On today's BradCast: The chaos continues...along with our efforts to try and bring common sense to the madness. [Audio link to today's show is posted below.]

Rates of COVID-19 infections are still getting worse, not better, in much of the country, particularly in rural areas and states not currently under statewide stay-at-home orders. At the same time, the President of the United States is citing those very areas as places that should be viewed as a model for ending stay-at-home restrictions as soon as the end of the month or earlier.

Georgia's Republican Gov. Brian Kemp, on Monday afternoon, announced plans to do exactly that, with theaters and restaurant set to be opened back up in the Peach State as soon as this coming Monday. According to medical experts, however, opening up the country without much more testing and contact tracing in place is a recipe for disaster, even as there appear to be no such plan in place, and testing remains vanishingly rare in much of the nation.

Meanwhile, the results of the first major antibody test in the nation on Friday, revealed that hundreds of thousands if not millions of more people may have actually contracted the virus without even realizing it. Nonetheless, Rightwingers, egged on by Fox "News" and Donald Trump and funded by the same Rightwing outfits that fomented the so-called "Tea Party" protests against Barack Obama years ago, have now been protesting against state closures in recent days around the country --- largely in states controlled by Democratic Governors. On Sunday, front-line healthworkers in Denver were forced to clash with protesters who told them, as the nurses stood up to the protesters cars in their masks and scrubs: "Go to China if you want communism!"

Amid all of this, we are somehow supposed to hold safe and inclusive elections this year, with more than 20 states set to hold primary elections in coming weeks (Ohio will hold its previously postponed primary next Tuesday) and all 50 set to hold the critical Presidential general election on November 3rd. Many Democrats and voting rights advocates are calling for Vote-by-Mail ballots to be sent to all registered voters without restrictions. Many Republicans around the country are going to extraordinary measures to make it harder, not easier, to vote during the pandemic.

In New Mexico last week, the state's Supreme Court rejected the proposal by all 27 County Election Directors and NM's Secretary of State to send absentee ballots to all registered voters. Republicans opposed the plan and the court split the difference by mandating that absentee ballot applications be sent to all registered voters instead.

SmartElections.us, a "non-partisan project dedicated to elevating the issue of election reform to an urgent national priority," recently released an open letter signed by more than 50 election integrity groups and voting rights advocates calling on restrictions to be included with any federal funding that may be offered to states to help them manage elections amid the pandemic. While some of the larger voting rights groups across the country are calling for as much as 4 or 5 billion dollars to be allocated by Congress to the states, Smart Elections' co-founder LULU FRIESDAT joins us today to remind us --- as does the group's letter to Congressional lawmakers --- about the disastrous consequences of the last time Congress appropriated nearly $4 billion for "upgrading" elections

That was the Help America Vote Act (HAVA) of 2002, which allowed private electronic voting system vendors to swoop in and essentially privatize our public elections with voting systems that were vulnerable to manipulation and prone to failure. The group's open letter produced by Friesdat and the other election experts, calls for specific restrictions to be placed on the use of any federal funding sent to states and counties to help them move to more accessible absentee ballot-based elections this year, including requirements that allow for voters to be notified and cure ballots rejected by officials (for any of various reasons) and to make the request for absentee ballots easier for voters. At the same time, it also calls for restrictions that prevent the process from being opened up to potential fraud. In other words, they are calling for sensible processes that allow more access for voters without procedures that allow for easy voter fraud or that hand over hundreds of millions to private companies to further bar public oversight of elections.

The letter is a common sense reaction to the chaos that is currently underway...even if common sense and measured responses are not normally what one expects from talk radio and cable news in the middle of highly-partisan election made even more chaotic due to a deadly global pandemic.

Finally, today, we open the phones to listeners --- many of whom in our Southern California listening area, have been following stay-at-home orders as long or longer than most in the rest of the country --- to see how they're doing, and if they agree that it's time to open the country back up for business....no matter how many Americans will end up being unnecessarily killed in the bargain...

Today, we devote the bulk of The BradCast to HBO's new documentary film, released just last week and considered important enough that the premium cable channel is now making it available, for free, through May 25th on their YouTube channel right here. (You can also watch a number of clips, teasers and extras from the film here.) [Audio link to today's full program is posted below.]

The new film is called Kill Chain: The Cyber War on America's Elections and it comes from the team who created the landmark, Emmy-nominated 2006 HBO doc Hacking Democracy.

The climax of that earlier film (you can watch just that key scene right here) featured the first known on camera hack of a Diebold optical-scan vote tabulation system, which changed the results of a mock election in which one question was asked on the ballot: "Can Diebold's optical-scan vote tabulators be hacked?" The votes, as we see them cast in the film on hand-marked paper ballots by Election Integrity advocates including Bev Harris of Black Box Voting in the office of then Leon County, Florida Supervisor of Elections Ion Sancho, are clearly 6 'NO' and 2 'YES'. But when the paper ballots are run through the tabulator, the results reported back by the computer are 1 'NO' and 7 'YES'. The tabulator had been hacked and only a hand-count of the hand-marked paper ballots would ever have revealed that it was, had it happened in an actual election. (Needless to say, almost no paper ballots are hand-counted by humans after elections in the U.S., including the 2016 Presidential election, to assure the computers are reported accurate results.)

The manipulation of the system at the time was carried out by legendary Finish cybersecurity and voting system expert Harri Hursti, who is the central character in this new follow-up film. It follows Hursti as he uncovers new and persistent revelations proving that U.S. elections remain far more vulnerable than many realize, and arguably no safer or more secure from manipulation --- by foreign or domestic actors --- than they were during the making of the 2006 film or even since the 2016 Presidential election. (Yes, the same optical-scanners hacked in the 2006 film are still in use in states around the country in 2020!) All of that, despite assurances from the U.S. Intelligence Community and bipartisan U.S. Senate Intelligence Committee that Russia attempted to access elections systems in all 50 states in 2016 --- when Donald Trump is said to have won by a razor thin margin in three states that hadn't voted for a Republican candidate in decades. Those same institutions continue to warn us that Russia plans to do the same in 2020, though as the film shows, it does not take a nation-state in order to do so.

We're joined for today's special edition of The BradCast by SIMON ARDIZZONE and RUSSELL MICHAELS, the British directors of both 2006's Hacking Democracy as well as, with Sarah Teale, the follow-up Kill Chain out this week from HBO. We share a number of clips from the new film, which features at its climax a chilling interview with a foreign hacker, shot in silhouette, who explains that, before the 2016 election, he was able to take complete control of Alaska's entire election system --- from its online voter registration database to its vote tabulation system. The hacker, who goes by the name 'CyberZeist', claims he was able to gain access to every user name and password on the system and obtain root access to change anything he might have wanted to. "I could have made any changes in the system, like deleting the candidates. I could kick anyone out. I could alter any date, any vote." he claims. "It was such a rush that, at that particular moment, I felt like I was the God."

Ardizzone and Michaels offer insight on CyberZeist and why they believe his allegations to be very credible. But there are many other disturbing allegations and evidence to support them presented before that point in the movie, including Ion Sancho's reflections and continuing concerns 16 years after the first film, as he reports on the mandatory secret meeting that all Florida election supervisors were summoned to after the 2016 election, regarding a hack of VR Systems, the contractor which runs the voter registration system in the Sunshine State and others as well. That is the company --- and the spearfishing operation --- described in documents leaked to media in 2017 by DHS whistleblower Reality Winner, who is still serving 5 years in federal prison for having done so.

We also witness disturbing evidence of chicanery in the 2018 Gubernatorial election in Georgia, which was overseen by its eventual "winner" Brian Kemp. He served as Secretary of State at the time, responsible for programming the state's unverifiable touchscreen voting systems and creating the electronic access cards needed to vote on it. The filmmakers were there and had their cameras rolling on Election Day in 2018 when those voter access cards failed, leading to hours-long lines to vote in one of the state's most Democratic-leaning counties. Kemp would eventually be named the winner of the election by little more than 1% over popular Democratic candidate Stacey Abrams.

Longtime BRAD BLOG readers and BradCast listeners are likely to recognize a number of the featured players in the film, as many of them have been repeated guests on the program over the years. Ardizonne and Michaels share a number of insights on the making of the film today, such as why it took 14 years to follow-up the previous one and the mysteriously huge interest in the original online just before the 2016 election; they offer additional details on several disturbing discoveries made by hackers at DefCon's Voting Village in Las Vegas; they discuss how the private voting system vendors responded to invitations from the filmmakers to tell their sides of the story in the movie; what the reaction has been from law enforcement officials to CyberZeist's revelations since the film's premier last week; whether they believe the 2016 election results were legitimate; whether a move to Vote-by-Mail during the coronavirus crisis will help avoid any of these problems in 2020; and why the film is titled Kill Chain.

"We, actually, in a way, didn't want to make [Kill Chain," Ardizzone tells me. "The reason we made it was because we noticed a really sudden uptick in the number of people who were watching Hacking Democracy online. And a lot of our contacts started to get back in touch with us, saying, 'You know, even though you made that film, the problems are still there, and they're kind of worse now.' And this was before the elections in November 2016."

"I believe, to this day, no individual voting machines [from 2016] have been subpoenaed, sequestered and cyber-investigated by the Department of Homeland Security," Michaels says. "The scientists are screaming out, saying this is completely insecure, you must stop doing it. As far as I'm aware, no one is going to stop doing it in 2020. It's still going full steam ahead."

Of course, there is much much more. I believe you'll want to tune in for this conversation today.

Finally, we close today with a bit of listener mail regarding the ongoing and upcoming election disaster now underway in Wisconsin which is still set to hold its Presidential Primary this Tuesday. That, despite the global coronavirus pandemic, a statewide stay-at-home order issued by the Governor, a lack of poll workers willing to risk death by working the polls, and a flood of absentee ballot requests and incoming mail ballots that officials are finding impossible to keep up with given their current lack of resources.

If any bad guys out there were hoping to cause havoc and chaos in the American electoral system, well mission accomplished! Hopefully it won't result in too many people actually dying in Wisconsin, where the state's Republican-controlled legislature has repeatedly refused the Democratic Governor's pleas to postpone the election or change it to an all Vote-by-Mail election...

On today's BradCast: We've got a boatload of news and more listener calls from the Coronaverse today, as Republicans continue to try and game this year's elections, even amid a global pandemic. (Priorities, ya know!) [Audio for today's show is posted below.]

We start with a quick review of some of the news from over the weekend, as Trump finally gave up the ghost on his idiotic threat of reopening the country on Easter (April 12), even though has no authority to reopen something that he hasn't closed in the first place. Instead, it appears he's finally heard the advice from his medical experts such as Dr. Anthony Fauci and Dr. Deborah Birx that 100,000 to 200,000 Americans will die even "if we do things almost perfectly" and shut everything down (which we haven't yet in many places, though a number of additional states, under pressure, finally issued stay-at-home orders on Monday, including Arizona, Maryland and Virginia.) So Trump has reluctantly extended "federal guidance" to call for social distancing through the end of April for now.

But, there are a few glimpses of potentially good news --- as thin as the threads may be --- coming from South Korea, Seattle and California today, if otherwise grim case numbers and death continue to increase across the country and world. That "good news" finds that yes, social distancing does appear to be working. At least for now.

All of which underscores that this is likely to go on much longer than officials are currently making clear, or have any really plans for, particularly with absolutely nobody --- nobody --- steering the ship at the national level.

And, in turn, that underscores the importance of this year's Presidential election, as if Trump's appearance on Fox "News" this morning saying the quiet parts out loud didn't already give the game away. In complaining about the $4 billion that Democrats had hoped to include for improved security for running elections during a global pandemic in last week's $2.2 trillion stimulus/corporate bailout package, Trump told Fox: "They had things, levels of voting that if you ever agreed to it you'd never have a Republican elected in this country again." Well, there ya go. He just said out loud that if everyone was allowed to vote in this country, Republicans would be in big, big trouble. He gets something right every now and again, but its usually the things that he's not supposed to be saying.

New York, with the most concentrated health emergency and most cases in the nation right now, has finally postponed its planned April 28 Presidential primary to June 23. But, as Wisconsin Republicans are cool with the state's plan to hold its election next week (April 7!), and as Georgia's Republican Sec. of State has come up with a scheme to pretend to be doing the right thing by sending absentee ballot applications to "active" voters (not all voters, just ones he deems as active), Ohio's GOP legislature and Governor aren't even trying to hide their contempt for democracy.

Despite OH's Republican Sec. of State Frank LaRose stating clearly that "No date before June 2nd is logistically possible" to hold Ohio's rescheduled primary, the Republican-controlled legislature passed a bill last week to hold it a month earlier on April 28. Moreover, LaRose's suggestion to send a postage-paid absentee ballot application to all registered voters was also ignored. Instead, the legislation --- now signed by Governor Mike DeWine --- requires the Sec. of State to send a postcard to every voter letting them know how to get an absentee application themselves (and, unconstitutionally, find postage needed to mail it back in.) Furthermore, all of that has to happen, plus ballots must get to those voters with time to send it back postmarked by April 27. Good luck Ohio voters! It wouldn't be an election year with a voting disaster in the Buckeye State! That, even after the Republican Sec. of State has already stated that plan is not "logistically possible"! In short, Ohio is demonstrating to the country how NOT to reschedule elections during a pandemic...unless your actually hope, like the President's, is to keep "levels of voting" as low as possible in hopes of helping Republicans win elections. Voting Rights groups in Ohio: Start your lawsuits!

Finally, we open up the phones to stay-at-homers to say hello and for any good news stories they may have to offer. We find a "Mad, Mad, Mad, Mad World" instead, a bit of good news, and some much less than good news. But we hope you find it to be a good show nonetheless, to help keep you company at home while become a smarter world citizen in the bargain...

On today's BradCast: With the frantic, if justifiable, move towards Vote-by-Mail in the midst of the coronavirus pandemic, one shouldn't underestimate the GOP scheming going on right now to figure out how to make sure that their efforts at vote suppression can continue none the less. [Audio link to show follows below.]

That's especially true since broad Vote-by-Mail programs are likely to increase Democratic "turnout" in many, if not most jurisdictions. (That, even as many Democrats, for their part, are underestimating the amount of fraud that can happen with broad Vote-by-Mail programs if safeguards are not carefully instituted. Such precautions are easy, given the rushed deadlines and lack of needed funding and manpower in most jurisdictions right now.)

Our elections this year are most definitely in peril. Even as many states have now rescheduled primaries, optimistically, until June 2nd. Georgia has rescheduled its primaries for May 19 (the date which was originally scheduled to hold Kentucky's primary as well, though they have smartly pushed theirs further down the road).

Perhaps most troubling of all at the moment, Wisconsin will hold primaries and a state Supreme Court election on April 7! That just over a week and a half from today, despite the Governor having shut down all non-essential businesses and ordering residents to stay-at-home through at least April 24! Election officials in several Badger State jurisdictions are complaining they will be unable to find enough pollworkers (resulting in much longer --- and dangerous --- lines); at least one major city is suing, declaring it "functionally impossible" to carry out the election while allowing voters and pollworkers to maintain necessary social distancing; and the County Clerk in for the state's capital (in one of the most Dem-leaning counties in the state) is seeing voters threatened with legal challenges if they follow his advice to declare themselves "indefinitely confined" in order to request an absentee ballot online without uploading a Photo ID, which many seniors are finding difficulty to do.

Nonetheless, the state's Democratic Governor is allowing the April 7 elections to move forward, and the Republicans in the state legislator --- who would be needed to take action in order to postpone it or change it to an all-VBM election --- are applauding the Governor. Now why would they do that?

In Georgia, meanwhile, don't be fooled by the Republican Sec. of State's lofty, high-minded explanation for mailing an absentee application to every "active" voter in the state. While that might otherwise be a very good thing, what about all of those voters who are still registered and eligible to vote this year, even if they have been marked "inactive" by the same Secretary of State?

None of this is particularly encouraging. Though neither is the fact that a record 3.28 million Americans filed for unemployment benefits this past week, shattering the decades-old record of 695,000, with likely many more who were not able to file this past week because state websites and phone systems were overwhelmed, crashing and freezing up.

But, don't worry. Treasury Secretary Steven Mnuchin says the quintupling of the all-time weekly unemployment record is "not relevant", thanks to the emergency stimulus bill passed by the Senate 96 to 0 on Wednesday night and now waiting for passage in the House, most likely on Friday. Of course, it's not only Mnuchin misleading Americans on behalf of the Trump Administration, the New York Times did a pretty good job of it as well recently.

All of which should serve as a reminder of the importance of supporting independent local journalism, with alt-weeklies dropping like flies (with no ad revenue to support them since restaurants, theaters, concerts, and other social gatherings are mostly shut down), even as their online readership is way up during the crisis, and local, non-commercial, listener-supported radio stations also having a similarly difficult time keeping their transmitters humming during this pandemic.

We discuss all of that and more today, before closing with Desi Doyen's latest Green News Report, which, along with some good and bad news on the stimulus bill and some bad news about the Trump Administration's continuing rollback of public safety regulations even during the crisis, actually includes some bona fide good news from a federal court regarding the Standing Rock Sioux Tribe's ongoing battle against the Dakota Access Pipeline...

After a glitchy start with a skeleton crew at KFPK in Los Angeles, today's BradCast was a reminder, for me at least, of why radio over our public airwaves is so essential, especially now. [Audio link to show is posted below.]

After a few news headlines on the latest from our horrifying global pandemic --- more state Governors, thankfully, issuing "stay-at-home" orders; more coronavirus cases and deaths in the U.S. and around the world; more screwups from our imbecilic President regarding his "great friends" in Congress who have now contracted COVID-19; more fights in Congress about a $1.8 trillion relief package meant to save the economy and the American people (or, if left to the Republicans, to save Donald Trump and their favored companies, unless Dems continue to hold strong and not fall for another bailout con); and my own suggested Bipartisan Stimulus Relief Plan (the one that should be adopted immediately) --- we open the phones to callers who have been enduring "stay-at-home" orders now for days in California, as well as elsewhere around the country.

I thought today would be a good moment to touch base with folks to see how everyone is doing, how they are holding up in these circumstances. Right now, radio and radio stations are considered an essential service as part of our federal Critical Communications Infrastructure (a designation we take seriously.) So we hope to stay on the air as long as possible, with as much live radio as we can.

Today's callers help underscore why I believe that's so important. Among the many great calls today:

• The 80-year old from L.A. who lives alone with his dogs and is having trouble getting food for them;
• The blind caller from Lake Elsinore who is "terrified";
• The caller from Minneapolis who felt he has never had to lock his doors at night, until now;
• The millennial (and former associate producer of our show!) who reports that few in Atlanta outside her window seem to be following the Democratic Mayor's "stay-at-home" order, as the state's wingnut Republican Governor refuses to issue one;
• The woman who believes we should call it the "Stable Genius Virus";
• And many others, including the last caller of the day who....well, we'll let you listen, but it's a bit heartbreaking, and I wish I could have said more, though the show was ending and I had few words to help, I fear...

Hopefully, we can all come together with love at this difficult and extraordinary moment of necessary physical distancing, as opposed to social distancing... And thank you for taking the time to join us for The BradCast during this unprecedented time in history...

On today's BradCast: America continues to adjust to the pandemic, as the most critical election in our nation's history is now threatened by a virus, even as voters in three major states hit the polls on Tuesday. At least some of them did. [Audio link to show is posted at end of summary.]

We begin another bizarre day in the Coronavirus Era with just a spot of good news. California's wildly corrupt GOP Congressman Duncan Hunter, Jr., who, with his wife, was charged with more than 60 felonies, but pleaded guilty to just one in a deal last December after it became clear his wife would testify against him, was sentenced to 11 months in prison today. The couple had stolen as much as a quarter of a million dollars in campaign funds for personal luxuries during Hunter's six elected terms before he finally resigned in disgrace in January. He, along with New York's GOP Congressman Chris Collins (who was recently sentenced to 26 months for insider trading), were the first two members of the U.S. House to endorse Donald Trump's run for the Presidency.

And with that somewhat good news out of the way, it's on to the more disturbing news we must try and make sense of today. Even as Florida, Illinois and Arizona all decided to hold their Presidential primary elections on Tuesday amid quarantines, closures, lock-downs and social distancing directives, other states continued to take more responsible measures.

Ohio, which was also scheduled to vote on Tuesday, postponed their primary election today amid no small amount of chaos, with the state's Governor taking extraordinary measures to do so late Monday night after initially being blocked by a state court.

Maryland's Governor today announced that his state would join others, such as Louisiana, Georgia and Kentucky in postponing their primary until June. It was previously scheduled for April 28. They will, however, still hold the April 28 Special Election to fill the U.S. House seat left vacant by the late Democratic Congressman Elijah Cummings in Baltimore. That election, however, will now be an all Vote-by-Mail (VBM) election. That as other states consider either postponing or changing to all-VBM elections for the foreseeable future during the virus outbreak.

The affects of the pandemic were seen in all three states which voted today, including poll closures, low turnout, and shortages of poll workers, many of whom are elderly and the most susceptible to the worst affects of the virus. Hundreds of them in South Florida, for example, decided to cancel at the last minute rather than be exposed to hundreds of people all day in crowded polling locations left open despite the CDC's recommendation to avoid all crowds larger than 10 at this time.

We're joined today by a guest well-accustomed to both chaos and elections. ION SANCHO is Leon County (Tallahassee), Florida's former longtime Supervisor of Elections as well as a champion voting rights advocate and opponent of private voting system vendors. During his nearly 30 years as one of the state's (and nation's) most respected election officials, he has held elections amid hurricane catastrophes and political ones. He was tapped by his fellow state officials in 2000 to oversee the eventually-aborted Presidential election recount between Al Gore and George W. Bush. Sancho has plenty of thoughts and insight to offer today amid the current chaos and challenges now faced by elections officials and voters alike. We discuss the likely necessity of all states moving to VBM elections for the duration of the crisis, and the steps that need to be taken to ensure such elections are carried out with integrity.

"The entire primary and elections process is going to have to be re-examined, given this crisis," he tell me. "This pandemic provides a challenge like no other in my lifetime. Mail ballots may be the way out of this, but mail ballots require machinery. Mail ballots require high-speed counting devices. It can be done, and it can be done excellently, but it can't be done cheaply. So if that's something we're going to need to go to, we're need to prepare for that." He warns that voters, many of whom do not bother to change their address on their registration when they move within a county, should check their registration record to assure it's up to date immediately, or else they risk not receiving a ballot at all, when and if states begin moving to VBM.

And while money will need to be spent to transition to high-speed optical-scanners to tally hand-marked mail-in paper ballots in many locations, the cost and benefits would still be far greater for voters than in jurisdictions such as Georgia which recently spent more than $100 million dollars for new equipment that will force all voters at the polls to vote on new, germy, unverifiable, touchscreen voting systems which violate voters' privacy by revealing secret ballots to everyone in the polling place. "The COVID-19 virus may be a blessing in disguise for the citizens of Georgia," Sancho explains. "Using a hand-marked paper ballot system is not only more secure, it's three to ten times more inexpensive to operate and maintain."

But in addition to money, guidance will be needed on the federal level to ensure a move to mail-in voting is done in a way that doesn't disenfranchise voters, since, he explains, it is so much easier for VBM ballots to be rejected by officials for dubious reasons and without notifying voters so that they have sufficient time to cure any perceived deficiencies on their ballots. VBM would be a "fair solution [during this crisis] if you have fair elections administration. Jurisdictions like Oregon, for example, which has pioneered mail voting in the United States, provide 14 days for an individual to present themselves to cure a problem, a deficiency, in the mail ballot. States like Arizona, Washington and California provide 2-3 weeks of days to allow the voter to cure a problem. Then you run into states like Florida, that had to be sued to allow voters to cure their ballot after the election. The deadline for Florida to cure all deficiencies --- so how could you know about it? --- is the day before the election."

While some elections officials, he believes, would be careful to institute best practices, others, he warns, would not. "They don't concern themselves with how actual machinery is working in other places. They just depend upon their voting vendor to tell them what to do. We don't really have any kind of mechanism nationally to provide the best practices, to give guidance. Our national elections administration is a debacle," he says, along with much more that you'll want to hear.

Finally, Desi Doyen joins us for the latest Green News Report, as the coronavirus epidemic has now cleared the air in both China and Italy, at least as far as toxic greenhouse gas emissions go, and has given Donald Trump yet another excuse to try and shore up the oil industry amid crashing prices. And, though much of it has now been lost to time and the global pandemic, we also examine the substantive debate on Sunday night between Democratic Presidential candidates Joe Biden and Bernie Sanders regarding our climate crisis...

To quote Donald Trump when he thought the cameras had stopped rolling after his disastrous Oval Office address last week: "Oooookaaay...." So, we are now living in a new world. For the time being. Millions are being instructed to stay home from work. Markets are tanking. Major states and cities are shutting down schools, restaurants, bars, clubs, theaters and casinos. Some are instituting full "stay at home" lock-down orders. And Congress is scrambling to pass emergency legislation to try and help displaced workers and families as the coronavirus crisis threatens to shut down the nation entirely for weeks, months or longer. All of this amidst a Presidential election under the most dangerously inept and dishonest Administration in the history of the nation.

On today's BradCast, we try to get you caught up with the unfolding, bizarre and disorienting mess that we are all going through together in hopes of "flattening the curve" of the rate of infections to try and ensure that the U.S. hospital system doesn't become overwhelmed with patients. Like you, we have no idea how this is supposed to work, but we're all working through it together, even as Trump literally told the nation's Governors today they are on their own in coming up with enough respirators and other medical equipment to keep their residents alive, and as he continues to lie to the country about the availability of testing and eventual arrival date of a vaccine (which is most likely more than a year from now, even as a single live test began today).

And, speaking of that Presidential election, states --- particularly those which are touchscreen-voting heavy, like Louisiana, Georgia and Ohio --- are beginning to announce postponements of their primary elections. Ohio's Governor has attempted to do so before tomorrow's planned election that was to be held along with Florida, Illinois and Arizona. But a state judge, late today (minutes ago, justt after we got off air) has now blocked the Republican Ohio Governor's attempt to postpone. So, full-on chaos for a change in the Buckeye State tonight. The other three big states (at least at this hour) are planning to go through with their own elections tomorrow, even as polling sites at senior citizen centers are requiring last-minute relocation and frequently-elderly poll workers are (justifiably) calling in to cancel.

Other states, such as New York are considering postponement, while Maryland considers moving to all-Vote-by-Mail primaries. More than a dozen states, such as Texas, do not even currently offer no-excuse absentee voting. That needs to change. [CORRECTION: I had initially cited Pennsylvania as one of those states that do not allow no-excuse absentee voting. In fact, no-excuse absentee voting was instituted late last year as part of a package of election reforms in the Keystone State. My apologies for the error!]

We cover all of that AND wave very briefly at Sunday's Presidential Debate (which we hope to revisit in a bit more detail soon - but we'll see) before opening the phones to check in with callers today, including one from Minneapolis who describes the situation there as dire, others from Southern California who wonder where the head of the CDC has disappeared to, and another who questions both the threat and infection numbers currently being reported. Six more states are voting today (Michigan, Washington, Missouri, Mississippi, Idaho, North Dakota). We'll have results tomorrow, as we're still trying to figure out who actually won and lost, in some cases, last week on Super Tuesday, particularly in Texas and California. Nonetheless, today, like last week, has already revealed more problems with electronic pollbooks that resulted in voters leaving without voting, and there is more likely trouble on the horizon in several states set to vote in the next several weeks. Among the stories covered on today's BradCast...

• A fire at Venezuela's National Electoral Council warehouse over the weekend has resulted in the destruction of 50,000 touchscreen voting machines and 582 computers. We swear we didn't do it! The unverifiable voting machines in question have been used during questionable past elections and are made by Venezuelan-based Smartmatic...the same company with a dodgy background of failed elections who also made the new touchscreen voting systems which failed so disastrously in Los Angeles County on Super Tuesday last week. But, again, we didn't do it!;

• Closer to home, voters today in St. Louis County --- Missouri's most populous --- were turned away from the polls for an hour or so this morning from at least 50 of the county's 400 polling places. Though St. Louis has finally moved to hand-marked paper ballots, they are using a print-on-demand system that uses electronic pollbooks (yes, more computers) to instruct the printers which ballot should be printed. Those e-pollbooks, apparently, were failing this morning until the company that makes them issued an update. In the meantime, there is also a manual print mode that pollworkers could have used to print ballots for voters when the e-pollbooks weren't working, but many appear to have not known that or just panicked and forgot. Also, in MO, Kansas City's African-American Mayor was turned away from the polls after his name was not found on the voting rolls. Later in the day, they figured out why;

• Both Bernie Sanders and Joe Biden cancelled campaign rallies set for Ohio today (where early voting has already begun for next week's primaries in the Buckeye State), due to coronavirus concerns, in what may foreshadow still more trouble for this year's elections, including how to include enough hand-sanitizer for polling places, especially those which use touchscreens. (People can usually bring their own pens to polling places that use hand-marked paper ballots.) We may end up seeing Vote-by-Mail elections for the entire country this November if the virus continues to spread, despite the steady leadership of stable genius Donald Trump;

• Some good news for voters (finally!) out of Georgia today, as the state has reached a settlement with the Democratic party in federal court that requires voters be immediately notified about absentee ballots that are rejected by county officials due to perceived signature mismatch or some other infirmity, allowing them time to come in and cure the problem so their votes may still be counted;

• But there is also less good news out of Georgia, where last week's "good news story out of Georgia" was the fact that Athens-Clarke County's Board of Elections had voted to ditch the new, state-mandated unverifiable touchscreen voting systems for hand-marked paper ballots instead. The Board found that the touchscreens on the new Dominion ImageCast ballot marking devices (BMDs) were so large and bright that they violate voters constitutionally-mandated right to a secret ballot, as others could see how they were voting from 30 feet across the room, according to a related lawsuit filed in a separate GA county. But now, GA's Republican Secretary of State Brad Raffensperger has called an emergency hearing in Athens, charging that the County's Board is violating state law by not using the new, unverifiable voting systems. Now why would he want do that?;

• Meanwhile, in Texas, ballot scans stored on 44 thumb-drives from the new Ballot Marking Device systems used for the first time during last week's Super Tuesday primaries in Dallas County apparently were not included in previously reported results. As many as 7,000 ballots could be missing from the current results. The County's Election Director was required to get permission from a court to "recount" the computer-marked ballots scanned in the county to include those previously left out of the count. A Dallas court, on Tuesday, gave permission to do so, but the order is limited to a computer-scan of the computer-marked paper ballots that were previously not included in last week's results;

• Finally, Desi Doyen joins us for our latest Green News Report, with news on the coronavirus and an oil price war, both affecting the stock market (and banks and fossil fuel-reliant communities) this week, a new troubling report on air pollution caused by fossil fuels, and some good news as New York state's disposable plastic bag ban finally kicks in...

On today's BradCast: Sad news for many regarding the end of Elizabeth Warren's run for the 2020 Democratic Presidential nomination. But we start with what suffices for good-ish news today regarding both voting and electoral politics, and one very mysterious Super Tuesday election result out of Texas. [Audio link to show is posted below.]

• First up, the Board of Elections of Georgia's Athens-Clarke County, where early voting has already begun for the state's March 24 Primaries, has voted to ditch their new touchscreen voting systems to move to a hand-marked paper ballot system. The move is in defiance of the state's Republican Sec. of State Brad Raffensperger, who has ordered the use of new, 100% unverifiable touchscreen voting machines across the entire state, after the County's Board determined that the huge screens on the new Dominion ImageCast systems, said to be visible from 30 or 40 feet away, violate voter's right to a secret ballot under state law. (We interviewed Marilyn Marks of the Coalition for Good Governance, the plaintiff in an emergency lawsuit to move to hand-marked paper ballots in another Georgia county for the exact same reasons, last week.);

• More good-ish news out of Montana, where the state's popular Democratic Governor Steve Bullock is reportedly considering reversing his earlier vows that he would not run for U.S. Senate this November against Republican incumbent Sen. Steve Daines. The Governor, a former 2020 Democratic President candidate, won his statewide re-election in 2016 on the same ballot on which Donald Trump is said to have won the state of Montana by 20 points. If Bullock decides to enter the race by Monday's filing deadline, it might offer Democrats a shot at winning the fifth seat they would need to flip in order to retake a clear majority in the U.S. Senate next year. Dems have targeted four other U.S. Senate seats --- in Arizona, Colorado, Maine and North Carolina --- which they believe to be winnable in November, but would need a fifth seat if Alabama's Democratic Sen. Doug Jones is unable to hold on to his this year;

• The totally predictable fallout from Los Angeles County's disastrous Super Tuesday election continues today, after the County's new $300,000,000 unverifiable touchscreen voting systems and electronic pollbooks failed so spectacularly during their first countywide use in the March 3rd elections. Washington Post's coverage last night confirms that election workers in L.A. were, indeed, ordered not to speak to media (as I originally reported on Sunday, only to be called a liar on Twitter by the brainchild of the new, failed voting system, L.A. County Registrar-Recorder/County Clerk Dean Logan).

  But the biggest breaking news in the embarrassing meltdown that resulted in hours-long lines and disenfranchised voters on Tuesday is that CA's Democratic Sec. of State Alex Padilla --- who certified the new systems for use in January despite warnings from cybsersecurity and voting systems experts, and despite the system's more than 40 violations of California Voting Systems Standards --- has now directed L.A. to send hand-marked Vote-by-Mail ballots to every voter in the County for this November's critical Presidential election;

• And, in Houston --- which also saw hours long lines for voters during its primaries on Super Tuesday --- a mysterious, completely unknown candidate on the Democratic ballot has has helped force a run-off for one of the longest serving members of the Texas state House. Despite Natasha Ruiz receiving more than 20% of the vote on Harris County's 100% unverifiable voting systems, the other three candidates in the race say they have never seen Ruiz or found any evidence that she actually had a campaign. She placed third in the four person race, resulting in just 45% of the vote (less than the 50% required to avoid a run-off) for long-serving State Rep. Harold Dutton, who is now investigating whether Ruiz even exists;

• Finally, we're joined by the former Editor in Chief of Rewire.news, JODI JACOBSON, a devoted Elizabeth Warren supporter, who is mourning today's announced end of the crusading progressive Massachusetts Senator's once-very promising Presidential bid. We discuss what Warren did right and where her candidacy appears to have gone wrong, why Americans appear to have been afraid to vote for her, and whether Warren might be tapped with a Vice-Presidential nod on either a Joe Biden or Bernie Sanders ticket...

On today's BradCast: If you think the coronavirus is worrisome now, just wait until voters in jurisdictions where they are forced to vote on unverifiable --- and germy --- TOUCHSCREEN computers start putting two and two together before Election Day. Not that the election officials who insisted on such an idiotic idea ever gave much of a damn about their voters, as our guest today makes abundantly clear. [Audio link to show is posted below.]

First today, however, another sign that Republicans should almost certainly be in very big trouble this November. But, of course, that requires voters be able to vote in a way that the public can know their votes were tabulated as per voter intent (not possible on a touchscreen voting system of ANY type.) The trouble for the GOP could get even worse, however, depending on the Administration's handling of the expanding coronavirus crisis. That response does not seem to be going well, so far. The Dow plummeted another 1,200 points on Thursday, due to investor fears of a global pandemic, resulting in the sixth straight day of losses and the worst week for the markets since October, 2008 --- the height of that year's global financial crisis.

But Donald Trump is finally on the job! He surprised the man who had been in charge of the government's response to the epidemic, Health and Human Services Secretary Alex Azar, by announcing that Vice President Mike Pence would now be the Administration's point man on the matter. Azar was informed at the same time as the rest of us, when Trump announced the news at a press conference on Wednesday evening as Azar was standing next to him.

As to Pence having "a certain talent for this", as Trump announced at the presser, Pence's record as Indiana Governor in 2015, when he presided over the worst HIV outbreak in state history, strongly suggests otherwise. Still, as Desi Doyen joins us to point out today, none of this is reason to panic. It is reason, however, to take a few simple measures to keep you and your family safe, and Desi offers some helpful tips toward that goal.

All of this is also just one more reminder as to why this dangerous menace of an Administration must be replaced as soon as legally possible. To that end, there are reasons to be concerned about the integrity of several upcoming primary elections, not to mention this November's critical general election. Saturday's crucial South Carolina primary will require all state voters to use brand-new, 100% unverifiable touchscreens made by a company with a long history of election failures. The March 3rd Super Tuesday primary, just three days later, will see voters in California, Texas, and North Carolina, among other states, forced to use new, similarly unverifiable touchscreen voting systems for the first time.

Meanwhile, in the battleground state of Georgia, where a federal judge last year ordered the state's nearly twenty-year old, failed, unsecure Diebold touchscreen systems to be scrapped and replaced, the Republican Sec. of State has now mandated that every county use all-new, unverifiable touchscreens made by the Canadian firm, Dominion Voting, for the upcoming March 24 primaries in the Peach State. That, instead of a simpler, safer, cheaper, verifiable hand-marked paper ballot systems.

We're joined today for a long-overdue visit from MARILYN MARKS, Executive Director of the invaluable Coalition for Good Governance, the lead plaintiff in the federal case that resulted in the decertification of GA's old touchscreen systems. And we've got a LOT of NEWS to catch up on with her today! Her group is also suing in federal court to block the new systems as well and filed this week, in state court, to block their use in a runoff election on March 3rd, given that the huge, brightly-lit touchscreens, as Marks explains, violate voter privacy by allowing others, from all the way across the precinct, to see the "secret ballot" of every voter!

She says "the outrageous way people are being required to vote in Georgia" is "disgusting" and "insidious". The new lawsuit [PDF] notes the new touchscreens (pictured above) are 22 inches high and 14 inches across. "It's very, very brightly lit with incredibly huge fonts. You can see across the room --- from thirty feet away --- you can see what candidate someone is voting for. So there is absolutely no ballot secrecy at all. Anybody in the room, you can see their ballot choices. The press can see it, the public can see it, the pollworkers can see it, their neighbors can see it, their minister, their doctor, their landlord, their boss. Everybody is voting essentially in public!," Marks says.

Marks watched "hundreds of people vote on this" while poll watching at last November's trial first run of the systems during a small municipal election and says, "we just turned our eyes when they get to the place that they're pressing the choice for their candidate, because we can see it from thirty, forty feet away. Everybody talks about it!" The mind-boggling design flaw, she explains, violates state law, and she details what the state court is expected to do about it.

But that's not all we catch up on today regarding the fight to vote verifiably (and secretly) in the state. Marks reports on the current state investigation underway by the GA Sec. of State into both her and Georgia Tech computer professor and voting systems expert Rich DeMillo (also a recurring BradCast guest) for, essentially, having the temerity to investigate concerns about the voting systems in Georgia. Marks explains the ongoing probe and what Sec. of State Brad Raffensperger's office is accusing her and DeMillo of doing. She calls it "completely absurd", adding "of course it is all retaliation. ... It is nothing but an attempt to try to marginalize the efforts of experts and successful activists. And to discourage others."

But, while all of that may be mind-blowing, it may be nothing compared to the new revelations recently uncovered by the expert hired by the Coalition to carry out a forensic investigation of GA's central computer server for its old system. As listeners may recall, data researcher Logan Lamb discovered before the 2016 Presidential election that GA's main election server for the entire state --- including the state's voter registration database, programming for all ballots statewide, and administrative passwords to its voting system --- were discovered to have been sitting on a web server for download by anyone, no password necessary, for at least six months (and probably much longer) before the 2016 Presidential election in which it was thought possible that Georgia might finally flip to "blue".

That researcher, Logan Lamb, alerted authorities about the data's vulnerability. As thanks, he was reported to the FBI by then Republican Sec. of State, now Governor Brian Kemp, as a potential hacker. He wasn't. But he has now been hired by the Coalition as an expert to examine the now-retired server in question. And, last month, according to AP, he made a startling discovery while examining a mirror image of the 2016 server, which was finally turned over by the state in December of 2019. Lamb found evidence that the server may have been hacked by someone who took advantage of a bug that provided full control of the server. Moreover, he found that all of the system's log files --- which would detail all actions taken on the server --- had been wiped out up until November 10, 2016, two days after that year's Presidential election...for some reason. Now why would that be?

We discuss all of that and MUCH more in another jaw-dropping, must-listen segment today with Marks, including our shared embarrassment that in both of our own home counties (she's in Mecklenburg County, NC, the state's most populous and diverse, and I'm in L.A. County, the largest in CA and even the country) elections officials have instituted new, unverifiable touchscreens for the 2020 elections, set for first time use in both counties next week on Super Tuesday!

On today's BradCast: As messy as the process of passing two Articles of Impeachment against rogue President Donald J. Trump was, the post-impeachment phase got messier still on Thursday, as Democrats stood strong --- at least so far --- in their fight for a fair impeachment trial in the Republican-controlled U.S. Senate. We've also got some important election integrity and voting rights news, along with our final Green News Report of the year. [Audio link to show follows below.]

Before we get to today's impeachment standoff, we finish out a few points from shortly after we left air on Wednesday night, including a review of the late vote on those historic Impeachment Articles in the House --- and some thoughts on Tulsi Gabbard's less than courageous vote of "present" --- as well as the surprising emergence of the backbone being displayed at the moment by House Democrats.

In a blistering response to Senate Majority Leader Mitch McConnell's repeated admissions in recent days that he is working hand-in-glove with the White House and has no intention of serving as an impartial juror in the Senate trial to decide whether the President should be removed from office, despite his Constitutional mandate to do so, House Speaker Nancy Pelosi told reporters on Thursday: "Our Founders, when they wrote the Constitution, suspected that there could be a rogue President. I don't think they suspected that we could have a rogue President and a rogue Leader in the Senate at the same time."

We do our best today to bring you up to date on the ugly and quickly moving story of what has come today from McConnell's --- and, shamefully, fellow juror, Sen. Lindsey Graham (R-SC)'s --- attempt to make a mockery of the Senate trial by rigging it in favor of the White House in refusing to allow first-hand testimony from witnesses of Trump's alleged high crimes and misdemeanors. That, despite Graham's own insistence from 1998, when he served as a House Manager for Bill Clinton's impeachment, that "in every trial that there has ever been in the Senate regarding impeachment, witnesses were called. When you have a witness telling you about what they were doing and why, it's the difference between getting the truth, the whole truth and nothing but the truth."

Those archival video-taped remarks came courtesy of an ad released on Wednesday from Republicans for the Rule of Law to call out Graham. It is in response to McConnell and Graham's refusal to allow testimony from a number of top Administration officials who were first-hand witnesses, but who failed to answer lawful subpoenas for testimony and documents in the U.S. House. The witnesses sought by Democrats and by a huge majority of Americans of all parties (including 64% of Republicans and 72% of independents) include Trump's acting Chief of Staff Mick Mulvaney, Sec. of State Mike Pompeo, and former National Security Advisor John Bolton.

Then, we move to some quick election integrity and voting rights news as the first votes in the 2020 elections are now just weeks away. In New Jersey this week, the Democratic Governor signed a bill to restore voting rights to 73,000 people across the state who are currently on parole or probation.

In Georgia, after Republican Sec. of State Brad Raffensberger was allowed to purge more than 300,000 voters earlier this week amid an ongoing lawsuit to prevent the removal of at least 120,000 of them, his office was forced to admit today that at least 22,000 had been wrongly removed due to what Raffensberger's office describes as an error in the state's screening process. The Admission came just hours before another hearing in federal court, leading plaintiff Fair Fight Action to demand that "every voter purged this week" should be "reinstated immediately."

We also have a quick update on the recent internecine battle at e-voting watchdog VerifiedVoting.org after the courageous resignations of now two well-respected members of their Boards of Directors and Advisors. (We interviewed the first of those to quit, Prof. Philip Stark of UC-Berkeley on a BradCast last week, after which the resignation of the second, Prof. Rich DeMillo of Georgia Tech --- who we have also interviewed a number of times --- was made public as well.)

The public resignations were in response to Verified Voting's disturbing years of support for 100% unverifiable touchscreen Ballot Marking Device (BMD) voting systems now proliferating the country in advance of the critical 2020 elections, and their frequently misleading information about how post-election audits could be used to verify results on such unverifiable systems. This week, the group finally responded to the embarrassing and costly pushback they have been receiving from Election Integrity advocates.

There were also two very important stories published this week on the very serious concerns about e-voting systems in advance of 2020. The first, "How New Voting Machines Could Hack Our Democracy," by attorney and Twitter activist Jenny Cohn at New York Review of Books, is a disturbing and encyclopedic exposé on the dangers and failings of BMDs, the Election Integrity groups such as Verified Voting who have failed to adequately warn against their use in American elections, and the private vendor/election official revolving doors and payoffs that have brought us to this perilous moment.

The second investigative article, out today from NBC News, reviews the shady ownership and shadowy manufacturing processes that runs through China and the Philippines at the nation's largest electronic voting company, Elections Systems & Software, Inc. (ES&S) of Omaha, Nebraska.

The gods must be angry. But they have very good cause. Among the stories covered on today's BradCast [Audio link to show is posted below]...

• At least four were killed and dozens injured as some 27 tornadoes reportedly ripped across the Deep South causing "total chaos" on Monday and Tuesday. In December. Is that normal?;

• DNC Chair and former Labor Secretary Tom Perez steps in to help resolve a labor union dispute at Loyola Marymount University in Los Angeles that had threatened to derail Thursday's 2020 Presidential Debate. Now, it won't. And the union workers got a great deal out of it;

• Nine Democratic Presidential candidates, led by Sen. Cory Booker (who did not qualify for Thursday's debate), petition the DNC to relax qualification thresholds for upcoming Presidential debates. The Party says it won't;

• Another former Trump campaign officials is heading to jail. Rick Gates, Trump's former Deputy Campaign Chair and a top Transition official, receives 45 days in jail, three years of probation and a $20,000 fine for fraud and lying to federal investigators --- to which he pleaded guilty last year. His sentence comes despite prosecutors seeking no jail time after Gates had cooperated with federal officials in Robert Mueller's Special Counsel probe, by helping to to secure guilty verdicts against Trump Campaign Chair Paul Manafort and longtime Trump associate Roger Stone;

• Donald Trump unleashed a bizarre, blistering, six-page, single-spaced, Donald Trumpian rant, disguised as a letter to House Speaker Nancy Pelosi [PDF] on Tuesday, decrying his looming impeachment as a "perversion of justice" by Democrats. The jokes seem to write themselves here, but for how pathetically sad, dangerous and threatening to our Constitutional order the behavior of this President of the United States now actually is;

• That threat continues to spread to Congress, where the House Rules Committee on Tuesday set terms for Wednesday's House Floor debate on the two Articles of Impeachment against the President, as Rep. Jim McGovern, Chair of the Committee said he looks at Trump's attempt to use Ukraine to help him win the 2020 election as "a crime in progress", with Democrats "trying to prevent the President from rigging the next election";

• While over in the Senate, Republican Majority Leader Mitch McConnell refused a request from Minority Leader Chuck Schumer to subpoena the testimony of four top Trump officials who were first-hand witnesses to Trump's Ukraine extortion plot. The officials, whose testimony is sought for the almost certain upcoming impeachment trial in the Senate --- in which Senators are supposed to serve as impartial jurors to determine whether Trump should be removed from office --- include Chief of Staff Mick Mulvaney and former National Security Advisor;

• As McConnell continues to rig the Senate trial on behalf of Trump, Plan B for the removal of this President involves the ballot box. There too, Republicans are attempting to rig next year's election results. In Wisconsin, which Trump reportedly won by just 23,000 votes in 2016, a Republican-appointed Circuit Court Judge ordered the removal of more than 200,000 voters from the voting rolls before the 2020 election. The voters were previously set for removal in 2021 as the Wisconsin Elections Commission had planned, and as the League of Women Voters had argued in favor of. A rightwing group sued to have them removed before 2020 instead, and the GOP-appointed judge agreed. Dems vowed today to re-register them;

• In Georgia, a federal judge allowed the purge of more than 300,000 voters identified by the Republican Sec. of State for moving or failing to vote in recent elections. But voting rights advocates argue that approximately 120,000 of them should not be on the list at all. The judge allowed the mass removal to move forward on assurances from the state those voters can be quickly restored after further hearings on the matter;

• But, it's not just rightwing controlled states where voter registration concerns are rearing their ugly (if expected) head before 2020. Due to what is being described as a "computer glitch" related to the state's new, automatic registration system, as many as 100,000 voters in California may have had their party preference incorrectly changed on their registration files in advance of next year's upcoming March 3rd Presidential primary. The state's rules for who can vote in which party primary are particularly confusing. So, its a very good idea for residents who believe they are registered to check their registration at VoterStatus.SOS.CA.GOV to make sure they are still registered, and for the party they think they are. Those who are registered as permanent "No Party Preference" vote-by-mail voters but who wish to vote for a Presidential candidate in a party primary on March 3rd, will need to make that request with their County Registrar very soon or will receive a vote-by-mail ballot with no Presidential candidate options!;

• Finally, Desi Doyen joins us for the latest Green News Report, as the U.N. climate talks in Madrid end without an agreement, but with much disappointment and rancor, thanks in no small part to sabotage by the U.S., and a new report finds the Greenland ice melt is on track for scientists worst case-scenario predictions of catastrophic sea level rise by the end of the century.

On today's BradCast, we continue down the long and often-too-winding road toward democracy and justice. [Audio link to show is posted below.]

After some 14 hours of debate on Thursday, the U.S. House Judiciary Committee made history on Friday morning by voting along party lines to approve two Articles of Impeachment --- for Abuse of Power and Obstruction of Congress --- against Donald John Trump. It is only the fourth time in America's 243-year history for such a "solemn and sad" event. But Republican Senate Majority Leader Mitch McConnell couldn't even wait for this morning's vote before declaring out-loud on Fox "News" Thursday night that he intends to rig the U.S. Senate's impeachment trial. The Kentucky Senator (who is up for re-election next year) and leader of the Senators who will serve as jurors in the impeachment trial to consider removal of the President early next year --- presuming the full House votes to adopt the Articles next week --- boasted that he has been colluding with the accused in order to assure the Senate trial will be anything but fair.

Speaking of Kentucky and the importance of uncorrupted democracy, on his way out the door, now thankfully-former Republican Tea Party Governor Matt Bevin, who narrowly lost reelection last month in the otherwise "red" state to Democrat Andy Beshear, pardoned and/or gave commutations to 428 convicted criminals. Among those granted clemency are a convicted child rapist, a man who hired a hit man to kill his business partner, and a third who killed his parents. Perhaps most appalling, however, was the pardon for a home-invasion murderer in the second year of his 19-year sentence, after the man's family threw a fund-raiser for Bevin's campaign just last year. (His two accomplices, whose families did not donate to the Governor, remain in jail.)

By way of contrast, the new Democratic Governor, on his second day in office this week, restored voting rights and the right to run for public office to some 140,000 non-violent former felons, leaving Iowa as the only state in the union which still bans all former felons from voting for life. Yes, voting and elections still matter.

But the right to vote and have that vote counted accurately, in a way that we can know it has been counted accurately, continues to be an ongoing fight for Election Integrity advocates across the country as we are weeks away from the start of voting in the 2020 Presidential race. On Friday, several such groups filed a lawsuit in Pennsylvania to block the use of brand new, 100% unverifiable touchscreen Computer Ballot Marking devices made by ES&S, and set for use in the key battleground state next year, after the systems failed to correctly record tens of thousands of votes during last month's municipal elections. The suit seeks to block the new touchscreen systems from use and to require hand-marked paper ballots instead in at least 17 percent of the state, including Philadelphia. Failure in that much of the state next year would be more than enough to throw the results of the 2020 Presidential election one way or another in the critical swing-state.

After those new systems failed so catastrophically during their first use last month (as new, similarly unverifiable touchscreen systems did in Georgia on the same day), long-time, previously well-respected e-voting watchdog group VerifiedVoting.org seemed to help both elections officials and private vendors off the hook by endorsing so-called Risk-Limiting Audits of some of the computer-marked paper ballot summaries produced by the systems in both states.

That appears to have been the last straw for Verified Voting's Board of Directors member Prof. PHILIP B. STARK of UC-Berkeley. Stark, a math and statistics professor, as well as a Board of Advisors member on the US. Election Assistance Commission (EAC) is the inventor of the post-election Risk-Limiting Audit (RLA) protocol. He has been trying, in recent months, to make clear to elections officials and vendors that RLA's of computer-marked (versus hand-marked) paper ballots are "meaningless" [PDF], because its impossible to verify that they reflect voter intent. With Verified Voting jumping in to publicly praise GA and PA's use of such tests to proclaim that reported results accurately reflected voter intent, Stark submitted a blistering resignation letter [PDF] to the group.

The missive, which he shared with me on the night he recently sent it, decries VV's "whitewashing [of] inherently untrustworthy elections by overclaiming what applying RLA procedures to an untrustworthy paper trail can accomplish." He accused the non-profit, non-partisan organization of "providing cover for inherently untrustworthy voting systems --- and the officials who bought them, the companies that make them, and any officials who might contemplate buying them in the future --- by conducting 'risk-limiting audits' of untrustworthy paper records, creating the false and misleading impression that relying on untrustworthy paper for a RLA can confirm election outcomes." His resignation letter charged that the result of VV's action was "security theater, not election integrity."

Stark joins us on today's program to discuss the response to his resignation from leadership at Verified Voting and the other well-respected, world-class cybersecurity and voting systems experts who serve on its Board (many of whom have appeared as guests on The BradCast and sources for BradBlog.com over the years). "Verified Voting retracted a tweet that had claimed that Risk-Limiting Audits, or audits to be conducted in Pennsylvania, would confirm outcomes when they suffered from the same flaw that the audits in Georgia did," he says. "I think in general, the board and I are sorry to part ways. I would gladly go back, if they revised their public position with regard to what audits of an untrustworthy paper trail can possibly accomplish."

Stark also explains --- as I've been very skeptical of the efficacy of post-election audits for many years, for reasons described on the program --- how RLAs work and/or don't. He tells me what type of voting systems he believes to be best for the secure and overseeable casting and counting of votes in American elections (hint: no computers necessary), and much more, including a conversation about just some of the many dangers of computer Ballot Marking Devices (BMD) proliferating the country for 2020, and the ability for voters to cause chaos with them by reporting --- either accurately or not --- that the systems have misprinted their votes on Election Day.

"They're completely vulnerable to crying wolf. Even if an election official trusts public complaints that their votes were altered or contests were missing, then their only recourse is to run a new election, and that opens the possibility for people colluding to cry wolf and have an election invalidated. In the other direction, the incentives are stacked in favor of election officials saying, 'well, it was probably just voter error, we're going to let it stand.'" That, argues Stark, is exactly what we saw last month in Northampton, PA, when elections officials and ES&S claimed that "just by re-tabulating the paper that was printed by technology that malfunctioned big time, they can figure out who really won. It's farce."

Desi and I are back for today's BradCast --- (thanks for saving us over the past three day, Nicole Sandler!) --- as the House Judiciary Committee's debate over two Articles of Impeachment against Donald J. Trump continues and with the first ballots for the 2020 elections set to be mailed out in just over two weeks. That, even as many jurisdictions around the nation are still choosing between gambling on faulty new electronic voting systems or moving to safe, verifiable hand-marked paper ballot systems. Among the stories covered today...

• Dems continue to make Trump's reelection easier for him with fresh compromises in Congress, including approval of his new Space Force military branch and expanded paid parental leave for millions of federal workers (as also supported by Trump);

• The (so far) two-day markup of the Democrats' two Articles of Impeachment against Trump continued into Thursday after opening statements on Wednesday night. We share some notable and pointed clips from Democratic Reps. Steve Cohen (TN), on the President's attempts to undermine American democracy itself; Pramila Jayapal (WA), who accurately describes Trump as "the smoking gun"; and Veronica Escobar (TX) who offers a great analogy to explain how Trump's attempt to force Ukraine to help him in the 2020 election would have landed any other public official in jail;

• In an attempt at fairness, we searched for hours (and hours) to find remarks from the Republican minority that were not comprised of blatantly false claims, wholly misleading information and/or out and out lies. We failed. We did find Rep. Ken Buck (R-CO), however, apparently characterizing 2016 Green Party Presidential candidate Jill Stein as a "Democrat" and falsely claiming that she filed "a frivolous lawsuit...claiming voting machines were rigged in three states" in 2016. She did no such thing. Nor did anybody else to our knowledge. But that's the sort of knowingly fake news Republicans are now using to try and defend their President from impeachment. They are also claiming that "Abuse of Power" and "Obstruction of Congress" are not actually high crimes and misdemeanors (which would likely come as a delightful surprise to Richard Nixon);

• Three years into his Presidency, major newspapers are now finally jumping in to support Trump's impeachment --- now that he is already being impeached. That, after many of those same courageous outlets called for Bill Clinton to resign from office within just days of a sex scandal that resulted in his own impeachment. But we do offer some well-deserved kudos to the American Conservative magazine, for their non-hypocritical support of Trump's impeachment, find the case to be "Overwhelming";

• As to what We, The People, can do about all of this, the first ballots of the 2020 Presidential Primaries will be sent out as early as December 28, just two weeks from now, for military and overseas voters participating in New Hampshire's February 11 primary. And voters from more than a dozen states which are holding Super Tuesday primaries on March 3rd --- including Alabama, Arkansas, California, Colorado, Maine, Massachusetts, Minnesota, North Carolina, Oklahoma, Tennessee, Texas, Utah, Vermont and Virginia --- will begin receiving Vote-by-Mail ballots in just over a month, as of January 18. That's before the Iowa Caucuses on Feb. 3 or the New Hampshire primary on Feb. 11;

• Nonetheless, there are still many jurisdictions around the country fighting to determine exactly which voting systems they will be using at the polls in the 2020 elections. Recent failures of brand-new touchscreen voting systems in Pennsylvania, Georgia and Texas should spook officials and voters alike, even as officials in the battleground state of North Carolina are facing big problems with their plans to use similarly unverifiable systems.

• Meanwhile, in Missouri, the most populous jurisdiction in the state, St. Louis County, was able to move seamlessly from unverifiable touchscreen systems to a brand new, completely verifiable, "Print-on-Demand" hand-marked paper ballot system last month with no complications, and at a saving of some $3 million for tax payers!;

• Finally, Desi Doyen joins us for both good news and bad in our latest Green News Report, as Exxon is exonerated in a big climate fraud case, while 16-year old climate activist Greta Thunberg is named TIME Magazine's 2019 "Person of the Year"!...

As we try to tell you damned near everyday here on The BradCast, everything is ultimately about elections. All of it. Today's impeachment hearings, I'm happy to say, drove that point home yet again, particularly regarding concerns from our nation's founders about the corrupting nature of foreign influence on U.S. elections. [Audio link to show follows below.]

The House Judiciary Committee held its first official impeachment hearing on Wednesday, regarding the Ukraine scandal and, yes, obstruction of justice in the Robert Mueller Special Counsel's probe. Four academics testified on both the history and meaning intended by the founders of the phrase "high crimes and misdemeanors" in the U.S. Constitution's impeachment clause, and on what at least three of the four scholars smartly described as clearly impeachable offenses committed by President Donald J. Trump.

"President Trump has committed impeachable high crimes and misdemeanors by corruptly abusing the office of the presidency," said Noah Feldman of Harvard Law School. We share some extended excerpts from his opening statement as well as his fellow esteemed Constitutional law professors Pamela Karlan of Stanford Law School and Michael Gerhardt of the University of North Carolina School of Law. All three testified that the record is now clear that Trump committed impeachable offenses in his strong-arm bribery campaign to force Ukraine to announce an investigation against his potential 2020 rival Joe Biden in exchange for nearly $400 million in military assistance allocated by Congress but frozen by the White House in what Trump's own EU Ambassador described in a previous hearing as a "quid pro quo" scheme.

Today's hearing was surprising enlightening with the unusually lively and passionate academics answering sharp questions from both Democratic and Republican counsel and members of the Committee, as chaired by Rep. Jerrold Nadler (D-NY). Not all of those who testified, however, agreed that Trump should be impeached --- at least not yet. George Washington University School of Law professor Jonathan Turley --- the Republicans' witness, who testified in support of impeachment against Bill Clinton in 1998 because "he ha[d] deprived himself of the perceived legitimacy to govern" --- argued the record was still too "wafer thin" to move forward with Articles of Impeachment against Trump.

We discuss that point and many others, including the Democrats' reasons --- some good, some not --- for moving quickly on impeachment before voting begins in the 2020 primaries less than two months from today, with our ace Impeachment Hearing Correspondent HEATHER DIGBY PARTON of Salon and Hullabaloo. Democrats appeared to be homing in on at least three, and maybe four, Articles of Impeachment, as both Digby and I read today's hearing, including Abuse of Power, Bribery, Obstruction of Congress (in the Ukraine affair), and Obstruction of Justice (in the Mueller investigation). But there was far more from today's eight hours of hearings and our coverage of it than I can possibly summarize here, so I'll just strongly suggest you tune in.
