Last week, the Rachel Maddow Show picked up on a story we'd first reported here, concerning the hypocrisy of Newt Gingrich's massive "voter fraud" in the state of Virginia, as compared to what the GOP and Fox "News" and even Gingrich himself had been decrying as massive "voter fraud" when it was carried out by ACORN. When Gingrich did the same thing --- but far worse --- he called it "just a mistake."

Last night, as her top story, Maddow picked up on our coverage of the indescribable hypocrisy of the Iowa GOP, which sets it's very own rules for the Iowa Caucuses tonight and, in doing so, chose to not require Photo ID restrictions on voters for either voting or registering to vote at the caucus on the same night.

As we originally noted last week, while the GOP has long claimed disenfranchising polling place Photo ID restrictions are necessary to stop rampant "voter fraud" during elections in which Democrats will be participating, apparently they have no such concerns about their own elections. Even when they are allowed to set all of the rules for them. Or, more accurately, they don't wish to disenfranchise their very own voters, while they do hope to disenfranchise Democratic-leaning voters in normal elections. It's also worth highlighting that they have fought against allowing same day registration and voting in regular elections as well, while having no problem with it here in the Iowa GOP caucuses.

Maddow was as amused by it all as we were. Here's her coverage from last night. Also, read on for details on one point of information that her guest, Doug Heye, former RNC Communications Director and current Sr. Advisor to the Iowa GOP, seems to have gotten blatantly wrong during his interview with Maddow...at least according to our confirmed reporting...


Heye claims in the video above that while no Photo ID is required for voting at the IA caucuses, it will be required for folks who wish to first register and then vote at the caucus sites tonight. His assertions is a direct contradiction of both information posted by the Iowa GOP itself on its own caucus website, as well as info on the website of Iowa's Republican Sec. of State Matt Schultz. Moreover, it also contradicts the information that his office confirmed to me when I called them last week before reporting my original story...

And no Photo ID is required to register or vote!...

Votes in next Tuesday's Republican caucuses in Iowa will be cast on paper ballots and hand counted publicly at each and every caucus site, according to a report late this week from Politico's Jonathan Martin. In other words, Republicans will be relying on "Democracy's Gold Standard" when it comes to casting and counting ballots in their own election, in which they set all of the rules, even if they will not allow the same standards to be applied to elections in which Democrats will take part.

Martin's story should come as great news for Election Integrity advocates and, in particular, Ron Paul supporters who have very good reason to be concerned about the process after witnessing --- first-hand and on video-tape --- blatant voter fraud carried out by Mitt Romney supporters in years past. The news is also welcome in light of a recent report suggesting the GOP would be counting votes in secret to avoid a purported "threat" by the hacktivist group Anonymous to disrupt next week's caucuses.

Though the article, if accurate, is wonderful news, it underscores, yet again, the Republican Party's almost indescribable hypocrisy when it comes to elections. Over the years, as we have detailed on hundreds (if not thousands) of pages at The BRAD BLOG, Republicans have eschewed both paper ballots and their public hand-counting at the polling place, insisting that computer cast and counted "ballots" are far more reliable than anything human beings, with their own hands and eyeballs, are able to do themselves with everyone in the public watching. (That is, except in cases where they are challenging the computer-tabulated results of an election, in which case they insist, appropriately, on publicly hand-counted paper ballots.)

Moreover, as we reported on Wednesday, even though the GOP has worked overtime, since coming to absolute power in many states around the nation during the 2010 elections, to institute polling place Photo ID restriction laws for elections in which Democrats will take part (and be disproportionately disenfranchised by they), when Republicans are able to create all of their very own rules for their very own elections --- as is the case with the Iowa Caucuses --- they require absolutely no Photo ID for any voter, even those registering as Republican for the first time and voting on the very same day (something they also have long fought against allowing everywhere else!)...

The blatant good-for-me-but-not-for-thee hypocrisy, even for this jaded independent journalist, after this many years of covering such issues, is remarkable..

New GOP voter suppression laws continue to create chaos around nation in advance of 2012 Presidential Election...

A 93-year-old Tennessee woman who cleaned the state Capitol for 30 years, including the governor's office, says she won't be able to vote for the first time in decades after being told this week that her old state ID failed to meet new voter ID regulations.

Thelma Mitchell was even accused of being an undocumented immigrant because she couldn't produce a birth certificate:

Mitchell, who was delivered by a midwife in Alabama in 1918, has never had a birth certificate. But when she told that to a drivers' license clerk, he suggested she might be an illegal immigrant.

Thelma Mitchell told WSMV-TV that she went to a state drivers' license center last week after being told that her old state ID from her cleaning job would not meet new regulations for voter identification.

A spokesman for the House Republican Caucus insisted that Mitchell was given bad information and should've been allowed to vote, even with an expired state ID. But even if that's the case, her ordeal illustrates the inevitable disenfranchisements that result when confusing voting laws enable state officials to apply the law inconsistently.

Add Mitchell's story to the rapidly growing instances of long-time voters who are now running into obstacles to voting, such as bad or confusing information in Mitchell's case, or a lack of required documentation in 96-year old fellow Tennessean Dorothy Cooper's case, or potential charges of hundreds of dollars in 84-year old Ruthelle Frank's case in Wisconsin (to name just a very few). All had simply been hoping to cast the same legal votes that they've been legally able to cast for decades --- until now.

All of this comes in the wake of Republican statehouse takeovers in 2010, after which they began to pass laws in dozens of states designed to suppress the votes of the elderly, minorities, and students, who tend to disproportionately vote for Democrats and who disproportionately lack the specific type of state-issued Photo ID now required at the polling place in order to cast their vote.

Expect to see many more such stories in the weeks and months ahead, as those of us who believe in the right to vote actually fight to assure that right may exist again some day for all constitutionally legal voters.

In the meantime, at least there was a bit of good news late last week, as the U.S. Dept. of Justice denied approval of the South Carolina GOP's new disenfranchising polling place Photo ID restriction law, finding that it would lead to racial disparity among voters, according to the state's own statistics.

That bit of encouraging news came about just after the Charlie White, the Republican Sec. of State of Indiana (the first state to institute draconian polling place Photo ID restrictions in 2008), was ordered removed from office by a Circuit Court Judge in the wake of a finding that White was illegally on the ballot in 2010, having committed voter fraud by registering to vote at a residence where he didn't actually live.

Curiously enough, however, the actual case of voter fraud by White --- the state's chief election officer, who is also facing seven criminal felony charges (three of them for voter fraud) --- was not stopped by Indiana's draconian polling place Photo ID law. Only 80 and 90-year old nuns, college students, and World War II vets, apparently, were denied their right to vote by the GOP's voter suppression laws in the Hoosier State, while scofflaws like their own Republican Sec. of State were allowed to vote (illegally) without incident.

No time to detail this one for the moment, as I'm preparing to guest host the nationally-syndicated Mike Malloy Show tonight, so I'll just link to TPM's breaking coverage for the moment. I'll almost certainly have more to say on this on the show tonight, but for now, it looks like we've got still more good news this Christmas!

The Dept. of Justice has denied preclearance [PDF] of the South Carolina GOP's new polling place Photo ID restriction law, finding it was likely to disenfranchise voters, particularly minority voters, as "the state’s own statistics demonstrated that the photo identification requirement would have a much greater impact on non-white residents, DOJ said in a letter to the state on Friday," according to TPM.

The racial disparity seen by the DoJ is similar to the hardships, from such laws, to students and elderly voters (you know, the ones who tend to vote for Democrats, which is why the GOP is instituting these voter suppression laws in the first place.)

The GOP has long used the lie about an an epidemic of "voter fraud" by voter impersonation at the polling place, though they have failed to document virtually any instances of it. Nonetheless, they've been using such false claims to institute these types of laws around the country after Republicans took over a number of state legislatures in 2010. States that are covered by Section 5 of the Voting Rights Act of 1965 must receive preclearance for such laws before they can be enacted, given the history of racism in the covered jurisdictions.

The BRAD BLOG's own crack legal analyst, Ernie Canning, detailed the concerns that the DoJ had about the disenfranchising affects of the law back in September, noting that they seemed to be signaling at the time that preclearance would be unlikely, given many serious flaws in the state law.

A final decision on DoJ preclearance is still pending in Texas where the agency has also indicated they are likely to reject the new Photo ID laws. Meanwhile, in states not covered by Section 5, such as Wisconsin, it's fallen to non-governmental organizations, such as the ACLU, to challenge the new laws in the court system, as they did earlier this month.

All of this follows on Indiana's first-in-the-nation Photo ID restriction law, approved by the U.S. Supreme Court in 2008. Ironically enough, yesterday in the Hoosier State, the Republican Secretary of State Charlie White, now facing seven criminal felony counts, including three of them for voter fraud, was ordered removed from his post by a circuit court judge who found he was not eligible to vote or be on the ballot at all in 2010. The judge has ordered White be replaced by the second-highest vote-getter, Democrat Vop Osili. Our coverage of that incredible "White Christmas" story is right here.

Election laws in Wisconsin are not covered by Section 5 of the federal Voting Rights Act, which would otherwise require the Dept. of Justice or a federal panel of judges to "preclear" such laws to assure they are not discriminatory. Thus, it falls to non-governmental organizations, such as the American Civil Liberties Union (ACLU), to take legal action in hopes of protecting Constitutional voting rights for citizens of the Badger State.

That's exactly what the organization did this week, in filing a 54-page federal complaint on behalf of some 17 named plaintiffs --- including elderly, student, minority and even veteran voters --- who may well be unable to cast their once-legal vote under the state's new voter suppression bill passed earlier this year by its GOP legislature and signed into law by its Republican Gov. Scott Walker.

The lead plaintiff in Frank vs. Walker [PDF], the ACLU's class action lawsuit filed in the U.S. District Court for the Eastern District, seeking to halt enforcement of the state's new photo ID voting restrictions, is 84-year old Ruthelle Frank.

As we previously reported, Frank has been a lawful resident of Brokaw, WI since her home birth in 1927. Although she has voted in every election since 1948 and is an elected member of the Brokaw Village Board, she learned that she may be barred from voting come February 2012 because she lacks one of the official photo IDs mandated by that state's new vote-suppressing photo ID law.

She was born at home, without a birth certificate, and will be forced to pay $20 to get one in order to get her supposedly "free" ID to vote. But even that may not be enough. Frank recently learned she may not be able to comply with the state GOP's Photo ID restriction unless she coughs up upwards of $200 to amend the Register of Deeds record of her home, which had misspelled her maiden name.

The feisty octogenarian, however, was not about to quietly accept this assault on a right she had exercised without interference for the past 63 years (see a video interview with her below), and so she agreed to lead the ACLU suit.

The ACLU complaint, however, may serve to be larger than just the 17 voters (and thousands of others included as part of 6 different classes) in the state of Wisconsin. If it succeeds, the lawsuit could have national implications that would go well beyond the question of who gets to vote in Wisconsin in the 2012 Presidential election. I don't have time today to thoroughly debunk all the reprehensible, anti-democratic, anti-American horseshit hurled by this FL State Rep. Dennis Baxley --- the original sponsor of Florida's new voter suppression laws, limiting early voting hours and imposing new big government regulations and huge fines against voter registration workers --- as seen in the following interview on Al Sharpton's Politics Nation show on MSNBC this week.

Fortunately, most readers of The BRAD BLOG will be able to smell the bullshit of the smirking, democracy-hating Baxley a mile away even without my point-by-point rebuttal. So I'll just run the video here for now without much comment, as it needs to be seen to be believed.

Near the front of the interview, Baxley admits that there's been no voter fraud problem in FL, and by the end he's charging (without a stitch of evidence, naturally) that the non-partisan League of Women Voters, who have been registering voters in the Sunshine State for some 72 years --- but who have now canceled their registration program for 2012 thanks to the onerous new GOP restrictions and fines on registration workers --- is actually a partisan Democratic organization! Who knew?

My loathing towards those who knowingly undermine American democracy is difficult to contain. So consider my restraint today an undeserved favor to you this afternoon, Mr. Baxley.


Oh, and for good measure, here's some info on some Florida school teachers recently arrested and/or charged for registering students to vote in apparent violation of Baxley's new anti-voting laws!

One thing I'm happy to see this year at least: MSNBC has been covering the GOP War on Voting --- at least the front-end war, the part in which Republicans are trying to keep millions of legal voters from being able to cast their legal vote at all --- very well this cycle, on many of their shows. Hopefully they'll soon begin covering concerns about the accuracy and transparency of the vote count itself, at least the vote counts of those who find themselves able to cast a vote in 2012, in any case.

Under new laws, third parties who want to help register voters could face $5,000 fines, a third degree felony and up to 5 years in prison if they violate any of the broad provisions noted in the legal paperwork.

For 63 years, Brokaw, Wisconsin native Ruthelle Frank went to the polls to vote. Though paralyzed on her left side since birth, the 84-year-old “fiery woman” voted in every election since 1948 and even got elected herself as a member of the Brokaw Village Board. But because of the state’s new voter ID law, 2012 will be the first year Frank can’t vote. Born after a difficult birth at her home in 1927, Frank never received an official birth certificate. Her mother recorded it in her family Bible and Frank has a certification of baptism from a few months later, along with a Social Security card, a Medicare statement, and a checkbook. But without the official document, she can’t secure the state ID card that the new law requires to vote next year.

“It’s really crazy,” she added. “I’ve got all this proof. You mean to tell me that I’m not a U.S. citizen?” But state officials have informed Frank that, because the state Register of Deeds does have a record of her birth, they can issue her a new birth certificate — for a fee. And because of a spelling error, that fee may be as high as $200

Add Frank's to the stories of 96-year old Dorothy Cooper in TN who has voted in every election since woman were granted the right to vote, but who no longer may be able to cast her vote on Election Day next year, and 86-year old WWII veteran Darwin Sparks in the same state; along with hundreds of thousands of others who are likely to find themselves unable to cast their legal vote on Election Day next year thanks to new voter suppression laws implemented in about a dozen states by GOP legislatures and governor's since they took control in 2010.

In Wisconsin, where "an estimated 177,399 Wisconsin residents 65 and older do not have a driver’s license or state photo ID — 23 percent of that population," and where Frank may have to pay as much as $200 to cast her legal vote under the GOP's new anti-democratic and anti-Democratic polling place Photo ID restrictions, the non-partisan League of Women Voters has filed suit charging the law is in violation of the state's constitution, as The BRAD BLOG detailed in October. That case is still pending.

Meanwhile, the Republican War on Democracy continues apace.

Happily, Rachel Maddow brings us up to date on the latest in the GOP's out-and-out assault on voting and voting rights in states all over the country. The new laws passed by GOP-controlled legislatures in the wake of their 2010 electoral victories, are expected to have a wildly disproportionate disenfranchising affect on voters who tend to vote Democratic, and are likely to make voting much more difficult for some 5 million Americans, according to a new study from NYU's Brennan Center for Justice.

Apparently, Republicans must be convinced, for some reason, that they can't win elections in a fair fight. Wonder why.

Maddow's latest maddening update includes an interview with the Republican Supervisor of Elections in Volusia County, FL who was "sick to her stomach" after being forced to turn in a high school teacher to law enforcement for registering students to vote now that Florida has criminalized such activities. And, no, we're not exaggerating. That is the same new FL GOP law which has led the non-partisan League of Women Voters to cancel all voter registration in the state of Florida, after doing so for the past 72 years, because the potential penalties for doing so have simply become too onerous....

The League of Women Voters sued on Thursday to block a new Wisconsin law requiring voters to present identification such as a drivers license at polling places, saying it would disenfranchise eligible voters.

The lawsuit, filed in Dane County Circuit Court, argues the state constitution allows only convicted felons and the mentally incompetent to be excluded from voting.

The new law creates a third class of people, those who do not have ID, said Andrea Kaminski, Wisconsin League of Women Voters Executive Director. Critics of the law say it would mainly affect minorities and the elderly, who may not have ID.

Not mentioned in the Reuters article is the effect the law is likely to have on student voters, as most WI student IDs have been disallowed for use as voting identification at the polling place, though some of those restrictions are being challenged via the WI Government Accountability Board (G.A.B.), the state's top election authority, which is interpreting the new measure.

Though the WI bill that was jammed through the state legislature by the Republicans who control it and signed by Gov. Scott Walker (R) allows for voters to receive "free" Photo ID at state DMV offices, many of the state's office are infrequently open, and some voters have documented difficulties in obtaining the free IDs even where they were able to take time from work or school and find a way to get to the DMV to go through the tedious process.

In July we reported on the story of a new voter whose residency was challenged after DMV officials rifled through his bank statement to determine whether there had been enough "activity" in the bank account to assure his residency. We also reported in the same story that state officials had explicitly instructed DMV workers to not notify applicants that their ID would be given to them for free, unless they specifically asked for it for the express purpose of voting. Otherwise, a $28 fee would be assessed on top of any costs incurred by the applicant, such as purchasing a copy of their birth certificate or passport or making their way to the DMV.

Kristina Boardman, Director of WisDOT's Bureau of Field Services explained to The BRAD BLOG at the time that the reason they've instructed DMV staffers to not ask applicants if the ID is to be used for voting purposes is because "the statutory language specifically puts the onus on the customer for getting the ID for free for voting."

The frustrating experience of the hopeful voter at the DMV was documented in a video tape recorded during the process which we posted along with our story.

As we also detailed previously, a 2005 study [PDF] by the University of Wisconsin-Milwaukee's Employment and Training Institute found that Democratic-leaning voters such as the elderly, ethnic minorities and college students are likely to be hit much harder by the new law than middle and upper-class white voters...

Venango County's Craig Adams says candidates reported to have received ZERO votes on ES&S voting machines in 2008 election...

Last week we wrote about Venango County, PA's landmark independent forensic audit of their 100% unverifiable ES&S iVotronic touch-screen voting machines. The heavily-Republican county will be moving to paper ballots this November, as their systems are now being examined by computer scientists from Carnegie Mellon University following what Marybeth Kuznik of the non-partisan Election Integrity group VotePA.us described to us as "numerous reports of vote-flipping, candidates missing from screens, write-ins missing, and high undervote rates in their May 17 Primary."

In our coverage last week, we highlighted the comments of Venango's Republican Election Director Craig Adams who asked at a presser, as the examination finally got underway following months of legal wrangling and opposition, "What is a vote worth?"

"If the vote is counted it is priceless," he continued. "If it is not counted, I don't care what it costs. Let's get a right."

On Friday night, as I was guest hosting the nationally-syndicated Mike Malloy Show last week, Adams was kind enough to call in to the show. [Audio posted below.] We didn't know we'd hear from him, but when he called in I was delighted to take his call, as he had more information to share on what had led to his Election Board --- currently comprised of two Republicans and one Democrat --- fighting together to move to paper ballots, and to see their machines independently examined.

"It started with an election in 2008 when the machines were basically showing a large number of undervotes," he explained. "And then there were candidates for positions in the county and they had zero votes, but there was like 250 or 260 undervotes..."

"Wait a minute," I interrupted. "There were people who had zero votes on the ballot? Is that normal?," I asked.

"No. No, it is not normal," he responded bluntly. "And so, ya know, that was a red flag"...
