Anti-Semitic email, threats sent to Mikey Weinstein, founder of Military Religious Freedom Foundation
Rifle sight contractor Trijicon reportedly describes group as 'not Christian'; MRFF responds with threat of possible legal action...
By Brad Friedman on 1/24/2010 8:42pm PT

And what they will never tell you on Fox "News," and probably not even on CNN or MSNBC, etc., is contained in the following three emails sent to Mikey Weinstein of the Nobel Prize-nominated Military Religious Freedom Foundation (MRFF), following an ABC News exposé last week on the bible verses that are encoded on the rifle scopes made by Trijicon, Inc., and used by our military serving in Iraq and Afghanistan.

The first disturbing email below is from a U.S. soldier who happens to be a Caucasian Muslim, horrified by the dangers of having such verse referenced on military equipment used in the Middle East, particularly in the event of capture. The soldier shares an appalling alleged account of his superior officer's description of the weapon as the "the Fire Arm of Jesus Christ." All the better, said the officer according to the soldier, than what they might have received, since "Uncle Sam had seen fit not to give us a 'pussy "Jewzzi" (combination of the word 'Jew' and Israeli made weapon "Uzi").'"

That account is then followed by two very short, anti-Semitic threats sent to Weinstein in regard to the same matter, following ABC's report. Moreover, a senior company executive is said to have described MRFF as "not Christian" to ABC, according to a letter threatening legal action sent to the company by the non-profit organization which counters that it's allied with thousands of Christian troops and organizations.

All three of the email missives are horrifying, though none of them are likely to receive the time of day in the bulk of the cowardly corporate media, where the real cause and effect of the Rightwing's modern day politicized religious agenda is rarely broached in any way, shape, or form...

'We the People' lose, 'You the Corporations' Win...
By Brad Friedman on 1/21/2010 11:00am PT

"The court's ruling threatens to undermine the integrity of elected institutions across the nation," wrote Justice John Paul Stevens in his dissenting opinion on today's U.S. Supreme Court ruling in Citizens United v. the Federal Election Commission, which will overturn decades of established campaign finance law.

"Threatens to"? That could be the understatement of the century. But this is what comes of not counting election results. We can thank, among a long list of others, John Kerry for having rolled over in Ohio in 2004.

In a 5 to 4 decision today, by an activist U.S. Supreme Court that actually requested to make a decision to hear this matter, despite the fact that the original case brought to them had little to do with their larger, most destructive finding, has decided that corporations may give as much money as they wish to federal election campaigns.

This would be 'Game Over,' folks, for those who believe in "We the People," rather than "We the Corporations," unless a movement like the one launched today at MoveToAmend.org (on which we are an original signer) can gain traction. You can (and must) join the call by signing on at FreeSpeechForPeople.org as well.

Some key quotes from today's ruling, which pretty much encapsulate the entire horrifying story:

In the majority opinion of the court, Justice Kennedy writes: "The Court has recognized that First Amendment protection extends to corporations."

Concurring, Chief Justice Roberts wrote of his fear that if the decision had gone the other way, "First Amendment rights could be confined to individuals, subverting the vibrant public discourse that is at the foundation of our democracy."

...And Justice Scalia, equating corporate money with free speech wrote "We should celebrate rather than condemn the addition of this speech to the public debate."

In dissent, Justice Stevens wrote "While American democracy is imperfect, few outside the majority of this Court would have thought its flaws included a dearth of corporate money in politics."

We will, no doubt have more on this soon (currently buried in a number of other items and still on road). In the meantime, we're sure the "grass roots" Tea Baggers, outraged by corporate money special interests, will be infuriated by this decision, light up new protests in every town in every state in the union, and demand that our country be returned to "We the People" as the founders envisioned.

Right?

Even those who supported Scott Brown overwhelmingly support 'public option'
Evidence counters GOP/media 'conventional wisdom' that Dems must pull even more punches...
By Brad Friedman on 1/20/2010 3:08pm PT

By way of offering a rather convincing counterpoint to Frank Schaeffer's editorial posted here earlier today, in which he asserted his opinion that Republican Scott Brown's reported win in MA last night for the U.S. Senate seat was the fault of "the ideological purist Left" who undermined Obama and the Democrats, a Research 2000 poll conducted last night after the election, surveying 500 Obama backers who voted in the Senate election and 500 backers who sat it out, would seem to suggest the exact opposite. (Much as almost all of you did in comments)...

My full coverage is now posted at Upstate NY's Right-leaning Gouverneur Times...
By Brad Friedman on 1/15/2010 11:35am PT

Since writing today's piece for Upstate New York's right-leaning Gouverneur Times, a new poll has come out this morning showing the Republican Scott Brown now leading the Democrat Martha Coakley by 4 points in the race for the U.S. Senate seat formerly held by a Democrat named Kennedy for nearly 60 years.

As of last night, when I filed the story with them, the latest survey from a Democratic-leaning pollster showed Coakley up by 8, though a day or two earlier, Republican Rasmussen had Brown down only by 2 points.

Suffice to say it's now officially "a toss-up," at least according to the Rothenberg Political Report, and to all the Dems and Reps now sweating out what was previously thought to have been an easy Democratic win.

With the 60th "filibuster-proof" Senate seat now hanging precariously in the balance, I'm sure you'll be delighted to hear that the winner will now be whoever Diebold declares it to be. The near-entirety of the state will vote next Tuesday on paper ballots to be counted by Diebold op-scan systems. The same ones used dubiously in the New Hampshire Primary in 2008, and the same ones notoriously hacked --- resulting in a flipped mock election --- in HBO's Emmy-nominated Hacking Democracy.

And to make matters even worse, the notorious LHS Associates --- the private company with the criminal background that has admitted to illegally tampering with memory cards during elections, and which has a Director of Sales and Marketing who embarrassed himself with obscene comments here at The BRAD BLOG some years ago, resulting in his being barred from CT by their Sec. of State --- sells and services almost all of MA's voting machines along with those in the rest of New England.

Read my detailed coverage of the entire sad affair over at Gouverneur Times today. And yes, here we go again...

'Election Verification Exit Poll' analysis show tallies of 'Marriage Equality Ban' off by 7.5%, as high as 17.7% in some L.A. precincts...
By Brad Friedman on 1/13/2010 4:45pm PT

In the November 2008 election, the tabulation of votes for California's Proposition 8 --- the controversial ballot measure which resulted in the repeal of marriage equality by, for the first time, amending the state's constitution to deny the rights of Californians --- was "probably corrupted".

That's the finding of a newly released study issued by a coalition of election integrity organizations, as based on their analysis of an Election Verification Exit Poll conducted in Los Angeles on the day of the 2008 general election. "An investigation is warranted," the study concludes, into the evidence which suggests a likelihood that either "fraud or gross errors" occurred in the tabulation of that specific ballot measure.

The complete 49-page study has now been released on a new website, WasProp8Straight.org.

The poll was conducted on Election Day by Election Defense Alliance, Protect California Ballots, and ElectionIntegrity.org and was designed and researched with the help of at least one well known exit pollster, Ken Warren of St. Louis University's The Warren Poll, for the express purpose of measuring the accuracy of the reported vote count. It functioned beautifully in general, by confirming the results of most of the issues and races on the ballot. On Proposition 4, for example, which concerned a similar hot-button issue --- parental notification for abortion --- polling results and official election results matched within 2%, well within the expected margin of error.

However, for Proposition 8 only, the official results varied from the Election Verification Exit Poll by an average of 7.75% in the 19 precincts polled. In some cases, the discrepancy was as high as 17.7%. That is, of course, far outside of the margin of expected error and certainly worthy of further investigation by officials.

The creators of the poll, along with the analysts of the results and the authors of the study, seem to have gone out of their way to preempt the usual reasons for questioning and/or dismissing the methodology and findings of such polls. For example, as noted in the group's press release [emphasis added]...

This just in. More Republican traditional family values...

John Michael Farren, who served as deputy counsel to President George W. Bush, has been charged with strangulation and attempted murder after allegedly choking his wife and beating her with a flashlight.

Police told the Associated Press that Farren attacked his wife at their New Canaan home Wednesday night, two days after she served him with divorce papers.

Remember, we must protect traditional marriage at all costs! Even for attempted Republican murderers and the recently twice-divorced Karl Rove, to whom we must give credit for at least having had the decency of not trying to murder either of his former wives (that we know of).

Furthermore, we hope they don't try to disbar Farren over this policy difference between him and his wife. Politicizing his belief that she should no longer be alive would just be wrong, set a very bad precedent for future administration attorneys, and put our nation at even greater danger from terrorism.

American Law Institute, 'only intellectually respectable support' for capital punishment system in U.S. abandons support for it...
By Brad Friedman on 1/6/2010 2:33pm PT

A bit of good-ish, encouraging news from out of an otherwise horrible year, from this week's New York Times...

Last fall, the American Law Institute, which created the intellectual framework for the modern capital justice system almost 50 years ago, pronounced its project a failure and walked away from it.

There were other important death penalty developments last year: the number of death sentences continued to fall, Ohio switched to a single chemical for lethal injections and New Mexico repealed its death penalty entirely. But not one of them was as significant as the institute’s move, which represents a tectonic shift in legal theory.

“The A.L.I. is important on a lot of topics,” said Franklin E. Zimring, a law professor at the University of California, Berkeley. “They were absolutely singular on this topic” — capital punishment — “because they were the only intellectually respectable support for the death penalty system in the United States.”
...
“It’s very bad news for the continued legitimacy of the death penalty,” Professor Zimring said.

Another Fox 'News', Bill O'Reilly, Glenn Beck viewer?...
By Brad Friedman on 12/24/2009 2:19pm PT

From AP today on the hostage stand-off that took place yesterday at a VA post office [emphasis added]:

"He was really down on the government," [Hostage Jimmy] Oliver told The Associated Press [about hostage-taker Warren "Gator" Taylor] on Thursday in an interview at his mother's floral shop. "About the government taking over the right to bear arms ... he was angry at the government over taxing us."

Now I wonder where Taylor could have gotten those completely-misinformed ideas?

Of course, as non-disinformed folks know, there have been no moves --- zero, not even a peep --- by the Democratic-controlled Congress or White House about taking away anybody's "right to bear arms," and taxes have been lowered, not raised, since Obama took office, for 95% of working families. Though you'd be hard-pressed to know that if you did nothing more than watch Fox "News" or listen to talk radio on the public airwaves.

In one sadly ironic note, the AP article adds...

UPDATE: NYTimes buries Story, gives last word to wingnuts...
By Brad Friedman on 12/22/2009 4:15pm PT

Earlier this month, a two-month independent investigation of ACORN, by former Massachusetts Attorney General Scott Harshbarger, found incidents of mismanagement, but no criminal wrongdoing by ACORN, the favorite whipping boy of Republican scammers such as Glenn Beck, Rush Limbaugh, Fox "News" and the GOP itself. That investigation (full report here [PDF]) also found that the "sting videos" used recently against ACORN were highly doctored and manipulated.

Of course, readers of The BRAD BLOG know the Republicans' entire, long, sad, anti-democratic (small "d" and large "d" both) campaign is based on little more than the fact that ACORN registers millions of legal low and middle income voters who tend to vote overwhelmingly Democratic (large "d") rather than Republican, and the GOP and their democracy-hating proxies will go to any lengths to keep those legal voters from exercising their legal franchise.

And today, once again, ACORN is cleared of wrongdoing vis a vis yet another independent investigation, this one by the Congressional Research Service [PDF], as noted in a press release from U.S. House Judiciary Chair John Conyers this afternoon (posted in full below).

Of most note to our readers, Conyers' statement points out what we've been pointing out - over and over and over again for years: "There were no instances of individuals who were allegedly registered to vote improperly by ACORN or its employees and who were reported 'attempting to vote at the polls.'" Who knew?! What a surprise! (At least to Fox "News" viewers, who probably won't hear about this report either.)

Also: "No instances were identified in which ACORN 'violated the terms of federal funding in the last five years.'"

And: "Recently enacted federal legislation to prohibit funding to ACORN raises significant constitutional concerns. The courts 'may have a sufficient basis' to conclude that the legislation 'violates the prohibition against bills of attainder.'" That finding is one that a federal judge also recently concurred with, when she issued an injunction earlier this month to keep the law from taking affect since ACORN had "been singled out by Congress for punishment that directly and immediately affects their ability to continue to obtain federal funding, in the absence of any judicial, or even administrative, process of adjudicating guilt."

Finally, according to today's report, Andrew "Drudge's Poodle" Breitbart's phony video-taped "sting operation" against ACORN may, itself, have violated the law in both California and Maryland, about which we might ironically recommend to prosecutors: "Capital punishment" for Andrew Breitbart!

The short press release from Conyers, announcing the new report's bullet points, follows below...

UPDATE: And coverage of the NYTimes burial of this report, now follows below it...

By Brad Friedman on 12/21/2009 8:40am PT

$636 billion for annual military spending was approved by the U.S. Senate over the weekend, with little more than a hiccup of debate from Republican "conservatives," not a peep from the Democrats, and even less coverage from the corporate mainstream media.

But $850 billion for 10 years of what is ostensibly meant to be health care reform for the health and welfare of American citizens --- all while reducing the budget deficit by $132 billion over that period, according to the CBO? "A budget buster!," shout the phony "conservatives" in the same Senate.

Anyway, there's your "American Values," in a two-part nutshell, from today's Republicans and the Democrats and corporate media who enable their madness as if it weren't so.

A Solution to the 'Progressive dilemma' in U.S. Electoral Politics...
By Ernest A. Canning on 12/20/2009 5:01pm PT

Guest editorial by Ernest A. Canning

There have been a few occasions during my 62 years when I heard something profound that stuck with me.

The year was 1969. I was attending a freshman college history class, shortly after returning from Vietnam, when my professor said:

If the American Right can be criticized for its insensitivity to the plight of the common man, the American Left can always be criticized for its inability to count.

His words came back to me as Brad Friedman and I simultaneously made guest appearances on Live from the Left Coast with Angie Coiro.

While the topic was Afghanistan, a concern emerged over the splintering of the Left as a product of what Coiro described as strident "rhetoric," such as the suggestion that President Obama was a "sell-out" or the announcement by Rep. Dennis Kucinich (D-OH) that he intended to introduce a privileged resolution to stop the "criminal enterprise" in Afghanistan. The concern was the potential for that "rhetoric" to adversely impact the Democratic Party in the 2010 and 2012 elections.

Unfortunately, in part due to technical difficulties they had on the show that night, I failed to adequately articulate my concerns, which go to the core of the Progressive dilemma in U.S. electoral politics....

Former AL Governor says same people working on his case even after Obama took office...
By Rebecca Abrahams on 12/18/2009 11:20am PT

Guest Blogged by Rebecca M. Abrahams

Two weeks ago Washington Post reported that U.S. District Judge Emmet G. Sullivan named federal prosecutor Henry Schuelke to investigate whether gross prosecutorial misconduct tainted the government's case against now-former Republican Senator Ted Stevens of Alaska. At issue, whether prosecutors withheld critical evidence from the defense or whether the case was improperly handled under pressure to meet deadlines.

US Attorney General Eric Holder, in a stunning move, threw out the government's corruption case against Stevens last April and issued the following statement:

After careful review, I have concluded that certain information should have been provided to the defense for use at trial. In light of this conclusion, and in consideration of the totality of the circumstances of this particular case, I have determined that it is in the interest of justice to dismiss the indictment and not proceed with a new trial.

Holder also relocated attorneys who worked on the case including William H. Welch II, who ran the Department's public integrity unit.

WaPo failed to report that William Welch is currently under criminal contempt of court for his role in the case against Stevens. Welch was also involved in the prosecution of former Alabama Governor Don Siegelman. Siegelman was convicted of bribery in 2006 and served nine months in prison before his release was ordered pending appeal.

Despite Welch's pending legal issues, his name continues to be listed on recent filings in Siegelman's case. Siegelman finds this "quite curious as he's been hot after my prosecution for a good long time now."

Aside from alleged governmental misconduct in the Siegelman case, there are paramount legal issues that have been recognized by 91 former State Attorneys General and a group of First Amendment law professors across the country. And yet, while the DOJ is making a point to review Republican cases, not one case against a Democrat has been completely overturned and, as Siegelman told me in a recent interview, he believes very little has changed at the department, other than the names "at the top"...
