On today's BradCast: it's all over but the desperate Donald Trump tantrums. Though don't try and tell our own Desi Doyen that today! [Audio link to show is posted below.]

As the stock market numbers rally on increasingly certain news that Joe Biden will become the next President (despite Trump's lies that the market would crash if the former Veep won), the U.S. coronavirus numbers also continue to skyrocket to all time records (thanks to Trump's disastrous denial and lies there as well.) For today, though, it's the vote count numbers we're again focused on, as Biden will almost certainly be called the unofficial winner in several remaining uncalled states --- including Pennsylvania, Georgia and Nevada --- very soon.

If he takes Pennsylvania alone it's over for Trump. But, as we went to air today, with Biden so far, according to media calls, having won a conservative 253 electoral votes of the 270 he ultimately needs to be declared the President-elect (that 253 total doesn't include Arizona's electors, which both AP and Fox "News" have already called for him), it's now likely that Biden will end up with at least 306 electoral college votes when all is said and done.

At the same time, Trump is filing every unsupported, nonsensical legal lawsuit in every state that his two-bit lawyers can figure out how to spell in hopes that something, anything, will actually help --- or even just turn out to be vaguely true. While the President's supporters in Michigan chant "STOP THE COUNT! STOP THE COUNT!", his equally gullible cult followers in Arizona are busy shouting "COUNT THOSE VOTES! COUNT THOSE VOTES!" That should give you an idea of the ingenously coordinated strategy of Trump and the Republican Party's election law geniuses at this point.

We're joined today by an actual legal professional, University of Kentucky College of Law's election and Constiutional law professor JOSHUA A. DOUGLAS, author of Vote for US: How to Take Back Our Elections and Change the Future of Voting to find out what we must be missing in reviewing Trump's woefully pathetic legal strategy to try and win this election or unring its bell.

"There's not really a coherent legal strategy to speak of. He's throwing as much spaghetti at the wall as he can and seeing what sticks," Douglas confirms. "The real problem I have is we're reporting on these lawsuits as if they have any merit whatsoever. And they don't. I don't think we should even be giving them airtime. Because in my view, the real goal here is to undermine people's faith in the integrity of the election."

"They are making wild allegations of voter fraud, but without having any evidence that it actually occurred. And then they're spreading misinformation on social media about anecdotes that, when you look into them, turn out to be" anything but what they are alleging, he explains.

Nonetheless, we press the good professor for how he would make the case for Trump, were he unfortunate enough to be representing him in this matter, and we discuss the actual looming legal danger awaiting decades of election law precedent at the now packed and stolen U.S. Supreme Court. Will Trump's newest stolen Justice Amy Coney Barrett actually deliver for her President if and when any actionable case on the 2020 election somehow makes its way to SCOTUS? Or will it only be later that she and four other compliant rightwing Justices will decide to undermine the affirmative Right to Vote found in almost every state Constitution?

We discuss all of that and more today, even if none of it seems to help our own Desi Doyen rest any easier about the Presidential election results just yet. (She has very good reason, in the meantime, to be concerned indeed about the results at the Senate and House level.) Nonetheless, we close today with her latest Green News Report with an eye on Hurricane Eta, now aiming for Florida, and what we should expect when it comes to U.S. climate action after the dust settles on the 2020 election...

'Poll Pad' systems made by KNOWiNK shut down, slow voting in several states; USPS ordered to sweep for undelivered ballots; Houston voters win again; World awaits election results...

I've got to be quick about this today, as polls are now closing on the nightmarish hellscape that is Election Day 2020. But, on today's BradCast, we cover some of the reported problems voters had around the country on Tuesday, thanks to failed voting systems in battleground states such as Georgia, Pennsylvania, Ohio and Texas. [Audio link to show follows below.]

Happily --- perhaps due to so many voters having already voted during Early Voting or by-mail --- there were far fewer problem reports today than in recent Presidential elections. At least as of air time. Frequently, problems don't reveal themselves until later. But, for now, we focus on a few places where voting systems went down entirely, preventing voters from voting in those states.

In almost every case it was related to the failure of electronic pollbooks made by a company named KNOWiNK, which produce the devices called "Poll Pads". Those systems seem to be behind the countywide shutdown of voting for the first several hours of Election Day in Spalding County, GA and in Morgan County, GA. Despite months of warnings from voting systems experts --- and a federal court order --- and the systems failing during the state's June primaries --- Sec. of State Brad Raffensperger did not make sure that backup paper pollbooks were in place. That meant that voters in Spalding could not vote at all for hours on Election Day. In Morgan, election officials were a bit more prepared, it seems. They were able to keep the process going, even if lines were a bit longer than hoped.

Similarly, when the Poll Pads failed in Ohio's Franklin County (Columbus), officials had backup paper pollbooks on hand, as ordered by Ohio Sec. of State Frank LaRose.

Early reports, overall, were that voting went largely smoothly in Philadelphia, in the battleground state of Pennsylvania that both Joe Biden and Donald Trump consider to be critical for their respective hopes of a victory.

But down in Texas, which is now also a battleground state, problems with the e-pollbooks in Upshur County prevented precincts from opening for several hours on Tuesday morning. That could not only affect the Presidential race, but the contest against loony incumbent Republican Rep. Louie Gohmert by Democrat Hank Gilbert in the state's 1st Congressional District. He spent hours in court today, helping to extend polling hours to try and make up for the early morning vote system failure.

Also in Texas, overnight, the far-right 5th U.S. Circuit Court of Appeals upheld a lower far-right lower court judge's ruling that dismissed a challenge to Harris County (Houston)'s ingenious drive-thru polling places, meant to help voters stay safe during the pandemic. The Republican plaintiffs in that case are hoping to reject more than 127,000 legal votes cast from cars in the state's largest county, a Democratic stronghold in the previously very "red" state.

On today's BradCast (with helicopters circling overhead here in Hollywood): Massive protests around the country continue today for an eighth day following last week's police killing of George Floyd in Minneapolis. The street protests continue to swell, no doubt, in response to the frequently brutal response by law enforcement officials in many major cities around the country toward the mostly peaceful demonstrations. But protests in the streets aren't the only much-needed response to years of violence instigated by law enforcement. [Audio link to full show is posted below.]

First up today, one response will be --- or, certainly should be --- at the voting booth this year. To that end, eight states and Washington D.C. are holding their Presidential primaries today. Congressional primaries and municipal elections are being held in a number of other states as well, many of them previously postponed due to the coronavirus. But the deadly pandemic continues, leading Republican Gov. Mike Parsons of Missouri --- where absentee voting is severely restricted --- to tell voters recently that if they don't feel safe to vote due to the pandemic, they just shouldn't bother. That, instead of working to expand absentee voting in the Show-Me State to make it safer for voters to exercise their right to participate in their own democracy. As a GOP-dominated state, however, making it easier to vote in MO may be the last thing Parsons wants.

Nonetheless, expanded absentee voting is now occurring in a number of states --- red, blue and battleground --- where problems have already emerged, including in Pennsylvania and in Idaho, as discussed on today's show.

We're hopeful that election officials see today's "practice run" primaries as a flashing red warning light to get their acts together before November 3rd. That will not be made any easier by intransigent Republican lawmakers in D.C. who are still refusing to appropriate the billions of dollars that elections officials say they need to upgrade systems for this year's elections amid a pandemic, or to bail out the U.S. Postal Service --- hard hit by the COVID crisis --- so they are able to handle the unprecedented mail-in voting we will see in this fall's critical general election.

In related news, the President of the United States, after reportedly spending time over the weekend locked away in a White House bunker due to fears of protests in front of the Presidential mansion, decided to play tough guy on Monday by unleashing federal troops with tear gas, rubber bullets, batons and shields on peaceful protesters in Lafayette Park, on the priest and several seminarians at St. John's Episcopal Church across the street, and on foreign journalists covering the American Dystopian nightmare live on television. D.C.'s Episcopal Bishop, as well as the Australian Ambassador, both had a word or two to say about it after a crew from the country's Seven Network was ">punched by federal storm-troopers as the journalists were covering the violent effort to clear out the park so that Trump could pose for a campaign photo-op holding a bible in front of the historic church.

And, in more related news, while Trump's questionably Constitutional threat on Monday to dispatch the U.S. military to quell protests in states around the country --- beyond his own front door, in any event --- is likely as hollow as most of his other strongman threats, the very real and systemic problem of brutal, racist policing policies continues in this country. To that end, calls to "Defund the Police" have grown in recent days, as seen in protest signs, from various non-governmental organizations around the country and in various media outlets.

We're joined today by longtime policing expert ALEX S. VITALE, Professor of Sociology at Brooklyn College and Coordinator of their Policing and Social Justice Project. Vitale, who penned an opinion piece for The Nation over the weekend headlined "The Only Solution Is to Defund the Police" explains how reforms instituted by the Obama Administration after outrage unleashed by the police murders of Michael Brown in Ferguson, MO and Eric Garner on Staten Island, NY six years ago have failed to bring much-needed institutional changes to police departments around the country. The Minneapolis Police Department, in fact, was once held up by some as a model of progressive change that, clearly, has not resulted in the hoped-for reform.

"Minneapolis was kind of a 'shining star' of this new approach to police reform," he tells me. "That comes out of the Obama Administration, the Department of Justice and a lot of academic think tanks. Their idea was if we can make the police more professional, less biased, more transparent, that this will help restore people's trust in policing. So they implement things like implicit bias training, mindfulness training, de-escalation training. They give police body cameras. They set up a lot of police-community encounter sessions. They try to identify a few problem officers, to give them supplemental training. These are the kinds of things that they hope will create a more modern, professional police force that hopefully will kill fewer unarmed black people."

None of that worked, however, he says. "The number of police killings has not been reduced over the last five or six years. The number of low-level misdemeanor arrests has not been reduced. The number of police in our schools has not been reduced. The war on drugs has not been reduced. So we haven't seen real changes in the impact of policing on those who are most heavily policed. And that's really the problem here."

Now, explains Vitale, author of the book The End of Policing, it is time to demilitarize and defund departments around the country after 40 years of expanded and intensified policing and the more recent failed reforms. "We have dozens of places across the country where people have organized campaigns to dial back police funding," he explains. "No one is out there saying tomorrow we can just flip a switch and there are no police. Most of these proposals are about rolling back increases in police spending over the last ten years."

He argues that many of the functions that cops are currently tasked with would be much better handled by social workers and community organizations, where funding should be shifted away from the police. He also details how this has been a long time bipartisan problem and that many of the "solutions" offered by politicians --- from tough guy "law and order" measures on the Right or more recent progressive initiatives to better train cops to handle sensitive racial situations and improve community policing efforts on the Left --- are more often "used by police leaders and political leaders to deflect and demobilize the protests against them."

Vitale explains how you can help join the movement, why its so important, and how it is literally the only chance we have left for change. Hopefully, this is just the beginning of a long-overdue conversation in our country. "My hope is that, as the immediacy of the protests subside, that people connect with these real movements to do the kind of sustained political organizing on the ground that can help change the view about policing, and develop a kind of new majoritarian politics that is more humane, and less centered on punishment and vengeance," he says.

Staggering unemployment numbers; McConnell tells Pelosi to 'stand down' from new relief measure; WI set to hold deadly vote on Tuesday...

On today's BradCast: Yes, it is as bad as we warned it would be. And it is getting even worse. And the way some state officials are now behaving, even upcoming elections may be unable to reverse much of this madness. [Audio link to full program is posted at end of summary.]

On Thursday, the U.S. Labor Department released gobsmacking statistics revealing that a record 6.6 million Americans filed for unemployment benefits in the past week. That follows more than 3 million doing so the week before. Both weeks blow to smithereens the previous all-time record high for weekly jobless claims since such records have been kept. That numbers was of 695,000, as set in 1982. We are quickly blowing past the disastrous economic tailspin of the 2008 Great Recession and moving into Great Depression territory.

In response, House Dems are attempting to move to another relief bill, in the form of a $2 trillion infrastructure plan to follow up last week's $2.2 trillion stimulus/corporate bailout bill. But Republican Senate Majority Leader Mitch McConnell is, so far, rejecting Democratic House Speaker Nancy Pelosi's proposal to do so, while telling her to "stand down" as the GOP does nothing instead. That, as NBC News reports today that Americans may be waiting as long as five months for the paltry $1,200 check promised them by last week's emergency relief bill.

But, of course, Congressional Republicans aren't doing absolutely nothing. McConnell has vowed to continuing packing the federal courts with unqualified judges, even among this disaster. And several GOP members of the House and Senate are proposing a bill to punish those who disseminated false information about coronavirus or who profited from it --- so long as those people are from other countries. Luckily, Donald Trump's months of repeated and purposeful and deadly disinformation that he and his Administration fed to the American people about the pandemic is all cool! So, apparently, are any U.S. Senators who may have profited from early information about the virus by trading millions of dollars of stock based on insider information, including Senators Richard Burr (R-NC) and Kelly Loeffler (R-GA). Presumably, they will not be held to account by the GOP's proposal to punish anyone who "financially benefits from acts intended to deliberately conceal or distort information about a public health emergency of international concern."

In the House, at the same time, Pelosi has announced the formation of a new bipartisan Select Committee to oversee the Trump Administration's response to the pandemic and its use of the $2 trillion allocated by last week's relief package. The committee, she says, will have subpoena power. So, if there are any questions the panel may have for members of the Administration dolling out that record amount of tax payer funds, we're certain that all of the President's men will undoubtedly respect any lawful Congressional subpoena they may receive.

Meanwhile, we continue to keep our eyes on how to help to begin to end many of these ongoing nightmares, somehow, via the ballot box. Toward that end, the Democratic National Committee announced they are postponing their national nominating convention, previously scheduled for Milwaukee, Wisconsin in July, back to August instead, in hopes that it will be possible to gather in person by that time (it likely will not be.) It would be held the week before Republicans plan to hold theirs in Charlotte, North Carolina, which Trump has vowed to hold with delegates gathered in person in the final week of August.

But, we're still in utter disbelief that Wisconsin is actually --- seriously --- going to hold their Presidential Primary, statewide Supreme Court election and municipal contests NEXT TUESDAY on April 7, despite, as we noted yesterday, the ongoing unprecedented health emergency, statewide stay-at-home order, and "a massive shortage of poll workers across the state, with more than 100 communities having no poll workers at all as of [this past Tuesday, and] an overall shortage of some 7,000 workers in 60% of the state's municipalities."

As we reported Wednesday, the only thing set to stop this madness with both the state's Democratic Governor and Republican heads of the state House and Senate also on board, is a federal lawsuit filed by voting rights advocates. Well, U.S. District Judge Mark M. Conley issued his ruling on Thursday, declining to postpone the election, while making clear that though he disagrees with the state's decision to move forward, he does not have the authority to postpone it due to a health emergency in which, he suggested correctly, residents could die. "That may be something that happens," he said during closing arguments, adding "that would be outside my jurisdiction. But it will be on the hands of the legislature and the governor."

Yes, it will. Judge Conley did, however, extend a few deadlines for absentee balloting, which has also reportedly already overwhelmed local elections officials who are having trouble keeping up with incoming ballots as well as sending out a record number of requested ballots. The Wisconsin Election Commission has already stated that it is very likely, barring a legislative change by the Republican-controlled legislature, that many votes will not be able to be counted at all in time for the state's statutory deadline. Republicans appear to be very happy about that. Conley suggested he may rule again, if voting rights are seen as imperiled on Election Day.
