From Democracy Now!...

Beginning in October, the Army plans to station an active unit inside the United States for the first time to serve as an on-call federal response in times of emergency. The 3rd Infantry Division’s 1st Brigade Combat Team has spent thirty-five of the last sixty months in Iraq, but now the unit is training for domestic operations. The unit will soon be under the day-to-day control of US Army North, the Army service component of Northern Command. The Army Times reports this new mission marks the first time an active unit has been given a dedicated assignment to Northern Command. The paper says the Army unit may be called upon to help with civil unrest and crowd control. The soldiers are learning to use so-called nonlethal weapons designed to subdue unruly or dangerous individuals and crowds.

The report from Army Times is certainly troubling, given the timing and the Constitution-hating evil-doers still allowed by Congress to continue holding the reins of our military. Back in 2005, an AP report headlined: "Bush: Boost military role in domestic emergencies" discussed the Constitutional issues that would block such domestic deployments of the U.S. military. Guess they got that all worked out? Or Bush just decided that following (and defending) the Constitution is a bit too quaint for him at this point in his failed "Presidency".

The brigade, according to the report, will be "known for the next year as...Consequence Management Response Force." Rest easy, kids!

The wealth of material on Sen. John McCain's Veep pick, Alaska Gov. Sarah Palin, just keeps getting richer. Apparently the old saying that you can never be too rich or too thin applies to resumes.

Last night, Brad covered a wide-range of recently emerging issues and concerns about Palin --- and McCain's judgment in having chosen her --- and asked whether she can even survive on the ticket through November 4th. Today, the New York Times front pages an Elisabeth Bumiller report revealing that McCain seems to have only begun vetting Palin last week, after his two preferred selections, pro-choice advocates Sen. Joe Lieberman and Gov. Mark Ridge, were nixed by the party's right wing.

So as Republicans scramble to vet their choice far too late, additional revelations continue to emerge (notably, beginning in the blogosphere, long before the MSM finally catches up.) The latest latest comes via Liz Arnett at Daily Kos, and includes videos in which the Alaska governor is seen as a member and supporter of the fringe Alaskan Independence Party (AIP), which aspires to secession from the union.

Steve Benen regards this latest information about Palin's past as perhaps "the most politically detrimental" of all the recently emerging discoveries about the little-known-until-now Governor of Alaska...

Following up on Jon Ponder's earlier coverage of the latest Impeachment machinations --- with a date now set for some kind of hearings in the House Judiary Committee on July 25th and even several Republicans breaking ranks to vote in support of accountability --- a statement this week from Rep. Dennis Kucinich (D-OH) pretty much nails the entire matter, at least the most obvious, in one fell paragraph as reported at RAW STORY:


"Our Constitution is being destroyed. We are losing our nation to a war based on lies. I am determined to get this bill to committee for a hearing," he said. "The President has conducted the affairs of the nation in a manner which cries out for justice and it is the Constitutional obligation of Congress to check his wanton abuses of U.S. and international law. We have troops whose lives were put on the line because the President told them Iraq was a threat to the United States and it was not. The loss of lives of our troops and of innocent Iraqi civilians is a direct result of the lies this president told to Congress. He must be held accountable."

House Speaker Says Judiciary Committee May 'Have Some Hearings on the Subject' as Kucinich Vows to File Yet Another Article Against George W. Bush

Perhaps impeachment won't die in the House Judiciary Committee after all, as Pelosi gently --- if tepidly --- seemed to put the topic back on the table, according to Politico today, (via RAW STORY):

Pelosi has said previously that impeachment "was off the table," so her comments this morning were surprising, and clearly signaled a new willingness to entertain the idea of ousting Bush, although no one in the Democratic leadership believes that is likely since the president has only six months left in this term.

"This is a Judiciary Committee matter, and I believe we will see some attention being paid to it by the Judiciary Committee," Pelosi told reporters. "Not necessarily taking up the articles of impeachment because that would have to be approved on the floor, but to have some hearings on the subject."

Pelosi added: "My expectation is that there will be some review of that in the committee."

Rep. Dennis Kucinich (D-OH) filed 35 Articles of Impeachment against George W. Bush in June. Those articles, like the ones before them against Dick Cheney, were referred to House Judiciary where action has yet to be taken on them. Yesterday, Kucinich announced that he will introduce yet another Article today, on Bush lying the country into war, in a privileged resolution on the House floor.

This morning, his office announced the new article will be filed between 3:30 and 4:00pm ET today. They are asking the public to sign their petition calling on Congress to take action on the matter.

DISCLOSURE: The BRAD BLOG was consulted by Kucinich concerning the Bush Articles of Impeachment. The information submitted was included in Article 28, "Tampering with Free and Fair Elections" and Article 29, "Conspiracy to Violate the Voting Rights Act of 1965" of the original 35 Articles filed last month against Bush.

Dem Leadership Tout Law's New 'Exclusivity' Provision, But None of Three Dems I Tried to Contact Can Adequately Explain Why They're Not Being Fooled Again...

House Majority Leader Rep. Steny Hoyer, (D-MD), one of the new FISA bill's strongest champions, spoke about the bill's new "exclusivity provision" on the floor of the House on March 14, 2008. He proclaimed that "It clarifies that FISA is the exclusive means of conducting surveillance in the United States for foreign intelligence purposes."

On June 20, Hoyer optimistically echoed his previous comment: "This legislation makes clear that FISA is the exclusive means by which the government may conduct surveillance."

Sen. Dianne Feinstein, (D-CA), in an email sent to some constituents, including myself, wrote that the new FISA bill: "Includes provisions I authored that make clear that FISA is the exclusive (or only) authority for conducting surveillance inside the United States...FISA would be the only legal authority for conducting surveillance on Americans for intelligence purposes..."

But the old FISA bill, which was the law when Bush began to spy on us without warrants, also had an "exclusivity" provision that stated:

[P]rocedures in this chapter or chapter 121 and the Foreign Intelligence Surveillance Act of 1978 shall be the exclusive means by which electronic surveillance, as defined in section 101 of such Act, and the interception of domestic wire, oral, and electronic communications may be conducted.

Since the "President" ignored the old FISA law, despite its existing exclusivity provision, what makes Hoyer or Feinstein or any of the other Dems think he'll bother to obey the new version of the law?

The existing law didn't keep Bush from breaking it last time, so it's beyond me what makes law makers think he won't do the same this time around. I decided to contact three different Democratic officials, all in favor of the new law, to try and find out why they believe they won't be fooled again...

Ohio Congressman Says He'll Bring More Co-Cosponsors; Promises 'We'll Come Back with 60 Articles, Not 35'

Dennis Kucinich, the Ohio Congressman and former 2008 Democratic Presidential candidate, said he would continue to introduce resolutions calling for the removal of President George W. Bush from office if the articles of impeachment against Bush that he presented to the House Monday is not taken up within 30 days.

Congressman Robert Wexler, (D-Fla.), agreed to co-sponsor of the measure Tuesday.

Congress voted 251-166 Wednesday to send the articles of impeachment to a House Judiciary Committee for review where it's expected to die.

But Kucinich said if that happens he will just introduce another resolution until lawmakers vote on the measure.

"Leadership wants to bury it, but this is one resolution that will be coming back from the dead," Kucinich told the Washington Post Wednesday. "Thirty days from now, if there is no action, I will be bringing the resolution up again, and I won't be the only one reading it. We'll come back and many of us will be reading this [on the House floor], and we'll come back with 60 articles, not 35."

Rep. Dennis Kucinich (D-OH) is currently reading all 35 Articles of Impeachment, against George W. Bush, on the floor of the House of Representatives.

UPDATE: Now back home, and watching Kucinich myself on C-SPAN. He's been reading for hours, and may have hours ahead still. As mentioned on the air, I was consulted for these Articles of Impeachment and submitted a number of suggestions and material concerning impeachable offenses related to election tampering by George W. Bush and his agents. Don't know whether those articles are still in the final version. We shall see. But I wanted to be sure to disclose that.

No doubt we'll be talking about this tomorrow on the PBC Show (which I'm Guest Hosting all week). We're trying to get Kucinich for tomorrow's show...if he still has any voice left.

FURTHER UPDATE: Looks like the election-related Articles of Impeachment made it into the final version, including a mention of GOP "voter fraud" sheister Mark F. "Thor" Hearne of front-group American Center for Voting Rights (ACVR). Nice to see Hearne get the recognition on the floor of the U.S. Congress that he so richly deserves.

STILL MORE: Reuters coverage notes Kucinich "defied his party leadership" in filing. AP incorrectly writes:

Kucinich introduced a resolution last year to impeach Vice President Dick Cheney. That resolution was killed, but only after Republicans initially voted in favor of taking up the measure to force a debate.

In fact, his Articles of Impeachment against Dick Cheney were not "killed," they were sent to the House Judiciary Committee, where they remain without action having been taken on them by the Dem leadership, despite best efforts by folks like Rep. Robert Wexler (D-FL), and others.

POST-ADJOURNMENT UPDATE: Just prior to midnight ET, Kucinich finally finished reading the list of High Crimes and Misdemeanors. Equal Justice Society writes:

"We've waited seven years to find one Member of Congress brave enough to stand up for our Constitution, for which generations of Americans have fought and died," said Bob Fertik, President of Democrats.com. "We are thrilled and honored that Dennis Kucinich has chosen to be that one genuine patriot. We congratulate him on his historic leadership, and pledge to do everything in our power to persuade Congress to adopt all 35 Articles and put George W. Bush on trial before the Senate of the United States, exactly as the Founding Fathers wanted."

"Some might question why Congressman Kucinich has done this now," continued Fertik. "My question is why 434 other Congress Members have not done it before. Despite the uncountable and unspeakable crimes this administration has committed, George Bush and Dick Cheney remain in power and immune from prosecution. You're a Great American, Thor Hearne...

The parade of disenfranchised and/or soon-to-be-disenfranchised elderly, nuns, U.S. veterans (even those disabled in Iraq and Afghanistan), hurricane victims, and other Democratic-leaning voters continues this week, following the recent Supreme Court decision to allow the disenfranchisement of thousands of such (previously) legal voters in Indiana.

While much of the coverage --- such as today's report by Art Levine at HuffPo --- has been intelligent and serious, the New York Times took the lazy way out in a front page story today, lending credence to the discredited GOP "voter fraud" huckster, Mark F. "Thor" Hearne, with quotes and reference to his defunct, sham organization, The American Center for Voting Rights (ACVR).

Writing about him and it, as if he were legit, and as if the ACVR were still in operation, the article's author, Ian Urbina --- who has written very good reports in the past --- didn't bother to mention the controversy surrounding Hearne and his group, that they had disappeared themselves under the glare of the U.S. Attorney Purge scandal, that they had lied on federal tax forms claiming that the group had not "attempted to influence national, state, or local legislation, including any attempt to influence public opinion on a legislative matter or referendum" (fraudulent tax form here), that Hearne himself has been behind every step of the systematic and dishonest scheme to get laws of this sort on the books across the country, and finally, Urbina didn't even bother to note that Hearne had been the national general counsel to Bush/Cheney '04 Inc. and remains the top election lawyer for the Republican National Lawyer's Association.

It's all easy to find, of course. We've even set up a Special Coverage page at https://BradBlog.com/ACVR so folks like Urbina --- and NPR who similarly quoted Hearne as if he were legit recently --- wouldn't have to look too far.

But darn that "liberal media" again. For the record, we sought comment from Urbina, who we've been a source for in the past, and who has done good work over the years, but he declined to comment on our criticism here.

In the days immediately following the horrible SCOTUS decision, we quickly turned to our old home state of Missouri, where the huckster Hearne has been basing his well-funded voter suppression operation on behalf of the White House and the RNC for years, going back at least as far as the moment we originally outed him in 2005 just after he had created the not "non-partisan," tax-exempt front group, ACVR, and testified just days later at a Congressional hearing, led by Ohio's felonious Rep. Bob Ney. Hearne told of fraud having been committed in Ohio in 2004, but by John Kerry's campaign, after Hearne described himself to legislatures only as a "longtime advocate of voter rights and an attorney experienced in election law."

We called on MO's Sec. of State Robin Carnahan for an exclusive interview, while we were hosting KPFK's "Special Election Year Coverage" last week (audio here), and took the opportunity to inform her, if she didn't already know, that Hearne's group lied on his federal tax form, and has, to this day, illegally failed to discose the source of his group's $1 million in start-up funding.

Our interview with Carnahan took place even as Missouri's Republican legislature was in mid-debate on the House floor about a new state Constitutional Amendment to require proof of citizenship in order to register to vote and for a similarly draconian Photo ID requirement as those approved by the SCOTUS for the polling places in the Hoosier State.

Kansas City Star reporter Dave Helling noticed our interview with Carnahan, and wrote a quick item about it, noting her characterization of these anti-voter efforts as "absurd," and alleging that she has not been quite as available to "reporters in the state"...

Appearing yesterday on the radio with well-known voting machine critic and blogger Brad Friedman, Secretary of State Robin Carnahan called the push for photo ID "absurd."

(Carnahan's discussion --- by telephone --- was rare. Her office usually refuses to make her available for questions from reporters in the state.)

...But whether the MO SoS has been available to Helling or not, she has been making quite a bit of noise ever since, concerning what a study by her office has found to be some 240,000 largely Democrati-leaning voters in the Show-Me State who would be disenfranchised by the Republican law as she explained to us on air.

Meanwhile, over in Arizona, a law that has already made it on to the books will similarly be keeping legal Americans from casting their legal votes this year.

Proposes 28th Amendment to US Constitution to Disallow Privatized Corporate Vote Counting in Secret, Standardize Nation's Voting Systems for 'Equal Protection'...

Yesterday The BRAD BLOG interviewed Byron DeLear who is running for Congress in Missouri's 2nd District. The current holder of the seat is the ultra-conservative war supporter and Bush crony, Todd Akin (R-MO), who last year infamously argued to keep sending reinforcements to Iraq by invoking Davy Crockett at the Alamo.

We found the intellectual DeLear, who supports the withdrawal of our troops from Iraq and the impeachment of Bush and Cheney, extremely knowledgeable on a wide range of issues including election integrity. DeLear even goes so far as to call for the 28th Amendment to the US Constitution to secure the vote.

Says DeLear during our exclusive interview...

"I talk about the necessity for the 28th Amendment to the US Constitution to be securing the most sacrosanct institution of our Republic which is the vote – the cornerstone of our democracy. And how is it that we can allow corporations to own the source code that instructs voting machines how to count the vote? How is it that in our supposedly popular and public owned electoral system can we have privatization occurring where the basic functions of our elections are in secret and are not available to the scrutiny of the American people?

"So I think the 28th Amendment to the US Constitution should be securing the vote, providing for independent verification of ballot results and I think we should explore the idea of perhaps standardizing the American voting experience. Because when you have 13,000 different methods of counting the vote littered across the landscape of our Republic – that essentially violates the essence of equal protection under the law. And I don’t think it’s fair that you can have African Americans waiting six hours in the rain in Ohio and then other people in other parts of the country just walk in and get their votes cast and there is no problem whatsoever.

"So we got to end this kind of unequal, unfair playing field that is occurring in regards to counting our votes and getting our voice heard."

I just finished a very lively late-night hour (actually 26 minutes with all the commercials removed, you're welcome) on San Francisco's KGO with Christine Craft. The discussion concerned the Supreme Court's outrageous ruling in the Indiana Photo ID restriction case, and my article yesterday detailing how difficult it now is to vote in Indiana if you don't happen to have one. Rights shmights.

The audio features plenty of wingnut callers who just don't get it, demonstrating why it's so damned difficult to fight off this out-and-out GOP voter suppression scam/assault on your democracy and Constitution. If it's this difficult in "liberal" SF (albeit, on "conservative" KGO), this nation is in big trouble. And, if the articles from the last few days here haven't made that clear, we are. Big time. This November is gonna be a nightmare. Big time.

VIDEO UPDATE: U.S. Named One of 'Top Five' Executioners with China, Iran, Pakistan, Saudi Arabia; Bush Kids Around With Pope: 'All human life is sacred'

Speaking of perverse discordance on the same day the Pope was serenaded with "The Battle Hymn of the Republic" at the White House (where Bush told him he gave an "awesome speech!"), the Supreme Court found that state-sponsored executions by lethal injection were just fine and dandy, as far as the U.S. Constitution was concerned.

The Supreme Court ruled yesterday that the most common method of lethal injection used to execute condemned prisoners is constitutional, a decision sure to restart the nation's dormant death chambers.

"Simply because an execution method may result in pain, either by accident or as an inescapable consequence of death, does not establish the sort of 'objectively intolerable risk of harm' that qualifies as cruel and unusual," wrote Chief Justice John G. Roberts Jr.

Roberts, of course, is Catholic. As are a total of 5 of the 9 justices now on the bench, 7 of whom gave the thumbs up to the continued use of a three-drug cocktail in order to kill citizens convicted of capital crimes. That, despite plaintiffs arguments that "if the first drug does not work, the second induces a 'terrifying, conscious paralysis' and the third causes an 'excruciating burning pain as it courses through the veins.'"

Of course, the Catholic Church strongly opposes all such state-sponsored executions. Yet all 5 of the Catholic justices joined the majority decision to end a temporary national moratorium on state-sponsored killing of criminals. All on the very same day the Pope came to D.C.

You'll forgive us then, if we see something --- yes --- perversely discordant in that. Again.


UPDATE 4/17/08: This morning, Democracy Now covered the Supremes' end to the de facto Death Penality Moratorium, noting that "the decision came one day after Amnesty International named the United States one of the top five executioners in the world, along with China, Iran, Pakistan, and Saudi Arabia."

Couldn't be prouder to be in such fine company. Good luck finding that AI stat --- reporting that of the 1200 people executed by governments last year, 88% of them occurred in those five countries alone --- in the American corporate media today.

No doubt, George W. Bush feels equally proud, even if we're not yet #1 in that area. And even though he said yesterday to the Pope, during the WH ceremony, as our own Alan Breslauer notes in the perversely discordant :38 second video at right: "In a world where some treat life as something to be debased and discarded, we need your message that all human life is sacred."

Bush was, of course, just kidding.

Jonathan Turley: It really is amazing because Congress, including the Democrats, have avoided any type of investigation into torture because they do not want to deal with the fact that the President ordered war crimes. But evidence keeps on coming out - the only thing we don’t have is a group picture with a detainee attached to electrical wires. I mean every time we see more evidence we have more and more high ranking people at the scene of this crime. And what you get from this is that this was a premeditated and carefully orchestrated torture program. Not torture, but a torture program.

Is this your America?

The long saught DoJ "Torture Memo" written by John Yoo, offering a defense to George W. Bush and his sadistic friends to order the torture, and even killing, of detainees, has finally been made available. Not by the DoJ to Congress as they'd long sought, but to the ACLU via a FOIA request. (Thank you, ACLU!)

Yoo's document is some 80 pages long, offering what he feels --- or what the Administration wanted him to feel --- is a reasonable legal defense for the use of torture, even where it is explicitly disallowed by international treaties to which the U.S. has signed on.

'One Small Step for Freedom of Speech,' Writes One Member of Cindy Sheehan's Courageous Band of Iraq War Protesters...

That's "one small step for freedom of speech," our friend Jesse Dyen writes to us this afternoon.

Dyen was arrested, along with a number of other freedom fighters who had the temerity to show up near Bush's "brush ranch" in Crawford, Texas, several years ago to protest against the war, only to be arrested (twice) by police enforcing an ordinance, passed by the locals after Cindy Sheehan's original stand there in the Summer of 2005, that no such protests on public lands were to be allowed.

Today, he writes to let us know that the guilty charges were overturned by an appellate court that decided [PDF] in favor of the U.S. Constitution, the First Amendment, and other quaint old notions such as those.

See below for Dyen's missive explaining what happened back then, and in the court decision today, to the courageous arrested "Prairie Dogs" (who happened to include legendary "Pentagon Papers" whistleblower Daniel Ellsberg, as well as a number of other notables), and a video made from one of our favorite songs, as written by Dyen, during the original historic tipping point moment in Crawford back in the Summer of 2005…

Apparently, it's just fine to break the law, as long as the economy is seen as being bad...

Democratic leaders and aides tell The Politico that pursuing the contempt citations in conjunction with the stimulus package would "step on their message" of bipartisanship.

“Right now, we’re focused on working in a bipartisan fashion on [the] stimulus,” House Majority Leader Steny H. Hoyer (D-MD) told Politico...

Seriously, we must remember to speak with Hoyer and Pelosi about this terrific bridge we've got for sale. We're certain they'd be interested.

And while there seems to be confusion in the Kucinich camp concerning the Election "Recount" in NH (more soon on that, hopefully), at least there's no confusion for Kucinich when it comes to what's going on in either the White House, or among his party's "leadership," according to the New York Times:

[T]oday Mr. Kucinich took to the floor to fire off his latest salvo at the Bush administration: his plans to introduce Articles of Impeachment against President Bush on Jan. 28 — the day of Mr. Bush’s State of the Union speech.

Accusing the administration of lying about the need for the war in Iraq, Mr. Kucinich said he did not need to hear the president’s
assessment. “We know the State of the Union,” he declared. “It’s a lie.”

He also fired a volley at House Speaker Nancy Pelosi of California who has maintained that impeaching Mr. Bush is not on the table for Congressional Democrats. “If impeachment is off the table,” Mr. Kucinich said, “truth is off the table. If truth is off the table then this body is living a lie.”

Yes, a lie. Some 935 of them to be exact-ish, on just one aspect of what the Kucinich Impeachment articles will detail.

As we reported last December, Kucinich has been preparing, for some time, to file Articles of Impeachment against George W. Bush. While the Democratic "Leadership" may not like the notion, it should come as welcome news to the country's few remaining admirers of the U.S. Constitution.
