UPDATE: Tea Party candidate loses! (On the verifiable ballots)...

In addition to the primary elections being held in New York today --- where long-ago predicted failures are reported to be occurring with their new e-voting system as we described earlier --- elections are also underway today in Delaware, D.C., Maryland, Massachusetts, New Hampshire, Rhode Island, and Wisconsin.

To find out which type of voting system will fail and/or or be 100% unverifiable in each of those states, please see VerifiedVoting.org's Verifier for details.

One of the races certain to get most attention tonight will be the Republican U.S. Senate primary in Delaware where the Tea Party/Palin/DeMint-backed Christine O'Donnell has seen a last minute surge in support, according to pre-election polls, against GOP-establishment supported Rep. Mike Castle. The popular Castle was thought to have been a shoo-in for the Republican nomination until recently, as well as the likely victor over the Democrats presumptive nominee Chris Coons.

But Coons currently cleans O'Donnell's clock in pre-election polling, so the GOP race has become a contentious one.

We point all of this out by way of noting that Delaware has just three counties, all of which force voters to use 100% unverifiable Direct Recording Electronic (DRE, usually touch-screen, but in this case push-button) voting systems on Election Day. The systems are made by Danaher Controls, one of the smaller, lesser-known e-voting companies in the U.S., though large enough to have been made infamous when hundreds of their machines reportedly broke down during Philadelphia's May 2006 trainwreck election. In 2004 Verified Voting and the Electronic Frontier Foundation published a short paper [PDF] detailing various other problems with the systems in Tennessee and Ohio elections going back to 1992.

While we've yet to hear of problems today on the machines in the "First State," we thought it might be a good time to mention that no matter whom the voting machines report as the winner in any of the races, including the hotly-contested GOP Senate primary, there will largely be next to nothing that can be done to challenge the results --- other than, perhaps, counting the smaller number of paper-based absentee ballots for accuracy. (The paper-based absentee ballots will initially be tabulated by Diebold AccuVote op-scan systems, the same type of system used to flip the results of a mock election in HBO's Emmy-nominated documentary Hacking Democracy. You can watch that hack here as it occurred live.)

The Danaher DREs being used in Delaware today make for 100% faith-based elections. As with all DREs, after the polls close tonight it will be strictly impossible to verify that even one vote cast on them was recorded accurately as per the voter's intent, for any candidate on the ballot.

In the event that the e-voting systems report a close election tonight, well, too bad.

UPDATE 7:15pm PT: With 85% of the vote "counted," and a reported 54%-46% margin, AP has declared O'Donnell the winner. Details...

That 'Tea Party' backing Koch Industries, an oily conglomeration which is ranked as one of the nation's worst polluters, has joined with two other Texas-based oil industry polluters, Tesoro Corp. and Valero Energy Corp., aka the "Toxic Twins," comes as no surprise. After all, Koch has already been aptly described by Greenpeace as "the kingpins of climate science denial."

It also comes as no surprise that California's Prop 23 measure on this November's ballot, which would require the state "to abandon implementation of [Assembly Bill 32's] comprehensive greenhouse-gas-reduction program that includes increased renewable energy and cleaner fuel requirements, and mandatory emission reporting and fee requirements for major polluters such as power plants and oil refineries," was submitted [PDF] to the CA Secretary of State's office bearing an Orwellian label, the "California Jobs initiative" --- an initiative that has the backing of "Tea Party" darling and former Hewlett Packard CEO Carly Fiorina, whose idea of "jobs creation" entails the transfer of domestic jobs overseas.

This corporate deception mirrors Pacific Gas & Electric's effort to use the ballot box as a vehicle for acquiring monopoly power. PG&E deceptively described its failed Prop 16 initiative, on last June's ballot, as the "Taxpayers Right to Vote Act."

There's a good chance that, just as they defeated Prop 16, CA voters will see through the "jobs creation" scam of Prop 23. But, if current polls are indicative, a large segment of an under-informed electorate who, in their disgust with President Obama's betrayal of "change we can believe in," are being taken in by billionaire-funded "poison populism" --- moving to the Right when the health of our economy and of humanity itself cries out for a sharp turn to the Left...

Robin Abcarian of the Los Angeles Times appears to be the type of reporter comedian Stephen Colbert had in mind during his blistering act at the 2006 White House Correspondence dinner:

"Here's how it works: the president makes decisions. He's the Decider. The press secretary announces those decisions, and you people of the press type those decisions down. Make, announce, type. Just put 'em through a spell check and go home. Get to know your family again. Make love to your wife. Write that novel you got kicking around in your head. You know, the one about the intrepid Washington reporter with the courage to stand up to the administration. You know - fiction!"

As revealed by her front-page Los Angeles Times article, "Swinging at the left, hit or miss," Abcarian, apparently armed with nothing more than the baseline, mainstream media accounts of the Shirley Sherrod scandal, paid a visit to the West Los Angeles office of the man whom Brad Friedman aptly described as a "pathological liar" and "race baiter;" jotted down Andrew Breitbart's latest spin about himself and the Shirley Sherrod fiasco, and then dutifully spit out a fawning account which accepted at face value Breitbart's latest claim that he simply failed to "wait for full video" of the Sherrod speech, and which described Breitbart as a "new-media phenom;" a "transformed...liberal" who became "a star of the 'tea party' movement" after experiencing an epiphany during the confirmation hearings of Supreme Court Justice Clarency Thomas, whom Breitbart describes as "an American hero" who was unfairly targeted by "a cavalcade of Caucasians asking...about his very private video rentals!"

In Abcarian and the Los Angeles Times, Andrew Breitbart, the consummate con-artist, had found yet another vehicle for rewriting history...

Fiorina offers bizarre claim that an increase in federal jobs, as opposed to outsourcing, is to blame for demise of middle class

After months of electoral politics conducted exclusively by way of dueling, 30 second propaganda slots (aka paid-for political ads), incumbent Senator Barbara Boxer (D-CA) and her Republican challenger, former Hewlett-Packard CEO Carly Fiorina conducted what excluded Green Party candidate Duane Roberts derided as "a sham debate between two multi-millionaires backed by big business interests."

While there is some merit in Roberts' complaint, the debate proved of vital importance, especially since it exposed the extreme views of the lesser known Fiorina on a variety of issues ranging from her opposition to environmental protection, opposition to marital equality for same sex couples, and her outright call to reverse Roe v. Wade. But the most telling aspect was that the debate exposed Fiorina to be an unapologetic proponent of outsourcing and corporate globalization, which, since the passage of NAFTA, has proved to be the bane of the American middle-class.

That made this a debate of manifest importance to the people of California. Yet the corporate media, whose financial interest is served by failing to provide meaningful news coverage, thereby forcing candidates into the paid-for propaganda slots, proved true to form. Live coverage was limited to Cox Communications' Oakland, CA, affiliate, KTVU...

Here, at The BRAD BLOG, we've spent a good deal of time addressing the duplicity of convicted federal criminal James O'Keefe and his employer Andrew Breitbart, a pathological liar, whose bogus ACORN pimp hoax proved the undoing of a benevolent community organization, ACORN.

While Breitbart received his comeuppance when he made the mistake of attempting a dishonest smear of a woman, Shirley Sherrod, who would not go quietly into the night in the face of the hard-right's distortion of her words, David Vitter (R-LA), the hard-right's Senate point man in its effort to destroy democracy and verifiable truth by smearing and then defunding ACORN is sailing towards re-election despite links to hookers and to an aide, Brent Furer, who plead guilty to an assault in which he held a knife to his girlfriend's throat and stabbed her in her hand --- Furer allegedly held her against her will for 90 minutes and threatened to kill her.

Now, comes a revelation that Vitter not only kept Furer on his taxpayer-funded payroll while tasking the girlfriend-assaulting Furer with overseeing women's issues, but that U.S. taxpayers footed the bill for the convicted Furer's travel to appear in court on the assault charge and on a DUI...

On Sunday, Brad Friedman posted a "Toon of the moment" in which a hypnotist sits dangling a watch in front of two stupified voters as Senators Mitch McConnell (R-KY) and Chuck Grassley (R-IA) look on. The hypnotist tells the voters:

You know nothing. You remember nothing. You don't remember George W. Bush or how badly he screwed things up. You love Republicans. They are here to help you. You will welcome them back...

Replace the hypnotist and watch with "illegal immigrants" or a "Ground Zero Mosque" (what the Los Angeles Times' Tim Rutten refers to as a "rising tide of Nativism") and the cartoon would be equally spot on, though this form of hypnosis is utilized by the billionaire-funded hard-right not only to "forget" the disaster that was the Bush/Cheney cabal but to avoid a debate on the Republicans' cold and heartless, class-based decisions to oppose an extension of unemployment benefits, to block funds for state governments intended to prevent a layoff of thousands of teachers, to block vital environmental legislation, to engage in never-ending privatization schemes, which by design are intended to destroy government's ability to provide vital public services (police, fire, health care, education), and to repeatedly level false charges of insolvency as part of their scheme to permit the thieves of Wall Street to raid the Social Security trust fund.

Those who are rational and see the mosque as an issue of First Amendment religious freedoms (and common sense) fail to appreciate the visceral appeal of Republican race-baiting, which, in the case of the mosque, seeks to tap into a deep-seated, cultural anxiety that has been created not only by 9/11 but --- as I explained in "Hate Speech and the Process of Dehumanization" here at The BRAD BLOG, and in its follow-up --- by the vilification of Arabs and Muslims in books, films and on television over a span of decades. It was this same deep-seated and subconscious loathing which permitted the Bush/Cheney cabal to conflate Saddam Hussein --- just another swarthy, mid-Eastern bad guy --- with al Qaeda for the purpose of invading Iraq.

The politics of Republican fear-mongering and race-baiting exploits cultural dehumanization so as to conflate all Muslims with 9/11. The result is a perversion of that seminal event --- which, even under the Bush/Cheney Administration's own "official theory," entailed only al Qaeda --- into an unprovoked assault by the Muslim world on "Christian America."

"You know nothing. You remember nothing. You don't remember George W. Bush or how badly he screwed things up. You love Republicans. They are here to help you. You will welcome them back..."

A number of noteworthy news items occurred yesterday while I was on the hot, hot, hot Midwestern road for the entirety of the day. These are several among those items...

Greene Indicted on Obscenity Charges

South Carolina's mystery Democratic nominee for the U.S. Senate (the one whose election "victory" is only explicable through malfeasance or malfunction of the 100% unverifiable ES&S iVotronic touch-screen voting systems) was indicted on obsenity charges yesterday. One of the charges was an "extremely rare" felony count. The state Democratic Party chairwoman, Carol Fowler --- the one who presided over the 5-hour Executive Board protest hearing by Greene's primary opponent Judge Vic Rawl who argued that voting machine failure was the only explanation for the unknown, jobless, money-less, campaign-less Greene having "won" --- has asked him, again, to voluntarily step down from the nomination. When asked if he'd be willing to accept the nomination if Greene steps down, Rawl has told The BRAD BLOG previously that he'd cross that bridge when/if he came to it.

Appelate Court Backs Congressional Defunding of ACORN

A 3-judge panel (two Rs, 1 D) on the 2nd District Court of Appeals has unanimously reversed [PDF] the ruling of a federal district court judge last March concerning the Congressional defunding of ACORN in light of deceptively-edited video tapes published by Rightwing propagandists Andrew Breitbart and James O'Keefe. The appellate court determined that Congress can target a specific group for punishment, despite what the district court judge had identified as an unconstitutional Bill of Attainder in light of the government having "offered no...unique reason to treat ACORN differently from other contractors accused of serious misconduct." U.S. District Court Judge Nina Gershon had previously granted injunctive relief to the four-decade old community organization after finding they were barred "from federal funding without either a judicial trial or an administrative process applicable to all government contractors." The 3-judge appellate panel disagreed. ACORN's legal representation has called the decision "deeply flawed," says they are planning to ask the full court for reconsideration, and added "We cannot let Congress act like judge, jury and executioner without any hearings at all."

O'Keefe Accidentally Admits to Being Immoral

And speaking of ACORN, the Rightwing dirty trickster and federal criminal James O'Keefe who hacked together secretly-taped videos in order to phony up the idea that the anit-poverty, pro-democracy community group was committing some sort of crimes, has, according to Think Progress, admitted during a recent speech that what he does is "the nadir of morality." ("Nadir" means "lowest point", versus "zenith" which means "highest".) No worries though. O'Keefe's employer, the discredited, pathological liar Andrew Breitbart, has plans to deceptively re-edit the video of O'Keefe in order to "fix" that little Freudian slip.

Stephanie Comes Out!

Finally, the most fun news of the day comes from progressive radio talker and friend of The BRAD BLOG, Stephanie Miller. During a moving program yesterday, Miller announced to listeners that she was gay, noting that it's been an "open secret" among close friends and family for years, but that a "perfect storm" of events (the recent federal court ruling that CA's Prop 8 ban on same-sex marriage was unconstitutional and the fight to repeal the federal "Don't Ask, Don't Tell" policy in the military, etc.) led her to the belief that it was the right moment to come out to her listeners and the public. It's been explained to me that one of the reasons we have such a difficult time selling ads on this blog --- or receiving donations (Serious hint there, people! Please? Thanks!) --- is that I'm reliably unreliable when it comes to supporting any particular political party.

This, of course, makes me toxic to most of the partisans out there, in what has become an insanely partisan world. (It also makes it very difficult to pay the rent, so see shameless plea above.)

Many more corporate-funded attacks to come, however...

Good for Sinclair Broadcasting, in this case, pulling an inaccurate commercial off the air that was being run by the despicable corporate money-launderers of the U.S. Chamber of Commerce, attacking Democratic U.S. Senatorial candidate Joe Sestak in Pennsylvania.

Of course, the ad was run on television before it was pulled. The fact-checking was not done in advance, so lies such as health insurance reform being "a government takeover of healthcare" were allowed to be aired as if they were legitimate claims.

Naturally, the campaign of Sestak's Republican opponent, Pat Toomey, backed up the Chamber's ads, even as they are not supposed to be coordinating with such groups, according to the law. But what do quaint old notions like "the rule of law" really mean anymore in these United States anyway?

What is underscored again here, is that corporate lobbyists and criminals like those at the U.S. Chamber of Commerce are now free to wield millions --- even billions --- of dollars for or against candidates they don't like, or who may not meet with their corporate approval for any reason.

That's what the U.S. Supreme Court has recently deemed "free speech". And you, dear private citizen of the United States of America, can do nothing about it --- unless you happen to have a few hundred million extra dollars sitting around the house and want to exercise your "free speech" in producing and airing TV commercials in opposition. Good luck with that.

UPDATE 4:04pm: Looks like the Rightwing corporate bosses at Sinclair may have come down on the local stations. AP is now reporting the Chamber says the ads are being restored:

Two Pittsburgh-area TV stations are reversing a decision to pull a commercial attacking Democratic policies and the voting record of U.S. Senate candidate Joe Sestak.

The U.S. Chamber of Commerce said Friday that the stations are restoring the ad that the business advocacy group sponsored.

An official for sister stations WPGH and WPMY declined to comment.

Funds for $10k fee came from military pay, tax refunds, according to state's top law enforcement agency...

An investigation by the South Carolina Law Enforcement Division (SLED), the state's top law enforcement agency, has concluded that no charges will be filed against Alvin Greene, the mysterious and unverifiable winner of the Democratic Party's nomination for the U.S. Senate, in relation to the $10,440 filing fee the unemployed military vet paid to get onto the party's June 8th primary ballot.

In that election, the unknown Greene was reported --- by the 100% unverifiable ES&S e-voting system --- to have defeated former four-term state legislator and U.S. Circuit Court Judge Vic Rawl 59% to 41% despite having failed to campaign for the nomination, nor even having a campaign website.

Questions have arisen as to how the jobless Greene, who was recently appointed a public defender in a felony obscenity case he faces, was able to afford the filing fee for the U.S. Senate race. As noted by Citizens for Responsibility and Ethics in Washington (CREW), which requested an investigation into the matter, Section 7-25-200 of the SC Code of Laws prohibits anyone from accepting or offering "either directly or indirectly, money, a loan of money, or any other thing of value...as inducement to file as a candidate for any state or federal election office." Greene, who lives with his father, maintains he used money saved from military pay to cover the fee.

Some, including both state Republicans and South Carolina's Democratic U.S. House Rep. James Clyburn (SC), have stated the possibility that Greene was a "plant" on the ballot, given a public poll taken in May, as cited by Rawl campaign manager Walter Ludwig here at The BRAD BLOG, just three weeks weeks before the election, which showed Rawl trailing SC's incumbent Republican Sen. Jim DeMint by just 7 points, 50 to 43%. However, even the "plant" theory can't explain Greene's nearly 20-point "victory" as reported in the June 8th election results.

It's the very last paragraph of CNN's report on SLED clearing Greene, however, which, for the moment, raises both our eyebrow and, possibly, a curious red flag in the results of the Republican-controlled state's investigation into Greene's filing fee...

100% unverifiable e-voting 'not the droid you're looking for'...

Near the end of an article today on an investigation now underway by South Carolina officials into how the unknown, unemployed Democratic U.S. Senate nominee Alvin Greene was able to afford the state's $10,440 filing fee to get on the ballot in the first place, the Associated Press quickly summarizes the "multiple theories" forwarded to speculate on how it was that Greene could have garnered a 59 to 41% "victory" over former state legislator and Circuit Judge Vic Rawl in the recent Democratic U.S. primary:

Multiple theories have surfaced about Greene's success. Some had speculated that Greene, who is black, benefited from black voters looking for a black candidate and opting for his name because of the spelling of his name, with an "e" on the end. And the leader of the state Democratic Party has speculated voters picked the first name on the ballot.

Earlier this month, the state Democratic Party's executive committee upheld Greene's victory, nixing a protest lodged by Rawl that could have required a new vote.

I guess there were just no other possible "theories" for Greene's still inexplicable "victory". Nothing that AP could come up with --- nothing at all to inform readers about --- despite the recent, official, formal five-hour hearing, filled with evidence and actual experts, at that "protest lodged by Rawl."

So, it must have been the "e" at the end of Greene's name that made more than 100,000 South Carolinians vote for a man who never campaigned and who they never heard of. Yeah, that must have been it.

In related news, I've officially changed my name to Brad Friedmane and am hereby announcing my candidacy for President of the United States in 2012. I hope this notice serves to get me elected, as it's the only campaigning I will be doing between now and then. Should be more than enough though. Measuring the Oval Office for drapes even as we speak.

Ends U.S. Senate campaign, vows to 'speak out about frail, vulnerable election system'...

Judge Vic Rawl just released a public statement on the heels of the SC Democratic Party Executive Board's insane rejection yesterday of his protest to the 100% unverifiable ES&S iVotronic touch-screen system's announced "victory" of Alvin Greene to be the state's Democratic nominee for the U.S. Senate. Rawl's statement reads in part:

I wanted you to hear from me that we will not be appealing last night’s decision by the Democratic Executive Committee to reject our protest of the election results. My campaign for the United States Senate has ended.

The issues we raised about the lack of election integrity in South Carolina are real, and they are not going away unless people act. I assure you that I will continue to speak out about our frail and vulnerable election system in the months to come.

Rawl's comments follow on both his own impromptu remarks after yesterday's protest was rejected, and his Campaign Manager Walter Ludwig's barely-contained on-the-record comments following the hearing: "We're certainly disappointed, but the unique circumstances of this election gave us an opportunity to put the specter of voting machines in front of the national public in the strongest way since Bush v. Gore."

As we'll be guest hosting the Mike Malloy Show again for the first week of July, hopefully Rawl and/or Ludwig will be able to join us to explain what the hell happened, what they intend to do about it, and what the hell is wrong with SC's shameful, apparently democracy-hating, Democratic Party Executive Board.
