As Congress fights over its promised $2 trillion "Phase III" relief bill in response to the coronavirus pandemic, we've got some dumb questions for our guest about it all on today's BradCast.

But first, some of the latest news from around the world and the nation. India announced a 21-day lockdown for all residents, including "a total ban on venturing out" of the house, according to President Narendra Modi on Tuesday. That lockdown for all of India's 1.3 billion citizens, in a nation with three of the world's 10 most densely populated cities, comes after just 469 identified cases of COVID-19 and 10 deaths there.

That is by way of contrast with New York, where its "only" 20 million residents are now facing more than 25,000 reported cases and at least 157 deaths, as the number of cases is now reportedly doubling every three days. The most infections are in New York City, which does not even make the list of the world's 10 mostly densely populated cities. The state's Gov. Andrew Cuomo on Tuesday is expressing growing frustration with the federal government, after they received just 400 ventilators in New York City, despite a need for as many as 30,000. They also estimate that as many as 140,000 hospital bed will be needed for virus patients, while only 53,000 are currently available. The state, the Governor says, has not "flattened the curve," which he describes as "actually increasing" despite the statewide stay-at-home order issued late last week.

At the same time, Donald Trump is attacking Cuomo for some reason or another, while lying about GM, Ford and Tesla "right now" making ventilators "FAST!". They are not and likely will not be doing so for a number of weeks or even months at earliest.

Nonetheless, on Tuesday, Trump suggested that by Easter (April 12), he hopes to roll back the current White House recommendations for social distancing in order to try and save the economy --- apparently no matter how many Americans he helps kill in the bargain. And it could be millions dead if he follows up with the action that he and Fox "News" have been suggesting and threatening of late, while the President of the United States continues to misleadingly argue that "we can't let the cure be worse than the problem." The "problem" for Trump, in this case, is not dead Americans. It's a tanking economy that he fears may harm his reelection chances.

But while Trump is busy lying and misleading in televised briefings and Fox interviews, Republicans and Democrats in Congress are trying to pass a record $2 trillion emergency relief package and claim they are close to reaching an agreement. That, after House Speaker Nancy Pelosi and House Democrats, frustrated with GOP intransigence on the Senate side on Monday night, released their own 1,400 page proposal called "The Take Responsibility for Workers & Families Act" which would pump hundreds of billions toward hospitals, health care workers and emergency medical coverage while expanding unemployment insurance, medicaid, food assistance programs, offering $500 billion in loans and grants to small businesses, help on some student loan debt, and immediate cash assistance to everyone in America.

We're joined today by The American Prospect's Executive Editor, longtime financial journalist DAVID DAYEN to explain the proposed bills and answer several "dumb questions" of mine about how the bailout programs might be structured to actually ensure help to individual Americans rather than corporate interests. One is my question about his thoughts on my own bipartisan stimulus proposal for a bailout that would let corporations keep the huge tax cuts they received in 2017 (stimulus that many of them have squandered) in exchange for the same amount of direct cash payments to individuals now and in the future, until such time as both can be stopped when the emergency is over.

Another question is whether all rent and mortgages can simply be paused until the crisis is over. Dayen tells me that is called "forbearance" and a version of it was actually included in the proposal Pelosi introduced last night. Whether it will remain in the Senate bill, of course, remains to be seen.

Dayen, who wrote an award-winning book on the 2008 financial meltdown, also offers a likely explanation for Trump's threatened plan to try and re-open the country for business after Easter, and whether the economic damage wrought by the current pandemic is likely to be even worse than the 2008 mortgage disaster.

With similar machines in critical states like Georgia, election experts are raising alarm. (As noted, I am liberally quoted throughout that one, but it is an excellent piece anyway!)

Finally, Desi Doyen joins us for the latest Green News Report in these grim times, with a few more "bright" lessons we can take from the coronavirus fallout around the globe, several ongoing and pending climate crisis-related disasters in African and the U.S. Midwest, and California's largest utility company pleading guilty to 84 counts of involuntary manslaughter. Trump team wraps up, Bolton reverberates, GOP lacks votes to block him; Smartphone app at Iowa Caucus; Internet election underway in Seattle...

On today's BradCast: The President's defense team wrapped up their Opening (and, they hope, Closing) Argument in the Senate Impeachment Trial of Donald J. Trump on Tuesday, even as we are now less than one week away from the official start of the 2020 Election season with worries about the integrity of the Iowa Caucuses, set for Monday night, February 3rd, now looming. [Audio link to show follows below.]

We break away momentarily, for the first half of today's program, from our ongoing coverage of the Impeachment Trial to cover some issues of concern for some, regarding the Iowa Caucuses and an arguably more troubling development regarding an election that is now underway in Washington state. First to Iowa, where Bernie Sanders is now said to have taken a slight lead, according to most of the recent polling in the Hawkeye State, over his nearest competitors, Joe Biden, Pete Buttigieg and Elizabeth Warren. At the same time, a number of listeners have written to express concerns about a smartphone app developed by the state Democratic Party to help report results quickly to Party headquarters on Caucus night.

We discuss the way Democrats caucus in Iowa, what this app --- developed by the state Party in secret --- is supposedly designed to do to assist in the otherwise-open Democratic caucus process, and the worries that some have about the possibility of this new app being hacked to report inaccurate caucus results on Monday night. (Misreporting of Caucus night results has caused problems in the past, at least for Republicans.)

Of far greater concern, however, is an election underway right now in the Seattle area where more than a million voters are eligible to cast their vote via the Internet for the first time on either a computer or smart phone. The first-of-its-kind online election will fill a vacancy on the board of the obscure King Conservation District, responsible for managing natural resources in King County, Washington. The online voting is being carried out in partnership between the County's Board of Elections and a nonprofit named Tusk Philanthropies, headed up by a venture capitalist and Democratic political strategist by the name of Bradley Tusk.

The landmark pilot election comes despite a years-long, nearly-unanimous consensus from cybsersecurity experts (we've interviewed tons of them over the years on The BradCast) that the Internet is nowhere near secure enough for public elections. It also comes in the wake of last Summer's bipartisan U.S. Senate Intelligence Committee's report finding all 50 states were targeted by Russia during the 2016 election, and the panel's recommendation that "States should resist pushes for online voting".

While she has no oversight of this particular election, Washington's top election official, Secretary of State Kim Wyman, a Republican, opposes the King County effort and hopes to roll back the use of electronic ballots in the state, charging (correctly!) that the Internet is "too risky for voting". Nonetheless, Tusk, King County Elections Director Julie Wise, and a Seattle company named Democracy Live are barreling ahead with this disturbing experiment that is set to further poison the all-too-quickly disappearing idea of publicly overseeable elections in the U.S.

You have been warned. Again.

Then, its back to impeachment today, at the end of Tuesday's brief, two-hour wrap up of the President's case in the Senate. Trump's attorneys argued largely that the President did nothing wrong, and even if he did, it's not impeachable, because the dispute boils down to little more than a "policy disagreement" between Democrats and the White House. Impeachment over such matters, Trump's bombastic TV/radio lawyer Jay Sekulow and White House Counsel Pat Cipollone argued, sets a dangerous precedent by lowering the bar on future Presidential impeachments.

But the biggest looming question over the U.S. Senate at the moment is whether four or more Republican Senators will agree to call for witnesses when they vote again on the matter later in the week, following two days of written questions for the attorneys on both side. The issue that has turned the Republicans' previous plans for a quick acquittal on its head is the reported bombshell claims by Trump's former National Security Advisor John Bolton, in the manuscript of his still-unpublished new book, that Trump did exactly what he is being accused of in the first of the two Articles of Impeachment. That Article charges Abuse of Power by Trump for withholding nearly $400 million in military assistance to Ukraine in order to force them to help Trump in his reelection bid by announcing an investigation of Joe Biden and other Democrats.

Bolton's explosive disclosure, first reported on Sunday night by the New York Times, has reverberated ever since, with Trump's former Chief of Staff, General John Kelly, asserting on Monday night that he believes Bolton and agrees he should be called in as a witness for the trial against his old boss. The shake-up also comes as a new national poll out on Tuesday afternoon from Quinnipiac finds that registered voters by an astounding margin of 75 to 20 percent, agree that witnesses should be allowed to testify. The tally includes nearly half of Republicans and an astonishing 75 percent of Independent voters. According to the new survey, more than half of those polled believe Trump "is not telling the truth about his actions involving Ukraine"; should "provide more details" about it; has "abused his power" in the matter; has "obstructed Congress" in the bargain; and that the "withholding of U.S. aid to Ukraine was not justified". All of which has left Republicans reeling in a panic to find the votes needed to block witnesses in the trial. But they're still trying, and will likely have until Friday to pull it off.

We've got a lot of news and notes of concern --- both good and bad --- about the 2020 elections on today's BradCast. [Audio link posted below.]

Among the many stories covered today...

  • Former Vice-President Joe Biden finally announces that he's getting into the crowded 2020 race for the Democratic Presidential nomination. His "stirring" announcement video takes on Donald Trump directly, in a way that other candidates have largely avoided to date. Whether that will be a winning strategy, of course, remains to be seen for the man many consider to be a front-runner at this early point in the contest;
  • Hillary Clinton pens a worthy op-ed in the Washington Post, with her personal recommendations on how to best take on the question of whether Trump should be impeached in the wake of damning findings of criminality by the President in Robert Mueller's Special Counsel report, as well as how best to work to protect the 2020 election from interference --- at least from foreign sources;
  • George Conway, the conservative attorney husband of White House senior adviser/Trump apologist Kellyanne Conway, once again wins Twitter by citing Clinton's oped to slam both the President and, by extension, his own dissembling wife. He also cites another article detailing yet another new international embarrassment courtesy of Trump, to help his new, apt moniker for the President, #DerangedDonald, trend on Twitter;
  • Big news out of Michigan breaking today as a three-judge federal court panel finds district maps created by GOP state legislators in 2011 to be unconstitutional partisan gerrymanders. The court has now ordered the state to redraw as many as 34 state legislative and Congressional districts and even hold a number of special state Senate elections under the new maps in 2020, rather than in 2022 as previously scheduled. Though a decade or so late, it's still very good news for Michigan voters, though Republicans plan to appeal in hopes of stalling until the U.S. Supreme Court comes down with their verdict on two other cases of similar partisan gerrymanders in North Carolina and Maryland this June;
  • The New York Times publishes a very disturbing --- if not surprising in the least --- exposé revealing that recently-fired DHS Secretary Kirstjen Nielsen was rebuffed, time and again, by Donald Trump and other senior White House officials, in her efforts to convene cabinet level meetings on a strategy to protect the 2020 election from cyber-manipulation by Russia and other foreign sources. The exceedingly insecure Trump, according to the report, sees any such efforts to harden defenses against the threat of cyber-intrusions by Russia as a way of casting doubt on the legitimacy of his 2016 victory...for some reason;
  • Finally, Desi Doyen joins us for the latest Green News Report, as the second monster cyclone in a month bears down on Mozambique (the one just weeks ago killed a thousand people and has resulted in an extraordinary humanitarian crisis --- this new one could be even worse), along with other troubling climate change news from around the globe as well as some encouraging news here at home as Los Angeles Mayor Eric Garcetti announces plans for the city's very own Green New Deal...

Guest: Tax policy expert Alexandra Thornton; Also: Great news for voters in MI! And, what exactly is Sen. Jeff Flake doing in Africa?...

On today's BradCast: Tax cuts by executive fiat? It may depend on what the definition of "cost" is. Republicans used to pretend to oppose "Imperial Presidencies" --- at least when the President in question was Barack Obama --- but, hey, things change. [Audio link to show is posted below.]

First up today, however, we begin with some good news for a change! The Michigan Supreme Court late on Tuesday, approved a wildly popular, non-partisan, grassroots anti-gerrymandering measure for this November's statewide ballot, after GOP opposition to the initiative. Michigan's Proposal 2 is just one of several encouraging election reforms that Michiganders will be able to vote for (or against) during this year's midterms. And, MI is just one of several states (along with Missouri, Utah, and Colorado) that will see citizen-driven initiatives to end the scourge of partisan redistricting on this year's ballot!

More good news: A U.S. court of appeals in California on Wednesday upheld a lower court ruling finding Donald Trump's executive order barring federal funds to so-called "sanctuary cities" as unconstitutional.

Then, several new studies find record corporate profits --- both before and after the Trump/GOP tax cuts to corporations and the wealthy late last year --- are being spent mostly on stock buybacks, rather than increased worker wages, as Republicans had pretended would be the case when they rammed last year's massive tax cuts through Congress. Those cuts have already raised the federal deficit above $1 trillion, rather than paying for themselves as promised.

At the same time, Trump's Dept. of Treasury is now said to be considering a controversial scheme to bypass Congress entirely in order to offer at least another $100 billion in tax cuts to the wealthiest Americans. We're joined today by ALEXANDRA THORNTON, former tax policy adviser to the U.S. Senate Finance Committee, now Senior Director of Tax Policy for Economic Policy at the Center for American Progress. She tells me: "We already have very low taxes on capital income, capital gains, and now they want to make it lower."

Thornton explains Treasury Secretary Steven Mnuchin's planned scheme that would reinterpret the word "cost" in the federal Revenue Act of 1918 in order to index the already very low tax rate on income earned via investment in stocks and real estate to inflation, and how doing so by executive branch fiat would most likely be unlawful. (At least the George W. Bush Administration found that to be the case when they considered a similar plan.)

"Here is this administration that's been talking about 'regulatory overreach' and wanting to get rid of all these regulations, and now they want to go beyond their authority to pass a regulation that gives this gigantic tax cut almost exclusively to the wealthy. It's incredibly hypocritical."

Thornton also debunks the long-held GOP "fairy tale" that tax cuts pay for themselves by growing the economy, rather than blowing holes in the national debt and deficit, and further helps explain why last year's tax cuts, as passed without any Democratic votes, may not be working quite as well as a campaign issue for Republicans before the midterms as they had hoped.

"This is all part of the conservative mantra that if we tax investment that'll slow down economic growth. There's really no evidence for that at all. Basically, what they say is that we need to cut taxes on any kind of income, and eventually that will mean that we'll be able to invest in more things in the economy which will make workers more productive, and when they become more productive their wages can go up and there will be more jobs. And it's a fairy tale. It's basically never happened. It doesn't work like that."

Finally today, Senate Majority Leader Mitch McConnell cancelled this year's August Senate recess in hopes of ramming through a bunch of Trump's federal judicial nominees and his pick for the U.S. Supreme Court, Brett Kavanaugh. His hope was to do so before Republicans potentially lose their slim majority in the U.S. Senate in the fall elections. But that plan may be facing an unexpected hurdle from Arizona's outgoing U.S. Senator Jeff Flake, who is currently in Africa observing the hand-counting of hand-marked paper ballots in Zimbabwe's historic election. He may not be returning to D.C. anytime soon, according to some Senate staffers, which could stymie the possibility of any nominees being voted out of the Senate Judiciary Committee (which is deadlocked at 10 to 10 without Flake's presence), and perhaps even prevent floor votes in a 49-49 Senate with both Flake and ailing fellow Arizona Senator John McCain both missing. Is Flake, who claims to be a Trump opponent (even while voting for most of his agenda anyway) finally taking some form of real action in response?...
