On today's BradCast, we go well beyond the horse-race (though we cover that too) for substantive, smart and, yes, occasionally snarky coverage of last night's Democratic debate on PBS between Bernie Sanders and Hillary Clinton in Milwaukee, WI.

I'm happy to be joined once again today by journalist David Dayen of The Fiscal Times, Salon, The Intercept and everywhere else and health care reform advocate and journalist Jacki Schechner, formerly of CNN and CurrentTV.

It was the first debate following Sanders' dominating win against Clinton in New Hampshire on Tuesday, and the last one currently scheduled between the pair before the Nevada Caucuses next week, the South Carolina Primary the week after, and then Super Tuesday on March 1. So, a lot was riding on their face-off last night.

Among the issues we examine on today's show: Do Bernie's plans for single-payer health care and free college tuition actually "add up"? Is Hillary's attack on Bernie for criticizing Obama fair? Has she finally found a message that can work against the insurgent Senator? And what the hell is up with PBS' obsessive embrace of misleading Rightwing memes concerning the "size" of government?

On today's BradCast: Breaking news out of Oregon and California, more disturbing voter suppression news out of New Hampshire and elsewhere and a new study finds hard evidence that "racial resentment" is central to the so-called "Tea Party" movement.

First up, the latest breaking news on the bizarre and bitter end of the Rightwing militia standoff at the Malheur National Wildlife Refuge in Oregon and the concurrent arrest of Nevada's scofflaw rancher Cliven Bundy.

Next, more disturbing Photo ID voter suppression news out of New Hampshire and elsewhere, including a new paper out of UC-San Diego finding that strict Photo ID restrictions result in an alarming rate of suppressed Latino and African-American votes. In general elections, for example, based on examinations of some 50 elections in states both before and after implementation of polling place restrictions by GOP lawmakers, "states with strict photo ID laws show a Latino turnout 10.3 points lower than in states without them."

Then, after a brief throwback to the early days of the so-called "Tea Party" (our complete short documentary from 2009, Rise of the Tea Bags, can be enjoyed here), I'm joined by political science researcher Sean McElwee of Demos to discuss his new study, with Jason McDaniel, offering empirical evidence that it is not opposition to "Big Government" or concerns about the economy or spending or taxes that mainly drives those who identify as being sympathetic to the Tea Party --- it's racial resentment.

McElwee explains how his study controlled "for race, ethnicity, partisanship, ideology, income, education, gender, religiosity" and that "once you compare the various strengths of these variables, the one that ends up becoming really the overwhelming predictor of Tea Party identification is racial resentment."

"From the beginning," of the movement, he tells me, "what you're seeing is this sort of racially-coded rhetoric. So, right from the beginning, you have a very great explanation of conservative politics of the last 30 years --- which is plutocratic policies being wrapped up in racist rhetoric in order to benefit a plutocratic agenda. And you have a lot of white middle class and working class people who have bought into that agenda."

"What Fox [News] has done is taken that model and actually weaponized it, politicized it, and used it to attack policies that benefit the vast majority of Americans," McElwee argues, even as the Rightwing network's viewers have little clue how they are being played. "What we have in a lot of cases are people who are very frustrated about what is going on, but lack the political knowledge to actually understand the causal mechanism for how this bad thing is happening. And if you don't have that --- if you don't connect government policy to your lived experiences --- what you end up doing is saying 'I'm upset, I don't know why my life is bad'. And if someone tells you your life is bad because 'immigrants are taking your jobs', or 'the government is helping black people with your tax dollars', people are susceptible to that message."

McElwee goes on to explain how his research finds that many who previously identified with the Tea Party have now folded into the Trump campaign, even though the Republican 2016 front-runner has called for massive government programs and increased spending --- things that Tea Partiers previously decried. We also discuss much more, including whether hatred for Obama from the Right can be attributed to the fact that he is black or, simply, that he is a Democrat.

Finally, Desi Doyen joins us with the latest Green News Report and the breaking news out of Porter Ranch, CA that the month's long, massive methane gas leak there has finally been stopped...for now...

• And, Wheaton College shames itself still further by attempting to terminate a tenured professor because she believes Muslims and Christians "worship the same god".

On today's BradCast, more rightwing domestic terrorism in the U.S., more Scalia race-baiting, another rightwing challenge to minority voting rights heard by SCOTUS, and some potentially good news for the climate out of Paris. [Link to the full program follows below.]

First up today, another 'active shooter' situation plays out as we go to air. And, once again, the terrorist in question appears to be a rightwinger --- at least based on the 'Tea Party' flag on his pickup truck.

Next, we're joined by The Nation's Ari Berman, author of the recently published Give Us the Ballot: The Modern Struggle for Voting Rights in America, to discuss Evenwell v. Abbott, the somewhat astonishing rightwing challenge to minority voting rights heard this week at the U.S. Supreme Court (for some reason).

Despite the "One person, one vote" principal having been seen by most as settled law for about 50 years in the U.S., the Court took up a challenge to that idea brought by the same man who successfully challenged the Voting Rights Act --- which SCOTUS subsequently gutted --- back in 2013. Now comes the idea out of Texas that each state's legislative districts should not be drawn with an approximately equal population in each, as they are now, but rather an equal portion of eligible voters in each Congressional and state house district.

Redrawing maps in this way --- and it would likely need to be done in all 50 states --- would lead not only to chaos, but it have the effect of seriously undercutting minority voting rights, as Berman explains on today's program.

If the plaintiffs in Evenwell are successful, he observes, "many people who are now counted would be excluded, because they are not eligible voters, such as those who are under 18, those who are not U.S. citizens, both documented and undocumented [and] prisoners who have lost the right the vote. All of those people will not be counted [when drawing up legislative maps]. So if you look at the math itself...that will mean that 55% of Latinos, 45% of Asian-Americans, and 30% of African-Americans will not be counted towards representation. And that's why this case is such an attack on minority voting representation."

Few, including Berman, saw such a challenge coming, though perhaps we should have. The case, he tells me, is "brought by the same people that challenged the Voting Rights Act, the same people that challenged affirmative action, and seemingly everything they bring --- particularly this one guy, Ed Blum and his Project on Fair Representation --- everything he brings seems to be heard by this Supreme Court. It's literally like he's sitting around thinking 'What's the next way I can try to attack voting rights? What's the next way I can attack racial equality?' And they keep thinking of more and more creative schemes. And it like they're just going through everything that was done in the 1960s and challenging it --- whether it's the Voting Rights Act or the Fair Housing Act or it's 'One person, one vote'. All of these landmark achievements that have been so successful are now under attack, and this is just the next iteration of this."

After spending months researching for his book, Give Us The Ballot, Berman observes the fight against voting rights today is a continuation of the same fight that has been waged since the passage of the landmark Voting Rights Act half a century ago. "There has been a 50 year attempt to try to restrict voting rights. And one of the things that I've noticed is that there's always new ways thought up to try to roll voting rights back. And we've seen a dramatic escalation, I think, of a very old strategy...And they don't seem likely to stop anytime soon."

Berman details how the questions from the Justices at Wednesday's oral arguments to suggest that we are likely looking at another 5 to 4 split decision from the Court...one way or another.

Also today: Justice Antonin Scalia, the Donald Trump of the Supreme Court, offers remarkably offensive comments about African-Americans; Rush Limbaugh's guest host testifies on climate change (sort of) in Ted Cruz' U.S. Senate Science Committee hearing; And the U.N. climate conference in Paris (COP21) comes down to the wire and may be set to produce an even better global agreement than almost anyone had predicted...

On today's BradCast, Desi Doyen and I are finally back from a week of maddening illness over the holiday! My enormous thanks to Nicole Sander of RadioOrNot.com for her generously quick-footed and quick-witted guest-hosting in our absence!

First up today is a quick review of what we can (or can't) look forward to over the next two weeks in Paris, where the largest gathering of world leaders in history is now underway in hopes of carving out a "final" agreement to curb the global emissions that cause deadly climate change. We will have much more on the COP21 conference as it unfolds over the next two weeks.

Then it's onto the rightwing extremism --- from the Black Lives Matter protesters shot in Minneapolis to the attack at Planned Parenthood in Colorado Springs --- that took place over the past week. As we note, it wasn't ISIS or Syrian refugees threatening our nation last week. Rather, as made clear once again, "the call is coming from inside the house."

Finally, we are joined for the interview by independent journalist Brandon Smith of the blog Muckrakery. It was Smith's persistent work and FOIA requests and lawsuit (along with the efforts of independent activists and attorneys) that eventually led to the release last week of the Chicago PD dash-cam video showing the outrageous killing of 17-year old Laquan McDonald by Officer Jason Van Dyke who has now been charged with first-degree murder.

"The Freedom of Information Act," Smith explains, "can be used by anyone. So, if you're reading a news story and something sounds fishy to you, you can ask for any document or piece of information. It's your government. It's your responsibility, and mine too, to hold them accountable for what they do with their positions of power."

We discuss why it took more than a year for the Chicago Police to release the tape during its cover up of an apparent murder, whether Mayor Rahm Emanuel has responded sufficiently, and what we still do not know about the killing. (For example: What happened to the audio on that video tape?; What about the surveillance video allegedly deleted by cops at the Burger King?; Why didn't the corporate media file suit to get at the video themselves?; And what of all of those other officers at the scene who failed to take action, or lied about it, after witnessing Van Dyke pump 16 bullets into McDonald --- the first two while he was walking away from them, the other 14 while he was shot, on the ground, and a threat to nobody?)

"I'm just trying to report the story of police brutality in Chicago," Smith tells me while describing how much remains unknown and what he plans to FOIA next. "We want to know who knew what about the case, and how long they kept it hidden, and kept that story out there that Laquan was acting erratically and threatening officers. Not only that, but keeping the video secret and fighting the release of the video which would tell people this was a murder, according to the prosecutors."

All of that and more today on what is clearly just the tip of the very bad and racially-based policing in the Windy City and beyond...

And I couldn't help but wonder if the blatant bigotry displayed by some of the Republican presidential candidates could be emboldening others to let their inner racists loose.

On today's BradCast, the power of protest and organization.

We start at the University of Missouri after African-American players on the football team there used their power over the weekend to collectively and courageously support a student hunger strike in a protest to force university system President Tim Wolfe to resign amidst a series of racially charged incidents on the Columbia, MO campus. The leverage used by the players is another great reminder of how smart and courageous protest can succeed in making substantive change --- even against some of the world's most powerful entities. Go Tigers!

Speaking of which, my guest today is, once again, Douglas Hughes. You may recall him as the 61-year old Florida postal worker who landed his homemade gyrocopter on the West Lawn of the U.S. Capitol in a dramatic protest last spring. He was our guest back in April, just days after the incident where he had hoped to bring attention to the desperate need for campaign finance reform.

He was, at the time, arrested and charged with six felonies that might have netted him more than 9 years in jail for his attempt to deliver an important letter to all 535 members of Congress. Now, he has struck a plea deal with federal prosecutors and joins us to discuss the deal, why he took it, the latest developments in his case, and whether he feels his protest was ultimately worth the extraordinarily high cost.

Hughes tells us today that he has "no regrets" for having "stomped on the dragon's tail", despite losing his job at the Post Office, facing enormous fines, jail time, and even the loss of his ability to vote as a "felon".

"I stomped on the dragon's tail and I knew it was going to turn around and come after me," Hughes tells me. "And it has, and I have no regrets."

He credits the flight with helping to broaden the discussion about the need for reform, and says, despite the extraordinary cost, he'd do it again "in a heartbeat" as he continues his call for a "voters rebellion" to help "get the money out of politics so everybody that's in Congress knows they've got to answer to us."

Though Hughes was reluctant to mention it, he has a GoFundMe page where folks can donate to his legal defense fund and other needs as he is now struggling to survive day-to-date until his Social Security finally kicks in. Please consider helping him out if you can!

"In 1938," according to the online civil rights organization, Color of Change, "civil rights activist and poet Langston Hughes wrote his chilling poem 'Kids Who Die' which illuminates the horrors of lynching during the Jim Crow era." Hughes presciently foresaw a civil rights movement, later carried out in the 1950s and 1960s, that would counter racial segregation and hatred with interracial solidarity and love.

This Danny Glover narrated, Frank Chi and Terrance Green video demonstrates the ongoing relevance of "Kids Who Die" and underscores why the #BlackLivesMatter movement must be a critical component of a just and equitable future. Please take less than three minutes to watch it...

We've got a big BradCast today, with on-the-ground reports from Ferguson, the huge Bernie Sanders rally in Los Angeles and an extended portion of an exclusive interview with Sanders himself.

First, we check in with Cassandra Fairbanks from our affiliate Sputnik News. She's in Ferguson covering the protests of the police killing of Michael Brown one year after his death and the birth of the Black Lives Matter movement.

Fairbanks was, incredibly, arrested yesterday while covering one of the demonstrations as a journalist. "They started arresting everyone," she tells me in detailing the incident. "I said, 'You know I'm press, and [the police officer] was like, 'I don't care, you're going to jail.' It was arrest first, ask questions later."

She also reports that white, militant rightwing protesters, openly carrying semi-automatic weapons in Ferguson, are being left alone by the St. Louis County police while local black protesters are receiving an entirely different treatment for the mere suspicion of being armed.

Then, 'feeling the Bern' in L.A. after 2016 Democratic Presidential candidate Bernie Sanders drew some 28,000 supporters to the L.A. Memorial Sports Arena out here last night, following only slightly smaller crowds over the weekend in Portland and Seattle where he also faced a small, but intense protest from self-proclaimed members of the Black Lives Matter movement.

We detail how Sanders' campaign appears to have deftly adjusted course in the wake of that and a similar protest in Phoenix last month, but how big questions about his foreign policy positions still linger for many progressives. (Our recent interview with author and peace activist David Swanson on that latter issue is back here.)

Former BradCast associate producer Margot Paez interviews Sanders supporters at the raucus L.A. event on the foreign policy questions, and then Nicole Sandler, of our affiliate RadioOrNot.com, presses Sanders himself on the matter in an exclusive interview!

"If you have an aggressive foreign policy, if you think the United States should have ground troops in the Middle East, if you think we should be engaged in perpetual warfare, well, then you're going to have a larger military budget," Sanders tells Sandler. "Needless to say, that's not my view. I think organizations like ISIS and al Qaeda, very dangerous organizations, have to be combated and have to be defeated. But it can't be the United States alone," he says.

He discusses, if somewhat vaguely, his position on aiding partners in the Middle East and argues that "we can make judicious cuts in military spending without harming our ability to defend ourselves."

It was a much bigger show today than we had expected when we started it!

First up on today's BradCast, author, peace activist David Swanson joins us to discuss Obama's speech today at American University on the Iran Nuclear Agreement. While Swanson is (somewhat uncharacteristically) optimistic and encouraged by the deal, he has concerns about how Obama and other Dems are misleading Americans in order to sell it. "I love that, for once, President Obama wants peace. I love that, for once, he's using diplomacy rather than war. I wish he would use that in eight other places on earth," Swanson tells me. "But at the same time he's pushing the propaganda of his opponents."

Then, Swanson asks, "Why Won't Bernie Talk About War?" A new petition from RootsAction.org asks Democratic Presidential candidate Bernie Sanders to start speaking up against U.S. militarism which, as Swanson argues, the U.S. Senator from Vermont has, up until now, been very reluctant to do for some reason.

Then, as we went to break, huge news came in from the very conservative 5th U.S. Circuit Court of Appeal striking down the Texas GOP's polling place Photo ID restriction law. The opinion confirms most of a lower court judge's previously ruling finding the restriction to be in strict violation of the Voting Rights Act as well as the U.S. Constitution. Constitutional law expert Ian Millhiser joins us to explain the very encouraging opinion from the court --- which comes, incidentally, just one day before the 50th Anniversary of the Voting Rights Act of 1965 --- and what happens next.

"The court got that voter ID laws do not really serve the purpose that their supporters say they're supposed to serve," Millhiser explains. "The court got that this was an attempt to dress up something that looks like a legitimate voter regulation in order to really do something else, which was to prevent groups like racial minorities and low-income voters who tend to prefer Democrats over Republicans from casting a ballot."

But, he also warns, "this wasn't a total victory for the good guys." Listen to the show for all the details.

Finally, in the few minutes we have left, we squeeze in some Presidential politics in advance of tomorrow night's first GOP Presidential debate, as sponsored --- and rigged by --- Fox "News". And, yes, that Republican debate will take place, ironically enough, on the 50th Anniversary of the landmark federal Voting Rights Act which Republicans used to support...until they decided they couldn't win elections anymore if all those "people" (read: qualified American voters who tend to vote Democratic) were allowed to vote.

Very good news, just breaking today from the 5th U.S. Circuit Court of Appeals in Texas!...

See Ian Millhiser over at Think Progress for more, as well as Rick Hasen at Election Law Blog for additional analysis. The court's opinion is here. [PDF]

We'll have more on this in The BradCast later today (and an explanation of some of the nuance here that, while it's a huge victory for voting rights advocates, the plaintiffs in the case have not yet won everything they had hoped for --- specifically, they wanted Texas to be required to pre-clear new voting laws with the federal courts from now on, as the state had to previously, before the U.S. Supreme Court gutted the Voting Rights Act in 2013.) On that issue, it appears the matter will be sent back down to the lower court, to establish whether their is strong enough evidence to prove the law was enacted with discriminatory intent, or whether it just had that effect. If the latter, striking down this version of the law will be enough. If the former, TX would have to get federal approval for such laws in the future --- and that would be a very big (and good!) deal.

But, for the moment, this is very good news for those of us who believe in the Right to Vote. And, by way of reminder, this is what we had noted late last year when the judge in the lower U.S. Circuit court in Texas absolutely eviscerated the law passed by state Republicans after a full trial...

First, a quick update on a conversation we had last week with FBI Special Agent turned 9/11 whistleblower turned TIME Magazine's 2002 "Person of the Year", Coleen Rowley. We had her on to speak about the difference between terrorism and hate crimes, as defined by the federal government, and as randomly applied after the (apparently non-terroristic) race-based hate crime shootings in Charleston, SC versus the shootings at U.S. Marine facilities in Chattanooga, TN last week. The latter which is being investigated as "terrorism". (My full conversation with Rowley from last week is here.)

During the discussion, Rowley noted how the difference between "terrorism" and "hate crimes" seems to be "clear as mud" to FBI and federal prosecutors, with "terrorism" charges now "uniquely set for Muslims or for Arab nations". But she also mentioned how terror charges are also applied to animal rights activists, specifically mentioning "mink farms". While we didn't have time to discuss that aspect last week, the very next day, news broke about the arrest of animal righs activists who'd released thousands of mink across the country. The crimes they are charged with, according to AP, "terrorizing the fur industry...under a conspiracy to violate the Animal Enterprise Terrorism Act."

Next, we're joined by Dr. Michael E. Mann, climate scientist, Distinguished Professor of Meteorology and Director of the Earth System Science Center at Penn State University, creator of the infamous "Hockey Stick" graph, and author of more than 160 peer-reviewed publications, as well as the book The Hockey Stick and the Climate Wars: Dispatches from the Front Lines to discuss last week's "bombshell" new study from NASA's former chief scientist Dr. James Hansen, warning that sea level rise of 10 feet or more is likely to happen much sooner than scientists previously expected. It could happen even as early as 2050.

Mann tells me Hansen's disturbing study suggests that "climate change is proceeding faster, and it's larger in magnitude than what the IPCC [UN's Intergovernmental Panel on Climate Change] reported. And that's been true at every juncture. We have tended to underestimate the rate and magnitude of the changes...What Hansen has shown is that indeed there is reason to at least suspect the possibility of a worst case scenario that is a lot worse than anything the IPCC talks about."

We also discuss the politics of this entire fine mess and the irony of 2016 GOP Presidential candidates Jeb Bush and Marco Rubio, both of Florida, denying the realities of the science --- each in their own way --- as their own state will be among the first to begin to disappear. That, of course, is only if Hansen is right --- as he has been in pretty much every case since he first rang the alarm about global warming in the U.S. Senate back in 1988.

"If we had acted when we already knew that there was a potential problem [back in 1988]," says Mann. "If we had acted then, then the emissions curve would be a bunny slope...a pretty gradual, smooth transition. It wouldn't be very hard to do, it wouldn't be very expensive. Before we get to Hillary Clinton and the awful truth about her climate plan and climate change itself on today's BradCast, Bernie Sanders is now leading all the major Republicans in national polling now.

That's right, in head-to-head national match-ups between the independent U.S. Senator from Vermont and Jeb Bush, Scott Walker or even Donald Trump, Sanders wins the Presidency --- if the election was held today, and those who wanted to vote got to vote (and got to have their votes counted as intended) --- according to a new CNN/USAToday/Gallup poll.

Nonetheless, the corporate media still loves to ignore Sanders. Though, thanks in part to the #BlackLivesMatter protesters that interrupted him during a progressive forum last week (the intra-progressive controversy we've been covering over the past week), he was finally allowed to appear on Meet the Press over the weekend.

Also, over the weekend, Trump continued to widen his lead against the rest of the Republican field and Hillary Clinton offered a tepid plan on how she would begin to deal with climate change.

We speak on today's show to David Roberts, the great environmental journalist from Vox.com (formerly of Grist.org), about Clinton's plan and the awful truth about both her plan and everyone else's.

"It's so polarized between the parties that Hillary can say anything she wants," Roberts tells me about her plan to add half a billion solar panels to the nation's grid by 2021. "But, as long as the House is in Republican hands they are foursquare against any of this --- any clean energy, any efficiency, anything that restrains fossil fuel in any way...If we're being honest with ourselves, what she's capable of doing is what the Presidency can do without legislative help."

Roberts is not optimistic about where the planet is headed, and holds scientists partially responsible for not being straight with the public about how bad things really are. He says "it's still physically possible" to save ourselves from where we're headed, "but it would mean the entire world shifting, basically, to a war footing in the next five years, and remaining on war footing for the next century. It's possible, but do you see anything around you that indicates that's going to happen? We're not doing it. So I think that it's worth at least saying, hey guys, we're headed for the shit. At this point, we're probably going to get mired in some really terrible stuff."

Despite those thoughts, it's actually an enlightening and entertaining discussion with Roberts! Finally, to close things out today (and cheer you up even more!), the U.S. House passes a bill to make it illegal for states and local governments to require consumer labeling of GMOs --- because, ya know, Republicans "hate" Big Government and are all for "local control" of issues.

Over the weekend, #BlackLivesMatter protesters disrupted a political forum featuring Democratic Presidential candidates Bernie Sanders and Martin O'Malley at the progressive Netroots Nation conference in Phoenix, AZ.

The leader of that lively and lengthy (and, apparently, controversial) protest, Tia Oso, National Coordinator of the Black Alliance for Just Immigration (BAJI) joins us on today's BradCast to explain why she did it and to discuss the reactions from O'Malley, Sanders and the progressives who support them.

"We talk a lot. There are a lot of town halls. We have NAACP and Urban League at the national level having these conversations all the time. Reports are issued. And the fact that it takes almost a spectacle of black suffering for people to even have their hearts moved is heartbreaking to me," Oso tells me.

While the "news" networks covered Donald Trump and his comments about John McCain all weekend, we cover a bit of what they did not on today's BradCast.

First, the climate crisis comes home, as two different climate change-related disasters on California and Arizona freeways over the weekend (one drought related, one flood related) were averted --- just barely.

Then, we're joined by Dr. Yosef Brody, president of Psychologists for Social Responsibility to discuss the disturbing new independent 542-page report [PDF] commissioned by the American Psychological Association (APA), confirming that top officials at the APA colluded with the Bush Administration to approve CIA and Dept. of Defense torture techniques after 9/11. The APA then spent the next decade covering it up and smearing the whistleblowers at Brody's organization.

The findings of the new report, and the scandal in its wake, has touched off a shakeup at the top echelons of the organization. The report by a former federal prosecutor reveals "a complete and utter failure of psychological ethics," Brody tells me. "What it's saying is that what we critics have suspected for about a decade now --- that senior [APA] staff have been currying favor with the Pentagon and the CIA, effectively facilitating torture. And to top it off, they've engaged in this very sophisticated, decade-long coverup."

It was all done, he explains, to protect the Bush Administration from legal liability for war crimes, allowing them to describe their "enhanced interrogation techniques," with the blessing of the APA, as "safe, legal, ethical and effective", when they were anything but.

"This is really about a culture of corruption at the top of the largest organization of psychologists in the world," says Brody, about the APA's complicity. "We're talking about war crimes here, ultimately. And we're talking about a health professional association!"
