Following the national shame of 2012 when long lines at the polls on Election Day and during Early Voting (which was restricted by Republicans in a number of states) once again suppressed the vote and endangered American democracy, President Obama called for electoral reform as he declared victory on Election Night.

"I want to thank every American who participated in this election...Whether you voted for the very first time or waited in line for a very long time," he said, adding: "By the way, we have to fix that."

During his second Inauguration speech, he repeated the message: "Our journey is not complete until no citizen is forced to wait for hours to exercise the right to vote."

At his State of the Union Address in 2013, he again re-iterated the call for reform --- citing the story of 102-year old Desiline Victor, an African-American Florida woman who was forced to wait in line for hours on end to cast her vote in 2012 --- before announcing his creation, by Executive Order, of a bi-partisan Presidential Commission on Election Administration. It would be headed up by both his own top election attorney, Robert Bauer, as well as Mitt Romney's lead election attorney and long-time GOP operative, Benjamin Ginsberg.

After six months of hearings and conferences around the country, that commission has now released its unanimous recommendations [PDF] for improving access to the voting booth and for other much-needed improvements for electoral administration.

While coming to bi-partisan consensus with a report on such a contentious topic is no small achievement in and of itself in this extraordinarily divisive environment, the Commission highlighted one fairly obvious point which will almost certainly disappoint the most partisan Republicans, but also, perhaps less obviously, some Democrats...

From the new documentary MITT, via Byron York...

"That's what I start with: 'Dad,'" [Mitt] Romney explained. "I always think about dad and about I am standing on his shoulders. I would not be there, there's no way I would be able to be running for president if dad hadn't done what dad did. He's the real deal..."

"You're the real deal," said one of Romney's sons.

Romney didn't pause. "The guy was born in Mexico. He didn't have a college degree. He became head of a car company and became a governor. It would have never entered my mind to be in politics, how can you go from his beginning to think, I can be head of a car company, I can run for governor, I can run for president?"

Romney wasn't finished. "The gap --- for me, I started where he ended up. I started off with money and education, Harvard Business School, Harvard Law School. For me it's moving that far" --- Romney held two fingers close together --- "For him, it's like that," Romney said, holding his arms wide apart.

So, like the Koch Brothers before him, who inherited their father's success only to work hard to limit the possibilities of others gaining the same, Mitt Romney recognizes, at least privately (and now in a documentary film which had unprecedented access to private moments during his last two Presidential campaigns), that he started off more advantaged than, say, 99% of Americans.

Jim Hightower once said that George H.W. Bush was "born on third base and thought he had hit a triple." Romney was also born on third base, but at least he has the decency to admit it. At least in private. While otherwise publicly describing his fellow citizens who who weren't born on third, like him, as 'takers'.

Still on the road (back full time as of next week), but thought this video from yesterday's The Lead with Jake Tapper on CNN was well worth popping here quickly, if you've yet to see it.

It's a fantastic and very lively debate about Edward Snowden and, perhaps most-interestingly, Obama's Director of National Intelligence James Clapper, between journalist Glenn Greenwald and Washington Post op-ed columnist Ruth Marcus. Greenwald describes Marcus here --- much to her apparent consternation --- as an Obama Administration "loyalist" for, among other things, what he sees as a double-standard for her calls for the prosecution of whistleblower Snowden, versus the seeming free pass she's willing to give to Administration officials such as Clapper who has admitted to misleading Congress with false testimony (aka Lying to Them). That would be a felony crime...if anybody bothered to prosecute it.

Greenwald is tenacious (as usual) in forcing Marcus to answer his question about whether Clapper should be prosecuted. For her part, she does a decent job of acquitting herself, sort of, even as the entire conversation --- and the two staked-out positions here --- really do help to illustrate, as Greenwald describes it, how "the D.C. media" and "people in Washington continuously make excuses for those in power when they break the law."

"That's what people in Washington do," he charges. "They would never call on someone like James Clapper, who got caught lying to Congress, which is a felony, to be prosecuted. They only pick on people who embarrass the government and the administration to which they are loyal, like Edward Snowden. It's not about the rule of law."

"People in Washington who are well-connected to the government like she is, do not believe that the law applies to them. They only believe that the law should be used to punish people and imprison people who don't have power in Washington or who expose the wrongdoing of American political officials," Greenwald argues. I'll let you watch to see how Marcus responds.

"True the Vote" (TTV), the Orwellian-named Republican "voter fraud" front group with a long and sordid history of deception and fraud won't take 'no' for an answer. Release the hounds.

The group has filed a formal notice of appeal [PDF] of U.S. District Court Judge Nelva Gonzales Ramos' recent refusal to permit TTV to intervene as a party defendant in the U.S. Justice Department's (DoJ) federal legal challenge to SB-14, the Texas polling place Photo ID statute.

Judge Ramos found that the interests of the organization --- which masquerades as an "election integrity" group in order to actually advocate for voter suppression --- were already adequately represented in the lawsuit by the state of Texas itself.

As they were filing their notice of appeal, the disgraced GOP "voter fraud" front man, Hans von Spakovsky --- who also just happens to serve on the "advisory board" for TTV --- challenged the court's rejection of the groups Motion to Intervene in an article published at the right-wing National Review. His work there, as usual, represents a masterful example of deception, dishonesty and well-remunerated cherry-picking. That is, apparently, what Hans von Spakovsky does for a living.

He is amongst good friends in the Republican Fraud community this time out...

Rep. Mel Watt finally approved by bipartisan U.S. Senate vote...

Yesterday, nearly five years after President Barack Obama first assumed office, the U.S. Senate removed what has been described by some progressives as the "single largest obstacle to meaningful economic recovery" when it was finally allowed to vote for the confirmation of Rep. Mel Watt (D-NC) as the new Director of the Federal Housing Finance Agency (FHFA).

In a vote allowed by a recent change to filibuster rules in the U.S. Senate, Watt will now replace Bush appointee Edward J. DeMarco, who was first appointed in 2008 and became the acting Director of the federal agency in 2009.

The FHFA oversees the government-sponsored mortgage giants, Fannie Mae and Freddie Mac, which collectively own 60% of all mortgages in the United States. The agency also oversees 12 Federal Home Loan Banks, which, according to the Washington Post, "serve as major sources of funding for hundreds of banks."

In a statement issued late yesterday, praising Watt's confirmation and chiding Senate Republicans for their obstructionism in holding up this and many other uncontroversial Presidential nominations, Rep. Xavier Becerra (D-CA), Chairman of the House Democratic Caucus, highlighted the importance of the FHFA's intended role in safe-guarding homeowners.

"Republicans in the U.S. Senate callously blocked the confirmation of the supremely qualified Congressman Mel Watt to be our nation's Director of the Federal Housing Finance Agency," Becerra said. "Today, by a bipartisan vote of 57 to 41, Rep. Watt is on his way to lead the FHFA as America's watchdog over the American Dream. What a difference a day makes when the Senate is free of the mischief of exploitive filibusters"...

Gov. Rick Scott and SoS Ken Detzner under fire yet again
'Not worth the paper it's printed on,' one of the defiant officials tells The BRAD BLOG...

At this point, the slogan for Republican Secretaries of State around the country seems to be: "If it ain't broke, break it!"

That's certainly the case in Florida, where Sec. of State Ken Detzner --- fresh off his and Governor Rick Scott's embarrassing and failed 2012 purge of supposed "non-citizen voters" from the rolls (with another more recent attempt underway since then) --- is at it again. And this time, Detzner seems to be facing a full-blown uprising from county Supervisors of Elections (SOE) refusing to carry out a new directive which would make it more difficult for absentee voters to cast their ballot.

The elected SOEs are claiming that the new directive by Detzner, an appointee of Gov. Rick Scott (R), was neither asked for nor necessary under state law. They Supervisors have also denied Detzner's initial claim that the directive was issued in response to requests by two SOEs.

Last week, Detzner issued a directive [PDF] to county SOEs instructing them that they may no longer allow voters to use secured remote absentee ballot drop-off stations created at locations like public libraries and tax-collectors offices. Suddenly, according to Detzner's new rules, all absentee ballots must either be mailed in, or dropped off at county election offices.

The directive was issued just prior to an upcoming special election to replace the late, long-serving Republican Congressman Bill Young in the 13th Congressional District, and it has led to both suspicion for its motives, and somewhat of a bi-partisan mutiny from election officials, leading one well-known Florida SOE to respond tersely to The BRAD BLOG's request for comment last week this way: "I do have a comment, legally it's not worth the paper it's printed on"...

Change in filibuster rule restores possibility of functioning Legislative, Executive and Judicial branches of government...

It took awhile. A few years even. But, on Thursday, Senate Majority Leader Harry Reid (D-NV) finally decided he'd had enough.

By a majority vote of 52 to 48, the U.S. Senate changed their rules to partially end the filibuster, invoking what some refer to as the so-called "nuclear option". The rule change, which will permit an up-or-down majority vote on all Presidential nominations for executive and judicial office (with the exception of Supreme Court nominations), is better described as the "democracy option".

The rule change, for now, would have no effect on the use of the filibuster by the minority to block legislation. Three Democrats, Carl Levin (D-MI), Joe Manchin (D-WV) and Mark Pryor (D-AR), voted with Republicans to sustain the previous filibuster rules, last changed in 1975 when the Senate amended their Standing Rules to reduce the number of Senators required for cloture --- to end debate --- from two-thirds to three-fifths.

Although there had been noise, and urging from many quarters, for a dramatic change of the filibuster rules for some time, especially after Senate Minority Leader Mitch McConnell (R-KY) drew the dubious distinction of becoming the first U.S. Senator in history to filibuster his own bill, the impetus became particularly strong over the past several weeks with the outrageous block put on the nominations of every one of President Obama's nominations to the important D.C. Circuit Court of Appeal, the court which oversees federal regulations.

The result of yesterday's rule change in the U.S. Senate could well be a return, at least in part, to the Constitutionally designed functions of three different branches of government, as envisioned by our founding documents. It may also mark an end to a thirty-year scheme by Republicans to pack the courts with radical, right wing jurists...

Last week, Senator Elizabeth Warren (D-MA), a former Harvard Law Professor, argued that Senators not only have the right, but a constitutional duty to change the Senate filibuster rules. She argued, in no small part to her fellow Democrats, that the rules were being abused by Republicans as part of a "naked attempt to nullify the results of the last Presidential election [in order] to force us to govern as if President Obama hadn't won the 2012 election."

Her remarks (see video and text transcript below) were made in the wake of the third occasion in which Senate Republicans blocked the nomination of an extraordinarily well-qualified female nominee to the important federal D.C. Circuit Court of Appeal.

"Republicans now hold the dubious distinction of having filibustered all three women that President Obama nominated to the DC Circuit," she said. "Between them, they have argued an amazing 45 cases before the Supreme Court and have participated in many more. All three have the support of a majority of Senators. So why have they been filibustered?"

"Well, the reason is simple," she explained, answering her own question. "They are caught in a fight over the future of our courts. A fight over whether the courts will be a neutral forum that decides every dispute fairly, or whether the courts will be stacked in favor of the wealthy and the powerful."

Yes. The minority party in the U.S. Senate is blocking these nominations, not because of the qualifications of these very well-qualified women, but because they are continuing a thirty-year Republican effort to "rig the courts", as Warren explains, by packing the U.S. federal bench, particularly the D.C. Circuit Court of Appeals...

The U.S. Department of Justice has filed a vigorous Opposition [PDF] to a Motion to Intervene [PDF] filed by the Republican "voter fraud" group calling itself "True the Vote." In its motion, True the Vote seeks to become a party to the DoJ's federal legal challenge to Texas's polling place Photo ID restriction law, SB-14.

The DoJ's opposition is rather straightforward. The right wing-funded True the Vote, they argue, has not established that it is entitled to intervene because it sets forth nothing more than a generalized grievance and because its allegation "that illegal voting might be prevented by enforcement of SB 14 is, at best, speculative."

Anyone familiar with this organization and its history, should appreciate how absurd it is that they should be taken seriously at any time, much less allowed to intervene in a critical lawsuit filed in federal court.

Permissive intervention is inappropriate, according to the DoJ, because True the Vote has failed to establish that its interests would not be adequately represented by the State of Texas. Indeed, its participation in the case, DoJ says, would be unduly burdensome in that the group seeks to divert the court's attention from the legal issues relating to polling place Photo ID restriction laws "to issues concerning True the Vote’s numerous allegations of purported voter registration irregularities."

The DoJ notes that, for identical reasons, True the Vote, whose 2011 list of "Recommendations for Legislation" [PDF] was topped by the desire to enact the polling place Photo ID law at issue, was excluded from participating in the Department's legal challenge to last year's ill-fated effort by Florida's Gov. Rick Scott (R) to purge "potential non-citizens" from the Sunshine State's eligible voter rolls.

True the Vote's deceptive tactics should come as no surprise to long time readers of The BRAD BLOG. The group is essentially the latest pretend "election integrity" arm of the Koch brothers-funded, Paul Weyrich co-founded, American Legislative Exchange Council (ALEC)-fueled GOP effort to enact voter suppression laws across the country.

The nature of their hostile, anti-voter tactics, according to the Houston NAACP, included an alleged attack upon its "volunteer poll monitors for handing out water to voters at Early Vote locations and for assisting Disabled and Elderly voters by standing in line for them or asking younger people in line to let the elderly and disabled go ahead of them in the line to vote."

The group's label, 'True the Vote', is nothing short of Orwellian. As detailed by The BRAD BLOG last year (and by others this year) truth and True the Vote remain perfect strangers...

'Harrowing account' of tragedy offered by British 'witness' on TV news mag appears completely untrue, says Washington Post
UPDATED: Davies responds, says lied to employer originally, but telling the truth now...

In what Washington Post's Karen DeYoung describes as an "explosive report" on CBS' 60 Minutes on Sunday, the venerable TV news magazine offered "a harrowing account of the extremist attack that killed four Americans" at the U.S. diplomatic outpost in Benghazi, Libya last year.

Naturally, Fox "News" and others on the Right --- such as Sen. Lindsey Graham who promised on Wednesday to block all of President Obama's nominees following the report --- have been trumpeting it all week.

In the report, CBS' Lara Logan interviews a man pseudonymously identified as "Morgan Jones", a British supervisor of security guards protecting the mission. He tells Logan that, as the attack that night went on and four U.S. officials were ultimately killed, he scaled the compound's 12-foot wall, took out an al-Qaeda terrorist "with the butt end of a rifle" and eventually was at the hospital to witness the lifeless corpse of U.S. Ambassador Chris Stevens.

But, as reported by DeYoung at WaPo today, that story by "Jones", as offered on 60 Minutes, appears to be completely untrue. That "harrowing account" by "Jones," whose real name is reportedly Dylan Davies, is completely at odds, according to the Post, with the written account that he "provided to his employer three days after the attack" when he said he was nowhere near the diplomatic compound on the night of the deadly tragedy...

On Thursday, despite a deal said to have been struck with Democrats in August, Senate Republicans successfully used the filibuster to block meaningful economic reform again.

With just 42 Republican votes, the GOP was able to block the majority and continue to prevent the President's nominee --- his second --- from taking taking the helm at a crucial federal agency, ensuring the man appointed by George W. Bush would remain in that key role.

In late summer, in "GOP Filibuster Still 'Single Largest Obstacle to Meaningful Economic Recovery'", we explained how the Senate’s Republican minority had successfully used the filibuster to prevent the Obama Administration from replacing Bush Administration holdover Edward DeMarco as head of the Federal Housing Finance Agency(FHFA) . The FHFA is the federal agency which oversees government-sponsored mortgage giants, Fannie Mae and Freddie Mac, which own 60% of all mortgages in the United States.

Last year, in a petition to President Barack Obama, the advocacy group Change.Org described DeMarco as "the single largest obstacle to meaningful economic recovery". That assessment was shared by The New York Times' Nobel Prize winning economist Paul Krugman, who called for President Obama to "Fire Ed DeMarco," after DeMarco, in defiance of the Obama Administration, rejected a U.S. Treasury Department request "that he offer debt relief to troubled homeowners --- a request backed by an offer that the U.S. Treasury would pay up to 63 cents to the FHFA for every dollar of debt forgiven."

Although Krugman explained at the time that "a reduction in debt burdens would strengthen the economy," creating "greater revenues" that could "offset any losses from the debt forgiveness itself," DeMarco has consistently sought to protect the Wall Street casino (aka the mortgage backed securities market) against any relief to homeowners who were victimized by those fraudulent schemes.

All of these years later, Republicans in the U.S. Senate, defying the majority will of the American people, continue to help him...

With the 81 - 18 vote in the U.S. Senate and 285 - 144 tally in the U.S. House, Congress averted a worldwide economic disaster this week by finally voting to end the 16-day, 'Tea-Party' manufactured shutdown and debt ceiling crises.

As CNN noted, shortly after President Barack Obama signed the measure into law, Congress has furnished only a "temporary bandage," which leaves the draconian "sequester" cuts in place, authorizes government spending at current levels through Jan. 15, 2014 and postpones the same threat of a default on the nation's financial obligations until Feb. 7, 2014.

Meanwhile, radical 'Tea Party' Republicans, like Rep. Mick Mulvaney of South Carolina, insisted "this was worth having the fight," even as they were conceding absolute defeat.

Worth it? Well, not to actual fiscal conservatives, according to the numbers...

As everything falls apart on The Hill tonight, again, Sen. Ted Cruz' speech writer and senior communications adviser Amanda Carpenter just had the temerity to tweet this...

She must be joking, right? Apparently, she isn't. Just completely and entirely tone deaf. Or just plain stupid. Congressional staffers are being forced to buy their health care on the Affordable Care Act exchanges because Republicans in the Senate added that requirement in an amendment during the fight over the ACA's passage in 2010, hoping that it would be a poison pill to kill the bill. The Democrats called their bluff and said, 'Okay, fine.' And now Carpenter is whining about the uncertainty it appears to be causing her.

That, while she and her boss are bringing down the U.S. government and potentially the global economy, in an attempt to keep some 50 million Americans from getting health care at all. Amazing.

UPDATE: With Fitch issuing a warning tonight that they may soon be forced to downgrade the U.S. government's AAA credit rating, thanks to the GOP's Cruz-inspired threats to default on the debt limit, maybe Carpenter will soon have the chutzpah to whine about the drop in value of her 401k plan.
