By Brad Friedman on 5/25/2013 3:15pm PT

After he was interrupted, several times, by CODEPINK founder Medea Benjamin during his foreign policy speech on Thursday, President Obama said: "The voice of that woman is worth paying attention to."

I agree with that part of his response, which was met with applause in the room. I rather liked the questions that Benjamin shouted out before and as she was eventually led out of the room. She offered a pretty well constructed set of thoughts and questions, particularly under the circumstances. And I'd love to hear the President's answers to a few of her questions.

Here's what she said, as well as I was able to capture her remarks from the video...

It's not Congress. It's you, sir. There are 102 people on a hunger strike [in the Guantanamo Bay prison]. These are desperate people. 86 have been cleared for release. You are Commander-in-Chief. You can close Guantanamo today. You can release those 86 prisoners today.
...
How about Abdulrahman al-Awlaki, a 16-year-old American killed by drones. Is that the way we treat a 16-year-old American? Why was he killed? Can you tell us why Abdulrahman al-Awlaki was killed?

Can you tell the Muslim people their lives are as precious as our lives? Can you take the drones out of the hands of the CIA? Can you stop the signature strikes that are killing people on the basis of suspicious activities? Will you apologize to the thousands of Muslims that you have killed? Will you compensate the innocent family victims? That will make us safer here at home.

I love my country! I love the rule of law! The drones are making us less safe. And keeping people in indefinite detention in Guantanamo is making us less safe. Abide by the rule of law. You're a Constitutional lawyer!

For the record, the President absolutely can release the 86 prisoners who have been cleared for release immediately, as Benjamin noted. He does not have to, as he likes to suggest, get approval from Congress to do that. He can release them immediately. He only needs Congressional approval to move prisoners (such as the ones who may actually face some sort of trial or military tribunal) to another prison on the U.S. mainland.

Despite his assertions to the contrary, as seen in the video below, Obama did not address the concerns of Benjamin. He did not explain why 16-year-old U.S. citizen Abdulrahman al-Awlaki was killed. He did not answer whether drone strikes would be taken out of the hands of the unaccountable CIA and given to the slightly-more-accountable military. He did not respond to the question about compensation to the families of innocent victims killed in drone strikes. He did not speak to whether "signature strikes" with drones (attacks based on profiles of those believed to be gathered at a particular location, rather than a specific person believed to be in the group) would be ended. He should address all of those issues.

Video of the section of his speech during which the President was interrupted several times by Benjamin --- remarkably, she was not removed the first several times --- and his responses to her, follows below...

By Brad Friedman on 5/1/2013 7:54pm PT

Yesterday, during his morning press conference, President Obama was asked by CBS' Bill Plante about the ongoing hunger strike by prisoners at Guantanamo Bay.

Obama's response: "Well, I think it is critical for us to understand that Guantanamo is not necessary to keep America safe. It is expensive. It is inefficient. It hurts us in terms of our international standing. It lessens cooperation with our allies on counterterrorism efforts. It is a recruitment tool for extremists. It needs to be closed."

He added that he was planning "to go back at" his effort to close the prison which was blocked back in 2009 by Congress.

But did he really mean any of it? I spoke with Truthout.org's investigative journalist Jason Leopold on the KPFK/Pacifica Radio BradCast about that very question today. Leopold has been covering Gitmo for a decade now, recently returned from a visit there and plans to be heading back soon.

The conversation was both enlightening and enraging, particularly given that, despite his suggestion to the contrary, Obama already has the ability to immediately free about half of the prisoners there who were cleared of all charges at least three years ago, if not longer. He could do it today...if he wanted to...or had the political courage to do it.

Also on this week's show, a bit of a rant on "blaming Bush"; the one woman who could have kept Dubya's disastrous reign from ever happening in the first place; a heads-up on the upcoming 100% unverifiable Special Election for the U.S. House in SC; some Green News with Desi Doyen; and, maybe, I decide to come out as both black and gay...But you'll have to tune in to find out if I do!

Many of the individuals who were swept up by last week's LAPD raid on the Occupy LA encampment at Los Angeles City Hall were arrested even as they attempted to disperse in accordance with police directives, according to testimonials from some who were detained in the early morning hours of November 30th and held on misdemeanor charges for days after.

Their videotaped testimonials [some of which are posted below] both corroborate and reinforce the excessive force and post-arrest abuse charges detailed in our previous article on the Occupy LA raid, in which detainees charged that they were hand-cuffed behind their backs and left to languish inside L.A. County Sheriff's Department (LASD) buses for eight to nine hours without access to food, water, medicine, or toilets as they were left to urinate on themselves in their seats.

The details also suggest that these conditions were imposed upon innocent demonstrators who were the victims of indiscriminate, false arrests by law enforcement officials. Worse, one written account suggests the LAPD's misconduct included not only pillaging the encampment and police brutality, but even torture...

Attorneys charge abuse of process, duplicity, public vilification
Shades of infamous McMartin Preschool trial, 'sex crime' fiasco...
By Ernest A. Canning on 1/13/2011 8:24pm PT

Guest blogged by Ernest A. Canning

As the corporate media weighed in on the Jan. 11 decision to postpone a hearing on the Swedish request that the U.K. extradite WikiLeaks' spokesperson Julian Assange until Feb. 7, Assange's U.K. legal team filed a powerful, preliminary legal brief.

The Assange brief, citing extensive legal authority, not only sets forth why extradition will not lie merely for the purpose of questioning someone who has yet to be even been charged with a crime, but affirmatively alleges an abuse of process that includes duplicity:

  • on the part of Swedish prosecutors in releasing Assange's name to the press as a suspect in a rape inquiry in violation of Swedish law;
  • in disingenuously asserting that Assange must be extradited for questioning, when such questioning could be, as repeatedly offered, conducted in the U.K. under established international procedures;
  • in informing the Australian Ambassador that the evidence against Assange could not be released, even while granting a newspaper unauthorized access to the the prosecutor's files;
  • and in refusing to release documents which severely undercut the veracity of the case the Swedish prosecutors presented to the press and in their European Arrest Warrant ("EAW").

This latter allegation calls to mind the infamous McMartin Preschool Trial and the horrific and irreparable harm that can be wrought when irresponsible media fan public hysteria by joining in a public vilification that assumes, as true, volatile allegations of sex crimes.

The brief, citing Sweden's past role in facilitating the Bush regime's extraordinary rendition requests which led to torture, ends with concerns that Sweden's request to extradite Assange is a sham intended to facilitate his unlawful rendition to the U.S. for placement in Guantanamo, or worse...

By Ernest A. Canning on 8/13/2010 8:45pm PT

Guest Editorial by Ernest A. Canning

Sorry, Mr. Gibbs, but your description of a "professional left" whose critiques of your boss, President Barack Obama, should be disregarded as the "crazy" musings of "people who ought to be drug tested" reflects that you are both authoritarian and out-of-touch.

The vast majority of citizens who supported the President in 2008 favor positions on policies that are far more progressive than anything which has emerged from either the corporate-controlled Democratic "leadership" in Congress or the Obama White House. The majority of Americans are by no means obligated to ignore the "democracy deficit" or the betrayal of the President's promise to bring "change we can believe in."

While one can readily agree that many of the Obama administration's policies are an improvement over those which are advanced by the reactionary fascist billionaires, and their mindless "Tea Party" followers, there are many instances in which the policies of the current administration threaten more harm than those of its predecessor. E.g,, those documented by a recent ACLU report (see Democracy Now video below) in which the current administration has created policies that may "enshrine permanently within the law policies and practices that were widely considered extreme and unlawful during the Bush administration."

Perhaps most disturbing is that the President's zeal to please his true constituency --- corporate America, Wall Street and the military-industrial complex --- comes from the same Presidential candidate whose soaring and lofty, yet deceptive campaign rhetoric gave rise to hope in so many that Election Day 2008 would mark a return to economic fairness, transparency, a restoration of the rule of law, an end to the fear-driven perpetual "war on terror," and a restoration of nature's ecological balance.

The title of Studs Turkel's powerful book is Hope Dies Last.

Even during the darkest days of the Bush/Cheney cabal, there was the hope that the foundering American ship of state could be righted by way of the electoral process. By raising the hopes of the American people during the course of the 2008 campaign, only to dash those hopes by betraying his own rhetoric, President Obama has, in some measure, caused more harm than the Bush/Cheney regime...

Says 'evidence overwhelming' they 'participated in criminal conspiracies to violate federal law and guaranteed civil liberties of hundreds, maybe thousands of human beings'...
By Brad Friedman on 7/12/2010 4:17pm PT

Wow. Seriously. Just...really...Wow.

Fox "News" analyst and former NJ Superior Court Judge Andrew Napolitano was featured on a segment of C-Span's BookTV over the weekend, to discuss his book, Lies the Government Told You: Myth, Power, and Deception in American History.

While being interviewed by Ralph Nader, Napolitano says what Bush and Cheney did while in office was "blatantly unconstitutional, and in some cases criminal."

When asked by Nader what the consequences should be, the judge says, in no uncertain terms: "They should have been indicted! They absolutely should have been indicted! For torturing, for spying, for arresting without warrant."

Wow. Guess his contract on Fox must be up. If it wasn't, we suspect it is now. The text transcript and video --- with Napolitano explaining that the "evidence...is overwhelming" that Bush and Cheney "participated in criminal conspiracies to violate the federal law and the guaranteed civil liberties of hundreds, maybe thousands of human beings --- follows below. A Thanksgiving Day Open Thread...

[Hat-tip Sibel Edmonds, for whom we are always thankful.]

And while things are decidedly imperfect this year, we remain thankful nonetheless that, unlike last year, these are not the photos we are forced to see on our Thanksgiving open thread this year.

Mostly, we are ever thankful for those of you who share your time, generosity, goodwill, feedback, tips, thoughts and well wishes with us here at The BRAD BLOG, even as you continue to spread the word and keep fighting the good fight however, whenever and wherever you can.

And what do you find yourselves thankful for this year?...

From the sub-title used with the LATimes story over the weekend about AG Eric Holder's long-rumored, now reportedly "all but certain" plan to appoint a special prosecutor to examine torture during the Bush Adminstration:

Insiders say Atty. Gen. Eric Holder is close to naming a prosecutor to look into reports of excessive waterboarding and other unauthorized methods.

So non-"excessive waterboarding" is now legal?

The Bureaucratic Euphemism of 'Extraordinary Rendition'...
By Ernest A. Canning on 7/14/2009 3:54pm PT

Guest Blogged by Ernest A. Canning
Part IV of a Five-Part Special Series
(Part I is here. Part II is here. Part III is here. Part V is now here.)

"We pick up a suspect or we arrange for one of our partner countries to do it. Then the suspect is placed on a civilian transport to a third country where, let’s make no bones about it, they use torture. If you want a good interrogation, you send someone to Jordan. If you want them to be killed, you send them to Egypt or Syria. Either way, the US cannot be blamed as it is not doing the work." - Former CIA officer Robert Baer [PDF]

In Part I of this now-five part series, I took care to distinguish the post-9/11 application of torture techniques by the U.S. military from the role played by the CIA and demonstrated how the Bush/Cheney decision to torture predated the quasi-legal Justice Department memos. In Part II, I covered the CIA's dark beginnings, including links not only to former Nazi war criminals but to those Americans who provided financial support to Hitler's Germany, including the late Senator Prescott Bush, George W's paternal grandfather. I also demonstrated how academic studies, performed as part of the CIA's maniacal quest to crack the code of human consciousness, culminated in KUBARK, the CIA's 1963 torture manual. In Part III, I showed how the KUBARK torture techniques, applied by US-trained foreign surrogates, became an essential component of the covert dimension of a US-led corporate Empire --- a means for exerting control over populations resistant to the injustice of a system that values the obscene wealth of a few over the needs of the many.

I had intended this to be the final chapter of a Four-Part Special Series, but length, complexity and new revelations necessitate further division into Parts IV & V.

Here, I will explore the arrogant application of overseas surrogate torture through "extraordinary rendition." The direct application of KUBARK techniques to a "floating population" of "ghost detainees" at CIA black sites will be covered in Part V. In both segments, I will demonstrate how torture was applied not to protect the American people but to help produce doctored intelligence that would provide cover for imperial conquest. I will end with the disturbing yet still unresolved questions as to how many victims of the Bush/Cheney torture regime remain amongst "the disappeared;" how many of those victims are now deceased...

Mohammed El-Gharani, captured at fourteen, mistreated by captors, never charged in over seven years, finally going home...
By Brad Friedman on 6/11/2009 5:20pm PT

Remember, these are 'the worst of the worst,' right?

Mohammed El-Gharani, the youngest prisoner at Gitmo, just 14 when he was captured in 2001, is finally being "freed five months after a U.S. federal judge ordered him released having reviewed the evidence against him and ruled that there was nothing to suggest he was ever an 'enemy combatant.'" El-Gharani has never been charged.

Andy Worthington, the man who literally wrote the book on the Guantanamo travesties, offers the sad background on the breaking news of the release of “Guantánamo’s Forgotten Child,” including details of alleged abuse such as being hanged by his wrists, and scissors held to his penis with threats of cutting it off. But we're supposed to look forward, not back, right?...

Guest Editorial by Sibel Edmonds

"In politics we presume that everyone who knows how to get votes knows how to administer a city or a state. When we are ill...we do not ask for the handsomest physician, or the most eloquent one." --- Plato

During the campaign, amid their state of elation, many disregarded Presidential Candidate Senator Barack Obama's past record and took any criticism of these past actions as partisan attacks deserving equally partisan counterattacks. Some continued their reluctant support after candidate Obama became grand finalist and prayed for the best. And a few still continue their rationalizing and defense, with illogical excuses such as 'He's been in office for only 20 days, give the man a break!' and 'He's had only 50 days in office, give him a chance!' and currently, 'be reasonable - how much can a man do in 120 days?!' I am going to give this logic, or lack of, a slight spicing of reason, then, turn it around, and present it as: If 'the man' can do this much astounding damage, whether to our civil liberties, or to our notion of democracy, or to government integrity, in 'only' 120 days, may God help us with the next [(4 X 365) - 120] days.

I know there are those who have been tackling President Obama's changes on change; they have been challenging his flipping, or rather flopping, on issues central to getting him elected. While some have been covering the changes comprehensively, others have been running right and left like headless chickens in the field - pick one hypocrisy, scream a bit, then move on to the next outrageous flop, the same, and then to the next, basically, looking and treating this entire mosaic one piece at a time.

Despite all the promises Mr. Obama made during his campaign, especially on those issues that were absolutely central to those whose support he garnered, so far the President of Change has followed in the footsteps of his predecessor. Not only that, his administration has made it clear that they intend to continue this trend. Some call it a major betrayal. Can we go so far as to call it a 'swindling of the voters'?

On the State Secrets Privilege

Yes, I am going to begin with the issue of State Secrets Privilege; because I was the first recipient of this 'privilege' during the now gone Administration;

Component of Empire, Distance through Surrogates & Reagan's Duplicity...

Guest Blogged by Ernest A. Canning
Part III of a Five-Part Special Series
(Part I is here. Part II is here. Part IV is now here. Part V is now here.)

"The widespread abuse of prisoners is a virtually foolproof indication that politicians are trying to impose a system --- whether political, religious or economic --- that is rejected by large numbers of people they are ruling. Just as ecologists define ecosystems by the presence of certain 'indicator species'..., torture is an indicator species of a regime that is engaged in a deeply anti-democratic project, even if that regime happens to have come to power through elections." - Naomi Klein, The Shock Doctrine (2007)

In Part I of this five-part series, I took care to distinguish the post-9/11 application of torture techniques by the U.S. military from the role played by the CIA and demonstrated how the Bush/Cheney decision to torture predated the quasi-legal Justice Department memos.
