Desi and I are back for today's BradCast --- (thanks for saving us over the past three day, Nicole Sandler!) --- as the House Judiciary Committee's debate over two Articles of Impeachment against Donald J. Trump continues and with the first ballots for the 2020 elections set to be mailed out in just over two weeks. That, even as many jurisdictions around the nation are still choosing between gambling on faulty new electronic voting systems or moving to safe, verifiable hand-marked paper ballot systems. [Audio link to full show follows below.]

Among the stories covered today...

  • Dems continue to make Trump's reelection easier for him with fresh compromises in Congress, including approval of his new Space Force military branch and expanded paid parental leave for millions of federal workers (as also supported by Trump);
  • The (so far) two-day markup of the Democrats' two Articles of Impeachment against Trump continued into Thursday after opening statements on Wednesday night. We share some notable and pointed clips from Democratic Reps. Steve Cohen (TN), on the President's attempts to undermine American democracy itself; Pramila Jayapal (WA), who accurately describes Trump as "the smoking gun"; and Veronica Escobar (TX) who offers a great analogy to explain how Trump's attempt to force Ukraine to help him in the 2020 election would have landed any other public official in jail;
  • In an attempt at fairness, we searched for hours (and hours) to find remarks from the Republican minority that were not comprised of blatantly false claims, wholly misleading information and/or out and out lies. We failed. We did find Rep. Ken Buck (R-CO), however, apparently characterizing 2016 Green Party Presidential candidate Jill Stein as a "Democrat" and falsely claiming that she filed "a frivolous lawsuit...claiming voting machines were rigged in three states" in 2016. She did no such thing. Nor did anybody else to our knowledge. But that's the sort of knowingly fake news Republicans are now using to try and defend their President from impeachment. They are also claiming that "Abuse of Power" and "Obstruction of Congress" are not actually high crimes and misdemeanors (which would likely come as a delightful surprise to Richard Nixon);
  • Three years into his Presidency, major newspapers are now finally jumping in to support Trump's impeachment --- now that he is already being impeached. That, after many of those same courageous outlets called for Bill Clinton to resign from office within just days of a sex scandal that resulted in his own impeachment. But we do offer some well-deserved kudos to the American Conservative magazine, for their non-hypocritical support of Trump's impeachment, find the case to be "Overwhelming";
  • As to what We, The People, can do about all of this, the first ballots of the 2020 Presidential Primaries will be sent out as early as December 28, just two weeks from now, for military and overseas voters participating in New Hampshire's February 11 primary. And voters from more than a dozen states which are holding Super Tuesday primaries on March 3rd --- including Alabama, Arkansas, California, Colorado, Maine, Massachusetts, Minnesota, North Carolina, Oklahoma, Tennessee, Texas, Utah, Vermont and Virginia --- will begin receiving Vote-by-Mail ballots in just over a month, as of January 18. That's before the Iowa Caucuses on Feb. 3 or the New Hampshire primary on Feb. 11;
  • Nonetheless, there are still many jurisdictions around the country fighting to determine exactly which voting systems they will be using at the polls in the 2020 elections. Recent failures of brand-new touchscreen voting systems in Pennsylvania, Georgia and Texas should spook officials and voters alike, even as officials in the battleground state of North Carolina are facing big problems with their plans to use similarly unverifiable systems.
  • Meanwhile, in Missouri, the most populous jurisdiction in the state, St. Louis County, was able to move seamlessly from unverifiable touchscreen systems to a brand new, completely verifiable, "Print-on-Demand" hand-marked paper ballot system last month with no complications, and at a saving of some $3 million for tax payers!;
  • Finally, Desi Doyen joins us for both good news and bad in our latest Green News Report, as Exxon is exonerated in a big climate fraud case, while 16-year old climate activist Greta Thunberg is named TIME Magazine's 2019 "Person of the Year"!...

A day full of both historic and chilling news...

Today's BradCast offers some historic news and some chilling news. And some that may be both. [Audio link to show follows below.]

U.S. House Speaker Nancy Pelosi announced on Thursday that she is directing House Democrats to move forward to draw up Articles of Impeachment against Donald J. Trump. It is only the fourth time in our nation's history for such an action. We share Pelosi's somber announcement and the history lesson that it includes, as well as the reaction from the White House, from Trump himself, and the steps that lie ahead in the House Judiciary Committee as we move toward a trial in the U.S. Senate for removal of the President.

The historic action, which reportedly may include as many as four different Articles of Impeachment --- Abuse of Power, Bribery, Obstruction of Congress (in the Ukraine affair) and Obstruction of Justice (in the Robert Mueller Special Counsel probe) --- has become necessary, according to Pelosi, to save the republic in light of Trump's recently revealed attempts to undermine the 2020 election with help, once again, from a foreign nation.

Then, the Dept. of Justice on Thursday announced two indictments of Russian hackers --- whose whereabouts are currently unknown --- as part of what officials describe as one of the largest cybercrime sprees in U.S. history. The sweeping criminal conspiracy was allegedly led by the two men, who officials have tied to Russian security services. It involves malware designed to defeat anti-virus software distributed by a group named Evil Corp (seriously) and used to siphon more than $100 millions dollars from the bank accounts of companies and even school districts in at least 11 states. The malware phishing schemes reportedly even targeted a small organization of nuns in Chicago.

While that attack has been broad and ongoing over many months, a seemingly separate scheme, also tied to Russians criminals, crippled technology services to more than 100 nursing homes across the U.S. with a ransomware attack on the company that provides the tech services to those facilities. Following a successful emailed phishing attack on November 18, that someone within the company appears to have clicked on, the network of the Milwaukee-based firm was infected, leading the cybercriminals to demand $14 million for the restoration of access to at least 100 hijacked servers. Reporting over the Thanksgiving holiday suggests the company will rebuild their servers rather than pay the ransom. But, in the meantime, some of the nursing homes serviced by the company were unable to access patient records, use the internet, pay employees or order medications. AP reports that ransomware attacks of this kind have been on the rise in 2019, particularly those that target critical public services, with some 70 such attacks in the first half of the year targeting more than 50 cities.

Another victim --- and here's where it begins to get even more chilling --- was the state of Louisiana. They appear to have been attacked on the same day as the Milwaukee tech services company. What makes this attack far more unnerving is that it took place just two days after Louisiana's recent gubernatorial run-off election on November 16.

While the state was quick to stop the spread of the virus, they had to shut down vital state services at dozens of agencies, including the Office of the Governor, the Louisiana State Legislature, the Office of Motor Vehicles, the Department of Corrections, the Department of Children and Family Services, the Department of Health and others, such as the Louisiana Secretary of State's office on the heels of the major runoff elections just two days earlier. Hundreds of computers were affected in the state overall, including those offering elections results to the public at the Secretary of State's website. Had the attack come just days earlier, it might have been devastating for the state's elections, which shamefully require all voters at the polls to vote on 100% unverifiable touchscreen computer voting systems. Had those been knocked out --- or the electronic pollbook systems required to use them --- chaos might have ensued in the closely watched statewide election.

Nonetheless, dozens of other states and counties around the country (many of them battlegrounds and/or highly-populated) are currently moving --- right now! -- to similar computer touchscreen voting systems that rely on working computer networks in advance of the critical 2020 elections. Those systems will be wildly vulnerable next year, where unhackable hand-marked paper ballot systems would not be. Are we insane?

Finally Desi Doyen joins us for the latest Green News Report, with even more chilling news. Though, in this case, it's about the warming of the globe and the GOP Senate confirming yet another lobbyist to a top Trump cabinet seat. Happily, there is a bit of good news in today's GNR as well, regarding California's ban on new fracking, and teen climate activist Greta Thunberg's safe arrival back in Europe for this year's U.N. climate conference in Spain...

Election Day 2019 voting system failures; Donald Trump failures; 2020 polling failures; And what YOU must now do about all of it...

On today's BradCast: It's Election Day today, and not going well in several states. But it's also Election Day one year from today, for President, and we've got some very timely advice. [Audio link to show follows below.]

Voter are voting, or trying to, in dozens of states around the country today. And, like clockwork, voting systems --- particularly newly installed touchscreen and electronic pollbook systems --- are failing and causing long voting times in a number of states (like New York, Virginia, and Indiana --- where "about 30% of the 93 precincts in St. Joseph County" had touchscreen problems, according to its County Clerk), even in sparsely attended off-year elections. We'll have more such problems as they come to light, undoubtedly, along with noteworthy results of Tuesday's elections across the nation, on tomorrow's BradCast.

But, while we're waiting, as we are now exactly one year out from next year's critical Presidential election, there is every reason to imagine (foolishly, we'll add here) that Donald Trump will be wiped out in a landslide next year. All things being equal, on a level playing field and sane world, he would be. But we live in neither these days. Even setting aside his ongoing impeachment, his last week has been an embarrassment of failures.

  • His withdrawal from the landmark Iran nuclear agreement has now resulted in Iran installing at least 60 new, modern, high-speed centrifuges to enrich uranium, which had been previously banned under the pact --- until Trump broke it.
  • An analysis of U.S. troops now both coming and going in Syria following Trump's sudden declaration that the U.S. was pulling out of the warn torn nation and his subsequent announcement that he was sending troops in to defend oil field left abandoned by our fleeing Kurdish allies, means that when all is said and done, the U.S. will have 900 troops in the country. That, versus the 1,000 that were there previously. And with all of that, "the United States has deserted its pivotal Kurdish ally; ceded territory the Kurds had controlled to Syria, Turkey and Russia; and opened the door for a possible Islamic State resurgence" as hundreds of ISIS prisoners were able to escape in the Trump-created confusion.
  • At the same time, back home, we've learned that Trump's "impenetrable" border wall, built with $10 billion in tax-payer dollars (not Mexican pesos), is anything but impenetrable, as smugglers are said to be breaching it with a simple power tool available for under $100 at Home Depot.
  • And while he hasn't cancelled Native American Heritage Month, as some on the Internet were reporting on Monday, he has declared November, awkwardly, for the first time, to also be National American History and Founders Month, a pet White Powery swamp project of one of his top campaign funders.

With all of that failure and ineptitude and embarrassment and corruption --- from just the past several days alone --- you'd think this guy would be heading toward a blow-out landslide loss next year to whichever candidate or ham sandwich Democratic voters nominate to run against him in 2020. Indeed, Washington Post and ABC News today published new polling showing that, among currently registered voters, all five leading Democratic candidates (Biden, Sanders, Warren, Buttigieg and Harris) crush Trump in head-to-head national match-ups next year by anywhere from 17 to 9 points. While that could ultimately turn out to be true, that polling --- and a lot of similar surveys you will hear over the next year --- are of NATIONAL polling. We do not run national elections in this country. We run state-by-state electoral college elections for President.

And, on that score, the New York Times has a much more sobering --- and even chilling --- preview of where they find that things currently stand in the six battleground states (MI, PA, WI, FL, AZ and NC) that were said to have decided the election in Trump's favor in 2016. In those states, Trump is currently believed to be even with or defeating the top Democrats, according to the new polling, which may be either right or wrong.

There are many caveats on that poll as well. Either way, it should serve as a very loud, screaming, red flag, siren alarm bell for those who believe Trump couldn't possibly win re-election next year. Given the more-art-than-science nature of such polling and our incredible fragile and vulnerable electoral systems, he absolutely could win the election again next year (just as we warned, to little avail or notice, in 2016.) Thus, NOW is a great time to take action: What are YOU going to do next year to help voters vote? We discuss and offer a few ideas. It's time to take action.

On today's BradCast, it was (another) very bad day for Donald Trump, but a good day for Hillary Clinton, if anybody was able to notice, thanks to another shameful weekend by the mainstream corporate media. [Audio link to show follows below.]

Our stable genius President didn't make it any easier on himself by beginning his day with a grotesquely offensively comparison of his ongoing Constitutional impeachment inquiry to "a lynching". But it got far worse for Trump (if nowhere near as bad as an actual lynching), when his top diplomat in Ukraine, Bill Taylor, testified before impeachment investigators in the U.S. House. The veteran diplomat and foreign policy elder statesman spelled out, in no uncertain terms --- based on copious, contemporaneous notes --- that Trump had personally tied the release of nearly $400 million in military assistance for Ukraine to a quid pro quo requirement that Ukraine's President publicly commit to investigating Trump's 2020 political rival Joe Biden.

The testimony, according to House impeachment investigators, directly contradicts Trump, numerous top White House officials, and a number of Trump-appointees who offered earlier testimony. It also included a 15-page opening statement from Taylor, accurately described as "damning" by a number of Democrats.

Then, while you may or may not have heard about the news which was buried deep inside weekend papers on Saturday, the State Department --- Trump's OWN State Department --- concluded its years-long probe of emails sent to and from Hillary Clinton's private email server. The report, sent to Congress with little or no fanfare from either the media or the Trump Administration, found "no persuasive evidence of systemic, deliberate mishandling of classified information" by Clinton or anybody else in the Department.

The faux "scandal" that Trump, his campaign and his party disingenuously used to help propel him to office in 2016 has officially ended with a barely imperceptible whimper. That, even as top White House officials from daughter Ivanka Trump to son-in-law Jared Kushner to Steve Bannon to Stephen Miller to Executive Agency heads like Education Secretary Betsy DeVos have all since been found to have carried out government business on private email servers and have even reportedly shared classified information on private texting apps.

We're joined today by longtime media analyst ERIC BOEHLERT to discuss not only the phony "BUT HER EMAILS!" scandal that Trump falsely described during his campaign as "worse than Watergate" --- and which even today results in "Lock her up!" chants at his unhinged campaign rallies --- but the corporate mainstream media's dreadful failure and stunning "whitewash" of its own role in colluding with the Trump Campaign by constantly over-hyping the baseless charges in the run up to the fateful 2016 Presidential election.

"The email story does not exist without the Beltway press," Boehlert tells me, noting their coverage of the end of State Department's probe on page 16 (NYT) and 6 (WaPo) on Saturday. "Most of the network newscasts never even reported on the story over the weekend.

"This email story ran from March 2015 to November 2016," he rails. "This story rolled for months and months. If you take one peek, in September 2015, on average, if you look at the Washington Post --- print and online --- they were publishing two Clinton email stories every day for the month of September 2015. We forget how bad it was. Pick your adjective. Mind-boggling. Numbing. Irresponsible. Reckless. And what's important [is] to not let this happen again."

But, of course, it will, especially given the lack of contrition for this failure evidenced by the story's coverage this weekend. "These are smart people," he says. "They play dumb on an epic scale." Boehlert aptly compares the media's failure in becoming "hugely investigated in this story from the get to" to their similarly reckless coverage of the Bush Administration's claim that Iraq had WMD in the run-up to our disastrous war there beginning in 2003. He also goes on to offer warnings about the Administration's schemes to use the very same playbook in 2020.

"If you're concerned that we're going to have a repeat because the press not only refuses to learn any lessons from 2016, but doesn't even admit there are any lessons to be learned --- look at Joe Biden and the Ukraine. It's happening again. Not as bad as the other, because Trump has inadvertently impeached himself by publicly confessing to colluding with a foreign power. But we saw it in the beginning of this story, a lot of headlines, "Trump and Biden both tainted by Ukraine'. No, they're not. Let's not do that," he pleads.

We discuss why this seems to happen over and over (remember how the media fell for the John Kerry "Swiftboat scandal" in the 2004 campaign?) when it comes to the media's coverage of Democrats, what the media should have done both in 2016 and today, and what Americans can do to help avoid being taken for another predictable ride in 2020.

Our long road toward catching up with a month's worth of news continues on today's BradCast, with voting news out of Battleground Ohio, the latest on Trump's impeachment and chaos in Syria (and the thing that ties them together), as well as the latest environmental and climate news after a month away. [Audio link to show posted at end of summary.]

First up today: Some surprisingly good news for voters out of Ohio! The biggest surprise, perhaps, is that it comes, at least in part, thanks to the state's new Republican Sec. of State Frank LaRose, who had the good sense to check with voting rights groups beforewrongly purging some 40,000 perfectly active and eligible voters from the rolls who should never have been flagged for removal in the first place! Most of his fellow Republicans are likely not happy about that.

Then, we're joined by the great HEATHER DIGBY PARTON of Salon and Hullabaloo to discuss the latest impeachment news and Trump's deadly withdrawal of U.S. troops from northern Syrian.

The impeachment inquiry over Trump's attempt to withhold nearly $400 million in military aid to Ukraine in exchange for its President's trumped-up state investigation of Joe Biden and the 2016 election continues to gain steam, with half a dozen or more current and former Executive Branch officials now lining up to testify --- and not in favor of Trump or his lackey lawyer Rudy Giuliani --- to Congressional investigators. Trump's former Russia and Europe expert, Fiona Hill, testified for some ten hours on Monday, reportedly citing Giuliani's shadow foreign policy schemes meant to undermine U.S. foreign policy and personally enrich the President in some way.

According to reports of her deposition, her superior on the National Security Counsel, former National Security Advisor John Bolton, was so alarmed by Giuliani's efforts he described the former NYC Mayor turned Fox 'News' conspiracist as a "hand grenade who’s going to blow everybody up". Bolton reportedly tried to warn White House attorneys about Giuliani's many attempts to undermine U.S. Ukraine policy. Bolton himself, the unlikeliest of heroes in this shameful saga, may soon be called to testify to Congress in coming days, along with a long list of other State, Defense and National Security officials who now seem eager to defy the White House's strategy of denying both documents and testimony in the House Democrats' impeachment inquiry. "They're defying the White House telling them not to go testify," Parton observes, "That is a change. That is different than what we've seen. Suddenly that stonewall is crumbling."

We also discuss Parton's reasonable theory as to why this matter has finally resulted in House Speaker Nancy Pelosi giving full permission to her caucus to proceed with impeachment, where clear evidence of felony obstruction of justice from Robert Mueller's report and Trump's hush-money payoffs to porn stars to help win the 2016 Presidential election did not. "This is the same kind of stuff that Trump was accused of [in 2016], that we all suspected him of doing, colluding with a foreign government to sabotage his rival's campaign. Here he is [with Ukraine] doing it in real time. I think that's really what has made the difference."

In not-at-all-unrelated news, Parton goes on to discuss her latest Salon column in which she details how Trump's Syria pullout appears to be anything but an impulsive decision after a recent phone call with Turkish President Erdogan, as many in the media are still describing the disastrous move. She explains how the U.S. abandonment of our Kurdish allies with the U.S. withdrawal of troops from Northern Syria is of a piece with Trump's feckless Ukraine policy. In both cases, she explains, there is one unavoidable fact in common --- even for those of us who may not be Russia hawks: both actions, like so many other controversial policies of the Trump Administration, are in the clear and direct interest of Russian President Vladimir Putin.

Finally, we close today with the long-awaited return of the Green News Report, which we had been forced to suspend over the past month due to my family emergency. Somehow or another, Desi Doyen manages to fit in a month's worth of green news into the latest GNR in just six minutes. Buckle up --- and stay that way!...

On today's BradCast, we catch up with a grab bag of stuff, most of which doesn't have to do with Donald Trump's idiocy --- you're welcome --- but a lot of which has to do with what Americans need to do about him! [Audio link to full show is posted below.]

Among the many stories covered on today's program...

  • The front page of the New York Times now, officially, looks like a pre-2016 parody of what the Times might look like if Donald Trump were ever elected President;
  • Denmark still doesn't want to sell Greenland to the US. Why, after all, would its citizens want to give up "universal health care, free higher education, five weeks of annual paid vacation and 12 months of paid parental leave, subsidized childcare and more"? But the Premier of Greenland is, however, interested in buying the U.S.!;
  • Two-term WA state Governor Jay Inslee, the climate change candidate, drops out of the 2020 Presidential race, but accomplished quite a bit and will now run for a third term as WA Governor;
  • Former CO Governor John Hickenlooper, who dropped out of the Presidential contest a week or so ago, announces his run for U.S. Senate to take on vulnerable Republican Sen. Cory Gardner in an already very crowded field of Dems vying for the nomination. (But, ahem....hint, hint, O'Rourke, Castro and Bullock!);
  • And, on the Republican side of the aisle, "reformed" Tea Party Republican and former one-term House Rep. Joe Walsh appears set to announce plans to primary Trump from the right next year. If his recent, blistering NYTimes op-ed is any indication, in which he eviscerates Trump for, well, just about everything, he would be a welcome participant along with already-declared former MA Gov. Bill Weld and a few other potential GOP challengers that may be coming soon;
  • In more disturbing and much-less noticed news, 22 Texas towns have been simultaneously crippled by coordinated ransomware attacks that have shut down all computerized city services. The hackers are demanding some $2.5 million to restore services to the unidentified towns which may all have used the same private contractor for municipal IT services. The attack-via-contractor is reminiscent of the 2016 spearphishing attack on voter registration services vendor VR Systems as described in Robert Mueller's Special Counsel report. That attack appears to have resulted in penetration of voter registration databases in several Florida counties in 2016, and perhaps other states (such as North Carolina) serviced by the same private vendor.

    But, sadly, none of this has prevented states and counties around the country from moving swiftly to fully-computerized voting and tabulation systems, as well as computerized electronic pollbooks (all frequently serviced by a small group of private contractors) as we move toward the critical 2020 elections. If those any of those thousands of jurisdictions whose poling places now rely on such automated systems on Election Day --- often without paper backup for ballots or pollbooks --- were to be similarly crippled by a ransomware attack on or before Election Day, the result would be unimaginable chaos next year. But how likely is that, really? Why worry?;

  • Some voters in Georgia are, in fact, very worried, and justifiably so, about the state's newly certified, 100% unverifiable touchscreen voting systems now planned for first-time use in 2020. As we reported on the show a few days ago, those voters have invoked a little-known provision in GA's election code to demand a reexamination of the new systems which the state certified just weeks ago. The multipartisan voters charge Republican Sec. of State Brad Raffensberger violated state requirements in his initial certification, and failed to do any security testing at all. The Sec. of State's office now says the petitioners, who prefer state voters use verifiable hand-marked paper ballots systems, simply disagree with the "policy preferences" of the Georgia General Assembly and must pay the costs for the second examination themselves;
  • In similar-ish news here in Los Angeles County --- the nation's largest voting jurisdiction, which is also planning to move to new, 100% unverifiable computer touchscreen Ballot Marking Devices for the 2020 election --- the county's Registrar-Recorder/County Clerk Dean Logan is refusing to answer questions by voters on Twitter as to whether they will be allowed to vote on hand-marked paper ballots at the polling place this year. That has been a mandate by the CA Sec. of State for many years.

    Also, Logan has similarly failed to respond for several days to a generous offer by legendary Finnish cybsersecurity and voting systems expert Harri Hursti to examine the county's new, never-before-used-in-any-election BMD systems for security concerns. Hursti, the first to have hacked a Diebold voting system over a decade ago, runs the now-infamous annual Voting Village event at the DefCon hackers convention in Las Vegas --- where, year after year after year, enormous vulnerabilities are discovered in every voting system put before the attendees. Despite Hursti's offer, Logan has not responded to it via Twitter.

    Why has the previously communicative Logan gone so mum? He has been very outspoken on Twitter in the past, and still seems to have no problem citing L.A. Times stories about his new system there. (Perhaps because those stories shamefully fail to mention any of the many security and verifiability concerns about them, as cited by cybersecurity and voting systems experts.) Why is Logan, a long time, usually quite responsive and responsible election official no longer answering questions from his voters and media about such a huge sea-change in voting for some five million L.A. County voters?;
