New York Mayor Michael Bloomberg has used the "F" word to describe what may have taken place when zero votes were registered for Barack Obama during unofficial results at nearly 80 precincts in New York City on Super Tuesday, including several in heavily African-American areas such as Harlem.

"If you want to call it significant undercounting, I guess that's a euphemism for fraud," the tin-foil hat-wearing conspiracy theorist Mayor --- who would not be welcome to post at the Daily Kos --- is quoted telling the New York Post today.

Politico's Ben Smith follows up today to report that a Bloomberg spokesman "reiterated the charge in an e-mail," but curiously notes that Bloomberg, who "controls the police department" in New York City would not be launching an investigation.

"Loeser said he didn't think there was actually a legal issue at stake in the preliminary, unofficial vote counts," reports Smith.

So if we have all of that straight, the NYC Mayor's office confirmed they believe there was "fraud" at work in the city's Primary Election, but don't believe there are any "legal issues at stake." Interesting position.

For our part, The BRAD BLOG covered the curious issue of NYC's zero vote totals as it emerged last week from a report by the New York Times (which included some misleading information, by the way, as we noted). We don't know if the matter rises to the level of fraud or not. But if we were to use that word, we'd also be calling for a full investigation by every appropriate legal authority.

How the anti-Election Integrity folks who control the front page at the Daily Kos will have to twist and contort themselves to cover this news is beyond us. So we'll simply continue seeking out information from knowledgeable and uncompromised news sources instead.

Counties Choose Paper Ballots Despite Court Ruling

Even though counties had the option, ordered by the Court, to choose DREs [touch-screens], they did not! This is a demonstration of the success of the work election integrity advocates did educating the public, election commissioners and the media. In the end, the commissioners chose paper not because they had to, but because they wanted to. That's pretty huge and says a lot about how deep our success has been.

But, just like Yogi said, it ain't over till it's over, and friends, it ain't over yet...

Paper Says 'Handful' of Zero Vote Totals Also Recorded for Clinton on City's Old Lever Machine, Before Offering Readers an Advertisement for New Electronic Voting Systems...

The conspiracy theorists at the New York Times today tell us something is amiss, but proceed to ultimately tell us nothing about why it happened, suggesting that all is just fine...and that it'd be even better if the city "upgraded" to new electronic voting machines...

Black voters are heavily represented in the 94th Election District in Harlem’s 70th Assembly District. Yet according to the unofficial results from the New York Democratic primary last week, not a single vote in the district was cast for Senator Barack Obama.

That anomaly was not unique. In fact, a review by The New York Times of the unofficial results reported on primary night found about 80 election districts among the city’s 6,106 where Mr. Obama supposedly did not receive even one vote, including cases where he ran a respectable race in a nearby district.

City election officials this week said that their formal review of the results, which will not be completed for weeks, had confirmed some major discrepancies between the vote totals reported publicly — and unofficially — on primary night and the actual tally on hundreds of voting machines across the city.

In the Harlem district, for instance, where the primary night returns suggested a 141 to 0 sweep by Senator Hillary Rodham Clinton, the vote now stands at 261 to 136. In an even more heavily black district in Brooklyn — where the vote on primary night was recorded as 118 to 0 for Mrs. Clinton — she now barely leads, 118 to 116.

So how did the numbers change from 141-0 to 261-136 and from 118-0 to 118-116? No confirmed explanation is given, but some lazy guesswork about how votes are counted on NYC's old lever voting machines is proffered by local Election Officials, and dutifully passed on by the Times who --- before proceeding with a misleading "ad" for new electronic systems --- soothes our concerns by informing us that an unspecified number ("a handful") of districts also reported zero votes for Clinton in the original, unofficial tallies...

Last Year, a State Official Pleaded Guilty to Felony For Using State Employees to Transport His Invalid Wife

Yesterday, we learned that when he was mayor of New York, Rudolph Giuliani allegedly played a shell game to hide from taxpayers --- and his scornful wife --- the cost of dragging his security details along when he traveled out to Long Island to visit his then-girlfriend, Judith Nathan. Now comes news that he assigned a car and driver from the NYPD to Nathan during their affair:

Well before it was publicly known he was seeing her, then-married New York Mayor Rudy Giuliani provided a police driver and city car for his mistress Judith Nathan, former senior city officials tell the Blotter on ABCNews.com.

"She used the [police department] as her personal taxi service," said one former city official who worked for Giuliani.

The former city officials said Giuliani expanded the budget for his security detail at the time. Politico.com reported yesterday that many of the security expenses were initially billed to obscure city agencies, effectively hiding them from oversight.

Last December, Alan G. Hevesi, the New York State Comptroller, pleaded guilty to defrauding the government and resigned his position after it was revealed that he had detailed a state employee to attend his wife, who was an invalid:

Mr. Hevesi, the state’s top fiscal watchdog, told the court in a hoarse voice that one of the state workers he had assigned as a driver for his wife, Carol, had done much more than provide security for her. Prosecutors filed court papers revealing that the worker had also watered her plants, driven her to Bloomingdale’s and dropped off her dry cleaning.

In addition to pleading guilty to a felony, Hevesi paid a fine of $5,000 and reimbursed the state for $206,000.

No word as of yet whether New York's Democratic governor, Eliot Spitzer, will look into allegations that Giuliani used public employees to carry out personal services for him and his girlfriend.

Fundraising is down dramatically nationwide for the Republican Party, but things are especially bad here in California, where the state GOP is in such dire straits that its ability to compete in both state and federal races could be affected.

But while the state party is cutting programs and considering layoffs, hundreds of thousands of dollars are flowing in from out-of-state fatcat supporters of Rudy Giuliani --- funds the state GOP can't touch because they are earmarked specifically to promote a ballot initiative that would, if passed, give Rudy (i.e., the Republican presidential candidate) 20 or so of the state's 55 Electoral College Votes, even if he loses the state to the Democratic candidate.

The California Republican Party has been in a death spiral since the 1990s when, under former Gov. Pete Wilson, the decision was made to make illegal immigration its signature issue. It's way too soon to send for the embalmers but the current crisis couldn't be worse:

Charge Is Part of $100 Mil Lawsuit over Her Dismissal over O.J. Book

Judith Regan, the tough-talking former book publisher and editor and television producer, has accused an executive at Rupert Murdoch's News Corporation of encouraging her to lie about her affair with Bernard Kerik, the former New York City police commissioner, in order to protect the presidential aspirations of Kerik's friend, Rudolph Giuliani:

Regan makes the charge at the start of a 70-page filing that seeks $100 million in damages for what she says was a campaign to smear and discredit her by her bosses at HarperCollins and its parent company, News Corporation, after her project to publish a book with O.J. Simpson [titled, "If I Did It"] was abandoned amid a storm of protest.

In the civil complaint filed in State Supreme Court in Manhattan, Ms. Regan says the company has long sought to promote Mr. Giuliani’s ambitions. But the lawsuit does not elaborate on that charge, identify the executive who she says pressured her to mislead investigators, or offer details to support her claim.

In fact, the allegation about the executive makes up a small part of a much broader array of claims concerning what she says was her improper removal from a job atop one of the more commercially successful book publishing operations.

This story quashes any doubt which candidate the folks at NewsCorp are rooting for in the next election. Not that the revelation is particularly surprising. Giuliani is a close friend of Roger Ailes, the CEO of Fox News, NewsCorp's loss-leading marquee cable channel. With Rudy in the Oval Office, FNC's conduit into and out of the White House propaganda shop would be assured for four more years.

On a much more salacious level, even in the continuum of recent revelations of GOP adulteries --- think Sens. Larry Craig and David Vitter, Rev. Ted Haggard and publisher Richard Mellon Scaife, who funded the Arkansas Project to dig up dirt on the Clintons' marriage --- Regan's affair with Kerik was particularly sordid. While Kerik was hooking up with Regan, he was simultaneously having an affair with another woman, all while his wife was pregnant:

And Other Quick Observations on Last Night's Debate in Orlando...

During the ninety full minutes of last night's lively Republican Debate on Fox "News" from Orlando, the word "Bush" was used only twice by the candidates. One time each by Ron Paul and then Fred Thompson.

The Fox "News" anchors used the word five times.

Everyone else? Apparently never heard of him.

(On the other hand, as Arlen Parsa notes, Hillary was mentioned some 34 times.)

Attorney Andi Novick Tells NY Officials Why The Vendors Lack Integrity

In a recently released report, New York Attorney Andrea Novick, Esq., tells members of New York state government and now the world that the vendors of the voting machines that most of us use are NOT responsible citizens and why. This report was written for, and addressed to, Governor Spitzer, the State Board of Elections and the State Legislature.

In her report Novick explains that New York state has laws that should bar any of the vendors from doing business in the state.

New York State is about to start testing the products of vendors who by any reasonable application of the State Finance Law (SFL) and New York State Comptroller's Procurement and Disbursement Guidelines (Vendex rules) should be barred from doing business in New York. I have included below a partial documentation of the available evidence revealing the myriad of ways in which the vendors fail to meet the criteria for responsible contractors. The State is responsible for affirmatively requiring all necessary disclosure to satisfy itself of the sufficiency of a vendor's responsibility. To assist in this effort, I have prepared this memo.

McCain Camp Reportedly Working With PR Outfit Tied to Apparent Creator of 'JEW-liani' Hit Video
An Elaborate 'Hoax'... or Something More?

A mysterious and politically-incorrect series of viral videos posted on YouTube are lighting up speculation online about their origin. A report published on July 13th attributed them to an employee of of Stevens, Reed, Curcio & Potholm (SRCP), the same Republican firm that produced the infamous Swift Boat Veterans for Truth ads in 2004.

The videos, posted on the YouTube account "abrad2345", mock several Republican candidates, at times making racist attacks against Rudy Giuliani, making fun of his bout with prostate cancer, suggesting that Fred Thompson's wife is transgender, and Mitt Romney is gay. SRCP now apparently works for John McCain.

"In 2004, Mr. McCain said the Swift Boat Veterans for Truth advertisement asserting that Senator John Kerry of Massachusetts had not properly earned his medals from the Vietnam War was 'dishonest and dishonorable,'" the New York Times reported in February. "Nonetheless, he has hired the firm that made the spots, Stevens Reed Curcio & Potholm, which worked on his 2000 campaign, to work for him again this year."

Plans for syndication of the story alleging an SRCP connection to the videos on The BRAD BLOG Monday were delayed at the last minute due to legal concerns after SRCP's lawyers claimed the story was false and asked that it be purged from The Daily Background blog, where it had been originally published.

Watch the first of the "abrad" videos (video at right), which appear to be endorsing Giuliani in a mocking way. The video even resorts to racism for its not-so-subtle attacks on Giuliani. More of the videos can be found here.

"We strongly urge you to cease distribution of all content furthering from these false assertions," a July 16th letter from SRCP's law firm Dickstein Shapiro LLP read. "The business reputation and professionalism of SRCP is being challenged in a way that causes irreparable damage unless you act immediately."

Harold A. Schaitberger, the General President of the International Association of Fire Fighters does not pull any punches in his smackdown of GOP presidential candidate Rudy Giuliani (see video). Requests for commutation generally are not accepted unless and until a person has begun serving that sentence. Nor are commutation requests generally accepted from persons who are presently challenging their convictions or sentences through appeal or other court proceeding.

And from Patrick Fitzgerald's reaction:

We comment only on the statement in which the President termed the sentence imposed by the judge as “excessive.” The sentence in this case was imposed pursuant to the laws governing sentencings which occur every day throughout this country. In this case, an experienced federal judge considered extensive argument from the parties and then imposed a sentence consistent with the applicable laws. It is fundamental to the rule of law that all citizens stand before the bar of justice as equals. That principle guided the judge during both the trial and the sentencing.

Meanwhile, former Sen. Fred Thompson couldn't be happier:

I am very happy for Scooter Libby. I know that this is a great relief to him, his wife and children. While for a long time I have urged a pardon for Scooter, I respect the President’s decision. This will allow a good American, who has done a lot for his country, to resume his life.

...And Guilliani joins him in standing firmly against National Security for America, and in favor of outing covert CIA assets:

After evaluating the facts, the President came to a reasonable decision and I believe the decision was correct.

George W. Bush's father, however, feels differently. Or, at least he did back in 1999 when addressing his former colleagues at the CIA...

New Yorkers win Round One in fight for source code protections

I’m pleased to report that due to a huge outpouring of calls from citizens, and three intense days and nights working the Capitol halls by New Yorkers for Verified Voting and the League of Women Voters/NY, New York State's voting machine laws were not weakened or tampered with in any way. Neither the Microsoft amendment nor any other proposals being pushed by voting machine vendor lobbyists made it into any of the thousands of bills passed in this last crazy week of the session. The citizens of New York State stood up to these powerful private interests and won.

A rapid response by citizens to this threat to our essential protections resulted in over 3,000 calls to legislators in just over two days. This huge outpouring from the public averted the threat of a stealth amendment slipping into law unnoticed, as so often happens in this last hectic week in Albany. Every legislator I talked to over the last three days was impressed by the volume of calls and the passionate reaction, and promised they would watch the bills carefully for back door changes, adding their eyes to ours. They reaffirmed their commitment to keeping New York’s voting machine laws among the strongest in the nation, and in the end, they came through. The public’s response to this threat has kept our representatives vigilant and committed to keeping New York State’s voting machine laws among the strongest in the nation.

Keeping our strict laws intact was an essential win for us, but this is only Round One. The next battleground will be the New York State Board of Elections, where the four commissioners are discussing how to interpret the New York State law. And yes, you guessed it, one of the interpretations being promoted by some of these decision makers would allow the voting machine vendors to use Microsoft and other source code in voting technology that would not be subject to review in the event of election problems. Our next task will be to make sure the State Board of Elections understands what we’ve told the State Legislature, that the public’s will is expressed precisely in the letter of our election law – ALL source code must be handed over, not just some pieces of it. Our elections, and the technologies we use to conduct them, belong to us. And we the people aim to keep it that way.

But today, let’s celebrate. Congratulations friends, we did it!

Election Board Ire as EAC Fails to Disclose 'Soiled Laundry' on Failure to Accredit Voting System Test Lab

Tom Wilkey, former executive director of the New York State Board of Elections, and now the executive director of the Election Assistance Commission, has refused to answer questions from New York election officials about the non-accreditation of voting machine test lab Ciber, Inc. A letter from a state election official describes the lack of response for requested information as "truly outrageous and scandalous." That refusal "to open the curtain that hides their soiled laundry," may lead to subpoenas by the State Board.

The ongoing secrecy, and apparent duplicity, of the U.S. Elections Assistance Commission (EAC) surrounding the failure of Ciber to be given federal accreditation to testing voting machines began last summer causing an unknown number of voters around the country to vote on improperly tested electronic voting machines in last November's election. The EAC failed to notify elections officials or the public about what they had already discovered concerning the poor state of testing conditions and procedures by the lab.

The EAC secrecy has been particularly troublesome in New York where Ciber has been testing equipment specifically under contract with the state. The EAC was created by the Help America Vote Act (HAVA) in 2002 and is charged with accrediting "independent testing authorities" to examine and certify electronic voting machines. Ciber failed to gain interim accreditation when the testing duties shifted from the National Association of State Election Directors (NASED) to the EAC last July.

As discussed in a report yesterday --- which included a series of 'very friendly' notes between Wilkey and the current chair of the EAC, Donetta Davidson --- Wilkey’s silence may stem from his role as chair of the Voting Systems Board at NASED prior to his position at the EAC. The failures of Ciber to properly conduct and document security testing of voting machines that led to the denial of interim accreditation occurred during Wilkey’s watch at NASED where he served with his "Sis", Davidson, as he referred to her in the emails between the two.

Davidson was on Wilkey’s NASED certification board along with "ex officio" member Shawn Southworth of Ciber, Inc. Wilkey and Davidson’s silence about the failures of Ciber has angered election officials around the nation who had relied on Ciber’s certification of their voting machines in the November 2006 election.

As also recently reported, the delay in the public disclosure of the problems at Ciber, conveniently allowed both the firm's founder and its CEO the time needed to unload $1.7 million of company stock before the news would eventually be reported by the New York Times earlier this month.

New York, unlike the rest of the states, did not rush into purchase of new, expensive voting machines without public hearings and more thorough testing and ended up being sued by the U.S. Justice Department for HAVA non-compliance. Commissioner Doug Kellner of the New York State Board of Elections has reacted to the EAC stonewalling about Ciber with a call for a subpoena in hopes of getting some answers.

In an email announcement on Wednesday, Kellner expressed his outrage in no uncertain terms...

While 150,000 Votes Already Miscounted or Lost!

Yesterday Bev Harris' BlackBoxVoting.org site began issuing "Bandwidth Exceeded" messages to users attempting to access the site. Such a message generally occurs when more users are attempting to access the site than the server can comfortably handle or when the bandwidth allocated by the domain's Internet Provider is exceeded.

Today, attempts to access the site now simply return a "Cannot Find Server" page, leading me to believe that hack attempts and/or Distributed Denial of Service (DDoS) attacks have been successful for the time being. [UPDATE: BlackBoxVoting.org is now finally back online. At least for now.]

We have had such attacks here at the BRAD BLOG for the last three days which have taken us similarly down and/or greatly slowed page retrieval at various times. Given the much higher profile BBV has had, it's little surprise that folks who'd rather see patriotic efforts like theirs discontinued would work feverishly to disrupt it.

Ms. Harris and BBV has been spearheading a huge "Freedom of Information Act" filing to collect and review audit logs and other materials from the election in some 3,000 US counties, and thus, her group has attracted quite a bit of attention in the past week. BBV has been attempting to warn Americans for at least the past year about the ticking time-bombs of unregulated, unauditable, and privately owned Electronic Voting machines and their corporate owners (the vast majority of them very closely tied to the Republican party).

Attempts to silence and/or disrupt sites like hers and ours, I believe, speak volumes in support of the underlying charges that we've been making. If there was nothing to fear in examining the inner-workings of these companies, and the way that our votes our counted --- specifically in last week's election --- there would be no reason to attempt to silence and disrupt those who are attempting to do so.

In other words, if the election was clean and fair, what's the fear of giving it a close inspection?

Now perhaps the problem at BBV really is simply related to an overage of bandwidth demand, however, given past attacks the site has received, similar attacks here, and the message changing from "Bandwidth Exceeded" to "Cannot Find Server", I'm inclined to believe that the problem is hostile attacks.

To those who claim that the roughly 150,000 (so far) documented votes that have been reported and confirmed by Election Officials as being mis-allocated would not have changed any election results, I'd point out:

1) Those are just the numbers reported by a mainstream media which by and large went "on vacation" after Kerry's "concession" last Wednesday.

2) Many of those mistabulated and/or lost votes discovered were due to software errors that likely exist on many other identical computers in many other counties in America where they may not yet have been noticed and/or reported.

3) The results of at least one ballot initiative last Tuesday has already been reversed when 70,000 previously mis-counted votes due to "software error" were "discovered" in Broward County, FL!

4) There has been a long record of elections in this country being mis-tabulated and/or reversed due to Electronic Voting Machine error in recent history.

Chapter 2 of Bev Harris' book, Black Box Voting outlines tons of those recently overturned elections. Here's the PDF version of Chapter 2, but since it's currently offline as of this posting, here's a summary of just a few such recent incidents summarized courtesy of Hunter over at DailyKos:

In the 2002 general election, a computer miscount overturned the House District 11 result in Wayne County, North Carolina. Incorrect programming caused machines to skip several thousand partyline votes, both Republican and Democratic. Fixing the error turned up 5,500 more votes and reversed the election for state representative.

Voting machines failed to tally "yes" votes on the 2002 school bond issue in Gretna, Nebraska. This error gave the false impression that the measure had failed miserably, but it actually passed by a 2 to 1 margin. Responsibility for the errors was attributed to ES&S, the Omaha company that had provided the ballots and the machines.
...
An Orange County, California, election computer made a 100 percent error during the April 1998 school bond referendum. The Registrar of Voters Office initially announced that the bond issue had lost by a wide margin; in fact, it was supported by a majority of the ballots cast. The error was attributed to a programmer's reversing the "yes" and "no" answers in the software used to count the votes.

Software programming errors, sorry. Oh, and reverse that election, we announced the wrong winner. In the 2002 Clay County, Kansas, commissioner primary, voting machines said Jerry Mayo ran a close race but lost, garnering 48 percent of the vote, but a hand recount revealed Mayo had won by a landslide, receiving 76 percent of the vote.

In the November 2002 general election in Scurry County, Texas, poll workers got suspicious about a landslide victory for two Republican commissioner candidates. Told that a "bad chip" was to blame, they had a new computer chip flown in and also counted the votes by hand --- and found out that Democrats actually had won by wide margins, overturning the election.

In 1986 the wrong candidate was declared the winner in Georgia. Incumbent Democrat Donn Peevy was running for state senator in District 48. The machines said he lost the election. After an investigation revealed that a Republican elections official had kept uncounted ballots in the trunk of his car, officials also admitted that a computerized voting program had miscounted. Peevy insisted on a recount. According to the Atlanta Journal-Constitution: "When the count finished around 1 a.m., they [the elections board] walked into a room and shut the door," recalls Peevy. "When they came out, they said, `Mr. Peevy, you won.' That was it. They never apologized. They never explained."

A software programming error gave the election to the wrong candidate in November 1999 in Onondaga County, New York. Bob Faulkner, a political newcomer, went to bed on election night confident he had helped complete a Republican sweep of three open council seats. But after Onondaga County Board of Elections staffers rechecked the totals, Faulkner had lost to Democratic incumbent Elaine Lytel. Just a few hours later, election officials discovered that a software programming error had given too many absentee ballot votes to Lytel. Faulkner took the lead.

In a 1998 Salt Lake City election, 1,413 votes never showed up in the total. A programming error caused a batch of ballots not to count, though they had been run through the machine like all the others. When the 1,413 missing votes were counted, they reversed the election.

If an official investigation doesn't take place immediately, there is little hope of determing the correct winner of any number of races from last week's election. Not the least of which is the race for President of the United States. And I would think, especially after four years of questions about George W. Bush's legitimacy as "President" that even the Right Wingnuts would like to be able to demonstrate once and for all to the American People that he was, in fact, legitimately elected this time.

Troubling Evidence is Beginning to Mount!

Folks are beginning to pay attention, guys!

Wired Magazine is now reporting that three Members of the U.S. House of Representatives Judiciary Committee are now calling for an investigation of the troubling incidents that we've been reporting concerning irregularities in Tuesday's vote counting!:

Three congressmen sent a letter to the General Accounting Office on Friday requesting an investigation into irregularities with voting machines used in Tuesday's elections.

The congressmen, Democratic members of the House of Representatives from Florida, New York and Michigan, cited a number of incidents that came to light in the days after the election. One was a glitch in Ohio that caused a memory card reader made by Danaher Controls to give George W. Bush 3,893 more votes than he should have received. Another was a problem with memory cards in North Carolina that caused machines made by UniLect to lose 4,500 votes cast on e-voting machines. The votes were lost when the number of votes cast on the machines exceeded the capacity of the memory cards.

There were also problems with machines that counted absentee ballots in Florida. Software made by Election Systems & Software began subtracting votes when totals surpassed 32,000. Officials said the problem affected only certain countywide races on one of the last pages of the ballot. Elections officials knew about the problem two years ago, but the company failed to fix the software before the election this year.

Reports from voters in Florida and Ohio also indicated that some of them had problems voting for the candidate of their choice. When they tried to vote for John Kerry, they said, the machine either wouldn't register the vote at all or would indicate on the review page that the vote was cast for Bush instead.

Keep up the noise, guys! They're starting to listen! I've had other unconfirmed reports about both Dems and the Kerry campaign beginning to take notice of all of this as well!
