Former U.S. House Speaker Jim Wright (D) was denied a Photo ID for voting purposes in Texas over the weekend by the state's Department of Public Safety (DPS).

The 90-year old Wright, who is lucky enough to have an assistant to drive him to and from the DPS office, says that while he believes he'll be able to get an ID in time to vote in this Tuesday's election, he's concerned the state's "unduly stringent requirements on voters" will reduce turnout.

According to the Star-Telegram, Wright's driver's license expired in 2010 and --- because he no longer drives --- he didn't bother to renew it. That expired license, he learned Saturday, is not good enough to obtain a Photo ID to vote under the law TX Republicans passed in 2011. That law will be in effect, for the first time, on Tuesday. The state statute had previously been nixed just last year by the U.S. Dept. of Justice and by a 3-judge federal court panel after being found discriminatory, in violation of the Voting Rights Act (VRA), as based on statistics supplied by the state itself.

Thanks to the U.S. Supreme Court gutting a key provision of the VRA over the summer, however, Texas announced the law would finally be enforced for the upcoming election.

Wright is hardly the only well known figure to be stung so far by the Lone Star State Republicans' purposely disenfranchising law. And the hoops that many voters --- even ones like Wright, who says he's voted in every single election since 1944 --- must now jump through in order to have a chance at their vote even being counted at all, is remarkable...

7th circuit's Posner admits 'did not have enough information' at time to judge landmark vote suppression case correctly...

This is nothing less than remarkable. The 7th circuit court judge who wrote the majority opinion in the landmark Crawford v. Marion County Election Board case, has now admitted he got it wrong!

"I think we did not have enough information," Judge Richard Posner said in remarks at HuffPo Live today. "If the lawyers had provided us with a lot of information about the abuse of voter identification laws, this case would have been decided differently."

Crawford is the Indiana polling place Photo ID restriction case that went to the U.S. Supreme Court where it was upheld in 2008. It is the case cited, usually inaccurately, by Republican advocates of such restrictions, who argue that such disenfranchising laws are not in violation of the U.S. Constitution. For example, it is the case cited (inaccurately) by TX Attorney General Greg Abbott, in his argument against the U.S. Dept. of Justice's current lawsuit attempting to block the Lone Star State's most recent attempt to institute that voting restriction at their polling places. "The U.S. Supreme Court has already ruled that voter ID laws do not suppress legal votes," Abbott said misleadingly in response to the DoJ's suit, as explained in detail last month by BRAD BLOG legal analyst Ernest Canning.

But, setting aside the misuse of SCOTUS' very limited ruling on Crawford, the remarkable news today comes via UC Irvine election law professor Rick Hasen, who transcribes remarks made today by Judge Richard Posner, author of the original 7th circuit majority opinion in Crawford, now completely recanting his original opinion on the case!

Greg Abbott, the Lone Star State's Attorney General, made a fool out of himself recently when he issued his public response to a U.S. Dept. of Justice lawsuit challenging the Texas Republicans' new polling place Photo ID law as a violation of the Voting Rights Act (VRA) and of the U.S. Constitution.

The "facts" he publicly offered in the law's defense were wholly misleading and, worse, plainly inaccurate. But if Abbott thought that was embarrassing, he may have no idea what he's in store for when he actually shows up in a court of law, seeking to defend the Photo ID law which Texas Republicans enacted in 2011 as part of a desperate attempt to cling to power.

Rapidly shifting voter demographics are quickly working against the Lone Star Republican Party. The numbers are leading them into a panic over an ever-increasing minority population and rising voting rates to go with it. So they have been, since 2005, attempting to squelch the inevitable by trying to tamp down minority turnout any way possible. But Texas Republicans are not only in a battle with demographics. The key facts about the Lone Star State's Photo ID restrictions --- as already determined in a court of law --- are not on their side either.

In both United States v. Texas, the DoJ's newly filed legal challenge to the Texas Photo ID restriction law, and in Veasey v. Perry, a separate federal lawsuit filed by Rep. Marc Veasey (D-TX) and later joined by Dallas County, the plaintiffs not only set forth allegations but facts already found to be true last year by a unanimous three-judge U.S. District Court panel.

Those already established facts reveal that the state's Photo ID law (SB 14) violates the Equal Protection Clause of the 14th Amendment to the U.S. Constitution because it imposes unreasonable, and often impossible, burdens upon the right of the poor to vote that would likely result in disenfranchisement. The three judge panel further found, via "undisputed record evidence", as they described it, that a disproportionate percentage of poor Texans who would be subject to such disenfranchisement are Hispanic and African-American.

At the time, however, despite establishing those uncontested facts, those Constitutional concerns were not the basis of the case in front of the federal court in question. But they are now.

Given the Lone Star State's acknowledgment during the previous litigation that it could not contest the facts already on record, the Texas Republicans' gambit to try and turn back time at the polls, or, at least, slow it down as the demographic clock continues to tick against them, is exceedingly unlikely to work. Yesterday, the U.S. Department of Justice sued the state of Texas under Section 2 of the Voting Rights Act. The complaint was filed in hopes of blocking the state's polling place Photo ID restriction law, newly re-enacted by TX Attorney General Greg Abbott just hours after the U.S. Supreme Court struck down the very heart of the VRA (the Section 4 formula used to determine jurisdictions covered by its Section 5 preclearance requirements for new voting laws) last June.

How did the TX AG respond to the DoJ suit?

Here is the very first line of Abbott's embarrassing website response to it posted yesterday...

AUSTIN --- “Just days after the U.S. Department of Justice arrested a Texas woman for illegally voting five times in the same election, the Obama administration is suing to stop Texas’ commonsense voter ID law. The U.S. Supreme Court has already ruled that voter ID laws do not suppress legal votes, but do help prevent illegal votes. Voter IDs have nothing to do with race and they are free to anyone who needs one.

Ya know what else "Voter IDs have nothing to do with"? The absentee ballot fraud committed by the woman cited by Greg Abbott above in the very first line of his response to the DoJ!

5-4 ruling by GOP Justices overrides Congress, Constitution, guts key provision of bi-partisan, 48-year old civil rights law...

In a remarkable display of judicial overreach, activism and legislating from the bench, the five Republican-appointed U.S. Supreme Court Justices, in a narrow 5-4 ruling today [PDF] have, in the words of dissenting Justice Ruth Bader Ginsberg, "demolished" the center-piece of the nation's beloved 48-year old Voting Rights Act, ignored the court's own repeated rulings, overridden a repeated and unambiguous mandate by the U.S. Congress (most recently, as led by two Republican chambers and signed by a Republican President), and made an absolute joke of the no-uncertain-terms directive of the U.S. Constitution's 15th Amendment.

In short, the nature of today's SCOTUS ruling, effectively gutting the central provision of what is arguably the most important Constitutionally-mandated and successful civil rights legislation in the nation's history, encompasses everything that the Republican Party has, in recent years, pretended to abhor when it comes to the judiciary --- everything, that is, but the partisan politics of its historic reach...

PLUS: Texas AG Settles Suit by Elderly African American Voters Harassed During State's 'Voter Fraud' Investigation

What's a Grand Ol' Party to do when they wish to disenfranchise Democratic voters via the specious specter of "voter fraud" when they can't actually find any evidence to make their case? Why, call their media wing at Fox "News" of course!

Fox picks up today where the DoJ and Republican Party have had no luck so far, but not for lack of trying. Hey, if you can't beat 'em, publicize 'em, and make it sound like you're beating 'em, at least.

David Edwards and Muriel Kane report at RAW STORY today that Fox is running a "special investigation" into non-citizens throwing elections:

"Could illegal immigrants sway an election?' Eric Shawn of Fox News asked on Wednesday, raising the terrifying specter of "people who are not even citizens voting for whomever they want."

Since 2005, the Bush administration has been pushing the idea that "voter fraud" is a widespread problem, even firing US Attorneys who did not make the investigation of claims of fraud a priority. However, investigations have never found more than a handful of votes being cast illegally, while requiring proof of citizenship seems likely to disenfranchise hundreds of thousands of voters, mostly the poor and elderly who may not be able to secure required documentation.

Fox News has now set out to find the evidence of fraud that the Bush Department of Justice could not, whipping up their audience with the threat of non-citizens "getting a fake ID, a driver's license, or a social security card and voting in this year's election."

"If you think there's voter fraud where you live, or there are other election problems, we at Fox News want to know about it," Shawn told viewers. "You can email us. ... voterfraud@foxnews.com."

RELATED: No Voter Fraud by Space Aliens Found Either, Though Ann Coulter's Clear Case of Voter Fraud Remains Wholly Unprosecuted...

Texas' Republican Attorney General has found that there's little or no "voter fraud" of note down there either, despite a promise two years ago, according to the Dallas Morning News, to "root out what he called an epidemic of voter fraud in Texas," and his creation of a special unit which "tapped a $1.4 million federal crime-fighting grant" to expose the election stealing rascals.

For all of his crime-fighting in those two years, across the big Lonestar State, TX AG Greg Abbott has prosecuted just 26 cases, "all against Democrats, and almost all involving blacks or Hispanics," according to the Morning News, most of which resulted in "small fines and little or no jail time."

Additionally, almost all of them (18 of 26) involved mail-in absentee ballots where elderly voters were "illegally" given assistance in mailing their ballots, versus in-person voter impersonation of the type that cynical GOP attempts to mandate draconian polling place Photo ID restrictions are purportedly meant to deter. (In reality, they are meant to deter Democrats from being able to cast their legal ballots, so Republicans can more easily "win" elections.)

Just eight of the 26 prosecuted cases, the Morning News found, out of Abbott's two-year effort, involved any kind of ineligible or manufactured votes --- only 2 actually involved individuals casting fraudulent ballots at the polls, the rest were registration fraud issues --- and none of them revealed any larger conspiratorial scheme meant to effect the results of an election.

In the meantime, critics charge Abbott has been ignoring complaints about Republican election skulduggery, and we'd be remiss if we didn't point out that nobody has bothered to prosecute Republicanist Ann Coulter, for her several demonstrable voter fraud-related felony crimes in Florida despite, dead-to-rights evidence as published by The BRAD BLOG since early 2006.

We'd also like to point out, that in addition to there not being "an epidemic of voter fraud in Texas," there is similarly no such epidemic among space aliens either. Though Ted Rall suggests we may wish to implement some new measures there too...just in case...
