The Secret Koch Brothers Tapes...

By Brad Friedman on 5/28/2014 9:32pm PT

After a couple of weeks off for the latest KPFK/Pacifica Radio fund drive, The BradCast was back at full throttle this week!

First up: Fred Karger joined us from the airport in Maine, fresh off his latest victory against the anti-freedom group calling itself the National Organization for Marriage (NOM). Karger, a Republican and long time political consultant for campaigns such as those for Gerald Ford, Ronald Reagan and George H.W. Bush, was also the first openly gay candidate for President of the United States when he ran for the GOP nomination in 2012. On Tuesday, the state of Maine levied a record fine of more than $50,000 against NOM after finding, based on a complaint filed by Karger, that the group committed egregious campaign violations in their $2 million effort to ban marriage equality in the state 2009.

We discussed that, his similar victory out in California against NOM and the Mormon Church, the remarkable recent string of court victories in the marriage equality movement, and why the hell Karger is still a Republican.

Next up: My round-up of the woeful state of the CA Sec. of State's race, which holds its primary next Tuesday. From the Democratic candidate (Padilla) who willfully misled the public about his radical e-vote reform bill; to the other Democratic candidate (Cressman) who is great on campaign finance reform, but not as great on voting systems; to the Republican candidate (Peterson) who just can't seem to denounce disenfranchising polling place Photo ID laws, even though he claims to be against them; to the Green Party candidate (Curtis) who would love to see Internet Voting, but is now threatening to sue me and The BRAD BLOG for pointing that out to the public (and defaming us to boot!)

Good luck, California!

Finally: As usual, Desi Doyen joins us for the latest Green News Report as the state of California learns the very very sad news that the fracking reserves in the Monterey Shale oil fields have only been over-estimated by some 2300%!

Enjoy!

Pete Peterson claimed to 'agree' with Rand Paul's position on voting restrictions, but won't say why, even after the KY Senator flipped
UPDATE: Peterson finally responds...
By Brad Friedman on 5/28/2014 1:45pm PT

The leading Republican candidate for Secretary of State in California does not want to go on record as to why he once claimed to agree with Sen. Rand Paul (R-KY) that GOP polling place Photo ID restrictions are "offending people".

Pete Peterson is, according to a mid-April Field Poll [PDF], leading a large field of candidates of all parties to become the next chief election official in the Golden State. He's a public policy adviser at Pepperdine University's Davenport Institute (which is funded in part by Charles Koch) and, according to that poll, leads his nearest competitor, Democratic state Sen. Alex Padilla, by double-digits in the state's upcoming June 3rd "Top-Two" primary contest.

Earlier this month, Paul offered a wobbly position on Republican polling place Photo ID restriction laws, at first seeming to buck his own his own party's years-long strategy to impose such disenfranchising statutes in states around the country. "Everybody's gone completely crazy on this voter ID thing," the Senator told the New York Times during an an interview. "I think it's wrong for Republicans to go too crazy on this issue because it's offending people."

On the day the NYT article ran, Peterson --- a Republican running for statewide office in a very "blue" state --- quickly allied himself with Paul, tweeting that he "agree[d] w Rand on his points re voter ID".

But, as we noted when The BRAD BLOG covered Paul's remarks, the Kentucky Republican and 2016 Presidential hopeful, was cagey in his comments to the Times. He didn't declare such laws to be wrong, per se, even though they may serve to remove the voting rights of millions of otherwise perfectly legal (and largely Democratic-leaning) voters. He said only that such restrictions were "offending people". He also later seemed to flip his position on the matter.

Just after the initial comments, however, and Peterson's tweeted claim to agree with him, we asked the candidate to clarify exactly what it was that he was agreeing with in Paul's remarks...

System failure follows warnings from e-voting experts that Estonian Internet Voting system vulnerable to attack, manipulated results...
By Brad Friedman on 5/26/2014 8:09pm PT

In case you're wondering, the U.S. isn't the only nation who still uses woefully unverifiable e-voting systems that are easily hacked and prone to malfunction and malfeasance. E-voting systems in Belgium failed spectacularly over the weekend, during the European Union "Super Sunday" elections there, according to PCWorld...

A bug in an e-voting application halted the release of European, federal and regional election results in Belgium, the country's interior ministry said Monday.
...
A bug in the voting software used at canton headquarters where the votes are counted caused "incoherent" election results when it tried to add up preferential votes from those machines, ministry spokesman Peter Grouwels said. The application counted the results in different ways that should always get the same outcome but that wasn't the case, he said, adding that the release of the results was immediately stopped when this was discovered.

The fault appeared in the system despite the fact that the application was especially developed for these elections, was "tested thousands of times" and was certified by PriceWaterhouseCoopers, he said.

"Tested thousands of times." Gosh, that sounds familiar.

Also, familiar? The response to the disaster from the group that has been fighting against unverifiable e-voting systems for years there [emphasis added]...

By Brad Friedman on 5/25/2014 12:05pm PT

It's that time of year again. Memorial Day weekend. When politicians of all parties love to pretend they care about the men and women they send away to fight and die for wars of political expediency, only to pretty much completely ignore them for the rest of their lives once they come back home.

The latest "outrage" about the various failings of the Veterans Administration is just more evidence of that. The Obama administration has known about many of the problems for years, but hasn't done nearly enough to fix them. Now that the issues have found their way into the media again, the Republicans, who've spent years denying veterans benefits and refusing to fund the VA at levels adequate to support their much-beloved wars-without-end, are pretending to be upset about it all --- now that they believe they can use it to hurt their real enemy, this particular President of the United States.

And that's where The Daily Show's Jon Stewart jumped back in to the matter last week, pointing out that the latest hypocrisy is, in fact, not particularly new for the U.S., not by a long shot.

Our friend Tom Courbat of Riverside, CA (decidedly not to be confused with Pennsylvania's democracy and freedom hating Gov. Tom Corbett) --- a Vietnam-era Agent Orange and Multiple Myeloma Surviving veteran, as well as great homefront hero of Democracy for many, many years --- requested we post Stewart's latest take over this Memorial Day weekend. We are all too happy to do so. It is, quite literally, the very least we can do to say thanks to Tom and all the others vets who have given far more for their country than it will ever be able to return in kind.

As Courbat writes us about Stewart's take (posted below): "Nothing, nothing I have EVER seen summarized as well how our country has managed to screw over our vets, going all the way back to our war for independence from England! You will be blown away by what you learn --- and this MUST be shown for the Memorial Day."

And so it shall be. Both parts of Stewart's epic takedown from Thursday night's show follow below. If you only have time for one of the two parts, let it be PART 2...

Isn't it time that the suckers dumb enough to have given money to Rightwing con-man and federal criminal James O'Keefe's ironically-named "non-profit" Project Veritas started demanding their money back from this clown? Or are they simply too stupid to care about being played for complete stooges as Fox "News" and, apparently, Megyn Kelly still appear to be?

Here's O'Keefe's latest really huge fail, as revealed fail after "sting victim", Academy Award-nominated Gasland documentarian Josh Fox, turns out to have recorded the entire conversation deceptively edited and featured in pretend "journalist" O'Keefe's new video...

What O'Keefe got busted doing there, as seen in the Chris Hayes MSNBC segment above, is exactly what he does in every one of his pretend "investigations", as we've demonstrated here for years. This time, at least, one of the victims happened to have had the foresight to have recorded it all independently on his own. It's remarkable that even the wingnut dupes at Fox "News" are still falling for this tired con, frankly, much less people stupid enough to send actual money to support Jimmy's scam.

For specific details on just some of the deceptively edited bullshit in his latest con, see this at Media Matters. For the entirety of the recording that documentarian Fox made of the encounter deceptively pimped in the scam video premiered recently by O'Keefe at Cannes, see this at The Daily Beast. For more on how despicable O'Keefe's latest scam actually was, see this from one of Josh Fox' business associates.

For the early history of the great James O'Keefe/Andrew Breitbart con that put both on these grifters on the map --- before we subsequently revealed them to be top-to-bottom two-bit con-artists by debunking the entirety of their infamous ACORN 'Pimp' Hoax bullshit and more --- see The BRAD BLOG's Special Coverage page on them here.

Finally, if you're tired of grifting, and would like to support actual investigative blogging and journalism that doesn't just make shit up --- but helps bust those who do --- please consider donating to The BRAD BLOG, since we don't actually receive hundreds of thousands of dollars (or any, in fact) from partisan operatives, and rely on only you to help us keep going...

By Brad Friedman on 5/23/2014 7:35am PT

Recently, conservative Andrew Sullivan (an actual conservative, as opposed to a wingnut Republican "conservative"), decried the Rightwing "resistance to the overwhelming data behind carbon and climate change" and what he describes as the "obvious role for conservatism here at every stage", as he bemoaned the buffoonery on the issue from once-serious folks like George Will and Charles Krauthammer as "deeply dispiriting"...

[A]t this point, the overwhelming scientific consensus is clear enough, and the argument behind it powerful. The world’s climate is changing; and it will mean huge challenges for humanity’s habitat. I simply cannot see why any sane person would not wish to try and mitigate that change or prepare for such an eventuality. It’s not about ideology so much as simple prudence. Even if you view the likelihood of a much warmer planet as small, its huge potential impact still makes it worth confronting. Low-probability-high-impact events are like that. And conservatives, properly understood, attend to such contingent problems prudently; only ideologues or fools decide it would be better to do nothing and hope for the best.
...
No amount of denial or distraction can change that fact. Either we adjust or we face the consequences. Or both. But pretending we live on another planet in another era does not seem to me to be a conservative position.

No, it's not a conservative position, but it is the "conservative" position, as of now, even as Sullivan still seems to have trouble grappling with the all-but-disappearance of what once used to be a legitimate political movement in America.

For another take on the Rightwing abandonment of reality, see former Republican D.R. Tucker's recent take-down of Republican Joe Scarborough after the MSNBC host blamed Al Gore for Sen. Marco Rubio and the Republican Party's newly-found climate denialism.

For my money, however, Sen. Sheldon Whitehouse still offers the most plausible explanation for the GOP's madness in the face of our ever-quickening climate crisis.

David Curtis offered demonstrably false claims about us to radio station, published them on his campaign website...
By Brad Friedman on 5/21/2014 7:43pm PT

California's 2014 Green Party nominee for Sec. of State David Curtis has pretty blatantly lied about both me and this blog in a recent defamatory statement sent to a Monterey radio station, charging us with, among other things, having "post[ed] fabrications masquerading as journalism."

The demonstrably inaccurate allegations made by Curtis were included in a statement he posted on his campaign website "to KRXA/MontereyRadio.com," presumably in response to a discussion on the station about Curtis, following one or more of several articles we recently published here about the candidate.

Curtis, who in 2010 ran as the Green Party candidate for Governor in Nevada, is one of several Sec. of State candidates on California's June 3rd primary ballot, where the two highest vote-getters, from any political party, will then go on to compete in the general election this November.

The BRAD BLOG has run several different stories on Curtis of late, and he appeared live as my guest on KPFK/Pacifica Radio's The BradCast in April...

Asa Hutchinson almost lost his own vote on Primary Day...
By Brad Friedman on 5/21/2014 1:49pm PT

This morning, in reporting on 92-year old Texan Ruby Barber's inability to receive a Photo ID to vote under the state Republicans' new law restricting legal voters who don't have a very specific type of ID, we noted that there are hundreds of thousands of otherwise legally registered voters in TX (and millions across the nation), who are likely to find themselves unable to vote at all, unless these purposely discriminatory voting laws are struck down once and for all by the courts.

While the elderly, the poor, students and minorities (all of whom just happen to lean Democratic) are far and away more likely to lose their right to vote under these Republican-enacted restrictions, they are not the only ones at risk of losing their franchise, as evidenced Tuesday during Arkansas' primary election...

State Republicans' voter suppression law hitting its target
UPDATED: Media coverage finally results in voting ID for Ruby Barber...
By Brad Friedman on 5/21/2014 6:03am PT

[This article now cross-published by Salon...]

Here is just one more of the hundreds of thousands of reasons that have led the U.S. Dept. of Justice to file suit against Texas Republicans' polling place Photo ID restriction law.

The same law had been previously blocked by the DoJ and again by a federal court under the federal Voting Rights Act, after the state's own data showed the law discriminated against racial minorities and others, while failing to deter actual voter fraud in the state.

But, literally minutes after SCOTUS gutted the heart of the Voting Rights Act last Summer, the section which was used to strike down the law previously, Texas Republicans announced their intention to re-enact the law which, of course, they knew to be discriminatory.

As the Waco Tribune reports, 92-year old Ruby Barber has tried, but has so far failed, to obtain one of those so-called "free" Photo IDs from the Texas Dept. of Public Safety (DPS), now that one is required for her to cast her legal vote this year, as she had for decades, until now, without a problem.

Barber's story is heartbreaking and maddening but, unfortunately, probably not entirely rare. The DoJ estimated, based on the state's supplied data when the federal agency blocked the law in 2012, "the total number of registered voters [in Texas] who lack a driver's license or personal identification card issued by DPS could range from 603,892 to 795,955."

Barber's driver's license expired in 2010 and she's now having difficulty locating "her nearly century-old birth certificate that she'd need to obtain a voter ID under a new state law." As the New York Daily News reports, the details of Barber's story and her fight to try and cast her vote are simply absurd...

George W. Bush-appointed judge concludes 'We are a better people than what these laws represent'
UPDATE: Governor decides to NOT appeal ruling court's ruling...
By Brad Friedman on 5/20/2014 12:35pm PT

Just hours after a similar decision in Oregon yesterday, Pennsylvania now becomes the 19th state where the Constitutionally conservative value of equal protection for all under the law becomes the law of the land again.

The Keystone State's ban on marriage equality has just been found by a federal judge to be in violation of the U.S. Constitution there. Wildly unpopular Republican Gov. Tom Corbett --- who lost today on this issue, as well as in his recent failed defense of Republican polling place Photo ID restrictions --- is believed likely to appeal the decision. (He recently chose not to appeal the indefensible polling place restrictions which, as the state was forced to admit before the trial even began, had nothing to do with stopping "voter fraud".)

Corbett, a self-proclaimed "conservative", hired a private $400/hour firm to defend the law after Democratic state Attorney General Kathleen Kane refused to do so. The wildly unpopular Corbett faces a very tough re-election this November.

District Court Judge John E. Jones, a George W. Bush appointee, described the state's ban on marriage quality as "an injustice" and wrote in his rather moving decision today, featuring section headers that mirror the classic wedding vows, that "all couples deserve equal dignity in the realm of civil marriage."

"In future generations the label same-sex marriage will be abandoned, to be replaced simply by marriage," he concluded. "We are a better people than what these laws represent, and it is time to discard them into the ash heap of history."

* * *

UPDATE 5/21/2014: As he did after the court's recent rejection of PA's polling place Photo ID restriction law, Corbett has now announced he will not appeal the trouncing his side of the argument received in court yesterday. Let the weddings, and equality, begin...

Frankenstein's monsters finally turn against the good doctor...
By Brad Friedman on 5/20/2014 6:02am PT

[This article now cross-published by Salon...]

Glenn Beck's natives are getting very restless, and many of them are now taking their frustrations out on him.

The organizers of last Friday's "Operation American Spring" (OAS) had claimed their massive Washington D.C. protest, "calling for the removal of Barack Obama, Joe Biden, Harry Reid, Mitch McConnell, John Boehner, Nancy Pelosi, and Eric Holder as a start toward constitutional restoration," was likely to draw 10 million to 30 million fed-up American patriots to the nation's capital.

To the weekend-long bemusement of Democrats and progressives, the number of attendees at the rally was closer to 10 than 30 million. As even the rightwing Washington Times reported, attendance fell "woefully below expectations," with turnout claims varying from a few hundred to a few thousand. "Hundreds is more like it," said one of the attendees quoted by the Times.

Progressives were predictably entertained by the dismal failure of the umpteenth rally to save our nation from the "outlaws" or "commies" or "Muslims" or "Constitution haters" who have now taken it over the government --- through peaceful elections. But once the King of the American Patriots himself, Glenn Beck, and his online "news" outlet The Blaze, appeared to join in to mock the event, the real patriots could no longer hold their tongues.

Long-time supporters of Beck's turned their sights on the radio host-turned-CNN-host- turned-Fox-"News"-host-turned-multi-millionaire-Internet-entrepeneur after The Blaze's Oliver Darcy covered the event, describing it as "only millions short of projected turnout," featuring "only a few dozen protesters" and as having "failed incredibly."

Many of Beck's fans were decidedly not happy about that, some going so far as to declare Beck himself "the enemy"...

Law found in violation of U.S. Constitution; Judge declares 'let us look to each other...and rise'...
By Brad Friedman on 5/19/2014 12:51pm PT

Constitutionally conservative victories for equal protection under the law are piling up across the country faster than we can note them here!

Moments ago, the latest victory was announced in Oregon, where a federal judge just found [PDF] the state's ban on marriage equality to be in violation of the 14th Amendment...

Because Oregon's marriage laws discriminate on the basis of sexual orientation without a rational relationship to any legitimate government interest, the laws violate the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution.

Well, that was easy. Marriages are expected to begin in the state "almost immediately".

The final paragraph of District Court Judge Michael J. McShane's opinion was particularly thoughtful...

Sacramento Bee does a lousy job of helping voters understand why that matters...
By Brad Friedman on 5/19/2014 6:05am PT

California is making it slightly more difficult for millionaires and billionaires like the Koch Brothers to secretly and fraudulently influence elections in the state.

As the Sacramento Bee tried to report it...

Nonprofit organizations that make political contributions in California will have to disclose more information about the source of their money under a law Gov. Jerry Brown signed Wednesday.

Senate Bill 27 was inspired by the 2012 ballot measure wars in California, when two out-of-state nonprofit groups poured $15 million into fighting Proposition 30 and supporting Proposition 32. Because of the groups' nonprofit status, they were not required to report where their donations originally came from, leading some to describe the contributions as "dark money."

"Leading some to describe"? It was dark money! The groups did not disclose who the donors were when they spent millions and millions of that dark money to try and fraudulently effect election outcomes in the state!

It was all money laundered through Koch Brothers front groups, as the SacBee failed to note for some reason, but as the Mercury News reported last year when the scheme finally came to light...
