First, some very good news just in: The hearing for the protest to the results of last week's SC Democratic U.S. Senate primary will be streamed live on Thursday at 3pm ET via Live.VicRawl.com.

The protest will be heard by the Executive Board of the South Carolina Democratic Party to consider Judge Vic Rawl's protest to last week's bizarre election.

Second, I'm happy to say that I have finally been able to make contact with the campaign of former state legislator and Circuit Court Judge Vic Rawl. I had a somewhat lengthy conversation earlier today with his campaign manager Walter Ludwig, and continue to be happy to report that it seems they have a very good grasp of the issues at stake --- in relation to the horrific ES&S e-voting system --- in their challenge to the 100% unverifiable election of Alvin Greene in SC's recent Democratic U.S. Senate primary race.

As I noted last night, in discussing Rawl's interview yesterday on Fox, given the sharp learning curve for those unfamiliar with the complex issues involved with e-voting and Election Integrity, they've done an excellent job of getting up to speed, at least inasmuch as possible in the short time they've been forced to become "experts" on the topic.

That, of course, is just another pitfall of using insanely complicated rocket science instead of common sense and eyeballs to add one plus one plus one in our current electoral system. Most candidates with questions about their election results simply can't afford the resources and computer scientists and time needed for the forensic investigation of these systems --- that's if they're even allowed access to the often proprietary trade-secret hardware and software --- following an election and prior to the date by which they must file and argue a legal challenge. That, as opposed to simply examining paper ballots and chain of custody procedures, as would be the case with sane, paper ballot elections.

Ludwig seems to understand just how bad the voting system is that voters were forced to use in SC's recent election, the same system used in dozens of other states despite The BRAD BLOG's best efforts over the past six years to warn of the dangers.

"These machines are incredibly frail and subject to manipulation. They don't work very well." In short, Ludwig told me, "They're crap."...

Convicted high-ranking officials include a circuit court judge, county clerk and school superintendent

All eight defendants in Clay County, Kentucky's election fraud trial have been found guilty today by a federal jury. Six of those eight were high-ranking election officials, including the county clerk, a circuit judge and the school superintendent. The conspirators were charged with having manipulated federal elections in 2002, 2004 and 2006 by buying and selling votes and manipulating electronic voting machines.

According to AP, each of the now-convicted felons could face up to 20 years in prison for what prosecutors had described as a conspiracy to manipulate elections for decades in the rural, heavily Republican county.

In additional to federal racketeering, several of the defendants were also convicted of charges that included mail fraud, extortion and laundering money used to buy votes.

The BRAD BLOG has been following this story since the conspirators were originally arrested in March of last year, and as details of the election officials' manipulation of ES&S iVotronic touch-screen voting machines has emerged...

Republican official says she was asked to change party affiliation to serve as 'Democratic' precinct official...

Meanwhile, back in Clay County, Kentucky, where election officials (including the county clerk, a district court judge, and the school superintendent) were arrested last year, and are now on trial, accused of having "fix[ed] elections for decades," a "precinct worker testified...that top election officers in the county taught her how to change people's choices on voting machines to steal votes in the May 2006 primary." The vote stealing was accomplished on ES&S touch-screen electronic voting machines, without the knowledge of legitimate voters, after they'd left the booth thinking they had cast their votes.

The scheme also included Republicans changing their party registration to Democratic in order to serve as Democratic poll judges and officers on Election Day, as has been alleged elsewhere (for example, in Ohio in 2004)...

Republican Secretary of State defied federal election law

The Association of Community Organizations for Reform Now (ACORN) has won a substantive victory on behalf of the voters of Ohio --- perhaps hundreds of thousands of them --- via a court case filed in 2006, challenging a number of voter suppression tactics employed by the state's then Sec. of State, J. Kenneth Blackwell (R).

The victory may lead to the enfranchisement of "hundreds of thousands of voting-eligible low-income Ohioans" according to one of the attorneys involved in the case, yet it looks like Fox "News", Matt Drudge, and all of the other Rightwingers may have forgotten to post a thank you note to ACORN this week for their successful battle to strengthen the growth of democracy in the U.S....

An update to the reports of an e-voting 'virus,' and other failures, in New York's recent Special Election for the U.S. House...

John Conklin, the Director of Public Information for New York State's Board of Elections has now issued a statement in response to the Gouverneur Times' article by Nathan Barker last week, alleging a "VIRUS in the VOTING MACHINES" [caps in original headline] which, the paper says, "tainted the results" of the recent Special Election for the U.S. House in NY's 23rd Congressional district.

We responded to Barker's detailed article ourselves over the weekend at some length, noting both the accurate and inaccurate information and assertions included in the online publication's coverage.

Conklin's response has drawn two responses in turn from the Gouverneur Times, as the right-leaning publication appears to have joined in the fight for election integrity, at least on behalf of their favored Conservative Party candidate whose apparent election loss has indeed been "tainted" by the very same concerns about which The BRAD BLOG has been warning for years. We're happy to see their new-found concerns, even as Republican partisans in political alignment with the Times have been ignoring and/or disparaging similar reports for years following elections in which Democrats have been the apparent victims of similarly failed voting systems...

Narrowing margin in post-election canvass raises hopes for GOP/Conservatives, but recent Republican-set precedent may well dash that hope...

A potentially interesting situation is underway in New York's 23rd Congressional district where post-election canvassing of the recent Special Election for the U.S. House is still underway.

According to Syracuse's Post-Standard, the post-election canvass shows the race between Conservative Party candidate Doug Hoffman, who conceded on Election Night, and Democratic candidate Bill Owens, who was sworn in as the district's new U.S. Congressman last Friday, to be tightening as results are double-checked, errors are being found, and a few thousand absentee ballots are still uncounted.

The race, regarded by many as a a bellwether contest before next year's full Congressional elections, appeared to have swung in the Democrat's favor on Election Night, following the suspension of the campaign of Republican candidate Dede Scozzafava who threw her support to Owens after she'd dropped out just days prior to the election.

On Election Night, Owens was reported to be the "winner" by just over 5,000 votes, with 93 percent of the votes tallied, leading to Hoffman's concession. Since then, various errors have been discovered in at least two different counties, resulting in a gain of some 2,000 votes for the Conservative Party's Hoffman, bringing the latest tally to 66,698 to 63,672. Closer, now a 3,000 vote margin, but still favoring Rep. Owens.

There were, however, some 10,200 absentee ballots requested and distributed. And, as we understand New York's state election laws, none of them have yet been counted. Many of those ballots were purportedly cast when Scozzafava was still in the race. At that time, according to Hoffman's campaign at least, they might have had an edge in the then-three-way contest. So it's possible, though believed to be a long shot, that Hoffman could gain enough votes in absentees to eclipse Owens.

This scenario --- a Congressional candidate quickly sworn in, based on unofficial results shortly after a bellwether Special Election before all votes have been properly counted --- should be a familiar one to long-time readers of The BRAD BLOG. A very similar situation occurred in the 2006 race to replace the jailed Republican Rep. Randy "Duke" Cunningham in California's 50th Congressional district.

While Republicans who stood in support of the Conservative Party's Hoffman this year --- he was endorsed by the likes of Rush Limbaugh, Sarah Palin, Glenn Beck, Michelle Malkin and the Republican Party itself (only after Scozzafava was pressured to drop out) --- are finding some cause for optimism in the still-narrowing margin. Limbaugh certainly has, at least according to his breathless reporting of the goings-on in NY-23 on his show this morning.

But the legal maneuvering and judicial precedent that the then-Republican-led House pulled in the Summer of 2006, in order to keep votes from being counted in the CA-50 Special Election and, indeed, to keep the voters of California from even being able to contest their own election, should ensure that Hoffman can no longer, legally, take possession of the House seat via any challenge in New York --- even if he's eventually found to have received more votes than Owens!...

Declarations filed in former AL Governor's request for new trial, describe government prosecutors manipulating key testimony, pressuring former aide in exchange for lighter sentence

How it's even possible that former Alabama Governor Don Siegelman's bribery case and conviction has not long ago been dropped by the Dept. of Justice is beyond us. There is now so much evidence of clear conflicts of interest, overt partisan political prosecutorial targeting, failures to recuse by at least one conflicted prosecutor as well as the judge in the case, evidence withheld from the defense team, and now evidence of the coaching and strong-arming of witnesses in exchange for a lighter prison sentence and a promise to conceal embarrassing personal information, it all makes the prosecutorial misconduct in the case of former Alaska Senator Ted Stevens --- a Republican whose case was dropped by Obama's Justice Dept. shortly after they came to power --- look like jaywalking.

Official declarations filed along with a recent motion by Siegelman, requesting a new trial in light of the new evidence, reveal what seems just the tip of the iceberg of a flagrant and wholly inappropriate case of wide-spread prosecutorial misconduct. The allegations (with much evidence to back them up) paint a compelling picture of an illegally targeted political prosecution/witch-hunt carried out by Karl Rove and his Alabama-based Dept. of Justice cronies in an attempt to remove Alabama's most popular Democrat from the political grid all together.

The scheme worked, as Siegelman is currently fighting his conviction on appeal and --- now armed with new evidence gathered by the defense team of fellow defendant Richard Scrushy, the man alleged to have "bribed" Siegelman --- is calling for a completely new trial. The government is to answer Siegelman's motion next week, and the decision will be made by the same federal U.S. District Court judge, Mark E. Fuller, reported to have severe conflicts of interest in the entire case, including a specific "grudge" against Siegelman.

The new declarations, believed to be posted here publicly in full for the very first time ( PDF links follow below), reveal a startling case of inappropriate misconduct by federal investigators, as Siegelman's former aide Nick Bailey, the government's star witness against him, is revealed to have been "coached and cajoled and threatened," as Siegelman's late June motion for a new trial describes it, throughout some 70 interviews and phone calls. Bailey, the documents describe, was said to have been frightened for his life and facing a possible years-long sentence in federal prison, if he failed to testify precisely as investigators had required him to.

The investigators went so far as to require Bailey to write down his testimony after he had failed, time and again, to offer the same answers to prosecutors' questions during undisclosed interviews. Yet, evidence of that coaching was allegedly concealed from the defense, according to the new documents and testimony, in violation of federal law, and in what appears to directly parallel the precise reasons for the dismissal of the Stevens case in Alaska.

Siegelman tells The BRAD BLOG that after the years-long prosecution, this is the first time the information has come to light about coached witnesses, and undisclosed documentation of government interviews.

Star witness Bailey, who testified that he saw Siegelman in receipt of a $250,000 check alleged to have been a "bribe" from Scrushy --- a check that was actually dated several days later than the day Bailey testified he saw it in the hands of the Governor --- is said to have been so unable to remember the specific details prosecutors wanted him to testify to, that he was given written questions and instructions to write down his answers to practice for the actual trial. He was, according to the new documents, told quite specifically how to answer questions.

The hand-written notes from Bailey's attempts to memorize his testimony to the satisfaction of prosecutors is said, in the new affidavits, one from Baily himself, to have included a page in which he responded to the government's specific instructions by hand-writing "bullshit," in response, on one of the undisclosed pages.

A complete notebook of those hand-written documents and other records of interviews with Bailey was apparently never given to the defense teams in either the Siegelman case or in Scrushy's, who also filed a motion for a new trail in late June...

A Republican election official, one of six allegedly bi-partisan [ed note: see update below for more on that] Clay County, KY, Board of Elections officials arrested last March and charged with a long-term conspiracy to rig elections, buy votes, and manipulate vote-selections on electronic voting machines without the knowledge of voters, has asked to change his plea from not guilty to guilty, according to local news reports...

The attorney for Paul E. Bishop filed a motion Thursday seeking a hearing for him to plead guilty to one count of racketeering.

That charge alleges that members of the conspiracy used the county Board of Elections as a vehicle to corrupt voting between 2002 and 2007 so they could hold on to power and enrich themselves and others.

According to the indictment [PDF], Bishop was a Republican election judge at precincts in 2002 and 2004, and hosted meetings at his house where candidates pooled money to be used for buying votes. The latest report also notes that Bishop, and some of the other conspirators, even employed Rush Limbaugh's illicit drug of choice, OxyContin, as part of their scheme...

Results of hand-count examination of paper ballots from allegedly 'fixed' special election, announced this afternoon...

No evidence of manipulation was found in the results of a 2006 special election in Pima County, AZ, according to the state Attorney General's announcement given at a press conference this afternoon in Tucson.

Today, AG Terry Goddard announced the results of his findings from a paper-ballot hand count, held earlier this month in Phoenix as part of a criminal investigation into whether the results of the '06 election were manipulated by election officials. A multi-partisan coalition of election integrity advocates have long charged that the results of the 2006 Regional Transportation Authority (RTA) election may have been electronically tampered with via the county's Diebold optical-scan central tabulator system.

The criminal investigation was re-opened in July of 2008, following the filing of a sworn affidavit from a former county employee who claimed he was told by a Pima County Election Division computer operator that the election was "'fixed'...on the instructions of his bosses."

The BRAD BLOG was listening in on the press conference, via a weak cell phone connection, so it was difficult to get direct quotes from Goddard, but we did speak to a number of people who attended the presser to get details from them, and were able to listen to Goddard's appearance on local radio shortly afterwords...

State AG: 'These [Diebold] systems are very, very bad'...

The AP has finally noticed the long-sought criminal investigation ballot count of the 2006 Pima County (Tucson), AZ, special election. State Attorney General Terry Goddard's hand-count of the disputed Regional Transportation Authority (RTA) election was concluded, at least for now, in Phoenix on Wednesday. That's when AP filed its report on the matter that we've been covering here at The BRAD BLOG in a number of special reports and exclusives, in great detail, this week, last week, and for several years prior.

AP's coverage was fairly cursory (recent inside joke: AP didn't report who the AG's office had found to be the "leading vote-getter"), but it hit a few points worth noting, including one of the key take-aways from the entire, epic morality tale still playing out on behalf of the entire U.S., in Arizona:

Maricopa County election workers have been hand counting ballots from a 2006 Pima County transportation election to determine if the vote was rigged by tampering with optical-scan polling machines and turning “no” votes into “yes” votes.
...
What may be of even greater concern is the voting machines in Pima County, which includes Tucson, are similar to those used in 12 of Arizona’s 15 counties and in hundreds of jurisdictions across the country.

If it turns out the election was rigged by manipulating Diebold Elections Systems (now Premier Election Solutions Inc.) computer election programs, as some fear, it will show weaknesses in electronic balloting that could endanger the democratic process.

There you have it. That's why this story matters, and why it's far more than simply a "local story."

It also matters on a still-broader level because, even if the 2006 Tucson RTA election wasn't rigged --- and it's three years on, and nobody yet actually seems to know for certain --- due to the god-awful, privatized, untested, hackable, oft-failed, secret vote-counting machines we now use in our public elections, it's become virtually impossible to know if any elections counted on such machines were accurately tabulated.

AP notes that Goddard seems to finally be understanding that larger point, at least:

No matter which way the recount goes, state Attorney General Terry Goddard said he is convinced the equipment jeopardizes election integrity.

“These (Premier) systems are very, very bad,” Goddard said. “(They) are not state of the art in terms of security. They are not state of the art in terms of transparency.”

The Arizona Republic's Dennis Wagner pulled some details from AP's cursory coverage and augmented it substantially for more lengthy, detailed coverage filed on Wednesday as well, which we're happy to see and recommend.

In a related note: Tucson election integrity advocate John Brakey saw charges against him dismissed by a judge today, following his arrest ordered by Pima County election officials last year during a state-mandated, post-election hand-count --- a statutory mandate that likely would not have existed were it not for Brakey's advocacy for such post-election "audits."

The county's case against him was so bad Brakey wasn't even required to put on his own defense before the judge dismissed the case entirely after hearing the county's testimony. The recent criminal investigation hand count carried out by Goddard, and all of the issues discussed above, would also likely never have come to light in Arizona, had it not been for the tenacity, courage, and tireless determination of Brakey. Democratic attorney sends letter to state AG detailing new concerns about Tucson's long-contested 2006 special election
AG's office: Examination may end today, says will 'examine all evidence seized, including poll tapes'...

In a letter written to the Arizona Attorney General's office on Monday, as obtained by The BRAD BLOG, the attorney for the Pima County (Tucson) Democratic Party has expressed a concern that thousands of ballots from a disputed 2006 special election, which should be in the AG's possession, may instead be "missing".

"Many thousands of ballots that should be in the ballot boxes in your possession don't exist," attorney Bill Risner writes in the 3-page letter [PDF] to Donald E. Conrad, Chief Counsel of the Criminal Division at the office of state Attorney General Terry Goddard. The alarming allegations come as the second week of an extraordinary hand-count of paper ballots, part of a criminal investigation into the '06 election, continued in Phoenix on Monday.

A spokesperson from the Attorney General's office says she believes the count will be concluded on Wednesday, though that could change. It was originally scheduled to conclude last week.

The AG is conducting a criminal investigation into allegations that that election may have been electronically manipulated by election official insiders. The special election created Tucson's Regional Transportation Authority (RTA) in May of 2006, and funded it with a joint bond measure to the tune of $2 billion over ten years. The Pima Democratic Party had endorsed the two RTA ballots questions in the election, but they now question the legitimate success of the measures. They've been bringing court cases to access ballot materials, and have been demanding a hand-count of the ballots for a number of years. Similar RTA initiatives had failed in four previous elections before they were finally passed in 2006.

"If we are correct," Risner wrote in his Monday letter to the Attorney General's office, concerning the absence of as many as 19,000 paper ballots, as estimated by observers of the counting in Phoenix, "the question arises as to what happened to those ballots." The latest mystery adds still more fuel to the already high-stakes, long-sought hand-count, and raises new questions in the nearly three-years long investigation into the 2006 election results.

If the ballots are indeed missing, did they ever actually exist? Was the Diebold electronic ballot box stuffed? Have ballots been surreptitiously removed by someone for some reason? Or have observers miscalculated the number of ballots being examined? The AG's Press Secretary Anne Titus Hilby tells The BRAD BLOG she's aware of the allegations of missing ballots but could not speak to that point in any more detail "until the examination is concluded"...

AG-selected party observers barred from taking notes, or video-taping long-sought manual tabulation of paper ballots from disputed 2006 election...

We wrote late last week, in some detail, about Arizona AG Terry Goddard's long overdue hand-count of paper ballots from the dubious 2006 Regional Transportation Authority (RTA) bond special election in Pima County (Tucson). The count of all 120,821 paper ballots from the election begins today in Phoenix as part of a criminal investigation, following years of allegations and court cases, in which a trans-partisan group of Election Integrity advocates in Tucson have sought transparency and public oversight following indications that Diebold tabulator databases may have been manipulated by election insiders.

Goddard's restrictions on political party observers --- just one per party, selected by the AG, not by the parties themselves --- was the cause of criticism by all of the involved parties (Republican, Democratic, Libertarian, etc.). But a letter [PDF] late last week from the AG's office indicated, at least, that a live, eight-camera video feed would be available on the Internet.

"Eight cameras will stream live video of the examination proceedings to the internet courtesy of the Maricopa County Elections Department," the AG promised. And, as the count began this morning, that feed is now up and running here.

Unfortunately, unlike Minnesota's recent, very transparent hand-count of 2.9 million ballots from the state's still-contested U.S. Senate race, the video from the Maricopa County Ballot Tabulation Center (BTC) is all but worthless, as critics had previously worried, in determining if counts are being carried out accurately.

Here are screen shots from this morning, as counting began, from all eight camera-views --- only two of which show any actual counting at all, while six of them are focused on different areas in the Phoenix counting facility (click a photo to see the live streaming shot)...

And, then again, it may not...

The 400 previously rejected absentee ballots in the Coleman/Franken U.S. Senate race in Minnesota won't be the only ballots being carefully counted next week. Neither will the more than 5,000 being counted in the NY-20 U.S. House special election where (fewer than) 25 votes, out of 150,000 cast, currently separate the winner from the loser.

A hand count of thousands of paper ballots that could trump all of the above, at least in regards to national importance, will quietly occur next week in a highly-secured Maricopa County, AZ, facility, as part of a years-long criminal investigation. Ironically, coming as late as it does, three years after the election, the results of the count, no matter what they may be, will not affect the actual outcome of that election --- even if it is found that the results were originally rigged by elections officials.

After almost three years; hundreds of legal documents; scores of hours in courtrooms; precedent-setting legal findings forcing the public release of Diebold computer databases supposedly recording how citizens voted in their own elections; allegations of potential hacking and fraud believed to have been possibly carried out by election official insiders; indications of tampering described as the result of "human error" by a report commissioned by the state AG, as part of a criminal investigation subsequently described by critics as a "whitewash"; arrests of local election integrity advocates; and lord knows how many articles documenting it at all here at The BRAD BLOG over those years, the paper ballots from the curious 2006 Regional Transit Authority (RTA) election in Pima County (Tucson), AZ, will finally be counted, beginning next Monday, as part of a criminal investigation being carried out by the state's Attorney General.

The hand-count of all 120,821 ballots from that special election will be carried out not in Pima, but under the supervision of "certified professionals who work for the Maricopa County (Phoenix) Elections Department," according to a 2-page letter [PDF] sent by the AG's office to the chairman of the Democratic Party of Pima County. The "strictly-monitored" count will either settle, once and for all, the matter of whether that election was conducted fraudulently by election insiders manipulating the vulnerable electronic Diebold tabulation system --- or it won't...

Were the election officials who allegedly manipulated votes on e-voting machines in Clay County, KY, Republican or Democratic? And does it actually make any difference?...

Since I first covered the story of the arrest of election officials (including a circuit court judge, the county clerk, the school superintendent and other members of the county elections board) in Clay County, KY, for buying and selling votes, as well as manipulating votes on electronic voting machines without the knowledge of voters, folks have been asking about the political affiliation of the conspirators and whether they were working on behalf of any particular political party.

The subject came up, as well, while I was on the Mike Malloy Show last Friday discussing these arrests, as they had just come to light.

While the federal indictment [PDF] notes that a number of those involved in the cabal appear to be members of the local Democratic Party, the scheme also involved at least one conspirator who served as the Republican Party's polling place judge at one of the precincts. Clay County is also a heavily Republican county.

On this point, a commenter who wrote in to respond to last week's article, who claims to be "from Clay County" and to know "each of the people arrested," writes that "ALL of the eight arrested this week" were actually Republican. "They registered as Democrat and took leadership roles in the local party to control precinct officer seats, ensuring all officers at the precinct were hand picked." I can't yet confirm that fact, but that reader's comment is posted in full below, with another one from a Kentucky writer, as both contain some helpful background.

Of course, it could still very well be the case that the crooks were Democrats at work. Either way, from what I'm able to understand about the scheme so far, it seems that it was more about personal power and financial enrichment than anything else. If they were Democrats, they don't seem to have been particularly successful in affecting Democratic wins in their county, even though their scheme was "successful" enough to be repeated election after election and year after year. At the heart of their scheme, after all, was bribing money out of candidates in order to be placed on a "slate" that the cabal would then help to get elected.

As the commenter suggests, it could well be that these "Democratic" officials were only signed up as such in order to affect primary elections (in order to ensure the weakest possible "D" candidate, for example) or even in hopes of adversely affecting general elections as "Democrats," secretly working on behalf of the Republican Party.

I've been unable to learn the party affiliations, yet, of the candidates who paid to be on their "slate," which, once we learn that, could be somewhat instructive. Maybe. But until then, a major point that I'd to make in any case: I don't really care what their party affiliations were.
