Back during the 2012 election cycle, there were so many cases of voter fraud and voter registration fraud by Republicans --- even very very high profile ones --- that The BRAD BLOG found ourselves dubbing it the "Year of GOP Election Fraud".

Well, it looks like there were even more GOP vote fraudsters at work that year, including this amazing case just revealed by prosecutors from the contentious 2012 Wisconsin recall elections of Republican Gov. Scott Walker and a number of state Senators, as well as the incredibly close state Supreme Court race that became a proxy battle election between Walker supporters and opponents...

Who's really behind the failed November ballot scheme?

Here's a bit of good news for California voters for a change: an effort to place a measure on the November 2014 ballot that would have implemented polling place Photo ID restrictions on voting in the Golden State has failed to gather enough signatures to qualify.

Similar voting restrictions enacted by Republicans around the country have recently been found to be in violation of both the U.S. Constitution and the federal Voting Rights Act. See this recent federal court ruling in Wisconsin, for instance, or this state ruling in Pennsylvania.

Despite those recent blows and others to GOP efforts to implement such policies, the aborted effort in California, headed up by a shadowy organization calling itself GuardMyVote.org, would deny the right to vote to otherwise legal voters who failed to present very specific types of Photo ID at the polls, or a photocopy of same for absentee voters. The legislative language of the detailed 7-page initiative [PDF] would have required voters to present a Photo ID with an expiration date that, among other requirements, "was issued by the United States or the State of California (excluding public colleges and universities)."

Why state-issued Photo ID from public colleges and universities would not have been acceptable is not stated in the proposed measure, but similar GOP-enacted Photo ID restrictions in other states have been found by courts and academic studies alike to disproportionately discriminate against those who tend to vote Democratic, including minorities, the elderly, the poor and student voters.

Had the initiative made it onto the ballot and then been adopted by California voters, it would have taken effect on January 1, 2016, just in time for that year's Presidential election cycle. The failed effort may also prove to be a dodged bullet for Pete Peterson, the state's 2014 Republican nominee for Secretary of State who would have also been on the same ballot. Peterson managed to dodge some of The BRAD BLOG's specific questions about his position on such initiatives in "blue" California.

In a short search, the only names The BRAD BLOG has been able to find involved in the failed CA Photo ID measure appear to be two Rightwingers, though it's unlikely that either crafted the detailed legislative language of the proposal. The woman who submitted the initiative to the state identifies herself as a "conservative" talk radio host who broadcasts out of Palm Springs, even though, as the summary of the initiative [PDF] created by the state Legislative Analyst and Director of Finance found, the fiscal impact of the initiative was anything but conservative. The initiative, if adopted, would have included increased costs to state and local governments "potentially in the range of tens of millions of dollars per year" and required a potential increase in state funding of elections to the tune of "about $100 million," according to the legislative analysis.

The slick GuardMyVote.org webpage describes the group as a "pending" non-profit, non-partisan 501(c)4 social welfare organization. According to the site's "About Us" page: "Guard My Vote is a non-profit volunteer organization dedicated to protecting the integrity of the vote and the voter rights of all eligible California citizens, native born or naturalized."

The site accepts contributions but offers no information on exactly who they are, or who has funded either the initiative or the website. For all of their claims about "integrity," the site fails to list a single name or organization backing the initiative, so we had to do a bit of digging...

State GOP's voter suppression law working as designed; Why has DoJ not challenged it yet?...

Yesterday we covered the story of 93-year old Willie Mims, the African-American man who was turned away from the polling place in Alabama for lack of a Photo ID, after having voted successfully in nearly every election since WWII.

Mims had a drivers license, but it had expired. So, according to the polling place Photo ID restriction law enacted by state Republicans, even though Mims would have had his photo on it and even an address that matched his voter registration, he was not allowed to cast his vote during yesterday's primary election.

But Mims was hardly the only one who was kept from voting yesterday, under the first official statewide run of the AL GOP's polling place Photo ID law. (The law was passed in 2011, but didn't take effect until now, since the state was waiting for the U.S. Supreme Court to knock down the section of the Voting Rights Act that would likely have blocked the racially discriminatory statute from taking effect.)

Kay Campbell of AL.com shared this story yesterday of another long time voter who lost her right to vote thanks to the same law...

A Huntsville woman, 92, who has lived in the same house in Huntsville for 57 years and voted in every election since she was eligible, was turned away from the polls today because her driver's license expired nine months ago.

The voter, a great-grandmother to five, was deeply embarrassed by the whole incident and declined to talk directly with AL.com, but she gave her go-ahead for her neighbor, who took her to the polls, to relay the incident, with the provision that her name not be used.

The license had expired in August 2013. She had not renewed it because her eyesight is failing and she has made the tough decision to quit driving. But she thought since it was so recent, it would work. She uses it to cash checks and in other rare incidences when she is asked for an ID.

As we also noted yesterday, via MSNBC's Zachary Roth, Alabama has a loophole built into the law, which the NAACP Legal Defense fund describes [PDF] as "an illegal relic of the Jim Crow South". It allows a voter without the very specific state-issued Photo ID now required to cast a ballot, to vote anyway so long as two poll workers at the precinct can vouch for them.

Campbell reports that Libba Nicholson, the neighbor who drove the elderly woman to the polling place, "said that the woman in charge of the Help Desk asked the other poll workers if any of them recognized her - just one more verification would have done it, Nicholson said, but no one did."

First use of new GOP voting restriction in the state, while state Republicans offered $1,000 reward for evidence of voter fraud...

It was Primary Day in Alabama on Tuesday and the first time since passage of the law that the state's Republican-enacted polling place Photo ID restriction on voting has been in place. Sure enough, the voter suppression law was successful, as voters were immediately disenfranchised by the new restriction, according to Zach Roth at MSNBC...

Willie Mims, 93, showed up to vote at his polling place in Escambia County Tuesday morning for Alabama's primary elections. Mims, who is African-American, no longer drives, doesn't have a license, and has no other form of ID. As a result, he was turned away without voting. Mims wasn't even offered the chance to cast a provisional ballot, as the law requires in that situation.

Mims, as he explains in the video below, first voted back during WWII. He says he's voted in almost every election since then. Until now...

State Republicans' voter suppression law hitting its target
UPDATED: Media coverage finally results in voting ID for Ruby Barber...

Here is just one more of the hundreds of thousands of reasons that have led the U.S. Dept. of Justice to file suit against Texas Republicans' polling place Photo ID restriction law.

The same law had been previously blocked by the DoJ and again by a federal court under the federal Voting Rights Act, after the state's own data showed the law discriminated against racial minorities and others, while failing to deter actual voter fraud in the state.

But, literally minutes after SCOTUS gutted the heart of the Voting Rights Act last Summer, the section which was used to strike down the law previously, Texas Republicans announced their intention to re-enact the law which, of course, they knew to be discriminatory.

As the Waco Tribune reports, 92-year old Ruby Barber has tried, but has so far failed, to obtain one of those so-called "free" Photo IDs from the Texas Dept. of Public Safety (DPS), now that one is required for her to cast her legal vote this year, as she had for decades, until now, without a problem.

Barber's story is heartbreaking and maddening but, unfortunately, probably not entirely rare. The DoJ estimated, based on the state's supplied data when the federal agency blocked the law in 2012, "the total number of registered voters [in Texas] who lack a driver's license or personal identification card issued by DPS could range from 603,892 to 795,955."

Barber's driver's license expired in 2010 and she's now having difficulty locating "her nearly century-old birth certificate that she'd need to obtain a voter ID under a new state law." As the New York Daily News reports, the details of Barber's story and her fight to try and cast her vote are simply absurd...

Sacramento Bee does a lousy job of helping voters understand why that matters...

California is making it slightly more difficult for millionaires and billionaires like the Koch Brothers to secretly and fraudulently influence elections in the state.

As the Sacramento Bee tried to report it...

Nonprofit organizations that make political contributions in California will have to disclose more information about the source of their money under a law Gov. Jerry Brown signed Wednesday.

Senate Bill 27 was inspired by the 2012 ballot measure wars in California, when two out-of-state nonprofit groups poured $15 million into fighting Proposition 30 and supporting Proposition 32. Because of the groups' nonprofit status, they were not required to report where their donations originally came from, leading some to describe the contributions as "dark money."

"Leading some to describe"? It was dark money! The groups did not disclose who the donors were when they spent millions and millions of that dark money to try and fraudulently effect election outcomes in the state!

It was all money laundered through Koch Brothers front groups, as the SacBee failed to note for some reason, but as the Mercury News reported last year when the scheme finally came to light...

The Arkansas Supreme Court has tossed a ruling by a lower court judge who had found the state's Photo ID voting requirement to be in violation of the state Constitution. The high court did not, however, rule on the constitutionality of the law, finding only that Circuit Court Judge Tim Fox "erred" by going too far in his ruling, as the issue of the law's Constitutionality "was not properly before the circuit court."

Late last month we described Fox' decision [PDF], declaring the state's Republican-enacted Act 595 "null and void" and "unconstitutional in that it violates Articles 3, Section 1 and Article 3, Section 2 of the Arkansas Constitution."

Those sections of the state Constitution describe both the "Qualifications of Electors" as well as the "Right of Suffrage," stating that "Elections shall be free and equal. No power, civil or military, shall ever interfere to prevent the free exercise of the right of suffrage; nor shall any law be enacted whereby such right shall be impaired or forfeited, except for the commission of a felony, upon lawful conviction thereof"...

Over the weekend, fading Republican superstar, weapons-grade professional troll and GOP voter fraud queen Ann Coulter decided to join other Rightwingers in mocking the #BringBackOurGirls hashtag --- currently being used on Twitter to help raise awareness to the plight of hundreds of young school girls recently kidnapped by the Boko Haram terrorist group in Nigeria --- for her own obnoxious, partisan purposes.

Because, ya know, making fun of concern about kidnapped children who may be sold into slavery is always high-larious and a great way to exploit a partisan advantage before the U.S. mid-term elections!

Coulter's scheme, however, may have "backfired", as Caitlin Macneal explains at TPM, once Twitter got a hold of Coulter's tweeted photo and decided to use it against her.

Well, we thought we'd join the "fun" as well. So this morning we Tweeted our own modified version of Coulter's photo, and that new photo immediately began receiving dozens of Re-Tweets. So, perhaps it's also worth noting here for history...especially since it happens to be true...

Just over a week ago, The BRAD BLOG's legal analyst Ernie Canning posited that the decision by a federal court in Wisconsin to strike down that state's polling place Photo ID law could signal "the beginning of the end" for such disenfranchising, Republican-enacted laws around the nation.

Since that landmark ruling in the Badger State, new signs from top elected Republican officials in Pennsylvania and Iowa, and even in Wisconsin, suggest that the (at least) decade-long GOP "voter fraud" fraud may have finally peaked, and will now begin the inevitably long slide into abandoned, historical shame.

We don't want to be too quick to declare the demise of this insidious attempt at reviving Jim Crow with a sophisticated and nefariously misleading legal patina, but after covering this beat for a decade --- long before much of the general public, much less the Democratic Party itself, seemed to notice --- it seems that the recent landmark court ruling in WI, followed by last week's towel toss in Pennsylvania and embarrassing revelations in Iowa, may be seen in the not-too-distant future as the moment that the GOP "voter fraud" fraud finally began to permanently unravel...

Finds Republican restrictions on voting violate both the U.S. Constitution and Section 2 of the Voting Rights Act...

Very big news out of a federal court in Wisconsin today, where the state's polling place Photo ID law (Act 23) has now been struck down as both a violation of the federal Constitutional as well as under Section 2 of the Voting Rights Act.

While similar laws, all enacted by Republicans, have been struck down by state courts before --- indeed, Wisconsin's, was already found in violation of the state constitution in state court --- and in federal courts under Section 5 of the Voting Rights Act, today's ruling is the first to strike down such a law under Section 2 of the VRA.

The landmark ruling will almost certainly have national implications for federal challenges in other states against similar restrictions recently enacted by Republicans.

Last summer, the U.S. Supreme Court gutted the heart of the VRA by making Section 5 unenforceable until Congress passes new legislation to determine which jurisdictions must pre-clear new elections laws with the U.S. Dept. of Justice before they are put into effect, due to a history of racial discrimination in elections in those jurisdictions. Section 2, however, bars discrimination in all 50 states, even though, unlike Section 5, it cannot be applied until after the new law in question goes into effect.

Judge Lynn Adelman's ruling [PDF] today, finding WI's version of the law discriminatory and in violation of both Section 2 and the 14th Amendment of the federal Constitution, is likely to have an impact on federal challenges to similar laws in states such as Texas and North Carolina, where federal cases are pending to block similarly discriminatory polling place restrictions.

Moreover, the judge placed the racial and class discrimination and disenfranchisement that would be caused by this law in stark terms, in regard to how many otherwise legal voters in Wisconsin might lose their right to vote, and how such a law might have directly affected the results of the state's 2010 election, had it been place at the time...

Democrat Derek Cressman fights for sunshine among a weak slate of candidates to oversee elections in nation's most populous state...

He makes a very cute campaign video. Please watch it above. It's quite clever. But it would be nice if California Secretary of State candidate Derek Cressman, one of two Democratic candidates vying for the job in the upcoming June 3rd primary, had a better understanding of the electronic voting systems he'd be overseeing as SoS.

I had originally intended to run the video above, because it's smart and fun, along with a throw-away remark expressing the wish that Cressman understood more about the very technical concerns about the security and verifiable of e-voting system --- particularly since the way CA deals with them has such a sweeping effect on the same systems as used across the country.

As a former Common Cause executive, Cressman has made his important fight to overturn the Supreme Court's abhorrent Citizens United ruling central to his campaign, as highlighted in the animated campaign video above. That's fine, but the office of Sec. of State, particularly in CA, requires much more.

Rather than offer that throw-away remark, however, I thought I'd see if Cressman had learned more about electronic voting systems since he and I briefly chatted in person at an event last summer, just as he was originally entering the race.

According to comments he sent in response to a recent query from The BRAD BLOG, while Cressman's general knowledge of the systems seems to have improved since we last spoke, and while he remains an ardent opponent of the madness of Internet Voting and some of the most unsecure methods of precinct-based voting, his understanding of the concerns about the vulnerability of e-voting remains troubling --- at least for a Sec. of State candidate in the nation's most populous state...

Says 'not willing to defend them anymore, I'm embarrassed by this'
Accuses colleagues of 'trying to suppress the vote'...

Last week we told you how Wisconsin's Republican Gov. Scott Walker considers implementing a polling place Photo ID restriction in his state to be so "pressing" that he would call a special session of the state legislature to do it. He says it's the only such matter "pressing" enough to merit such extraordinary action this year, in advance of the November 2014 election --- when Walker himself, just coincidentally, faces a very tight re-election race.

That, despite the fact that two state courts have already found the Republicans' existing polling place Photo ID voter restriction law to be a violation of the state constitution and that expert testimony during one of the two trials detailed how there is only one single known case of voter impersonation fraud in WI over the past 10 years that might have possibly been deterred by such a law. At the same time, tens of thousands of perfectly legal voters will likely be barred from voting under such a law.The state Supreme Court is currently deciding on the state's appeal to the lower courts' rulings.

Republicans pretend that implementing such a law is not about voter suppression, but now at least one of them, to his great credit, strongly and loudly disagrees.

This week, Republican state Sen. Dale Schultz accused his own party of "trying to suppress the vote" and said that he is "not willing to defend them anymore. I'm just not and I'm embarrassed by this."

Schultz also decried the current WI GOP effort to suppress the vote --- one which would likely effect many elderly as well as minority and student voters --- as an insult to veterans, calling it "a slap in the face at the very least to some of the people who gave some of the most vital years of their life in the service of their country"...
