Reporter Dennis Domrzalski's terrific scoop deserves to be read in full, so I won't quote much of it here.

The short version, however: New Mexico's ABC field producer and KKOB afternoon drive news reporter, Laura MacCallum, a 32-year news veteran, has quit her job after her stories on an alleged vote-buying scheme by Republican Rep. Heather Wilson at the recent delegate nominating convention in Bernalillo County, New Mexico, were scrubbed from her station's website hourly news cycle by the News Director, after alleged pressure from Rep. Wilson.

The sitting Congresswoman is angling for an upgrade, as she hopes to be the state's Republican nominee to fill the Senate seat being vacated by outgoing Republican Pete Domenici. MacCallum's report, sourced by at least three different people, including herself, said that voters showed up to the delegate convention and claimed they were being "paid $35-an-hour (for two hours)" by Wilson's senate campaign and the congressional campaign of Bernalillo County Sheriff Darren White, "and that the campaigns had also paid their $30 registration fees."

I just spoke with Domrzalski, and he underscored again, as he did in his story, that "Wilson’s spokeswoman flat out refused to answer the question" when asked if he asked her if the reports were true.

Such a scheme, if true, would be a fourth-degree felony, according to New Mexico law. But as remarkable as those charges are, even if having the ring of truth, given what we already know about Wilson, the response, including the memo sent from KKOB News Director Pat Allen to MacCallum, is almost as remarkable...

Kudos (for a change) to AP for their report today into what happened during the Super Tuesday Democratic Caucus in New Mexico, where thousands of long-time registered Democratic voters were knocked off the rolls, leading to some 17,000 provisional ballots being cast (11% of all votes, up from 4% four years ago.)

What has changed since 2004, just four years ago? For a start, the private, constantly failing voting machine company ES&S has taken over management of the registration rolls. At the same time, Secretary of State Mary Herrera's office seems to be in complete denial of the problem, which could drastically affect the ability of legally registered voters to cast proper ballots in the state come this November, when the race could be as razor-thin in New Mexico as it was in 2004.

The AP report picks up on one of our own, covering the privatization of NM's (and several other states') voting rolls, as filed here just after Election Day, when the mess first began to emerge.

Contracts with Unaccountable Private Vendors Like ES&S in NM and Elsewhere, Continue Taking Costly Toll on American Democracy...

On Wednesday, we covered some of the massive problems emerging from New Mexico's Democratic Party Caucus on Super Tuesday. The razor-thin margin between Obama and Clinton remains in question at this hour after ballot boxes were discovered to have been kept overnight, uncounted, at the home of a party official; voters faced long lines at the polls; and some 17,000 voters (11% versus 4% in the last caucus) were forced to vote on provisional ballots.

NPR had reported on Thursday that the state's Democratic party, which ran the election, as opposed to the state itself, had decided to do a full recount of all ballots. Tonight, though, John Gideon informs us the report was incorrect, and only "all qualified provisional ballots" are set to be counted by officials.

We had updated our previous story several times while covering the mess, before finally noting:

The most notable take-away from this story may end up not being the poorly run caucus process of the Democratic Party (as opposed to the state, which would run the general election in November), or even the "sleepover" ballot boxes. The most notable issue here may be the questions about what the hell happened to the registration rolls in New Mexico, as now maintained by the thugs and failures at voting machine company ES&S, since the last election.

Remember, NM is where former U.S. Attorney David Iglesias was fired because he refused to prosecute the bogus "voter fraud" charges made by the Republican Party there.

Tonight, Steve Rosenfeld at Alternet jumps in with a New Mexico update, in which he tries to make sense of it all. He ends up confirming our fears in his opening graf...

17,000 Voters Forced to Vote on Provisional Ballots After Being Dropped from Registration Rolls 'Maintained' by SoS and Voting Machine Company, ES&S
Few Explanations Available Yet for Any of It, Governor Richardson 'Deeply Disturbed' by Reports...

The good news: New Mexico now votes on paper ballots, since their touch-screen debacle in the 2004 Presidential Election left Gov. Bill Richardson with little legal choice but to move to paper.

The bad news: The huge turnout in yesterday's Democratic Primary led to long lines, voters who found they were no longer on the registration rolls for some still-unexplained reason, 17,000 votes had to be cast on provisional ballots which remain uncounted today, and now it's being reported --- incredibly --- that at least three ballot boxes were kept overnight last night, uncounted, at the home of a Democratic County Party Chairwoman.

What makes it all worse, as if all that is not troubling enough, is that the current razor-thin margin between Barack Obama and Hillary Clinton in the caucus stands at just 217 votes out of 136 thousand ballots cast.

The governor's apologizing, the party is prevaricating, the candidates' representatives are negotiating, and, as usual, it's the voters who are left hanging, wondering if their voices will actually be heard...

Gonzales Still Under Fire, ACVR Still Off Scot-Free, Along With the White House, the DoJ, John Tanner, Ann Coulter and Everyone Else the Democrats Have Utterly Failed to Properly Bring to Justice...

First, the good-ish news. Just out from Jason Leopold at truthout [emphasis added]:

The Justice Department's Office of Professional Responsibility (OPR) is attempting to build a case of misconduct against Alberto Gonzales by showing that the former attorney general may have played a hands-on role in ousting former New Mexico US Attorney David Iglesias based on pressure he received from former White House political adviser Karl Rove, according to several individuals familiar with the agency's probe.

Succumbing to improper political pressure in firing a US attorney would constitute a violation of Justice Department policy.

Recently, the OPR contacted Iglesias's former executive assistant, Rumaldo Armijo, to interview him about whether he was pressured by Pat Rogers, a Republican attorney in Albuquerque, and Mickey Barnett, a Republican lobbyist, to bring charges of voter fraud against Democrats in the state, individuals with knowledge of the scope of the OPR probe said.

Rogers was affiliated with the American Center for Voting Rights, a now defunct non-profit organization that sought to defend voter rights and increase public confidence in the fairness and outcome of elections. However, it has since emerged that the organization played a major role in suppressing the votes of people who intended to cast ballots for Democrats in various states. Rogers is also the former chief counsel to the New Mexico state Republican party, and was tapped by Sen. Pete Domenici (R-New Mexico) to replace Iglesias as US Attorney for New Mexico.

In an interview with Truthout in May, Iglesias said he had investigated so-called voter fraud allegations and found zero evidence to support the claims. He added that, based on evidence that had surfaced thus far and "Karl Rove's obsession with voter fraud issues throughout the country," he now believes GOP operatives had wanted him to go after Democratic-funded organizations in an attempt to swing the 2006 midterm elections to Republicans.

The BRAD BLOG has, of course, been following the GOP's voter suppression scam, headed by the so-called "American Center for Voting Rights" (ACVR) for years, ever since we first outed them as a phony GOP front group back in March of 2005. See our ACVR Special Coverage page for the entire sordid mess.

As well, in March of 2007, we ran exclusive comments from John Boyd, one of the top Democratic attorneys in New Mexico, who offered his first hand account of the pressure being brought to bear on Iglesias by Republicans in the state to bring phony charges of Democratic "voter fraud" as far back as prior to the 2004 election.

A review of Boyd's insider perspective is instructive, to say the least, particularly as we head into 2008 when disingenuous cries of "voter fraud" will be heard from Republicanists from coast to coast --- as long as they don't concern Ann Coulter's own voter fraud --- and as the U.S. Supreme Court prepares to hear a key case on Photo ID polling place restrictions, described by the Century Foundation's Tova Andrea Wang, in her year-end column, "The Best and Worst of 2007: Voting Rights and Elections," to be "a far more important decision than Bush v. Gore ever was."

But with the continuing --- some might say, snail's paced --- OPR criminal investigation of Gonzales, we should note that the probe, as mentioned above, at least can be said to be moving forward in some fashion. Unfortunately, that's a far cry more than we can say for the job the Democrats are doing in bringing accountability via the U.S. Congress after a full year on the job.

Even the New York Times, in an editorial over the holiday, called on the lackluster Dems to get their act in gear, calling for "a full investigation into the misconduct that may have occurred," in the U.S. Attorney Purge scandal, adding that "it needs to be investigated vigorously and completely."

Then, unfortunately, they offer readers the bad news...

Vice Presidential Candidate Bill Richardson Said to be 'Dream Candidate' to Run for Seat...

WaPo blogger Chris Cillizza is reporting:

Veteran Sen. Pete Domenici (R-N.M.) is expected to announce tomorrow that he will retire from the Senate in 2008, according to several informed sources, a decision that further complicates an already difficult playing field for Republicans next November.

You'll remember Domenici, of course, as the senator (along with NM Rep. Heather Wilson) who was haranguing US Attorney David Iglesias to bring phony "voter fraud" indictments in the state via several inappropriate phone calls prior to the 2006 election. Iglesias was later fired for not having done so.

Like most Repubs, when called out, he'd rather run (or not run, as the case may be) than fight.

Though Cillizza speculates that NM Gov. Bill Richardson would be the "dream candidate" to run for the seat, it seems he's currently too busy for the moment running for vice president. We'd be delighted to see him change his mind and do something actually useful for the country in 2008.

UPDATE: AP confirms, and notes that "Domenici would be the fifth Republican senator to decline to seek a new term." They've also got more details on the "health issues" that Domenici, who had previously planned on running again, will use as his excuse. We guess "need to spend more time with the family" is getting a bit worn out by now.




Vote Caging Schemes, Plans to Challenge Voters Part of High-Level Bush/Cheney 'Voter Fraud Strategy'...

Bad news for the RNC. New emails reveal their "Voter Fraud Strategy Conference Call" just prior to the 2004 Presidential elections, with plans to use Vote Caging lists to challenge voters in swings states from OH to PA to FL to NM. The effort seems to have been spearheaded by Tim Griffin.

Truthout gets the scoop and the collections of emails, as based on a report from PBS's NOW to air tomorrow night. Here's the skinny...

Previously undisclosed documents detail how Republican operatives, with the knowledge of several White House officials, engaged in an illegal, racially-motivated effort to suppress tens of thousands of votes during the 2004 presidential campaign in a state where George W. Bush was trailing his Democratic challenger, Senator John Kerry.

The documents also contain details describing how Bush-Cheney 2004 campaign officials, and at least one individual who worked for White House political adviser Karl Rove, planned to stop minorities residing in Cuyahoga County from voting on election day.

The efforts to purge voters from registration rolls was spearheaded by Tim Griffin, a former Republican National Committee opposition researcher. Griffin recently resigned from his post as interim US attorney for Little Rock Arkansas. His predecessor, Bud Cummins, was forced out to make way for Griffin.

Another set of documents, 43 pages of emails, provided to Truthout by the PBS news program "NOW," contains blueprints for a massive effort undertaken by RNC operatives in 2004, to challenge the eligibility of voters expected to support Democratic presidential candidate John Kerry in states such as Nevada, New Mexico, Florida and Pennsylvania.

One email, dated September 30, 2004, and sent to a dozen or so staffers on the Bush-Cheney campaign and the RNC, under the subject line "voter fraud strategy conference call," describes how campaign staffers planned to challenge the veracity of votes in a handful of battleground states in the event of a Democratic victory.

Furthermore, the emails show the Bush-Cheney campaign and RNC staffers compiled voter-challenge lists that targeted probable Democratic voters in at least five states: New Mexico, Ohio, Florida, Nevada and Pennsylvania. Voting rights lawyers have made allegations of so called "vote caging," against Republicans previously. These emails provide more evidence. One Republican operative involved in the planning wrote "we can do this in NV, FL, PA and NM because we have a list to run against the Absentee Ballot requests, and should."

Truthout has a bevy of emails that I haven't been able to review, but we'll have the producer of tomorrow's NOW story on the Peter B. Collins Show tomorrow (which I'm still Guest Hosting through the end of the week) to discuss this story.

And yes, Bush/Cheney '04 Inc's national general counsel, who would later go on to create the phony "grassroots" GOP front-group, American Center for Voting Rights (ACVR), was right there in the thick of it all...

Richardson Answers, Wants 'Verified Paper Trails on Optical Scanners,' No More 'Touch Stones,' and an End to Republican Voter Suppression

The question (video below) in the CNN/YouTube seems to be about "standardizing" voting systems around the country. The only one given the opportunity to answer it is New Mexico's Governor Bill Richardson, who should have hit this out of the park since he signed a bill to outlaw the use of DRE touch-screen systems after disaster in NM in the 2004 election.

Though his answer uses the phrase "touch stones" (we'll chalk it up to nervousness, we guess) and he goes on to use the phrase "verifiable paper trail" (instead of paper ballot), he's clearly speaking about actual ballots since he calls for those "verifiable paper trails" with "optical scanners."

Richardson is theoretically trying to break out from the pack. He ought to be able to use his status as the only candidate to have actually outlawed dangerous, disenfranchising DRE touch-screens to distinguish himself from the others. It might help, however, if he got his words right. But at least someone spoke to democracy, finally, in the midst of this absurd Presidential Election campaign.

Anybody else in the pack care to speak up and stand up in favor of democracy? Anyone? Bueller? We're waiting.

Today, Gordon advances the ACVR story --- which we broke more than two years ago and have been drilling down into ever since --- with the latest in his string of doozies that he's been rolling out since jumping on the beat.

Captain Iglesias, Obstruction of Justice, and the Theft of 2008...

"The wheels have come off, the engine is on fire and no one is driving," Captain David Iglesias told me yesterday. I'd asked the Naval Reserve officer, heading off to duty in Norfolk, why he didn't want his old job back, United States Attorney for New Mexico.

The busted, burning, ghost-mobile he described is the Department of Justice, driven by Alberto Gonzales. Or is Karl Rove at the wheel? Or no one? Whomever, he didn't want to jump back into Bush's Justice Jalopy.

Today, Iglesias is in Washington to pull the junker off the road, meeting with the Office of Special Counsel where Obstruction of Justice may be swirling around in the old oil pan laying on the garage floor.

The ex-prosecutor and I, long, long ago, had both worked for the Attorney General of New Mexico, a state where the snakes have less venom than the politicians.

First, there's Senator Pete Domenici, whose hiss is as smooth as his bite is deadly.

Domenici, softball interviewer Chris Matthews notes, is a nice guy. On TV. However, the Republican Senator's call to Iglesias at his home, just before the 2006 midterm election, asking the prosecutor about filing charges against Democrats in the week before the vote, was downright rude. When the prosecutor replied in the negative, the Senator hung up.

And apparently, the Senator contacted one Monica Goodling who, scribbled on a notepad: "Iglesias - Domenici says he doesn't move cases." Oops. Goodling, a political stooge working for Gonzales, was listing the reasons for firing US attorneys. Now, rudeness was no longer the issue. Firing a prosecutor for failing to "move cases" --- handcuff citizens at the request of a Senator --- is Obstruction of Justice.

No wonder Monica took The Fifth.

Of course, the Rove dogsbodies at Justice couldn't tell Congress they fired Iglesias because he wouldn't jump at the Senator's rattle. They reached for another complaint on Monica's list: "absentee landlord." Deputy Assistant Attorney General Paul McNulty used absenteeism as the official reason for dismissal. McNulty's resigned.

U.S. Attorney Fired After Failing to Indict ACORN for Voter Fraud

There are new developments in the scandal over the Bush administration's firing of eight U.S. Attorneys. One of the dismissed prosecutors has revealed that he was pressured by Republican officials to target the advocacy group ACORN for voter fraud. ACORN was working on a voter registration drive in low-income and largely minority neighborhoods in New Mexico. David Iglesias told Newsweek that he found no case worth bringing against ACORN. But that apparently did not please the White House. Last week Attorney General Alberto Gonzales's ex-chief of staff D. Kyle Sampson testified that during the run-up to the mid-term election White House adviser Karl Rove complained that Iglesias and two other U.S. Attorneys had not done enough to prosecute so-called voter fraud.

Ah yes, the always reliable GOP "vote fraud" scammers' "ACORN canard" rears it's ugly (and unsubstantiated) head again. The NEWSWEEK article referenced above is here.

ACORN is the "Association of Community Organizations for Reform Now", a group which has successfully run voter registration drives across the country in low-income and minority areas.

As we reported back in December of 2005 --- when high-level GOP operative James Tobin was actually found guilty of jamming Democratic 'Get out the Vote' phone lines in order to keep voters away from the polls in 2002 by "orchestrating an election day phone-jamming plot against New Hampshire Democrats" --- the ACORN nut had already fallen off the Republican's "vote fraud" tree.

ACORN had "been vindicated of the various bogus charges, as virtually all of the frivolous lawsuits and investigations the GOP liars made so much noise about had simply collapsed by then," as we reported at the time in linking to ProjectVote.org's coverage.

And yet, the scam, built deep in the heart of Texas (by Rove and his slimy, democracy-hating operative buddies at the phony ACVR), just kept rolling...

New Mexico attorney John Boyd, who was working with state Dems at the time, had a front-row seat to the bogus 2004 "voter fraud" charges in the state, and wrote about it, in some detail, for BRAD BLOG a few weeks ago.

It's always been about undermining democracy for these jerks. From 2000 on up to 2008, the quest for power trumps the people in the minds of the wretched GOP evil doers.

RELATED? - The GOP 'Voter Fraud' Front Group ACVR Goes Suddenly AWOL!

As you might expect, there is much more to the "voter fraud" angle in the U.S. Attorneys Purge scandal than initially meets the eye. As you might also expect, we've taken keen notice as we've long been following and reporting on the insidious machinations behind the GOP/White House/Rove scheme to (rather successfully) invent the cynical notion of a "voter fraud" epidemic in America for purely political purposes.

First... Allow me to set the stage for the unenlightened by referring you to an amazingly wonderful new report [PDF] on the manufactured myth of American "voter fraud" as released by ProjectVote.org and authored by Lorraine C. Minnite, Ph.D., an assistant professor of Political Science at Barnard College, Columbia University.

Among the report's key findings [PDF]:

  • Voter fraud is extremely rare.
  • Most voter fraud allegations turn out to be something other than fraud.
  • There is a long history in America of elites using voter fraud allegations to restrict and shape the electorate.
  • The historically disenfranchised are often the target of voter fraud allegations.

Finally, an academician thoroughly debunks --- nay, eviscerates --- the long-worked, well-moneyed, and invidious GOP plot to create the illusion of an American "voter fraud" epidemic (as distinct from very real election fraud concerns). The point behind the effort is solely to push for disenfranchising laws and restrictions in an effort to keep legitimate voters away from the polls in our democracy. If you read only one page of this report, "The Politics of Voter Fraud," it will be well worth your time!

Second... The phony "non-partisan" GOP front-group calling themselves the "American Center for Voting Rights" (ACVR), created in 2005 for nothing more than to facilitate the White House/Karl Rove "voter fraud" schemes, seems to have suddenly gone missing! BRAD BLOG readers will recall the despicable operatives who set up their "tax-exempt," "voter fraud" chop shop just three days before testifying at a staged Congressional hearing on the 2004 Ohio Presidential Election before the now-disgraced, felonious former Ohio Rep. Bob Ney of the House Administrative Committee. We broke the story exclusively at the time, and have continued reporting on it in a long series of special coverage reports ever since.

The alleged 501(c)3 group --- which has never produced paperwork to back up its tax-exempt status, to our knowledge --- was founded by the "non-partisan," "former" Bush/Cheney '04 Inc. national general counsel, Mark F. "Thor" Hearne, along with "non-partisan" RNC Communications Director Jim Dyke. Dyke now works for non-partisan Dick Cheney's office. Hearne then, and apparently still now, seems to be working for Karl Rove as one of his top national operatives.

Since news coverage of the tip of the iceberg in the GOP "voter fraud" scam has been revealed as directly related to the U.S. Attorney Purge scandal, it seems that all of a sudden the ACVR's detailed and propaganda-filled website has suddenly disappeared down the memory hole. As of today, both of ACVR's domain names AC4VR.com and AmericanCenterForVotingRights.com each return "Bad Request (Invalid Hostname)" errors.

Gone, but not forgotten. As we find out more on the AWOL ACVR we will, of course, let you know.

Lastly... Though certainly not leastly, John Boyd, an Albuquerque, New Mexico, based elections attorney who worked with the Democratic party in the state during the 2004 election, sends us the following inside account of the scandal surrounding recent reports that purged NM U.S. Attorney David Iglesias was removed for his unwillingness to prosecute claims of "voter fraud" in the state prior to the 2004 Presidential Election.

Before the election, Boyd helped represent the Dems in defending against the scurrilous GOP "voter fraud fraud," as he calls it. After the election, he successfully filed suit, along with the watchdog organization VoterAction.org, against the state concerning failures in their DRE/touch-screen voting system. That suit eventually led to a statewide ban on such systems and a requirement for paper-based elections.

Boyd writes that the firing scandal is actually "far worse than it now appears." His harrowing, first-hand account and reasons for that claim, as sent to us this morning, details how the GOP manufactured their pre-election "voter fraud" crisis in the state, despite lacking any evidence of any actual crimes.

Comparison of Voting Data from 2004 to 2006 Shows Hispanic Undervote Plunged 69% as the 'Civil Rights' Case for DREs Continues to Fall Apart

"We were looking for any impact the change to paper ballots may have had on New Mexico’s historically high undervote rate. When we found the dramatic drop in Native American precincts, we were shocked," says New Mexico's Theron Horton. The Election Defense Alliance (EDA) activist added, "something was going on with the DREs in those precincts in 2004."

Something indeed.

Details now out from New Mexico reveal that undervote rates dropped precipitously in both Native American and Hispanic areas after the state moved from DRE (Direct Recording Electronic touch-screen) voting systems in 2004 to paper-based optical-scan systems in 2006. In Native American areas, undervote rates plummeted some 85%. In Hispanic communities, the rate dropped by 69% according to the precinct data reviewed by EDA, VotersUnite.org and VoteTrustUSA.org.

Ellen Theisen, then-Executive Director of VotersUnite.org, reviewed the original high undervote rates in the state after the 2004 elections, but hadn't broken it down to compare DRE/touch-screen vs. Op-Scan precincts. "When I heard of Theron’s work," Theisen says in today's press release, "I performed the comparison, and found that it’s the paper ballots that made the difference in the minority precincts.”

New Mexico banned the use of DREs across the state after their disastrous experience with Sequoia touch-screen voting machines during the 2004 Presidential Election. They now require a paper ballot for every vote cast statewide.

As he signed the bill which banned DREs into law in early 2006, New Mexico's Gov. Bill Richardson wrote a letter to Election Officials in all 50 states, warning that while "some believe that computer touch screen machines are the future of electoral systems...the technology simply fails to pass the test of reliability."

"One person, one vote is in jeopardy if we do not act boldly and immediately," Richardson implored, while decrying the failures of DREs in his state and supporting paper ballots. "When a vote is cast, a vote should be counted," he wrote.

The BRAD BLOG has reported on the urgent need to ban disenfranchising DRE voting systems --- with or without a so-called "paper trail" --- from all American elections.

Of course, we've been covering Christine Jennings's (D) refusal to concede and her stand in favor of the voters in the FL-13 fiasco. And though we haven't mentioned it lately, vote-rigging whistleblower Clint Curtis (D), rather than conceding, is convening a group of volunteers to verify the reported "results" of his race against the corrupt Tom Feeney (R) in FL-24.

But several other House candidates, from North Carolina to Ohio (but not New Mexico), are still fighting to assure the voice of the voters is accurately heard...

BRAD BLOG: New Mexico's 1st Congressional District Should Be Re-Counted by Hand in Full!

We hate to rely on such questionable fringe sources as Associated Press, but for lack of time today, we'll point to their coverage of the remaining "handful of close contests for the House" which are still undecided.

The races that AP describes as "still in dispute" are in NM, NC, FL, and two in OH (naturally).

In addition to the completely obvious and resignation-worthy mess in the FL-13 race, The BRAD BLOG would draw particular attention to the less-discussed contest in New Mexico's 1st Congressional district. We've been plowing through first-hand accounts sent our way detailing the disasterous state of conditions in the counting rooms out there where there's a very close race between incumbent Rep. Heather Wilson (R) and her opponent Patricia Madrid (D).

Based on the exceedingly detailed reports we've read so far of the (ahem) less-than-optimal-or-accurate initial tally of votes (yes, Bernalillo County, we're talking to you), we'd suggest any recount of that race must be done as a complete hand count of all ballots in order to assure the final result actually resembles the intention of New Mexico's voters.

But we just may be radical that way.
