Asked 'How Many Dead Americans is Saddam Worth?'

That was then, this is now, we suppose.

Dick Cheney, in 1994 (see short video at right), said "we got it right" by deciding not to invade Iraq after the liberation of Kuwait in '91, since "for the 146 Americans killed in action, and for their families --- it wasn't a cheap war."

"[I]n an effort to get Saddam Hussein, [the question for the President] was how many additional dead Americans is Saddam worth?" Cheney is seen answering the question at the time: "Our judgment was, not very many, and I think we got it right."

Apparently, the worth of Saddam has increased since '94, to at least 4,000 dead Americans and still counting.

But, as we said, that was then, and this is now. So flip-floppery doesn't matter, even though he predicted back then that "if we'd gone to Baghdad we would have been all alone. There wouldn't have been anybody else with us...It's a quagmire if you go that far and try to take over Iraq."

Smart guy. He should have listened to him.

Listening to Sen. Russ Feingold (D-WI) for fifteen minutes is worth a week of the para-discourse from elsewhere on national television. Feingold said on Meet the Press this morning that he will introduce a resolution to censure George W. Bush “in a few days.”

The censure resolutions will focus on two huge issues:

• Bush's process for getting us into the war in Iraq, including misleading statements and misuse of intelligence before the war; and
• “the outrageous attack on the rule of law,” including illicit electronic surveillance and other surveillance, and administration approval of torture. “This administration has assaulted the constitution,” Feingold said briskly.

Feingold said that he has talked with the Democratic leadership about the resolution, adding that it might provide an opportunity as well for Republicans uncomfortable with the administration but unwilling to use impeachment.

Questioned by Tim Russert about whether the resolution would pass, Feingold said basically we’ll see how it goes. He commented, “There’s a lot of support in the country for actually impeaching the president and the vice president.”...

Looking into the combination high-level and shadowy backstory of Marc Rich, pardoned unpardonably by former President Clinton on the latter’s last day of office, will throw further light on the longterm Libby-Cheney relationship.

While this little item below went rapidly down the memory hole, back in early 2001 (very early) the incoming Bush administration made little noise (very little, very quickly ceased) about revoking Rich’s pardon. No public emphasis by the administration that Libby, the new chief of staff for Cheney and Special Assistant to Bush, had recently been Marc Rich's attorney for twelve years.

A new poll conducted by Ameircan Research Group finds that 54% of American adults want the US House of Representatives to begin impeachment proceedings against Vice President Dick Cheney, including 76% of Democrats, 17% of Republicans, and 51% of Independents. The same poll found 46% of voters in favor of the same thing for President George W. Bush, including 69% of Democrats, 13% of Republicans, and 50% of independents.

The poll also asked about Bush's commuting of I Lewis Scooter Libby's sentence, and found that 31% of Americans approve, and 11% would approve of a full pardon.

So what's the hold up? Accountability awaits.

For months, the so-called "DC Madam" --- Deborah Jeane Palfrey --- has been forbidden by a court injunction from discussing or sharing the contents of the meticulous phone records she kept of her Washington D.C. client base.

Before the injunction was handed down, ABC News' Brian Ross had received a partial list. Ross declared, in a broadcast report, that the phone records did not point to any "newsworthy" individuals beyond the three known names of Randall Tobias (former head of the Agency for International Development), Harlan Ullman (developer of the "shock and awe" military doctrine) and former presidential adviser Dick Morris.

ABC dealt only with records going back five years, and did not have access to the earlier records. Long-standing rumors --- as-yet unconfirmed --- have held that Vice President Dick Cheney used Palfrey's escort service, Pamela Martin and Associates, in the 1990s, while he was still the CEO of Haliburton.

Less than two hours ago, Judge Kessler released the injunction. Palfrey is now free to make those phone records available to any journalists or bloggers who ask for them. She has set out certain circumstances for their release; her primary hope is that those looking into the matter will do so thoroughly. Palfrey has expressed disappointment in ABC's treatment of this story.

When contacted by The BRAD BLOG, Palfrey first expressed her thanks to Judge Kessler. "This decision could have gone either way," said Palfrey, "given our current political climate."

In her decision [PDF], as posted by Citizens for Legitimate Government, the Judge wrote:

The List in question is the Defendant's personal property and contains only a log of telephone numbers. It was neither seized by the Government when it searched the Defendant's residence in California, nor listed in the Indictment putting the Defendant on notice as to which items of her property were subject to forfeiture.

The question everyone is asking, and that we asked, of course, is this: Can Ms. Palfrey confirm that Dick Cheney was a client?...

Says 'Both Crossed the Rubicon Last Night', 'Even Nixon Knew When It Was Time to Go'...

In a pretty spectacular peroration tonight, MSNBC’s Keith Olbermann delivered a ten-minute indictment of the president and vice president and asked Bush to perform one last act of patriotism: resign.

Saying “Even Richard Nixon knew it was time to resign” and adding that Nixon’s resignation, belated though it was, ranked as one final action of nonpartisanship, Olbermann urged George W. Bush to emulate Nixon, “not for self, not for party,” but for the country.

Olbermann also prefaced his speech, in one of several promotional moments, with the comment that “No one is holding their breath on this, but frankly, were Mr. Cheney and Mr. Bush true patriots, they would resign.”

The total commutation of Libby’s sentence should put an end to any questions, if any remain, about whether the Bush-Cheney cabal is completely crooked.

Briefly: the published statement for public consumption that the president found Libby’s sentence “excessive” is transparently false. If he had merely found the sentence excessive, he could have commuted it PARTLY. Two and a half years could have been reduced to two, or to one and a half, or to one year. It could have been drastically commuted to six months, or to three months.

That did not happen. Instead, George Walker Bush elevated smarmy propagandists like Byron York over federal judges. He elevated Charles Krauthammer over three U.S. Circuit Court Judges appointed by three former presidents. (Not that Krauthammer’s first reaction after Libby was indicted was to defend Libby. Au contraire: Krauthammer took the line, on ABC’s Inside Washington, that Libby’s actions were the work of one man, namely Libby. Neocon loyalty at work – until the echo chamber pulled Krauthammer back in line.) Bush elevated rightwing talk show hosts, the creepy National Review, Fox television and Rupert Murdoch's media empire and the now-moribund PNAC over the U.S. justice system.

Typical for him, that.

Leahy on Meet the Press today (via TPM, who has more, video available at C&L)...

RUSSERT: Are you prepared to hold the Bush White House, the vice president, the attorney general and his office under contempt of Congress?

LEAHY: That is something that the whole Congress has to vote on. In our case, in the Senate, we'd have to vote on it; in the House, they would have to vote on it. I can't...

RUSSERT: Would you go that far?

LEAHY: If they don't cooperate, yes, I'd go that far. I mean, this is very important to the American people.

Leahy's comments synch up with what Conyer's telegraphed a week during a House Judiciary hearing when he asked outgoing Dep. AG Paul McNulty if the DoJ would work with Congress should the White House ignore their subpoenas and it became necessary to issue criminal contempt charges. (For the record, McNulty punted in response, stating he's recused himself from the issue, will likely be gone by then, since he's already resigned, and otherwise, couldn't speak for the DoJ on the matter.)

Washington Post noticed Leahy's comments as well, and offers this road map to what comes next in their Monday edition...

The next step is for the congressional committee chairman to rule on the validity of the privilege claims. If the claims are deemed invalid, the committee can repeat the directive to comply. If the president continues to refuse, the committee can find the president in criminal contempt, and the issue would go to the full Senate or House. If a majority in either chamber approves the criminal citation, the matter is referred to a U.S. attorney with a recommendation to issue an indictment.

"Referred to a U.S. attorney." See what a frickin' mess we're looking at here? The USA in question would be Jeffrey A. Taylor of the District of Columbia. Unless he gets fired any time soon. Don't know much about Taylor, with no time to dig for now. So feel free to fill us in with any thoughts on him in comments.

Constitutional law professor Jonathon Turley on Olbermann: "For many years, since we first found out about this program, some of us have said that this was a clearly criminal act that the president called for. ... If we're right, not only did he order that crime, but it would be, in fact, an impeachable offense."

"This administration, I have to say, has a certain contempt for the law," added Turley. "They treat it like some of my criminal defendents used to treat it. ... They come up with any argument that might work. ... It's a sort of shocking development. ... But at the end of the day, they will lose, and they're making the situation worse."

Waxman, Conyers, and Clay Issue Statement Calling on Response, Action from DoJ, Gonzales...

Following on subpoenas issued to both Dick Cheney and the White House earlier today on the warrantless wire-tapping issue, the Summer of Accountability continues as the heat grows on both Cheney and Gonzales in the matter of the refusal by Cheney's office to provide reports on the handling of classified information.

A statement just sent to The BRAD BLOG (posted in full at the end of this article) by the offices of Representatives Conyers, Waxman, and Clay calls on Gonzales to explain his position on the National Archives request for Cheney to comply with an Executive Order requiring all Executive Branch offices to detail their handling of classified material and his subsequent refusal.

Cheney has claimed, in his failure to file appropriate reports for the last three years, that he didn't need to because the Office of the Vice President is not a part of the Executive Branch (that, despite their having complied with the order in years prior to 2003, when it seems they leaked the classified identify of covert CIA operative Valerie Plame).

In the statement, Waxman says Cheney's response is "absurd," Conyers calls it "highly dubious," and Clay characterizes the matter as "a breathtaking act of arrogance" in which Cheney is making a mockery of the law and our system of checks and balances."

WASHINGTON - The Senate Judiciary Committee subpoenaed the White House and Vice President Dick Cheney's office Wednesday for documents relating to President Bush's warrant-free eavesdropping program.

Also named in subpoenas signed by committee Chairman Patrick Leahy, D-Vt., were the Justice Department and the National Security Council.

The committee wants documents that might shed light on internal squabbles within the administration over the legality of the program, said a congressional official speaking on condition of anonymity because the subpoenas had not been made public.

As TPM Muckraker notes in their breaking coverage, "The trigger is pulled...Get ready for a huge court fight."

RAW STORY has a statement from Sen. Leahy concerning the subpoenas.

And as Joseph Cannon guest blogged here yesterday, a subpoena was/is needed to begin the impeachment process. Any subpeona issued to Cheney's office and/or the White House. Well, we now have one.

"If Cheney or any of his underlings refuse to comply with a single subpoena --- and that's a very good bet --- he becomes instantly impeachable, on the same grounds that brought down Nixon," wrote Cannon, who knows the topic well.

Stay tuned. It may be a busy summer...

Even the Republicans are sick of this guy

As Des points out below, top Republicans are now plotting ways to remove Dick Cheney from office. The thinking is that a vacancy in the Veep's office could well provide a berth for one of the 2008 Republican contenders --- McCain or Thompson.

The strategy could work two ways, of course. Anyone who replaces Cheney will get Bush administration "cooties." It won't be easy to wash off the smell by November of 2008.

How to bell the cat? After Downing Street has some excellent suggestions. I have one of my own.

Call on your senators and congressional representatives and ask to have documents subpoenaed from Cheney's office. Which documents? It almost doesn't matter. Documents pertinent to the energy task force. Documents pertinent to the use of torture. Documents pertinent to the Niger forgeries. Anything will more or less do.

All of Cheney's staffers can be subpoenaed as well, on any number of issues. A Congressional investigation of Plame-gate. Haliburton contracts. The refusal to comply with the National Archives. Anything. Everything. All at once.

If Cheney or any of his underlings refuse to comply with a single subpoena --- and that's a very good bet --- he becomes instantly impeachable, on the same grounds that brought down Nixon. Cheney no longer has many friends in Congress. Nobody has his back.

If every person reading these words made the call to his or her House and Senate members, Cheney could well be history. First subpoena, then impeach. That's the plan, and it WILL work.

The big question right now among Republicans is how to remove Vice President Cheney from office. Even before this week's blockbuster series in The Post, discontent in Republican ranks was rising.

As the reputed architect of the war in Iraq, Cheney is viewed as toxic, and as the administration's leading proponent of an attack on Iran, he is seen as dangerous. As long as he remains vice president, according to this thinking, he has the potential to drag down every member of the party --- including the presidential nominee --- in next year's elections.
