On today's BradCast: If you think the way the Republican Party has rigged and stolen the U.S. Supreme Court is appalling, just wait until you see what they're trying to do of late at a few of the state Supreme Courts! [Audio link to show is posted below.]

But, first up today: Donald Trump says the Crown Prince of Saudi Arabia told him he had nothing to do with the disappearance --- and, likely, murder --- of Washington Post journalist, Saudi citizen and U.S. resident Jamal Khashoggi at the Saudi consulate in Turkey. The Prince's word appears to be good enough for Trump, who went on to compare the situation to the allegations of sexual assault against now-U.S. Supreme Court Justice Brett Kavanaugh

Meanwhile, the midterm elections are now exactly three weeks away and early voting got underway on Monday in Georgia where, you'll be shocked to learn, it didn't go well. After our previous coverage of ongoing racially disproportionate voter suppression schemes under the command of GA Sec. of State and Republican gubernatorial candidate Brian Kemp (who is in a tight election contest with Democrat Stacey Abrams), and after very serious and years-long concerns about their completely unsecure, wildly hackable, and 100% unverifiable touchscreen voting systems, it appears that the electronic pollbook systems failed across Fulton County (Atlanta) on the first day of early voting.

In not entirely unrelated news, the GOP appears to now be a wholly owned subsidiary of Las Vegas billionaire Sheldon Adelson.

Then, we move to some of the insanity of several attempted state Supreme Court coups this week with Slate's legal reporter MARK JOSEPH STERN. Stern joins us to detail both some good news from the Florida state Supreme Court, regarding that state's Supreme Court, and an apparent Constitutional Crisis in West Virginia after a decision by that state's Supreme Court, regarding their state Supreme Court. If it all sounds nuts, it's because it is.

First, in Florida, outgoing Republican Gov. Rick Scott had vowed to name three new Justices to the Court, even though the Democratic-appointed Justices he planned to replace will not be vacating their seats, because of term limits, until after Scott officially leaves office in January. Stern reports the largely good news --- with a caveat or two --- regarding the Sunshine State's Supreme Court's unambiguous ruling last week that will leave the job of appointing three new Justice to Scott's successor instead (who will be either Democratic gubernatorial candidate Andrew Gillum or Republican Ron DeSantis, depending on how things go on November 6th.)

Then, things get far crazier at the West Virginia state Supreme Court, where the Republican state legislature, along with Republican Gov. Jim Justice, have been attempting a coup by impeachment of all five Justices on the state's 3 to 2 Democratic-majority Court. This story has more jaw-dropping twists and turns in it than I can possibly describe here --- including five temporary replacement Justices determining that at least one of the impeachments was unconstitutional under state law and the GOP-majority state Senate which hopes to move forward with a trial anyway...if only they could only find a Justice willing to preside over it, as required by the state Constitution.

Just tune in for the insane details on how, as in Florida, West Virginia Republicans are doing anything and everything they can to blatantly steal a Democratic-majority high court.

And, as if that's not enough, Stern then reports on the wildly hypocritical decision by the U.S. Supreme Court last week that will leave a new voter suppression law --- enacted by North Dakota Republicans --- in place for the November midterms. The ruling effectively changes the state's election law at the last minute before this year's general election and is likely to disenfranchise thousands of Native American voters. The ruling threatens to undermine this year's re-election chances of Democratic Sen. Heidi Heitkamp, who won her previous election in 2012 by just 3,000 votes, and could assure Republicans hold their control of the U.S. Senate along with it.

Yes, elections and Supreme Courts --- be they at the federal or state level --- matter!

Finally, Desi Doyen joins us for the latest Green News Report, as the long road to recovery begins and the death toll increases after the catastrophic Hurricane Michael, and as a bought-and-sold Republican Party --- from Marco Rubio in Florida to Donald Trump in the White House --- continue to deny the deadly and costly impacts of climate change on behalf of their fossil-fueled corporate owners...

Watching Dr. Christine Blasey Ford’s life get shredded, five Congresswomen spoke up to publicly identify themselves as victims of sexual assault or domestic violence. Rep. Alma Adams of North Carolina said so very simply that this is "just part of her job representing her constituents."

This hour I present to you the contrasting statements of the accuser and the accused. A tentative but strong, conciliatory and polite woman (asked about taking a break, she replied "Does that work for you? I’m used to being collegial."), and an angry, bellowing, interruptive, hostile nominee for a lifetime position on the U.S. Supreme Court. As Brian Behar tweeted: "Can you imagine what the reaction would've been if Dr. Ford had behaved even half as hysterically as Brett Kavanaugh or Lindsey Graham?"

On today's BradCast, we're closely watching a number of things: Major storms, major elections, and major lies (under oath) revealed as coming from the nominee for a lifetime appointment to the U.S. Supreme Court. [Audio link to full show is posted below.]

First up, we're watching the "monster" Category 4 Hurricane Florence closely this week, as it quickly increases in intensity, even while slowing down over record warm waters before its predicted landfall later this week, in what could result in a catastrophic wind and rainfall event in the Carolinas and Virginia by week's end. Officials warn power could be knocked out for weeks, but, citing his Administration's "unsung success" in Puerto Rico after Hurricane Maria (after which nearly 3,000 Americans died and power remained out for nearly a year), Donald Trump declares the federal government is "totally prepared". The National Weather Service now says that nearly 5.5 million people are threatened by the incoming storm.

We're also watching the final week of primaries before the crucial 2018 midterms this fall, with New Hampshire voters taking their turn to vote on Tuesday. But we're also still watching the fallout from earlier primaries this Summer, including an all-Republican State Objections Board in Kansas which, this week, a) Voted to allow a Republican state House candidate who was arrested and charged with election fraud last week to stay on the November ballot, and b) Dismissed a challenge to the incredibly narrow reported win (just 343 votes out of some 317,000 cast) by Sec. of State Kris Kobach several weeks ago, after he was certified to be the state's GOP nominee for Governor, despite an unknown number of uncounted or rejected provisional and late Vote-by-Mail ballots across the state and serious malfunctions of a new voting and tabulation system in the state's most populous county. Kobach's own deputy chaired this week's meeting of the three-member, all-GOP State Objections Board and personally appointed the County Clerk who purchased the new, unverifiable touchscreen ballot marking device system which spectacularly failed during their first outing in Johnson County last month.

Next, we're also still watching the proceedings for Donald Trump's latest nominee to the U.S. Supreme Court. Confirmation hearings in the U.S. Senate Judiciary Committee for Judge Brett Kavanaugh wrapped up last week, but not before revealing that Kavanaugh appears to have lied to the Senate under oath, multiple times, during his previous confirmation hearings for the U.S. Court of Appeal in Washington D.C., regarding whether he had received stolen documents from Democrats on the Senate Judiciary Committee while serving as an operative in the George W. Bush Administration.

We're joined today by LISA GRAVES, the author of some of the documents stolen by one of Kavanaugh's fellow GOP operatives who worked in the Senate at the time Kavanaugh was shepherding controversial, hard-right Bush judicial nominees through the confirmation process. Graves, who is now co-founder of the non-profit Documented and former Executive Director for the Center for Media and Democracy, was Chief Counsel for Nominations for the U.S. Senate Judiciary Committee for Sen. Patrick Leahy (D-VT) back when the stolen documents in question were pilfered.

She explains today how some of the very few recently-released emails from Kavanaugh's tenure during the Bush Administration revealed last week that he lied to Congress during testimony about his knowledge of, and personal participation in, what was a major Senate email theft scandal in the early and mid-2000s.

"It was the first time that we saw evidence that he had seen talking points, draft materials, content from the materials that were stolen," she tells me, detailing how she had long suspected as much, after the initial scandal broke over a decade ago. "It was so shocking what was happening at the time, in terms of that sort of confidential material being stolen, that Senator Hatch expressed his mortification and assigned the U.S. Sargent-at-Arms, who was a Republican, to lead an investigation." But that probe, she adds, did not have subpoena power, so last week was the first time the public finally saw the incriminating documents revealed by Sen. Leahy during last week's hearings.

Graves is now calling for Kavanaugh to be impeached whether or not he is confirmed to the U.S. Supreme Court. Ironically, a complaint has been filed with Kavanaugh's boss on the D.C. Court of Appeals, Chief Judge Merrick Garland, Barack Obama's 2016 nominee to the Supreme Court who, for the first time in history, Republicans refused to even hold a vote on.

Kavanaugh's confirmation still appears likely, despite a very slim Senate GOP majority that could be lost in this November's midterms, and the presence of Republicans like Utah's Orrin Hatch who served on the Judiciary Committee at the time of the theft of those Democratic documents and continues to do so today. Hatch was just one of the Senators who Kavanaugh, we now know, appears to have blatantly lied to, under oath, during hearings in 2004 and 2006. Hatch was also a loud supporter of the impeachment of President Bill Clinton for having lied under oath.

Graves argues that Kavanaugh's testimony from those years "compared to the evidence that he lied," is now "very strong and warrants a full investigation". She also says she has yet to speak to anyone in Congress about her call for impeachment following the new revelations. "I believe the American people have a right to know that this is what's happening. And I believe the Senate should stand up and defend itself against this sort of perjury. There are certainly other right-wing judicial nominees that the White House could nominate who don't have this track record, who haven't played this role, and who perhaps also don't have this extreme view of Executive power, where --- if Brett Kavanaugh were confirmed --- he could be called to rule on cases involving cases of potential perjury or lying to investigators,"

Finally today, Desi Doyen joins us for the latest Green News Report with more on the dangers (and causes) of the looming Hurricane Florence off the Eastern seaboard, and another major storm currently threatening Hawaii this week; a brand new pipeline explodes in Pennsylvania, owned by the same company which owns the Dakota Access Pipeline that Trump approved in 2017, despite months of protest by the Standing Rock Sioux tribe in North Dakota; and, thankfully, some very good news about several new landmark actions taken by California this week to combat the growing menace of global climate change...

On today's BradCast: A stunning political upset in MA's primary on Tuesday, the Kavanaugh hearings continue, and a senior Trump Administration official drops an anonymous late day bombshell in the New York Times. [Audio link to full show follows below.]

First up today, primary election results out of Massachusetts, including the stunning, double-digit defeat of 10-term Democratic U.S. Rep. Michael Capuano by progressive challenger Ayanna Pressley. With no Republicans running in the state's 7th Congressional District this November, Pressley is set to become the first African-American woman to represent MA in the U.S. House.

Then, Judge Brett Kavanaugh dodges many questions as "hypothetical" --- including on whether a sitting President must respond to a subpoena and whether the Constitutional allows one to pardon to themselves-- from Democrats in the U.S. Senate Judiciary Committee on the second day of confirmation hearings for Donald Trump's nominee to fill the U.S. Supreme Court seat of retired Justice Anthony Kennedy. Kavanaugh also stumbled a bit when seemingly taken by surprise by a line of questioning from Sen. Patrick Leahy (D-VT) regarding about his knowledge of stolen emails from the Democratic Senator's office during the mid-2000s when, as a GOP operative, Kavanaugh was helping to shepherd George W. Bush nominees through Senate hearings. Leahy indicated that a number of emails still being protected as "committee confidential" for no legitimate reason, demonstrate Kavanaugh was aware of the ill-gotten information and lied about it during Senate testimony some years ago.

"There's a reason that Republicans don't want all of these documents released," argues my guest today, Roosevelt University political scientist DAVID FARIS, columnist at The Week and author of the recently published book It's Time to Fight Dirty: How Democrats Can Build a Lasting Majority in American Politics. He joins us to discuss all of the above, including his thoughts on the Democrats' strategy to oppose Kavanaugh's nomination and to continue his call, first published in his book this Spring, for Democrats, once they eventually regain control of the White House and both chambers of Congress, to "pack" the U.S. Supreme Court with enough new seats to create a Democratic majority to replace the one stolen from them by Republicans in 2016.

"We're still living in the dream palace of the previous normative order," he tells me. "And there's a lot of Senate Democrats who are clinging to the fantasy that if they adhere to Senate norms, then at some point in the future, we will return to what they see as regular order."

Faris discusses how Democrats might have fought harder or more effectively against Kavanaugh's nomination, while conceding they are most likely powerless to block his seating. "I think what's being revealed over the past two days is that they are stuck with a much worse nominee, with much greater baggage, than anyone understood," he says, before adding: "I wish I could say those revelations would be enough to have a couple of Republican senators vote against him, but I've really, over the last couple of years, just lost faith that there are even two people, two Republicans, in the US Senate who are willing to take a political hit to do the right thing."

He is optimistic, however, in describing what he sees as an incredible "generational transformation" of the Democratic Party over the past year or so, highlighted by the rise of more progressive, diverse and younger candidates vying for office, and details what he feels Democrats should do after the November midterms if they are able to regain control of one or both houses of Congress.

Finally today, just before we go off air, stunning breaking news of the anonymous op-ed by "a senior official in the Trump administration" published in the New York Times late on Wednesday. The remarkable column from a self-described member of a "quiet resistance within the administration" charges that Trump is unmoored from reality, that top officials must work to counter his "impulsive," "half-baked," "ill-informed and occasionally reckless decisions" in order "contain" the worst and most dangerous of them. The author also asserts that cabinet officials had, at one time, considered "invoking the 25th Amendment" to remove the Trump from office given "the instability many witnessed", but decided against it in order to avoid "a constitutional crisis". Wow.

On today's BradCast: Details on the extraordinary court ruling out of North Carolina on Monday, and the judicial coup being staged in West Virginia. But first, voters went to the polls for Tuesday's primary elections in Arizona and Florida and in Oklahoma for primary runoff elections. It did not go well in Arizona. [Audio link to full show is posted below.]

Maricopa County (Phoenix)'s paper ballot optical-scan computer systems failed in at least 100 precincts, according to the County Recorder. Many polling places were closed entirely this morning, and it was nearly noon before the systems were said to finally be working in all precincts. It's still unclear what the precise failure was, but the new County Recorder Adrian Fontes (who won his election after the previous, long-time Recorder was booted out for shutting polling places during the 2016 Primaries), tied it to pre-election tests that failed on Monday, and then a lack of contractors from the voting machine company (Dominion Voting) on hand to properly set up the systems before polls were to open today. "The contractor responsible for the voting machines was supposed to provide more than 100 technicians to assist with issues, but only 70 were available," the Arizona Republic reports Fontes as telling them at a news conference this morning. If we learn more, of course, we'll share it on tomorrow's show along with noteworthy problems and results in all three states holding elections today.

Then, following up on a story that broke minutes before airtime on Monday, we're joined today by Slate's excellent legal reporter MARK JOSEPH STERN to detail the extraordinary ruling issued by a three judge federal court panel finding all of North Carolina's U.S. House districts --- for a second time --- to be partisan gerrymanders in violation of the U.S. Constitution. Remarkably, the judges are considering ordering new maps to be drawn up before this November's elections, after already having found last January that Republicans had unlawfully gerrymandered the state's U.S. House districts. That ruling, however, was appealed to the U.S. Supreme Court which punted in June by ordering the lower court to review matters of standing. After having done so, the three-judge panel found the same Constitutional infirmities.

"The real villain here, in a sense --- aside from the Republicans, who obviously drew these incredibly gerrymandered maps --- is the Supreme Court and Justice Anthony Kennedy," says Stern. "A virtually identical ruling came down in January, at which point the US Supreme Court could have and should have acted on this question of partisan gerrymandering. Instead, the Supreme Court punted [and] sent this case back down for reconsideration. Now the [lower] court has reached the same conclusion it did in January."

The map in question was the one drawn up in 2016 after the state's previous GOP-drawn map, used in 2012 and 2014, was found to have been an unlawful racial gerrymander. So, Stern explains, the federal judges in North Carolina seem to have had enough and may now order new maps "on this incredibly compressed timetable where the election is looming" in just over 70 days, ballots need to go out to overseas voters 45 days in advance, and the state's primaries were already been held in May.

The unconstitutional maps have resulted in a wildly unbalanced 10 to 3 GOP majority in the state's Congressional delegations, despite North Carolina's status as a very divided swing state which narrowly elected Obama in 2008, Trump in 2016, and a Democrat to be its Governor in that same election. If the matter is appealed to SCOTUS by the state (as it almost certainly will be), the Supremes could deadlock 4 to 4, if Justice Kennedy's seat has yet to be filled, and the lower court ruling would stand. We could be in for a lot of chaos ahead (as if we need any more this year.)

Stern also explains the astonishing situation in West Virginia, where that state's Republican-majority House of Delegates recently impeached all four sitting members of the state's Supreme Court. (Its 5th member had already resigned after been charged with a felony crime.) The move, Stern reports, was timed in such a way to avoid allowing voters to replace the justices at the ballot box this year. That means the previously 3 to 2 Democratic-leaning court may soon become a 5 to 0 Republican court, and stay that way through 2020. Following impeachment trials of the justices in the state Senate, any vacancies will be filled by the appointments of Trump-loving Republican Gov. Jim Justice, a Democrat when he ran and won the Governor's race in 2016, but who flipped parties shortly thereafter.

"There are no good guys, per se, in this story," Stern notes. However, it serves as yet another example of Republicans blatantly hoping to pack the courts, and could prove to be another useful example that Democrats could cite in the future. If they ever re-take control of the U.S. House, Senate and White House, they'll be able to cite such moves when and if they decide to move to add seats to the U.S. Supreme Court in order to restore a majority that should have been theirs, until Senate Republicans stole a vacant seat in 2017 after holding it open for nearly a year following the early 2016 death of Justice Antonin Scalia.

Speaking of that stolen U.S. Supreme Court, Stern also offers his thoughts on whether Senate Democrats will be able to block --- or even stall --- the seating of Donald Trump's second nominee to the Court. Judge Brett Kavanaugh's Senate Judiciary Confirmation hearings are currently scheduled to begin next week and, Stern argues, "he owes an explanation as to why he thinks it's perfectly valid and legitimate and acceptable to be nominated by a racist and openly corrupted President to the Supreme Court."

Finally, we're joined by Desi Doyen for our latest Green News Report on, among other things, the record rainfall in Hawaii following Hurricane Lane over the weekend, and the complicated climate legacy of the late Republican U.S. Senator and former GOP Presidential nominee, John McCain.

On today's BradCast, the fallout, both political and legal, continues today after the extraordinary news events of the past 24 hours, when Donald Trump's former campaign chair Paul Manafort was found guilty of eight federal felonies and the President's longtime personal attorney and 'fixer', Michael Cohen, pleaded guilty to another eight, including two that implicate Trump in a serious criminal campaign finance violation conspiracy related to hush-money payoffs made to two women just before the 2016 election. [Audio link to show follows below.]

But all of that wasn't the only bad news for Trump and Republicans yesterday. Late on Tuesday, Rep. Duncan Hunter (R-CA) and his wife were indicted on 60(!) astonishing counts of fraud, conspiracy and campaign finance violations. Hunter was the second member of Congress to support Trump's 2016 run for President, after Rep. Chris Collins (R-NY), the first in the U.S. House to endorse him, was federally charged earlier this month with insider trading. Hunter's indictment may not be all that surprising if one is familiar with his (and his father's) track record of lying to the public. His previously-believed-to-be "safe" Republican House seat in his San Diego Congressional District may now be in peril.

All-in-all, it's starting to feel a whole lot like 2006, when a similar avalanche of failures and corruption by a GOP Administration and a scandal-ridden Republican House resulted in a "blue wave" election in November.

We're joined again today by Salon and Hullabaloo's award-winning opinion journalist HEATHER DIGBY PARTON, as we try to make sense of what feels, in her words, like "the weirdly unfamiliar impression that something real and recognizable had happened".

We discuss the fallout from the Manafort and Cohen guilty verdicts and pleas, including the new subpoena Cohen received today from the state of New York in the case against Trump's phony charitable foundation, and the remarkable statement from Cohen's attorney Lanny Davis last night, that his client "has knowledge on certain subjects that should be of interest to the special counsel," regarding Team Trump's infamous 2016 Trump Tower meeting with Russians and the "computer crime of hacking" that year. Davis now says Cohen is "more than happy to tell the special counsel all that he knows."

"Digby" shares her thoughts on what surprised her from the Cohen plea deal, what all of this may mean for the President, the GOP and Democrats just over two months out from the crucial 2018 midterms and for Brett Kavanaugh, Trump's nominee to the U.S. Supreme Court.

On today's BradCast: Our long 'Digby' drought is finally over! [Audio link to show follows below.]

But, first up today, an update on the ongoing counting from (and fights over) last week's incredibly close GOP gubernatorial primary in Kansas between Sec. of State Kris Kobach and Gov. Jeff Colyer, who is accusing Kobach's deputy of giving incorrect instructions to counties regarding the counting of provisional ballots. Some 9,000 provisionals are now being processed as Kobach leads the current unofficial count by just over 100 votes out of some 311,000 cast last week. The latest battle is over whether provisional ballots cast by unaffiliated voters who did not officially declare a party affiliation at the polls (because poll workers failed to instruct them to do so) should be included in the tallies. Colyer's office argues yes. Kobach's deputy --- who is overseeing the post-election canvas following Kobach's recusal --- says no. We explain both positions.

Meanwhile, in neighboring Missouri last week, Republican voters in Clay County appear to have elected a huge Hitler fan, by a very large margin, as their nominee for the state House of Representatives. Earlier this year a former member of the American Nazi party won the GOP nomination for the U.S. House of Representatives in a Congressional district outside of Chicago.

Then, as the defense rested Tuesday without bringing forward any evidence or witnesses in the first of two federal indictments against former Trump Campaign chairman Paul Manafort, we're joined by HEATHER DIGBY PARTON of both Salon and Hullabaloo, to catch up on a number of stories boiling over from within the Trump Scandal Swamp.

Most notably, she explains her recent spot-on observation that the Whitewater scandals during the Clinton Presidency, rather than Nixon's Watergate scandal, may offer "a better window into the current behavior of the Republican Party" when it comes to their denial of and outrageously partisan attacks on Special Counsel Robert Mueller's investigation into alleged Team Trump/Russia coordination in the 2016 Presidential election.

After drawing apt comparisons to Watergate (and there are plenty), Parton moves to Ken Starr's Whitewater investigation. "What the Republicans did in that era --- it was kind of the beginning of this 'scorched earth' partisanship that we see today. They brought all hands on deck to go after Bill Clinton, starting in 1992," she says. After which, "they started to use this scandal-mongering as a political weapon. This became their weapon of choice."

Thus, she concludes, "that's how they're viewing the Russia scandal. They are portraying it to their people as a partisan weapon, that 'They're using all of this to damage Trump, there's no substance to it!' In their view, they can convince their people that this is how scandals work because that's what they do" in their own so-called investigations, which really are, more often than not, the "witch hunts" that Trump and Congressional Republicans characterize the probe by Mueller (a lifelong Republican) to be.

While we're in the swamp, we also discuss the Manafort case, Trump's Dept. of Justice firing of senior FBI counter-intelligence official Peter Strzok (who oversaw the beginning of the Trump/Russia investigation in 2016) on Monday, and the importance (or lack thereof) regarding sensational new allegations being made by fired White House staffer and former TV reality star Omarosa Manigault Newman this week, in conjunction with the release of her new tell-all book.

Finally, we're joined by Desi Doyen for our latest Green News Report in which, among other things, we discuss more record heat and fires threatening national parks and forests, the Trump Administration's efforts to use those disasters to cripple the Endangered Species Act and help out the logging and farming industries, and Interior Secretary Ryan Zinke's on-tape charge that "environmental terrorist groups" are to blame for massive record wildfires currently engulfing large areas of the West...

Donald Trump's grip on reality seems to be slipping more and more each day. Or, at least his interest in reality is slipping, if not his interest in deceiving his supporters and everyone around him about demonstrable reality. That sentiment was, perhaps, best summed up when, on Tuesday, the five-time draft dodger declared at the Veterans of Foreign Wars (VFW) annual convention in Kansas City: "What you're seeing and what you're reading is not what's happening." Got it?

Among the things that actually are happening, as covered on today's BradCast. [Audio link to show follows below]...

The Administration now (quietly) concedes they were wrong about last year's massive tax cuts for corporations and the wealthy paying for themselves through a rise in federal revenue. In the first half of 2018, we now know, corporate tax revenue plunged to its lowest level since such data was first tracked beginning in the 1940s. Thanks to slashed corporate tax rates, federal revenues are now lower than the then-historic plunge following the 2017 economic collapse. And, with that, deficits are now set to rise above $1 trillion annually for the foreseeable future. That, of course, is the exact opposite of what Trump, his White House and Congressional Republicans told Americans last year when pushing for their new tax rates and even worse than real economists at the time had predicted.

Then, after former CIA Director John Brennan declared Trump's "performance" at his joint press conference with Vladimir Putin in Helsinki last week was "nothing short of treasonous," the White House announced they were seeking to remove his security clearance, along with five other former top U.S. intelligence officials (two of whom no longer have such a clearance anyway) who have been critical of the President's behavior and statements regarding the investigation into Russia's alleged cyberattacks and other interference in the 2016 Presidential election.

The rank politicization of security clearances by a White House may be unprecedented and even one of many impeachable offenses by this President, but does his behavior regarding Russia really rise to "treason", as Brennan argued? BRAD BLOG legal analyst ERNEST A. CANNING joins us today to discuss his recent article on the Constitutional definition of "treason" (the only crime defined in the founding document and one that is punishable by death) and whether the charge could possibly apply to Trump, given that we are not --- at least officially --- "at war" with Russia.

Canning, while he's here, also details two very encouraging court rulings handed down in advance of the crucial 2018 midterm elections, one from a federal court in Florida yesterday, and the other from a state court in Iowa today --- both regarding GOP attempts to restrict early voting and other related issues. In Florida, as Canning explains, the judge described the state's GOP-run state Election Division's restrictions on creating early voting sites at state colleges and universities displayed "a stark pattern of discrimination" in violation of the U.S. Constitution's 26th Amendment. And, in Iowa, the court ruled the Republican state legislature's newly enacted law and GOP Sec. of State effort to promote it "substantially and directly interfere with Iowans' constitutional rights to vote."

Finally today, speaking of reality, on Tuesday the Kremlin made clear they had no intention of accepting Trump's invitation for Putin to come to Washington D.C. this fall for a second summit. That, despite Trump and his Press Secretary Sarah Huckabee Sanders previously declaring that plans were already being made for the meeting. Today, White House officials were finally forced to admit the meeting will not, in fact, take place, though the admission was misreported by some in the media as, naturally, the White House pretended it was their choice, not Russia's...

On today's BradCast: Our 'WTF?!' coverage of the remarkable joint press conference following President Donald Trump's meeting with Russian President Vladimir Putin in Helsinki, Finland. [Audio link follows below.]

It was not 72 hours following US Special Counsel Robert Mueller's indictment on Friday of 12 top Russian Military Intelligence officers on 11 felony indictments related to hacking into and stealing DNC and Hillary Clinton campaign emails and releasing them to the world, in an alleged attempt to manipulate the 2016 Presidential election, when Trump tweeted: "Our relationship with Russia has NEVER been worse thanks to many years of U.S. foolishness and stupidity and now, the Rigged Witch Hunt!"

Hours later he held his one-on-one summit with Putin in Helsinki before going on to hold a remarkable press conference in which, essentially, the President of the United States took Russia's side in the matter on virtually every point. In the bargain, he also attacked the FBI, the DNC and other Americans, as he stood next to the Russian President, taking his side against his own intelligence agencies.

On one point, however, they differed. Trump asserted Putin had told him he was not involved in interference in the 2016 Presidential election and he didn't "see any reason why" he would have been. But, when asked directly by a reporter if he "direct[ed] any...officials" to help Trump, who he says he supported over Clinton, Putin admitted, "Yes, I did."

Nonetheless, Trump failed to demand an explanation for any of the exceedingly detailed allegations contained in Mueller's Friday indictments when directly asked by media, choosing instead to return to strange, and largely disproven assertions regarding Democrats, the DNC server, Hillary Clinton's emails, his claims of "no collusion" with Russia and his great electoral college victory (which he also lied about.) Neither did he condemn Russia or its President in any way. We have clips from several of those answers during today's presser and reaction to it --- much of it gobsmacked --- from media, Democrats, former top intelligence officials, and even a number of Republicans, including at least one Fox "News" host who, on air, just after the news conference, condemned Trump's behavior as "disgusting".

Then, we open up the phone lines to callers --- who have a number of diverse opinions --- on all of the above, even as most of the same U.S. electoral vulnerabilities said to have been exploited by Russia in 2016, remain equally as vulnerable just months before our crucial 2018 midterm elections...

On today's BradCast: Incredibly enough, one newly nominated Democratic U.S. House candidate had to ask, out loud, on one of the weekend network news shows: "Are we fighting or not?" The question was in reference to whether Senate Democrats planned to do everything within their power to block a vote on Donald Trump's nominee for the U.S. Supreme Court. [Audio link to show follows below.]

That Democratic U.S. House nominee was progressive Alexandria Ocasio-Cortez, who unseated the 4th most powerful Democrat in the House just last week in New York's Democratic Primary election by a landslide. She was appearing on NBC's Meet the Press. It's simply stunning that the Democratic Party's response to the retirement of Justice Anthony Kennedy has been so flat-footed that it's still unclear today, almost a week later, whether Democrats are prepared to fight, all out, against a second Trump nominee for the Court who will be the decisive vote in overturning and reversing decades of hard-won rights on virtually every front.

Today, Democratic Senate minority leader Chuck Schumer called on Americans to pressure their Senators to block anybody nominated by Trump. The call, via a New York Times op-ed charging that "our rights hang in the balance", comes not a moment too soon and follows a lukewarm response from many Senate Dems (including Schumer) and a tepid commitment by (supposedly) pro-choice GOP Senator Susan Collins of Maine to vote against a Trump nominee who is "hostile" to settled law, such as Roe v. Wade.

It's still unclear whether all Democrats are onboard with blocking Trump's nominee, whether any Republicans will actually join them, and what Dems are willing to do in order to block such a vote entirely for a few months, until at least after this November's election where they could regain the majority. That, even after Senate Republicans blocked Obama's SCOTUS nominee for nearly a year before stealing a majority on the Court with Trump's nominee Neil Gorsuch.

We discuss the possibilities for Dems on today's show, along with what I describe as the necessity for Dems to walk out and deprive the Senate of a Constitutionally-required quorum and bring all business to a halt, if that what it takes to block Trump's nominee. That nominee, of course, would also immediately have a huge conflict of interest in ruling on a President who nominated him or her, even as he was the subject of a serious criminal investigation by a Special Counsel into an alleged conspiracy against the United States and unlawful obstruction of that investigation.

Remarkably, there are still many "Very Smart People" in the media and Democratic politics who seem to feel that the fight is already lost, and that Dems should somehow keep their powder dry until after the crucial midterm elections or else risk losing their chances of winning back one or both houses of Congress this November.

That is nonsense. This is the fight of all of our lives, at this point. Political calculations like that are both outrageous and counter-productive for Democrats for several of the reasons I detail today. If Democrats can't take a stand on this, they should get out of politics all together. They may or may not win the fight, but that's nowhere close to the point.

We open the phone lines today to all of that and more, as both elected Democrats --- and even many of those calling into the show today --- seem to have a very difficult time staying focused on what actually matters at this crucial moment in history and what is at stake for the country itself in the midst of our ongoing Trump/GOP-fueled National Emergency...

On today's BradCast: The nation appears to be lurching ever closer to a full-blown Constitutional Crisis, as Trump and his team offer a series of extraordinary and largely unprecedented (save for Nixon) claims in support of sweeping Presidential powers, over the past few days, which would place the Executive completely above the rule of law. [Audio link to show is posted below.]

Over the weekend, Team Trump was once again on the offensive in the media, following the disclosure of a 20-page letter sent by Trump's attorneys to Special Counsel Robert Mueller in January, wherein they argued, among other things, that Presidents cannot legally be subpoenaed to appear before a grand jury, cannot be guilty of obstruction of justice, since they have unfettered power over all Dept. of Justice investigations, cannot be indicted while serving, and have absolute power to pardon anybody for any crime at any time for any reason.

Moreover, on Monday, Trump took to Twitter to charge that the Mueller probe is, itself "totally UNCONSTITUTIONAL" (his caps) and that he has "the absolute right to PARDON" himself. Many constitutional law experts disagree with many of those points.

In response, author, blogger, Slate contributor and Fordham University School of Law legal historian JED SHUGERMAN joins us on today's show to offer historical, legal, and Constitutional points of clarity and precedent on the power and scope of Presidential pardons, subpoenas, indictments and the expansive interpretation of those powers that Trump and his attorneys have been proffering in recent days.

Among the historically relevant cases and precedents referenced by Shugerman today: United States v. Richard Nixon, Bill Clinton v. Paula Jones, and even the more recent case of Rod Blagojevich, who, Trump recently said, he was considering pardoning after the disgraced Illinois Governor was convicted for trying to sell off the vacant U.S. Senate seat left by Barack Obama when he became President. "It's no accident that Trump is talking about pardoning [Blagojevich]," argues Shugerman, detailing how Trump sees him as unfairly convicted for simply using his constitutional powers, "even with a bribe, because that's just politics as normal. It's an incredibly cynical move."

"Just because the Constitution gives someone the power to do something, it doesn't mean they can use it for whatever purpose they want," he tells me. "Even if you have five good reasons for doing something, but one illegal reason, that illegal reason still makes it illegal."

"The Constitution says 'the President shall take care that the laws be faithfully executed'," Shugerman notes, while explaining why many of the current arguments being made by Team Trump may work effectively for propaganda purposes, but appear to have little legal basis or precedent, particularly while describing that a President would be acting "faithlessly" by pardoning himself. But, even if that happens, he says, he is confident (more so than I) that state prosecutors who are unbound by federal pardons, will pick up the prosecutorial ball against Trump and his cohorts.

Shugerman also describes the "bombshell" disclosure from that newly revealed letter from Trump's lawyers, in their admission that the President "dictated" the false written response from Don Jr. after the disclosure of the infamous June 2016 Trump Tower meeting with Russian nationals to receive "dirt" on Hillary Clinton.

Also on today's show...

• Republican House Majority Leader Rep. Kevin McCarthy --- believed to be the front-runner to become the next Speaker of the House if the GOP maintains control of the chamber this November --- refused to respond to CNN's on-air questions over the weekend about the Trump attorneys' concession that they and the White House had lied to the public about the infamous 2016 Trump Tower meeting;
• Despite his continuing lies and chaotic presidency, Trump remains wildly popular among Republicans, according to Gallup. As of his 500th day in office, he enjoys a higher "own party" approval rating than any other President since WWII, other than George W. Bush (following 9/11), at a similar point in their presidencies;
• The U.S. Supreme Court allows a baker in Colorado to discriminate against a gay couple. (More on this tomorrow.)
• Corporate CEOs are now admitting out loud that, despite record profits, a theoretically booming economy and huge recent tax cuts, they have no intention of raising pay for workers;

And, on the day before 2018 mid-term primary elections are held in eight states tomorrow, an Election Integrity author rings in to remind us that Russia isn't the only threat to vulnerable, easily-manipulated computerized election results in the U.S. --- not by a long shot...

Among the stories covered on today's post-Memorial Day weekend BradCast. [Audio link to show is posted below]...

First up, some accountability news. Missouri Governor Eric Greitens (R) finally announces his resignation, after two separate indictments (one related to allegedly blackmailing a woman he has admitted to having had an affair with, and the other for unlawfully using a veterans charity contact list during his 2016 run for Governor) and after the GOP-majority legislature convened an historic special session to consider his impeachment.

Also, hit ABC sitcom reboot Roseanne is cancelled just hours after its titular star tweeted a racist comment about a longtime friend and adviser to former President Obama.

Then, why at least some of Trump's obnoxious, inaccurate, and sometimes dangerous tweets actually matter (as much as we try to avoid them). A new poll finds alarming numbers of Republicans (and, yes, Democrats!) actually buy the President's evidence-free claims that as many as 5 million fraudulent votes were cast in the 2016 Presidential election, as his new --- and similarly evidence-free --- tweets targeting Special Counsel Robert Mueller's probe now claim the investigation is "rigged" and is meant for "MEDDLING with the mid-term elections now that Republicans...are taking the lead in Polls".

In fact, while there is no evidence that Mueller's probe is "rigged" or that he is "meddling" in the mid-terms, Republicans are now said to be nearly tied or even taking the lead in some generic U.S. House polling on the heels of Trump's increasingly strident and inaccurate Twitter torrent. (Here, however, is a more skeptical look at those numbers.)

Nonetheless, many Democrats still seem very confident that a "blue wave" is in the making to flip one or both chambers of Congress from GOP control this November in response to Trump, as suggested by a surge in Democratic turnout during the 2018 primaries. It should be noted, however, that there are also signs that GOP turnout is increasing as well.

All of that is before the usual GOP voter suppression kicks into high gear. To that end today, the lawsuits have begun already. Last week, a suit was filed by the League of Women Voters and others against Florida's Republican Gov. Rick Scott and his hand-picked Sec. of State Ken Detzner's refusal to allow early voting centers at public universities.

And, in Ohio, the ACLU has now filed suit against the state's Republican drawn U.S. House districts, charging that the maps, drawn up in secret by the national GOP after the 2010 Census, violate the U.S. Constitution as an extreme partisan gerrymander.

We're joined by ACLU Ohio's Legal Director FREDA LEVENSON, who explains the case, why it's taken so long to be filed after resulting in 12 GOP U.S. House members to the Democrats' 4 over each of the last three elections in the swing-state, and how related cases from other states, now pending decisions at the U.S. Supreme Court, may effect this one.

Levenson also updates us on another case awaiting a decision any day from SCOTUS, regarding Ohio Sec. of State Jon Husted (R)'s attempt to purge voters from the roles after failing to vote in two consecutive federal elections. She explains why the ACLU sees that as a violation of the National Voter Registration Act (NRVA) and how SCOTUS' ultimate decision in this case could result in similar mass voter purges being carried out in states across the country.

Finally today, a new scientific study finds that some 5,000 Puerto Ricans may have been killed by Hurricane Maria, rather than the 64 officially attributed to it, and Desi Doyen joins us with troubling details on deadly storms and flooding in Maryland and North Carolina over the holiday weekend, as subtropical storm Alberto, the first named storm of the new Atlantic hurricane season, rolls ashore days before the new season even officially begins...

On today's BradCast: Another reminder that the nation's elections officials remain woefully unprepared for and under-informed about threats to this year's crucial mid-term elections, and clear examples of where our governmental institutions currently work to combat blatant corruption by top officials (Missouri) and where they don't (D.C.).

First up, an election night cyberattack in Knox County, Tennessee's local primaries on Tuesday should have officials there (and elsewhere) far more concerned than they appear to be. We discuss why this latest attack echoes similar incidents we've seen previously (including at the end of election night during the 2004 Presidential election in Ohio), why such attacks are likely to become more frequent, and how election and cyber-security officials continue to woefully underestimate and misunderstand the very real dangers to our elections when they (falsely) tell the public, as they are doing in Knox County this week, that their computerized voting, registration and tabulation systems are "never connected to the Internet, so can't be hacked." They are wrong.

Next, Missouri's Republican governor Eric Greitens is now facing three different felony charges, two separate court trials, and the GOP-majority state legislature has now overwhelmingly decided to call a special session to consider impeachment. Greitens maintains his innocence in both a sexual blackmail scandal and campaign finance scandal. We explain why the extraordinary historical moment --- despite the Show-Me State's Governor refusal to resign, echoing Donald Trump in calling the well-documented evidence against him the result of a "witch hunt" by prosecutors (and his own party?) --- is actually, at least so far, an example of how the system is supposed to work.

Contrast that to the quickly devolving mess in D.C. today, where Republicans in the House and Senate who ought to be demanding accountability from a corrupt President, are looking the other way and/or undermining prosecutors, and where prosecutors seem to (falsely) suggest they cannot indict a sitting President, no matter the evidence of serious crimes. That, even as whatever credibility this Administration may have once had, has now disintegrated so much amidst Trump's latest flip-flops on a number of scandals, that even one top Fox "News" anchor unloaded on the President on Thursday, with an astonishing smack down of Trump lies, which ends: "I guess you’re too busy draining the swamp to ever stop and smell the stink you’re creating. That’s your stink. Mr. President, that’s your swamp." When you've lost Neil Cavuto...

Finally, Desi Doyen joins us with an update on the evacuations, earthquakes and new eruptions near Hawaii's Kilauea volcano and on the state's recent deluge (50 inches in 24 hours!) of global warming-related rain. As well as another explosion, massive fire and evacuations --- the third within the past month --- at a fossil fuel-related processing plant, this time in Louisiana...

On today's BradCast: The chaos that is the Trump Administration continues to move faster than anyone can possibly keep up with. But we try. [Audio link to show follows below]

First up today: Late last week a judge in Arkansas found the state's second try at a Photo ID voting restriction law to be as unconstitutional as the one struck down by the state Supreme Court four years ago. The new measure, adopted by Arkansas' Republican-majority legislature, has now been blocked in advance of the state's mid-term primaries coming up later this month. Leslie Rutledge, the state Attorney General who unsuccessfully defended the law, failed to demonstrate any evidence of voter fraud in court. The state is now appealing the lower court ruling. But, as we reported back in 2014, Rutledge herself committed actual voter fraud when she voted by mail in Arkansas even after registering to vote in Washington D.C.!

News out of Texas on this front is not as encouraging, as a split decision by a three-judge panel on the conservative 5th U.S. Circuit Court of Appeals decided to allow that state's new version of its voter-suppressing Photo ID law to be used in the 2018 mid-terms, though opponents are likely to appeal. Lower courts --- and even a unanimous panel on the 5th Circuit itself --- have repeatedly found both versions of the state's GOP-adopted state statute to be unlawful and/or in violation of the U.S. Constitution.

Then, we're joined today by national security journalist MARCY WHEELER of Emptywheel to try and make sense of, among other things, the nearly four dozen questions said to be from Robert Mueller's Special Counsel probe for Donald Trump, as published by the New York Times on Monday night after apparently being leaked by someone on Team Trump. Those questions include queries on Trump's alleged obstruction of justice, as well as Team Trump's so-called "collusion" with Russia before and after the 2016 election.

Wheeler explains why she believes the information was leaked and how its being desperately used by Trump to (falsely) suggest the Special Counsel has found no evidence of "collusion", despite the many published questions in the list which cite issues related to a conspiracy between Russians and members of the Trump Campaign.

"These guys are incompetent at governing and most every other thing, but they are very competent at playing the press. And they have played the press for the last six months, making it seem as if the only risk to Trump has to do with obstruction," Wheeler argues. "More than a third of these questions go to the conspiracy. It was never just about just obstruction."

We also try to make sense of the bizarre, late-breaking story regarding Trump's infamous gastroenterologist, Dr. Harold Borenstein, who is now charging that Trump's longtime personal bodyguard Keith Schiller and a Trump Organization lawyer "raided" his office last year to take Trump's medical records without the required legal forms, shortly after Borenstein told the media that Trump uses a hair-loss drug.

Wheeler also offers her insights into the new evidence suggesting that Trump is now tossing his old business partner and personal lawyer Michael Cohen under the bus in the wake of the recent FBI raids on Cohen's office and residences. "There are so many weird things about the Cohen thing that I hesitate to settle on an explanation for what's going on there, aside from the fact that I think that yeah, Trump is worried about him flipping."

All of it is perhaps best summed up by Wheeler's comment today: "It's a mess. Trump is in trouble."

Finally, Desi Doyen joins us for the latest Green News Report as an EPA whistleblower (and Trump supporter) charges that embattled EPA chief Scott Pruitt lied to Congress during recent testimony, and the Trump Administration is trying again to rollback fuel efficiency standards for vehicles. Both of those stories also have late updates today, as we now learn that two top (and controversial) EPA officials have recently resigned amid the mountain of Pruitt-related scandals, and as California and 17 other states sue the Trump Administration over its new attempt to rollback fuel efficiency...

On today's BradCast: It's Tax Day! Donald Trump is trying to celebrate his massive tax cut for the rich, but not many are dumb enough to actually believe him. Not with White House staffers and Republicans in Congress leaving in droves, and legal trouble getting ever closer to the President by the day, hour, moment. [Audio link to show follows below.]

First today, while Trump and the GOP have been banking on their deficit exploding tax cut to help mitigate their likely losses in the upcoming 2018 mid-term elections, they may need to come up with a Plan B, as new polling reveals the scheme is decreasing, rather than increasing in popularity since it's passage last December.

That, as still more Republicans are running from Congress today, and even lobbyists turned White House officials are crawling back out of the swamp and back through the revolving door to get their corporate lobbying gigs back before it's too late.

Even Trump's own stolen Supreme Court Justice Neil Gorsuch abandoned the President momentarily today, to join the Court's four liberals in striking strike down a law allowing the government to deport criminals for vaguely defined "violent crimes".

But all of that may be of little moment to Trump today, as his own personal legal woes continue to mount each day at a seemingly ever increasing pace.

Joining us to try and make sense of the fallout from the recent raid of Trump's "personal attorney" Michael Cohen and his bizarre federal court hearing on Monday, as well as where Special Counsel Robert Mueller's probe may (or may not) be heading at this point, is RANDALL D. ELIASON, former Assistant U.S. Attorney in D.C., George Washington University law professor, blogger, and Washington Post legal commentator.

Eliason details why the case against Cohen is "much bigger than just some Stormy Daniels referral" and why the Trump attorney's argument hoping to prevent prosecutors from examining supposed attorney-client privileged documents is, along with the entire criminal probe of a sitting President, "so remarkable, and incredible, and unprecedented."

"I mean, yesterday the lawyers for the head of the Executive Branch were in a federal courtroom arguing that the Department of Justice's own prosecutors can't be trusted to do a privilege review. Their own boss is in there arguing against them, basically, that they can't do this properly," Eliason tells me. "It is just unbelievable."

He also explains precisely what "collusion" is and isn't; what "corrupt intent" actually means in a legal sense, as it relates to potential obstruction of justice felonies being investigated by Mueller; why it doesn't matter whether Mueller interviews Trump at all; and whether the Special Counsel may end up issuing an indictment of the President, rather than just a report that could be referred to Congress for impeachment consideration.
