Whether statistician Beth Clarkson, PhD, head of Wichita University's National Institute for Aviation Research, is ultimately proven correct, today's must-listen, in-depth interview with her on The BradCast should remind us all, once again, why neither election officials nor voting systems are simply to be trusted.

Without the ability to carry out public oversight, democracy vanishes. That's what's happening right now in the state of Kansas, where Sec. of State Kris Kobach is attempting to block Clarkson's legal attempt to audit touch-screen voting system "paper trails" in Sedgwick County (Wichita), the state's most populous county.

Confirming a theory initially reported by two other statisticians in 2012 [PDF], Clarkson has found that computer-reported results from larger precincts in the state, with more than 500 voters, show a "consistent" statistical increase in votes for the Republican candidates in general elections (and even a similar increase for establishment GOP candidates versus 'Tea Party' challengers during Republican primaries). Those results run counter to conventional political wisdom that Democrats perform better in larger, more urban precincts.

The larger the precinct size, she explains on today's program, the higher the percentage of the vote for the GOP candidate. Clarkson finds "that is the case, and that is a relationship that is unexplained and very troubling." Previously, statisticians Francois Choquette and James Johnson found a similarly unexplained relationship while examining reported vote totals in Iowa, New Hampshire, Arizona, Ohio, Oklahoma, Alabama, Louisiana, Wisconsin, West Virginia and Kentucky.

Even more disturbing, in hopes of further testing her theory, Clarkson has filed a lawsuit under the state's public records act in hopes of auditing some of the so-called "paper trails" from the state's unverifiable touch-screen voting systems, but Kansas Sec. of State Kris Kobach (a long-time GOP vote suppression champion) is fighting her access to those records in court. Clarkson tells me she believes the statistical pattern she confirms in KS is evidence of rigged elections.

"There have been a few theories advanced," to explain the statistical pattern. "The one I find most probable is that the voting machines are being manipulated. Their vulnerability seems to me a fairly high-probability explanation for this particular pattern. It fits exactly what you'd expect to see if people are flipping the votes within voting machines."

While I've been skeptical of the general theory for some time, for reasons that I explain during the program, Clarkson makes a compelling case, particularly for the ability of the public to oversee their own elections by examining the voting systems in question. If the public is not allowed to examine the so-called "paper trail" of these god-forsaken machines, what good are they?

"Suspicion isn't proof," Clarkson is careful to note. "The reason I'm suing for the paper records is because an audit can provide proof. Statistics are not going to be convincing to most people over the long term because they don't understand the math, and you don't believe what you don't understand. But an audit is fairly straightforward and the results should be fairly definitive."

She adds that Kobach's attempt to keep her from examining paper logs and tapes makes little sense, particularly when they concern elections which are long enough ago that the results may no longer be officially contested. "Voting is important and we want to keep those records secure so we can be assured of the accuracy of the count. But they're so secure now, nobody gets to see them."

Also today, as if we needed yet another reminder of why neither electronic voting systems nor election officials are simply to be "trusted", on Friday, New Mexico's Republican Sec. of State Dianna Duran --- like Kobach, also a long time "voter fraud" fraudster --- was charged with 64 criminal counts related to embezzlement, fraud, money laundering, violations of the Campaign Practice Act, tampering with public records, conspiracy, and a Governmental Conduct Act violation.

On today's BradCast...The U.S. Supreme Court announces its decision [PDF] in King v. Burwell, a case that would have gutted the Affordable Care Act ("ObamaCare"). As usual, Justice Scalia, on the losing side once again, displayed his extraordinary hypocrisy in his dissent to a case that was stupid to begin with. I explain on today's show.

Then, the last election challenge of 2014 (as far as we know): Dr. Laura Pressley joins me explains why it's impossible to know whether the results of her runoff election for Austin City Council were accurately tabulated on the 100% unverifiable electronic voting systems used in Travis County, across much of the state of Texas and across much of our country.

"We're not just fighting this for our single city council district race. This is a bigger issue," Pressley explains. "Elections have to be verifiable. Candidates need to have the right to question and ask for validation. This is a tenet of our democracy."

Pressley charges that the unverifiable Hart-Intercivic eSlate voting systems actually violate the Lone Star state's own elections laws, even as they clearly undermine overseeable democracy. Remarkably, she says she is now facing a potential court fine of $100,000 for simply bringing her challenge, following some rather disturbing irregularities on the voting systems during her runoff and a complete inability to recount thousands of in-person electronic ballots despite an exact tie on the Vote-by-Mail paper ballots.

Her case was dismissed in state court, but she is appealing the decision and tells me: "One of the comments [in court] was, we needed to be punished as a candidate for challenging these electronic voting systems and that the sanctions should reflect a punishment to deter other candidates from bringing this forward."

This guy, Tom Scott of Computerphile, is right on the money in every respect, when it comes to electronic voting --- be it via touch-screen computers, paper ballot optical-scan systems or, God forbid, Internet Voting. If I was British, and younger, and better looking, and smarter, this would be me...

After almost 11 years at this, it's great to see that at least a few folks are finally getting it. While many understand some of the problems of e-voting, too many still think those probs can be solved with "paper trails" or "open source systems" or Vote-by-Mail or, somehow, even Internet Voting (via phone, tablet or elsewhere). Scott clearly understands, and smartly explains in the short video above, why the problems of electronic voting and tabulating cannot be solved by any of those methods, no matter how much many otherwise well-intentioned folks may wish they could be.

Scott starts off by citing the extraordinary failure of Gov. Chris Christie's emergency Internet Voting scheme, hurriedly (and disastrously) implemented in 2012 in the wake of Hurricane Sandy.

Beyond that, he goes on to make a number of spot-on points, though all of them are predicated on one key notion that, while it may still be true in Great Britain, is becoming more and more of a distant memory in the U.S. every day: An election where everyone in the public is allowed to observe the removal of hand-marked paper ballots from the ballot box, and watch them being counted right then and there, is the most secure and "trustworthy" election possible --- at least based on hundreds of years of vote counting in democracies...

This is a very smart post, particularly from someone calling themselves "potatohead" at DailyKos: "About Touch Screen Voting".

I'd quote something from it, but then you'd be less likely to click over and read the whole thing.

The author has almost everything exactly right, discussing concepts that BRAD BLOG readers should understand very very well by now, but using different words than I usually do, so it may help everything soak in a bit more.

He (presuming a "he" here) even extends his explanation of the inherent, unfixable problem that make touch-screen voting systems 100% unverifiable (and, therefore, antithetical to American democracy) to explain why both "open source" computer voting systems and Internet Voting can't work either, for the same reasons.

Only quibble: He needs to put the word "hand-" before the words "marked ballots" and we'd be 100% golden. Thank you, "potatohead".

Voter disenfranchisement caused by EVID could affect neck-and-neck Governor race against Rick Scott in Sunshine State...

While we've been covering multiple cases of on-screen vote flipping by the 100% unverifiable Direct Recording Electronic (DRE, usually touch-screen) systems, another electronic vote-related system failure, relating to the state's Electronic Voter ID (EVID) system, has also emerged in the state of Florida.

The state Democratic Party filed an emergency Motion for Ex Parte Relief [PDF] earlier this evening seeking to compel Broward County election officials to keep polls open until 9:00 p.m. They alleged, among other issues, that an "EVID system throughout the day has prevented voters from being able to update their address on the day of the election, as they are permitted to do by law."

Instead of being allowed to vote, voters were "asked to present themselves at the Supervisor of Elections office in order to update their address and return to the polling place at a later time to vote a regular ballot." That and other issues may have prevented the lawful casting of ballots in an extraordinarily close Governor's race...

By our count, Virginia is now the 7th state to report touch-screen voting flipping in the 2014 election (though we may have missed a few in Pennsylvania and elsewhere).

During Early Voting, prior to today's mid-term, we've covered 100% unverifiable touch-screen votes reportedly flipping on screen in Texas (D to R), in Illinois (R to D), in Tennessee (NO to YES on anti-choice initiative), in Maryland (R to D) and in Arkansas (unclear which direction the votes were flipping in several different counties), and in North Carolina, where votes were said to be flipping from D to R in the crucial, neck-and-neck U.S. Senate race there.

Now, "Republicans and Democrats alike" are reporting votes flipping in a U.S. House race in Virginia Beach and Newport News, and one of the Republican candidates involved has supplied a video tape of the flipping votes cast on the town's Diebold AccuVote touch-screen systems...

  • If you have problems or see problems at the polls, be sure to report them to 866-OUR-VOTE, or at OurVoteLive.org!
  • Catch any problems at the polls on photo or video? Upload it to YouTube and social sites, and tell us and the rest of the world about it!
  • Be at the polls when they close and photograph and video tape the results tapes that are printed out from electronic systems. Results have a way of changing between the time they're printed out at the close of polls and the time they show up on the web. Your photographic evidence could help save an election!
  • Watching results on the web throughout the night? Take screenshots, save them as you go, and include a timestamp in the filename when you do. Those web results also have a way of changing, sometimes in the wrong direction, throughout the night. Your evidence could help save an election!

Most expensive Senate race in U.S. history - and balance of Senate along with it - may be determined by 100% unverifiable votes...

So far, in the run-up to Tuesday's mid-term election, we've covered 100% unverifiable touch-screen votes reportedly flipping on screen in Texas (D to R), in Illinois (R to D), in Tennessee (NO to YES on anti-choice initiative), in Maryland (R to D) and in Arkansas (unclear which direction the votes were flipping in several different counties.)

Now, votes are reportedly flipping from Democratic to Republican in the "toss up" U.S. Senate race in North Carolina, a crucial contest if Democrats have any chance of hanging on to the majority in that chamber. The "down to the wire" contest is also reportedly turning out to be the most expensive Senate race in U.S. history.

So can supporters of either candidate actually have any confidence at all in results to be reported after the close of polls on Tuesday in the Tar Heel State?...

Same voting systems fail year after year in the state; But officials have a terrible plan to deal with it...

Via KATV in Little Rock, Arkansas...

The Pulaski County Election Commission has received a dozen reports claiming voting machines are changing people's votes. Three of the 12 reports came from North Little Rock voters who voted at Laman Library.

Bryan Poe, Pulaski County's Director of Elections, said the commission is asking voters to be extra cautious.

"We're not the only ones that have experienced something like this. I've heard reports from Lonoke County, Franklin County, and I have also heard reports from Maryland, Illinois, Tennessee and Texas," Poe said. "They would go to select one candidate and it would select a different candidate for them. That's generally an issue that occurs with the calibration of the machine."

It's also "generally an issue" that occurs in Arkansas...on voting systems made by ES&S...year after year after year, as The BRAD BLOG has reported, continuously, over the past decade and as we quickly summarize below.

Are this year's votes flipping from R to D in Arkansas? From D to R? The story doesn't say, and, frankly, we're delighted about that. Because it doesn't matter!

Over the past decade or more, reports of touch-screen votes flipping from D to R have been far more common across the country, but it can go the other way as well (and/or to and from third parties). The point is that even when these god-forsaken 100% unverifiable electronic voting systems work as designed, there is still no way to know that any vote ever cast on one of them during an election for any candidate or initiative on the ballot was ever recorded as per any voter's intent!

As to the Pulaski County Election Commission's reported "plan" for dealing with this problem as they move forward between now and Election Day, it's a disaster in the making...

The Politicus USA headline typified MSM coverage of what Brad Friedman often refers to as the "horse race" --- "Democrats Surge As Michelle Nunn Leads Georgia Senate Race In Third Straight Poll."

For The BRAD BLOG, and for a good many election integrity advocates and computer scientists, that narrow focus ignores "the track conditions," which, in Georgia entails the continued use of touchscreen voting systems courtesy of a 2009 determination by the Georgia Supreme Court that "unverifiable elections are just fine."

Where horse race coverage focuses exclusively on the here and now, this site feels it helpful to look back a dozen years to what took place in Georgia shortly after Democratic Secretary of State Cathy Cox signed a May 2002 contract with what was then known as Diebold Election Systems Inc....

With the latest KPFK/Pacifica Radio fund drive behind us, it was great to be back on the air live today with The BradCast!

Just in time for Election Day next week, we got everybody up to date on all of the terrible SCOTUS rulings in regard to GOP voter suppression from over the past several weeks --- in OH, NC, WI and TX (and an important Photo ID ruling by the state Supreme Court in AR) --- for those who may have missed our coverage during the fund drive. The first state, along with GA, to install Diebold's 100% unverifiable systems in 2002 are still forcing them on voters in 2014...

As we told you recently, after 100% unverifiable touch-screen voting systems reportedly began flipping votes from Democratic to Republican in Texas, and from Republican to Democratic in Illinois, and then from "NO" to "YES" on an anti-choice measure in Tennessee, there would be more. There always is, as we discussed on Thom Hartmann's TV show earlier this week.

Now it's reportedly happening in Maryland. Again.

Yes, there are still many states and counties out there that have so little respect for their voters that they force them to use these horrible, completely unverifiable electronic voting systems because, clearly, they don't give a damn whether votes are recorded accurately or, more to the point, whether any voter can ever know that any election result actually reflects the will of the voters. Whether these systems fail (as they often do), whether they are hacked (as they easily are), or whether they work accurately, voters can never know one way or another --- and that is the core problem with them.

Nonetheless, these machines are still in use across the country in 2014. One of the very first states to foist them on voters back in 2002 was Maryland, when they installed 100% unverifiable Diebold touch-screen voting systems across the entire state.

Those systems are still being used there today and --- whaddaya know? --- they are flipping votes, according to the state Republican Party which is now demanding an investigation after receiving complaints from "about 50 voters in 12 Maryland counties"...

Rutgers finds Christie's unilateral, illegal voting experiment resulted in tens of thousands of unauthenticated votes in 2012...

In the run-up to the 2012 Presidential Election, as Superstorm Sandy was bearing down hard on the East Coast, we wrote quite a bit (both here and at Salon) about how flooding and, specifically, power outages in several states that rely almost exclusively on electronic voting systems, could cripple the integrity of elections in a number of them.

Ultimately, among the hardest hit of those northeastern states was New Jersey, which, shamefully, still forces almost all of its voters to cast their ballots on 100% unverifiable electronic touch-screen systems.

On the weekend before Election Day, as water was rising and power was out across much of the eastern part of the state, NJ's Gov. Chris Christie and Lt. Governor Kim Guadano issued an unusual, emergency order, allowing for the use of early voting to ease the crush on Election Day in areas where some polling places would be shut down to due flooding, and for the use of paper ballot voting in precincts where power was still likely to be out as of Election Day.

We applauded those emergency measures at the time, particularly as the chances for voters to actually have their votes counted accurately and transparently could only increase with the use of hand-marked paper ballots in a state which has had nothing but disasters over the years with their oft-failed, easily-manipulated touch-screen voting system.

However, at the same time Guadano was announcing those emergency measures, she also --- without bothering to consult with election officials around the state --- tossed in one other emergency order [PDF] which, as we warned at the time, was likely to be a terrible mistake.

Guadano ordered emergency Internet Voting --- of a sort --- by allowing for voters displaced by the storm (and it would be left up to election officials' discretion to determine which voters were or weren't "displaced") to cast their ballots via email or fax.

We now know, thanks to a new report from the Rutger's School of Law [PDF], that, indeed, NJ's experiment with voting over fax and the Internet was a disaster, one that led to tens of thousands of unauthenticated votes in 2012, and which hasn't hasn't been reported by the media...until now...

Just after this morning's official start of our regular biennial coverage of votes flipping on 100% unverifiable touch-screen voting systems around the country, this report comes in right on cue from the great state of Tennessee...

"I honestly sort of slapped my head and said, 'Why me? Why did this happen to me?'" said Bernie Ellis, of Santa Fe.

Ellis said he voted "no" on Amendment One Thursday. Before he submitted his ballot, he noticed a problem.

"Sometime between when I cast my vote and when I got to the review page, the machine had changed my vote to a 'yes,'" Ellis said.

Beverley Turner, of Columbia, experienced the same issue last Friday when she tried voting "no" on the same position.

Both Ellis and Turner voted at the Maury County Election Commission.

Tennessee's 95 counties use touch screen election machines.

Amendment 1 is a TN ballot measure that would amend the state constitution to allow the legislature to "to enact, amend, or repeal statutes regarding abortion, including, but not limited to, circumstances of pregnancy resulting from rape or incest or when necessary to save the life of the mother."

Ellis, who explains what happens in the video posted below, happens to be a long-time election integrity advocate in Tennessee. He was very instrumental in helping the state legislature pass, nearly unanimously, the Tennessee Voter Confidence Act (TVCA), a 2008 law to move to all of their 95 counties to paper ballots. Shamefully, after TN Republicans took over the legislature later that year (via the statewide touch-screen voting system, in a year when the GOP got trounced literally everywhere else in the country), they fought and then eventually repealed the reform which would have done away with the state's 100% unverifiable e-voting system.

The Republican fervor to continue the use of such unverifiable voting systems in the state may have been best reflected by a comment offered directly to us in 2007 at a meeting of the Davidson County (Nashville) election commission. After Tennessee election integrity documentarians David and Patricia Earnhardt (filmmakers of the award-winning Uncounted: The New Math of American Elections, which both Ellis and I happen to appear in) reported seeing their own votes flip on touch-screen systems in Davidson County during Early Voting for the 2008 Presidential Election there, we explained:

In 2007 we had the displeasure of attending a meeting of the Davidson County, TN, Election Commission ourselves. While the Democrats on the committee were in the majority, the three hapless Democratic members were run roughshod over by the two Republicans who virtually ran the entire meeting themselves.

The Republican who seemed to be in charge of things, Commissioner Lynn Greer, while the actual Chair Eddie Bryan did almost nothing, actually told us after the meeting --- and after we'd spoken during it, to warn about the troubles they would have with their touch-screen systems --- that "paper ballots are the greatest fraud ever perpetrated on America."

It seemed as though he actually believed those words as they came out of his mouth.

Greer later became Chair of the county's Election Commission after Republicans took over the state legislature that year for the first time since Reconstruction.
