Guest: Legal reporter Mark Joseph Stern of Slate...
By Brad Friedman on 9/29/2017 5:58pm PT

On today's BradCast: Trouble in TrumpLand continues, but we're all paying the price for it --- and likely will for decades to come. [Audio link to show follows below.]

Donald Trump's Secretary of Health and Human Services, Tom Price is out. He’s just the latest top Administration official to be fired or to resign during the first eight chaotic months of this Administration. Price, who claimed to be a fiscal conservative during his years in the U.S. House, had come under fire for spending hundreds of thousands of tax-payer dollars on chartered private and military plane travel since taking office, even while working to take health care away from millions of Americans. Several other top Trump cabinet officials (EPA’s Pruitt, Treasury’s Mnuchin, Interior’s Zinke) are also now under the spotlight for similar travel issues, even though Price's corruption, while in the U.S. House, was an open secret completely ignored by the GOP Senate during his confirmation.

Meanwhile, in Puerto Rico, the situation on the ground following Hurricane Maria continues to deteriorate, despite Trump and his Acting Director of the Dept. of Homeland Security declaring the recovery effort "a good news story", to date. The Mayor of San Juan urgently and desperately disagrees.

Then, speaking of U.S. Senate Republicans rubber-stamping Presidential nominees no matter how extremist, crazy or corrupt they may be, we're joined by Slate's legal reporter MARK JOSEPH STERN to discuss what he describes as the Trump Administration's attempt to lay the groundwork for overturning marriage equality. Yes, really.

While it seems impossible to imagine, Stern makes his case --- a disturbing one --- after we discuss whether a High School principal in Louisiana has the legal right, as threatened, to suspend student football players for taking a knee in peaceful protest during the national anthem.

The letter sent this week to students and parents by Parkway High School's Wayne Bates "made my jaw drop to the floor," Stern says, going on to detail well-established SCOTUS rulings on the First Amendment in schools. “You just can't do that. Students have a fundamental free speech right to take a knee during the anthem. And if this principal goes any farther with this crazy campaign, he's gonna get slapped with a lawsuit that is going to make his hair fall out.”

But, how interested are Trump’s judicial appointees in maintaining “settled” law? Stern warns that with some of Trump’s lifetime appointees still likely to still be serving on the federal bench as late as 2067, a long list of extreme Rightwingers now been confirmed by Senate Republicans, same-sex marriage rights are not nearly as secure as many of us may think.

“Republicans are completely ruthless in their endeavor to stack the court with wackadoodles,” he says. “And Democrats need to get their act together, or the world is going to be incredibly bleak in 2067 --- so bleak that Trump judges may be the least of our problems.”

Finally, Stern has a few choice thoughts on the unapologetic rightwing extremism of illegitimate Supreme Court Justice Neil Gorsuch, as the Court returns for its first full new term with a stolen Republican majority...

Plus: Trump deflects on Puerto Rico disaster; DHS wrong on 'Russia hacking'; Callers ring in on all of that and more...
By Brad Friedman on 9/28/2017 5:59pm PT

On today's BradCast, we open the phone to callers to discuss another very busy news week, though most want to talk about election integrity. That's good. [Audio link to show follows below.]

Among the stories we cover before we get to listener calls: The Trump Administration is blocking members of Congress --- both Democratic and Republican --- from taking military flights down to Puerto Rico, for some reason, where the disaster for 3.5 million U.S. citizens following Hurricane Maria is said to be quickly deteriorating. Meanwhile, Trump continues to sing his own praises for his handling of the disaster, while using his Twitter account to tweet about the NFL instead of offering help or support for the storm victims.

Then, the state of Wisconsin finally decertifies its terrible, two-decade old Optech Eagle paper ballot tabulators which will only read marks in pencil (not pen). That, despite many WI municipalities which used those same machines to both tally and then 'recount' the 2016 Presidential election, rather than ever count ballots by hand. Those machines may well be replaced by 100% unverifiable touch-screen systems. Also, though the U.S. Dept. of Homeland Security informed the state late last week that Russia attempted to hack their voting system last year, it turns out DHS now admits has no such evidence.

Here in California, where DHS told the state the same thing last week (and apparently got it wrong there as well), Democrats in the state assembly recently passed a bill, AB-840, that will make stealing elections easier, by removing nearly half of the ballots cast from the state's 1% post-election hand 'audit'. Governor Jerry Brown (D) is now deciding whether to sign the bill, which election integrity advocates and voting system experts are begging him to veto instead, describing AB-840 as a "roadmap to fraud". You can contact the Governor with your opinion on whether he should sign or veto right here.

Callers ring in on all of that today, and challenge me on a point or two regarding voting and election fraud, before Desi Doyen joins us for the latest Green News Report, on the rapidly devolving humanitarian crisis in Puerto Rico, and even some good news about coal for the Pacific Northwest (and for all of us, in truth)...

Guest: Mikey Weinstein of the Military Religious Freedom Foundation; Also: U.S. Military brass confirm Iran nuke deal compliance; And Tuesday's Special Election results cause shock-waves...
By Brad Friedman on 9/27/2017 6:08pm PT

Buckle up for today's BradCast. It's a humdinger, from first to last. [Audio link to show follows below.]

First up: In written testimony this week to the U.S. Senate, Gen. Joseph Dunford, the Chairman of the U.S. Military's Joint Chiefs of Staff, agreed with Donald Trump's Sec. of State Rex Tillerson and European diplomats that Iran was in compliance with the 2015 anti-nuclear agreement between Iran, the U.S., Russia, China, France, Britain and Germany. He also argued that, in lieu of a breach of the treaty, pulling out of it, as Trump has continually threatened, would provide a disincentive for other nations, like North Korea, to enter any such agreements with the U.S. Also, Iran's Foreign Minister blasted the U.S. President today for tweeting fake news over the weekend charging they had test-launched an intercontinental missile.

Next: It was Special Election Day on Tuesday in several states and, once again, Democrats continued to pick up state legislative seats previously held by Republicans. They've now notched eight such wins (in FL, NY, NH and OK) since last November, while the GOP has failed to take over any Democratic held seats in 2017. At the same time, Alabama's far-right religious extremist Roy Moore --- who was twice removed as a Justice from the state's Supreme Court for violations of law, the Constitution and federal court orders (regarding the Ten Commandments and Marriage Equality) --- defeated Trump's endorsed candidate Sen. Luther Strange in Alabama's Republican Primary Runoff election to fill the U.S. Senate seat vacated by U.S. Attorney General Jeff Sessions. The win by an openly homophobic and Islamophobic candidate has led to shock-waves for establishment Republicans, deleted tweets by Trump, and questions for Dems as to whether their candidate, former U.S. Attorney Doug Jones, might have a shot at picking up the U.S. Senate seat in the deeply "red" state in this December's general election.

Finally: Speaking of radical religious extremists who place their personal religious beliefs above protecting and defending the U.S. Constitution, we're joined by the indefatigable founder of the Military Religious Freedom Foundation, MIKEY WEINSTEIN, to discuss a U.S. Air Force Reserve Chaplain who appears to be doing exactly that. Weinstein, a registered Republican and former White House legal counsel for Ronald Reagan, details his group's legal complaints against Capt. Sonny Hernandez (pictured above), whose recent writings declare that Christian service members who support the Constitutional rights of those who follow other religions are, in fact, tools of Satan. Yes, really.

In a recent article, for example, headlined "Christian Service Members: Avoid Supporting or Accommodating Evil!", Hernandez writes that "Christian service members who openly profess and support the rights of Muslims, Buddhists, and all other anti-Christian worldviews to practice their religions --- because the language in the Constitution permits --- are grossly in error, and deceived." He goes on to charge that "Counterfeit Christians in the Armed forces will appeal to the Constitution, and not Christ," which, he writes, "will lead them to hell."

Weinstein, whose group offers legal representation for thousands of clients in the military, predicts that, despite the Air Force Inspector General's current investigation of Hernandez, he will likely be promoted from Captain to Major, rather than being "administratively discharged and, if possible, court-martialed."

"When you write, on a Christian Nationalist blog, a column telling military people 'you better not be showing respect to people that don't follow my particular version of Christianity...because of this silly thing called the Constitution, you are not only erroneous but you are stirring the dark evil of Mephistopheles --- Satan,' and you're writing it to the military community, it's beyond unconscionable. From our perspective it's actionable under the Uniform Code of Military Justice."

As Weinstein details during our conversation today about Hernandez, who he describes as an "anti-Semitic, homophobic, misogynistic, Constitution-hating individual," the military has attempted to come to his defense, which Weinstein characterizes as "a kill-shot to the head with regard to stupidity by the Air Force, or willful ignorance." Nonetheless, he explains that Hernandez is hardly the only one in the U.S. military violating their sworn oath to protect the Constitution in such a way. Weinstein charges that the problem of theocratic "Dominionism" --- "which is an attempt to try to replace our democracy with this weaponized version of Christianity" --- has exploded in the U.S. Armed Forces following Trump's inauguration, and already far outpaces the same concerns that led to the formation of MRFF during the George W. Bush Administration.

I can't possibly do full justice to the impassioned case that the extremely colorful Weinstein offers on today's show here, (he also rings in on Trump's national anthem "controversy" and much more), so please tune in for this one, if you can...

By Ernest A. Canning on 9/25/2017 10:25am PT

"Some men see things as they are, and ask why. I dream of things that never were, and ask why not." - Sen. Robert F. Kennedy, 1968

It is really of no moment whether or not the mainstream media was correct when it proclaimed that "Medicare-for-All" will be "dead-on-arrival in a Republican-controlled Congress."

Politically, the decision by Sen. Bernie Sanders (I-VT), together with 16 co-sponsoring Democratic Senators, to introduce a new "Medicare-for All", single-payer healthcare bill, must be seen as a stroke of political genius --- a strategy that could provide a path to securing Democratic majorities in both Houses of Congress as a result of the 2018 midterm elections.

Most Americans, including the author, thought the national trauma occasioned by "repeal and replace" ended on July 28 with the dramatic thumb down presented by Sen. John McCain (R-AZ). But, alas, like a zombie, another monstrosity --- the Graham-Cassidy-Heller-Johnson ACA repeal bill --- has arisen from the crypt of its legislative graveyard. And this time, the desperate hope was to move so swiftly that the Congressional Budget Office (CBO) will not have time to score it.

According to the Center for American Progress, Graham-Cassidy would not only add 32 million to the ranks of the uninsured but create huge premium surcharges for pre-existing conditions, ranging from $17,320 for pregnancy to $142,650 for metastatic cancer.

Republican willingness, indeed outright audacity, to repeatedly bring back a legislative obscenity that elicits as little as 12% support amongst the American electorate, is, in part, reflective of the tactically flawed strategies of their Democratic opposition.

Tactically, with the 2018 midterms on the horizon, the introduction of a "Medicare-for-All" --- a single-payer healthcare bill that by every objective measure is vastly superior to our existing corrupt, inefficient, dysfunctional and deadly government-subsidized, "free market" system --- has the potential to be a game changer, especially if the latest "repeal and replace" measure somehow defies the momentary odds and succeeds...

Callers ring in on Donald Trump and Kim Jong Un; Also: Is the GOP ObamaCare 'repeal' finally dead?...
By Brad Friedman on 9/22/2017 5:51pm PT

On today's BradCast, we open the phone lines to callers, mainly on the Donald Trump v. Kim Jong Un madness that may get us all killed. [Audio link to full show follows below.]

As you'll recall, in an unprecedented speech by a U.S. President, Trump called Kim "Rocket Man" and threatened to "totally destroy North Korea" at the United Nations General Assembly.

That, as reported today, was apparently a surprise even to Trump's top officials, who are said to have "warned him not to deliver a personal attack on North Korea’s leader at the United Nations." In turn, North Korea said they are considering a test of a hydrogen bomb above and the Pacific, and Kim issued an unprecedented first-person response, describing Trump as a "mentally deranged dotard". Trump answered back via Twitter (naturally), calling Kim a "madman". But the school yard bully act by both is far more complicated, nuanced and, yes, dangerous, as revealed in part by the full statement from Kim, which we share today.

Then, Sen. John McCain now says he's a "no" on the last-gasp desperate efforts by Senate Republicans to gut the Affordable Care Act with the wildly unpopular Graham-Cassidy-Heller-Johnson amendment, that would take hundreds of billions away from federal health care, and result in loss of coverage for at least 21 million Americans. Does McCain's announcement finally signal the end for the GOP's zombie-like attempt to '"repeal and replace" ObamaCare? Don't count your chickens just yet.

Also today: breaking news on the Guajataca Dam in Puerto Rico that is now reportedly failing following Hurricane Maria, and threatening tens of thousands already struggling without power in the wake of the record storm; and a 30-year old reminder from then UK Prime Minister Margaret Thatcher, of all people, that, yes, the nations of the world can come together to save the planet in the fight against deadly emissions.

Callers ring in today on all of that and more (and even on NASA's totally "fake" moon landing!) in a very lively, and occasionally chilling, BradCast...

Guest: Investigative journalist Rachel Leven | Also: Catastrophic Hurricane Maria in Puerto Rico, 7.1 M earthquake in Mexico...
By Brad Friedman on 9/20/2017 6:13pm PT

We shine a spotlight on a whole lot of hypocrisy --- both corporate and political --- on today's BradCast. [Audio link to show follows below.]

But first, we begin with the seeming unending string of natural disasters slamming North America of late. After a quick riposte from French President Emmanuel Macron in response to U.S. President Donald Trump's failure at the U.N. General Assembly to mention "climate change" or his withdraw from the Paris Climate Agreement on Tuesday --- even as yet another Category 5 hurricane was about to slam the U.S. --- we cover the latest on several ongoing disasters. In Mexico, hundreds are dead and as many as a thousand still unaccounted for following Tuesday's catastrophic earthquake. And, in Puerto Rico, the power is out across the entire island after the record winds and rain of Hurricane Maria slammed ashore early on Wednesday, putting some 3.5 million U.S. citizens in dire danger.

Then, amidst all of that, Republicans continue their last ditch frantic attempt to repeal and replace ObamaCare before a deadline will make it much more difficult to do so at the end of the month. That, despite the Affordable Care Act's continuing success in helping to provide medical care to tens of millions of Americans, and the fact that the latest GOP repeal scheme will seriously hurt those in both 'red' and 'blue' states with enormous cuts to health care funding and the gutting of many long-sought protections offered by the Affordable Care Act.

Most galling, perhaps, is the hypocrisy of Republican U.S. Sen. Bill Cassidy of Louisiana (pictured above), one of the new bill's lead sponsors and a doctor himself. Cassidy had publicly promised, during the last round of GOP attempts to gut ObamaCare, that he would vote against any scheme that did not pass what he dubbed at the time as "The Jimmy Kimmel Test". That was a reference to the touching story regarding the late night comedian's son who was born with congenital heart disease during the previous attempts by Republicans to kill the ACA earlier this year.

On Tuesday night, at the top of his show, Kimmel offered a sharp and very well-informed response to Cassidy's hypocrisy. We share that accurate response on today's show.

Finally, speaking of remarkable hypocrisy, we're joined by investigative journalist RACHEL LEVEN of The Center for Public Integrity to discuss her new exposé this week, with Jamie Smith Hopkins, documenting dozens of major U.S. corporations --- from Google to eBay to Walmart to Coca-Cola to General Electric and more --- who publicly declared their "opposition" to Trump's withdrawal from the Paris Climate Agreement, even while those very same companies invested millions of dollars in a Republican political group leading the fight to kill the Obama plan meant to meet the emissions reduction standards under the landmark global pact...

Guest: Former Asst. U.S. Attorney Randall D. Eliason of George Washington University; Hurricane Maria on Irma's path of destruction...
By Brad Friedman on 9/18/2017 6:17pm PT

On today's BradCast, Here come more hurricanes, political and otherwise. [Audio link to show is posted below.]

Hurricane Maria, on a similar path to the devastating Hurricane Irma just over a week ago, has now strengthened to a deadly Category 4 before its projected landfall on many of the same Caribbean islands still reeling from Irma. But Maria is hardly the only storm swirling right now in the Atlantic and the Pacific (including Jose, Norma, Lee and Otis!).

Then, while Republicans and so-called "conservatives" last week pretended to be furious about the suggestion that Trump was working out an agreement with Democrats to protect some 800,000 kids of undocumented immigrants --- previously protected by DACA until Trump reversed it --- from deportation, in exchange for non-Border Wall border security, it turns out they're not all that angry after all. Evidence to support that argument --- along with the GOP's stated intention to balloon the national debt with massive new tax cuts and military spending --- underscores, yet again, that Republicans, like their President, have no real ideology, other than saying and doing what they believe is necessary to stay in power.

Yes, even anti-immigration zealot Rep. Steve King (R-IA) who claimed, after the deal between Dems and Trump was made public last week, that Trump's base was "blown up, destroyed, irreparable, and disillusioned beyond repair," said over the weekend that he was "gonna stick with President Trump".

Speaking of a lack of "convictions" (pun intended there), we're then joined by former Asst. U.S. Attorney RANDALL D. ELIASON, now a blogger and professor of law at George Washington University, to explain the ongoing corruption trial of sitting U.S. Senator Bob Menendez (D-NJ). Given the recent constraints the U.S. Supreme Court has placed on charges of bribery and public corruption by officials (see SCOTUS' dismissal last year of the guilty convictions against Republican Virginia Gov. Bob McDonnell and the limits on quid pro quo political bribery detailed by Citizens United and related rulings), can prosecutors successfully make charges stick against Menendez, who is charged with a number of felony counts relating to taking a huge amount of "gifts" from a physician friend, allegedly in exchange for "official acts" by the Senator.

"It's basically an exchange for these luxury trips, and jet trips, and pretty large political donations over the years, that Senator Menendez was working on these various things on Dr. Melgen's behalf," according to federal prosecutors, explains Eliason. "What the government has to prove is that there was a corrupt link between the two, that it was because of the gifts that the Senator was doing this."

Eliason, who headed up the Public Corruption/Government Fraud section at the U.S. Attorney's District of Columbia office for many years, walks us through the legal weeds of the case, which has received shockingly little attention in the corporate media, as storms --- both political and climatic --- have sucked up a lot of press attention in recent weeks.

And, though the investigation into Menendez was begun under Obama (on the heels of a completely fake news story, published by a Rightwing "news" outlet), are there any lessons we may take from this prosecution as it relates to potential charges being investigated against Team Trump? As it turns out, there are, as the always-insightful Eliason details today.

Finally, Trump's Homeland Security Advisor H.R. McMaster claimed over the weekend that Trump might be willing to rejoin the Paris Climate Agreement, but only if the there were better terms for the U.S. Our own Desi Doyen has a thought or two in response to that claim...

Among the many stories covered on today program:

  • First, some good news (before everything else goes to hell), a federal court blocks Attorney General Jeff Sessions' attempt to withhold DoJ funding from so-called "sanctuary cities";
  • North Korea's latest missile test bodes ominously, but there is a potential way to avoid war, if officials are smart enough to use it;
  • Another terror attack in London today and, as Scotland Yard and Prime Minister Theresa May described it, Trump's very "unhelpful" response to it;
  • Speaking of terror, Donald Trump is very quick to comment on alleged Muslim terror attacks, but both he (and the corporate media) are very good at ignoring and/or downplaying domestic acts of terror by white people with guns, including a deadly high school shooting this week in suburban Washington and one of the worst mass murders in a decade this week in suburban Texas.
  • The growing cost to the U.S. economy of Harvey, Irma and other increasingly intense storms (another may hit the U.S. in the coming week) --- and the ever-increasing costs of ignoring climate change altogether;
  • More on the massive Equifax hack;
  • Hundreds of thousands of voter files left unprotected online (again), this time in Alaska;
  • The election office in Ohio largest county, with voted ballots inside, was discovered completely unlocked and vacant, just days before a municipal election;
  • Both bad and good news out of the California state legislature, including the success of a Dem-supported bill (AB 840) that will make election fraud easier to carry out by keeping nearly 40% of the state's ballots from being subject to any post-election hand "audits" (if you're in the state, feel free to contact Gov. Jerry Brown to ask him to veto it!) and the passage of a different bill that Donald Trump won't like at all;

And, finally today, a few pieces of listener mail, also both good and bad, at the end of another insane week in these United States...

Guest: Gaius Publius of 'Down With Tyranny'; And another hurricane over Mexico, another North Korean missile over Japan...
By Brad Friedman on 9/14/2017 5:45pm PT

On today's BradCast: The Art of the Scammer; the Equifax outrage, and Dems work to win back the populist Left. [Audio link to show follows below.]

Donald Trump is working very hard to have it both ways since reversing Barack Obama's Executive Order last week on Deferred Action for Childhood Arrivals (or DACA). The program had served to protect some 800,000 children of undocumented immigrants, brought here through no fault of their own, from deportation. On Wednesday night, following dinner with the President, Democratic Congressional leaders Sen. Chuck Schumer and Rep. Nancy Pelosi announced they had struck an agreement with Trump to pass DACA legislatively, in exchange for more border security, as long as it didn't include Trump's long-promised border wall with Mexico.

Trump has been flip-flopping and flop-flipping on that reported deal ever since, pretending that his wall is already being built, and trying to otherwise appease his angry(ish) base at the same time he's apparently trying to close a deal with both Democratic and Republican leadership in Congress.

Then, we're joined by blogger GAIUS PUBLIUS to discuss his coverage of last week's massive Equifax data breach, including what you can and should do to protect yourself in its wake, and whether the massive credit monitoring firm will face any accountability at all for what they did to help cause --- and cover up --- the hack which reportedly exposed the personal information of some 143 million Americans.

We also discuss Sen. Bernie Sanders' single-payer "Medicare-for-All" health care bill, introduced in the U.S. Senate this week, with the co-sponsorship of some 16 Senate Democrats, many of whom are thought to be 2020 Presidential contenders. What does the sudden popularity of "Medicare-for-All" in both the U.S. Senate and House signal for Democrats? And will their tepid steps towards economic populism help turn the tide for them at the national level in 2018 and 2020?

Finally, Desi Doyen joins us for the latest Green News Report, on the long tail of catastrophic devastation left behind by Hurricanes Irma and Harvey. And, as if all of that isn't enough, also today: Yet another hurricane comes ashore in Mexico (their second in the past week), and North Korea launches another ballistic missile over Japan...

Guest: Disaster historian Dr. Scott Knowles of Drexel University...
By Brad Friedman on 9/11/2017 6:13pm PT

On today's BradCast: The latest on our nation's quickly piling up megadisasters, what we need to do about them, what we should have done long ago, and why we haven't. [Audio link to full show follows below.]

First up today: A quick overview of Irma's disastrous weekend course as a massive and deadly hurricane which lashed the entire state of Florida. Now, disaster recovery is under way as power remains out for millions, and the storm continues wreaking havoc in that state, as well as Georgia, South Carolina, Alabama and elsewhere as a dangerous tropical storm.

This latest storm has been playing out on the heels of Hurricane Harvey in Texas and Louisiana along with a number of other contemporaneous and ongoing natural disasters. So, naturally, Donald Trump over the weekend called for "speeding up" massive tax cuts that he and Republicans have long been promising. But, if taxes are slashed, who, and what, is going to pay for the likely-record disaster relief funding that will now be needed, not to mention the infrastructure upgrades that are long overdue in the storm areas, as well as across the U.S. --- particularly as we face a quickly changing climate?

We're joined today for a fascinating interview with DR. SCOTT KNOWLES, disaster historian (who knew there was such a thing?), at Drexel University's Center for Science, Technology and Science, to help put the costs of the one-two punch of Harvey and Irma into historical perspective, to discuss what lessons must be learned from those two record storms, what lessons we should have learned long ago and, frankly, why it is that we haven't learned those lessons by now, given what once was a robust U.S. government effort at disaster research and infrastructure management.

There is a lot of ground covered in my conversation with Knowles, author of The Disaster Experts: Mastering Risk in Modern America, today. Please give it a listen in full below. But, I'll quickly share just one or two of his thoughts to hopefully whet your appetite. Following massive deadly floods and fires in the 18th and 19th century, he explains, there was a largely successful effort to avoid those catastrophic and deadly events by local, state and federal officials in the world's wealthiest nation. That post-WWII effort, however, began to change in recent decades. And, with the worsening of our climate crisis, the "deferred maintenance" of our infrastructure and reduced environmental regulations, the still-prevalent notion that government needs to be scaled back in every way, couldn't have come at a worse time for the nation and the planet.

"We're able now more accurately to trace back the causes of these disasters to historical decisions that have been made since World War 2," Knowles explains. "Where we live, how we live, how we write our building codes, what we choose to spend our money on and not spend money on. Those are traceable historical pathways.

"One would have thought we could've had national standards for safety by now," he tells me. "I think this is the core of what we're really arguing about now. Can we make a national commitment to safety from disaster? If we can't, then I think we've really let down what Americans expect out of science, and government, and infrastructure and engineering, and all other things that we rely on every day."

As to climate change itself, and the need to act on the "settled science" that Republicans continue to ignore at our peril --- Trump's EPA Administrator Scott Pruitt recently said, that now is not the time to discuss such things --- Knowles argues: "These are the moments when people are attuned. This is when you have their attention. I don't think it's disrespectful to people who are suffering to raise the cause of their suffering into political light at these moments. In fact, I think it does them a service. And that's why so many of my colleagues who do this work do that"...

Guest: Radio host Nicole Sandler in South Florida...
By Brad Friedman on 9/8/2017 6:15pm PT

On today's BradCast: How government subsidized lies and liars are killing the nation, the planet, and U.S. democracy. [Audio link to show follows below.]

With more than a thousand dead from monsoons in South Asia, two monster hurricanes in the Atlantic, one of them about to engulf Florida, a third one in the Gulf striking Mexico and Houston struggling to rebuild from unprecedented flooding after Harvey, a magnitude 8.1 earthquake struck off the coast of Mexico late Thursday night, killing more than 60 and leading one wise Twitterer to observe: "All that's missing is the locusts."

On today's show (after once again marveling at Ronald Reagan's greatest, and most damaging, cons --- particularly pungent on a day like today), we check in with our friend NICOLE SANDLER, host of The Nicole Sandler Show, just north of Miami, as she and her family, unable to evacuate, are preparing to hunker down before Hurricane Irma rolls ashore and then up the entire length of the state.

Other radio hosts in the South Florida area, like con-man Rush Limbaugh, are apparently lucky and wealthy enough to be able to evacuate at the last moment before the record hurricane strikes, even after spending the week downplaying the threat of the Category 5 monster and the last several decades downplaying the threat of climate change by disinforming tens of millions of Americans about it over our tax-payer owned public airwaves.

Then, speaking of tax-payer funded disinformation, the head of Trump's so-called "Election Integrity" Commission, Kansas Sec. of State Kris Kobach, has built his career on lying to gullible Americans about voter fraud in hopes of disenfranchising as many of them (at least of a certain party) as he can get away with.

A new report finds his state has been discarding ballots at an alarming rate. But, at the same time, just days before the sham Commission he co-chairs is set to hold its second public meeting in New Hampshire, Kobach unleashes a whopper of a scam column at the wingnut "news" site Breitbart, citing new "evidence" proving that "voter fraud" by "illegal" out-of-state voters was responsible for the Republicans' narrowly lost U.S. Senate seat in NH last year, as well as Donald Trump's 2016 loss in the Granite State to Hillary Clinton.

As we detail on today's show, Kobach's deceptive "new" NH claims are easily dispelled nonsense. Getting the actual facts about it, however, to the dupes, pawns, suckers and chumps who actually trust the fake news they suck up from accomplished liars like Limbaugh and Kobach at places like Brietbart and Fox "News", is a different matter all together.

Finally, still on the topic of a thoroughly propagandized nation, we close with some listener response to a caller on a recent show about Trump overturning DACA...

Guest: TPM Congressional reporter Alice Ollstein previews next week's return of Congress | Also: Lots of U.S./Russia news, Harvey updates...
By Brad Friedman on 8/31/2017 6:12pm PT

On today's BradCast: As bad it's all been, it's about to get much worse, as the devastation from Harvey continues and as Congress returns to session following the Labor Day holiday. [Audio link to show follows below.]

But first up today: What we know and don't (and why we don't) about the explosions at a swamped chemical plant north of Houston; Russia warns the U.S. that further sanctions against North Korea would be "dangerous"; U.S. continues diplomatic tit-for-tat with Russia by ordering several more diplomatic facilities closed, and; Special Counsel Robert Mueller is now reportedly working with NY Attorney General Eric Schneiderman in their criminal probes of Team Trump in what could serve as an end run around Donald Trump's pardon power of his associates at the federal level, and even a hedge against the possibility of the President removing the Special Counsel from his post in some way.

Then, as horrible as August has been on so many levels, TPM Congressional reporter ALICE OLLSTEIN joins us for some breaking news, and to explain why September could be even worse as Congress reconvenes next week following Summer recess, with "a nightmarishly short calendar during which they must pass a host of bills" to, among other things, approve a budget to keep the government from shutting down and avoid a federal default by raising the debt ceiling.

That, along with the need to fund disaster relief for Harvey, reauthorize children's healthcare and the national flood insurance programs by the end of the month, amid ongoing feuds between Trump and GOP Congressional leadership while the President threatens to shutdown the government if Congress fails to fund his border wall, almost assure what Ollstein characterizes as "The September From Hell".

Even if we had a "Congress who generally got along, and generally got along with the President," Ollstein tells me, "it would have been so hard to pass all of these bills that are coming up. But we don't have that. We have a President who is attacking members of his own party --- leaders in his own party --- and the opposing party. We have a lot of bad blood."

Add to it all the Trump/GOP hopes of passing huge tax cuts ("an even heavier lift than health care reform," she says) and today's late breaking news from Ollstein, fresh off a call with the Health and Human Services Dept. announcing the Administration plans to slash the Affordable Care Act's advertising budget by 90% in advance of this year's truncated Open Enrollment period, and it all amounts to not only a September from Hell, but likely a rest-of-the-year from same.

Enjoy the upcoming holiday weekend if possible, but buckle up thereafter, as Ollstein warns: "We thought it couldn't get any crazier than August, but get ready."

Finally, Desi Doyen joins us for our latest Green News Report with more coverage of the ongoing devastation from Harvey, before we finish up with some actually very good news concerning nuclear power, solar power, and the nation's largest utility company...

Guest: Rep. Hank Johnson (D-GA) | Plus: 'The end of the beginning' of Harvey, and top Trump officials distance themselves from the President...
By Brad Friedman on 8/30/2017 6:25pm PT

On today's BradCast, the Harvey disaster continues, even as skies clear over Houston. And a Democratic Congressman joins us to blast several of Trump's new policies, issued as the record storm was rolling in. [Audio link to show follow below.]

Floodwaters have begun to recede a bit in Houston, as some sunshine finally returns and the airport begins to re-open after five hellish days. But its only "the end of the beginning" in the Bayou City, cautions one meteorologist as Harvey moves back onshore near the Texas/Louisiana border, continuing to threaten lives there and in states to the north, even as officials expect the death toll in and near Houston to surge in the days ahead. Moreover, a nearby chemical plant in Crosby is likely to explode soon, due to the flooding, according to the company's CEO.

All of this as Congress prepares to return from their long Summer recess after Labor Day, and members respond to some of the startling Executive Actions taken by Donald Trump as the record-shattering hurricane slammed ashore last Friday night.

We're joined by CONGRESSMAN HANK JOHNSON today to discuss some of those actions, including the President's pardon of former Maricopa County, AZ Sheriff Joe Arpaio, who was found guilty of criminal contempt of court for violating federal court orders against detaining Latinos on nothing more than suspicious of being undocumented and Trump's less-noticed Executive Order reversing President Obama's restrictions on the Pentagon's infamous "1033 Program".

On the Arpaio pardon, Johnson tells me: "President Trump has proclaimed loudly, by that action, that he will use the power of the presidency to benefit himself, and to benefit his supporters, his friends, and his family. And so it does not augur well for a future for this country under Donald Trump."

"To follow up the notorious pardon of Joe Arpaio with a rescinding of President Obama's executive order which placed limits on the Pentagon's 1033 program --- it does send a clear message to law enforcement that it's open season on the civil rights of anyone who you choose to violate the civil rights of. It's not a good thing for America."

The DoD's "1033 Program" supplies surplus military weapons and equipment --- such as automatic rifles, mine-resistant vehicles, armored drones and even grenade launchers --- for free, to local law enforcement agencies around the country. Johnson has been introducing and re-introducing his bi-partisan "Stop Militarizing Law Enforcement Act" (H.R. 1556) for three successive years now and explains today --- as Republican Sen. Rand Paul appears to agree in the Senate --- why curbs must be placed on the program.

In an op-ed by Johnson, to be published by the Guardian on Friday, he explains one of the things that "makes it dangerous is the fact that 1033 requires that the equipment be 'placed into use' within 12 months of being acquired." He tells me today that means that "if they don't use them, then they have to turn them back in. And so it's a recipe for misuse. It's a recipe for abuse of civil rights of the citizens who law enforcement is sworn to protect and serve. It's frightening that this onslaught of weaponry, straight from the battlegrounds of Afghanistan and Iraq, will find its way back to the streets of America's cities and towns."

The controversial program originally came to the nation's attention after military vehicles and gear were deployed by local law enforcement in Ferguson, MO in response to protests after the police killing of African-American teenager Michael Brown in 2014. After the nation was horrified by the militarization of local military and it was discovered that some weaponry had been disappearing, or was being sold by local agencies, Obama placed restrictions on the program that Trump, last Friday night, lifted with a stroke of his pen.

I also ask Johnson about whether he believes Congressional Republicans from Texas will support Harvey disaster relief upon their return next week (unlike after SuperStorm Sandy slammed the East coast in 2013), about his Election Integrity bill, and whether he intends to join fellow Democrats in the House who have filed Articles of Impeachment against President Trump.

Finally, Defense Secretary James Mattis appears to be separating himself somewhat from Trump --- though not nearly as much as some on the Left are suggesting --- following the order to ban transgender members of the U.S. Military and saber-rattling with North Korea. And, as more longtime State Dept. officials announce they are leaving, Secretary of State Rex Tillerson's job may be on the line following a clear separation from the President's "values" following Trump's statements about neo-Nazi violence in Charlottesville...
