Will Ann Coulter finally be held accountable for having committed voter fraud? We may find out on October 14th when the matter will come up at a public hearing by Connecticut's State Elections Commission after an extraordinarily long two-year delay since the complaints about her allegedly illegal absentee votes in 2002 and 2004 were filed.

As The BRAD BLOG spent years documenting beyond a shadow of a doubt concerning her voter registration fraud and voter fraud in a different state, Florida, Ann Coulter committed third degree felony voter registration fraud, along with a first degree voter fraud misdemeanor, when she lied about her residency and then knowingly voted at the wrong polling place in Palm Beach County, FL, in 2005.

Years of lying to the media, as well as election and law enforcement officials, and a last-minute, inappropriate intervention by a former boyfriend in the FBI, helped run out the clock on those charges. Her offenses in the Sunshine State were eventually found to be beyond the statute of limitations by the Florida State Election Commission (FSEC). The stalling by other friendly Florida agencies took so long that the FSEC didn't receive the case until years after it had been originally reported to law enforcement by the Palm Beach County Supervisor of Elections. So she got off the hook and was never held accountable for easily documented crimes in Florida. [After years of reporting that part of the story in pieces as it developed, we told the entire sordid tale in one fell swoop in Hustler magazine. That April 2008 exposé can be read in full here.]

However, in Connecticut, where official complaints were filed in 2009 --- by a conservative activist --- that she also committed absentee voter fraud in the years prior to moving to Florida, when she allegedly voted illegally from her residence in New York, there is no such statute of limitations for voter fraud. [See UPDATE at bottom of story for someone who disagrees with that point.]

After a 20-month delay, Coulter's case is finally coming up for a vote at a public hearing before CT's State Elections Enforcement Commission (SEEC) on October 14th at 9:00am, 20 Trinity St. in Hartford CT, according to an email from the commission's MaryAnn Stratton and confirmation from the commission's director of communication...

University of Michigan's J. Alex Halderman fesses up...

As we posited in our coverage yesterday of D.C.'s Internet Voting scheme which was hacked with the University of Michigan fight song just days after experts had warned against the entire scheme, J. Alex Halderman, asst. professor of electronic engineering and computer science at the university, was, indeed, at the heart of the hack.

He details tonight that he and a small team of students were happy to participate in the test that D.C. election officials had announced, with just three days notice, inviting hackers to try and penetrate the system they planned to use this November, as developed with the Open Source Digital Voting Foundation.

Halderman writes in his explanation of how they did it:

Within 36 hours of the system going live, our team had found and exploited a vulnerability that gave us almost total control of the server software, including the ability to change votes and reveal voters’ secret ballots.

And if you think that's chilling, Halderman goes on to note that all cast ballots on the system were modified and overwritten with write-in votes, all passwords taken --- including the encryption key, which e-voting supporters constantly suggest will keep such systems safe --- before they went on to install a back door to let them view any votes cast later, after their attack, along with the names of voters and whom they voted for...

Latest incident in long, growing list of e-vote hack events...
[UPDATED: Hacker fesses up, took total control of system]

Last week we told you about D.C.'s intention of running an insane live experiment on live voters in a live election with an untested, wholly unverifiable, easily-manipulated Internet Voting scheme this November, and about just some of the computer security and election experts who have been desperately trying to warn them against it.

And now we find out that the very short planned pre-election test phase, in which hackers were invited to try to manipulate the system, has been abruptly aborted in the wake of a, um, disturbing (if not wholly unpredictable) development.

The failed system in D.C. was developed with the Open Source Digital Voting Foundation, an outfit that is working with election officials around the country to push Internet Voting everywhere, along with other computerized voting schemes. Simply because a system is "open source" does not mean it's secure, particularly when it relies on concealed vote counting, as all of their e-vote schemes do.

Below, along with our quick list of other recent known e-voting hack events, computer scientist Jeremy Epstein in "The Risks Digest," which describes itself as a "Forum on Risks to the Public in Computers and Related Systems," offers the quick timeline of recent developments in the District of Columbia's plan "against advice from many computer scientists, pursuing a trial of a prototype system for the November election."

The result, as seen below, in this latest assault on citizen-overseeable democracy is, of course, a stunning surprise to absolutely nobody other than perhaps the D.C. election officials interested in this horrific scheme and the profiteers who must have tricked them into believing that it was a secure and/or good idea [emphasis added]...

CNN's Sr. National Editor Dave Schechter had this to say about The BRAD BLOG on their "Election Center" page yesterday, in regard to our coverage of election integrity [emphasis added]...

One of the squeakiest wheels on the subject of voting is Brad Friedman, of "The Brad Blog," who is not impressed with the security of high-tech voting machines. "Use of any touch-screen voting machine is the equivalent of a 100% faith-based election. No votes cast during an election --- none --- can be verified as having been accurately recorded on such systems. Ever."

Needless to say, the companies that manufacture voting machines have more faith in their product than Friedman and other critics, seeing them as secure, more capable of accurately recording a voter's intentions, and more accessible to the disabled and those who don't speak English.

And also, "needless to say", no matter what the voting machine manufacturers have to say --- and no matter whether their systems are secure (they're not) or accurate --- there remains no way for us, we, the people, to actually know that, particularly on 100% unverifiable DRE (Direct Recording Electronic, usually touch-screen) voting systems, since it remains impossible for anybody, including the companies, to produce a single piece of evidence to prove that even one vote, ever cast on any of them during an election, for any candidate or initiative on the ballot, has ever been recorded as per the voter's intent.

Our thanks to CNN's Schechter for the kind notice, and we hope our squeaky wheels bring some much-needed grease to our ridiculously perilous and undemocratic system of concealed vote counting in this nation.

As if U.S. elections aren't disastrous enough as is...

Along with the madness of Instant Runoff Voting (IRV) and Vote-by-Mail, Internet Voting is the other scheme/virus that makes my head explode --- as if the existing e-voting system we already use in the U.S. isn't unverifiable, unoverseeable and susceptible enough to malfeasance and malfunction as is.

So with the little patience I can muster to even mention this latest particular nightmare at all today, I'll defer to Washington Post's coverage yesterday --- sure to be ignored until it's too late ("Who could have foreseen it?!") --- of the experts' latest warnings against D.C.'s planned live democracy experiment of using an untested and unverifiable Internet Voting scheme on real voters, in a real election, beginning in just a few weeks.

The WaPo column includes this explanation of two letters sent to D.C. officials this week, urging them to take a different path...

The first missive [PDF] questions whether the digital vote by mail system is "voter-verifiable," as required under the city's new election laws. The voter has no way of confirming that the ballot he or she sent is the same one that is counted by elections officials, the letter argues.

The second letter [PDF] raises sharp concerns over the vulnerability to infiltration by hackers, calling the new system a "poorly conceived experiment" that "imperils the overall accuracy of every election on the ballot."

The letter continues: "Return of marked ballots over the Internet is something we simply don't know how to do safely. Exercises such as this are counterproductive, because they will provide a false sense of security to the [D.C. Board of Elections and Ethics], while the real problems lie undetected."

Four advil and three shots of vodka please.

We detailed some of the alarming points coming out of that election, where ten candidates have now filed suit, a few weeks ago here, and Harris has a more recent update --- including on the "3,221 more votes than voters" discovered "in large Republican precincts" --- now posted here.

Systems uncertified for state-mandated Instant Runoff Voting...

Well there's a twist! Hopefully you weren't drinking coffee when you read the headline.

How often do you hear of a voting vendor saying they really really (really!!) do not want to break the law, but state officials are forcing them to? But that's exactly what's about to happen in North Carolina where the first statewide use of Instant Runoff Voting (IRV) could produce, according to some, a "train wreck" this November.

Four years ago, the state legislature created new rules for special elections needed to fill vacancies in the state's appellate courts. They apply when an opening occurs on the bench after the primary but at least 60 days before the general election. If more than two candidates file to run, voters are asked to indicate their first, second and third choices on the ballot. If no candidate receives a majority of first-choice votes, the winner is determined by adding the second- and third-choice votes.

But while election officials are mandated to run IRV elections, there is actually no state or federally certified software to tally Instant Runoff Voting on North Carolina's e-vote systems and the representative for the vendors, ES&S and PrintElect, says the companies "cannot be held responsible for issues as a result of IRV"...

Over the weekend, Republican Sen. Lisa Murkowski announced she would run as a write-in candidate this November after reportedly losing a close GOP primary race to far Rightwing "Tea Party" candidate Joe Miller.

The three-way race, along with Democratic candidate and Mayor of Sitka Scott McAdams, could prove to be a serious challenge for Alaska's historically-dicey optical-scan voting system made by Diebold. Given the shortcomings of the system which otherwise employs the concealed vote-counting of centrally tabulated ballots, the need to hand-review write-in votes this November could present a unique opportunity for citizens of the 49th state to oversee at least some of their own electoral system --- for a welcome change.

Statistical polling analyst Nate Silver, whose FiveThirtyEight blog is now hosted by The New York Times, has been suggesting that Murkowski's seemingly-Quixotic bid, while still a long shot, may actually prove to be "viable" as a write-in campaign. But whether or not Alaska's voting system is up to task may be a different matter, and an additional hurtle for Murkowski to overcome...

One of the basic axioms of law is that fraud vitiates consent. One of the foundational principles of democratic governance is that legitimacy rests on the informed consent of the governed. Come November, those principles will be tested in California.

Billionaire Meg Whitman, a former EBay CEO who surpassed the $100 million mark in campaign spending nearly a month prior to the traditional Labor Day kickoff of the Fall campaign, who, by Sept. 16, had donated a record-smashing $119 million of her own funds to her campaign, who refused to meet with former California Democratic Governor Jerry Brown and Republican State Insurance Commissioner Steve Poisner in a pre-primary debate, has knowingly sought to fill the gaping knowledge deficit created by the corporate media's gross neglect of its fourth estate responsibilities with disinformation about Brown, her Democratic opponent.

When confronted by an analysis which exposed a powerful but deliberately deceptive ad (video below) which shows former President Bill Clinton accusing Brown of lying about his tax record based on a CNN report which is now known to be erroneous, Whitman's spokesperson, Darrell Ng dismissed the idea of pulling the deceptive ad as "ridiculous"...

Yesterday's hotly contested race for the GOP's U.S. Senate nomination in Delaware ended in victory for the state's moderate, much-beloved former Governor and nine-term U.S. Congressman Mike Castle --- at least according to the tabulation of ballots cast in the race which can actually be verified by anybody as having been recorded accurately as per the voters' intent.

From the State of Delaware's Elections website with 100% reporting:

Verifiable Paper-Based Absentee Results:
CASTLE: 54.7% - O'DONNELL: 45.3%

Unverifiable Election Day E-Voting Machine Results:
CASTLE: 46.7% - O'DONNELL: 53.3%

Nonetheless, the Tea-Party/Palin/DeMint-endorsed Christine O'Donnell, who was getting trounced by the popular Castle in pre-election polls until only recently after losing twice before in her quest for a U.S. Senate seat, was declared the "winner" of yesterday's race and --- as The BRAD BLOG detailed yesterday --- nobody can prove whether the voters of Delaware actually selected her or not.

Appropriately enough for the far Rightwinger, the "victory" was 100% faith-based, since it's strictly impossible to know if even one citizen's vote cast yesterday on the 100% unverifiable e-voting machines Delware forces voters to use on Election Day was recorded accurately...

In addition to the primary elections being held in New York today --- where long-ago predicted failures are reported to be occurring with their new e-voting system as we described earlier --- elections are also underway today in Delaware, D.C., Maryland, Massachusetts, New Hampshire, Rhode Island, and Wisconsin.

One of the races certain to get most attention tonight will be the Republican U.S. Senate primary in Delaware where the Tea Party/Palin/DeMint-backed Christine O'Donnell has seen a last minute surge in support, according to pre-election polls, against GOP-establishment supported Rep. Mike Castle. The popular Castle was thought to have been a shoo-in for the Republican nomination until recently, as well as the likely victor over the Democrats presumptive nominee Chris Coons.

But Coons currently cleans O'Donnell's clock in pre-election polling, so the GOP race has become a contentious one.

We point all of this out by way of noting that Delaware has just three counties, all of which force voters to use 100% unverifiable Direct Recording Electronic (DRE, usually touch-screen, but in this case push-button) voting systems on Election Day. The systems are made by Danaher Controls, one of the smaller, lesser-known e-voting companies in the U.S., though large enough to have been made infamous when hundreds of their machines reportedly broke down during Philadelphia's May 2006 trainwreck election. In 2004 Verified Voting and the Electronic Frontier Foundation published a short paper [PDF] detailing various other problems with the systems in Tennessee and Ohio elections going back to 1992.

While we've yet to hear of problems today on the machines in the "First State," we thought it might be a good time to mention that no matter whom the voting machines report as the winner in any of the races, including the hotly-contested GOP Senate primary, there will largely be next to nothing that can be done to challenge the results --- other than, perhaps, counting the smaller number of paper-based absentee ballots for accuracy. (The paper-based absentee ballots will initially be tabulated by Diebold AccuVote op-scan systems, the same type of system used to flip the results of a mock election in HBO's Emmy-nominated documentary Hacking Democracy. You can watch that hack here as it occurred live.)

The Danaher DREs being used in Delaware today make for 100% faith-based elections. As with all DREs, after the polls close tonight it will be strictly impossible to verify that even one vote cast on them was recorded accurately as per the voter's intent, for any candidate on the ballot.

In the event that the e-voting systems report a close election tonight, well, too bad.

Mayor declares 'royal mess' on city's ES&S machines; Probs elsewhere on systems made by Dominion/Sequoia
Election officials, advocates had long warned, were ignored...

Problems with New York's new electronic voting system are being reported across the state today, according to the New York Times. Today's primary elections mark the first statewide use of the new, paper-based optical-scan systems which have been been the cause of much controversy among election officials and Election Integrity advocates over the last several months and years in the Empire State.

New York is the last state in the union to replace their older election system --- much of the state, as well as all of New York City had previously used mechanical lever machines --- with new-fangled, failure-prone, easily-manipulated computerized systems following the federal Help America Vote Act (HAVA) of 2002 which was enacted in the wake of the 2000 Presidential Election debacle.

In New York City, where Wall Street Journal reports the problems are "most severe" --- including reports from Mayor Bloomberg on "reports of broken and missing scanners, poor customer service and poll sites opening two to four hours late" --- the new systems are made by ES&S, the nation's largest voting machine company, and one with a storied history of election failures.

The systems used in other parts of the state are largely manufactured by the Canadian firm Dominion Voting, formerly as a partnership with Sequoia Voting Systems. Dominion eventually bought out cash-strapped Sequoia's portion of the NY state deal before buying out Sequoia entirely earlier this year. The purchase of Sequoia, then the nation's third-largest e-voting firm, on the heels of their purchase of Diebold/Premiere just weeks prior, has vaulted Dominion, virtually overnight, to one of the largest e-voting vendors in the U.S..

Some state election officials and Election Integrity advocates alike had long-warned against the implementation of these new systems, going so far as to take the issue to court and to testify to the inability of certifying the accuracy of elections run on the new machines.

According to the Times this morning, some polling places "did not open for more than 90 minutes" in Brooklyn; elsewhere, every ballot scanned "was returning a the 'system error'" message; and across the state, there have been reports of "longer-than-usual delays and troubles with the scanners that are supposed to swallow and tabulate the new, SAT-style ballots"...

The Democratic underdog is pushing buttons, if not touch-screen voting machines, in the Golden State's 4th Congressional District...

It's been a while since we've checked in with election fraud whistleblower turned would-be politician Clint Curtis, so let's bring everyone up to speed. Clint Curtis is the computer programmer who was allegedly asked to write election-flipping software by former Florida Speaker of the House-turned-U.S. Congressman Tom Feeney (R) back in 2000. Curtis blew the whistle and testified, under oath and on video tape, before a U.S. House Judiciary Committee panel shortly after The BRAD BLOG broke the extraordinary story in late 2004. (Quick recap of the Curtis story and links to our years-long, in-depth coverage right here.)

Curtis fought back, taking on Feeney twice for his congressional seat, only to lose both times - the first to a fishy vote count in 2006 (which Curtis challenged with evidence in hand, only to be shot down by a Democrat-led Congressional committee) and the second time to a pro-Bush Blue Dog millionaire put up by the Dems in the 2008 primary. Feeney, dogged by Curtis' allegations, and an FBI investigation into his dealings with disgraced Republican lobbyist Jack Abramoff, would finally lose his seat in '08. (Curtis' story is covered in depth in the award-winning 2008 documentary film Murder, Spies & Voting Lies.)

You'd think that'd be enough politics for anyone, but not Curtis. He loaded up the truck and moved several hundred miles north of Beverly… Hills, that is. Now armed with a brand-spankin' new law degree, he is mounting one more assault on a Congressional seat --- this time in Northern California's 4th Congressional district.

Will this be another quixotic attempt? Or will the progressive Democratic candidate who ran unchallenged in the recent CA primary, finally break through, giving Congress a much-needed voice of reason and election integrity advocates a serious ally in the House of Representatives?

Election Watchdog: 'Most brutal voter disenfranchisement, election tampering case we have witnessed yet...like watching a 2 week bank robbery in process'...

While barreling westward across the Great Plains yesterday, I received an urgent text message from Bev Harris of the non-partisan election integrity watchdog organization BlackBoxVoting.org. She and Susan Pynchon, an election integrity advocate from Florida Fair Elections Coalition, had traveled to Shelby County (Memphis), Tennessee, following reports of massive voter disenfranchisement during the state's August 5th elections.

She and Pynchon have been in the county, on behalf of a number of the candidates affected by the apparent disaster for the last two weeks.

"Wildest election tampering yet in memphis," Harris' detailed text message read. "7 out of eight candidates black in black locations with 70 percent dems but white republican sweep."

"Ten candidates filed lawsuit today," the message continued, as she explained that over the past two weeks she and Pynchon "watched as [election officials] wheeled cartloads of computers out of the building. Thousands and thousands of votes don't add up...poll tapes in trash and much more."

"Even the candidates could not get their own results and were told they were 'not available,'" she wrote. "They certified [the elections] and STILL did not give out results until threatened by a lawyer and even then the results said 'unofficial'. There is hilarious video of repub lawyer shouting 'keep those women away from me!'"...

We were on the road all day long yesterday, after getting the morning's Green News Report. We finally got off the road and back on the grid as the sun was setting here in the Midwest, and as "results" began coming in from some of the five different states (Alaska, Arizona, Florida, Oklahoma and Vermont) holding primary elections last night.

It seemed a good moment to ask a question on Twitter about what we'd missed so far. In the bargain, we received some interesting Twitter replies from NBC's Chief White House Correspondent and election results guy Chuck Todd, in regard to counting ballots and the fact that he (and others) were busy reporting "results" to the world, even as not one single ballot had yet to be counted by any human being in all of the United States by that point.
