Last week, Federal Election Commission (FEC) disclosures for the 2016 Presidential contest confirmed that wealthy Super PAC donors are now spending more than three times as much as small donors. As Politico describes the "gusher of cash" now pouring into American elections from millionaires and billionaires, the "67 biggest donors, each of whom gave $1 million or more, donated more than three times as much as the 508,000 smallest donors combined."

At the same time as that obscenity plays out, a select few GOP Presidential candidates auditioned for the Koch Brothers and rich friends over the weekend in California, where Charles Koch compared their political fight to the Civil Rights Movement. Seriously. Politico's Tarini Parti, joins us on today's BradCast to discuss all of the above and Politico's own controversial role in the weekend confab.

Then, Chuck Lindell of the Austin American-Statesman joins us to discuss today's indictment and arrest of Texas' brand-new Attorney General Ken Paxton (R-Tea Party) on three felony counts related to securities fraud. Thanks to a law Paxton helped pass when he was a member of the TX House, he could now be facing life in prison if convicted on the charges being brought by Special Prosecutors (one of whom was formerly Republican U.S. House Majority Leader Tom DeLay's defense lawyer). The indictment is in response to a complaint filed by one of Paxton's fellow GOP statehouse members. None of that, of course, has kept the state's Republican Party from declaring the entire matter to be a partisan witch hunt.

Lindell also updates us on the status of Texas' even more notorious felony indictment, the one against the state's former Governor and current GOP candidate for the 2016 Presidential nomination, Rick Perry. The trial in that case, Lindells tells me, "could take place as early as December --- or right before primary season opens up" in January.

Finally today, President Obama unveiled the new EPA rules for cutting carbon emissions at power plants in all 50 states by some 30% over 2012 levels. Can you hear the wingnut heads exploding?...

While we have, for more than a decade, covered the extreme vulnerabilities of voting machines and electronic tabulators and broken numerous exclusive stories about it on both The BRAD BLOG and The BradCast, my guest on today's show offers a number of additional ways --- some of which had largely never even occurred --- by which bad actors could disrupt U.S. elections.

Michael Gregg, IT security expert and COO of the private, Houston-based computer security firm, Superior Solutions wrote about some of those concerns recently at Huffington Post. He joins me today to discuss several of the ways that U.S. democracy could be disrupted by political hacktivists, election insiders or even foreign entities and how we might not ever even know about it if they did --- thanks to the type of electronic voting systems we now use in all 50 states and the different ways in which the public is now being blocked from overseeing our own elections and election results.

"Attackers could potentially get in and do these things and it would be very hard to prove. The scary part is, by the time any of this is worked out, the election is over with, so it's too late," he tells me. I ask him how elected officials in his home state of Texas --- much of which forces voters to use 100% unverifiable electronic voting systems --- react when he points out these concerns. "We've brought that up multiple times, but that seems to be the powers that be, how they want to do things."

Gregg, who I've never spoken to previously, concludes, as I have, that paper ballots (hand-marked and hand-counted, in my case) are the most secure way to run elections. "I agree with you 100%," he says. "If you have a paper-based system, it's very very hard to attack, it's very much easier to be able to detect those types of things."

As to Internet Voting, well, you'll want to tune in for this computer security professional's opinion on whether or not the Internet can ever be secure enough to use for the most important aspect of our representative democracy.

On today's BradCast, we start where we left off on yesterday's show, regarding Thursday's amazingly corrupt and disturbing ruling in favor of Scott Walker and his cronies --- by the amazingly corrupt Wisconsin Supreme Court --- and how, if Republicans have their way, that ruling may soon enough become the law of the land for the entire nation.

As our producer Desi Doyen noted on today's show: "This is your early warning system." Ignore at your peril. Then it was on to a couple of quick items and updates, including dumb Confederate flag wavers in Oklahoma and Maine's even dumber Governor Paul LePage.

From there, we head to North Carolina, where "the most extreme anti-voter bill passed by any state since the Jim Crow Era", as we initially described it when it was passed by state Republicans back in 2013, is finally now facing trial against the NAACP, the ACLU, the DoJ and other democracy and voting rights advocates.

We are joined by The Nation's author/journalist Ari Berman, who was in the federal courtroom in Winston-Salem, NC this week as the trial finally got under way. The results of this trial are likely to head all the way to the U.S. Supreme Court, one way or another, and may well determine the future of voting rights in this country. The new voting restrictions were passed in 2013, just days after the U.S. Supreme Court demolished the provision of the Voting Rights Act that otherwise, says Berman, would have kept this law --- which is "already disenfranchising voters" --- from even taking effect.

"That's such a clear case study to me that the Supreme Court was wrong when it said that the special protections of the Voting Rights act weren't needed." Berman goes on to explain why he believes NC, a state which had made astounding progress in voting rights over the previous decade, has now become the new Selma, Alabama, where the bloody fight for voting rights led directly to passage of the federal Voting Rights Act in 1965.

"In North Carolina, they had seemingly everything," Berman tells me. "They had all these voting reforms --- early voting, same day registration, pre-registration for 16 &17 year olds. And it was all taken away or reduced" when the GOP took over both the state legislature and Governor's mansion for the first time since Reconstruction in 2013.

"What Selma in the 1960s and what North Carolina in the 2013-2015 era shows is how far these conservative white Southerners will go to protect political power. There aren't billy clubs. There aren't literacy tests. But they're saying this is how black turnout increased --- North Carolina went from 48th in voter turnout in the late 80s, to 11th in voter turnout in 2012 --- Republicans there basically said we're gonna tamp this turnout down."

And now it's left to the courts to find out if those rights, once granted, can be taken away by political whim --- and if NC, and other states with a history of racial discrimination in elections, will be forced once again to face preclearance from the federal government before they can enforce any new voting restrictions.

Berman has a lot of insight on all of this. His new book, Give Us the Ballot: The Modern Struggle for Voting Rights in America, will be published next month to coincide with the 50th Anniversary of passage of the VRA. As I note during the show, the book is an exhaustively researched and heart-wrenching documentation of the uniquely American and harrowing tale of the fight to vote in this country --- and the outrageously long and continuing effort to block it. That fight continues, sadly, to this day. Go buy his book!

Constitutional law expert Ian Millhiser...

Yes, Donald Trump is still leading in the national polls, but, after that, we turn to slightly more serious topics on today's BradCast, as a nuclear deal is finally struck between Iran, the U.S., China, Russia, France, Great Britain and Germany.

But, of course, those heads you hear exploding are (mostly) Republican Presidential candidates who, it seems, are either talking about another deal entirely or they haven't a clue how foreign policy actually works or maybe they've been living in a cave over the past 15 years. (Particularly the years from 2000 to 2008.)

Scott Walker, a very serious candidate for the Republican nomination, is particularly daft on the issue, opposing the agreement with Iran on absolutely ridiculous grounds. But his domestic policy is quite a different and far more disturbing matter. It includes a legal/political/Constitutional philosophy that, while once rejected by the courts and largely left for dead, is now "ascendant within the Republican coalition," as my guest, constitutional law expert Ian Millhiser explains on today's show.

"One thing that has transformed amongst the American right in the last several years is a desire to implement their agenda through any means necessary --- and if that means bypassing the democratic process and just getting their friends on the Supreme Court to implement it, they're happy to do that," Millhiser tells me while discussing one key dog-whistle offered during the Wisconsin Governor's announcement of his 2016 GOP candidacy on Monday.

"What they're doing here is they're trying to effectuate a wholesale transfer of power from the two branches of government that are elected to the one branch of government that is not elected," he says. "And I don't care what your agenda is, that's not something that should be done."

Last week we saw two major news dumps! The first was Tuesday night at 9pm (!), the time the State Department thought was optimal for them to release the first batch of Hillary Clinton emails from her private mail server. Jason Leopold, "FOIA Terrorist" from Vice News, filed the FOIA requests that led to this release. He spent the Fourth of July weekend reading the damned things so we wouldn't have to, and he joined in for the last few minutes of the show.

The other big dump came Thursday night, on the eve of the Independence Day holiday, as the U.S. DoJ and five Gulf states announced a deal with BP representing a final settlement on the world's largest offshore oil spill in history in 2010. Oil industry expert/journalist Antonia Juhasz, who covered the deal at Rolling Stone, arguing that, though it's the largest such settlement in history, BP still "got off cheaply", gives us all the details.

Today's landmark SCOTUS ruling on marriage equality was an extraordinary end to an extraordinary week. So, that what I was more than happy to cover on today's BradCast.

Rights win again, as the U.S. Supreme Court finally declares marriage equality to be a fundamental right to Americans in all 50 states in the union. We discuss the 5-4 opinion in Obergefell v. Hodges, its Constitutional basis, its fallout, its dead enders, and how we predicted it years ago --- even as the GOP was using "gay marriage" as a politicized weapon back in the 2004 elections.

Our guest is Raw Story's Mike Rogers, who, as a journalist, has been helping to lead the way in this fight for years and served as the inspiration behind Kirby Dick's 2009 documentary film, Outrage, "a searing expose of the secret lives of closeted gay politicians".

Rogers credits the Internet and the first-hand coverage of cases that it allowed, for shifting American opinion so quickly on the issue. It "gave us the opportunity to do the most important thing, which is to tell the stories in our own voices," he explains. "America hearing from those folks, and being able to more creatively use the media and the web --- to be able to move those stories of people with kids, people with spouses, people who were widowed like Jim Obergefell in his case, and what it will mean for him and his family now that his marriage is recognized in Ohio --- that happened because of a shifting change in the media. Change doesn't happen without that."

Mike has also been a long-time friend of the blog and the show, having joined us for our "Big Gay Hour" episodes years before such things were done in polite company over our nation's public airwaves. On today's BradCast...The U.S. Supreme Court announces its decision [PDF] in King v. Burwell, a case that would have gutted the Affordable Care Act ("ObamaCare"). As usual, Justice Scalia, on the losing side once again, displayed his extraordinary hypocrisy in his dissent to a case that was stupid to begin with. I explain on today's show.

Then, the last election challenge of 2014 (as far as we know): Dr. Laura Pressley joins me explains why it's impossible to know whether the results of her runoff election for Austin City Council were accurately tabulated on the 100% unverifiable electronic voting systems used in Travis County, across much of the state of Texas and across much of our country.

"We're not just fighting this for our single city council district race. This is a bigger issue," Pressley explains. "Elections have to be verifiable. Candidates need to have the right to question and ask for validation. This is a tenet of our democracy."

Pressley charges that the unverifiable Hart-Intercivic eSlate voting systems actually violate the Lone Star state's own elections laws, even as they clearly undermine overseeable democracy. Remarkably, she says she is now facing a potential court fine of $100,000 for simply bringing her challenge, following some rather disturbing irregularities on the voting systems during her runoff and a complete inability to recount thousands of in-person electronic ballots despite an exact tie on the Vote-by-Mail paper ballots.

Her case was dismissed in state court, but she is appealing the decision and tells me: "One of the comments [in court] was, we needed to be punished as a candidate for challenging these electronic voting systems and that the sanctions should reflect a punishment to deter other candidates from bringing this forward."

Remember that 2009 Dept. of Homeland Security report about Rightwing Domestic Extremism that Republicans forced the Obama Administration to retract?

We do --- once again --- on today's BradCast, particularly in the bloody wake of this week's domestic terrorist attack at Charleston's Emanuel AME Church. For some reason, Rightwingers don't want to remember that report, much less describe this week's attack at "terrorism". Wonder why. And so does Jon Stewart.

Then, speaking of extremist Republicans, the state of Texas has overruled a voter-approved ban on fracking in the city of Denton and declared such local control illegal. TX Gov. Greg Abbott actually says, with a straight face, that, in fighting for fossil fuel industry profits over people, he's protecting private property rights from the "heavy hand of local regulation." (Yes, he actually said that.)

As you know, last week, Hillary Clinton gave a speech in Texas, calling for expanded early voting in all 50 states and for universal voter registration for all eligible U.S. citizens. During the speech, she also called out some of her potential Republican rivals vying for the GOP's 2016 Presidential nomination, among them, former TX Gov. Rick Perry who, Clinton accurately noted, "signed a law that a federal court said was actually written with the purpose of discriminating against minority voters."

She added, Perry "applauded when the Voting Rights Act was gutted [by the Supreme Court] and said the law’s protections were 'outdated and unnecessary'."

Clinton's remarks there were in reference to the Texas Republicans' draconian polling place Photo ID voting restrictions, which, after being passed in 2011, were barred by the Voting Rights Act (VRA) as discriminatory, before the statute was implemented anyway by state Republicans just hours after the U.S. Supreme Court gutted the provision of the VRA under which the TX voting restriction had been found in violation of that law. Late last year, after a full trial on the merits of the law, a federal judge subsequently found the law to be in violation of other, still-standing sections of the VRA as well as the U.S. Constitution --- and, perhaps worse still, found it to be purposely discriminatory.

U.S. District Court Judge Nelva Gonzales Ramos, based on statistics supplied by the state of Texas itself, found the statute could serve to disenfranchise some 800,000 already legally registered voters in the Lone Star state (not to mention hundreds of thousands of others who had yet to register) and slammed both the discriminatory effect and purpose of the law in her written ruling. "The Court holds that SB 14 [the TX GOP's Photo ID restriction] creates an unconstitutional burden on the right to vote, has an impermissible discriminatory effect against Hispanics and African-Americans, and was imposed with an unconstitutional discriminatory purpose," she wrote, adding that the law also "constitutes an unconstitutional poll tax."

On CNN, stammering in response to Clinton calling him out in her speech, Perry failed to explain how either Clinton or Judge Ramos was incorrect. "You need a photo I.D. to get a library book, or to get on an airplane," he incorrectly asserted. (More on that below.) "I think we make it pretty easy in the state of Texas for people to vote, so, you know, again, I don't know what her beef is with the people of the state of Texas about voter I.D."

But there's another point about the TX law that neither Clinton nor Perry noted: its discriminatory effect on women, as highlighted in a Letter to the Editor from this week's Concord Monitor in New Hampshire...

Guest: Police officer-turned-U. of SC asst. professor Seth Stoughton...

On today's BradCast, I was joined by Seth Stoughton, former cop and now asst. professor at the University of South Carolina School of Law, to discuss the "Guardian v. Warrior" cop mentality as displayed in this past weekend's viral video of a pool party gone bad in suburban McKinney, TX.

Stoughton, who teaches criminal law and police regulation, analyzed the video for Talking Points Memo and explained what lessons might be learned from both the behavior of the helpful ("guardian") cops seen in the video and the other ("warrior") cop mentality as displayed by McKinney Officer Eric Casebolt who is seen inappropriately roughing up and threatening a number of African-American teens during the incident.

"Originally the warrior mindset referred to the mental tenacity, the sheer determination that an officer had to have to survive a life and death struggle," Stoughton tells me. "Now what we see, the warrior mindset refers to a more hyper-vigilant, often-aggressive approach to policing where everyone that the officer deals with is a potential threat."

But our discussion is much broader than all of that, as we talk about how these lessons apply to police everywhere in the U.S., whether the spate of recent videos of racist and/or rogue cops might actually be good news over all, and what are some steps that may improve things for everybody in the future.

Guest: Montana Commissioner of Political Practices Jonathan Motl...

Nebraska does it again! The majority-GOP state legislature overrides yet another veto by the state's GOP governor to do the right thing yet again, this time to allow the children of immigrants to obtain drivers' licenses. The latest move by Conservative legislators in the state comes on the heels of overriding vetoes and/or filibuster-proof majorities to protect voting rights, raise tax revenue to repair roads and bridges and ban the death penalty. (Today's news, by the way, was available last week to regular BradCast listeners, as it was hinted at quite directly on our show at the time by my guest that day, Republican state Sen. Al Davis.)

In the meantime, my guest on today's The BradCast is Montana's Commissioner of Political Practices John Motl. He explains the state's latest disturbing court battle to retain their long-standing caps on campaign donations. As noted during the show, this case could very well end up at the U.S. Supreme Court and serve to remove all caps on donations to candidates across the country. So it's very important. This in a state which recently saw SCOTUS gut it's 100-year old prohibition on corporate campaign spending (the Corrupt Practices Act of 1912) in the wake of Citizens United.

"We fully understand we are standing in on behalf of the average person," Motl tells me. "We're not standing here on behalf of the large moneyed interests. And we're willing to take that burden on." He adds that he's confident they will win this case. "If there's justice, we will prevail." I'm not quite as confident as he is, to be frank. Pay attention to this case.
