We're up before the West Coast dawn this morning to monitor the hearings in the U.S. House Judiciary's Subcommittee on the Constitution, Civil Rights, and Civil Liberties featuring John "Minorities Die First" Tanner. His recent objectionable comments were originally video-taped and reported by The BRAD BLOG several weeks ago.

The most objectionable of those comments including his contention that it was a "shame" that elderly voters might be disenfranchised by a 2005 Georgia Photo ID poll restriction that he approved on behalf of DoJ and against the advice of four out of five of his career staffers, minorities would somehow benefit from it. His twisted reasoning was that "because our society is such that minorities don't become elderly. The way white people do. They die first."

Tanner, incredibly, is still the Chief of the Voting Section in the DoJ's Civil Rights Division.

It's being carried live and webcast on C-Span 3, as well as via the Judiciary Committee's own webcast.

Wire Service Reports on Obama Letter, Fails to Cite BRAD BLOG for Breaking Story, Misses Much of the Point in General...

AP is notorious for refusing to give appropriate credit to blogs that break stories. They've done so again in their coverage today of Barack Obama's letter calling for the firing of DoJ Voting Rights section chief John Tanner in the wake of our video coverage of his recent objectionable comments [emphasis ours]:

"That's a shame, you know, creating problems for elderly persons just is not good under any circumstance," Tanner said, according to video posted on YouTube. "Of course, that also ties into the racial aspect because our society is such that minorities don't become elderly the way white people do. They die first."

Setting aside the de rigueur BRAD BLOG slight, AP received a response to Obama's call for Tanner's head from DoJ spokesman Erik Ablin:

"Mr. Tanner is an attorney who works to protect civil rights on a daily basis," Ablin said, adding that the official had won numerous awards from African-American groups. "Nothing in his comments deviated from his firm commitment to enforce the law, and it is unfortunate that they have been so grossly misconstrued."

"Grossly misconstrued"? AP does not detail in what way Ablin believes the comments to have been "grossly misconstrued," but quotes him as saying the department "continues to have full confidence" in Tanner.

Former colleagues of Tanner's, however, don't seem to agree that the comments were misconstrued...

Letter to Acting Attorney General Says John Tanner's Recent Remarks Are 'Patently Erroneous, Offensive, and Dangerous'

After recently stepping up, along with Sen. Russ Feingold (D-WI), to block the nomination to the FEC of insidious GOP "voter fraud" zealot Hans Von Spakovsky, Illinois' Democratic Senator and Presidential Candidate Barack Obama is calling for the head of the Voting Rights Section chief of the DoJ's Civil Rights Division.

In a letter sent today (posted in full at end of this article) to Acting Attorney General, Peter D. Keisler, Obama has requested that John Tanner be sent packing following objectionable comments he made two weeks ago in Los Angeles at the National Latino Congresso.

The remarks by Tanner, video-taped and first reported by The BRAD BLOG, were meant in support of his decision to allow a Photo ID restriction at polling places in Georgia, over the recommendation of four out of five of the career attorneys in the Civil Rights unit. The law would later be found unconstitutional by two federal judges, one of whom declared the practice to be a "Jim Crow-era poll tax".

Tanner told audience members during the panel on October 5th, that while it was a "shame" that the elderly would, in fact, be disenfranchised by the law he approved on behalf of the DoJ, minorities would have less to worry about because, as he told the stunned room, "Our society is such that minorities don't become elderly the way white people do. They die first."

Former colleagues of Tanner went on to characterize his comments as "false", "ludicrous" and "cherry-picked" from existing data.

In his letter today, Obama said, "Such comments are patently erroneous, offensive, and dangerous, and they are especially troubling coming from the federal official charged with protecting voting rights in this country."

As we reported several days ago, Tanner is scheduled to testify on this and related matters to a sub-commitee of the House Judiciary Committee on October 30th. The committee has asked The BRAD BLOG for a copy of the entire session with Tanner, as video-taped by our own Alan Breslauer. We have complied with their request.

In breaking the news of Obama's letter this morning, TPM Muckraker's Paul Kiel noted the irony that during his appearance before the Judiciary Committee, Tanner will "get to explain personally to its 78 year-old African-American chairman [John Conyers] that minorities don't 'become elderly.'"

"Through his inexcusable comments," Obama writes in today's letter, "Mr. Tanner has clearly demonstrated that he possesses neither the character nor the judgment to be heading the Voting Rights Section. For that reason, I respectfully request that you remove him from his position."

Since the 2004 election, Republican officials and operatives have been attempting to enact such Photo ID laws at polling places across the country, despite some 10 to 30 million, largely Democratic and minority voters, who do not have such ID's and would be disenfranchised by such laws. Millions of dollars have been spent to support the unevidenced idea of Democratic "voter fraud" by phony GOP front groups such as the "non-partisan" ACVR, created by Bush/Cheney '04's national general counsel Mark F. "Thor" Hearne and RNC Communications Director, Jim Dyke. Hearne is now laying low since shutting down the ACVR in the wake of calls for phony "voter fraud" prosecutions being found at the center of the U.S. Attorney Purge scandal. Dyke, who parlayed his "non-partisan" ACVR gig into work for Dick Cheney, is now Communications Director for the Rudy Giuliani campaign.

Continuing the false GOP meme of Democratic "voter fraud", The BRAD BLOG recently noted unsupported claims of undocumented immigrants being "rounded up, herded into the polls [and] voting illegally" in California as charged by Golden State Rep. Duncan Hunter during a recent Republican Presidential Debate. Both Hunter's campaign and Congressional offices subsequently failed to respond to BRAD BLOG requests to back up with the claim with details or evidence.

During it's current session, the Supreme Court of the United States is scheduled to review the constitutionality of a similar Photo ID law enacted in the state of Indiana.

Statement Suggesting Whites More Disenfranchised Than Minorities Because Minorities 'Die First' Before Becoming Elderly, Disputed by John Tanner's Predecessor, Former Colleagues
An 'Imus Moment' Declares a BRAD BLOG DoJ Source...

Paul Kiel at TPM Muckracker has picked up on, and advanced, our Exclusive report yesterday concerning the remarkable comments made last Friday by John Tanner, the Chief of the Civil Rights Division, Voting Unit, at the DoJ, concerning Photo ID restrictions at the polls.

In a follow-up report today, Kiel gets reactions from former DoJ officials, including the man who previously held the same job as Tanner at the DoJ, charging that the remarks and logic behind them were "frankly ludicrous" and "false" and based on "cherry-picking the data that he wants to use."

A DoJ source of our own wrote to us after yesterday's report and characterized the comments as Tanner's "Imus moment."

Tanner had told a group in Los Angeles last Friday --- and our own Alan Breslauer was there to catch it on video tape --- that non-minorities were more likely to be disenfranchised by such restrictive polling laws laws than African-Americans.

"It's probably true that among those who don't [have Photo ID], it's primarily elderly persons. And that's a shame," Tanner told the audience. He then added: "Of course...our society is such that minorities don't become elderly. The way that white people do. They die first." The implication being that, therefore, minorities are somehow less likely to be disenfranchised by draconian Photo ID laws at the polling place.

Tanner had approved a disenfranchising Georgia Photo ID scheme on behalf of the DoJ in 2005, despite the fact that 4 out of the 5 career civil rights unit staffers who had reviewed the law recommended against pre-approval under the Voting Rights Act. The law, once approved by Tanner, was later found unconstitutional by two federal courts, and described by one of the judges to be little more than a "Jim Crow-era poll tax."

ePluribus Media has much more on Tanner's resume and discriminatory reign as voting section chief in the Civil Rights Division.

Restrictive Photo ID laws, being strongly and strategically pushed by elements of the GOP around the nation, are controversial since anywhere from 10 to 30 million Americans, largely Democratic-leaning voters who are elderly, minorities, and/or urban dwellers, are believed to have no driver's licenses. Most states already have requirements for some form of ID when voting, though not necessarily state-issued Photo ID.

Further, the federal Help America Vote of Act of 2002 already requires proof of identity when a voter registers to vote. In the meantime, by even the DoJ's own numbers, voter fraud at the polls is exceedingly rare in America. That, despite GOP kool-aid drinkers like Rep. Duncan Hunter and his recent unfounded claims to the contrary.

According to Kiel at TPM Muck today, both Tanner's predecessor Joe Rich and the man who analyzed the numbers for Tanner at the DoJ in the Georgia case, Toby Moore, strongly dispute Tanner's comments, characterizing them as "not only wrong, but way off, and typical of the type of decision making" in the current DoJ's Voting Rights section...

Police are investigating a possible double murder and suicide in an Orlando, Florida, residence owned by the former Executive Director of the Georgia Republican Party.

The Orange County Sheriff was called to 2420 Hickory Oak Blvd. in Orlando early Thursday. There they found three dead white men and two live dogs. The men may have been dead since Tuesday.

The home where they were found dead was owned by a political consultant/strategist of Rep. Tom Feeney (R-FL), the one who worked on the Congressman's smear campaign against vote-rigging whistleblower Clint Curtis last year. More details on that campaign below.

Feeney describes Gonzalez as "a born political consultant." On commenting on the news, Feeney said of Gonzalez, "He was an adviser and strategist for me and became a very good friend."

You know, because when I got hit, and I hearin' somebody clicking a gun by my head about three, four times, and that gun not going off. You know, for a lot of years I've been hearing that click and I've been hearing that gun going off. Jumping up out of my sleep."
--Larry Young, July 2007, 18 years after he was attacked in the parking lot of a Savannah, Georgia Burger King.

You might think Larry Young would know who hit him, because two weeks ago the man who was convicted in the case came within 24 hours of being executed by the State of Georgia. But Larry Young doesn't know because he, like nearly all the witnesses whose testimony originally convicted Troy Anthony Davis of the assault on Young and the murder of a white police officer that night, doesn't believe Davis is guilty. Next week, the testimony these witnesses want to give, testimony that will show their original "witness statements" were coerced by police, will finally be heard.

On August 19, 1989, Larry Young, an African American man who was then homeless, was assaulted in a Burger King parking lot by two or three men. He was hit in the head by what is believed to be a gun. As Young described to The BRAD BLOG in a phone interview, he fell to the ground, bleeding. Someone held a gun to his head and tried to shoot him, but the gun didn't fire. Young's friend dragged him away from the assailants. Before they got far, they heard two gunshots. Police officer Mark Allen McPhail had been killed.

Young himself was detained that night, he told The BRAD BLOG. "The blood was just steady fallin', sort of fallin' … The police grabbed me, threw me on the car, handcuffed me and threw me in the police car. And I was back there for about a hour and a half, maybe about a hour and a half. And I kept telling 'em, you know, I needed some medical attention."

The police took him in for questioning, refusing him medical care until he signed a statement implicating Troy Davis, a man he says he never saw that night, in his attack and the killing of Officer McPhail.

Young told The BRAD BLOG, "So whatever statements that they made me take, I mean, it was just a lot of statements made like, 'Well, you give me a statement of what you need, what we need, and then you'll go to the hospital.' So therefore whatever the statements were that was given was not accurate statements. ... I'm concerned ... about my health, you know. And I'm hearing these clicks in my head still, you know what I'm saying, sitting up there, I'm pretty much kinda scared. So I just pretty much signed what they wanted me to sign and whatever went on the courtroom, you know, I mean it was all pretty much like coerced."

On evidence like this, the State of Georgia may send Troy Davis to his death?...

State Officials Say Kathy Rogers, Democratic Director of State Elections Division Under Outgoing Democratic Secretary of State, Said to be Going to Work for Un-American Voting Machine Company

The Atlanta Journal-Constitution is reporting that Georgia state officials are claiming that Kathy Rogers, the recently resigned Director of outgoing Secretary of State Cathy Cox's State Elections Division, is going to work for Diebold.

Rogers resigned on November 30th, and rumors have been swirling ever since in the state where Diebold first planted it's dirty claws with paperless touch-screen voting machines in 2002 (along with the state of Maryland). Democrats Cox and Rogers have been apologizing and covering for the deceptive and anti-democratic Voting Machine Company ever since.

Cox even went so far as to appear on a Diebold promotional brochure singing the company's praises.

"Rogers apparently will serve as a liaison between elections officials throughout the United States and Diebold," according to the AJC...

Dear Judges: You may as well make swift and unambiguous decisions that lead to the end of E-voting in America as we know it. For your own sake, and that of the court docket, sooner would be better than later.

Elections Officials can't do it themselves because it would be tantamount to admitting they failed in their only job: to ensure free, fair, and accurate elections. Of course they have failed, but they've already staked their careers on millions in state and local dollars, robbed from unsuspecting taxpayer constituents. Admitting that fact out loud would mean that most of them would (deservedly) be run out their jobs faster than Diebold or ES&S or Sequoia spokesholes can dutifully tell AP: "our voting machines work fine, the problem is human error!"

Until you folks on the bench end this nightmare forever, you will keep finding only more and more such suits like the one mentioned below in Georgia (and dozens, if not hundreds more like it) month and after month, year after year, election after election, hitting your docket until this mess is solved once and for all.

Underscoring what The BRAD BLOG has been saying for years --- that this is not a matter of Left versus Right, but rather a matter of Right versus Wrong --- Democrat, Republican, and Independent candidates have now joined the suit to put an end to Diebold's paperless E-voting in the state of Georgia...

Three losing candidates in this year's elections announced their plans Tuesday to join a lawsuit challenging Georgia's electronic voting system.

A group of activists, led by VoterGa, filed a lawsuit in Fulton County Superior Court in July, alleging that electronic voting machines in Georgia do not accurately record votes.

Mary Wilhite, a Republican candidate for a state House seat in Cherokee County, Woody Holmes, an independent write-in candidate for a seat in south Fulton, and Donzella James, a Democratic candidate for the 13th Congressional District, joined VoterGa representatives at the Capitol to say the results of their elections have caused them to join the lawsuit.

Arizona's Scam Photo ID Laws Meet Similar Fate as Court Imposes Injunction for '06 Election!

Restrictive and disenfranchising laws for Photo ID requirements at the polls are being pushed all over the country as part of a nationally orchestrated GOP scam that's been underway since at least the first few hours after the 2004 Election.

(For more details, see this series of BRAD BLOG articles exposing the phony GOP front group at the epicenter of this national effort. They are the "non-partisan" and ironically-named "American Center for Voting Rights". We discovered their onerous, ongoing scam early in their attempt to pull off this nationwide hoax with the direct aid and comfort of now-disgraced Rep. Bob Ney of Ohio, and others even higher-up in the GOP.)

This week, news on the Photo ID scam front from Georgia, Arizona and Missouri, where the laws have been repeatedly struck down by courts as blatantly unconstitutional. Yet the democracy-haters in favor of these laws continue to leverage big-time GOP resources in their never-ending search for legal forums with friendly judges. If that doesn't work, as in Georgia, they're prepared to use the laws anyway, even if they've already been ordered not to.

The Associated Press is reporting that voters in Georgia have received letters stating they must show a photo ID to cast a ballot on Nov. 7th. In fact, that letter is wrong and the courts found it was wrong before many of the letters went into the mail...

In an Atlanta Progressive News article today, Matthew Cardinale advances the ball forward a few steps concerning Diebold's chicanery and undocumented and/or questionable software patches down in Georgia just prior to the 2002 election.

Georgia, along with Maryland, was one of the original Diebold "showcase" states where paperless touch-screen voting machines were originally, and disastrously installed by the now-outgoing Democratic Secretary of State (and Diebold apologist) Cathy Cox.

Robert F. Kennedy Jr., who filed a landmark article last June in Rolling Stone concerning evidence of a stolen 2004 Presidential Election in Ohio, is set to rock the country again in tomorrow's Rolling Stone, The BRAD BLOG can now report.

The issue is currently on the stands in some sections of LA and NY, and will be available across the nation tomorrow.

Through interviews with a number of BRAD BLOG insider sources over the past several months, Kennedy, along with co-writer Dick Russell, will expose a plethora of new details concerning the scandalous and outrageous overtaking of our public election system by private companies such Diebold, ES&S, Sequoia and others.

The article is titled: "Will The Next Election Be Hacked? - Fresh disasters at the polls --- and new evidence from an industry insider --- prove that electronic voting machines can't be trusted".

Many of the items covered may be familiar to readers here, as a good number of them were originally broken on these very pages over the last year or so. We worked closely with Kennedy and Russell on this story during its development over the past several months.

The article, however, covers several new and sometimes explosive details of Diebold's rollouts in both Georgia and Maryland dating back to 2002, as well as Florida, Ohio and Texas in 2004.

[A]s midterm elections approach this November, electronic voting machines are making things worse instead of better. Studies have demonstrated that hackers can easily rig the technology to fix an election – and across the country this year, faulty equipment and lax security have repeatedly undermined election primaries. In Tarrant County, Texas, electronic machines counted some ballots as many as six times, recording 100,000 more votes than were actually cast. In San Diego, poll workers took machines home for unsupervised “sleepovers” before the vote, leaving the equipment vulnerable to tampering.

“Every board of election has staff members with the technological ability to fix an election,” Ion Sancho, an election supervisor in Leon County, Florida, told me. “Even one corrupt staffer can throw an election. Without paper records, it could happen under my nose and there is no way I’d ever find out about it. With a few key people in the right places, it would be possible to throw a presidential election.”

US Rep. Cynthia McKinney (D-GA) is pursuing numerous legal avenues to challenge the so-called "results" of not only her recent Primary and Runoff Elections, but also the fundamental reality that the current E-voting system in Georgia does not provide us with "results" that are in any way meaningful.

The Congresswoman and her attorneys and campaign are looking at ways in which they can either join or support Donzella James’s legal election contest filed last week, Donzella James, who is working closely with the Congresswoman, told Atlanta Progressive News. The US Department of Justice is already said to be investigating as well.

An early-morning report from the headquarters of Congresswoman Cynthia McKinney's campaign indicates that voting is not going smoothly in Georgia's 4th Congressional District. Congresswoman McKinney is involved in a runoff election against Hank Johnson, after "failing" to gain 50% of the votes in the first round of the primary three weeks ago.

According to the McKinney camp,

Less than one hour into the voting day, multiple problems with the electronic voting machines have arisen. McKinney precinct watchers are reporting machines down already, insecure machines, and at least one 4th Congressional District precinct without McKinney's name on the ballot, but with her opponent's name on it.
...
Another location had to redo the zero report because the machine did not initiate at a zero count. And at yet another location, the voting machine where the voting card is inserted is not secure.

We've reported on McKinney's troubles in the first round of the primary (here and here) and we have also mentioned the smear campaign being waged against her --- and against opponents of electronic voting in general --- by the Atlanta Journal-Constitution, a so-called "newspaper" which is part of the so-called "Cox media empire". Judging from their coverage of the first round of the primary, we should not expect the AJC to pay any attention to the claims of irregularities in this election, regardless of how well documented they might be.

"Good, I’m glad she’s challenging, she should!" Brad Friedman of the noted elections integrity website, BradBlog, said in a phone interview.

The Donzella James Campaign isn’t taking the same approach as say, Kerry/Edwards 2004. They aren’t trying to calculate the known malfunctions to see if they add up to greater than the margin of vote difference between more progressive James and the moderate Scott (35%). The point is, because of the lack of a paper trail, there is no way to determine how many unknown malfunctions there are.

"When you figure out something is wrong with these systems, you can’t get in there to see how much has gone wrong in these systems. It’s in the ether," Friedman said.

And:

Attorney Paul Lehto, who is contesting the Busby/Bilbray race in San Diego where voting machines were taken home with poll workers, has offered to provide informal advice to Donzella James. Expecting voters to trust E-voting as presently done is "like asking everyone to put blindfolds on," Lehto said. "I endorse this. It’s exciting that there’s an elections contest in Georgia."
