Even today's late breaking news, as we are able to make sense of it on today's BradCast, is unlikely to end well for our disgraced former President, while the U.S. House Select Committee continues to close in on their man.

We were forced to shake up today's show at the last minute, thanks to the late decision by a three judge panel at the U.S. Court of Appeals in D.C. that buys Donald Trump a few more weeks until damning documents (including video tape and more) are likely to be turned over by the National Archives to the bipartisan House Select Committee investigating the January 6th attack on the U.S. Capitol. The deadline set for this Friday is now on hold for the moment.

There's been a whole bunch of legal rulings happening very quickly over the past three days, with U.S. District Judge Tanya Chutkan's Tuesday night, 39-page "Presidents are not kings, and Plaintiff is not President" ruling [PDF] being the most devastating for now. All of which culminated, as of today, in a temporary administrative injunction [PDF] issued on Thursday by three Democratic appointees to the D.C. Court of Appeals and a hearing, set on an expedited schedule, for November 30th on Trump's attempt to invoke Executive Privilege as a private citizen, in desperate hopes of blocking the release of those documents.

If you're having trouble keeping up, don't worry. Today, we try to walk you through those legal rulings and where the case is heading, as the House Committee continues to make clear they have no intention of letting any of it go, in their probe of the insurrection incited by Trump as his last ditch effort to steal the 2020 election.

Top staffers in Mike Pence's office are now being brought into the probe, as top staffers in both the Trump Administration and Campaign are already facing subpoenas from the panel. The U.S. Supreme Court's previous sparse rulings on Executive Privilege from the Nixon Watergate-era do not bode well for the latest former President. That said, this Supreme Court, stolen and packed by Trump and the GOP, has also shown itself willing to ignore any and all precedent whenever they feel like it.

And while saving the nation from a bitter, angry, broken despot bent on revenge is no easy feat for any of us, imagine what it's like for the 196 nations meeting in Glasgow, Scotland right now to try and save humanity itself this week. Prime Minister Boris Johnson, of host nation Great Britain, goes to bat for the planet in the closing, crunch-time hours of the COP26 U.N. Climate Summit. His remarks serve as a helpful reminder that real conservatives (unlike American ones) are not actually insane. And, also unlike American ones, they're also actually conservative.

Millions are voting around the country on Tuesday. Governors, Mayors, school boards and various initiatives are on the ballot (along with a couple of Special U.S. House elections) in a whole bunch of states in this year's off-year elections. Full results, such as we might have them, on tomorrow's BradCast. But for today, as voters vote (or try to), elected officials were making some pretty big and important and long-overdue deals today, from D.C. to Glasgow. [Audio link to full show is posted below this summary.]

Among the stories covered on today's program...

  • The extreme partisan gerrymandering in states controlled by Republicans continues apace, with Oklahoma the latest to propose cracking a major Dem stronghold into three pieces in order to squeeze out another GOP House member for the next decade in the already very "red" state. All of that made much easier in states that, prior to the 2020 Census, had to win approval for new maps from the federal Government under the Voting Rights Act. The GOP's stolen and packed U.S. Supreme Court majority has helpfully done away with that little annoyance in advance of 2022 and 2024.
  • Thanks to lighter off-year election turnout and measures enacted before and during the pandemic to make early and remote access to the ballot box easier, we're not hearing about too many voting problems today so far...except for in New Jersey, where electronic pollbooks reportedly failed across the state for several hours when polls opened. Unclear if there were backup paper pollbooks available, but as one outlet reported: "When the Internet would go down, the machines would crash."
  • For the second year in a row --- and the third time in history (the first time was in 2005) --- the National Weather Service has once again run through all of the names in the alphabet for named Atlantic storms. With the naming of Subtropical Storm Wanda over the weekend, we are turning to the supplemental name set, which is starting over from "A" this year. Unlike last year, they won't be using letters from the Greek alphabet which seems to have confused a whole bunch of us. But the increasing number of storms is the real worry, despite absurd, years-ago-debunked climate change denialist talking points still coming out from the fossil fuel-sponsored Republicans in Congress.
  • With the critical U.N. Climate Summit (COP26) in Glasgow, Scotland now officially underway, President Biden officially apologized to the world for Donald Trump pulling the U.S. out of the Paris Climate agreement, during his four disastrous years as President. (The U.S. was the only country, out of about 200 across the world, to withdraw from the pact.) Now that we're back in, two fairly big agreements were struck in the conference's opening days. One to stop and reverse deforestation and another to cut climate warming methane emissions by 30% by 2030. The first was signed on to by more than 100 countries, including the U.S., UK, China, Russia and Brazil. The second did not yet win the support of China or Russia, but the others, including Brazil, seem to be in. The agreements are pretty big deals, as Desi Doyen explains today --- even if there is much more work that must be done at this two week summit.
  • Speaking of big deals, apparently another big one was struck in the U.S. Senate between Kyrsten Sinema (AZ) and all of the other Democrats to lower prescription drug prices in Biden's Build Back Better bill. The details are still not fully known, but the agreement will allow "lower prescription drug prices for seniors and families," according to Senate Majority Leader Chuck Schumer. The seemingly interminable negotiations continue on the BBB, but that news from Sinema and some encouraging remarks today from the other Democratic obstructionist, Joe Manchin (WV) are hopeful signs today, as Mitch McConnell makes clear that he is rooting for Sinema and Manchin to gut the (currently) $1.75 trillion social safety net and climate change legislation.
  • After anti-vax alarmists had warned for weeks that as many as 10,000 cops would be lost from the NYPD once Mayor Bill deBlasio's vaccine mandate kicked in on November 1, it turns out the number of uniformed police placed on unpaid leave was much smaller. As of Monday, the number was 34, or 0.15 percent of NYPD employees. Over the past week, NYPD's vaccination rate jump 15 points to 85 percent. As evidence from other states and industries reveals, mandates work.
  • Finally, we're joined by Desi Doyen for our latest Green News Report as host UK's Prime Minister Boris Johnson opens COP26 with a dramatic flair; as the U.S. House calls Big Oil on the carpet for decades of climate lies; and as the corrupted U.S. Supreme Court agrees to review a case that could dismantle the EPA's authority to regulate dangerous greenhouse gas emissions...

Huge, hard-fought win for the environment on KeystoneXL; Another fight builds in MN over another tar sands pipeline; Mr. Biden goes to Europe (not a moment too soon); TX's corrupt A.G. faces still more legal trouble...

Among the stories covered with appreciation on today's program...

  • It was a huge, hard-fought, well-deserved win for the unprecedented coalition of environmentalists, tribes, scientists, farmers, ranchers, and even a few journalists, behind the defeat of TC Energy's enormous, dangerous KeystoneXL Pipeline. For 13 years, the company, formerly known as TransCanada, had fought to build a 1,200 mile pipeline to send 830,000 barrels each day of toxic, sticky tar sands crude from Alberta, Canada to refineries in Texas for export overseas. For 13 years, protesters stood up against the project, which threatened rivers, streams, native lands, farms, drinking water aquifers and the climate itself. One of the nation's greatest climate scientists James Hansen warned in 2012 that if the Alberta tar sands are full developed, via projects like KXL, it would be "game over for the climate". After President Obama canceled the pipeline's permit due to the damage it would cause for the environment via climate change, it looked to be game over for KXL itself. But then Donald Trump got elected and reversed Obama. When Joe Biden took office, he cancelled the permit once again as one of his very first actions, and has refused to back off, despite pleas from both Canada and the company. On Wednesday, TC Energy finally gave up the game. The KeystoneXL Pipeline is now really, truly dead. We all owe the coalition of protesters and activists a huge thanks. But the fight now continues elsewhere...
  • In Minnesota this week, a similar coalition of activists stood up demonstrations against another Canadian company named Enbridge Energy, which is replacing a 1960's era pipeline called Line 3, said to be deteriorating and unable to operate at full capacity, with a steel reinforced pipe the same size as KXL's. Also like KXL, the upgraded Line 3 would also pump more than 800,000 barrels a day across thousands of rivers, streams and native lands from the Alberta tar sands to Wisconsin. So the protesters are back at it. Hundreds were arrested during protests this week, even as a helicopter from the federal Border Patrol (unlawfully?) buzzed over them from about 20 feet, kicking up dust and debris on more than 1,000 peaceful demonstrators. They are calling for President Biden to take similar action on Line 3 that both he and Obama took in lifting permits for KXL. The Administration has yet to take a position on Line 3, but protesters are back at it, with some blocking off the entrance to a construction site this week, by parking --- and spending the night chained to --- a boat named "Good Trouble" that they parked in front of one of the Enbridge construction sites. We cover that critical new battle today.
  • These actions to save the environment are for good reason, as we are currently seeing very clearly in the Southwest, which is facing another record "megadrought" right now. Lake Mead --- the nation's largest reservoir, which provides water for agriculture and human consumption to seven states --- is at its lowest level since it was built in the 1930s. Water cutbacks are already in place and likely to become much more severe by August if the lake's level, which sits on the border of Nevada and Arizona continues to drop. More than 86% of AZ is already under "extreme" or "exceptional" drought. Power supplies in the region are also likely to be affected, as Mead supplies water to Hoover Dam, which has already cut back electricity generation due to the low water levels. In California, reservoirs are now at 50% of normal capacity, with mountain snow-pack already gone two months earlier than normal, vegetation moisture at record lows, Summer just beginning and fire season set to begin as early as this month. All of this, thanks in no small part to man-made climate change due to the burning of fossil fuels like the ones that won't being flowing through the KeystoneXL and --- if environmentalists win more battles --- through massive pipelines like Line 3 or Dakota Access. This fight matters. Not only for the future, but for the immediate present, as those of us out West can attest right now.
  • Meanwhile, overseas, President Biden is kicking off his first trip as President, meeting with British Prime Minister Boris Johnson today, after speaking to U.S. troops about the importance of reinforcing democracy over rising autocracy upon his arrival in Europe yesterday. Johnson warmly welcomed Biden as the two leaders today reaffirmed their nations' "special relationship" by renewing the World War II era Atlantic Charter signed by FDR and Winston Churchill.
  • BoJo wasn't the only one to welcome America's new President. A new survey out today from Pew Research Center underscores the support by the publics of 16 economically developed nations who couldn't be happier to see Biden in place rather than Trump, after trust in the U.S. overseas fell to historic lows under the previous President. We cover some of the striking numbers from Pew today, including, for example, the 75% of respondents who express confidence in Biden to "do the right thing regarding world affairs", versus the paltry 17% in the same countries who thought as much about Trump. Overall favorability for the U.S. skyrocketed 23 points since last year, but other numbers from the survey suggest the U.S. still has a long way to go to in restoring their leadership role after damage done to the nation and the world during Trump's failed tenure.
  • Texas' corrupt Attorney General Ken Paxton is facing still more trouble. Sad! The state's top law enforcement official is already facing multiple indictments on felony securities fraud in Texas, even as the FBI is now investigating him for abuse of power, following a complaint to the feds by eight of his own top staffers. Now, as AP reports in an exclusive today, Paxton is also in trouble with the Texas Bar Association, which is investigating a complaint brought after the frivolous lawsuit he filed at the U.S. Supreme Court last year to overturn the Presidential election results in four states won by Biden. That case --- which the state's own solicitor general refused to represent at SCOTUS --- was thrown out by the high court. Now Paxton faces potential disbarment in the Lone Star State, even as he faces a primary challenge from George P. Bush (Jeb's kid) before next year's election.

On today's BradCast: After a disastrous four year mistake by the name of Donald Trump, the United States, under the leadership of Joe Biden, is taking the lead once again on our global climate emergency on Earth Day 2021. Or, at least, trying to. [Audio link to full show is posted below summary.]

Among our coverage today...

  • Global tensions were greatly eased on Thursday with the announcement that Russia --- which had been amassing more than 100,000 troops on its border with Ukraine --- plans to deescalate and pull most of its troops back by May 1. The tensions continue to simmer, however, amid the years-long, ongoing conflict in the region, between NATO-backed Ukraine and Russia-backed separatists, where 14,000 have died over the past 6 or 7 years of war. And, of course, the U.S. and Russia remain at odds over any number of things. But today's announcement at least lowers figurative global temperatures just a bit.
  • As to lowering literal global temperatures, more than 40 world leaders --- including Russia's Vladimir Putin and China's Xi Jingping --- met today for Day 1 of a virtual global climate summit hosted by Joe Biden and the White House, as the U.S. rejoins the landmark Paris Climate Agreement and hopes to assert its critical leadership role once again after Trump left the pact, increased the dangerous production of fossil fuels, and dismissed deadly global warming as a "hoax". President Biden, on the other hand, doubled-down on President Obama's previous commitment to the Paris Climate Agreement today, by announcing today that the U.S. vows to cut deadly greenhouse gas emissions in half by 2030, and reach net-zero emissions by 2050. Desi Doyen binge-watched hours of today's worldwide Zoom conference and shares both key details and those that may not make the corporate media headlines. Including desperate pleas for help and funding from some of the nations most effected by --- but least responsible for --- climate change, and from young climate activists who urge the nations of the world to stop making excuses and take far more decisive action to meet the true, scientific urgency of the moment.
  • Back in D.C., Republicans continue to block the formation of a bipartisan 9/11-style commission to examine the deadly, Trump-fueled insurrection on January 6th, despite a rapidly growing number of troubling new questions about the disastrous failure to protect the U.S. Capitol from the angry MAGA Mob while Joe Biden's 2020 Electoral College victory was ratified during a joint session of Congress. Last week, an Inspector General's report found that both DHS and the FBI had warned Capitol Police, days before the attack, that "Congress is the target". And yet, Capitol Police leadership instructed officers NOT to use their most effective methods to defend the Capitol. Why? A Washington Post investigation subsequently found that D.C. Metro Police --- out-manned by 58 to 1 on the west side of the Capitol --- radioed for emergency back-up at least 17 times over 78 minutes at the height of the attack, but received no response. Why? New evidence has been emerging from more than 400 indictments made in the days following the insurrection to reveal that the assault, which injured and hospitalized more than 140 law enforcement officials, was far more violent than many have understood. And, on Wednesday, Rep. Zoe Lofgren (D-CA) revealed during a hearing in the House Administration Committee that she chairs, that undisclosed internal investigations suggest Capitol Police were instructed to seek out anti-Trump protesters, but not pro-Trump protesters. Why? We ask those questions and many more, as the chaos and confusion of disparate investigations continues while the GOP obstructs the formation of an over-arching commission that might be able to make sense of what actually happened on January 6th, and who should actually be held accountable.
  • Finally, Desi returns for our latest Green News Report on Earth Day, documenting new commitments to stave off the worst effects of our climate emergency by world powers; Rep. AOC and Sen. Markey reintroduce their Green New Deal; And Nobel-prize winning climate scientist Dr. Michael E. Mann offers his thoughts as to whether the latest actions may be enough to save humanity...

On today's BradCast, a brief if welcome respite (mostly) from the embarrassment of Donald Trump's pathetic, ongoing denial about his election loss, for a look at some under-reported news from last week's election, and the worsening crisis that Trump really needs to eventually face Crimes Against Humanity charges for. [Audio link to show is posted below.]

The COVID-19 crisis continues its stunning surge in the U.S., with new daily case numbers now clocking in at 150,000 after reaching 100,000 for the first time only last week. Hospitalizations are also now shattering all time records, with some 65,000 admitted across the country. It's all getting much much worse, including (perhaps, especially) at the White House, following Trump's maskless super-spreader Election Night "Victory" Party last week. One senior official after another is now testing positive there, along with RNC officials who have reportedly been spending time spreading the virus while shuttling between the White House and various states in which the Trump Campaign is pathetically contesting election results. Sadly, the oldest member of Congress, 87-year old, 24-term GOP Congressman Don Young of Alaska also announced he tested positive on Thursday.

But perhaps of even more note to BradCast listeners, the wife of Georgia's hapless wingnut Sec. of State Brad Raffensperger says she is positive. That means the Secretary himself will now be forced to quarantine as his state is set to kick off the unprecedented --- and likely disastrous --- mess that Raffensperger described yesterday as "an audit, a recount, and recanvass all at once" in the statewide Presidential contest. Joe Biden appears likely to have defeated Donald Trump in the state by more than 14,000 votes.

We explained in great detail on yesterday's BradCast why Raffensperger's newly-announced statewide hand-count is likely to be a mess (and end up increasing Biden's margin if it's legitimately carried out). But now, with Raffensperger in quarantine, it will be even more of a mess --- or it could run much more smoothly now that he won't be there to screw everything up!

Either way, we're happy to associate with Karl Rove, of all people, today. He opined in the Rupert Murdoch-owned Wall Street Journal last night that "This election won't be overturned," arguing persuasively that Trump's "efforts are unlikely to move a single state from Mr. Biden's column, and certainly they're not enough to change the final outcome." If even Rove is unwilling to play along with Trump's hapless scheme to steal the White House for a second term, then you can probably rest easy that none off this is ultimately going to amount to anything more than anxiety, bluster and noise from our cry baby President.

But, in a welcome break today from our deranged, wannabe tyrant and outgoing President-in-denial, we catch up on just a few of the noteworthy contests and issues from last week's ballot concerning criminal justice reform and voting rights. Despite disappointing losses for Democrats in the U.S. House and Senate, there was quite a bit of very encouraging news for progressives in down-ballot races for District Attorney and County Sheriffs, as well as measures that take on mass incarceration and over-policing. We also saw voters approve the legalization of recreational marijuana in every state where it appeared on the ballot (including, yes, so-called "deep red" states), along with other very progressive decriminalization measures to begin winding down our long, failed War on Drugs.

We're joined today to discuss all of this and more by DANIEL NICHANIAN, popularly known as simply @Taniel on the Twitters. He is the Editor of The Appeal: Political Report and a Senior Fellow at the Justice Collaborative, where he reports on the local politics of criminal justice reform, mass incarceration and voting rights, among other important matters.

"When you look at the county level, at the state level, there are a lot of opportunities for progressives to push the conversation forward, to push policies in a more progressive direction, specifically on criminal justice," he tells me. "If you do care about mass incarceration or about law enforcement, about racial injustices that accompany all that, then the local level, the county level is really where you should be looking. Because prosecutors, sheriffs and officials that are elected locally are going to be some of the most important actors that are going to be deciding what practices and policies are going to be implemented. And that's where we saw some big flips this year."

After an update on the latest news, I'm joined by Blogger TOM SULLIVAN, aka BloggersRUs, who writes for Digby's Hullabaloo blog. After publishing a post about Lawrence O'Donnell's MSNBC report on Donald Trump and Deutsche Bank, Tom received a letter from Donald Trump's attorney demanding a retraction and an apology. He explains what happened.

Then we turn our attention across the pond to the UK, where the new Prime Minister Boris Johnson appears to have engineered a coup of sorts. The Queen approved his plan to suspend Parliament for five weeks to allow him time to push through a "no deal" Brexit. People have taken to the streets in protest. I'll speak with American ex-patriot DENIS CAMPBELL, an author, journalist and broadcaster, who does his best to explain what's happening over there.
