House Labor and Education Committee Votes to Permit States to Adopt More Progressive Health Plans...

On Friday the House Labor and Education Committee voted 27 - 19 to adopt an amendment offered by Rep. Dennis Kucinich (D-OH) to HR 3200 [PDF], the hybrid "public option" health care legislation that leaves in place the current multi-payer system. The Kucinich amendment was supported by 13 of the Committee's Republicans. It was opposed by the Committee's chairman, George Miller (D-CA). If it survives a House floor vote and a House/Senate Conference Committee, the Kucinich amendment would insure that efforts to secure single-payer systems at the state level would not be preempted by federal law.

As explained by Donna Smith, co-chair of Progressive Democrats of America's "Healthcare NOT Warfare" campaign during a July 15, 2009 conference call [audio] amongst single-payer activists, the Kucinich amendment does not reflect an abandonment of the effort to enact the national single-payer system embodied in HR 676 [PDF]. As Smith sees it, the right to basic health care is a civil right, and like the earlier civil rights movement, its advocates must be flexible, yet relentless in pressing various strategies to put an end to what I described in "Single-Payer and the 'Democracy Deficit'" as a corrupt, dysfunctional and deadly system which places the obscene wealth of the few over the health and very lives of our citizens.

The Kucinich amendment would permit single-payer advocates in the U.S. to pursue the same strategy used in Canada where a single-payer system was first adopted at the province level, eventually placing pressure on Canada's federal government to adopt a national health care system.

This, by no means, suggests that HR 3200 comes even close to representing meaningful reform...

Walter Cronkite, 1916 - 2009

On a personal note... Aside from the obvious reminder that Cronkite's death offers about what the news media were once --- but no more --- all about... I had a brief chance meeting with Cronkite years ago when, in the late 80's, I was working as an in-store demonstrator for a new board game over Christmas. He was shopping at the great flagship FAO Schwarz toy store on 5th Ave. in New York City.

Even then, some twenty years ago, he seemed surprisingly frail to me. Don't know whether it was because I'd only seen him on TV decades earlier or not. As I recall, I demo'd the game with him and beat him (I had quickly become an expert at the game for all of the hours I'd spent playing it with shoppers, even beating the inventor of the game when I'd met him one day). Cronkite, if I remember correctly, bought a couple of the games for his grandkids or nephews that day.

Not a particularly insightful story, other than for me, at that time in my life, I felt as if I had been in the presence of greatness. It was certainly the highlight of my holidays that year. He will be missed. So will the once-great American news corp which he left, and which left all of us, too long ago.

Unsealed appellate court decision explains delay in corruption probe of Tom Feeney, but will indictments ever come?...

So whatever happened to that expected indictment of former Congressman Tom Feeney (R-FL) and alleged vote-rigging conspirator for, among other things, his 2003 Abramoff-funded junket to play golf in St. Andrews, Scotland?

The other two Congressman who took the trips with the disgraced, imprisoned Republican uber-lobbyist have been held, at least, partially to account (Rep. Bob Ney (R-OH) spent time in jail, Rep. Tom DeLay (R-TX) is still facing related indictments in Texas). Feeney ran a sad "apology" commercial --- five years later --- during his unsuccessful re-election bid in 2008, but since then has so-far escaped real accountability for that, and the many other allegations of corruption that helped see him listed as among Congress' "Most Corrupt" for four years running.

So what happened to Feeney's indictment? A D.C. Court of Appeals decision from February (as we reported at the time, when we also noted Feeney is now being repped by Karl Rove's criminal attorney) was finally unsealed last week likely explaining the answer --- at least for the delay of such an indictment...

So the DailyKos' Markos Moulitsas is scheduled to be on Bill Maher's Real Time tonight (which will be back on live again on HBO this evening).

Good. Hopefully Maher will push Kos hard to concede that President Barack Obama is not Progressive enough, is not bringing the change he'd promised, is failing to bring the accountability for the previous administration's blatant violations of the Rule of Law and the Constitution as the Democratic base and the majority of Americans had come to expect that he would.

If Maher presses Kos specifically, hard and loudly, on these points --- and he will have to --- I'd suspect Kos will agree with him. If he does, and makes such direct criticism of Obama heard in no uncertain terms, I suspect that might even catch Obama's attention, and further force him to ponder his current untenable stance on these matters and perhaps encourage him to begin to push back against the Rahm Emmanuels in the administration who are urging him down the easy "Clinton middle" instead

If anybody is in direct touch with Maher, or Kos, --- or even Obama --- please bring this opportunity to their attention. It starts with Maher. And, if anybody can do it, he can. It'd be a shame to see such an opportunity wasted.

UPDATE 7/18/09: Opportunity missed. Maher didn't push Obama or Kos. Kos didn't use the opportunity to push for more progressivism or accountability. Too bad. Maher's closing "New Rules" monologue was awesome, however. I'll try to get that posted here soon if possible.

Earlier this week I wrote about the ABC "News" chuckleheads, and their laff riot over the floated idea of a torture probe, "on the verge of" being announced by AG Eric Holder. They laughed and pooh-poohed the high-larious suggestion on last Sunday's Stephanopoulous.

And now MSNBC offers another egregious example of corporate media failure --- in this case, again, "inside the beltway" corporate media failure --- in their "coverage" of such a possible investigation/prosecution. Glenn Greenwald is, as usual, a must read here beginning this way on Wednesday...

NBC's Chuck Todd --- who, remember, is billed as a reporter covering the White House, not a pundit expressing opinions --- was on MSNBC's Morning Joe on Tuesday discussing reports that Eric Holder is likely to appoint a prosecutor to investigate Bush torture crimes. Needless to say, everyone agreed without question that investigations were a ridiculous distraction from what really matters and would be terribly unfair.

As I say, Greenwald's analysis of how far off the rails such insider "journalism" has now gone; how far from what the nation's Founders intended; how completely and utterly out of touch these guys actually seem to be from the public, is a must-read. So please do.

I do believe that every person has an equal opportunity to be a good and wise judge regardless of their background or life experiences." - Judge Sonia Sotomayor, July 14, 2009.

A fair reading of the full context of Judge Sotomayor's 2001 University of California remarks reveals that the above two statements are not inconsistent. In the first, Sotomayor was merely giving recognition to what cognitive science has long recognized --- that differences in culture, background, and experience create frames through which our minds process data, or as George Lakoff observes in Don't Think of an Elephant and in greater depth in Moral Politics: "Concepts are not things that can be changed by people telling us a fact. Frames are needed to make sense of the facts."

Sotomayor's personal history suggests a progressive world view, or what Lakoff refers to as the Nurturant Parent Model, which emphasizes concepts like empathy, fairness in opportunity and relativity.

Such concepts were put into stark contrast with those of her lead inquisitor in this week's Senate Judiciary Committee oversight hearings, where Sen. Jeff Sessions (R-AL) --- whose "checkered past" includes allegations of racism, a nearly-unprecedented rejection by a Republican-led Judiciary Committee for his appointment to the federal bench and a long track record of obsession with non-existent minority "voter fraud" --- led the ironic attack on her record...

Editorial on key national election reform bill egregiously misrepresented by both the 'Paper of Record' and the Democratic U.S. Congressman who authored it...

It's been nearly a month since the New York Times misinformed readers by describing NJ Democratic Congressman Rush Holt's national election reform bill (H.R. 2894) by inaccurately writing that it "would require paper ballots to be used for every vote cast in November 2010."

As it's currently written, it will do no such thing. It won't be until 2014 that a paper ballot for "every vote cast" will be required.

Election integrity expert Ellen Theisen, of VotersUnite.org (who had previously endorsed the bill, until withdrawing the group's endorsement after a different provision was amended prior to final introduction), told us earlier this month she believed the Times' assertion, in the unbylined editorial, was a "glaring inaccuracy" and a "complete misrepresentation of the bill."

Election attorney John Bonifaz, director of VoterAction.org, which has fervently endorsed this version of Holt's bill, later concurred, in response to a request for comment from The BRAD BLOG, that the Times was inaccurate in its representation of the bill.

While the Times has yet to take note, or issue a correction, Holt himself has responded to our concerns by somewhat re-writing the bullet-point on his website --- which had previously offered inaccurate language describing the bill almost identical to the Times' mischaracterization --- in order to somewhat more accurately describe what the bill actually does...

The Bureaucratic Euphemism of 'Extraordinary Rendition'...

Then the suspect is placed on a civilian transport to a third country where, let’s make no bones about it, they use torture. If you want a good interrogation, you send someone to Jordan. If you want them to be killed, you send them to Egypt or Syria. Either way, the US cannot be blamed as it is not doing the work." - Former CIA officer Robert Baer [PDF]

In Part I of this now-five part series, I took care to distinguish the post-9/11 application of torture techniques by the U.S. military from the role played by the CIA and demonstrated how the Bush/Cheney decision to torture predated the quasi-legal Justice Department memos. In Part II, I covered the CIA's dark beginnings, including links not only to former Nazi war criminals but to those Americans who provided financial support to Hitler's Germany, including the late Senator Prescott Bush, George W's paternal grandfather. I also demonstrated how academic studies, performed as part of the CIA's maniacal quest to crack the code of human consciousness, culminated in KUBARK, the CIA's 1963 torture manual. In Part III, I showed how the KUBARK torture techniques, applied by US-trained foreign surrogates, became an essential component of the covert dimension of a US-led corporate Empire --- a means for exerting control over populations resistant to the injustice of a system that values the obscene wealth of a few over the needs of the many.

I had intended this to be the final chapter of a Four-Part Special Series, but length, complexity and new revelations necessitate further division into Parts IV & V.

Here, I will explore the arrogant application of overseas surrogate torture through "extraordinary rendition." The direct application of KUBARK techniques to a "floating population" of "ghost detainees" at CIA black sites will be covered in Part V. In both segments, I will demonstrate how torture was applied not to protect the American people but to help produce doctored intelligence that would provide cover for imperial conquest. I will end with the disturbing yet still unresolved questions as to how many victims of the Bush/Cheney torture regime remain amongst "the disappeared;" how many of those victims are now deceased...

Corporate MSM minimize, serious journalist bloggers offer appropriate coverage, condemnation

Following up on Saturday's NEWSWEEK scoop that Attorney General Holder "may be on the verge of" appointing a prosecutor to investigate Bush/Cheney-era torture, Digby notes how the chuckling dinosaurs of ABC News' This Week with George Stephanopoulos on Sunday snickered their way through a discussion of prosecution for torture by the Bush/Cheney regime (in our name!) as if they were wise-cracking about any old political brouhaha from inside the Beltway. (Video/transcript here, courtesy of C&L.)

Note to Stephanopoulos: How about featuring some actual journalists and bloggers who've actually been covering this issue for months (years?) before you eventually come to wonder why your show has gone the way of all the dead trees in the newspaper publishing business. Greenwald, Scahill, Wheeler, Horton all come to mind. It might bring your show up to date...or at least, up to 2006 or so.

The serious folks out there, several mentioned above, took a look at Saturday's NEWSWEEK report with the grim sobriety and analytical acumen that it deserves, while in largely shabby followups Washington Post, New York Times, and Rupert Murdoch's Wall Street Journal all seem to float anonymously sourced trial balloons, averring the notion that only low-level rogue interrogators who exceeded the boundaries of the DoJ's illegal torture justification memos would be targeted by such an investigation.

On that point, while Glenn Greenwald charges such an approach would be arguably "worse than doing nothing," as it would "actually further subvert the rule of law rather than strengthen it," he also notes:

It's worth emphasizing here that all of these reports are preliminary and from anonymous DOJ sources, so it's a bit premature to get too worked up over a prosecution approach which Holder hasn't even announced yet. Still, given how many DOJ sources went to multiple newspapers at the same time to disclose Holder's plans, it seems clear that this was a coordinated, approved effort to disseminate Holder's intentions as a "trial balloon" to gauge public reaction.

Scott Horton's reporting counters the indications from anonymous sources in the increasingly obsolete WaPo, Times, and WSJ coverage which suggests focus on only low-level agents and contractors, rather than policy makers, by reporting that his sources at DoJ indicate just the opposite [emphasis ours]...

Just in from Senator Feingold (D-WI), on the weekend news, that "The Central Intelligence Agency withheld information about a secret counterterrorism program from Congress for eight years on direct orders from former Vice President Dick Cheney," according to CIA Director Leon Panetta...

"The failure to notify the congressional intelligence committees of the program prior to last month was a violation of the National Security Act and individuals who ordered that Congress be kept in the dark should be held accountable. I also have deep concerns about the program itself and have conveyed those concerns, along with a request for a thorough investigation, in a classified letter to the president."

Senator Feingold is a member of the Senate Intelligence Committee.
