

The facts of the case highlight Romney as just the latest in a rapidly growing list of high-profile GOP vote fraudsters, as detailed in our article, including Utah's former Governor Jon Huntsman Jr. (also set to run for the GOP Presidential nominee), Indiana Sec. of State Charlie White (who's already been indicted for 3 voter fraud related felonies), Missouri's U.S. Rep. Todd Akin (who's running for U.S. Senate), and GOP voter fraud queen Ann Coulter.

The complaint against Romney was filed by fellow GOP Presidential candidate Fred Karger, who was my in-studio guest last night on the nationally syndicated Mike Malloy Show (which I'm guest hosting this week and the beginning of next). Convicted rightwing criminal may also have violated terms of his federal probation...

Convicted federal criminal and Rightwing dirty-trickster James O'Keefe appears to have flagrantly run afoul of the rule of law yet again. This time, he appears to have violated and/or conspired to violate Maryland's Wiretapping and Electronic Surveillance Act. It would not be the first instance of him having done so.

The apparent violation(s) of state felony laws, revealed today as part of what is being reported as O'Keefe's "botched" attempt to "punk CNN", comes on the heels of O'Keefe's previous apparent violations of the very same laws in MD, though law enforcement officials have yet to hold him accountable, to date, for those previous offenses.

Documents and other material produced by CNN today suggest that O'Keefe secretly, and illegally, taped phone calls he had with CNN's investigative journalist Abbie Boudreau, and conspired to secretly video tape her in a compromising situation, also in violation of MD law.

O'Keefe, who is currently on probation after pleading guilty to a federal misdemeanor following another botched scheme in Louisiana earlier this year, seems to have broken similar laws last year in a number of states, including Maryland, where he secretly video taped employees at the offices of the community organization ACORN in Baltimore. Hillsborough Co Florida outgoing election chief, Buddy Johnson, wanted $2.3M from the county to cover election cost overruns from the Nov. election. Stupidly Johnson did not bother showing up to appear before the county supervisors so they could ask him questions. The supervisors took his no-show as an insult and they have deferred any decision until they can review the election office’s records.

Meanwhile the Maryland Board of Public Works has approved a contract between the state and Premier/Diebold for $974,000 for six months to cover municipal elections within the state. That contract could add up to $1.4M if two three month options are exercised. All of this even though the state is scrapping their paperless DREs at the end of next year in place of a paper based system.

And, after the reports of Diebold accuracy failures in Humboldt Co., California, the county has decided to scrap their present system and replace it with machines provided by Hart Intercivic. The selection of Hart is a bit strange in light of the fact that Hart has removed themselves from all EAC certification testing. They will not, in the future, have a voting system that has been tested to the voting system standards and certified by the EAC....

MD's Chief Election Official, Linda Lamone Rips off Mic During Pointed Queries About Her State's Failed Touch-Screen Voting System
2006 Broadcast News Interview Never Aired, Never Seen Until Now...

"Source code is almost irrelevant to us," says MD's State Election Director Linda Lamone a few minutes before she removes her mic and walks off the interview. "That's not what we use to run this voting system. It's the executable code."

Lamone, responsible for bringing Diebold's 100% unverifiable voting machines to the entire state of MD in 2002, is wrong and/or lies about so much in the course of this interview --- taped by a major broadcast news network, but never aired, in 2006 --- that we don't even have time to dissect it all. So, for the moment, I'll leave it to all of the good denizens of The BRAD BLOG who are now very well-versed in just how full of it Lamone is during the entirety of this interview.

"I think you're in Fantasy Land, so I'm gonna end this," Lamone says, ironically enough from the bowels of her own Fantasy Land, in support of her 100% faith-based voting system, before she rips off her mic, walks off camera, and ends the interview. We guess she's not used to being interviewed by a reporter who knows what she's talking about.

Senator Says 'It Wouldn't Make Much Sense' For Illegals To Vote 'To Be Perfectly Honest'

Neil Cavuto of Fox "News" had on Maryland state senator, Alex Mooney (R), to discuss Maryland Governor Martin O'Malley's plan to allow "illegals" to keep driver's licenses. For the most part, Mooney plays the Fox guest role perfectly --- bashing the plan that could help "illegals", calling the Governor a "strong supporter of Hillary Clinton" and repeatedly referring to his political opposition as the "Democrat" party. However, the Senator fails to follow Cavuto's lead when he tries to link the licensing of "illegals" to voter fraud (beginning at the 2:55 mark):

Cavuto: But that second license, the illegal license, whatever you want to call it, that can't get you on planes or in federal offices, but I bet you it could let you vote.

Senator Mooney: Well, actually to vote you have to be a citizen according to the voter, when you register to vote you have to check off, at least pledge, under penalties of perjury, that you are a citizen.

Unconvinced, Cavuto pushes his case by stating that some municipalities might accept the licenses granted to illegals to which Mooney gives in a little. With Mooney back on board, Cavuto proceeds to bottom line the issue:

Cavuto: Bottom line Senator, you could have illegals voting in your state.

Senator Mooney: We could, but it wouldn't make much sense for them to do so, to be perfectly honest, because they would be subject to perjury and other problems. There's other things they'd rather do like be able to drive and have these jobs and, you know, go to schools.

Ouch! Only time will tell if the Senator is ever invited back to Fox "News".

Voting Machines Failures Reported (So Far) in Indiana, Georgia, Pennsylvania, Colorado, & Maryland...
UPDATE: Naturally, Ohio Joins the Group of States with Voting Failures...

Voter turnout was light in many parts of the country yesterday. Ironically enough, that's the good news.

Alternet ran a preview of voter suppression issues of concern in yesterday's elections across the country. Sure enough, the author, Steve Rosenfeld, wrote in during the early evening to let us know there were problems concerning Photo ID issues popping up in pockets around the country, and that he'd have more soon. Our own Alan Breslauer touched base as well with several reports he'd been getting from around the country.

John Gideon's "Daily Voting News" yesterday pointed to some of those issues that had been reported in the media as of yesterday afternoon around the country. GOP voter suppression, through specious claims of Democratic "voter fraud" and the invented "need," therefore, for disenfranchising photo ID laws and challenges at the polls, is at the top of the Republican strategy for '08. Naturally, it was taken out for a test spin yesterday.

(Speaking of spin, don't miss wingnut Mychal Massie's despicable retread diatribe --- including the mandatory quotes from GOP "voter fraud" fraudster, John Fund, who wrote the book on it, literally --- in the wingnut WorldNetDaily. His tragically misguided piece, headlined "Vote fraud: Democrats' meal ticket" gives you just about all you need to know. Read it once, save yourself a thousand or so near-identical reads between now and November 2008. But we digress...)

The other major prong of voter disenfranchisment is, of course, the machine issue. Problems in that area, in particular, tend to reveal themselves in the days after elections. Early on election day such problems are frequently downplayed in the media, who tend to turn to Election Officials for information despite the inherent conflict of interest such officials have in hoping to portray their elections as "successful."

In the early hours, then, hints of such breakdowns are reported as little more than computer "glitches" "hiccups" "snafus" and "snags" (though "kinks" makes it debut today, see below) until later on, when the true extent of the voting system failures --- and that's what they are, not "kinks" --- become known.

With that in mind, here are just a few of those e-voting glitches, hiccups, snafus, snags, and yes, kinks, from around the country so far yesterday, as culled from Gideon's DVN last night...

Linda Lamone Allows Her Picture To Be Used In Diebold Sales Literature
Testifies Favorably for Equipment That Failed Spectacularly In Maryland Last September...

Today Wired News' Kim Zetter reported on their "Threat Level" blog that Maryland Election Director, and long-time Diebold apologist, Linda Lamone has allowed her statements and picture to be used in new advertising brochures Diebold has produced to promote their Express Poll 5000 electronic poll books.

Zetter quotes Lamone:

"Our election judges just love this product, and so do I. We in Maryland are extremely pleased with the performance of the system during the general election," reads Lamone's quote next to a photo of her smiling and sitting, presumably, in a state election office.

Note Lamone's mention of being pleased during the general election.

As Zetter points out in her article, the machines that Lamone is speaking for failed spectacularly in Maryland during last September's Maryland primary election. The machines also failed in Georgia last July. It appears that Diebold was doing what seems to have become a common practice among the voting machine vendors, "Beta Testing" in a real election. While Diebold claimed that they fixed all of the problems found during the primaries, at least one official told Zetter that machines in at least one precinct crashed when a last name beginning with "Cur" was typed in.

And what about the conflict of interest of Lamone shilling for a company that the state is doing business with? Zetter goes on to report...

State Lawmakers Moving Towards Paper 'Trail' Voting Instead of Paper BALLOTS...

Maryland was one of the first states in the country (along with Georgia) to adopt Diebold's paperless touch-screen voting. Now that they've learned from that mistake, it looks like their legislature is preparing to make the same mistake again by moving to paper trail voting, instead of paper ballots, according to the Washington Post.

If you're still confused about the difference --- and even if you're not --- please see this short and to-the-point Open Letter to Congress Members, and the accompanying e-mail petition, signed and released by more than 35 non-partisan Election Integrity organizations just before the holidays.

It calls for a paper ballot --- not "trail" or "record" --- for every vote cast in America. That is, of course, the only acceptable first-step solution on the long road towards restoring America's electoral system and the voters' confidence therein.

After you've read it and signed it, please pass it on. Maybe Maryland will take notice before they screw things up again. We certainly hope so.
