On today's BradCast, Congressman Ted Lieu (D-CA) joins me to explain the letter [PDF] he sent late last week, with Rep. Mark DeSaulnier (D-CA), to Attorney General Loretta Lynch seeking an investigation and, if appropriate, prosecution of ExxonMobil.

In light of internal company documents recently unearthed and published by Inside Climate News and by the Los Angeles Times revealing that Exxon knew about the "potentially catastrophic" dangers of global warming as early as 1977 and their subsequent funding of the climate change denial industry in an attempt to obscure their own science, Lieu tells me he believes that a conspiracy case, akin to the one brought against Big Tobacco, would now be appropriate against the world's largest oil producer.

"In the case of [Big] tobacco," Lieu explains on today's program, "it's having knowledge that your product had a tendency to cause harm in people, and then denying that was the case, and affirmatively selling your product in the face of that knowledge."

He believes Exxon's actions are very similar and likely to trigger the broad "conspiracy statute" known as RICO, as successfully brought against the tobacco industry in the largest such prosecution ever.

"It wasn't just that Exxon remained silent and didn't share [what their scientists had confirmed]. They took affirmative steps to campaign against the science of climate change. They funded organizations that obscured the science behind climate change. Their top executives would make statements to say that climate change either isn't happening or 'these are just models that we don't know much about and things are very uncertain'," Lieu tells me. "And keep in mind, they internally took actions to take advantage of global warming," by changing their business strategy in the Arctic where drilling would become easier thanks to the melting caused by the use of their product.

"So this is beyond hypocrisy," he says. "An investigation is warranted into what Exxon knew, when they knew it, and what they said about it."

We cover a lot of ground, yet again, on today's BradCast.

First: More climate change dots connected out here in California, as another freeway is shut down (the third in the last couple of months) thanks to yet another extreme weather disaster.

Next: As Donald Trump correctly notes that George W. Bush did not "keep us safe" either before or after 9/11, Jeb tries again to come to his brother's defense and fails almost as much as his own campaign is now floundering.

Then: With federal sentencing reform for non-violent drug offenders about to result in freedom for 6,000 federal inmates (and another 40,000 likely in the near future), we are joined today by artist and author Anthony Papa of the Drug Policy Alliance.

Papa (self-portrait seen above in today's BradCast logo) shares his amazing story about how he was sentenced to "15 years to life" for a first-time, non-violent, drug-related crime under New York's "tough on crime", "war on drugs" policies of the 80s. He served 12 years of hard time --- for delivering 4 ounces of cocaine in exchange for $500 --- before he was finally granted clemency by the Governor.

He follows his first book, 15 to Life: How I Painted My Way to Freedom up with his latest, An Open Letter to Men and Women Returning Home in the Age of Reform, just released on Kindle today.

Papa was lucky enough to earn three degrees while serving 12 years in prison, where he also discovered he knows how to paint. He now serves as Artist in Residence at Drug Policy Alliance and has had his work exhibited at the Whitney Museum. On today's show, in addition to his personal story, he shared his optimistic thoughts on criminal justice reform ("mandatory minimum sentencing became the poison that literally broke the system"), some words of advice to those about to be released ("these men and women coming home into a society that is not ready for them, can be a problem"), and his opinions on the outrage of restrictions on voting placed on both current and former felons.

"The greatest thing for me being in prison, was my discovery for me of my political awareness," he tells me. But, after his release, he learned he would still not be able to vote for another five years, even though he had served his time under laws passed by officials he should have been able to vote against. "Before I went to prison, I didn't even bother to vote. I was a regular Joe. When I came out, discovering I couldn't vote was very painful for me. So it took five years, but when the time came, I cast that vote. I felt like I was whole again. It was a wonderful feeling."

Finally today: Wayne Simmons, the "former CIA operative" regularly featured on Fox "News" for more than a decade, where he has been cited by wingnuts time and again on everything from Benghazi to torture to ISIS and their "19 paramilitary Muslim training facilities in the United States" (which don't exist), turns out to have never worked for the CIA at all and has now been arrested on federal fraud charges.

State Rep's admission of plot to oust African-American U.S. Congresswoman comes on eve of landmark Supreme Court hearing...

It is rather remarkable what one can learn when the presumed private remarks uttered by Republicans and their oligarchic benefactors are captured on secretly recorded audio and videotapes.

Four years ago, Brad Friedman revealed the secretly recorded audiotapes from a Koch Brothers Summer Seminar that captured Charles Koch's "mother of all wars" remark and David Koch's introduction in which he described keynote speaker, Gov. Chris Christie (R-NJ) as his "kind of guy." This was followed by a bombshell in the form of a secretly recorded video that captured Mitt Romney's "46%" remark that the GOP Presidential nominee erroneously believed would be heard only by a group of well-heeled donors.

Now comes a new, secretly recorded audiotape, published by Politico and, subsequently included as part of an in-depth analysis provided by News One. The audio captures Florida Republican state Rep. Janet Adkins at a meeting with the North Florida GOP, plotting to dilute minority representation at the polls by deliberately redrawing Florida's 5th Congressional District so as to include some 18 prisons, disproportionately populated by African-Americans who are ineligible to vote.

Adkins, who is white, described the scheme as the "perfect storm." She explained that if the district was redrawn in this way it would enable Florida Republicans to oust the 12-term, African-American incumbent Democratic U.S. Rep. Corrine Brown. "You draw [the district] in such a fashion so perhaps, a majority, or maybe not a majority, but a number of them will live in the prisons, thereby not being able to vote," Adkins is heard explaining on the recording, after making sure that all the reporters had left the room. (When interviewed by News One, Brown noted that, in addition to the prison populations, there are approximately 6,000 felons living in the newly proposed district whose voting rights have not been restored by the state.)

The secretly recorded audio arrives at a very propitious moment...

On today's BradCast, idiocy in the U.S. Senate and the U.S. House and --- much more importantly --- the future of cars and a clean, livable planet!

First up, as the death toll mounts in Guatemala and the waters continue to rise in South Carolina, all thanks to global warming, the state's U.S. Senator and woeful 2016 GOP Presidential candidate Lindsey Graham embarasses himself as he begs for federal relief from the government, while conveniently "forgetting" that he repeatedly voted against similar aid for other states after Hurricane Sandy.

Then, speaking of disasters and climate change, Steve LeVine, author of The Powerhouse: Inside the Invention of a Battery to Save the World, joins us to discuss his recent article, "Volkswagen’s best shot at a comeback now has the automaker right where Elon Musk wants it."

LeVine explains how Volkswagen, whose recent emissions test cheating scandal will cost them billions in fines, may be able to help save themselves by helping to power the future of electric cars in a massive way. That future, LeVine tells me, is just about here. "In the coming 3-5 years," he says, we will be hitting "a critical mass."

"All of this has been triggered by [Tesla CEO] Elon Musk. Musk has put the fear into car makers --- they think that he could be a game changer, and they could be left out," LeVine explains. "You've got GM, Audi, Porsche, Jaguar, BMW, Nissan [and] a bunch of others car-makers, all planning to launch their own 200-mile, $35-40K [electric] cars" in the next several years. Even Apple is getting in the game. But, that new generation of clean cars needs to be powered, and VW could help their horrible damaged image by taking a leading role.

Finally, we go back to more idiocy in Congress to finish out today's show, as two incapable jackasses battle it out to win the GOP nomination in hopes of becoming the next Speaker of the U.S. House and, incidentally, third in the line of succession to become the President of the United States. And, speaking of which, is that the "death rattle" of the Jeb Bush campaign that we hear?...

In the wake of the horrific mass shooting in Oregon on Thursday, President Obama asked Americans to address the epidemic of mass shootings, in part, by turning to the ballot box. We concur. And we've got a great idea about who to vote out of office first on today's BradCast!

Then: Are Muslims the new Catholics? Ben Railton, Associate Professor of English and American Studies at Fitchburg State University, joins us to discuss the historical parallels he recently documented at Talking Points Memo, between centuries of anti-Catholic sentiment in the U.S. and today's similarly toxic political rhetoric regarding Muslims.

2016 GOP Presidential candidate Ben Carson's recent assertions that a Muslim must "renounce Islam" before he'd consider them qualified to be President of the United States is just one example that echoes a similar sentiment about Catholics earlier in this country's history.

"It can seem like something 19th century, something really distant, but as recently as half a century ago, there was a pretty sustained debate in our mainstream political media, our body politic" Railton tells me, "of the genuine concern on behalf of many that any Catholic --- including John F. Kennedy, the candidate for President --- would owe a first allegiance not to anything within the United States, not to America, not to the American government or the American people, but to that entity, that foreign scary place, the Vatican and the Pope and the Catholic Church."

"Many of the fears that are directed at Muslim-Americans and Muslim communities are directed at the idea of these communities and their customs and beliefs, themselves representing an internal threat," he explains, while going on to remind us that, even with a well-established Muslim community in the U.S. at its founding ("We have Muslim-American communities going back to the Revolutionary Era...so fears of religious 'others' do date back to the very beginning"), this country's Constitutional framers determined there would be no religious test for the highest office in the land.

Railton's message is ultimately a very an encouraging one --- we have, it seems, finally moved beyond our fear of a Papal takeover in this country, after all, so we are likely to do the same with Muslims --- but is that historic comparison an appropriate analogue given the threat so many feel of an actual hostile takeover by Islamic extremists? We discuss.

Finally today, as ironic as it might be, the best news of all may well come from Desi Doyen and our latest Green News Report. How often does that happen?!...

We start today's BradCast with the grim news of yet another mass shooting, this time in Oregon, and a massive storm bearing down on the U.S. East Coast.

As too-occasional BRAD BLOG contributor D.R. Tucker noted: "We have a superstorm on the East Coast brought to us by a problem right-wingers refuse to acknowledge, followed by another massive school shooting caused by a problem right-wingers refuse to do anything about."

But we can do something about it. We can vote those folks out of office. But, of course, only if we're allowed to vote.

Today we discuss two states, specifically (and a few more, generally) controlled by Republicans where they are making it much more difficult for many of their voters to vote. First, the state of Alabama has announced it will shut down 31 DMV offices, after the state's new Photo ID voting restriction just went into effect last year. You'll be shocked to learn that the closures disproportionately affect voters in the state's "Black Belt", including the closure of offices in "Every single county in which blacks make up more than 75 percent of registered voters."

Then, in Iowa, we look at the ongoing legal challenge to the more than 100,000 former felons who have fully completed their sentences, but are being kept from voting for life by one man: the state's Republican Gov. Terry Branstad, who, by executive order, has rolled back Iowa's previous policy that had automatically restored voting rights to former, non-violent felons.

ACLU Voting Rights attorney Julie Ebenstein, who spent years fighting similar voter suppression tactics by Republicans in Florida, joins us on today's program to discuss the latest legal battle(s) for the right to vote in the Hawkeye State (and elsewhere).

"It's shameful the way that we treat our fellow citizens because of a prior conviction, sometimes decades ago," Ebenstein tells me. "The confluence of over-criminalization, mass incarceration, and the ongoing collateral consequences of that --- which is disenfranchisement, sometimes for life --- is something that really rips at our democracy."

It is shameful. As Think Progress noted earlier this year, "in the 2008 election, 5.3 million Americans, or one in 40 adults, were unable to vote due to a felony conviction, according to the Sentencing Project." But, as bad as that is, it's even worse for African Americans. "Nationally, 2.2 million --- or one in every 13 --- black adults is disenfranchised."

And as bad as that is, Ebenstein explains, it's even worse in Florida which, she notes, "like Iowa, has a lifetime ban on voting for people who have committed a felony. And, as a result of that, there's over 1.5 million citizens in Florida who are disenfranchised. So that's about 10 per cent of the voting population --- 1 in 5 African-American men in Florida --- who remain disenfranchised."

Also today: Oklahoma halts all scheduled executions indefinitely following the state's latest death penalty disaster. And a quick look at Bernie Sanders' rather extraordinary fund-raising operation, built on small donations from the Internet, as the independent Vermont Senator almost outraised Hillary Clinton in the third quarter of 2015.

After a week talking (mostly) about sleazy Republicans, we switch to sleazy Democrats today for a bit on The BradCast.

I'm joined by great progressive blogger Howie Klein of DownWithTyranny.com, who is also co-founder of the Blue America PAC, to discuss the recent smear of Bernie Sanders by a Hillary Clinton-supporting Super PAC, which is not supposed to be coordinating with the Clinton campaign or vice versa. But are they?

"There's no chance that it's not coordinated," Klein tells me, while admitting he has no hard evidence. "They'll deny it. It's illegal. If they admitted it, they would all go to jail. But the Clinton campaign, just like the Republican campaigns of Jeb Bush, Carly Fiorina and Ted Cruz and Scott Walker --- they're all coordinating with their SuperPACs."

Klein details his assertions and his thoughts on the $1.2 million raised by Sanders in response to the smear, in the 48 hours after it!

Also, we discuss the absurd fiction of these so-called "SuperPACs", the failure of the Federal Election Commission (FEC) to do anything about blatant violations of campaign finance laws, and the remarkable hypocrisy of the DNC and the DCCC (Democratic Congressional Campaign Committee) in the wake of the GOP's latest threat to shut down the government, this time over a pretend Planned Parenthood "controversy".

Today's BradCast is packed with news from top to bottom. Please buckle up before listening.

First, Big Oil's deceptive scam in California (as discussed on yesterday's show) has succeeded, for now, as Dems pull landmark legislation that would have called for a 50% cut in petroleum usage in the state.

Then, new polling finds Bernie Sanders overtaking Hillary Clinton now in Iowa, as well as New Hampshire, while the party's internecine battle over more debates continues. On the GOP side, candidates not named Trump are flailing as they desperately try to get attention. It's not working --- neither is their lost hopes of scuttling the Iran peace plan.

Next, author and national security correspondent Shane Harris joins us to discuss his disturbing new exclusive at The Daily Beast on 50 U.S. intelligence analysts now reportedly charging that the U.S. has been "cooking" its intel on ISIS.

The still-unnamed military intelligence analysts working for CENTCOM, as Harris explains, are reportedly seeing some of their own reports manipulated by higher-ups. "Key pieces of [their analyses] that they feel are very important [are being] taken out, not given the proper context, [and] in some cases making it look like ISIS and al Qaeda are weaker than these analysts actually believe they are."

So are these charges akin to the way intel on Iraq and WMD was manipulated by the Bush Administration in the 2002/2003 lead-up to war, as revealed by the notorious Downing Street Memos ("the intelligence and facts were being fixed around the policy")? Or are these claims more akin to the hyperventilation over unsubstantiated allegations from the Right concerning Benghazi?

Harris tells me his reporting suggests it is more likely the former than the latter, though it remains unclear who is behind the alleged manipulation of intel and how high up it might go, even if proven true. "What I think is notable is that these 50 --- actually 52 --- professionals who are doing this every day, to go against their bosses, to take this to the IG is a very bold move. They feel very strongly that they have a case," he explains. "I've never seen anything like this. Usually whistle-blowers are in ones and twos, but for a group of people en masse to complain like this is certainly unique in my experience as a reporter."

We discuss who may be behind the alleged "cooking" of the intel and whether President Obama or the White House is somehow directing all of this as the Bush/Cheney Administration was doing in the case of the manipulated intel on Iraq. Tune in for Harris' response to those questions and many others, in what seems, at least as of now, a startling, if still-developing story.

On today's BradCast we look at the numbers, the jaw-dropping death toll in this nation, and what, if anything might ever be done about it.

For the record, as WaPo details, we've now had 247 mass shootings in the 238 days of 2015.

No, I wasn't just blowing smoke when I told you many many months ago that vaping (quitting tobacco and moving to e-cigs) is a life saver and that those who were trying to restrict its use were helping to kill people unnecessarily.

A new independent expert study out this week, commissioned by the UK government's Public Health England (PHE), underscores exactly that, as we discuss at the top of today's BradCast.

As the new study finds, e-cigs are "around 95% less harmful" than tobacco cigarettes; there is no evidence that vaping is a "gateway" to tobacco smoking; horrible reporting has misinformed the public to believe that e-cigs are as dangerous as tobacco; vaping helps smokers quit and saves lives; and that public officials (shamefully, many of them Democrats!) should be encouraging smokers to move to vaping, rather than discouraging the use of e-cigs, since they are harming the public by doing so.

All stuff we've told you long ago. And here's another study, a major one, proving that The BRAD BLOG and The BradCast had it right to begin with.

Speaking of stuff we've told you long ago, we then move back to Presidential politics and how --- as we told you on the day he entered the race in mid-June (before almost anybody was taking him seriously --- they are now!) --- Donald Trump has blown up both the 2016 campaign and the Republican Party along with it.

Today's latest high-larious examples include both Jeb Bush and Scott Walker absolutely falling over themselves trying to figure out and/or flip-flop on their positions on immigration (and "anchor babies" and Constitutional birthright citizenship) and the latest embarrassment for now-disgraced Republican favorite Josh Duggar and the rest of his Republican Party.

Finally, we finish with an adult politician, Democratic 2016 Presidential candidate Sen. Bernie Sanders, and his extended response this week (you're welcome!) to corporate media failure in covering the substance of important campaigns and why he refuses to attack Hillary Clinton just to please them...

Guest: The Nation's John Nichols...

On today's BradCast, we begin with the sad breaking news about Jimmy Carter's illness and a few thoughts on the ailing former President. Then, it's onto a bit of fact-checking on "ObamaCare" and on Jeb's silly, fact-free foreign policy propaganda speech last night at the Reagan Library.

Next, Wisconsin's own John Nichols of The Nation joins us to explain new revelations about an old criminal investigation of Wisconsin Governor and 2016 GOP candidate Scott Walker and his remarkable ability to blatantly lie about that and so much more.

"Scott Walker is, frankly, better than just about anybody in American politics at gaming the media," Nichols, who has covered him for years in the Badger State, tells me. "At counting on the media to take his absolute denial and give it the same treatment as the accusations, the charges, rather than getting to the bottom of it to actually figure out whether something is there."

He explains that Walker is clever enough to realize that lying works with today's Rightwing electorate, who get their news from very selective sources that rarely bother to fact-check. "He is, in fact, the embodiment of where our politics is going," Nichols warns, citing a description of Walker as "more Nixonian than Nixon."

Then, Nichols, a long time supporter of Bernie Sanders, addresses the recent controversy concerning Black Lives Matter protesters confronting the Vermont Senator and quickly rising 2016 Dem candidate to suggest that, as he explains in detail at The Nation today, such protests have, in fact, made Presidents such as FDR and Kennedy much greater than they might have been otherwise. He argues that the BLM protests have already had a similar effect on Sanders' campaign.

"What we should understand is that pressure from activists often makes politicians into what we like about them, what we respect about them," he says. "What it means is that pressure from activists forces politicians --- and Presidents even --- to step up, to do what they should do, do what will make them more universal in their appeal."

Finally, some very good polling news for Sanders in New Hampshire and more embarrassing polling news for Bush, Walker and the rest of the Republican Party...
