On today's BradCast, the stolen U.S. Supreme Court begins to pay dividends for Republicans and the GOP's deadly Senate healthcare legislation continues to take much-deserved heat from all sides, including doctors, Nobel laureate economists and now the non-partisan Congressional Budget Office. [Audio link to show is posted below.]

But, first up today, Kansas Sec. of State Kris Kobach, the long-time "voter fraud" fraudster who has been tapped to head up President Trump's so-called "Election Integrity Commission" (actually, a voter suppression commission), has been sanctioned by a federal court for "deceptive conduct" in the ACLU's case against his attempted proof-of-citizenship voter registration restrictions. That's almost the best news we have on tap today, though we do manage to find a few bright spots here and there.

The CBO on Monday came out with its score of the Senate Republicans' legislation to repeal the Affordable Care Act ("ObamaCare") and finds it will result in 22 million fewer Americans having access to health care coverage by 2026, with 15 million losing coverage in 2018 alone! Despite that, and with still more groups (now including both the American Medical Association and a group of Nobel Prize winning economists) excoriating the Republican bill, Senate leadership still vows a vote before the July 4th holiday recess this week.

Meanwhile, the U.S. Supreme Court session came to a close on Monday, with the Court allowing some of Trump's Executive Order "travel ban" to be implemented in advance of a full hearing now scheduled for next October, when the Court's new session begins, in what my guest today describes as a "qualified victory" for the Administration. The Supremes also issued a ruling today requiring state officials to allow same-sex parents to be listed on birth certificates, and scheduled a hearing for next session regarding businesses who choose to discriminate against same-sex couples, in what my guest, legal journalist MARK JOSEPH STERN of Slate.com, describes as a case that could seriously imperil non-discrimination laws for the LGBTQ community and become a full-blown "constitutional catastrophe" in the bargain. Stern argues that the birth certificate opinion reveals the position of Justice Neil Gorsuch ("he of the stolen seat"), to be "a surefire vote against LGBTQ rights" and "just as bad" as the late Antonin Scalia on such matters.

Then, with a new study from AP finding extreme partisan gerrymandering accounted for some 22 Republican U.S. House victories in 2016 and untold number of GOP state legislative victories, we discuss SCOTUS announcements from last week in two free-speech cases and a related Court ruling issued on a rather massive case of unconstitutional partisan gerrymandering in Wisconsin.

That case, as Stern describes, could have an impact on American elections as far reaching as Citizens United but, depending on how the Court rules, in a positive direction for those of us who give a damn about free and fair democratic representation and elections. On the other hand, if the stolen majority on the Court decides the wrong way, it could result in our embarrassing system of "democracy" becoming even more so.

Finally today, we close with a much needed laugh regarding some "100% unverifiable" listener email...

On today's BradCast: Donald Trump repeatedly promised not to cut Medicaid during his Presidential Campaign. During his Inauguration, he vowed to "end the American carnage". Now he's prepared to slash Medicaid under the GOP health care legislation, which is certain to create untold "American carnage" in its wake. [Audio link to full show follows below.]

Hospitals, doctors and other health care providers have been blasting the Senate Republicans' health care bill to replace the Affordable Care Act, or "Obamacare", since the legislation, crafted in secret, was finally unveiled on Thursday. It has not aged well in the past 24 hours. That's for very good reason, as my guest today, IGOR VOLSKY, health care reform advocate, a Vice President at the Center for American Progress, and co-host of the Thinking CAP podcast explains in detail.

Volsky, who we last spoke with during the Democrats' fight to enact Obamacare back in 2009 and 2010, explains how the GOP plan's cuts and restructuring of both the ACA's Medicaid expansion and the traditional, 52-year old Medicaid program will stifle or end medical care for massive numbers of children and elderly, not to mention the poor.

"Medicaid is a program that covers 74 million Americans," says Volsky. "It's not just lower income Americans --- who we usually, I think, think of when we talk about Medicaid --- 49% of all births are covered by Medicaid. 64% of all nursing home residents have Medicaid coverage. 76% of poor children, 39% of all children. So you're really talking 20% of Americans rely on Medicaid. The House bill cuts it by about $834 billion. The Senate bill is even worse. Because not only do they go after [Obamacare's] Medicaid expansion, but they also cap the [traditional Medicaid] program and change the way its funded by the federal government."

"It's really going after lower-income and middle-income Americans in a way that we've never seen before," he tells me. "They want to push those folks into private insurance. That's really the end goal --- to drown the program over time in the bathtub entirely."

But the GOP's scheme will also adversely affect those who receive health insurance via the Obamacare exchanges as well as via employers, while giving massive tax cuts to a tiny handful of very wealthy families in exchange.

"My favorite statistic is that for the 400 richest tax filers, they get a tax cut totaling --- are you ready for this? --- 2.8 billion dollars," Volsky explains. "You look at this bill, and it looks like Republicans don't think they'll ever have to face a fair election ever again." Hmmm...

We also discuss what you can do to help derail this deadly plan (among those things, call your Senators and otherwise check out the Center's TrumpCareToolkit.org for more info), and which Republican Senators may be in a position to block the scheme together.

On today's BradCast, Republicans in the U.S. Senate finally released a draft of their secret plan to repeal and replace the Affordable Care Act, or 'ObamaCare', and the Dept. of Defense finally releases a redacted version of a damage assessment from 2011, examining the fallout to national security from the Bradley/Chelsea Manning leaks of 2010. [Audio link to show follows below.]

First up: The secret working group of white, male Republicans in the Senate finally revealed their new scheme, dubbed the "Better Care Reconciliation Act", to rewrite 1/5th of the U.S. economy by replacing ObamaCare with what Donald Trump has promised would be a healthcare plan "with heart" that was less "mean" than the version he celebrated after its narrow passage by Republicans in the U.S. House several weeks ago.

The release of the new Senate plan did not go well. Democrats, independents, and healthcare advocates alike --- not to mention elderly protesters in wheelchairs dragged away from outside the office of Senate Majority Leader Mitch McConnell --- slammed the legislation for its massive tax cuts to the wealthy in exchange for deeply cruel cuts to federal Medicaid funding, and the promise of stingier premium subsidies for less generous health care policies.

A number of Republicans in the Senate also currently oppose the plan as written, because it doesn't repeal ObamaCare enough, but we'll see if they change their tune before the bill comes up for a vote next week, as promised by McConnell, before Congress leaves for the July 4th recess. The GOP can only afford to lose the support of two Republicans among their 52-seat caucus.

Then, we're joined by BuzzFeed News journalist and "FOIA terrorist" JASON LEOPOLD, to discuss the newly unearthed Dept. of Defense damage assessment of the hundreds of thousands of documents on the Iraq and Afghanistan Wars, as well as diplomatic cables, leaked by U.S. Army intelligence analyst Chelsea Manning in 2010.

During her trial, Government officials charged that the disclosures caused massive damage to national security and endangered counts lives of both U.S. personnel and our allies, but is that what the DoD's own secret 2011 assessment --- finally released this week in heavily redacted form in response to Leopold's Freedom of Information Act request --- actually found? We discuss that and the "passionate responses" he has received since publishing the assessment.

We also discuss the new White House ban on cameras during press briefings and how the Trump Administration compares to previous administrations on matters of government secrecy and document classification.

"In the overall picture, you have an administration that operates under intense secrecy that wants to limit access --- 'access' being the key word there --- that journalists depend upon. Access is really important, and it's really important to be able to confront government officials," Leopold tells me, while placing the news about the ban in context with the Trump Administration's secrecy and on-going battle with journalists elsewhere. "This type of behavior trickles down to various levels within the federal government and, I've seen, it also goes into local and state governments, as well. This intense secrecy, where elected officials who are accountable to the people are simply not interested in speaking --- and then try and set up some new rules that basically bars the press from confronting them."

Leopold goes on to cite the increased difficulty he is beginning to have prying documents loose via FOIA requests under the Administration, while noting that "some of these agencies are having trouble trying to figure out how to respond to requests, largely because you have a President now who is tweeting, who is arguably declassifying --- instantly declassifying --- information that would otherwise remain secret."

Speaking of which, finally today, Trump tweeted that, despite his previous suggestions, he has no audio tapes of his one-on-one conversations with now-fired FBI Director James Comey. But is he telling the truth, or bluffing yet again?...

On today's BradCast, given the reports that Donald Trump is now personally being investigated for obstruction of justice, we unpack the chaos that may soon come about if the Deputy Attorney General is forced to recuse himself (or is fired) from overseeing the Special Counsel's probe of Team Trump. [Audio link to complete show follows below.]

But, while all the madness of the DoJ's Trump investigations are going on, Senate Republicans indicated today that they will call for a vote on their secret Obamacare replacement bill before the July 4th recess next week. They also announced they will have the votes needed for passage. If they are right, the results are likely be devastating for millions of Americans, and not only the poor. One of out three elderly Americans in nursing homes, for example, rely on Medicaid to cover the costs, and the GOP is about to cut hundreds of billions of dollars from the program in exchange for massive tax cuts for the wealthy.

We discuss that and, as record heat blasts the Western US, the unbelievably stupid explanation for climate change just offered by Energy Secretary Rick Perry (it's not CO2, he says, it's "the ocean waters and this environment that we live in"!) We also offer a very quick preview of the U.S. House Special Elections being held today on 100% unverifiable touch-screen voting machines in BOTH Georgia and South Carolina. (We'll have full results, whatever they are reported to be, on tomorrow's show).

Then we're joined by attorney, author, columnist and UNH asst. professor SETH ABRAMSON to step through his recent 50 tweet(!) tweetstorm detailing the 'bedlam' that is likely to ensue when and if (he insists "when") Deputy AG Rod Rosenstein is forced to recuse himself from overseeing Special Counsel Robert Mueller's investigation of Team Trump and, reportedly, obstruction of justice by the President himself in his firing of FBI Director James Comey.

The chain of events that could come about as the result of Rosenstein's recusal, as Abramson details on the show today, are amazing and could lead to a very real Constitutional Crisis and even completely separate obstruction of justice charges against Trump based on an entirely different investigation related to his February mass firing of all of the US Attorneys.

Lots of somewhat jaw-dropping 'bedlam' unpacked and explained and to be absorbed in detail on this front on today's show, including whether or not Rosenstein himself could come under investigation; who the next officials in line are to take his place (first, a friend of Ted Cruz' named Rachel Brand, then a man named Dana Boente) and what their conflicts are; how Trump could personally come to appoint the person overseeing the Special Counsel's investigation after we go through Brand and Boente; and why, if sitting Presidents cannot be indicted, as many argue, Mueller would be carrying out a criminal obstruction of justice investigation of Trump in the first place.

"Honestly, If I were to lay out the full complexity of the situation right now at the DoJ, which goes well beyond the question of Rachel Brand possibly becoming the Acting AG in the very near term, it would take --- and I am not exaggerating --- probably about 500 tweets," Abramson tells me. "We are in so many unprecedented situations and sub-situations at the DoJ, it is bewildering even for attorneys," he says, adding later: "This is the most complex and public litigation of probably the last 100 years in American political history."

Finally today, another heartbreaking story of yet another immigrant victim of Trump's, now facing deportation and separation from his family despite spending months in the clean-up efforts at Ground Zero after 9/11...

On today's BradCast, big wins for Democrats in very Republican districts, more trouble for the GOP as the Congressional Budget Office (CBO) finally scores the House healthcare bill, and trouble likely ahead for still-divided Democrats. [Audio link to full show is posted below.]

As Republicans struggle to pass any major legislation in the wake of Donald Trump's continuing political and legal troubles, Democrats saw two different huge state-level electoral victories in "deeply red districts" in New York and New Hampshire during special elections on Tuesday. Both seats had been previously held by Republicans for years and, in NY, the former Bernie Sanders delegate who won the set, helped flip the district "an astounding 39 points" since the November election!

All of that comes in advance of a statewide special election for the U.S. House in Montana on Thursday, believed to be "closer than it should be" in a state that went for Trump last November by more than 20 points, and a U.S. House special election runoff next month in Georgia's 6th Congressional District which also went to Trump last year, but where the Democrat is now said to be leading his Republican opponent by 7 points.

The first-time Democratic candidates in both the MT and GA races are raising record-shattering money from small donors, though in Georgia, non-partisan election watchdogs are urging voters to cast absentee paper ballots by mail or, preferably, dropped off at County HQ, rather than via the 100% unverifiable touch-screen systems the state will once again, shamefully, force voters to use at the precincts on June 20th.

Then, just before airtime, the non-partisan CBO finally released its score of the Republicans' American Health Care Act (ACHA), which was narrowly adopted in the U.S. House three weeks ago. Like previous GOP versions of the bill to repeal and replace the Affordable Care Act ("Obamacare"), the CBO finds the latest version will result in more than 20 million Americans (23 million, in this case) losing their health care coverage over the next ten years, including 14 million next year alone.

Journalist and health care reform advocate Jackie Schechner joins us with details from the CBO's just-released report, and what it is likely to mean for the future of the GOP legislation in the House and in the U.S. Senate. (She believes the GOP will ultimately fail to pass a bill that both houses can agree upon, so Obamacare will stay in place for the foreseeable future.)

Schechner details how the GOP's House bill will imperil health care for those with preexisting conditions (the CBO found such people "would ultimately be unable to purchase...health insurance at premiums comparable to those under current law, if they could purchase it at all"); the Senate GOP leadership's strange plan to create a competing bill in the upper chamber with a "group of 13 white men" and no Democrats or even industry experts taking part; how she believes Republicans and President Trump have purposely undermined Obamacare; and how Democrats and Republicans together could actually fix the problems in the Affordable Care Act --- if they actually wanted to.

"I think it's important that we take a step back and take the politics out of this, and start to focus on the policy of what we're trying to do," she tells me. "What we're trying to do is get people in this country access to health care, and to make it affordable. That's where the policy specifics need to come into play, and that's not going to happen if you got 13 white men who are crafting this behind closed doors who have no experience in health care policy."

We then close with a very lively discussion of a Democratic single-payer "Medicare for All" health care bill introduced by Rep. John Conyers (D-MI) in the House. The legislation, HR-626, for the first time ever, now has support from more than half of the Democratic caucus. Does that bill present a way forward for health care reform in the U.S. --- and for Democrats at the ballot box?

On today's BradCast: A ton of breaking (and largely distressing) news, before largely encouraging review of four upcoming U.S. House special elections that may offer a bit of an antidote to some of that distressing news, at least for Democrats and progressives. [Audio link to show follows below.]

Today's show both opens and closes with a ton of breaking news, including, for a start: Another school shooting, which appears to be a murder-suicide, in San Bernardino, CA (the same town where 14 were killed in a mass shooting in late 2015); The white supremacist Charleston church shooter is sentenced to 9 consecutive life sentences in state court after being sentenced earlier this year to execution in federal court; Stolen U.S. Supreme Court "Justice" Neil Gorsuch is sworn in, as President Trump thanks Senate Majority leader Mitch McConnell for the theft; War planes take off from the very same air base said to have been bombed by Trump last Friday, and U.S. war ships head toward the Korean Peninsula for a possible confrontation with nuclear-armed North Korea; and Trump huddles with the Koch Brothers at Mar-a-lago as special elections to fill Republican U.S. House vacancies left by Administration appointees get underway in Kansas, Georgia and Montana (and in Los Angeles, where there is a Democratic vacancy).

We're joined today by the great Howie Klein, progressive champion and founder of DownWithTyranny.com for an overview of all four upcoming U.S. House races and the surprising (if still long-shot) possibilities of Democratic pickups in the three otherwise very Republican districts. Klein breaks down the likelihood for Dem victories in each district, describes the candidates who are running, and why it is that both the Republican and Democratic parties seem to have been underestimating the possibility of several of those seats "going blue" in the first federal elections of the Trump Era.

Among the upcoming U.S. House races, Klein notes that in CA-34, leading candidate Jimmy Gomez is a very progressive Dem running against another Dem who, he charges, is actually a Republican who changed his party affiliation for this race; in KS-4 (which votes on Tuesday, 4/11), Klein tells me that a week ago he'd have said the Dem candidate, James Thompson, had no chance in the deeply "red" district. But now that national GOPers are suddenly pouring panic money and other resources into the race, he thinks it's still long odds, but possible that Republican Ron Estes could face an upset in the home district of Koch Industries. In GA-6, he details, progressives have very high hopes for 30-year old Jon Ossoff who is running way ahead of a split GOP field in a "Jungle Primary" compromised of some 18 candidates in the first round of voting set for 4/18, where any candidate who gets 50%+1 could win the whole thing outright; And, finally, we review Montana's at-large U.S. Congressional race which, he says, could also be vulnerable to the populist Democratic candidate now running in a Republican state that has shown itself able elect Democrats to statewide seats in the very recent past.

Klein spares no criticism, however, for a number of Democratic organizations, like the Kansas Democratic Party which, he says, "should be ashamed of themselves" for failing to spend money on the House race. "They haven't had a candidate this strong running for that seat ever, and they haven't had an opportunity like this as long I can remember. They should be all over this, and they're not."

"These are dark, deep 'red' districts, and normally there would be no Democrats having any chance. But because of Trump's policies, because of that crackpot healthcare bill --- TrumpCare or whatever it was --- because of that, Republicans are discouraged and thinking, 'I'm not even going to go vote'. Or other Republicans are thinking, 'You know what? I'll vote for the Democrat!,'" Klein tells me. We'll soon see if he's right. But, of course, we'll also have to presume that Georgia's 15-year old, 100% unverifiable touch-screen voting systems weren't manipulated by (or since) a recent "massive" hack of its voter database.

And finally, as we head off air today, breaking news about the resignation and criminal booking of Alabama's Republican Governor Robert Bentley in the face of impeachment charges and...as if that's all not enough...a U.S. District Judge in Texas once again finds that state Republicans deliberately discriminated against racial minorities with their controversial Photo ID voting law...

On today's BradCast, the world and the U.S. Congress respond to Trump's bombing of Syria earlier this morning, even as Republicans in the Senate complete their unprecedented theft of the U.S. Supreme Court. In a related matter, an appellate court issues a landmark expansion of the Civil Rights Act. [Audio link to show is posted below.]

While many in the corporate media are joining a number of world leaders and members of Congress in celebrating Donald Trump's cruise missile attack on a Syrian air base days after an horrific chemical attack in the country, Russia is citing the action as a "significant blow" to U.S.-Russia relations and an act of "aggression" in violation of international law. Moreover, a number of Congress members, both Republican and Democratic from both chambers, are similarly citing Trump's attack as "an act of war" that is unlawful under the U.S. Constitution, as well as ill-considered and dangerous on several levels. Congress itself has now scuttled away for a two-week holiday recess, after refusing to even debate U.S. action in Syria more than 4 years, in the wake of some 400,000 deaths in the war-torn country.

At the same time, before heading home for the holidays, as the nation, the media and world were otherwise distracted today, Majority Leader Mitch McConnell and Senate Republicans finalized their historic judicial coup by confirming "Justice" Neil Gorsuch to the Supreme Court with a simple majority after unilaterally changing Senate rules to kill the right to filibuster SCOTUS nominees in the wake of their year-long refusal to hold a hearing or a vote for Barack Obama's nominee Judge Merrick Garland.

Then, following a landmark 8 to 3 bi-partisan Civil Rights Act ruling this week by the full 7th Circuit Court of Appeals (where most of the judges were appointed by Republicans and are considered quite conservative), Mark Joseph Stern, legal reporter for Slate, joins us to explain why he sees the decision as a precedent-setting "thunderbolt" for civil rights and the LGBTQ community.

The case involves a community college which was found sued for having discriminated against a woman in its employment practices on the basis that she was gay. The ruling, as Stern details, is the first time an appellate court has extended the Civil Rights Act to include protections against workplace discrimination on the basis of sexual orientation in addition to simply race and gender.

"What the 7th Circuit majority said was, look, it is logically incoherent to remove sexual orientation discrimination from the concept of sex discrimination. When an employer discriminates against a woman for dating another woman, he is discriminating against her explicitly on the basis of her sex. If she were a man dating a woman, then she would not face discrimination. If she were a woman dating a man, then she would not face discrimination. It is only because she is a woman and she is associating intimately with other women that she faces this kind of discrimination," Stern explains.

The case is likely to have broad national implications and will be "impossible to ignore" at the Supreme Court, says Stern. It's also important thanks to Reagan-appointed conservative Judge Richard Posner's opinion in which he argues that courts, as Stern short-hands it, "should interpret statutes in a manner that 'infuses' them 'with vitality and significance today' rather than relying on their original meaning. Posner contrasted this theory with the conservative 'originalism' championed by Justice Antonin Scalia." That is no small matter as it's being sung out by Posner, the Supreme Court's most cited federal jurist of the 20th century. (And, incredibly enough, even the far-right activist Judge Frank Easterbrook joined the majority in this case!)

Stern also discusses what we should expect when and if the case is heard by what he also considers to be a "stolen" Supreme Court in the wake of the GOP's illegitimate confirmation today of Gorsuch.

Finally, Desi Doyen joins us with the latest Green News Report with an unconscionable corporate media failure, and as the GOP-controlled U.S. House Science Committee shamefully uses McCarthy-esque tactics to put science itself on trial...

Today on The BradCast, Republican Senate Majority Leader Mitch McConnell's theft of the U.S. Supreme Court is nearly complete after his use of the so-called "nuclear option" today and his blatant, continuing lies in support of it. Also, concern grows about Donald Trump's reaction to this week's chemical attack in Syria on a dark day for both the country and the world. [Audio link to show follows below.]

As of today, it's almost done. McConnell's scheme to steal the Court majority for a generation on behalf of the GOP is now virtually a fait accompli with his procedural maneuver to kill the use of filibusters for SCOTUS nominees in light of the Democrats' attempt to block the confirmation of Judge Neil Gorsuch. The Senate rules change comes as McConnell continues to lie about his unprecedented obstruction of Barack Obama's nominee for the same seat, Judge Merrick Garland, for more than a year following the death of Justice Antonin Scalia in February of 2016.

Constitutional law expert Ian Millhiser, author of a recent book on SCOTUS and its widening political divide, joins us today to help explain what all of this is likely to mean for the Senate, the Court and the country in both the short and long-terms. None it very good, I'm afraid.

"I'm not the least bit surprised," that there were not three Republican Senators willing to step forward today to block McConnell's rule change with a simple majority vote, Millhiser, the Editor of ThinkProgress Justice, tells me. "After you make the deal with the Devil that leads to you supporting Trump in the White House, going one step further and saying 'we're also going to change the rules of the Senate' - that's not too heavy of a lift all of a sudden."

"It's absolutely a stolen seat. This is the Merrick Garland seat," he charges, referring to the Republican's years-long blockade of Garland and failure to even hold hearings, much less an up or down vote. "The block of Democrats who voted against Gorsuch represent more than 53% of the nation. So, the only reason this guy is going to be on the Supreme Court is because a President who lost the popular vote by nearly 3 million votes nominated him, and a group of Senators who represent a minority of the country, are going to vote to confirm him."

Millhiser also offers his thoughts on whether the filibuster for legislative actions may be next on the GOP Senate's chopping block, whether Democratic then-Majority Leader Harry Reid made a mistake by nuking the filibuster for non-SCOTUS judicial nominations back in 2013 (and we discuss what actually happened that led up to it), and what, if anything, Americans can now do to try and reverse the dangerous course the nation is clearly on.

Speaking of dangerous courses...Also today: Trump bangs the drums of war in response to the horrific chemical attack in Syria this week, despite his previous insistence that Obama and the U.S. stay out of the matter (even after an even more deadly chemical attack there in 2013) and despite the lack of international investigation, to date, as to who and what was behind the incident. And, finally, we close with a bit of good-ish news (the best we can find on a grim day) concerning a significant change in the way Americans, including Republicans, now view the Affordable Care Act in the five short months since last year's election.

Guest: Law professor Peter Shane on lack of 'institutional penalty' for GOP theft of SCOTUS; Also: House GOP makes healthcare bill even crueler...

On today's BradCast: Donald Trump's U.S. Supreme Court nominee faced questions all day in the U.S. Senate Judiciary Committee. But what the hell is Judge Neil Gorsuch even doing there at all? And doesn't normal coverage of the hearings do little more than normalize a decidedly abnormal situation? [Audio link to show follows below.]

Donald Trump's selection to fill the seat left vacant by the death of Justice Antonin Scalia more than a year ago, represents nothing less than a stolen seat on a stolen U.S. Supreme Court. If he is confirmed, Republicans are likely to be rewarded for their theft with a majority on the high court for another generation, following their unprecedented refusal to even hold hearings for Barack Obama's nominee for the seat, Judge Merrick Garland.

I've been wrestling with how to cover this week's hearings, which I consider to be illegitimate (and that is true even setting aside the disturbing matter of Trump as President!) Professor Peter M. Shane of Ohio State University's Moritz College of Law joins me to try and help make sense of the situation. His recent piece at the American Constitutional Society, cited by the New York Times today, details how neither Democrats nor corporate media, to date, seem to have figured out how to issue any kind of institutional penalty for the GOP's blatant, brazen and unheard of theft.

Shane explains that, historically, despite Republican assertions to the contrary, "there is no close precedent" in history for what the GOP has done here. "The reason that they didn't want Judge Garland to become Justice Garland was, of course, the fear that they would be losing what had been a secure 5-4 conservative majority on the court. But they also didn't want to give him a hearing because they knew, if they gave him a hearing, that Judge Garland would appear to be so thoughtful, so reasonable, so accomplished and balanced a person, that it would be politically much more difficult to vote 'no'. Nobody in the Senate is constitutionally obligated to vote in favor of Judge Garland, it would just be hard to explain why [they didn't.]"

So they stole the seat instead, by refusing to even hold a hearing, much less a vote. As to the Democrats' lack of an organized response, such as a promise to filibuster Judge Gorsuch (or any other Trump nominee other than Garland), despite the threat of the GOP doing away with the filibuster for SCOTUS nominees, Shane observes: "It seems to me that the Democrats very frequently anticipate the political defeat that lies ahead, and just keep their powder dry for a fight that never happens." He argues Dems are likely "worried about political blowback for being a fierce party of resistance," adding: "That's what the Republicans have been, increasingly, since 1980. If they've paid a penalty for it, I haven't noticed."

Also on today's program: While Congressional hearings have taken over the beginning of the week, House Republicans are making last minute changes to their scheme to replace the Affordable Care Act, by making it still crueler for millions of Americans (but with even more kickbacks for wealthy ones!) in hopes of wheeling and dealing for enough votes to squeek by with passage in the U.S. House, where they plan to ram the bill through for a full floor vote this week before tossing it to the Senate.

Finally: A majority of Americans are unable to name even a single SCOTUS Justice, and the tax-payer cost for Trump's constant weekend vacations could cover four federal programs for the arts, the elderly, the jobless and the homeless that his budget proposal hopes to slash entirely...

On today's BradCast, Congressional GOP leadership continues to ram their "ObamaCare" repeal and replacement bill through House Committees, even as the future of their American Health Care Act remains uncertain with Republican opposition in both the House and Senate, not to mention growing opposition from health care advocacy groups. But that's just one of the potential battles on the near horizon amongst Republicans in the House, Senate and White House. [Audio link to show posted below.]

Donald Trump's budget proposals include a huge increase in military spending and huge cuts across the board to domestic programs --- and just about everything else --- in order to pay for it, including taxes and cuts to the IRS itself, by itself, will cost the government billions in revenue alone. (The IRS brings in $4 for every $1 that funds it --- so why would the GOP and Trump want to cut it? We discuss.)

But the question of whether Republicans in the House and Senate can come to terms with the White House, much less each other, on spending priorities is another matter entirely. Journalist Alice Ollstein of Talking Points Memo joins us from Capitol Hill today to discuss what may be ahead for the upcoming budget battle that could include, yes, another Government Shutdown (today the Treasury Department announced we will hit the debt ceiling against next week) and even an attempt by Trump to circumvent the law entirely, "because you can't legally do what President Trump wants to do," she explains.

By way of just one example of surprises that Trump may encounter even with a friendly Republican Congress, Ollstein explains: "I am hearing a lot of opposition from Republican lawmakers, especially to cuts to the State Department, saying 'We do not support cutting the State Department's budget by a third, because diplomacy keeps us safe and would make us eventually have to spend more on war.'" Those proposed cuts to State, 37% of their current budget, have already been opposed by Trump's own Secretary of Defense James Mattis, among others.

Ollstein also cites "the ghost of Ronald Reagan" as a specter that could end up haunting Trump's plans, since he seems to be following a path for radically growing the military, cutting taxes and blowing out the deficit in the bargain, a model that even Reagan ultimately had to try and roll back. "So, we'll see if this Trump plan, that is sort of Reagan 2.0, goes forward" at all, she explains.

Medical advocacy groups come out against the GOP leadership's scheme to 'repeal and replace' ObamaCare...

On today's BradCast, can Paul Ryan, Mitch McConnell and Donald Trump overcome the mountain of push-back --- from Right, Left and Center --- against their plan to repeal and replace the Affordable Care Act ("ObamaCare")? [Audio link to show is posted below.]

First up today, we check in with KPFK/Pacifica Radio's Alan Minsky from the scene of today's International Women's Day demonstrations in downtown Los Angeles, where, he reports, thousands are gathering in protest.

Then, it's on to the quickly growing opposition to Speaker Ryan and the rest of the GOP leadership's scheme to "repeal and replace" ObamaCare, as introduced on Monday, and being "rammed" through House Committees beginning today, even before the bill, the American Health Care Act, has been scored by the non-partisan Congressional Budget Office (CBO).

So far, the conservative right is revolting against the replacement bill, dubbed the American Health Care Act, endangering its potential for passing in either the House or Senate. But the scheme is also now being opposed by major medical advocacy groups like the American Hospital Association (AHA), the American Medical Association (AMA) and the American Association of Retired Persons (AARP), who all charge that millions will lose health care coverage under the Republican plan.

Will the GOP and Donald Trump be able to overcome the opposition to keep their long-held promise to kill ObamaCare? Do they really event want to, as discussed on yesterday's show? We take listener calls today on that and more, including the continuing progressive push for a single-payer plan that covers all Americans.

Also today, with yesterday's document dump at WikiLeaks revealing (among other things) that the CIA has been able to hack into encrypted apps and devices, it's yet another reminder that encryption schemes cited by supporters of electronic vote casting and counting, like all non-transparent forms of tabulation, should be dismissed.

Finally, Desi Doyen joins us for our latest Green News Report, as Trump continues to break his promise to "protect our air and water" with his new EPA and Interior Department chiefs rushing to return favors to the fossil fuel industry...

On today's BradCast, the GOP health care plan to "repeal and replace" Obamacare has landed with a thud among Democrats and, only somewhat more suprisingly, among so-called conservatives. And, as our guest argues today, that may have been the plan all along. [Audio link to show posted below.]

House Republicans leadership introduced their long awaited health care plan on Capitol Hill late yesterday and we break down the details of it today. But, other than Donald Trump who described it, via Twitter, as "our wonderful new healthcare bill", the plan does not seem to be going over well in a number of key quarters. Of course, Democrats oppose the new scheme to "repeal and replace" the Affordable Care Act (or, "ObamaCare") and Republicans have yet to have their new plan, dubbed the American Health Care Act, scored by the non-partisan Congressional Budget Office (CBO). So we don't know how much it will cost or how many people will actually be covered under it (or lose their coverage, thanks to it.)

But, the more important push-back against the new plan appears to be coming from Republican members of Congress and the rightwing policy groups like the Heritage Foundation and the Koch Brothers-funded Americans for Prosperity. They are calling it "ObamaCare-lite" and vowing to block it, as our guest Ryan Grim, Washington Bureau Chief for Huffington Post reports today.

Grim tells me why, based on his reporting, the roll-out --- and the plan itself --- appears to be such a disaster, and suggests that Republicans, including Speaker Ryan and Republican Senate Majority Leader Mitch McConnell, have no actual intention of repealing and replacing the Affordable Care Act at all. "They're pretending," he says. "Also they didn't think they were going to win the election. They didn't think they were going to catch this car that they've been chasing down the road. The problem for them is that Obamacare itself was basically designed by the Heritage Foundation years ago. So it's almost unfair for them to try to come up with an alternative to the thing that they developed themselves. But they're the ones who disavowed their original plan, so it's not that unfair."

"Paul Ryan is not an idiot. He has the phone numbers for the Koch Brothers, Club for Growth, Freedom Works, Heritage, all these different outfits that piled on it today. So how was this not worked out [in the last 8 years]? It suggests to me that it's not actually a serious attempt," Grim explains before detailing why it is not even a safe bet, at this point, to assume that Ryan and McConnell "actually want to pass something" at all.

Guest: Attorney Mark Joseph Stern of Slate...

On today's BradCast, as dark as yesterday's show was, today is somewhat the opposite, with a whole bunch of encouraging news from the courts and the people across these United States. [Audio link to show follows below.]

Attorney and legal journalist Mark Joseph Stern of Slate joins us to break down the full 4th Circuit Court of Appeals' potentially landmark decision upholding the state of Maryland's ban on semi-automatic "weapons of war" and the U.S. Supreme Court's ruling today on a race-based death penalty case out of Texas.

On MD's ban on military-style assault weapons, enacted by the legislature following the 2012 Sandyhook Elementary school massacre, the full court's majority ruling, including a number of Republican-appointed judges, soundly rejected the opponents argument that, as Stern says, "once enough people own a certain type of gun, the 2nd Amendment magically begins to protect it." He explains what may happen next with this case as it moves toward the Supreme Court and offers his thoughts on why GOPers and the NRA are suddenly unconcerned with their "states rights" arguments when it comes to guns.

On the SCOTUS death penalty case, granting a repreive, for now, to a Texas man on death row since 1997, Stern explains how the case underscores that "people who are sentenced to death in this country get the worst lawyers sometimes...It's really quite shocking." Incredibly enough, Chief Justice John Roberts eloquently agreed --- at least in this case.

And more encouraging news also covered today...

  • A federal court in Texas blocks the state's attempt to defund Planned Parenthood;
  • North Carolina's Democratic governor moves to withdraw the state's appeal to SCOTUS, filed by his Republican predecessor seeking to overturn a federal appeals court finding that the state's election reform law unconstitutionally discriminated against African-Americans "with surgical precision";
  • An FEC commissioner refuses to back down in the face of legal threats from Koch Brothers'' funded group after her demand to see Trump's alleged evidence of thousands of illegal votes cast in New Hampshire's 2016 Presidential election;
  • Another new poll finds Trump's approval ratings "sinking like a rock";
  • A Muslim group raises $90 thousand (so far) to help repair the desecrated Jewish cemetery in St. Louis, MO;
  • A people continue to exercise democracy, whether Republicans and Donald Trump like it or not, by showing up in huge numbers at Congress member town halls across the country...

Trump's National Security Advisor Michael Flynn resigns. What did the President know and when did he know it?...

On today's BradCast: Is it just me, or is it getting Nixon in here? [Audio link to show is posted below.]

As they asked during Watergate: "What did the President known and when did he know it?" That's just one of the many questions quickly emerging in the hours since last night's resignation of National Security Advisor, Lt. General Michael Flynn, following revelations that he spoke with the Russian Ambassador about U.S. sanctions prior to Trump's inauguration and then lied about it to the media, the public, Vice President Mike Pence --- and perhaps even the FBI.

As they also said during Watergate: "It's not the crime, it's the cover-up." The Logan Act, as I explain today, was never really the problem. It's a weak statute and has never actually been prosecuted in its history, dating back to the 1790's. It's the lies and the possibility of blackmail in the wake of those lies that are now (among) the many problems for this White House.

The continuing --- and growing --- disarray of the not-even-one-month-old Trump Administration extends to the amazing contradictions from high-level officials at the White House about all of this over the past 24 hours, and to Trump himself, who, just last Friday, seemed to feign ignorance about Flynn's conversations with Russian officials. That, before the White House confirmed this afternoon that the President was directly informed about all of this by the Department of Justice weeks ago.

Among questions now being raised, even by some Republicans in the House and Senate: Why didn't Trump act weeks ago on this? Is it plausible in anyway that Flynn went "rogue", or was he, in fact, authorized and/or directed --- by someone on the Trump transition team --- to discuss lifting sanctions against Russia with their Ambassador? If so, by whom? Was he also directed to lie about it? If so, by whom and why are so many seemingly lying about it all now? We discuss those questions and many others on today's show.

Listeners call in with opinions for and against what will likely result in dishonest, hypocritical Republicans invoking 'the nuclear option'...

On today's BradCast, history and democracy need heroes right about now. Senate Democrats have the option to fight back against Trump's nominee to the GOP's stolen U.S. Supreme Court, or they can become collaborators and enablers of the Republican theft and be voted out of office in response. [Audio link to show follows below.]

In 2016, Senate Republicans stole the U.S. Supreme Court by refusing to hold a hearing, much less a vote, on Barack Obama's centrist (arguably, too centrist) nominee Judge Merrick Garland following the death of Justice Antonin Scalia. Now that Donald Trump has announced his own nomination for the stolen seat, Judge Neil Gorsuch, history --- and democracy --- demands that Democrats filibuster any nominee other than Garland, even if it leads (as it will) to the "nuclear option" in which Senate Republicans do away the filibuster rule, as Trump has now called for.

We explain why all of this matters on today's show, detailing the GOP's extraordinarily dishonest and hypocritical action and rhetoric on this point from Republican Majority Leader Sen. Mitch McConnell, Sen. Orrin Hatch, Sen. John McCain and others.

Most importantly, we call for listeners to demand their U.S. Senators prevent the Court from being further stolen during Trump's Chaos Presidency. (You can reach your Senators' D.C. offices by calling them at: 202-224-3121). We strongly support Oregon Senator Jeff Merkley's call for exactly this, hope you do too, and hope you'll let your Senators know you will work and donate and vote against them if they fail to protect the Court.
