As word was floating around this afternoon about a possible "book keeping error" discovered during canvassing of Tuesday's incredibly close Wisconsin Supreme Court election, an error that might give thousands of votes to Justice David Prosser in a race which he trailed by just 204 votes based on unofficial Election Night numbers, we idly wondered if the county in question might turn out to be the very controversial Kathy Nickolaus' Waukesha County.

And, whaddaya know...

The above comes from the Rightwing National Review Online and is similarly reported at this hour at the similarly Rightwing Weekly Standard where Stephen F. Hayes adds that Nickolaus is also "a Republican activist":

As Schneider notes in the NRO piece, Waukesha's County Clerk Kathy Nickolaus had indeed come under scrutiny for her election procedures in the past. As The BRAD BLOG flagged back in August of 2010, it was discovered that Nickolaus keeps election results on her personal PC in her office, and only on her personal PC.

At a press conference moments ago, Nickolaus is said to have attributed the confusion in numbers to "save error" in Microsoft Access on her computer.

As we noted, quoting the Milwaukee Journal Sentinel last year in regard to questions about Nickolaus', um, unusual election procedures:

An audit of Nickolaus' election procedures was subsequently performed by the county and a number of recommendations to improve the security and accuracy of her system were made by the auditors. Among them, the recommendation that she stop using the same ID and password for three different employees in her office. Nickolaus claimed, in opposing that recommendation, that it would take too much time for one employee to log off before another one logged on with a different user ID.

When presented with the results of the audit at a County Board meeting in January after Nickolaus had refused to implement the recommendations, saying only that she would take them "into consideration," she was taken to task for what the Chairman of the Executive Committee described as her "smirks" during the discussion. With 100% of the precincts now reporting unofficial results, Assistant Attorney General JoAnne Kloppenburg leads Justice David Prosser by a remarkably thin 204 votes out of some 1.5 million ballots cast in the Wisconsin Supreme Court race --- according to the computers that count votes in the state.

The unofficial numbers at this hour, according to AP's spreadsheet of those computer results, give Kloppenburg 740,090 votes to Prosser's 739,886.

Despite Kloppenburg's tiny reported lead, the race is virtual dead heat in what might otherwise be a little-noticed state Supreme Court election. The race, however, has been turned into a proxy battle between supporters of the state's controversial new Republican Gov. Scott Walker (who Prosser has allied himself with) and union workers and their supporters who oppose Walker and the state GOP's attempt to legislate away the freedom of citizens to collectively bargain through public worker unions. Outside groups, according to NYU's Brennan Center for Justice, are said to have spent a record $3.5 million on so-called "issue ads" to support their favored candidate in the closing days of the election.

For proponents of Election Integrity, there is both good news and bad in the Badger State. The good news: most of the state's voters used verifiable hand-marked paper ballots to record their votes yesterday. The bad news: Those ballots are counted by easily-manipulated, oft-failed computers instead of human beings; 100% unverifiable Direct Recording Electronic (DRE, usually touch-screen) voting machines are used by some voters with disabilities across the state; and, given close results, even if a hand-count of paper ballots occurs, as is likely, the number of votes cast on unverifiable DREs could end up being larger than the final margin between the two candidates --- meaning that it will be, literally, impossible to know for certain who actually won the election...

While prepping for tonight's Mike Malloy Show (which I will be busy guest hosting all week), here are just a few of the items which caught my eye so far today...in no particular order...

• Record amounts of cash being spent by labor unions and the (supposedly grass-roots) "Tea Party" on tomorrow's Supreme Court election in Wisconsin, as the race between the unabashedly pro-Walker Justice David Prosser and Asst. Attorney General JoAnne Kloppenburg has turned into a proxy battle between the two clashing ideologies right now in WI. A defeat of Prosser would tilt the court's 4-3 majority from Right-leaning to not Right-leaning. The race is also seen as a bellwether for upcoming recall elections of GOP state Senators likely to occur there in the near future, as Ernie Canning reported on earlier today at The BRAD BLOG.

• Nuclear triage. Workers at the Fukushima Daiichi nuclear plant in Japan are dumping 11.5 tons of "low-level" radioactive water into the ocean to make room in filled storage containers for the more radioactive water leaking from reactor Unit 2. They say they have "no choice," but to dump that water (with radiation levels 100 times over the legal limit) as they must continue injecting new water to cool the plant's four crippled reactors, even as the radiated water floods out. Over the weekend, workers were unsuccessful in their attempt to use polymer, sawdust and newspaper (BP "JunkShot" anyone?!) to plug an 8 inch crack in a flooded tunnel at Unit 2 said to be gushing highly radioactive water, at 100,000 times legal levels, into the ocean.

• Transocean, the owner of the BP oil rig which blew up last year in the Gulf killing 11 workers (9 of them from Transocean) has apologized for referring to 2010's safety record as the company's "best year ever". They have not, however, apologized for issuing enormous bonuses to their executives in the bargain.

• A sweeping new election law in Florida is working its way through the GOP-controlled state legislature along predictably partisan lines, just in time for the 2012 Presidential election there. Some of the proposed changes will make it much more difficult for non-partisan voter registration groups, such as the League of Women Voters, to do their work, and will likely lead to a huge increase in "provisional" (and, therefore, frequently uncounted) ballots. Leon County's highly-respected Supervisor of Elections Ion Sancho has called the bill "a travesty".

• Former U.S. State Department spokesman P.J. Crowley --- recently forced to step down for referring to the treatment of alleged WikiLeaks leaker Bradley Manning as "stupid" --- compares WikiLeaks to the New York Times. The paper's Editor-in-Chief, who has been bashing Julian Assange and WikiLeaks themselves of late, even though the "paper of record" has written hundreds of stories based on WikiLeaks documents, will not be happy. • After relentlessly bashing Democrats for cuts to Medicare vis a vis the 2010 health insurance reform bill, Republican Congressman Paul Ryan plans to largely do away with the program entirely as part of the GOP's proposed budget plans to be revealed shortly.

• Even Republican state Senators in Maine are beginning to become uncomfortable with the radical statements and extremist behavior of the state's new GOP Governor Paul LePage and are asking him to "tone it down". Beginning to see the writing on the wall, boys?

In addition to some of the above possibly coming up for discussion tonight, we will definitely be discussing the U.S. Chamber Plot (which was to have targeted, among others, myself and my family) with my guest U.S. Rep. While it should hardly be necessary, given the extent to which the GOP's billionaire-funded direct assault on workers' rights has exposed the Orwellian deceptions of the so-called 'Tea Party' movement, there are times when the adage, "sex sells," seems unavoidable, especially when it involves exposing the vast gap between the right-wing's professed "family values" and "fiscal responsibility" and a reality that includes infidelity and an eager willingness to squander public funds on friends and the billionaire sociopaths who fund their campaigns.

No doubt, Chris Bowers, the Campaign Director of the Daily Kos, understood this when he sent out a fund-raising email which, as reported by Rich Mitchell of the Conservative Daily News, reads, in pertinent part:

Mitchell denounced the salacious allegations as a "smear", though he offered no evidence in support of that claim to counter what appears to be an accurate account of Hopper's infidelities and the questionable hiring of his girlfriend, the GOP operative Valerie Cass, by the new administration of Gov. Scott Walker.

While there is always a legitimate question as to whether marital infidelity should disqualify an individual from holding public office, here the issue arises in the context of allegations of nepotism and hypocrisy, not to mention the issue of whether the Fond du Lac Republican could lawfully cast a vote opposing his own recall, now that, as his estranged wife admits, he no longer resides in his own district. He lives with Cass elsewhere.

This new sex scandal adds to a powerful, substantive recall message which has gained a great deal of momentum over the last several weeks...

POST-SHOW UPDATE: What a fun show! I'll not give anything away, in case you've yet to listen, as the audio archives are now posted below (along with archives for the chat room, if you're interested)...

Choosing an interesting way to 'celebrate' the 8th anniversary of the launching of Tomahawk cruise missiles into Iraq kicking off our invasion there on March 19th, 2003, the U.S. Commander-in-Chief Barack Obama approved the launching of Tomahawk cruise missiles into Libya on the anniversary today, as a five-nation coalition began to carry out a U.N.-approved No Fly Zone mandate over yet another oil rich Middle Eastern nation.

In response, the Tokyo Electric Power Co. (TEPCO), General Electric, The Shaw Group, the U.S. Chamber of Commerce, and the rest of the nuclear energy lobby sent a thank you note to Libyan dictator Col. Muammar Gaddafi, as the world media quickly turned their attention en masse to the new military action in the Middle East and away from the still-pending nuclear disaster at the Fukushima Daiichi nuclear plant in Japan.

In related sarcastic and fake news, Wisconsin Governor Scott Walker (R-Koch) tore off all of his clothes and danced naked with glee in celebration, by himself, in the middle of the capital rotunda in Madison. No media were there to capture the moment.

Meanwhile, in news that is neither sarcastic nor fake, but seemingly impossible upon everything else, a giant 100-mile oil slick has been spotted in the Gulf of Mexico, off the coast of Louisiana near the site of last year's BP deepwater oil drilling disaster. And yet with all of that, CNN has still not announced plans to scale back the 150 staff contingent they are set to deploy to cover next month's Royal Wedding in the UK.

In still more, let's call it irony, over a 100 demonstrators, including "Pentagon Papers" whistleblower Daniel Ellsberg, were arrested at the White House Saturday, protesting all the wars we were in prior to today, as well as against the reportedly deplorable conditions of detainment for 23-year old Army Private Bradley Manning, accused of leaking classified war documents and diplomatic cables to WikiLeaks. Many of the same protesters were arrested in a similar protest at the White House in December, also for failing to obey orders as they handcuffed themselves to the White House fence, though few media bothered to cover that demonstration either. Another rally is set for tomorrow in support of Manning, also sure to be ignored, at the Quantico Marine Corps Base in Virginia where he has been held in solitary confinement, reportedly, 23 out of 24 hours of each day for the last nine months.

At Fukushima today, only a bit more noticed, McClatchy reports that the spent fuel rod pool at reactor No. 3 is said to be "stabilized," with radiation levels dropping there after 13 hours of sea water was sprayed onto it with water cannon trucks [* See UPDATES below for more on Unit 3 issues.]; the Unit 4 fuel pool --- where, as we reported last night a "renewed nuclear chain reaction [was] feared" --- may in fact be cracked and leaking water, but with Unit 3 "stabilized" for now, fire fighters have turned the water cannon trucks onto that unit in hopes of cooling it down as well; and late last night, power was restored to Units 5 & 6, with pumps said to be working and the cooling ponds in both reactors cooling from their previously reported temperatures around 65C, back towards the desired temp of 25C. The readings there today were 37C and 41C respectively, in what can certainly be considered a bit of good news in a story desperate for some...

Rep. James Sensenbrenner (R-WI) is clearly not a fan of opposition view points. At least not when they are in opposition to his own. Last night wouldn't be the first time he simply gavelled a meeting to a close in order to shut out the voices of those who disagreed with him.

At a Town Hall meeting in a library in Wauwatosa, WI, on Monday night, as TPM reports, Sensenbrenner suddenly adjourned the event after just 27 minutes as citizens expressed their disagreement with the speaker, state Sen. Leah Vukmir (R), concerning the state GOP's attempt to legislate away their freedom to collectively bargain as public employees.

After Sensenbrenner abruptly shut down the event --- something he has done before, but in the U.S. House --- the crowd on hand erupted into cries of "Shame! Shame! Shame!", echoing Democratic law makers in the state Assembly a week and a half ago after Republican members suddenly opened a vote on the "Budget Repair Bill" without warning at 1am, and closed it seconds later before nearly a third of the chamber had even had a chance to cast their vote.

Before we flash back to what Sensenbrenner did in 2005, here's what the end of the event looked like last night in Wauwatosa...

Sensenbrenner --- who had previously been a fan of rowdy Town Halls over the last year or two when corporate-manipulated "Tea Party" protesters were attempting to shout down Democratic elected officials over the so-called health care reform bill --- has a record of simply shutting down debate when he is not in favor of the viewpoints being expressed...

What do GOP superstar Ann Coulter, the head of the GOP's California voter registration firm Mark Anthony Jacoby, and, as of yesterday, Indiana's newly elected GOP Secretary of State Charlie White all have in common? Unlike the four-decade old community organization ACORN, each of the Republicans appear to have committed voter fraud and/or voter registration fraud.

Coulter's well-documented acts of voter fraud and voter registration fraud took place in 2005 in Palm Beach County, FL, and were preceded by likely acts of voter fraud in Connecticut in 2002 and 2004 as well. Jacoby's voter registration fraud in CA led to his 2008 arrest and subsequent guilty plea. And now White, the new chief election official in IN, the state with one of the most draconian voter suppression polling-place Photo ID restriction laws in the nation, has been charged with three counts of voter fraud (as well as additional counts of perjury, financial institution fraud, and theft), just two months after being sworn in last January, for having lied about his address when he voted in last year's GOP primary...

We were under the impression that the tens of thousands of citizen protesters in Wisconsin, standing up against Big Government's attempt to take away their freedoms over the last three weeks, were extremely peaceful. But, apparently, that's because we were relying on actual news reports and evidence and stuff.

So, in the interest of fairness and balance, here's what's actually going on in Wisconsin, according to Fox "News"...

We are hoping that Fox "News" "reporter" Mike Tobin survives the dangerous conditions under which he's been working. Covering the mobs in Cairo was nothing compared to the dangers faced by Fox in Madison!

Of course, in our never-ending quest for fairness and balance, we should probably also point out that the man who "punched" Tobin, as discussed in the video above, didn't actually punch him at all. But we only know that because a liberal non-Fox camera happened to be rolling, so that camera should not be trusted. Neither should liberal Eric Boehlert of the liberal, George Soros-funded propaganda outlet Media Matters. He highlighted more evidence this week attempting to suggest seemingly phony WI reporting by Fox "News." Obviously, his actual, independently-verifiable evidence is probably of the liberal nature as well, so feel free to ignore it.

Also, WI's Republican state Sen. Glenn Grothman, as seen in the video above being overrun by the "dare I say, violent" and "angry mob" chanting "Shame! Shame! Shame!" was shouted down after he appeared on television referring to all of the protesters as "slobs." That appearance by Grothman, however, was on the liberal MSNBC, so, ya know. (Later, he would go on to admit that "there were many friendly people in that crowd" and "courteous people there" and that he never "felt threatened," but, again, ya know.)

For the record, as Bill O'Reilly is only too happy to remind us nearly every day, any mitigating information out there which suggests Fox's reporting is less than truthful or accurate should be ignored because they remain the most popular cable "news" channel in the nation. Therefore, what Fox "News" reports is truthful and accurate. If it wasn't, they wouldn't be so popular, now would they? Suck on that, Liberals!

"This is not a budget issue," the policeman speaking to the cheering protesters jammed inside of the capital rotunda in Madison, WI, shouted this weekend, "This is a civil rights issue!"

"Mr. Walker, if you are listening to me, let me tell you something," he continued through the bullhorn as the crowd rallied, "We know pretty well now who you work for. Let me tell you who we work for. We work for all of these people!"

"We're not here, Mr. Walker, to do your bidding. We're here to do their bidding!" he told the crowd in a remarkable video-taped moment posted by RAW STORY on Sunday.

While a wide swath of Wisconsin society, entailing not only both public and private union members, but students, doctors, nurses, teachers, police officers (like the one mentioned above), and fire fighters have swarmed the streets and public buildings of Madison as part of a mass movement rivaling those we've recently seen on the streets of Cairo, there is one sector of our society who should be especially angry with the Wisconsin branch of Corporate America's wholly-owned, public subsidiary, GOP, Inc.

It is the uninformed and misinformed working class stiffs, aka "Tea Partiers," who should be most disturbed by the scam they've been subjected to over the past two years (and many more). It is they who were taken in by the lies and deceptions of billionaire sociopaths, like oil-baron David Koch of the infamous Koch Industries. Koch's aim is not liberty, freedom, and jobs but American fascism, corporatocracy, and the "eternal subjugation of the common man"...

The scene last night, as the Republicans in the Wisconsin Assembly suddenly, and without warning --- quite literally in the middle of the night --- announced and took a vote on Gov. Scott Walker's union-busting "Budget Repair Bill," followed by chants of "Shame! Shame! Shame!" from Democrats inside the chamber after it passed was remarkable.

As it was happening, I was reminded of all of those "Tea Partiers" last year who, despite a full year of committee hearings in both chambers of the U.S. Congress, mark-ups, negotiations, changes and concessions in hopes of bringing Republicans on board with the health care insurance reform bill that had otherwise been discussed and debated for at least a full year prior as well during the Presidential campaign, complained that the bill had been "crammed down the throats" of the American people in defiance of popular protests.

Well, in case you're wondering, Tea Partiers, this is what cramming a bill down throats in defiance of popular protests actually looks like.

This is also what it looks like when Big Government actually votes to take away freedoms from American citizens --- the other matter you folks pretended to once care about during the Health Care bill debate. So why aren't you joining with the protesters in Wisconsin now?

Slate's Dave Weigel, who was in WI's capital as the vote went down last night around 2am, explains what happened and offers this remarkable video...

We previously covered the WI protests by highlighting Rachel Maddow's analysis of the Walker/GOP bill in which she framed the debate as "Billionaires vs. Bake Sales: an existential fight for the survival of the Democratic Party" due to the legislation's blatant goal of busting the state's public unions in hopes of being the first domino to destroy the unions in full, in advance of the 2012 election.

The prank call from the Buffalo Beast's Ian Murphy --- claiming to be "David Koch," one of Walker's billionaire funders --- further underscores the GOP hope that Wisconsin will be "the first domino" in this latest attempt to destroy the politically powerful unions all together. Murphy's phone call to Walker as "David Koch" --- in which the Governor admits to having considered planting "troublemakers" among the peaceful protesters converging over the past week on the capital in Madison, follows in full below...

If you're ready to join such a fight, we're quite certain there are tens of thousands of freedom-loving Americans now rallying in Madison, Wisconsin this week who would welcome you in that fight.

For those just joining this extraordinary story in Madison (which also seems to be spreading to other states, like Ohio, where their new Republican governor is also attempting to legislate away the freedom for citizens to collectively bargain with their employers), MSNBC's Ed Schultz, who was on the ground in WI yesterday, has offered the most comprehensive coverage from the start of the still-growing fight for the rights of teachers, fire-fighters and other public employees to collectively bargain for themselves.

But it was Rachel Maddow who may have put things in the best perspective last night, as she offered a persuasive case as to how the purported claims of new Republican Gov. Scott Walker, and the new Republican majority in the state legislature, weren't really about responding to a "budget crisis" --- one that appears to have been "manufactured" by them, in fact --- but rather, a brazen attempt to break the backs of Democrats, via the unions which often support them, prior to the upcoming 2012 election.

"What's happening in Wisconsin right now is not about a budget. This is about elections. This about the Republican Party going after the institutions that make it possible for Democrats to win elections in America," said Maddow in her report last night (video posted below).

What's happening in Wisconsin right now is about Republicans versus Democrats. It's about elections. We saw the same thing with ACORN. Remember the Rightwing jihad against ACORN? What did ACORN do to earn that?," she asked before answering her own question. "Well, ACORN for years registered huge numbers of minority voters and poor voters. Minority voters and poor voters overwhelmingly vote Democratic when they vote.

"There were not any real problems with the way ACORN registered people. This whole 'ACORN voter fraud epidemic' was essentially made up out of whole cloth. The only problem with ACORN and its voter registration program is that they were really good at it! And that helped Democrats," she argued.

"ACORN was not a Democratic organization, but ACORN's work was very politically beneficial to the Democratic Party and so therefore the Right decided that ACORN had to be destroyed."

Unions, she then went on to argue, who are similarly not Democratic organizations, but whose well organized, often well funded work tends to help Democrats in elections and --- especially, since Citizens United --- now remain largely the only thing between Republicans with their enormous corporate benefactors and the chances for Democrats to win elections anywhere.

"The only institutions of any size, with any heft at all on the liberal side, are the unions. So, of course, they too, must be destroyed."

"If you break the public-sector unions in Wisconsin, then you can break them anywhere. And if you break them everywhere, then it is 'Bake sales versus Billionaires' for not only this next election, but for every election here on out. Republicans run the table. Bake sales on one side, billionaires on the other. That's it."
