You may be happy to know we don't begin today's BradCast with news about the disgraced former President. But you may be less happy about what we do lead with, especially if you own a home or a car or live on Planet Earth. [Audio link to full show follows this summary.]

Among our many stories today...

  • Recently, Federal Reserve Chair Jerome Powell confirmed that, thanks in no small part to our quickly worsening climate, insurance rates for cars and homes continue to skyrocket. Yes, manmade climate change is a key factor in slowing the decrease of inflation (which, of course, is just one reason Republicans would rather do nothing about it). As the frequency and intensity of weather-related disasters quickens (just ask the folks in New Orleans who were swamped with some 8 inches of rain in a matter of hours last week), the cost of insurance is spiking, becoming unaffordable for many and even unattainable in a number of coastal states. You may soon discover that your home is worth a lot less than you think, thanks to the climate crisis. We step through some of those grim details today, the trillions of dollars it is ALREADY costing Americans, and the even grimmer news about what is still to come unless and until we can end the burning of fossil fuels that is only beginning to wreak so much havoc across the entire globe.
  • We started reporting on this story last week, when it didn't seem like it could really be a story. Well, it's beginning, at least, to look more like it really could be a real story. Ohio's Republican Attorney General has now joined the state's Republican Sec. of State to say they will not allow Joe Biden on the state's ballot this November unless the Democratic Party certifies his candidacy before the state's statutory deadline of August 7. The Democratic National Convention, which is set to officially nominate the President, doesn't happen until August 19. When a similar situation occurred in 2020 --- which might have kept Donald Trump off the ballot --- the GOP state legislature simply changed the statutory deadline for that year. But now, because it's only Democrats whose convention isn't scheduled to take place until after OH's 90-day deadline before the November 5th election, Buckeye State Republicans seem to be suggesting they may actually not put Biden on the ballot...as impossible as that seems to believe. Let the lawsuits begin...
  • The Nevada Supreme Court on Thursday overturned a lower court ruling that had blocked a broad, Constitutional "Reproductive Freedom" measure to protect prenatal care, abortion, vasectomies and infertility care from appearing on this November's ballot in the critical battle ground state. Supporters of the measure are celebrating today, but are also said to be gathering signatures for a second measure that will focus only on abortion rights for this year's ballot.
  • After two of seven previously-seated jurors were dismissed on Thursday morning in Donald Trump's criminal trial in New York, seven more were seated before the day was done. Barring any other dismissals, that fills out the 12 jurors that will be needed to begin the case proper, once six alternate jurors are chosen. The judge admonished the press for reporting enough details about jurors that one who asked to be removed this morning said that friends had been able to identify her from media reports. Also, after prosecutors earlier this week sought sanctions against Trump for three violations of his gag order, they cited another seven incidents since then. That issue will be heard next week. Opening Statements in the trial could begin as early as Monday if the case continues to move briskly forward.
  • Very exciting news is underway in the South this week, specifically in Tennessee, where workers at a Volkswagen plant in Chattanooga are now voting to unionize and join the United Auto Workers. Workers at the plant seem confident that the election will be successful. But that's just the first of 13 non-union automakers who are being targeted for unionization by the UAW since labor unions huge victories last year in strikes against GM, Ford and Stellantis (which now owns Jeep and Chrysler). Another election is likely to happen soon at a Mercedes-Benz plant in Alabama, with 36 non-union plants targeted in all. If workers are successful in unionizing at both VW and Mercedes in the two southern states, according to one labor historian, it "would be nothing less than an earthquake" for the labor movement and its "biggest breakthrough in private-sector organizing in decades." It apparently has anti-labor Republicans worried. In a joint statement described by one expert as "unprecedented and shocking", six southern state governors, all Republican --- from Tennessee, Alabama, Georgia, Mississippi, South Carolina and Texas --- issued a joint statement on the day before voting began at VW, charging that "unionization would put our states' jobs in jeopardy." Kentucky's Democratic Governor, Andy Beshear, by contrast, announced last week that he was "proud to stand shoulder-to-shoulder" with the UAW.
  • Finally, in case we didn't frighten you enough with our opening coverage of the catastrophic, climate change-fueled weather driving insurance rates through the roof, Desi Doyen joins us for our latest Green News Report with much more to frighten you about. But she also has good news for workers as well, and bad news for the fossil fuel industry tools at Fox "News"...

I should be in bed nursing my illness (whatever it is), rather than doing today's BradCast. But given the firehose of news, some of it huge, that broke after yesterday's guest-hosted show with Nicole and Desi (thank you, guys!) and today, I felt I had to come in for this one. Nasal congestion be damned. [Audio link to full show follows this summary.]

Back in 2018, as Trump-nominated Supreme Court Justice Brett Kavanaugh was lying his way through his Senate Confirmation hearings, he made what sure sounded like a threat at the time. "This confirmation process has become a national disgrace," he whined through angry tears. "And as we all know, in the United States political system of the early 2000s, what goes around comes around."

There has been a boatload of important news over the past 24 hours. But what may have been Kavanaugh's long-promised "comes around" moment may have finally occurred last night. The U.S. Supreme Court came up with at least 4 votes to hear Oral Argument of Donald Trump's ridiculous claim that Presidents enjoy "absolutely immunity" for any and all crimes they may commit while in office --- including ordering Seal Team Six to murder domestic political opponents, as Trump's lawyer's argued in this case at the lower D.C. Court of Appeals.

The federal appellate court, as well as the trial court below it, unanimously rejected the argument. But, rather than taking up the case three months ago, when Special Counsel Jack Smith asked them to, the corrupt SCOTUS waited more than two months before deciding, in a terse, one-page order [PDF], to "expedite" the matter by hearing it...seven weeks from now. The question will be: "Whether and if so to what extent does a former President enjoy presidential immunity from criminal prosecution for conduct alleged to involve official acts during his tenure in office." --- Which "official acts" they may be referring to are uncited.

In the bargain, Trump's previously scheduled May 4th federal trial date for attempting to steal the 2020 election remains on on pause and may not now even begin before the 2024 election.

At the same time, in New York state court on Wednesday, an appellate judge, within hours after Trump's filing, rejected his attempt to offer a $100 million bond to prevent Attorney General Letitia James from beginning seizure of his assets in about 30 days for failure to post cash or a bond for the full $454 million penalty he faces for a decade of massive fraud via his corrupt real estate company. And Trump's criminal trial in the state, on 34 charges related to cheating to win the 2016 election with hush-money payments to a porn star, is set to begin at the end of next month.

Given my physical condition of late, we called in our good friends and very wise longtime fellow bloggers HEATHER DIGBY PARTON of Salon and Hullabaloo, and 'DRIFTGLASS' of The Professional Left Podcast, to help make sense of these key, historic events. They each offer context and analysis of what appears --- to them at least --- to be one of the most corrupt actions ever taken by our corrupted, far-right, Trump-appointed supermajority on the High Court.

Driftglass argues the news from the Court on Wednesday is that "It's a corrupt court. And that corrupt court has rendered a corrupt decision," underscores his belief that Trump will never see a day in prison. Digby reminds us that true accountability was always going to come from only one place: the voters at the ballot box this November. "I'm sorry to have to tell you," she tells me, "but it's going to have to be a grinding out of a Presidential campaign and people are going to have to vote this guy out."

We've got a lot of ground to cover on today's program, with smart insights from both of them as usual, even if I don't have the energy to document much of it here for you today. So, please tune in.

There's one point, however, that I didn't get to on the show --- blame the cold medicine --- in response to the somewhat grim and arguably cynical (if accurate) assessments from Digby and Driftglass. That is, that even if Trump's federal trial for attempting to steal the 2020 election had moved forward, as scheduled, well before this November's election, I think the magic bullet moment that had been applied to that trial --- as if a guilty conviction would be an elixir that finally woke up the nation to how corrupt he truly was, leading supporters to abandon him --- was always, in my estimation, somewhat overblown.

When (not if) Trump is found guilty on any of the 91 criminal counts he is currently facing at both the state and federal level, his supporters will find a way to justify it and continue their support nonetheless. It'll be a evidence of a "corrupt system" or "Joe Biden's witch hunt" against Trump, etc.

I have never quite bought into the prodigious polling which suggests his 2024 support would crater once he was finally found guilty of a crime. His supporters know what he did. We all do. It's obvious. A criminal conviction is unlikely to change many opinions of him either way. This was and still will be --- as both Digby and Drifty point out --- about the VOTERS showing up and VOTING to save our democracy from the clutches of a fascistic, sociopathic, narcissist hell-bent on destroying it for revenge. Whatever happens between now and November 5, nobody else was ever gonna do it for us.

Finally today, Desi Doyen joins us for our latest Green News Report, as winter heat in the center of this nation blew away records for February, topping out in the 80s and 90s in huge swaths of the region over the past week. That helped touch off what is now the largest wildfire in Texas history. In February! That, and much more on today's GNR.

Legislation is hard. It involves compromise and stuff. But the bulk of Republican state Senators in Oregon won't have to worry about that anymore. At least for a few years. Also, stealing money from your duped political donors to cover your mountain of legal fees to defend your law breaking appears to be very easy if you are the disgraced former President. And, a whole bunch of landmark climate and energy successes under Joe Biden that you likely haven't about, but should have. Those are just some of the many news stories covered on today's BradCast. [Audio link to full show follows this summary.]

Among them...

  • As of airtime, we're still waiting for (sorta overdue) key rulings on Donald Trump's ridiculous "Presidential Immunity" claims at the DC Court of Appeals and on how much Trump and company (and sons) will have to pay up in New York's $370 million bank fraud suit against them. In the meantime, Trump has lost again today in court on an entirely different matter. This time in London, where his lawsuit against the Steele Dossier's author was summarily dismissed by a UK judge (just as the similarly absurd suit filed by Trump against Christopher Steele, Hillary Clinton and top FBI officials was rejected by a U.S. judge in 2022.)
  • All of those failed lawsuits, and defending himself against civil cases and four criminal felony indictments is costing Trump's gullible dupes/supporters a lot of money. New FEC filings released today reveal that Trump spent/blew $27 million of his donors' money on personal legal bills in the second half of last year, bringing the total amount of campaign donor money used for legal fees in 2023 to about $50 million. That number is expected to be much higher in 2024, giving the phrase "chump change" a whole new meaning.
  • The Oregon Supreme Court, on Thursday, determined that 10 Republican state Senators may not run for office in 2024, after violating a 2022 state Constitutional Amendment adopted by voters in a 36-point landslide that year. The measure bans state lawmakers from running in the next election after they've accrued more than 10 unexcused absences. The GOP state Senators in question walked out for a record 6-weeks in 2023 in hopes of blocking legislation on abortion rights, LGBTQ rights and gun safety, delaying or killing hundreds of other bills in the bargain. The state Senate currently has only 12 Republicans. Ten of them, including the chamber's minority leader, are now barred from running for reelection this year.
  • The U.S. House passed a bipartisan bill! It is compromise tax legislation. Republicans agreed to offer modest tax relief to low income families with children, so long as Democrats agreed to extend huge tax breaks to wealthy corporations and small businesses. Nobody got everything they wanted, and the legislation, adopted on Wednesday by a lopsided 357-70 House vote, will almost certainly change or be killed altogether in the Senate. But that's how legislation works. Or is supposed to work. Or used to work. And, for one day this week, incredibly enough, it did again. We discuss why it did.
  • "Government, in a large, wealthy, functional modern democracy, is pretty boring. Lots of bureaucracy, lots of agencies, lots of complexity, lots of rules, mostly incremental change. It's not particularly dramatic," noted our friend climate and energy journalist David Roberts on Twitter on the last day of the year. "That makes it a very poor fit for the dynamics & demands of modern media, especially social media. Drama, outrage, sweeping counterintuitive generalizations --- these are the coin of the realm. No one gets clicks by celebrating the workaday operation of the gov't machine," he continued. "Consequently, boring democratic governance --- perhaps the greatest advance in collective human welfare in history --- has no day-to-day defenders. Basically everyone is incentivized to take it for granted."

    Of course, we are defenders of that "boring democratic governance" and we don't take it for granted. Roberts was linking to a lengthy --- and wildly enlightening --- thread from former professor turned White House clean energy policy advisor Costa Samaras, who detailed a stunning year-end list of positive, landmark environmental actions and initiatives undertaken by the Biden-Harris Administration in the wake of passage of the Bipartisan Infrastructure Law and the Inflation Reduction Act (adopted only by Democrats). If you think Biden has done little for climate and clean energy you may want to review Samaras' list.

    Just one of dozens of examples: "The Inflation Reduction Act & @POTUS' agenda have supercharged U.S. grid-scale energy storage. Before the Biden-Harris Administration, grid-connected energy storage was basically zero. This year there will be 9 Hoover Dams worth of batteries on the grid. Next year: 16 Hoover Dams."

A whole lot of climate related political news converges on today's BradCast. [Audio link to full show follows below this summary.]

You'll not be shocked to learn that Donald Trump is still lying to his followers about climate change, clean renewable energy and electrification. No, as he lied during a recent rally in Texas, California didn't experience "blackouts all over the place this summer". We had zero, in fact, thanks to renewable energy and battery storage, and haven't had one since 2020.

Sadly, however, Trump is hardly the only Republican politician willing to hoax his own supporters on behalf of the deadly fossil fuel industry which funds so much of the party. At last week's GOP Presidential Primary Debate in Miami --- of all places --- none of the candidates even mentioned climate and, shamefully, neither did the NBC News moderators, who failed to ask a single question about the most existential crisis facing our planet. In Miami!

But the facts about the climate crisis, caused largely by the burning of coal, oil and natural gas, continue to flood in, along with our rising and warming seas, whether any particularly party remains in denial or not. On Tuesday, the U.S. Government released its Fifth National Climate Assessment, a 37-chapter, 2,200-page report which includes an interactive atlas that allows users to zoom down to the county level across a nation where warming is far outpacing the global average.

Climate related disasters are touching every corner of the country, and --- in addition to lives lost --- it's costing an extraordinary amount of money. Last year alone cost U.S. tax payers $178 billion in damage from climate-fueled storms, wildfires and droughts, etc. The new report, as terrifying as it may be, is also hopeful, as it details how it is still not too late to implement already existing tools to mitigate at least the worst of the dangers still to come.

And, on Tuesday, the world may have received a big boost toward that goal, with an announcement by the U.S. and China, in advance of President Biden's meeting today with President Xi Jinping, that the two nations have agreed to jointly ramp up the use of wind, solar and other renewable energy in hopes of displacing fossil fuels in the near future. That's a big deal, as both countries agreed to "pursue efforts to triple renewable energy capacity globally by 2030."

But how do we overcome GOP fossil-fuel funded intransigence (and lies) which have made China very wary that any agreement struck now with the U.S. may not be honored if Democrats are displaced from the White House in the future?

That remains a challenge. But there may be a glimmer of hope for the GOP, as a recent op-ed at The Hill details "The global climate solution Republicans have been looking for". What is that solution? A bill recently introduced by three Senate Republicans --- Bill Cassidy (LA), Lindsey Graham (SC), and Roger Wicker (MS) --- called the Foreign Pollution Fee Act of 2023.

What would it do? It would impose a fee on imports of certain carbon-intensive products manufactured in nations without the same kind of environmental regulations that make similar products more expensive to produce in the U.S. Several weeks ago, the European Union announced a similar tax that puts a fair price on carbon emitted during production of goods that are imported into the EU. They call theirs a Carbon Border Adjustment Mechanism.

Its sounds kind of geeky, but only because it is. It would, however, according to my guests today, both help to lower emissions around the world and bring overseas jobs back to the U.S.

We're joined today by MATTHEW LEE, author of the aforementioned opinion piece at The Hill and a Federal Policy Specialist at the non-profit Evangelical Environmental Network (EEN). We're also happy to be joined by REV. DR. JESSICA MOERMAN, President and CEO of EEN, which has long carried out the mission of educating and mobilizing evangelical Christians to reclaim the Biblical mandate of caring for creation and working toward a healthy, stable climate.

Lee explains the Republicans' policy proposal, how it would work, and what it hopes to accomplish. Moerman, who, as it turns out, is also (helpfully) a Ph.D. in Earth and Atmospheric Sciences, also offers her insights into this week's alarming Climate Assessment Report. She was at the White House on Tuesday when the report was released, and when Biden announced $6 billion in new investments to help mitigate the worst of the climate challenges we are all facing.

"For many decades, our country has had higher environmental standards than other countries," Lee tells me today. "American products are among the cleanest in the world. The problem is that because our companies are held to higher standards, there's an incentive for companies to offshore their factories and take advantage of looser regulations abroad in order to increase profits. This is a problem that a carbon border adjustment or foreign pollution fee, or whatever you want to call it, addresses. If companies have an incentive to offshore their factories to take advantage of looser regulations abroad, let's just charge them a fee when they want to import their products back to the U.S."

"Fossil fuel pollution killed 8 million people around the world --- that accounts for 1 in 5 deaths --- in 2018," Lee says. "If there's any way that we can use our policies to incentivize foreign governments to do better in protecting the health and lives of their citizens and children everywhere, that's something that we should get behind. That's something that Republicans would totally get behind, evangelicals, and anyone who really cares for the health and lives of people around the world."

For her part, Moerman assures me this Republican proposal has no poison pills we might otherwise expect from a "Republican climate bill". "I understand your skepticism," she says. "As we are looking at policy options, we always look at, first, does it defend life? Does it make sure that it's defending the health and livelihoods of all people? Does it protect the environment or, as we see it, God's Creation? And, also, does it support those family-sustaining careers in the clean economy? This one checks all of those boxes."

In speaking about evangelical community's move to the political right in recent decades, Moerman contends "we are seeing a real shift in our community. As evangelicals, we are people who take the Bible seriously. That means we also have to take seriously our biblical mandate to care for God's Creation." She explains that progress is being made in her community "whenever we talk about it in this framing. Take climate out of the partisan political space, the culture war space, and really root it in scripture, in our faith of following through on our values of honoring God, by taking that stewardship mandate seriously. And also loving our neighbor by ensuring that they have that healthy environment and safe climate to thrive in."

Will it work? Will Republicans in Congress take hold of that mandate when, as Moerman notes, "20% of deaths [across the world] can be attributed to fossil fuel pollution"? She says the U.S. steel, aluminum and even oil and gas industry is supporting the bill, "so that should make Republicans pay attention."

We'll see. I remain skeptical, but hopeful. Lee says that Wicker has taken his name off the measure, so we'll see if that is a bad omen. But, we've got to do something, at this point, and we need to do it fast. At least if "God's Creation" might have a chance of surviving our ever-worsening climate nightmares...
