Lots of news (for a change?) on today's BradCast after a tremendously busy news weekend (for a change?) [Audio link to today's show is posted below.]

Among the stories covered on today's program: In a fairly transparent attempt to distract from all of his Administration's --- and his own personal --- scandals, Donald Trump announed today that he plans to pull the U.S. out of the North American Free Trade Agreement (NAFTA) between the U.S., Canada and Mexico, and is striking a new trade agreement with Mexico only. We caution to be very aware of that claim.

Then, we're joined by STUART NAIFEH, Senior Counsel at Demos to discuss the lawsuit recently filed by his group and a number of Hispanic-American organizations against 32 counties in the state of Florida. Following last year's catastrophic Hurricane Maria in Puerto Rico, more than 133,000 U.S. citizens living on the island relocated to the Continental U.S., according to the Center for Puerto Rican Studies, which estimates [PDF] more than 54,000 of them now live in Florida. These U.S. Citizens, many of whom speak Spanish only, can now re-register and vote in the state, but the counties named in the lawsuit make election materials available in English only, in violation, the groups argue, of Section4(e) of the 1965 Voting Rights Act. The groups are suing to force those counties to produce election materials in Spanish before the November 2018 midterms and argue that the English-only procedures have led to lower than expected registration by these potential voters in the Sunshine State. Naifeh says this has been a longstanding issue in Florida, but even more of an issue since Maria, since there are suddenly "a lot of people coming all at once with limited English," he says.

Naifeh also explains another lawsuit just filed by the group against the state of Arizona, where the Secretary of State is not properly re-registering voters who have changed their addresses on their drivers licenses through the DMV. That, he argues, means that some 500,000 registered voters, whose registrations should be automatically moved, may find themselves unable to vote or will have their provisional ballots tossed out this November, because "Arizona has been systematically failing to update voting addresses," as required by 1993's National Voter Registration Act. Voters in both states --- Florida and Arizona --- are heading to the polls on Tuesday for their state's midterm primary elections.

Then, some breaking news out of North Carolina, where a federal court panel has found the state's U.S. House Districts to be an unconstitutional partisan gerrymander. That, after the federal courts found the previous maps were unconstitutional racial gerrymanders. The court may order new maps to be redrawn in advance of the November election! If they do, and if the U.S. Supreme Court is deadlocked 4 to 4 on an emergency appeal by the state before a new Justice is seated, then the lower court's order to use new maps for the November 6th election would stand!

Next, over the weekend, the DNC voted to change their bylaws to restrict the role of so-called SuperDelegates (party insiders, activists and elected officials) in the nominating process for Presidential candidates. Under the new scheme, adopted by an overwhelming voice vote at the weekend's annual Summer meeting in Chicago, SuperDelegates would have no vote for the party's Presidential nominee on the first ballot at the Democratic National Convention, leaving the selection of the nominee (if he or she can get a majority on the first ballot) up to state primary and caucus voters, rather than party insiders, before the Convention.

Also today, the Government's student loan ombudsman at the Consumer Financial Protection Bureau (CFPB) has resigned, charging in a scathing resignation letter that the Trump Administration is using the Bureau "to serve the wishes of the most powerful financial companies in America" by allowing private for-profit colleges, universities and student loan companies to run roughshod over American families, despite mandates from Congress to end the decades-long ripoffs by such companies.

On today's BradCast: Understanding two new, seemingly conflicting directives on "dark money" in campaigns --- one of them very encouraging --- and a new complaint filed with the Federal Election Commission charging several GOP Senators unlawfully colluded with the NRA during the 2014 and 2016 elections. [Audio link to show follows below.]

But, first up today, adjusting some numbers! In this past Tuesday's very close U.S. House Special Election in Ohio's (previously, very Republican) 12th Congressional District, the Trump-endorsed GOP candidate Troy Balderson was reportedly up over Democrat Danny O'Connor by just over 1,700 votes out of about 200,000 tallied on election night in the closely watched, bellwether race. On Wednesday, however, Franklin County's Board of Elections discovered an electronic cartridge from one precinct, with 588 votes stored on it, had not been included in the original unofficial tallies. With those ballots now added, O'Connor has netted 190 additional votes over Balderson, lowering the current unofficial margin in the contest to just 0.8 points. A margin of 0.5 or less would trigger an automatic "recount", as thousands of provisional and late vote-by-mail ballots are still being processed.

In Kansas, Tuesday's even tighter race between Sec. of State Kris Kobach and Gov. Jeff Colyer for the GOP gubernatorial nomination, saw its margin cut by more than half, from 191 votes to just 91, out of some 311,000 cast. The adjustment appears due to an incorrectly entered number by the Sec. of State's office on Tuesday night. The controversial, hard-right Kobach's razor-thin lead may further erode (or expand) as some 10,000 provisional and late mail-in ballots are still to be processed. A recount in that contest is all but certain.

Meanwhile, Puerto Rico, in an official statement to Congress, now acknowledges that at least 1,427 were killed during and after Hurricane Maria last year, a vastly different figure than the island's still-official death toll of 64. The new numbers place Maria's death toll much closer to the 1,833 said to have been killed during and after 2005's Hurricane Katrina. We discuss why it has been so difficult for Puerto Rican officials to acknowledge those far-higher numbers, long ago estimated by many experts.

Then we're joined by BRENDAN FISCHER, Associate Counsel at the Washington D.C.'s Campaign Legal Center (CLC), to help explain several important, if seemingly conflicting, pieces of campaign finance related news. About two weeks ago, the Treasury Department announced that non-profits who spend money on political campaigns --- so-called "Dark Money" groups --- would no longer be required to disclose the names of their donors to the IRS. The timing of that new policy, Fischer notes, "was pretty terrible. It happened on the same day that federal prosecutors charged Maria Butina with being an unregistered Russian agent who tried to influence American politics through the NRA, which had spent at least $35 million through its 501c4 [non-profit political action committee] arm during the last election cycle."

"So, if you're concerned about foreign money in elections, you should be really concerned about the Treasury Dept. stating that 501c4s, like [Karl Rove's] Crossroads GPS or the NRA, no longer have to disclose their top donors to the IRS."

Then, a week or so later, last Friday, a federal judge ordered the Federal Election Commission (FEC) to rewrite their current rules, within 45 days, in order to require the disclosure of the names of donors to many of those same "dark money" groups. Fischer details how the new mandate from Judge Beryl Howell, Chief Judge of the U.S. District Court for the District of Columbia, differs from the Treasury Dept. directive and, in fact, could be very good news indeed for those who believe in transparency and public oversight of elections!

"If the FEC was doing its job, then it wouldn't matter quite so much if the IRS was not collecting this information," Fischer tells me. "Judge Howell said that the FEC has been failing at its job, and it needs to go back to the drawing board and draft new rules that are going to ensure effective donor disclosure for certain types of political advertising."

"Judge Howell's decision is a reminder that the FEC is largely to blame for the rise of dark money. It's not just the Supreme Court's decision in Citizens United, it also is in large part the fault of the FEC for failing to enforce the laws that are on the books. The Supreme Court has endorsed donor disclosure, and the laws passed by Congress say that donors to politically active dark money groups must be disclosed. It falls to the FEC to draft the rules that interpret laws passed by Congress and to enforce those rules. But what the FEC has done is draft rules that narrow the donor disclosure laws passed by Congress, and then they failed to enforce even those narrow rules."

While acknowledging the new ruling as "a very big deal", Fischer explains why questions remain as to whether the ruling will be (or even can be) appealed and how the current vacancies on the FEC may prevent them from being able to act within the time ordered by Judge Howell.

In a separate, if somewhat related matter, Fischer details CLC's recently filed complaint with the FEC charging that the campaigns of four different Republican U.S. Senators unlawfully coordinated with the NRA's political action committee in violation of long-standing campaign finance laws during the 2014 and 2016 elections. The GOP Senators named in the complaint: Ron Johnson (WI), Tom Cotton (AR), Cory Gardner (CO) and Thom Tillis (NC).

Among the stories covered on today's post-Memorial Day weekend BradCast. [Audio link to show is posted below]...

First up, some accountability news. Missouri Governor Eric Greitens (R) finally announces his resignation, after two separate indictments (one related to allegedly blackmailing a woman he has admitted to having had an affair with, and the other for unlawfully using a veterans charity contact list during his 2016 run for Governor) and after the GOP-majority legislature convened an historic special session to consider his impeachment.

Also, hit ABC sitcom reboot Roseanne is cancelled just hours after its titular star tweeted a racist comment about a longtime friend and adviser to former President Obama.

Then, why at least some of Trump's obnoxious, inaccurate, and sometimes dangerous tweets actually matter (as much as we try to avoid them). A new poll finds alarming numbers of Republicans (and, yes, Democrats!) actually buy the President's evidence-free claims that as many as 5 million fraudulent votes were cast in the 2016 Presidential election, as his new --- and similarly evidence-free --- tweets targeting Special Counsel Robert Mueller's probe now claim the investigation is "rigged" and is meant for "MEDDLING with the mid-term elections now that Republicans...are taking the lead in Polls".

In fact, while there is no evidence that Mueller's probe is "rigged" or that he is "meddling" in the mid-terms, Republicans are now said to be nearly tied or even taking the lead in some generic U.S. House polling on the heels of Trump's increasingly strident and inaccurate Twitter torrent. (Here, however, is a more skeptical look at those numbers.)

Nonetheless, many Democrats still seem very confident that a "blue wave" is in the making to flip one or both chambers of Congress from GOP control this November in response to Trump, as suggested by a surge in Democratic turnout during the 2018 primaries. It should be noted, however, that there are also signs that GOP turnout is increasing as well.

All of that is before the usual GOP voter suppression kicks into high gear. To that end today, the lawsuits have begun already. Last week, a suit was filed by the League of Women Voters and others against Florida's Republican Gov. Rick Scott and his hand-picked Sec. of State Ken Detzner's refusal to allow early voting centers at public universities.

And, in Ohio, the ACLU has now filed suit against the state's Republican drawn U.S. House districts, charging that the maps, drawn up in secret by the national GOP after the 2010 Census, violate the U.S. Constitution as an extreme partisan gerrymander.

We're joined by ACLU Ohio's Legal Director FREDA LEVENSON, who explains the case, why it's taken so long to be filed after resulting in 12 GOP U.S. House members to the Democrats' 4 over each of the last three elections in the swing-state, and how related cases from other states, now pending decisions at the U.S. Supreme Court, may effect this one.

Levenson also updates us on another case awaiting a decision any day from SCOTUS, regarding Ohio Sec. of State Jon Husted (R)'s attempt to purge voters from the roles after failing to vote in two consecutive federal elections. She explains why the ACLU sees that as a violation of the National Voter Registration Act (NRVA) and how SCOTUS' ultimate decision in this case could result in similar mass voter purges being carried out in states across the country.

On today's BradCast, more news you need to know about in 2018, while cable news hypnotizes you with everything else. [Audio link to show follows below.]

Today, the U.S. National Oceanic and Atmospheric Administration (NOAA) released a new report tallying up the extraordinary costs of weather and climate disasters in the United States during 2017. All told, the damage adds up to a record-shattering $306 billion from devastating hurricanes, droughts, fires, floods, freezes and more last year, as our climate crisis continues to worsen, just as scientists have long warned.

But the corporate media, particularly cable news channels, instead of covering stories you need to know, continue their 24/7 speculation about what Special Counsel Robert Mueller may or may not be up to, the salacious fall-out from Michael Wolff's Fire and Fury book, and now whether Oprah Winfrey will run for President in 2020 following her barn-burner speech at the Golden Globes last night. (Full transcript/video)

Instead, we continue our efforts to focus on stuff that matters to voters in 2018, which they are far less likely to have heard about on those same cable channels. Among those other stories covered today, in addition to our climate-related nightmares: At year's end, the Trump Administration gutted more regulations intended to protect the elderly in nursing homes(!), and continues to cut from the federal work force those who help protect American workers from injury and death on the job at construction sites and manufacturing plants, and anyone who lives near sites containing dangerous chemicals.

Then we open up the phone lines to listeners with other under-covered news and get a bunch of interesting calls, including one from a pharmacist reporting a dangerous saline and antibiotics shortage due to the ongoing disaster in Puerto Rico, where many of the manufacturers were once located and where power is still out for more than a million U.S. citizens following Hurricanes Irma and Maria more than 100 days ago.

But our favorite callers, as usual, are the rightwingers and conspiracy theorists and we get some humdingers today. Don't miss the call from a VERY angry woman by the name of Shannon! She straightens us all out with the truth about "fake news" and "illegal aliens". :-)

Guest: Election integrity advocate Lulu Friesdat; Also: One deadly disaster after another, the 'Corker Kickback', calls for Franken to un-resign...

On today's BradCast: Yet another mind-blowing adventure in attempted election oversight. This time regarding the complete destruction of all paper ballots in the middle of a Florida lawsuit, following an election between two Democrats, one of them a powerful member of Congress. [Audio link to show follows below.]

But first: Deadly and costly disasters, natural and otherwise, top the news headlines on today's program. Among them: the catastrophic Amtrak train derailment on a brand-new line near Seattle, the second straight week for still-raging apocalyptic wildfires in Southern California, and the continuing disaster in Puerto Rico where, three months after Hurricane Maria came ashore, one-third of the island is still without power and the Governor has finally conceded that the official death toll of 64 may be off...by as much as 1,000!

All tolled, hundreds of billions will be needed to rebuild from those deadly disasters, and yet Republicans in Congress are still hoping to pass a $1.5 trillion tax cut, largely for wealthy Americans, before Christmas. Their scheme took a troubling turn over the weekend, as a new provision was added to the legislation during reconciliation of the House- and Senate-passed versions late last week. The new provision, it was revealed by David Sirota at International Business Times, would give special tax breaks to owners of large real estate holding LLC's like President Donald Trump, House Speaker Paul Ryan and, most curiously, Sen. Bob Corker who, on Friday, mysteriously reversed his previous opposition to the bill after the new provision was tacked on, in what many are now calling the #CorkerKickBack.

Then, we're joined by journalist, documentarian and election integrity advocate LULU FRIESDAT to discuss the remarkable turn of events recently revealed in response to multiple public records requests she has made over the past year in hopes of reviewing hand-marked paper ballots from the Democratic primary election last year between Rep. Debbie Wasserman-Schultz and her Bernie Sanders-endorsed challenger Tim Canova.

Just weeks after being forced to step down as chair of the DNC amidst the release of stolen emails from party officials, Wasserman-Schultz soundly defeated Canova in the first primary she'd faced in her six terms as a member of Congress. But, unexplained vote count numbers --- such as hundreds of more voted ballots than voters signed in to the poll books in the 23rd Congressional District race in Broward County, FL --- led to Friesdat's attempt to examine the paper ballots by hand, in hopes of determining if they were tallied correctly by the county's computer tabulators during the August 2016 Democratic primary. Eventually Canova himself filed a lawsuit against the county's Supervisor of Elections Brenda Snipes, after Friesdat says she was continually denied access to the materials.

In November of this year, well over a year after Snipes certified the contest, both were finally invited to inspect the Broward County ballots only to learn upon arrival that all of them had actually been destroyed by the county in the middle of the lawsuit. Only digital images of what were purportedly the original ballots were available for examination, according to Snipes, in what appears to be, according to Politico's survey of election experts, a clear and stunning violation of federal election law requiring all such materials be retained for 22 months after an election.

Friesdat tells me that neither her nor Canova had any idea the ballots were destroyed before showing up to review them. "If you're looking at digital scans, and you don't have the original ballots to turn to, at that point you have no way of verifying that ballots haven't been switched out, that ballots haven't been added, that ballots haven't been taken away --- you don't have any verification that those are the original ballots."

Oddly enough, she explains, "in the very first public records request in November [of 2016], I requested all of the digital ballot scans for the election, and I was told that they didn't have them, that they didn't exist. And then it turned out that they did exist. So the county was duplicitous in regard to that information."

As to what's really going on here, Friesdat demures from speculation, but says, based only on what is already known on the public record, that "according to Politico, seven legal experts that they consulted all agreed that the ballots being destroyed was illegal."

It is of a piece, she observes, with the recent revelations in Racine County, WI, in November of this year, when multi-partisan election transparency advocates were finally allowed to review some of the computer-scanned paper ballots from the 2016 Presidential election. After months of similar public records request, they were allowed to view original paper ballots, only to find that, in the precincts they examined, anywhere from 2 to 6% of perfectly valid Presidential votes had been ignored by the computer tabulators entirely. That, in an election where Trump is said to have pulled off his shocking statewide victory by less than 1%.

"What's going on here is actually just a representative sample of the problems that we have with our elections, and which you have been reporting on for over a decade," Friesdat says. "We're heading into the 2018 primaries. We at least now have a growing understanding and awareness that, in many cases, our election results may or may not be accurate, and that the protocols we are using in order to get those results are not secure." She offers many other troubling observations on all of this during our conversation today.

Finally, four U.S. Senators --- two of whom had previously called for Sen. Al Franken to resign amidst allegations of inappropriate conduct --- are now, according to a new report today, said to be hoping that he might reconsider his previously-announced plans to resign "in the coming weeks", before the Senate Ethics Committee has even investigated the charges against him...

On today's BradCast, there are two major stories to cover. Both huge. But the one that is receiving less coverage than it needs, is the one likely to upset American life as we know it for decades.

First today, Donald Trump's former National Security Adviser, Gen. Michael Flynn, pleaded guilty to one count of lying to F.B.I investigators about conversations he had with Russia's U.S. Ambassador concerning sanctions against Russia and a U.N. vote regarding Israel during Trump's transition to office, among other things.

He is being offered leniency by Special Counsel Robert Mueller in exchange for his cooperation in the on-going Trump/Russia probe. The White House spent the day downplaying the charges, though reports and court documents filed on Friday indicate the President's Son-in-Law and senior adviser Jared Kushner could be among those now in the sites of federal investigators. Flynn is the fourth member of Team Trump to be charged by the Special Counsel and the first to have served during the Administration itself.

As that played out on Friday, Senate Republicans continued to push their massive $1.5 trillion tax scam through Congress, which, as we discuss today, is much more than just a massive tax cut for corporations, donors and the wealthiest U.S. citizens. The bill has also become a catch-all for long-sought, far right-wing causes, such as establishing rights for fetuses and repealing a 60-year old ban on partisan political activity by tax-exempt religious organizations.

In addition to offering windfalls for the rich, while increasing taxes on most of the middle-class, the far-reaching legislation will also curb the ability for states and cities to provide basic needs to residents, while otherwise undermining the economic system on a generational scale by removing deductions for state and local taxes, higher education and much more.

Perhaps most disturbingly, as experts and lawmakers admit, the scheme will blow such an enormous hole in the long-term national debt that, as Republicans have made clear, additional massive cuts to social safety-net programs such as Medicare, Medicaid and Social Security will be next on their agenda. In all, the massive redistribution of wealth from low- and middle-income Americans to the richest elite in the country will serve to cripple generations of younger Americans.

But, yes, Michael Flynn was charged with a crime on Friday and may now sing on the President and his team. The White House is likely unhappy about that, even if Republicans in Congress are unlikely to mind the distraction at all, as they push their generational tax scam over the finish line.
