In Wisconsin, two Dane County Circuit Court judges, David Flanagan and Richard Niess both issued injunctions against the state GOP's polling place photo ID restriction ("Act 23") --- Flanagan's temporary, Niess' permanent --- after finding that the law was in direct violation of the WI state constitution's guaranteed right to vote.

Immediately after the first of those two injunctions, issued by Judge Flanagan in Milwaukee Branch of the NAACP v. Walker, the WI GOP filed an ethics complaint with the WI Judicial Commission, alleging that the judge had violated the WI Code of Judicial Conduct because he had signed a petition to recall Gov. Scott Walker (R) and failed to disclose that fact before issuing his ruling.

However, when Flanagan's temporary injunction was promptly followed not only by Neiss' permanent injunction one week later, but by a subsequent refusal by an intermediate WI appellate court to stay the temporary injunction, the hard-right, operating under another right-wing billionaire front group, the Landmark Legal Foundation, filed ethics complaints against 29 WI judges who also signed recall petitions.

If you can't beat 'em, hit 'em with ethics violations complaints...

The title of historian Kevin Phillips' otherwise excellent work, Wealth and Democracy: A Political History of the American Rich, is somewhat misleading. With the exception of constitutional monarchies, which preclude royalty from all but figurehead status, democracy and the concentration of great wealth cannot co-exist in the same society.

If citizens can see past the corporate media-erected contest of personalities so as to examine how it reflects the undemocratic structure of our society, the 2012 Presidential election can provide us with a teachable moment of great value. This is true whether we examine the flood of SuperPAC monies, courtesy of the now infamous Citizens United decision, the striking similarities in their methodology of wealth acquisition depicted both in the 1987 movie Wall Street through its fictional Gordon Gekko and in real life by Bain Capital and Mitt Romney, the ridiculously low 13.9% federal taxes on Romney's $21.7 million income in 2010, his extensive Goldman Sachs holdings and as much as $32 million maintained in off-shore accounts, or the fact that only one, essentially marginalized Presidential candidate in either of the two major political parties --- Ron Paul --- is willing to discuss an end to perpetual war and our global military presence.

Here, Mitt "Gordon Gekko" Romney provides the principle focus, not because of personality, or "envy", but because his candidacy affords an opportunity to explore the inconsistency between wealth and democracy...

Election laws in Wisconsin are not covered by Section 5 of the federal Voting Rights Act, which would otherwise require the Dept. of Justice or a federal panel of judges to "preclear" such laws to assure they are not discriminatory. Thus, it falls to non-governmental organizations, such as the American Civil Liberties Union (ACLU), to take legal action in hopes of protecting Constitutional voting rights for citizens of the Badger State.

That's exactly what the organization did this week, in filing a 54-page federal complaint on behalf of some 17 named plaintiffs --- including elderly, student, minority and even veteran voters --- who may well be unable to cast their once-legal vote under the state's new voter suppression bill passed earlier this year by its GOP legislature and signed into law by its Republican Gov. Scott Walker.

The lead plaintiff in Frank vs. Walker [PDF], the ACLU's class action lawsuit filed in the U.S. District Court for the Eastern District, seeking to halt enforcement of the state's new photo ID voting restrictions, is 84-year old Ruthelle Frank.

As we previously reported, Frank has been a lawful resident of Brokaw, WI since her home birth in 1927. Although she has voted in every election since 1948 and is an elected member of the Brokaw Village Board, she learned that she may be barred from voting come February 2012 because she lacks one of the official photo IDs mandated by that state's new vote-suppressing photo ID law.

She was born at home, without a birth certificate, and will be forced to pay $20 to get one in order to get her supposedly "free" ID to vote. But even that may not be enough. Frank recently learned she may not be able to comply with the state GOP's Photo ID restriction unless she coughs up upwards of $200 to amend the Register of Deeds record of her home, which had misspelled her maiden name.

The feisty octogenarian, however, was not about to quietly accept this assault on a right she had exercised without interference for the past 63 years (see a video interview with her below), and so she agreed to lead the ACLU suit.

The ACLU complaint, however, may serve to be larger than just the 17 voters (and thousands of others included as part of 6 different classes) in the state of Wisconsin. If it succeeds, the lawsuit could have national implications that would go well beyond the question of who gets to vote in Wisconsin in the 2012 Presidential election. The case could serve to reverse the bevy of voter-suppression laws being enacted by Republicans in state after state in the wake of their take-over of statehouses across the nation in November of 2010...

While both phenomena --- Occupy Wall Street and the "Tea Party" --- have emerged at a time of acute economic distress and a sense of alienation, disenchantment and betrayal brought on by an increasingly authoritarian corporate capitalism, they are as different as night is to day.

Occupy Wall Street is a genuine, organic, knowledge-driven democratic uprising. Its source, as perceptively described by Ben Manski, Executive Director of the Liberty Tree Foundation, is to be found in a profound "contradiction." "The promise of the Unites States is democracy," he writes, yet "The reality is that corporate elites rule."

The American "promise" is embodied in the lofty, egalitarian principles of the Declaration of Independence, in the recognition provided by the U.S. Constitution that the purpose of government is to "promote the general welfare," and in the concept inscribed above the portico of the U.S. Supreme Court --- "EQUAL JUSTICE UNDER LAW." The "reality," as noted by former New York Times reporter, Chris Hedges, is that political power in the U.S. has been seized by a "criminal class" of rapacious oligarchs, whose radical goal is not merely the ability to carry out their criminal pillage of the economy and the environment with impunity, but the decimation of "all impediments to the creation of a neo-feudalistic corporate state."

The goal of Occupy Wall Street, Manski observes, is "to make the promise the new reality." It is, in that sense, a broader movement than both the civil rights and anti-war movements of the 1960s, for it is not limited to a rejection of Jim Crow and imperial conquest, but a total rejection of the authoritarian corporate security state that the rapacious oligarchs have erected.

Like the occupiers, the indoctrinated followers of the "Tea Party" are experiencing a profound sense of fear, alienation and betrayal. But what the latter do not realize is that theirs is a misdirected anger --- the product of an Orwellian manipulation by the same reactionary billionaires (aka "economic royalists" per FDR) who, in reality, are the source of their economic insecurity and political oppression.

But, before exploring the Orwellian manipulations of billionaire sociopaths, let's examine the underlying political and economic conditions that have given rise to Occupy Wall Street...

A nearly two-hour hearing in the U.S. Senate Judiciary Subcommittee on the Constitution, Civil Rights and Human Rights earlier this month (full video available here), carefully examined the partisan, multi-state effort by the billionaire Koch brothers-funded, Paul Weyrich co-founded American Legislative Exchange Council (ALEC)-fueled GOP effort to enact new state voting laws across the country.

The coordinated, nationwide GOP voter suppression effort was aptly described by Judith Browne Dianis, a civil rights litigator at The Advancement Project, and a witness in the second three-member panel, as "the largest legislative effort to roll back voting rights since the post-Reconstruction era."

"Our country has not seen such widespread attempts to disenfranchise voters as we have seen this year in more than a century. Inclusive democracy is under attack," she testified, while Sen. Sherrod Brown (D-OH) described the "brazen" GOP attempts to undermine the right to vote.

Subcommittee Chair and Senate Majority Whip, Dick Durbin (D-IL) broke the new state voting laws into three major categories, and the discussions of each are worth covering here over two different articles. In Part 1 here, we'll cover the first category: Polling place Photo ID laws restricting the ability of lawfully registered voters to cast their ballot on Election Day. The hearing produced several remarkable face-offs, including between Sen. Al Franken (D-MN) and long-time GOP "voter fraud" front man Hans von Spakovsky (cue James Bond villain music), as detailed below.

In Part 2, we will cover the discussion of the other two categories at the hearing --- draconian new restrictions on voter registration, and laws which significantly reduce early voting periods --- plus a very troubling event that "reactionaries" have planned for the 2012 election, according to Dianis' testimony [UPDATE: Part 2 is now posted here]...

State AG vows to litigate 'up to U.S. Supreme Court'...

In an Aug. 29, 2011 letter, T. Christian Herren, Jr., Chief of the Obama DOJ's Civil Rights Division, not only demanded that South Carolina, within 60 days, provide additional information about its recently enacted polling place photo ID restriction law, but stated that if SC failed to provide a timely "response...the [U.S.] Attorney General may object to the proposed changes consistent with the burden of proof placed upon the submitting authority."

Herren noted that SC has the "burden of demonstrating" that the new polling place photo ID law was neither enacted "for a discriminatory purpose nor will have a retrogressive effect."

SC's Republican Attorney General, Alan Wilson, in an apparent recognition that pre-clearance is likely to be denied, told those in attendance at a GOP fundraiser that he had "no faith" that the DOJ "will do the right thing." He vowed to litigate the matter "up to the U.S. Supreme Court if necessary."

As The BRAD BLOG previously reported, on Aug. 5 the ACLU submitted a 15-page letter to the U.S. Department of Justice (DOJ) seeking a denial of pre-clearance under Section 5 of the Voting Rights Act of South Carolina’s polling place photo ID restriction law. The letter argues that proponents’ unsubstantiated claims of "voter fraud" were but a pretext for unlawful discrimination and that statistics suggest that the new law would operate as an illegal poll tax, especially for the disproportionate number of African Americans who live below the federal poverty level in the state.

Last Friday, SC's Senate Democrats weighed in as well, asking the DOJ to deny pre-clearance for what they contend is the nation's harshest polling place ID restrictions, which could potentially disenfranchise, for example, someone whose driver's license has been suspended.

While denial of pre-clearance due to the retrogressive effect of photo ID restrictions in SC would be a positive step, it will not serve to protect democracy and the sanctity of the vote in other jurisdictions not subject to pre-clearance under the Voting Rights Act of 1965.

As described by John Nichols in The Nation (see video below), and again by Ari Berman in Rolling Stone --- as we detailed yesterday --- state-after-state across the nation has come under a well-coordinated assault by the corporate-funded American Legislative Exchange Council (ALEC) and GOP legislators bent on rigging electoral outcome as part of their war on the middle class...

Noting that someone earning $106,000 a year contributes the same amount as a billionaire, Sen. Bernie Sanders (I-VT) announced his intention to introduce the "Keeping Social Security Promises Act."

The legislation, modeled after a promise President Obama made during his 2008 campaign, would attach the Social Security payroll tax to all incomes over $250,000.

Sanders cited the Chief Actuary of the Social Security Administration, who said that the move would "ensure that Social Security can pay out all benefits for at least the next 75 years."

Receiving a standing ovation from some 3,000 labor leaders at last week's Las Vegas United Steelworkers Convention (see video below), Sanders blasted both Republicans and those Democrats who've called for cuts to Social Security. He noted that as Social Security is funded by the payroll tax and not the U.S. Treasury, it "has not contributed one nickle to the deficit."

"In fact," said Sanders, "according to...the Congressional Budget Office, Social Security has a $2.6 trillion surplus."

"When [Social Security] was developed, 50% of seniors lived in poverty," explained Sanders. "Today…that number is 10%. Social Security has done exactly what it was designed to do….For 75 years…Social Security has paid out every nickel owed to every eligible American."

The Senator went on to tell the union workers in Vegas that he'd "be damned if they're going to cut Social Security."

Ah, the 2012 election cycle is fast approaching. The Plutocrat (aka 'Republican') Party is in the process of garnering funds from far-right billionaires like the Koch brothers in order to present their usual "jobs, jobs, jobs" propaganda.

"Jobs, jobs, jobs" will come to us not only by way of paid-for political ads, but by way of corporate MSM "coverage" which will conveniently neglect to mention that the GOP-controlled House has not offered a single bill that would create a single job, or that the 2010 GOP "victories" have merely produced an all out assault on the middle-class including an effort to eliminate Medicare, an assault on the fundamental right to engage in collective bargaining, and drastic cuts in programs designed to protect the health, safety and economic well being of the vast majority of the American people at the same time they tirelessly strive to protect subsidies for the oil cartel and tax breaks for billionaires.

Against this backdrop, Robert Reich has come up with this two minute, fifteen second explanation of "What’s Wrong with the Economy..."

"I don’t want everybody to vote," Paul Weyrich, co-founder of the billionaire-funded Heritage Foundation and the Moral Majority, said while addressing a right-wing Christian audience in 1980. "[O]ur leverage in the elections goes up as the voting populace goes down," he added after he denigrated those who seek "good government" through maximum, informed voter participation as people who suffer from the "goo goo syndrome."

Voter suppression has long been a staple of American politics, but the tsunami of new restrictions on the polling place now being rammed through by newly-elected Republican majorities in state after state is unprecedented, certainly since the era of Jim Crow was supposed to have been ended by the Voting Rights Act of 1965.

While most Americans may think of the poll tax and literacy tests as forms of voter suppression associated the Jim Crow South, the confirmation hearings of the late U.S. Supreme Court Chief Justice William Renquist included sworn testimony from former U.S. Attorney James Brosnahan and others reflecting that, as an early 60's GOP activist, Renquist intimidated African-American and Hispanic voters in AZ by challenging their ability to read.

1965's Voting Rights Act outlawed both the poll tax and literacy tests. In more recent times, pursuant to a 1987 federal court consent decree, and a subsequent provision of the National Voting Rights Act of 1993, another GOP suppression tactic, "caging lists," was banned, though as documented by the BBC's Greg Palast, the Bush administration-led Plutocrats didn't let a little matter like illegality get in the way of their use.

21st Century voter suppression operates under cover. Or it had, until the new wave of legislation being passed by GOP legislatures across the country began hitting its stride. Until FL's then-governor Charlie Crist overturned it, for example, the state banned convicted felons from voting even years after they'd been released from prison. In Armed Madhouse, Palast asserts that prior to the 2000 Presidential election, FL's then Sec. of State Katherine Harris, appointed by Gov. Jeb Bush, the brother of candidate George W. Bush, purged 94,000 "felons" from the state's computerized voter rolls, though the only "crime" at least 91,000 were guilty of was "being Black, Democrat or both."

Over much of the past decade, voter suppression efforts have been bolstered by bogus "voter fraud" claims leveled at groups like ACORN, who aided in the registration of those who might be likely to vote against the GOP (minorities and the working class); "non-partisan" GOP astroturf groups like the phony American Center for Voting Rights (ACVR) created after the 2004 election solely to create and spread false propaganda about a Democratic "voter fraud" epidemic; laws meant to increase the legal risk to real non-partisan organizations for assisting in registration; draconian polling place "photo ID" restriction laws, and in a reduction of opportunities for early voting.

With the tide of GOP victories at the ballot box last November, those efforts have now been ramped up and are now front and center in some 30 state legislatures across the country...

Sanders introduces 'Medicare-for-All,' single-payer bill in Senate; Paul argues it would 'enslave' physicians...

With the backing of the AFL-CIO, National Nurses United, and the International Federation of Professional & Technical Engineers, Sen. Bernie Sanders (I-VT) and Rep. Jim McDermott (D-WA) simultaneously introduced the American Health Security Act of 2011, a Medicare-for-All single-payer system.

The move triggered a "provocative, interesting discussion," as Sanders described it, during a Health, Education, Labor, and Pensions subcommittee hearing in the Senate last week in which the Vermont Senator squared off with Sen. Rand Paul (R-KY) (see video below). Sanders and a physician-witness agreed that treating healthcare as a "right" is consistent with the Hippocratic Oath. For his part, Paul, a self-certified physician, claimed that the establishment of healthcare as a right would turn physicians and their staffs into slaves, with the possibility of police barging into their houses at night to arrest them. Paul's theory that medical care for all "enslaves" doctors and all of those who choose to work in their offices, would no doubt come as a surprise to many physicians who live comfortably in single-payer countries, like the wealthy UK physician interviewed by Michael Moore in Sicko!

Dr. Paul's remarks underscore the extent to which ideology has obscured a basic reality that the core problem is not the ability of American physicians to deliver quality healthcare, but the absurdity of a society which places a greater value on accumulating obscene wealth in the hands of the privileged few above the health and very lives of its citizens...

Sex scandal adds steam to powerful WI recall locomotive...

While it should hardly be necessary, given the extent to which the GOP's billionaire-funded direct assault on workers' rights has exposed the Orwellian deceptions of the so-called 'Tea Party' movement, there are times when the adage, "sex sells," seems unavoidable, especially when it involves exposing the vast gap between the right-wing's professed "family values" and "fiscal responsibility" and a reality that includes infidelity and an eager willingness to squander public funds on friends and the billionaire sociopaths who fund their campaigns.

No doubt, Chris Bowers, the Campaign Director of the Daily Kos, understood this when he sent out a fund-raising email which, as reported by Rich Mitchell of the Conservative Daily News, reads, in pertinent part:

Last year, Wisconsin Republican state Senator Randy Hopper left his wife to live with a young Republican political operative. Last month, as Governor Scott Walker unveiled legislation calling for deep cuts in state workers' salaries and collective bargaining rights, Hopper's mistress was hired by the state on the advice of Scott Walker's cabinet as a "communications liaison." Further, her salary is 35% higher than her predecessor's.

Randy Hopper is one of the most vulnerable Republicans facing recall. He is a freshman, and only won his seat by 163 votes. A poll conducted by Daily Kos and PPP shows Hopper losing to a generic Democrat 49%-44%.

Mitchell denounced the salacious allegations as a "smear", though he offered no evidence in support of that claim to counter what appears to be an accurate account of Hopper's infidelities and the questionable hiring of his girlfriend, the GOP operative Valerie Cass, by the new administration of Gov. Scott Walker.

While there is always a legitimate question as to whether marital infidelity should disqualify an individual from holding public office, here the issue arises in the context of allegations of nepotism and hypocrisy, not to mention the issue of whether the Fond du Lac Republican could lawfully cast a vote opposing his own recall, now that, as his estranged wife admits, he no longer resides in his own district. He lives with Cass elsewhere.

This new sex scandal adds to a powerful, substantive recall message which has gained a great deal of momentum over the last several weeks...

PLUS: Correlating the demise of unions and U.S. wealth disparity...

Rep. John Mica (R-FL), Chair of the House Transportation Committee, inserted union-busting language into the 2011 Federal Aviation Administration Re-authorization bill.

His remarkable display of contempt for the democratic aspirations of working class Americans comes as little surprise, unfortunately. Mica, during his time in office, has received more than $620,000 in campaign contributions from the airline industry.

The Mica clause would block a rule adopted by the federal National Mediation Board which, according to the Communications Workers of America permitted airline and railroad workers to achieve "union representation based on a majority of votes cast, in line with the National Labor Relations Act rules governing union representation across all other industries." Instead of accepting the rules of a democratically held election of workers, Mica wants to count those who are eligible to vote, but who fail to do so, as votes against unionization.

Over the dissent of three Republicans and every Democratic member of the Committee, the House Transportation Committee rejected "an amendment by Rep. Jerry Costello (D-IL) to strip Mica's anti-union language from the bill."

Mica's new definition of "democracy" underscores the observations we set forth in "Gov. Walker's Wisconsin 'Union Busting' Exposes 'Tea Party' Scam, Duped Americans" as to how so many working class Americans have been "taken in by the lies and deceptions of billionaire sociopaths, like oil-baron David Koch...[whose] aim is not liberty, freedom, and jobs but American fascism, corporatocracy, and the 'eternal subjugation of the common man.'"

That subjugation flows from the disparity of power that accompanies a growing disparity of wealth, which, in turn, correlates with the demise of unions in the U.S...

UPDATED TWICE: Pressure said rising again at nuclear reactor Unit 3, now stabilized after all...

Choosing an interesting way to 'celebrate' the 8th anniversary of the launching of Tomahawk cruise missiles into Iraq kicking off our invasion there on March 19th, 2003, the U.S. Commander-in-Chief Barack Obama approved the launching of Tomahawk cruise missiles into Libya on the anniversary today, as a five-nation coalition began to carry out a U.N.-approved No Fly Zone mandate over yet another oil rich Middle Eastern nation.

In response, the Tokyo Electric Power Co. (TEPCO), General Electric, The Shaw Group, the U.S. Chamber of Commerce, and the rest of the nuclear energy lobby sent a thank you note to Libyan dictator Col. Muammar Gaddafi, as the world media quickly turned their attention en masse to the new military action in the Middle East and away from the still-pending nuclear disaster at the Fukushima Daiichi nuclear plant in Japan.

In related sarcastic and fake news, Wisconsin Governor Scott Walker (R-Koch) tore off all of his clothes and danced naked with glee in celebration, by himself, in the middle of the capital rotunda in Madison. No media were there to capture the moment.

Meanwhile, in news that is neither sarcastic nor fake, but seemingly impossible upon everything else, a giant 100-mile oil slick has been spotted in the Gulf of Mexico, off the coast of Louisiana near the site of last year's BP deepwater oil drilling disaster. And yet with all of that, CNN has still not announced plans to scale back the 150 staff contingent they are set to deploy to cover next month's Royal Wedding in the UK.

In still more, let's call it irony, over a 100 demonstrators, including "Pentagon Papers" whistleblower Daniel Ellsberg, were arrested at the White House Saturday, protesting all the wars we were in prior to today, as well as against the reportedly deplorable conditions of detainment for 23-year old Army Private Bradley Manning, accused of leaking classified war documents and diplomatic cables to WikiLeaks. Many of the same protesters were arrested in a similar protest at the White House in December, also for failing to obey orders as they handcuffed themselves to the White House fence, though few media bothered to cover that demonstration either. Another rally is set for tomorrow in support of Manning, also sure to be ignored, at the Quantico Marine Corps Base in Virginia where he has been held in solitary confinement, reportedly, 23 out of 24 hours of each day for the last nine months.

At Fukushima today, only a bit more noticed, McClatchy reports that the spent fuel rod pool at reactor No. 3 is said to be "stabilized," with radiation levels dropping there after 13 hours of sea water was sprayed onto it with water cannon trucks [* See UPDATES below for more on Unit 3 issues.]; the Unit 4 fuel pool --- where, as we reported last night a "renewed nuclear chain reaction [was] feared" --- may in fact be cracked and leaking water, but with Unit 3 "stabilized" for now, fire fighters have turned the water cannon trucks onto that unit in hopes of cooling it down as well; and late last night, power was restored to Units 5 & 6, with pumps said to be working and the cooling ponds in both reactors cooling from their previously reported temperatures around 65C, back towards the desired temp of 25C. The readings there today were 37C and 41C respectively, in what can certainly be considered a bit of good news in a story desperate for some...
