It is a primal scream of a BradCast today, following what happened --- once again --- on Election Day yesterday. We see, again, the nightmare scenario I've warned about for so many years: a U.S. election where all of the pre-election polls suggest Candidate X is set to win, but Candidate Y ends up winning by a huge margin instead and nobody even bothers to verify that the computer tabulated results accurately reflect the intent of the voters. That's exactly what happened in Kentucky on Tuesday, where Democratic Attorney General Jack Conway was leading by a fair margin (about 3 to 5 points) in almost every pre-election poll in his race for Governor, but then ended up being announced as the loser to 'Tea Party' Republican candidate Matt Bevin by a landslide (almost 9 points) --- according to the state's 100% unverified computer tabulation systems.

As detailed on today's program with my guest Karoli Kuns of Crooks And Liars, there are a number of reasons to question the reported results. Among them, as Kuns points out today at C&L, the Democrats running in the down ballot races --- for Secretary of State, Attorney General (Conway's current job) and even state Auditor --- each reportedly received tens of thousands more votes than Conway did at the top of the ticket!

Bev Harris, of BlackBoxVoting.org, who I spoke with earlier today, described the higher vote totals in the down ballot races as a "significant anomaly". She tells me that, at least until more records are requested and examined, the KY-Gov's race "has to be looked at as a questionable outcome, particularly because of the discrepancies in the down ballot races. More votes in those races and not at the top...that just doesn't happen."

There are many other reasons for supporters to question the reported results in the KY-Gov's race, as I detail during the show. Of course, the reported results could also be completely accurate. But, without public, human examination of the hand-marked paper ballots (which, thankfully, now actually exist across most of the state!) and other related records, we have yet another unverified, 100% faith-based election to leave supporters wondering if they really won or lost.

We've seen this before, of course. Too many times. We've seen malfunctioning paper ballot op-scan systems report losers as "winners" until a hand-count corrects the record. We've seen how easy it is for hackers to game election equipment. We've seen election insiders, even as recently as last week, breaking in to computerized central tabulators. And we've even seen high-ranking election officials in Kentucky (including County Clerks, Circuit Court Judges and School Superintendents!) convicted for decades of insider election fraud, including the manipulation of electronic voting systems.

We've seen both Democrats and Republicans alike fall victim to similarly anomalous and unverified results. And, while none of it bodes well for 2016 and beyond, neither does it bode well for those immediately and directly impacted by Tuesday's elections --- such as the 400,000 Kentuckyians who stand to lose health care under a new Republican Governor who has vowed to shut down the state's expansion of coverage under ObamaCare by the very popular if term-limited and outgoing Democratic Governor.

Also today: More election results from races around the country, from the attempt to legalize marijuana in Ohio, to campaign finance reform in Maine, to the recall of Koch Brothers-funded school board officials in Colorado...

Today on The BradCast, special coverage in commemoration of the 50th anniversary of the Voting Rights Act of 1965 --- the crowning jewel legislation of the civil rights movement, written with the blood and tears of thousands, and now under fire today as it has never been since its passage helped lift the nation out from under the shackles of the Jim Crow era.

Sam Walker historian at Selma, Alabama's National Voting Rights Museum and Institute, at the foot of the Edmund Pettus Bridge, joins us to discuss the Act's history and legacy --- from the circumstances of the courageous Bloody Sunday march from Selma to Montgomery that finally resulted in the passage of the VRA, to the release of the movie Selma last year.

Among other things, he reminds us of the difficulty African-Americans faced in simply trying to register to vote in the deep south prior to the VRA. "Two days a month --- the first Monday and the third Monday --- were the only two days you could go and attempt to register," he told me. "Those were the days when they would see people coming and they would lock the door when they tried to come inside....You still couldn't register because you couldn't get inside the building to sign up."

Walker, who we haven't had on the show since the 40th anniversary of the VRA back in 2005, shares stories that need to be heard, even today. One, for example, about his meeting, years later, with one of the state troopers who took part in the beatings on Bloody Sunday. Another, about the importance of cameras and national media on that infamous day in Selma.

"The people in the media had their cameras set up when the attack happened, so when people were being beaten and tear-gassed, all those scenes were captured by the TV cameras and by the news media on camera. And that started a new momentum to try to get the right to vote for all our citizens." Sound familiar?

Then, former DoJ Civil Rights Voting Section attorney Katherine Culliton-González of the Advancement Project, joins us to discuss the ongoing legal battles in the fight for voting rights across the country in the wake of the U.S. Supreme Court gutting the VRA's landmark Section 5 provision in 2013 --- and the battle to restore it.

"All we have to do is look around us and unless they're living in a bubble, they can see that's there's been a renaissance in discrimination in voting since they took away that protection," she explains. From Congress to Texas to North Carolina to Wisconsin and beyond, the fight continues 50 years later.

"There are many, many voting changes across the country, and particularly in the South, at the local level that do all kinds of maneuvers of politicians trying to manipulate the vote. Moving poling places away from people of color - that happens a lot in the Native American community, the African-American community. We've seen laws requiring documentary proof of citizenship that have a strong disparate impact on the Latino community and the African-American community. For example, if you're a naturalized citizen and you don't have those papers, it's going to cost you at least $600 to get what's needed" to vote, she says. "All of this would have been subject to Section 5 of the Voting Rights Act."

Culliton-González reminds us, as the NC NAACP civil rights leader Reverend William Barber says, "this is our Selma".

Finally, civil rights icon Rep. John Lewis (D-GA), beaten by state troopers on Bloody Sunday as he courageously and stoically helped lead the march across the Edmund Pettus bridge as a 25-year old, discusses the importance of LBJ signing the Act in 1965. It's one of many historical sounds and songs that help us mark this historic day.

Last week we saw two major news dumps! The first was Tuesday night at 9pm (!), the time the State Department thought was optimal for them to release the first batch of Hillary Clinton emails from her private mail server. Jason Leopold, "FOIA Terrorist" from Vice News, filed the FOIA requests that led to this release. He spent the Fourth of July weekend reading the damned things so we wouldn't have to, and he joined in for the last few minutes of the show.

The other big dump came Thursday night, on the eve of the Independence Day holiday, as the U.S. DoJ and five Gulf states announced a deal with BP representing a final settlement on the world's largest offshore oil spill in history in 2010. Oil industry expert/journalist Antonia Juhasz, who covered the deal at Rolling Stone, arguing that, though it's the largest such settlement in history, BP still "got off cheaply", gives us all the details.

Fallout continues --- much of it surprisingly encouraging, thankfully --- following last week's racist terrorist shooting at the Emanuel AME Church in Charleston.

In its wake, I spoke to Sean McElwee of Demos on today's BradCast about his new study comparing the racist views of white Fox 'News' viewers versus white non-Fox 'News' viewers, and self-identified "conservative" Fox 'News' viewers with "conservatives" who don't watch Fox.

He describes the findings as "a deep indictment of the way that Fox News portrays the news." The analysis also examines whether regular viewers of Fox' The O'Reilly Factor are more racist than Fox 'News' viewers who do not regularly watch O'Reilly. The results, as they'd say on The Factor, will shock you! (Or not.)

"It's very clear that Fox News is playing on the racism and the latent racial resentment of many whites in the country," McElwee tells me. "You can see that on their coverage of the 'ground zero mosque'. You can see that on their coverage of the Trayvon Martin case. It's very clear." But does that racist coverage rub off on their viewers or vice versa? We discuss, you decide.

Also on today's show, several Senate Democrats help Republicans and President Obama move "Fast Track" authority for TPP and other trade deals forward in Congress; FEC Commissioners are not 'persons', according to the FEC; And an update on the federal case against postal worker Douglas Hughes, who landed his gyrocopter at the U.S. Capitol in April (our interview with him at the time is right here) in hopes of bringing attention to the need for campaign finance reform...

This week's BradCast on KPFK/Pacifica Radio was a fund drive show for the station, but it included some interesting stuff along the way, including an in-studio visit with documentary filmmaker and election integrity advocate John Wellington Ennis, who's newest film, Pay 2 Play: Democracy's High Stakes, has its L.A. "green carpet" premiere next week. (Note: I appear in the documentary, but from the early cuts I've seen, it's excellent anyway.)

It also allowed me to rant a bit about connect a few dots between things like last weekend's aborted "recount" in the California Controller's primary election (which, as I reported earlier this week, helped draw a roadmap for how to steal an election in this state with little likelihood of being caught), and the more-than-decade-long fight for election integrity, including the continuing fight for actual citizen oversight of public elections, which both Ennis and I have waged in parallel journeys.

Moreover, it allowed me to connect some dots again between things like the infamous Citizen's United decision, which cut off much hope for election integrity at its knees in 2010, and the emergence of the mainstream Republican global warming denialist movement. Yes, the two issues are directly connected. (For more on that, which I didn't get time to fully cover on the show as hoped, see this.)

Finally, it also allowed me to talk about, and play some great clips from, three of my favorite election integrity documentaries (one of them Ennis' Free For All: One Dude's Quest to Save Democracy), which we made available as premiums for listeners pledging support for KPFK's fund drive. (And you are still welcome to call the number and offer your support as well, if you like!)

We covered too much on the KPFK/Pacifica Radio BradCast this week to go into great detail here, but the common thread seemed to be: Stamping out Zombie Myths.

In other words, those popular lies and deceptions that never seem to die on everything from e-cigs and vaping to the death penalty to Ann Coulter's voter fraud to Fox "News" propaganda on global warming and polling place Photo ID laws (too many of those to link here) to the fight for marriage-equality in Mississippi.

In other words, there was a lot packed in to this week's 58 minutes, including a lot of bullshit to dispel, a bunch of great callers, and even one who totally disagreed with me on e-cigs and children. That was fun.

P.S. During the show, a caller questioned the facts of a quote I read on air from a press release issued today by the Freedom to Marry organization, citing the first Mississippi mayor to call for marriage equality in the state. The quote in question was from the group's President Evan Wolfson, who said in the statement: "More same-sex couples are raising children in Mississippi than in any other state."

The caller, appropriately, challenged the veracity of the statement, and I promised I'd look into the details, since I had just received the release prior to air time and didn't have the details handy. Now I do. Here's where that claim comes from...

Funny thing. For some reason, professional, weapons-grade Rightwing troll Ann Coulter doesn't think her fellow Republicans should waste their time looking into issues of vote fraud. We wonder why.

Coulter, writing an op-ed in Jackson, Mississippi's Clarion-Ledger yesterday, is hoping to urge Republican "Tea Party" Senate candidate Chris McDaniel to not challenge the results of his very close, June 24th primary runoff election against six-term incumbent Republican Sen. Thad Cochran, warning that doing so is a "primrose path to political oblivion."

The irony here --- and the hypocrisy --- and even the criminality, as those familiar with The BRAD BLOG's years of exclusive reporting on Coulter's own personal problems with voter fraud --- is extraordinary...

Mississippi's disgruntled Republican U.S. Senate candidate Chris McDaniel may want to be very careful about what seems to be his current hope of challenging the results of his GOP primary runoff last Tuesday, at least based on the "ineligible" voters he claims cast ballots across the state. If he's too effective in his challenge, he may actually end up seeing himself charged with voter fraud.

On June 3rd in the first primary round McDaniel barely bested Sen. Thad Cochran, but neither candidate received enough votes to avoid a runoff on June 24th, which Cochran is said to have won by just under 7,000 votes. The "Tea Party" candidate McDaniel, however, has yet to concede this week's runoff.

While McDaniel was believed to have been the favorite going into Tuesday's rematch, Cochran stepped up his campaign during the three weeks between the two elections. He even reached out to Democratic voters in the state, making the case that he, unlike McDaniel, was able to continue bringing in federal funding to the state for all manner of important infrastructure spending, from disaster relief to education aid to fighting against reductions in the food stamp program for the state's impoverished population.

At the same time, McDaniel, quite literally, vowed that he was "not going to do anything" for Mississippi voters, having finally taken the long trip to the ultimate dead-end of the "Tea Party" movement. "I'm going to get the government off your back, then I'm gonna let you do it for yourself," he explained in a Politico interview, which was happily exploited by the Cochran camp.

Then came the Tuesday race. And, surprise, the voters of Mississippi seemed to prefer Cochran's message to McDaniel's, according to the results reported by the *computerized vote tabulators in the state's 82 counties.

But McDaniel and his supporters aren't accepting the verdict reportedly delivered by the voters. On Election Night, McDaniel announced that there had been "literally dozens of irregularities reported all across this state," although he offered few specifics other than to blame his loss on "liberal Democrats." He added that "it's our job to make sure that the sanctity of the vote is upheld. Before this race ends, we have to be absolutely certain that the Republican primary was won by Republican voters."

It seems the "irregularities" he was referring to are his belief that Democratic voters had illegally voted in the June 24th open primary runoff.

Unfortunately for McDaniel, however, even if he is able to make the legal argument that that was true, and that enough ballots were cast by ineligible voters to affect the reported results of the election, he might well also have to end up admitting that he, himself, committed "voter fraud" when voting for himself last Tuesday night...

It's been a stupid busy news week this week, but I tried to fit as much of it as possible into this week's BradCast on KPFK/Pacifica Radio.

You may have already heard at least some of the bizarre story about three "Tea Party" supporters of Mississippi's Republican U.S. Senate candidate Chris McDaniel who found themselves locked inside the Hinds County Courthouse around 2am on primary election night last Tuesday. McDaniel himself is now locked in a run-off for the Republican nomination for U.S. Senate against six-term Senator Thad Cochran, after the nail-biter on Tuesday which left the two men reportedly about 1,400 votes apart out of more than 300,000 cast.

Ultimately, neither candidate received more than 50% of the vote, so they'll face each other again in a run-off for the GOP nomination on June 24. But the incident that left the three McDaniel supporters calling for help to let them out of the courthouse in the middle of the night after the last election official had locked the door and left almost three hours earlier is more than curious. It has many wondering what the hell the three were doing at the location where ballots are tallied and vote tabulators stored, in one of the last counties to come in with their results on the squeaker of an election night.

The details of the story, and why the three --- one a top campaign official for McDaniel (and a former Presidential campaign staffer for Newt Gingrich) --- were there at all, remain murky. On Wednesday, the Hinds County Sheriff's office said that there were "conflicting stories from the three of them." But by Thursday evening, despite what a Sheriff's spokesman described as a "fabrication" from the President of the Central Mississippi Tea Party who contacted a fellow Hinds County Republican executive committee member to seek his help in getting out of the courthouse, the county decided that she and the two men caught in the courthouse caper along with her broke no laws.

"Based on our findings and subsequent conclusion," the County Sheriff's office announced in a statement, "there is no reason to believe that the three individuals engaged in any criminal activity nor do we believe any laws were broken."

But with one of the original headlines about the story focused on the fact that the three had been locked in the empty courthouse "with ballots on Election Night," there remain a number of questions about what actually happened, despite initial reportage indicating that "ballots had been secured prior to the intrusion" and a subsequent report noting that "some precinct information wasn't sealed."

So, The BRAD BLOG contacted the Hinds County Election Commissioners to get more information on the exact type of voting system used there, which aspects of it might have been vulnerable to the three McDaniel supporters alone inside the courthouse, and what type of information was left unsealed there on election night.

We received detail answers to our questions from one of the five Hinds County Election Commissioners --- the one who would, perhaps, have the most reason to be suspicious of the trio of McDaniel supporters...

Ah, what more can you say about those "small government conservatives" as they once again attempt to place the big government they claim to despise between citizens and their doctors by taking away more rights and freedoms?

In Mississippi, the Jackson's Women's Health Organization --- which operates the only remaining clinic to offer abortion services in the entire Magnolia State --- filed a federal lawsuit seeking to block enforcement of a state law meant solely to shut them down and nullify the U.S. Supreme Court's ruling in Roe v. Wade.

The new law requires any physician who performs an abortion to be both a board-certified OB-GYN and have admitting privileges at a local hospital. According to MSNBC's James Eng, this would almost certainly force the clinic to shut down because most of their physicians "live out-of-state or because local hospitals are reluctant to grant such privileges to physicians who perform abortions." That closure would "lead some to consider unsafe and illegal alternatives that pose grave risks to [women's] health, lives, and reproductive future," according to Nancy Northrup of the Center for Reproductive Rights.

On July 2, Reuters reported that "U.S. District Court Judge Daniel Jordan issued a temporary restraining order," stating that "plaintiffs have offered evidence --- including quotes from significant legislative and executive officers --- that the act's purpose is to eliminate abortions in Mississippi." On Wednesday, in a hearing on the Jackson Women's Health Organization's motion for a preliminary injunction, Judge Jordan, who was nominated to the federal bench by George W. Bush, extended his TRO pending his ruling. So the clinic stays open for the moment.

Meanwhile, Republicans in the Michigan legislature silenced a female colleague, Rep. Lisa Brown (D), when she responded to their anti-women's reproductive rights measure last month by stating: "And, finally, Mr. Speaker, I’m flattered that you’re all so interested in my vagina, but 'no' means 'no'."

At least in that instance, the GOP "War on Women" produced an hilarious segment on the Daily Show with Jon Stewart entitled "The Vagina Ideologues". If you missed it a few weeks ago, have a look...
