Merry Christmas from the White House and the NRA...
UPDATES: Bushmaster semi-automatic assault rifle and others weapons used in mass murder legally purchased and registered; Newtown, CT elementary school shooting 2nd deadliest in U.S. history, most came since NRA helped loosen laws; Tearful President speaks in Brady Press Room, calls for 'meaningful action regardless of politics', fails to offer specifics...
By Brad Friedman on 12/14/2012 11:16am PT

[This began as breaking coverage. It has been UPDATED many times below.]

Despite the horror of a second mass shooting playing out during the holiday season this week, White House Press Secretary Jay Carney says "today is not [the] day" to discuss gun laws. So it is, undoubtedly, a very Merry Christmas for the terrorist-enabling NRA and their cowardly supporters.

* * *

UPDATE 12:14pm PT: According to AP, at this hour, there are 27 dead at the school shooting in Newtown, Connecticut, including 18 children, most of them kindergarteners, making this the second deadliest shooting in U.S. history. Which means, according to BuzzFeed's Andrew Kaczynski, that "of the 12 deadliest shooting attacks in US history, six have occurred since 2007."

In other words, the six of the most deadly shootings in our history all happened in the years since the NRA was so successful in assuring the Reagan-era assault-weapons ban was ended and other gun laws were loosened and struck down entirely across the country.

As of this week, all 50 states now allow concealed guns to be carried. But, according to the terrorist-enabling NRA and its cowardly supporters, the solution is for still more people to carry guns (the Republican MI legislature approved a new law allowing guns in schools just last night) so we all keep getting safer and safer. Right?

The NRA plan to make America safer: Everyone get a gun. Wait for someone in bullet-proof armor to use a semi-automatic assualt rifle to shoot 60 people in a crowd in 90 seconds or so. Someone try to shoot them. That plan is perfect! No downsides at all.

UPDATE 12:21pm PT: President Obama just spoke in the Brady Press Room, named for Ronald Reagan's Press Secretary James Brady, who was shot in the head during the assassination attempt on Reagan, and the man for whom the now expired assault weapons ban, supported by Reagan and signed by George H.W. Bush, was named.

In terse remarks, while fighting back tears, the President said: "We've endured too many of these tragedies these past few years...We are going to have to come together and take meaningful action to prevent tragedies like this, regardless of the politics."

He offered no suggestions, at this time, for that "meaningful action".

UPDATE 1:20pm PT: Number of children said killed, among the 27 shot by suspect, increased to 20.

Also, Democratic strategist Julian Epstein on MSNBC says 30 people are killed by guns every day in the U.S. 11,000 per year. "The equivalent of a jumbo jet going down every week in this country."

UPDATE 3:27pm PT: According to NBC News: "Weapons used in shooting were legally purchased and registered to gunman's mother, law enforcement officials tell NBC News ". Thanks for the great work, NRA con-men!

UPDATE 3:40pm PT: Fox "News" confirms weapons used were legally purchased and registered by shooter's mother (who was also killed). They (and CNN) report one weapon was a .223 caliber semi-automatic rifle made by Bushmaster. Here's the Bushmaster 2012 catalog. Note the bottom of their website includes two different links to the NRA.

Apparently, you can buy one over the Internet today. It comes standard with 30-round magazine capacity. 27 were killed in CT today.

Here's a video of a .223 Bushmaster AR-15, similar to the one reportedly used in the killing of 27 in CT today, firing at 100 yards...

UPDATE 9:51pm PT: There seems to be quiet a bit of confusion, and conflicting information, about the type of weapons used in the mass shooting today. So let's try to clear that up a bit, with what we're able to learn at this hour...

ALSO: NY, CT, PA, VA and OH polling sites struggle to get back on line after Superstorm Sandy and in time for Election Day...
By Brad Friedman on 11/3/2012 11:47pm PT

[This article cross-posted by Salon...]

Since both before Superstorm Sandy hit, and after, we've been reporting on concerns in states where voters are forced to vote on electronic voting systems on Election Day and, thus, could be kept from being able to cast a vote at all in this Tuesday's Presidential Election should power be unavailable at polling sites.

We've noted that voters simply cannot cast a vote at all on such systems when the power is out, and that it's just one more reason why no American should ever be forced to vote on the 100% unverifiable voting systems, incredibly, still in use across most of states such as New Jersey, Pennsylvania, Maryland, Virginia, West Virginia and parts of Ohio which were all hit hard by the storm, along with New York, Connecticut and elsewhere.

We've got a bit of good news to report today, for some of the voters whose ability to vote at all has been imperiled by this inexcusable, completely foreseeable failure by public officials who have long ago been warned about this possibility and yet refused to do the sensible thing and move to a verifiable paper ballot system to avoid it.

The news is more encouraging in states like NY and CT, where officials respect voters enough to allow them all to vote on paper ballots, even when natural disasters haven't struck...

By Brad Friedman on 4/25/2012 12:43pm PT

Welcome to the civilized world, Connecticut! And thank you for putting an end to the biggest Big Government tyranny there can be.

From AP:

Connecticut's governor has signed a new law that abolishes the state's death penalty for future crimes.

A spokeswoman says Democratic Gov. Dannel P. Malloy signed the bill Wednesday afternoon at a private ceremony with lawmakers, clergy and family members of victims.

Malloy issued a statement calling it "an historic moment" as Connecticut joins 16 other states that have abolished capital punishment. He said it was a moment "for sober reflection, not celebration."

The law replaced the death penalty with a maximum sentence of life in prison without the possibility of release. It does not affect the sentences of the 11 inmates already on Connecticut's death row.

A former prosecutor, Malloy said his position on the death penalty has evolved over the years.

Now about those 11 inmates you all are still planning to murder out there...

State Elections Enforcement Commission says it 'cannot make full and fair determination', but failed to look at documented facts and even Coulter's own admissions...
By Brad Friedman on 10/14/2010 6:10pm PT

The Connecticut State Election Commission announced this morning in Hartford that "it cannot make a full and fair determination of the allegations" against Ann Coulter who was alleged to have committed voter fraud twice in the state by voting illegally from her residence in New York City while being registered at her parents home in the Nutmeg State.

After a nearly inexplicable 20-month investigation, the Commission found "insufficient evidence in the present matter to substantiate the Complainant's claims."

However, The BRAD BLOG can report that, based on the Commission's five-page "Findings and Conclusions", it appears the Connecticut board either overlooked or ignored key evidence, including specific documentation of Coulter's illegal voting history in the state of Florida (they were only off by more than a year!), as well as her own incriminating admissions on the Fox "News" Channel about living in New York City......

By Brad Friedman on 10/6/2010 2:04pm PT

Will Ann Coulter finally be held accountable for having committed voter fraud? We may find out on October 14th when the matter will come up at a public hearing by Connecticut's State Elections Commission after an extraordinarily long two-year delay since the complaints about her allegedly illegal absentee votes in 2002 and 2004 were filed.

As The BRAD BLOG spent years documenting beyond a shadow of a doubt concerning her voter registration fraud and voter fraud in a different state, Florida, Ann Coulter committed third degree felony voter registration fraud, along with a first degree voter fraud misdemeanor, when she lied about her residency and then knowingly voted at the wrong polling place in Palm Beach County, FL, in 2005.

Years of lying to the media, as well as election and law enforcement officials, and a last-minute, inappropriate intervention by a former boyfriend in the FBI, helped run out the clock on those charges. Her offenses in the Sunshine State were eventually found to be beyond the statute of limitations by the Florida State Election Commission (FSEC). The stalling by other friendly Florida agencies took so long that the FSEC didn't receive the case until years after it had been originally reported to law enforcement by the Palm Beach County Supervisor of Elections. So she got off the hook and was never held accountable for easily documented crimes in Florida. [After years of reporting that part of the story in pieces as it developed, we told the entire sordid tale in one fell swoop in Hustler magazine. That April 2008 exposé can be read in full here.]

However, in Connecticut, where official complaints were filed in 2009 --- by a conservative activist --- that she also committed absentee voter fraud in the years prior to moving to Florida, when she allegedly voted illegally from her residence in New York, there is no such statute of limitations for voter fraud. [See UPDATE at bottom of story for someone who disagrees with that point.]

After a 20-month delay, Coulter's case is finally coming up for a vote at a public hearing before CT's State Elections Enforcement Commission (SEEC) on October 14th at 9:00am, 20 Trinity St. in Hartford CT, according to an email from the commission's MaryAnn Stratton and confirmation from the commission's director of communication...

Those who follow me on Twitter may already know that I've been referring there to the New York Times' shameful coverage of the Richard Blumenthal situation as the paper's "ACORN Pimp Hoax REDUX."

Their front page exposé last week suggested that Connecticut's Attorney General --- the leading Democratic candidate for the U.S. Senate --- was, perhaps, a serial liar because, the "paper of record" informed readers, he'd exaggerated his service in the military. But then we learned that the Times had failed to share the complete video taped comments from a recent speech. Instead, they chose to quote and share just one selective portion out of context to help make their case.

Not only did the complete video --- which Times Executive Editor Bill Keller now admits the paper had seen prior to publication of their story --- offer additional comments from Blumenthal in the same speech, which may have mitigated the comments the Times selectively shared with readers, the paper also failed to share with readers that the story had been fed to them originally by the campaign team of one Blumenthal's Republican rivals for the U.S. Senate seat.

Now that the NYTimes' Public Editor, Clark Hoyt --- supposedly the paper's "readers' representative" or ombudsman --- has rung in with his "verdict" on the whole mess over the weekend, we can officially announce that the comparison to the Times' shameful response to the ACORN Pimp Hoax scandal, which we spent the better part of three months detailing earlier this year, is complete...

State officials say case of alleged voting improprieties in 2002 and 2004 'still pending' nearly five months since complaint filed...
By Brad Friedman on 6/22/2009 5:05am PT

It's been nearly five months since the official complaint about Ann Coulter's alleged voter fraud in 2002 and 2004 was filed in Connecticut, yet state election officials continue to refuse comment on the status of the case beyond acknowledging that it's "still pending," as recently confirmed by The BRAD BLOG.

Several charges of absentee voter fraud were alleged in the complaint against Coulter in Connecticut, where evidence shows she cast absentee ballots illegally while living in her then permanent New York City residence.

In addition to the head of the California GOP's voter registration firm pleading guilty to fraud last week (his company, Young Political Majors, is under investigation in several other states as well, and is alleged to have secretly changed thousands of registrations from Democratic to Republican, denying voters the ability to cast votes in last year's primary), and the Republican election official in Kentucky who last month pleaded guilty to participating in a massive election fraud conspiracy beginning in 2002, there still remains the outstanding official investigation into the allegations against Coulter, the GOP's storied Queen of Voter Fraud.

If all you watched was the Fox "News" Channel, however, and their increasingly bizarre --- and yet still evidence-free --- "investigation" into "voter fraud" by ACORN, you'd have no idea. That, even though Coulter herself continues to parade in front of their cameras as a regular guest without ever being asked about the official inquiry in the second state to investigate voting improprieties by the GOP superstar.

"The delay in this case is inexplicable given they need to prove two things: where she registered to vote/voted and where she lived when she registered to vote/voted," the complainant in the case, Daniel Borchers, a Christian conservative who has long opposed Coulter's behavior, told The BRAD BLOG. "Both are easily proven."...

New allegations of absentee ballot fraud in '02 and '04 follow on her multiple voter fraud crimes in FL in '05, for which she was never 'cleared,' as some media have inaccurately reported...
By Brad Friedman on 2/9/2009 1:25pm PT

An official state investigation is now underway into multiple voter fraud charges against Rightwing author and one-time attorney Ann Coulter in Connecticut. The investigation began after a complaint was filed with the state's Elections Enforcement Commission on January 29, 2009.

The BRAD BLOG has exclusively obtained a copy of that one-page complaint which is posted in full, as filed with Joan M. Andrews, Director of Legal Affairs and Enforcement for the commission, at the end of this article.

The complaint was filed by Daniel Borchers, a conservative Christian critic of Coulter's following allegations in the New York Daily News in January that she had illegally voted by absentee ballot in CT, using her parents address there, in 2002 and 2004, despite being a resident of New York City at the time.

Previously allegations by Borchers against Coulter have been the subject of a number of articles over the years here at The BRAD BLOG, and he has, on occasion, even guest blogged a number of times here for us himself.

Though the allegations of Coulter having committed voter fraud in CT in 2002 and 2004 would be her first known instances of casting ballots illegally, they are not the first allegations of such crimes against Coulter. In 2005, after she moved from NY to Palm Beach, FL, she knowingly falsified her Voter Registration Form (a 3rd degree felony), knowingly voted at the wrong precinct (a 1st degree misdemeanor), as well as gave a false address for her drivers license (another 3rd degree felony).

Despite an inaccurate report from AP in May of 2007, subsequently picked up by other media, Coulter was never "cleared" of the voter fraud charges in FL.

The BRAD BLOG has posted indisputable evidence of her FL crimes, including her actual fraudulent Voter Registration Form on which she lied when filling out her own address, official testimony from a Palm Beach pollworker (and the county's former Supervisor of Elections) detailing her knowingly having voted in the wrong precinct, as well as a report from the Palm Beach Township Chief of Police, verifying the crimes.

Coulter, however, was able to escape accountability for the illegalities in FL, due to an inappropriate (and likely illegal) intervention from a former boyfriend of hers in the FBI, and gaming of the legal system, such that the crimes were eventually nullified by the statute of limitations there.

The most recent complaint from Borchers follows articles by the New York Daily News and Lee Stranahan at Huffington Post last month, detailing her apparently-illegal CT absentee voting. But it would not be the first time he would play a roll in this continuing saga...

Since we could use some good news around here for a change, we're happy to highlight yet another conservative decision to honor both the Constitution and the rights of all Americans to enjoy equal protection under the law...

The Connecticut Supreme Court has ruled 4-3 in favor of eight gay couples who sued on the grounds that the state's 2005 civil unions law did not provide equal protection under its constitution.
...
The court's decision in Kerrigan & Mock v. Dept. of Public Health reads, in part:

We conclude that, in light of the history of pernicious discrimination faced by gay men and lesbians, and because the institution of marriage carries with it a status and significance that the newly created classification of civil unions does not embody, the segregation of heterosexual and homosexual couples into separate institutions constitutes a cognizable harm.

Congratulations to the free peoples of Connecticut, and thank you to their Supreme Court for pushing back against those --- Democratic, Republican, or any other --- who would attempt to re-interpret the Constitution and/or liberally create new laws in order to try and discriminate against any American.

Today’s general news has articles about an expanded post-election audit in Connecticut. SOS Bysiewicz has ordered an audit of the results of the August 12 primary. This audit will be of 33% of the precincts. This audit plan had input from UConn. We congratulate the state for taking this step.

Meanwhile in Ohio Secretary of State Brunner has taken a huge step toward securing the voting machines in her state. She has outlawed all "sleepovers" of voting systems at poll workers homes prior to election day. We congratulate the Secretary for taking this step....

UPDATE: 92-Year Old WWII Vet Registers, Says 'Nobody Was Here Last Year to Do This', CT VA Begins to Reverse Position...
By John Gideon on 6/30/2008 1:33pm PT

Guest Blogged by John Gideon, VotersUnite

The federal Department of Veterans Affairs (DVA) has decided, this year, that veterans under their care do not need to vote, so they have ruled that any voter registration drives or other voting related issues are in violation of the Hatch Act. Of course the Hatch Act is a law that keeps federal employees from participating in partisan politics and veterans in veterans' hospitals and nursing homes are not federal employees but the DVA has chosen to ignore that fact.

The Secretary of State of Connecticut, Susan Bysiewicz, decided "Not In My State," so after asking permission to visit veterans' facilities in the state in order to register veterans and show them how to use the state's voting machines and being denied permission she, and the state AG, decided to defy the feds.

UPDATE - 7/1/08: The New Haven Register reports today that Secretary Bysiewicz registered a handful of veterans, including one 92-year old WWII veteran, while standing outside the front door of the New Haven Veterans Center.

"There was nobody here to do this last year," said Martin Onieal, the WWII vet of the Italian and North African campaigns.

Suddenly, when faced with a protest and possible law suit, the director of the VA Connecticut Healthcare System decided that he would reinterpret the rules from the Department of Veterans Affairs and blame any problems on a new employee. He told the Secretary that as long as she signs up as a volunteer and certifies that the registration drive is non-partisan, all is well. Of course this is after two unanswered letters and a phone call on Friday denying her access.

Will other states now take up the gauntlet for our veterans? Will congress step up and put a stop to the misuse of the Hatch Act and disenfranchisement of our veterans? We deserve much better than this.

The Secretary of State's original press release from yesterday follows below...

Election Officials Confirm that Employees from LHS Associates, Diebold's Sole Programmer, Vendor, and Service Provider in NH, Were Allowed to Access Vulnerable Optical-Scan Systems Throughout Election Day
Attorney General's Office Offers Conflicting Information...
By Brad Friedman on 1/12/2008 9:57pm PT

Special to The BRAD BLOG by Dori Smith of Talk Nation Radio

Early research into New Hampshire wards and towns which used Diebold's AccuVote Optical-Scan voting machines during last week's Primary reveals that chronic problems continue with the company's infamous paper-ballot voting machines.

As well, the preliminary investigation reveals a great deal of confusion and conflicting information from local election clerks and a high-ranking official in the state Attorney General's office regarding protocols and security procedures for voting systems and memory cards, and how they are to be handled during Election Day failures.

All four counties I contacted on January 10th that had used Diebold's electronic machines last week reported problems during the election with the machines. Two other calls that same day turned out to have been to areas where electronic voting is not in use, where hand counts are done instead. If the small sampling is any indication, a statewide study would likely reveal that voting machines failed many times during the 2008 Presidential Primary across the entire state.

Problems with the systems were quickly revealed during all of my calls to officials who had used the optical-scan systems in Hanover, Exeter, Nashua, and Manchester.

Little reporting or inquiry into such problems has been done so far by the mainstream media. Reports of machine failures in Stratham, leading to hand counting of votes after a "glitch" was discovered in the optical-scan systems used there, were buried in a local article on Primary results in SeaCoast Online on Thursday. The bulk of media reporting on the anomalous results from the election has focused, instead, on speculation as to what might have gone wrong with pre-election polls. Little if any coverage has been given to whether the results themselves were correct as reported, or whether voting machine errors or tampering may have occurred.

The paper ballots cast by 80% of the state's voters have never been examined by anyone to determine the mechanical vote-counting accuracy. The computer counting of those ballots is overseen by a single, private company which is routinely granted extraordinary access to the systems, and interviews with a number of state officials indicate they all seem to have different understandings of what, if any, rules exist to regulate that access...

Ken Hajjar, Director of Diebold's Exclusive Sales & Service Provider in New England Pled Guilty to Criminal Charges in 90's
Does the Sec. of State of NH --- or CT or MA or VT or ME --- Even Know About It?...
By Brad Friedman on 1/9/2008 8:47pm PT

Does the Secretary of State of New Hampshire have any idea that a key executive in the private firm that programs and "counts" 80% of the state's ballots on hackable, error-prone Diebold voting machines is a convicted narcotics trafficker?

In 1990, Ken Hajjar, the Director of Sales and Marketing for LHS Associates, and childhood friend of company owner John Silvestro, was arrested and pled guilty to charges of "Sale/CND" (Sale of Controlled Narcotics/Drugs) which earned him a 12 month sentence, according to documents received via a public records request and posted this evening at BlackBoxVoting.org.

LHS Associates, as BBV's Bev Harris points out, programs "every single voting machine in New Hampshire, Connecticut, almost all of Massachusetts, Vermont, and Maine."

Hajjar himself is also the the guy who showed up in BRAD BLOG comments, at one point last summer, to let us know we are "totally full of shit" and "deluded...paranoid...looney idealogues" to boot. Well, maybe. But at least we don't have a secret felony conviction, even while owning almost complete control over every vote cast and "counted" in New England.

The newly-revealed felon's impolitic rant here earned him the boot from the Secretary of State of Connecticut, where he is now barred from working, as guest blogger Dori Smith pointed out in another BRAD BLOG story last November, detailing the horrors that are LHS Associates, Silvestro and Hajjar.

When Smith asked Hajjar about his admission that he and his company regularly replace voting machine memory cards (the keys to the kingdom!) at will, in the middle of elections, he told her, "I mean, I don't pay attention to every little law."

We'll say!

Go check out Harris' new article tonight, which includes more details and the arrest record --- along with the note that "until recently, LHS employees were listed on the company Web site. Now the pages identifying who programs New England voting machines have been taken down."

Now ya know why.

Even if you still don't know who actually won the New Hampshire Primary.

(What say we actually count the ballots and put the questions to rest? Just sayin'...)
