Last week, Federal Election Commission (FEC) disclosures for the 2016 Presidential contest confirmed that wealthy Super PAC donors are now spending more than three times as much as small donors. As Politico describes the "gusher of cash" now pouring into American elections from millionaires and billionaires, the "67 biggest donors, each of whom gave $1 million or more, donated more than three times as much as the 508,000 smallest donors combined."

At the same time as that obscenity plays out, a select few GOP Presidential candidates auditioned for the Koch Brothers and rich friends over the weekend in California, where Charles Koch compared their political fight to the Civil Rights Movement. Seriously. Politico's Tarini Parti, joins us on today's BradCast to discuss all of the above and Politico's own controversial role in the weekend confab.

Then, Chuck Lindell of the Austin American-Statesman joins us to discuss today's indictment and arrest of Texas' brand-new Attorney General Ken Paxton (R-Tea Party) on three felony counts related to securities fraud. Thanks to a law Paxton helped pass when he was a member of the TX House, he could now be facing life in prison if convicted on the charges being brought by Special Prosecutors (one of whom was formerly Republican U.S. House Majority Leader Tom DeLay's defense lawyer). The indictment is in response to a complaint filed by one of Paxton's fellow GOP statehouse members. None of that, of course, has kept the state's Republican Party from declaring the entire matter to be a partisan witch hunt.

Lindell also updates us on the status of Texas' even more notorious felony indictment, the one against the state's former Governor and current GOP candidate for the 2016 Presidential nomination, Rick Perry. The trial in that case, Lindells tells me, "could take place as early as December --- or right before primary season opens up" in January.

Finally today, President Obama unveiled the new EPA rules for cutting carbon emissions at power plants in all 50 states by some 30% over 2012 levels. Can you hear the wingnut heads exploding?...

We have a number of encouraging items on today's BradCast, believe it or not, regarding elections and campaign finance for a change.

But first today, after an emotional debate in South Carolina, the Confederate flag will finally come down at the state capitol on Friday - clearing the way for debate on stuff that may actually reduce gun violence, racism and terrorism. But in the U.S. House, it's business as usual as the GOP fails on a Confederate flag-related amendment.

After that, another reminder why Internet Voting would be a disaster, and a bit of Trump news (which I know you crave every single moment --- don't lie!), some very good news today from the Florida Supreme Court on redistricting and even more good news from the U.S. Court of Appeals in D.C. on campaign finance.

Hamline University professor of political science and law David Schultz --- author of last year's Election Law and Democratic Theory and the upcoming Presidential Swing States: Why Only Ten Matter --- joins us to discuss those cases and four important steps he's laid out which could be taken immediately to reform our nation's campaign finance embarrassment. The best news: none of the steps require either a Constitutional amendment or our broken Congress! (Though it might require the President of the United States to step up.)

Among those steps, the FCC, for example, could immediately require free airtime for candidates over our public airwaves. "About 60-70% of all the money that will be spent in Presidential elections will be spent on media advertising predominantly on television," Schultz explains. "Forty years ago, the average time that a candidate got on the national news to describe his or her position was about a minute. Now it's down to about ten seconds."

"Requiring that free air time would be perfectly Constitutional" in exchange for licenses granted by the FCC. "If the FCC can move on Net Neutrality, it can move on this." But that's just one of several executive agencies which the President could instruct to take action without the need for Congress or amendments to the U.S. Constitution.

Fallout continues --- much of it surprisingly encouraging, thankfully --- following last week's racist terrorist shooting at the Emanuel AME Church in Charleston.

In its wake, I spoke to Sean McElwee of Demos on today's BradCast about his new study comparing the racist views of white Fox 'News' viewers versus white non-Fox 'News' viewers, and self-identified "conservative" Fox 'News' viewers with "conservatives" who don't watch Fox.

He describes the findings as "a deep indictment of the way that Fox News portrays the news." The analysis also examines whether regular viewers of Fox' The O'Reilly Factor are more racist than Fox 'News' viewers who do not regularly watch O'Reilly. The results, as they'd say on The Factor, will shock you! (Or not.)

"It's very clear that Fox News is playing on the racism and the latent racial resentment of many whites in the country," McElwee tells me. "You can see that on their coverage of the 'ground zero mosque'. You can see that on their coverage of the Trayvon Martin case. It's very clear." But does that racist coverage rub off on their viewers or vice versa? We discuss, you decide.

Rove, Republicans & the broken FEC w/ Craig Holman of Public Citizen...

On today's BradCast...Jeb Bush makes it official! (But don't notice his brother!) Who could have guessed he'd run, after spending so many months violating federal campaign finance laws? And Hillary launches her campaign with a rally on Roosevelt Island in NY, promising to support a Constitutional amendment to overturn Citizens United and "end the flow of secret, unaccountable money distorting our elections".

Public Citizen's Craig Holman joins us to discuss all of the above and how "we are now being besieged --- in the last election it was $300 million --- by dark money. Money that influences our elections, but we have no idea where it came from."

More specifically, Holman discusses how Republicans on the Federal Elections Commission (FEC) continue to block any and all enforcement of existing campaign finance law, as seen in the organization's ongoing lawsuit attempting to hold Karl Rove's Crossroads GPS accountable for campaign finance violations from as long ago as 2010!

"Just as big of a problem, when it comes to enforcing our campaign finance laws, is the Federal Elections Commission," Holman says, while explaining again how the FEC has become purposely paralyzed by its three Republican commissioners who flatly refuse to enforce existing statutes. "When [the FEC] cannot act and when it cannot make a decision, we literally have no cop on the beat when it comes to money in politics."

His use of the word "literally" there, is literally correct, for a change. That's right, even without the Supreme Court's infamous Citizens United decision --- even if it eventually gets overturned somehow --- unless the courts or the DoJ step in to take control of the matter (which, he explains, they actually can!), the GOP and their operatives on the FEC will allow campaigns to get away with campaign finance murder during yet another Presidential election. Listen to today's show for much more on this. But, yes, Citizens United ain't the half of it...

I've been having sort of a running conversation/debate with author, comedian, friend and KPFK/Pacifica Radio colleague Jimmy Dore ever since the Charlie Hebdo massacre in Paris. He heard my take on the shootings, as discussed on KPFK at the time, and picked it up (a less generous person might say, misinterpreted it) on his own show.

We then had it out on his show and, finally, with the weekend shootings in Garland, TX at a rightwing group's event offering $10,000 for the most offensive cartoon featuring the prophet Mohammed, it seemed like a good time to pick up that conversation to see if either his or my views have changed.

So, Jimmy was my guest on today's BradCast and I think you'll enjoy the discussion!

Also, Bernie Sanders' refreshing words on a Sunday network news show; Carly and Carson both jumped into the 2016 GOP nomination clown car; one encouraging moment in Nepal amongst unspeakable tragedy following their recent devastating earthquake; the FEC continues to be dysfunctional, with one of their chairs now out-and-out noting that campaign finance regulations are unlikely to be enforced during the 2016 Presidential elections, despite record "dark money" set to be spent on them.

Documents reveal Commissioners at war over defending lawsuit charging the agency is failing to enforce campaign finance law

While Congressional Republicans are busy filing a lawsuit against President Obama, in a purported attempt to bring accountability for...failing to enforce the law...or something, Republican Commissioners on the Federal Elections Commission (FEC) are going to extraordinary lengths to avoid enforcing the law.

In the bargain, its GOP Commissioners are railing against their fellow Democratic Commissioners for attempting to bring accountability for actual violations of federal campaign finance law, turning the facts of the case on its head, and publicly attacking their colleagues as "strident" obstructionists, eschewing the rule of law.

Yes, it's another breathtakingly twisted chapter from the unending Partisan Wars of 2014, although a rather important one with potentially far reaching consequences for the nation, as those paying attention might notice --- though few seem to be...

After a recent three-to-three decision by a partisan-deadlocked Federal Elections Commission (FEC), Karl Rove may have thought he was off the hook for federal campaign finance violations by his Crossroads GPS organization. Two non-profit, good government groups, however, feel differently. Last Friday, they filed a federal lawsuit [PDF] against the FEC in hopes of forcing the agency to reverse its ruling, revisit the complaint against his group's 2010 electioneering, and to enforce federal campaign finance rules as specified by law.

Late last Friday, Attorneys from the non-partisan Campaign Legal Center and the Public Citizen Litigation Group filed a civil complaint against the FEC in U.S. District Court in Washington D.C.

The suit seeks to reverse what the plaintiffs describe as an "arbitrary" and "capricious" decision by the three Republican FEC Commissioners, in contradiction of the advice of their own staff attorneys, to dismiss the administrative complaint the groups had filed against Rove's organization. That administrative complaint charged that Rove's group violated federal campaign finance law during the 2010 election cycle.

The votes by the three Republican FEC Commissioners effectively quashed any further official investigation into the allegations that Rove's group violated the Federal Election Campaign Act of 1971 (FECA) when it spent the majority of its money during the 2010 election cycle on electioneering, but failed to register as a "political committee" with the FEC, as required by law. Their decision to shut down the investigation came after what the FEC's own staff attorneys found to be a likely violation of the federal campaign finance law.

By dismissing the administrative complaint and shutting the door on the investigation, the Republican FEC Commissioners not only allowed Rove to keep, as a secret, the identity of donors of tens of millions of dollars used to support Republican Congressional campaigns in 2010, but effectively offered Rove carte blanche to conceal donor identities with respect to monies spent in subsequent elections, such as the 2012 election cycle in which Crossroads GPS "spent at least $71 million on federal campaign activity," according to the newly filed federal complaint.

The plaintiffs charge that the FEC's deadlock was the result of "an impermissible interpretation of FECA," and the agency's own published guidelines due to an "abuse of discretion" by the Republican commissioners in a manner that was "otherwise contrary to law"...

A number of unhappy "good government" groups will file a lawsuit against the Federal Election Commission next month, in hopes that the courts will force the FEC to enforce the federal campaign finance laws that the FEC is, supposedly, there to enforce.

The organizations are particularly unhappy about Karl Rove's Crossroads GPS "behemoth" outfit, which has raised hundreds of millions over the last several years to elect Republican candidates to office, recently receiving a pass from the FEC, even after the agency's Office of General Counsel found reason to believe Rove's group clearly violated campaign finance laws.

The news about the groups' intention to file suit was offered on the KPFK/Pacifica Radio BradCast this week by my guest, Craig Holman, the Government Affairs Lobbyist for Public Citizen's Congress Watch. Public Citizen, along with the Campaign Legal Center, Center for Media and Democracy, and Protect Our Elections filed the initial complaint over campaign spending in 2010 by Rove's then new non-profit 501(c)(4) organization. They now plan to sue the FEC for failing to do their job, Holman explained on the show on Wednesday. [Disclosure: Protect Our Elections is a campaign created by VelvetRevolution.us, an organization co-founded by The BRAD BLOG, though we weren't personally involved with either the complaint or the upcoming suit.]

"What's happened with the Federal Election Commission is," Holman explained during my interview [posted in full at the end of this article], Senator "Mitch McConnell [R-KY], back in about 2008, realized that even though he can't get Congress to rescind campaign finance laws --- and he certainly can't sell the public on rescinding campaign finance laws --- he realized that if he were to appoint three Republican Commissioners to the FEC, he could ensure that the campaign finance laws don't get enforced. And that's exactly what has happened." Holman detailed how three-to-three deadlock votes on whether to pursue further action in most of the campaign finance rulings by the three Democratic and three Republican Commissioners on the FEC has increased "nine-fold" since 2008. A deadlock vote effectively ends the matter, even if wrong-doing had been found by the investigative staff, as is the case here.

In the original complaint against Rove's Crossroads GPS, the FEC's Office of General Counsel (OGC) found that the group had spent a majority of its funding on campaigning in 2010. If so, that's a violation of the law, since Rove's group should have filed with the FEC as a political committee, rather than as a 501(c)(4) which is supposed to be a non-electioneering "social welfare" organization. As a political committee, funders would have to be immediately disclosed, but as a (c)(4), the identity of those funding Rove's organization can remain a secret....

With mega-media conglomerates killing Progressive talk radio and licenses coming up for renewal, will the Feds finally do their job in Wisconsin and elsewhere?...

There is a little known ritual that occurs in the election years when Democrats prevail: Big "Conservative" Media starts to pull progressive talk radio off the air.

I documented this in my 2009 documentary film, Broadcast Blues: after Democratic candidates made big gains in 2006, Clear Channel and other public airwaves radio licensees pulled several well performing progressive talk radio stations off the air, and replaced them with sports and other programming. It would be easier to understand if the new programs got big ratings bumps, but that didn't happen. The new shows' ratings are typically only half those of Progressive Talkers.

True to form, Clear Channel Communications, which owns about 850 radio stations nationwide, took the Progressive voices off of the public airwaves in Portland, Oregon just days after Democrats won big nationwide. When devoted listeners tuned in to Portland's 620 AM, they expected to hear Thom Hartmann, Mike Malloy and other Progressives waxing exuberant in the wake of this year's election results and looking forward to new possibilities in the new session of Congress under a wildly popular re-elected President. Instead, they heard fans exuberant over some football game or other. FoxSports620 now broadcasts over that 25,000 watt frequency on our public airwaves.

Bye bye lefty talk, hello left-handed quarterbacks.

It isn't like Portland needs another sports radio station; there are already two in that very same market. But the community does need to hear an alternative to the "conservative" talk which is broadcast on eight, count them, eight separate frequencies on Portland's radio dials.

But as of November 9th, as reported here on The BRAD BLOG, Portland joined the ranks of the other 95% of the country which can hear many stations spewing Right Wing propaganda [PDF], but not a single one broadcasting progressive points of view. A few days later, we learned that the CBS-owned Progressive station in Seattle --- also in one of the most progressive cities in the nation --- is scheduled to disappear, most likely on the first of the year. It's KPTK caller letters have already been changed to KFNQ (Fan Q) in preparation for the all sports station it is scheduled to soon become, unless something changes.

Freedom of political choice vs. slavery in post-'Citizens United' America...

In a case where the employment of several members of the United Public Workers (UPW) was terminated after they failed to fully participate in unpaid, off-duty campaign activities on behalf of a union-supported Congressional candidate, three Republican members of the Federal Elections Commission produced an astounding Aug. 21 decision. They ruled that it is perfectly lawful for unions and corporations to compel their members and employees to engage in such activities, sans compensation, as part of "independent campaign efforts."

In their "Statement of Reasons" [PDF], the three GOP Commissioners explained the basis for their remarkable ruling.

They acknowledged that the Federal Election Campaign Act of 1971, 2 USC §441b(a), as well as FEC "regulations prohibit a labor organization [or a corporation] from facilitating the making of a contribution by means of 'coercion, such as the threat of a detrimental job action...to make a contribution or engage in fundraising activities on behalf of a candidate." But, they wrote: "These provisions do not apply to UPW's independent campaign efforts."

UPW's independent use of its paid workforce to campaign for a federal candidate post-Citizen's United was not contemplated by Congress and, consequently, is not prohibited by either the Act or Commission regulations.

The FEC's three Republican appointees thus presented not only a novel but a remarkable extension of Citizens United given that 2 USC §441b(c) makes it "unlawful" even for a corporation's or union's "segregated fund" to provide "anything of value" that is secured by a threat of financial reprisal. The statute mandates that employees must be told about their "right to refuse to so contribute without any reprisal."

In their separate "Statement of Reasons" [PDF], the three FEC Democrats, along with Office of General Counsel (OGC), found a clear-cut violation of Section 441b. "Nothing in Citizens United," the FEC Democrats opined, "suggests...that the Court intended to expand the rights of corporations and unions at the expense of their employees' longstanding rights to be free from coercion and to express or decline to express their political views."

According to the Congressional Research Service [PDF], at least four votes are required for the FEC "to exercise core functions." Thus, the 3-3 deadlock prevented the FEC from disciplining the union for anything beyond the fine for non-reporting of the "independent expenditure."

Setting aside the fact that the OGC's and FEC Democrats' interpretation appears to find direct support in the language of Section 441b of the U.S. Code, there's a fundamental constitutional issue that arises from the disturbing GOP interpretation of Citizens United which neither side addressed --- slavery!...

For Hunter to be disbarred, for Blankenship to be arrested...

Following on Brad Jacobson's investigative expose last month at RAW STORY concerning GOP operative turned EAC commissioner turned FEC commissioner Caroline Hunter, Velvet Revolution.us (VR) has filed a complaint [DOC] with the DC Court of Appeals asking for her disbarment based on the purposely misleading statements she offered under oath in a federal court hearing concerning allegations of voter suppression by the RNC in Ohio in the final days of the 2004 election. And in other accountability news, VR's StopTheChamber.com campaign called yesterday for the arrest of Massey Energy CEO and U.S. Chamber of Commerce Director Don Blankenship for being "criminally culpable as any mass murderer," following the deaths of 29 miners at Massey's Upper Big Branch mine in West Virginia last week. GOP operative Caroline Hunter could face disbarment, according to first in series of investigative reports at RAW STORY

[Updated below with details on the second part of Jacobson's series, just posted at RAW STORY, in which he ties together Hunter's EAC appointment and dubious tenure, representing the RNC's nefarious "voter fraud" fraudster wing (which is to say, pretty much the entire RNC these days!) The second in the series offers important info and a good reminder of the names you'll be seeing again soon, singing the same old phony, discredited "voter fraud" songs once again as November nears, as sure as the sun rises in the East.]

Brad Jacobson has filed the first in a series of exclusives at RAW STORY concerning GOP operative and Bush-appointed FEC commissioner Caroline Hunter. [Disclosure: Jacobson has blogged at The BRAD BLOG in the past.] Here's the lede for his first excellent investigative report yesterday:

Caroline Hunter, a Bush-appointed Federal Election Commissioner who remains in office, provided misleading statements under oath in an effort to conceal Republican National Committee involvement in vote suppression activities during the 2004 presidential election, a Raw Story investigation has found.

Legal experts say Hunter's submission of such statements under oath is a serious ethical and professional breach which could warrant a bar review and potential disbarment. At the time, Hunter was serving as deputy counsel to the Republican National Committee.

The report goes on to detail how Hunter --- who, as The BRAD BLOG has highlighted over the years, had previously been allowed to serve as a commissioner on the U.S. Election Assistance Commission (EAC) --- deceptively misrepresented the facts, on behalf of the RNC, in a 2004 voter caging hearing in federal court.

Jacobson quotes election law experts, including two long-time former DoJ Voting Section attorneys, who argue that while the way she couched her sworn testimony may "shield her from perjury charges," the statements she gave may "still pose ethical problems that potentially could result in her disbarment."...

Brad Takes on the Unapologetic Democracy-Hater on Tavis Smiley's Radio Show
PLUS: Taking on John Fund, Another GOP 'Voter Fraud' Scammer, on the Radio, the Following Day...

Late last week I had the "pleasure" of appearing on Tavis Smiley's public radio show, along with GOP "voter fraud" zealot and propagandist Hans von Spakovsky, about whom we've written quite a bit here over the years. The show was pre-taped last Thursday, ran over the weekend, and will continue to be available at Smiley's website throughout the week.

The audio discussion, which became rather heated at times, is posted at the end of this article.

In his introduction, Smiley credits von Spakovsky as being "from the Heritage Foundation." But in addition to being funded by those unapologetic Republicanists, it goes unnoted that vS, a former chair of the FEC, recess-appointed by Bush, then blocked by the Democrats in the Senate when his appointment came up again, was formerly embedded in the Bush DoJ's wholly-politicized Civil Rights Division voting section.

At the DoJ, he helped to deconstruct the beloved Voting Rights Act of 1965 by, among other things, pushing through polling place Photo ID restrictions in places such as Georgia, against the advice of just about every career employee in the division. (The law was later found to be an "unconstitutional day poll tax" by the courts, but ultimately allowed by a higher court, and still under challenge by Democrats in the state.) He was also instrumental in bringing phony "voter fraud" charges, such as those against ACORN workers in Missouri, filed just days before the razor-thin 2006 Senate election, in violation of the DoJ's own written rules against bringing such indictments just prior to elections where they are likely to affect the race.

Perhaps even more noteworthy, but unmentioned by Smiley, is that even with all of that, the disgraced von Spakovsky has been secretly hired, at tax-payer expense, as a consultant for Bush's similarly compromised, and now ironically-named, U.S. Commission on Civil Rights, to help monitor the job that the DoJ will (or won't) be doing to monitor the 2008 general election.

In any case, vS remains an unapologetic democracy hater, hell-bent on keeping Democratic-leaning voters away from the polls and, as you'll note during the interview, a liar.

Normally, however, he's not faced with anybody who can actually call him on his bullshit. That wasn't the case this time, as I was there, and was able to do exactly that...

Congressional Candidate/Whistleblower Clint Curtis Says Primary Opponent Suzanne Kosmas Staffers Made Illegal, Deceptive Campaign Calls from Dem Party Offices, Phone Lines

A Democratic candidate running in a contested primary for the U.S. House seat representing Florida's 24th Congressional District has filed an official complaint with the Federal Elections Commission (FEC), alleging that his opponent has been making illegal and deceptive campaign calls from within the Florida Democratic Party (FDP) offices, on party phone lines.

In a statement sent to The BRAD BLOG blasting his opponent, Clint Curtis described the tactics being used by the Suzanne Kosmas campaign as "the worst example of Rovian dirty tricks."

Curtis, a Florida computer programmer turned well-known vote-rigging/anti-corruption whistleblower (see BRAD BLOG's years-long coverage of Curtis here) has filed a complaint charging that paid campaign staffers for his opponent in the August 26th Democratic Primary, former state Rep. Kosmas, "have been contacting Democratic primary election voters and fraudulently identifying themselves as calling on behalf of the Florida Democratic Party," according to the campaign's press release.

"The callers then go on to solicit votes for Kosmas in the Aug. 26 Democratic primary," the Curtis camp alleges.

The press release is posted in full at the end of this article, with a link to download the complete FEC complaint. Also at the end of the article is the full text of an email sent to Curtis and campaign manager Jerry Halberg, from a Curtis campaign staffer who also serves as a local Florida precinct captain. The precinct captain claims to have received one of the deceptive phone calls.

The email notes that the Caller ID recorded showed the call as having come from "KOSMAS FOR CONG" with the phone number 407-365-7808. A call made by The BRAD BLOG to that number this afternoon, was answered by someone identifying the number as belonging to "The Campaign for Florida of the Florida Democratic Party."

The Curtis campaign press release, issued yesterday, details the main points of Curtis' complaint to the FEC:

* Kosmas and her committee knowingly misled the democratic primary election voters as to the origination of her telephonic communications and utilized state Democratic Party offices and telephone equipment for her federal campaign.

* The Kosmas campaign claimed the state offices, which are leased by the Florida State Democratic Party, as her campaign offices in public communications with Democratic voters.

* She knowingly led the voters to believe that the communication asking for support in the primary was from the Florida Democratic Party when in fact it was from paid staffers.

"The unlawful calls continued even after the Kosmas campaign was notified of the problem," the release continues, with Curtis adding, "Her campaign was given the opportunity to rectify the violations prior to the submission of FEC charges but apparently chose not to."

The Curtis campaign says photos taken of the Democratic Party offices in Oviedo reveal how the evidence of FDP support for Kosmas was "scrubbed" after they complained. Photos said to have been taken on July 31, before Curtis complained to both the FDP and the Kosmas camp, show campaign signs for Kosmas plastered throughout the local Democratic Party facility. After the initial complaints on Aug 3rd, as the following photos purport to show, the signs were removed...
