On today's BradCast, we try and figure out WTF Republicans in the U.S. Senate are doing, and why, since even they don't seem to have a clue --- and many of them don't seem to care. [Audio link to show follows below.]

Without even knowing what bill they were actually voting on, fifty Republican Senators on Tuesday voted to proceed to debate some scheme or another to repeal and replace the Affordable Care Act (ObamaCare), or just repeal it, or even just kick the can down the road to worry about it later in conference with the U.S. House.

They had help from Sen. John McCain, who flew back from Arizona after surgery and a diagnosis of brain cancer, and a tie-breaking vote from Vice President Mike Pence. Just two GOP Senators (Collins of Maine and Murkowski of Alaska) had the courage to join all of the Democrats and vote 'no', though McCain, just after his 'yes' vote, offered remarks excoriating Republican Senate leadership for their secretive process in creating unworkable legislation without committee processes or input from Democrats.

We're joined by journalist and health care reformer JACKI SCHECHNER to help us try and make sense of what is being characterized as one of "the most chaotic, rudderless, un-Senate-like" moments in modern American history. She explains how today's process differs from the one that resulted in ObamaCare in 2009 and 2010, when she served as Communications Director for one of the nation's largest health care reform organizations.

"There is this myth that things happened behind closed doors [in 2009], but that's not in fact the case. There was plenty of public disclosure when it came to what was up for consideration, and it took a long time," Schechner tells me. "We worked from the outside pushing the President to do what he campaigned on. The myth that Republicans were excluded is just that --- a myth."

She charges that the various GOP plans, if adopted, will result not only in tens of millions of Americans losing health care coverage, but that, in many cases, "people will die" in the bargain. She explains why that is, and how it'ss going to "throw our system into a spiral that's going to jack up premiums for the people who are still paying private health insurance costs."

"It's really dangerous when partisanship overtakes policy, and that's what happening here. This is about Trump getting a win. He has no idea what health care is, how the health care system works. Twice now he's confused it with life insurance. He has no clue," she tells me before declaring she's "over mincing words" and really unloads on the President. (You'll have to tune in for that part.)

"People who worked on health care reform [during Obama's Presidency] actually care if people live or die," Schechner continues. "I don't understand how you stand up and vote for a bill that's going to strip millions and millions of Americans of their access to quality, affordable health care."

She also explains how related moves from both Congress and the White House suggest the U.S. is rapidly devolving into an authoritarian nation, before offering a number of critical words for Democratic Party leadership in the bargain.

Also today, speaking of authoritarianism, Trump continues his extraordinary attacks on his own Attorney General (we discuss why), and the President's new Communications Director moves to purge White House staffers who leak to the media and aren't sufficiently loyal to the President...according to a number of leaking White House staffers...

On today's BradCast, the turmoil continues in the Senate over the GOP undead attempt to repeal health care for millions, and in the White House where Team Trump faces the ongoing investigations of the Dept. of Justice's Special Counsel. [Audio link to complete show follows at end of article.]

A new analysis out late Friday from the U.S. Senate Parliamentarian suggests that a number of provisions in the GOP's scheme to repeal and replace ObamaCare may not pass muster under Senate rules for passage under 'budget reconciliation' with just a 51 vote majority. Instead, 60 votes may be needed, in which case, the scheme may be in even more trouble than it already appears. Or, Senate Republicans could simply try to kill the legislative filibuster instead. Either way, Majority Leader Mitch McConnell is promising a vote to proceed on Tuesday, even though it remains unclear exactly what Senators will be voting on.

At the same time, Democrats are unveiling their own scheme ("A Better Deal") to try and win back voters in 2018. Comments over the weekend from Democratic Senate Minority Leader Chuck Schumer suggest that the passionate advocacy from progressives for a "Medicare-for-all" style system (single payer) or, at least a public option for health care insurance, may finally be moving the party establishment.

Meanwhile, Donald Trump continues publicly attacking his own Attorney General Jeff Sessions and talking about Presidential pardon powers for some reason. But some of those powers, contrary to conventional wisdom, may not be as absolute as he and others have argued, including the power to pardon himself. We're joined by author and Constitutional law expert IAN MILLHISER, Senior Editor of ThinkProgress Justice, to discuss legal assessments from the Nixon era though the Clinton era through now, in regards the power of the Presidential pardon, and the dangers that power could present for Donald Trump himself if he chooses to exercise it for some of his close aides and family members.

Among the man related questions and "myths" discussed: What dangers lurk for the President from those he may pardon? Can the President really pardon himself? Can a sitting President be criminally indicted?

But, of course, much remains unknown when it comes to the various extraordinary ways we are discussing the power of the Presidential pardon, of late, because the U.S. Supreme Court has not rung in on most of it. That's because, as Millhiser notes, "most Presidents don't commit federal offenses when they're in office."

"Here's what this really comes down to: Everyone has assumed that the President would be capable of shame. I'm dead serious about that. Why did Nixon resign? He resigned because he was capable of shame," Millhiser argues. "Everyone assumes that if the President somehow was not capable of shame, then the Congress would be capable of shaming him. When you go back and you read James Madison or Alexander Hamilton, they did not understand the inevitability of political parties," Millhiser argues. "So the Constitution was written on this assumption that you've got all these ambitious people in Congress...and so if you've got a rogue President, they'll all band together to throw that President out because it's good for their careers. They did not understand that, in 2017, we would have the kind of extraordinary partisanship we have right now, where you have a President who is incapable of shame, and you have Congress controlled by the President's party, which is unwilling to do anything to undermine its party's President. Our Constitution is not fit for this set of circumstances."

Finally today, in related matters, the public is much more in favor of impeachment now than they were at the start of the Watergate scandal, four years and six months into Richard Nixon's term as President. And, speaking of public interests, it appears the GOP attempt to undermine ObamaCare has resulted in many more Americans believing the federal government has a responsibility to ensure health care coverage for all...

On today's BradCast: Another roller-coaster as Trump's war on his own nation and its people takes several dark and/or ominous turns. [Audio link to show follows below.]

We continue to move closer to the coming Constitutional and political crisis we discussed yesterday, as shakeups in the Trump Administration and in his legal team rocked D.C. and the nation. Embattled Press Secretary Sean Spicer resigned on Friday in protest of the hiring of Fox 'News' contributor, Wall Street financier and former Goldman-Sachs executive (yes, yet another one) Anthony Scaramucci as new White House Communications Director.

Late on Thursday, Marc Corallo, the spokesman for Trump's legal team, also quit in protest of infighting among attorneys and White House officials and, specifically, due to the Administration's plan to go to war against Special Counsel Robert Mueller who is leading the Justice Department's investigation of Team Trump. At the same time, Trump appears to be going to war with the rule of law itself as the likelihood of firing Mueller and others at the Justice Department seems to be increasing each day (hour?) while the probe focuses in on Trump family finances. That has reportedly led the President to inquire about his own power to pardon staffers, family members and even himself.

Meanwhile, amidst all the noise, Senate Republicans press ahead toward votes on repealing and replacing ObamaCare (or just repealing it) in the coming days, despite questions about whether they have enough support for passage. But while Trump has, at times, called for letting the Affordable Care Act "fail" if it can't be replaced by Republicans in Congress, more and more evidence is piling up to reveal that his Administration is not just letting it fail, but actively trying to make it fail.

ELIZABETH HAGAN, Associate Director of Coverage Initiatives at Families USA, a non-partisan health care advocacy group, joins us to detail the number of ways the Administration is now, aggressively and affirmatively (and possibly unlawfully) attempting to sabotage the ACA itself, and putting at risk millions of Americans who have gained access to health care coverage, thanks to the landmark law.

"Without repealing and replacing the Affordable Care Act, there are a lot of things that the Trump Administration can do to undermine the law," Hagan says, detailing the effect of the Administration's cancellation of contracts this week, for in-person sign-up assistance in 18 major cities. "Consumers that have in-person assistance are twice as likely to successfully enroll as those who didn't. And I would argue that that's probably even more likely now, given all the rhetoric and attempts to undermine the law going on."

"I think it is clear that this is part of a larger effort to sabotage and undermine the Affordable Care Act, absolutely," she tells me, as we detail a number of those efforts recently reported, including changes to the Health & Human Services (HHS) and HealthCare.gov exchange websites to make sign-ups more difficult, cutting days for the open enrollment period in half for 2018, cancelling advertisements for the enrollment period, and even spending tax-payer money on propaganda videos meant to convince Americans that the law is failing, when it isn't.

"The ACA is doing well," Hagan argues, citing a great deal of evidence to support the case. "A lot of the insurance companies are finally seeing a more stable market, and the only instability that they're seeing is due to the Trump Administration."

Finally, Desi Doyen joins us for the latest Green News Report amidst the newly record-breaking heat of 2017, California's ambitious if controversial extension to its landmark cap-and-trade emissions law, and the President announces 45,000 new mining jobs in just his first six months of office! (In fact, there are only 800, which is 500 fewer new coal jobs than in the final six months of Obama's Administration.)

On today's BradCast: We may be quickly heading towards a very troubling Constitutional crisis and what will it take for voters (and corporate media!) to appreciate the dangers posed by our absurd voting systems in the U.S.? [Audio link to full show is posted below.]

President Donald Trump offers some astounding revelations regarding his thoughts about firing the nation's top law enforcement officials (the Attorney General, Deputy Attorney General, the Acting FBI Director and the Special Counsel investigating Team Trump) during a rare interview with the New York Times. He also suggests he believes he can restructure the Dept. of Justice so that the FBI Director reports directly to the President, rather than the Dept. of Justice. The breathtaking admissions in the interview leads at least one former top Justice Department official under Obama to predict that "we are headed for a massive clash....I don't see how we get past this without him firing either [Special Counsel Robert] Mueller or other people at the Justice Department and a massive, massive crisis."

As disturbing and important as Trump's revelations are, the Times' reporters, Peter Baker, Michael Schmidt and Maggie Haberman, utterly failed to ask any substantive questions about the President's positions on and understanding of the various ongoing Republican schemes to repeal ObamaCare. That, despite each of the GOP's proposed plans for doing so predicted by the non-partisan Congressional Budget Office to result in anywhere from 22 million to 32 million Americans losing access to health care coverage.

Instead, the reporters focused only on process questions surrounding the political difficulty of enacting health care repeal, rather than the untold suffering and damage it will cause and Trump's own wildly conflicting advocacy for such proposals. They even ignored the fact that the transcript of the interview appears to suggest he does not even know the difference between health insurance and life insurance!

All of that, as former Presidential candidate and Vietnam War torture victim, Sen. John McCain (R-AZ) is diagnosed with an aggressive form of brain cancer and Senate GOP leadership is reported to be desperately promising to spend some $200 billion in hopes of buying votes for their health care repeal schemes from so-called moderate Republicans in the U.S. Senate.

Then, we're joined by BRAD BLOG legal analyst ERNIE CANNING, to discuss his analysis of the multi-partisan lawsuit recently filed in Georgia contesting the surprising and 100% unverifiable results of the June 20 U.S. House Special Election in the 6th Congressional District and his rather gob-smacking article on the massive security breaches before the election and the more-than-a-decade of disturbing revelations from computer scientists and whistleblowers alike about the Diebold touch-screen voting systems still forced on voters in the Peach State.

Moreover, he tells me about an Atlanta Journal-Constitution reporter who recently dismissed his concerns about her reporting on GA Sec. of State Brian Kemp's comments that there was no evidence to suggest any election results in the state, including the recent GA-06 race, were inaccurate, or that any manipulation, hacking or programming error occurred. "Well, that's true," says Canning, "but you can't prove that the actual count is valid, either. There's no scientific way to do it. The only one that would really know if it was rigged would be somebody who actually took part in the rigging of the vote."

"You have all this coverage everyday with MSNBC about potential Russian hacks," he continues, "and yet nobody there bothers to talk about the fact that these systems are vulnerable to anybody, whether it be Russia or anybody else, and that there's no way to know whether the votes have been altered."

On today's BradCast: U.S. war atrocities and California's fight against global warming. [Audio link to show follows below.]

The State Department is reportedly planning to close their office that investigates war crimes. That may come in handy for Donald Trump, as his campaign promise to "bomb the shit out of 'em", appears to be working. A startling new report from international analysts finds the U.S. has killed twice as many civilians in Iraq and Syria during Trump's first six months in office, compared to the previous three years of war against ISIS under Barack Obama. The U.S. air war is now killing, on average, 12 or more civilians per day in those two countries alone --- with 2,200 said to have been killed since Trump took office --- and neither Republicans nor Democrats are willing to even debate the issue in Congress.

At the same time, House Republicans have stripped Rep. Barbara Lee (D-CA)'s amendment repealing the 2001 Authorization for Use of Military Force (AUMF) from the Defense Authorization bill, despite the amendment's bi-partisan adoption in a House Committee late last month.

Meanwhile, on the heels of Trump vowing to pull the U.S. from the landmark Paris Climate Agreement, California and its Democratic Gov. Jerry Brown have stepped up to fill the leadership vacuum Trump has left behind in the battle against global warming. Two counties in the San Francisco Bay area and a city in Southern California have filed what are being regarded as landmark lawsuits against 37 of the world's largest oil and coal companies. The plaintiffs charge the companies --- including Chevron, ExxonMobil, BP, Shell and others --- have known about the climate change dangers of their products for some 50 years, but have covered it up. They are filing similar claims as those brought successfully against the tobacco industry in the 90's.

Moreover, after a bruising battle, this week the CA state assembly adopted a bipartisan package of climate bills that would, among other things, extend California's cap-and-trade legislation to curb the emission of carbon dioxide and other greenhouse gasses through 2030. While some are describing the legislation, which passed both houses with two-thirds majorities, as a "stunning" bipartisan victory, many environmentalists are unhappy with the bills they fought bitterly against.

R.L. MILLER, the elected chair of the CA Democratic Party's Environmental Caucus and founder of Climate Hawks Vote, is one of those who opposed the bills. She joins us to explain why. As she describes, even though the state has radically reduced emissions levels in recent years and has enacted one of the toughest targets to curb greenhouse gases, the newly adopted extension of the state's Cap-and-Trade program through 2030 was drafted to disproportionately meet the concerns of oil companies, and will result in restrictions on local regulations.

"The problem with it is that the people who live next to the refineries in California have correctly pointed out that this is not doing a darn thing to make their lives any better. And they live in California. And they vote. And they're mad," she tells me, going on to argue that the new measures "will not enable us to meet our 2030 goals."

Also today: The non-partisan Congressional Budget Office finds the ObamaCare repeal bill Senate Republicans are now promising a vote on next week, despite opposition from their own caucus, would result in 32 million Americans losing health care, including 17 million losing coverage next year alone...

On today's BradCast: Donald Trump and Congressional Republicans' attempt to govern continue to fall apart. Also, the assault on our nation's elections continue as well, both from without and within. [Audio link to full show is posted below.]

After new defections by two more GOP Senators late Monday night led to the stunning collapse of Majority Leader Mitch McConnell's latest attempt to repeal and replace the Affordable Care Act ("ObamaCare"), his subsequent plan, to repeal ObamaCare now and replace it later, also collapsed within hours, after the number of Republican Senators needed to kill the measure almost immediately vowed to vote against it. Cue Donald Trump's blame game, avoidance of responsibility and lies about the entire matter.

So what's next on the Republican agenda? A budget resolution must be passed to avoid a Government shutdown by the end of September and a major tax cut effort has long been promised. Evidence suggests both items may run into a similar inability of Congressional Republicans to even agree amongst themselves. Such is the danger of radicalized, illegitimate political enterprises. They may work for winning elections, but not so much when it comes to actually governing.

Also today: New and startling revelations (even to me) of hundreds of thousands of attempts to hack South Carolina's general election system last November offer a dark omen and yet another much-needed reminder regarding election systems in the rest of the country, as well as the need for the public to be able to oversee results; Thousands of legitimate Colorado voters un-register in response to the massive data request for private information by Trump's "Election Integrity" Commission headed up by "voter fraud" fraudster Kris Kobach; and new details about the hack last year of the U.S. Election Assistance Commission --- the federal agency tasked with overseeing electronic voting and tabulation systems in the U.S. --- highlight, yet again, why it's so disturbing that the GOP is attempting to shut down the agency entirely. (No matter how many times over the past decade The BRAD BLOG has found the EAC to be both corrupt and a failure.)

Finally: Desi Doyen joins us for the latest Green News Report, with huge wildfires in Canada, Trump giving away more tax-payer dollars to fossil fuel companies and much more...including, yes, some heroic nuns and a small, disorganized Tropical Storm named Don...

On today's BradCast: There was a time when we used to debate the pros and cons of various public policy in this country, rather than whether one side was simply lying about the policy. This is not that time. The brazen and utter lies from this Administration and the GOP leadership in the Senate about their health care legislation is becoming more desperate (and obvious) by the day. They've also received the notice of Republican Governors, Senators and, yes, Trump voters. [Audio link to show follows below.]

There is no small amount of irony in the fact that Sen. Majority Leader Mitch McConnell has been forced to delay a vote on the Senate's Republican health care bill to repeal and replace ObamaCare, due to a health incident for Sen. John McCain (R-AZ), who is said to be recuperating in good condition after surgery on Friday. Doctors have ordered him, however, to sit out the week in Arizona, so he is unable to make it back to D.C. for McConnell's previously planned vote this week.

As of now, the bill can not possibly survive without every Senate Republican on hand. Even then, it may not pass the upper chamber. Over the weekend, the Trump Administration unleashed Vice President Mike Pence and the two top health care officials --- Health and Human Services Sec. Tom Price and the and Centers for Medicare and Medicaid Services Administrator Seema Verma --- to convince members of the National Governor's Association that up was down, black was white, and some $800 billion in cuts to Medicaid in the GOP health care scheme were not cuts at all, and wouldn't result in the loss of coverage to millions of Americans.

The governors, including many Republicans, weren't buying it. And some (like Ohio's Republican Governor John Kasich) even called out the Administration on their lies, some of which were also repeated on the Sunday shows over the weekend. As noted on today's program, there are several reasons why the Admin has been left with virtually no choice but to lie about the legislation, because even their own voters have begun to take notice.

We discuss today some of the concerns about the bill from Senate GOP moderates like Susan Collins of Maine, who worries (correctly) about the cuts to Medicaid and subsequent harm to rural hospitals in her state. She also pointed out over the weekend that, despite the huge cuts to Medicaid (and the 1/5th of the American economy that will be affected by this legislation), there has not been even one single Senate hearing to discuss its consequences for Americans. Not one.

Then, NED RESNIKOFF, Senior Editor at Think Progress, joins us to discuss concerns from the other end of the GOP caucus --- namely, from Senators like Ted Cruz (R-TX) and Rand Paul (R-KY) --- about why health care is different than regular commercial commodities like breakfast cereal, no matter how much Senators Cruz and Paul attempt to argue otherwise.

Cruz' amendment to allow insurers to include skimpy, cheap plans that don't meet minimum Affordable Care Act (ObamaCare) requirements was allowed into McConnell's latest version of the bill (and has subsequently been blasted by health insurers themselves), and Paul has said he's a "no" on the bill, because it still allows too much of ObamaCare to stand. He would prefer to let the "free market" sort it all out --- ya know, the way the "free market" sorted it all out before ObamaCare, leaving more than 40 million Americans with no health care at all.

"The analogy I used to explain what's wrong with Rand Paul's line of thinking here was selecting between different boxes of cereal at the supermarket. Because the place where Paul is coming from is assuming that markets always work in the same way and play by the same rules. But the truth is that healthcare is a very different kind of commodity, if we choose to treat it as a commodity, than a box of cereal," says Resnikoff, as he explains how the "life and death" nature of health care tends to "skew the way that a market would [normally] set prices."

And, while it's unclear whether Paul actually believes his own rhetoric or not, what's clear is that Republicans in general do not believe their own arguments against the ACA over the past 10 years, which is just one of the reasons they are now forced to lie about it. "This really has taken on this sort of internal logic of its own," Resnikoff argues. "Where if you actually take a step back, and think about it outside the inverted logic that this debate has taken on, it's hard to figure out why they're doing any of this. This most recent version of the bill is designed to solve a problem that doesn't exist. If you go and ask these Senators, which Vox did a few weeks ago, what is this bill trying to do? What is this bill for? No one has an answer. No one can really explain it. It's just: 'This is the Obamacare repeal bill'."

Finally, a new study looks at the fall-out after the state of Texas slashed family planning funding to health care providers like Planned Parenthood in 2011. You'll be "shocked" to learn that the GOP initiative, just like their lies about ObamaCare, didn't exactly accomplish what they had pretended it would. In fact, quite the opposite happened. And, of course, tax-payers are left once again to pay the price for those lies...

On today's BradCast, take your pick. Either the Trump Administration (and its cronies in Congress) are liars or completely incompetent. There is plenty of evidence for both. [Audio link for show follows below.]

For a start today, the number of people now reported to have been at that June 2016 Trump Tower meeting with a Russian attorney said to have dirt on Hillary Clinton has now risen to eight. And, not single day has gone by since the revelation of that meeting one week ago, without the Team Trump explanations for it --- including from the President himself --- changing. Why?

But those aren't the stories today to suggest they are either liars or buffoons (and can't do math either.). Among the many additional stories placed into appropriate context today:

  • Trump's own Sec. of State takes a withering shot at Trump's government;
  • A congressional GOPer laments Republicans "simply don't know how to govern";
  • The non-partisan CBO finds Trump's budget doesn't actually balance (it's only off by $3.4 trillion);
  • Senate Republicans newest health care repeal plan doesn't either;
  • Some GOPers are willing to shut down the government if Trump's wall isn't funded (by tax-payers, not by Mexico, as promised);
  • Trump's border "wall" is beginning to sound exactly like Dubya and Obama's border fence (And his plans for immigration reform are beginning to sound a lot like Obama's as well.)

Given a new Pew survey finding a huge majority of Republican voters now believe higher education at universities and colleges has a "negative effect" on the country, perhaps none of today's stories should come as much of a surprise.

Finally, on the 100th Anniversary of the Espionage Act, the Committee to Protect Journalists offers a report on how, since Nixon first did so in the 70's, the Act has been misused to prosecute whistleblowers rather than spies, particularly under Obama, and how Trump may well begin using it against journalists in the bargain...

"I worry that what we have here in Georgia is the Titanic Effect," Georgia Tech Computer Scientist Richard DeMillo observed, regarding the myriad security issues revealed during the course of last month's U.S. House Special Election in Georgia's 6th Congressional District.

"Georgia officials are convinced the state's election system cannot be breached. Shades of the 'unsinkable ship'. They have neglected to give us life boats...a fail-safe system designed so that in case of a catastrophe Georgia voters can easily verify that reported vote totals match voter intent. It is the sort of common-sense approach that first-year engineering students learn. Other states have that capability. Inexplicably, Georgia does not," DeMillo said in a statement quoted in support of a legal challenge filed contesting the 100% unverifiable results of the June 20 contest.

The computer scientist's concerns are hardly the first expressed about Georgia's absurd voting system. In fact, they cap well over a decade of chilling revelations, shocking vulnerabilities and dire warnings issued from the community of experts who have examined the Peach State's voting system, including a number of those who installed it in the first place back in 2002.

For election integrity advocates, the allegations set forth in the July 3 complaint (Curling II) --- filed by the Coalition for Good Governance and a multi-partisan (Republican, Democratic and Constitution Parties) group of electors --- should be enough to make their hair stand on end. That's especially true as it relates to official intransigence and even outright hostility towards computer scientists and researchers who revealed critical vulnerabilities within the state's 100% unverifiable and Orwellian-named Diebold "AccuVote" TS touch-screen voting and tabulation system.

Curling I involved an earlier unsuccessful effort, filed just prior to the election, to secure a temporary restraining order that would have compelled Georgia to use paper ballots during what had become the most expensive U.S. House race in American history.

With the exception of a relatively small number of verifiable paper absentee ballots, Georgia 6th Congressional District electors were forced to cast their votes into electronic black holes. The result: an "election" in which Republican Karen Handel reportedly defeated Democrat Jon Ossoff 51.9% to 48.1%, despite almost all pre-election polls predicting an Ossof win, with some surveys finding the Democrat with a 7 point lead over his Republican opponent. The touch-screen "victory" for Handel, the state's former Secretary of State, is now being contested in Curling II precisely because the reported results were produced by a wildly vulnerable and 100% unverifiable e-vote tabulation system.

As Brad Friedman accurately reported in his first BradCast following Election Day, the results "may be absolutely right or completely wrong...Nobody knows for certain either way...[What we] do know, according to the state's reported results, [is] that Democrat Jon Ossoff defeated Republican Karen Handel in GA-06 by a nearly 2 to 1 margin on the only verifiable ballots used in the race, the paper absentee mail-in ballots"...
